01. ANNUAL CONSOLIDATED ACCOUNTS : 2013-14

To consider and approve the Annual Consolidated Accounts for the year 2013-14. Connected papers are placed on the table.

03. GRANT OF DEARNESS ALLOWANCE TO CANTONMENT FUND SERVANTS. To consider grant of Dearness Allowance to Cantonment Fund Servants w.e.f. 01.05.2014 @ 10% on Basic Pay + Grade Pay as per Govt. of Maharashtra vide their Finance Department Resolution No.

माभाव-1112/Pra.Kra.12/Seva 9 dated 07.05.2013 have increased

the rate of DA to its employees and Pensioners also. A copy of GR enclosed. Note : The increase in the rate of DA is applicable to the Cantonment Board Employees and Pensioner under the provision of memorandum of settlement dated 13.05.1969. The financial implication will be Rs.16,53,470/- p.m. approx. Budget provision will be made in the Budget Estimates 2014-2015 (Revised).

04. GRANT OF TRANSPORT ALLOWANCE TO CANTONMENT FUND

SERVANTS. To consider grant of Transport Allowance to the employees of the

Board w.e.f. 01.04.2014. The Government of Maharashtra vide Finance Department Resolution No. Vahabha-2014/Pra.Kra.5/Seva 5 dated 03.06.2014 have resolved to grant TPT to the employees as per the rates mentioned below :-

RESOLUTION NO. 4 : Considered. The Chief Accountant brought to the notice of the Board that there is a typographical error in the rates of Old Transport Allowance as shown in the agenda side. Board noted the same and resolved to approve the grant of Transport Allowance to the employees of the Board w.e.f. 01.04.2014 as under and necessary sanction of the Competent Authority be obtained.

05. PAYMENT OF ARREARS OF SIXTH PAY COMMISSION

Reference Government of Maharashtra Finance Department Resolution No. VPR-1209/PK/20/SER-9 dated 27.02.2009. To consider the question of disbursement of VIth Pay Arrears alongwith interest to the employees of the Board in cash. The total arrears amounts to Rs. 6.98 crores for five years and interest amount is Rs. 1.46 crores. Connected papers are placed on the table.

Note : Vide above referred GR VIth Pay Commission was granted to all the employees of this Board. As per the G.R. the arrears on account of Pay and Allowances are to be credited to separate Provident Fund Account w.e.f. 01.01.2006 to 31.03.2014 in five equal installments. Accordingly, this office has deposited the amount in Provident Fund Account. The total arrears amounts to Rs.6.98 crores for 05 years and interest amount is Rs.1.46 cr. The all 05 installments has been deposited in PF account with interest as per the bank rates. As per the G.R. of Maharashtra Govt. this amount has to be credited to PF account of all employees after June 2014. It is understood from this office that 70% employees are class IV employees and they will be withdrawing the PF amount once they know that the arrears is credited to their PF account also the total employees contributing for NPS is 234. Since their amount of VIth pay arrears has not been deposited in their NPS account it is requested to let this office know as to whether cash has to be paid or deposit in their NPS account.

As per Vth Pay Commission the Govt. of Maharashtra had declared the same terms and conditions but for a period of 03 years, the amount will be kept in separate PF account and thereafter the amount will be transferred to individuals PF account. This office has received sanction from PDDE, SC, Pune vide their letter No.10723/PNA/V/DE dated 03.04.2002 for payment of arrears in cash to the employees of this Board.

RESOLUTION NO. 5 : Considered. Matter discussed. Chief Accountant explained that the VIth pay arrears has been deposited in a separate Provident Fund Account in five installments as per the GR of Government of Maharashtra and further this amount has to be credited to PF account of all employees after June 2014. Further

he stated that Vth pay arrears have been paid in cash with the sanction of the competent authority and similarly VIth pay arrears may also be paid in cash. Resolved to approve disbursement of VIth Pay Arrears alongwith interest to the employees of the Board in cash subject to sanction of the Competent Authority.

06. RESULTS OF STANDARD X OF PUNE CANTONMENT BOARD

HIGH SCHOOLS – 2013-2014 To note the results achieved by the three High Schools of Pune

Cantonment Board during the academic year 2013-2014. Dr. Ambedkar Memorial High School 100% Ghorpuri Village High School 86% Mahadji Shinde High School 81.91% The highest percentage obtained by top three students of each High

School are as under :-

RESOLUTION NO. 6 : Considered. Board noted the results of the three High Schools. President & CEO congratulated HM, Dr. AMHS for achieving 100% result continuously for three years and also other HMs of the High Schools. Matter further discussed. Resolved to provide cash award of Rs. 5000/- to the three students of Ghorpuri Village High School as shown on the agenda side, since all of them have scored more than 85% & Rs. 5,000/- each to the students who have scored first in Dr. Ambedkar Memorial High School & Mahadji Shinde High School.

Headmistress. The requisite sanction for Std IX has been received and for Standard X, the procedure for obtaining Index number is in process from SSC Board. The School Management Committee during their meeting has also recommended that X standard should be started.

08. ENGAGEMENT OF TEACHERS & ALLIED STAFF ON CONTRACTUAL BASIS IN PUNE CANTONMENT SCHOOLS

To consider and approve the list of teachers & other allied staff to

be engaged on contractual basis in Pune Cantonment Board Schools for the academic year 2014-15.

A notice has been issued in local newspapers viz. Indian Express

Clubbed Loksatta dated 02.06.2014 for walk-in-interview for teachers & other allied staff to be engaged on contractual basis for the Pune Cantonment Board Schools. Various panels were appointed for conducting the interview. The requirement has been raised by the various HM’s of the School. The panel has informed that all the candidates are below average and hence the existing staff may be asked to continue with the teaching.

RESOLUTION NO. 8 : considered. Board noted that walk-in-interviews have been conducted for various posts as per the requirements raised by the concerned HM’s of the Schools. Resolved that the aforesaid selected candidates may be engaged purely on contract basis for the academic year 2014-15. Further resolved that if any additional requirement arises, they may be engaged as per the requirement either from the waiting list candidates or by calling walk-in-interviews.

Further the Board opined that the major requirement of teachers are from Ravindranath Tagore English Medium School. Further the Board noted that since the said school is non-grantable, nominal fees may be charged from the student, who does not comes under the purview of RTE. Matter further discussed. Further resolved that HM may explore the possibility of charging nominal fees from the students and examine the matter and put up a detailed report before the Board.

09. PROVISION OF MID-DAY MEALS TO THE STUDENTS OF PUNE

CANTONMENT BOARD SCHOOLS FOR THE YEAR 2014-2015

To consider the question of approving the existing contractor Parnakutti Anath Mahila & Baladhar Kendra for providing mid-day meal to the students of Pune Cantonment Board Schools for the year 2014-15. Connected papers are placed on the table. Note : The Director of Education (Primary) vide above referred letter has informed all the local bodies that the process of finalization of Centralized Kitchen has been completed but the Hon’ble High Court has issued a stay order for the same. It is further stated that the contractor of 2012-13 may be continued for the year 2013-14. Further they have informed that the Hon’ble High Court vide order dated 27.02.2014 has approved the provision of Centralized Kitchen by the State Government.

Further Director of Education has informed that according to the orders of the Hon’ble High Court, the provision of mid-day meals to all the Schools through the Centralized Kitchen is expected to start at any time during the academic year 2014-15. Hence it is informed by the Director of Education that the concerned local bodies may

continue with the existing contractor of 2013-14 for the year 2014-15 till the implementation of provision of mid-day meal through Centralized Kitchen agencies. It is informed that the existing contractor Parnakutti Anath Mahila & Baladhar Kendra may be continued for providing mid-day meal to the students of the Pune Cantonment Board Schools for the academic year 2014-15 or till the finalization of the centralized Kitchen by Zilla Parishad, whichever is earlier. RESOLUTION NO. 9 : Considered. Board perused the letter received from Director of Education and also orders of the Hon’ble High Court. President opined that the kitchen of the existing contractor may be inspected periodically. Matter discussed. Resolved to approve the existing contractor Parnakutti Anath Mahila & Baladhar Kendra for providing mid-day meal to the students of Pune Cantonment Board Schools for the year 2014-15. Further resolved that surprise inspection will be carried out by a committee comprising of official from Health Department and one HM every month on rotational basis and a report to that effect will be placed before the Board in the ensuing Board Meetings.

10. PAYMENT OF AUDIT FEES TOWARDS AUDIT OF SVP CGH

W.E.F. 01.04.2013 TO 31.03.2014 To consider payment of audit fees amounting to Rs. 3,50,000/- in

respect of M/s. Prakash Mahendra Vinod & Co.

A letter bearing No. Accts/38 dated 20.01.2014 was issued to M/s. Prakash Mahendra Vinod & Co. for carrying out the work of audit of SVP CGH documents w.e.f. 01.04.2013 to 31.03.2014 for Medical Indent Register, local purchase register, OPD register, indoor register, physical verification of stock, OT Register, medical re-imbursement claims, shift and duty register and other audit observations. An audit report has been submitted by them. By carrying internal audit the hospital administration alongwith records and other details can be maintained properly as per the observations raised by them like computerization of overall hospital maintenance. It will also help in maintaining transparency in the records of the Hospital. The said firm has also carried out the work for fixing triennial assessment rates, calculation of LBT etc. The firm has submitted an bill amounting to Rs. 3,50,000/-. RESOLUTION NO. 10 : Considered. Board viewed the presentation made by the auditors. Matter discussed in detail. The Board directed RMO & MOi/C to go through the internal audit report submitted by M/s. Prakash Mahendra Vinod & Co. and submit their report alongwith comments and recommendations. They may lay specific emphasis towards measures to be undertaken to

improve efficiency and affectivity of the hospital administration. Board resolved to undertake implementation of software applications for OPD / IPD registrations, billing for OPD / IPD and diagnostic services on priority. Further resolved that CEO is authorized to incur necessary expenditure towards the same as per rules. Further resolved to approve the bill submitted by M/s. Prakash Mahendra Vinod & Co. amounting to Rs. 3,50,000/-and the auditors may carry out monthly inspection on the progress of the steps being taken for atleast three months. Further resolved that CEO may also take action for initiating AMC in respect of Stores software which has been already customized and being used. He may incur the expenditure towards the same. The Board also noted that there is a requirement for having experienced staff to handle and assist the RMO to streamline the Stores Department. Matter discussed. Resolved to engage a qualified person with experience to assist the RMO in managing the Hospital stores department by conducting walk-in-interview.

11. ORDERS PASSED BY THE APPELLATE AUTHORITY IN

RESPECT OF APPEALS FILED UNDER SECTION 274 OF THE CANTONMENTS ACT, 1924 : HOUSE NO. 2390-B NEW MODIKHANA : GLR SY. NO. 522 HIDAYATULLAH ROAD, PUNE CANTT.

To note letter bearing No. 261564/Appeal/Shri Haji Gulam Md/351/Q(L)) dated 30.04.2014 received from HQ, SC wherein the order of the Appellate Authority has been forwarded in case of the Appeal filed by Secretary, Haji Gulam Mohammed Azam Educational Trust in respect of unauthorised construction carried out in the property bearing House No. 2390-B New Modikhana. The hearing was conducted on 20.03.2014. The appeal has been dismissed vide order of the Appellate Authority dated 30.04.2014. Connected papers are placed on the table. RESOLUTION NO. 11 : Considered. Noted the orders of the Appellate Authority. Resolved to issue notices under Section 320 of the Cantonments Act, 2006 for demolition of the unauthorised construction.

12. RENEWAL OF LEASE : HOUSE NO. 18 GHORPURI BAZAR SY. NO. 89/67 : PUNE CANTONMENT

Reference CBR No. 3 (2 CAC dated 24.02.2014) dated 28.02.2014.

To review the decision of the Board in respect of renewal of lease of House No. 18 Ghorpuri Bazar admeasuring 740.00 sq. ft. for a period of 30 years w.e.f. 01.01.1999 on an enhanced rent of Rs. 750.00 per annum, since the property involves unauthorised construction. Connected papers are placed on the table.

Note : As per site Inspection of Technical Staff, the property is used for residential cum commercial purpose. The lessee has carried out unauthorized construction for which notices were already issued on 30.12.1973, 16.02.1973 & 26.03.1973. There is no encroachment on Government land or sub division of site is involved in the subject property. The Board vide above referred resolution had resolved to renew the lease but the unauthorised construction carried out in the subject property was not brought to the notice of the Board. RESOLUTION NO. 12 : Considered. Board noted that unauthorized construction exist in the subject property for which notices has been issued by the Board. ROAD, GLR SY NO. 390/515 : PUNE CANTONMENT

To consider application dated 29.06.2012 received from Smt. Marisa Fernandes & others requesting for renewal of lease in respect of House No 808 Dastur Meher Road, admeasuring area 1163.14 sq.ft. for a period of 30 years w.e.f. 17.01.2003 at an enhanced rent of Rs. 872.37 per annum. The site is Class- B 3 land and held on lease in Schedule VIII of CLA Rules 1937. As per the condition No 1{6} of original lease dt. 23.07.1973 the Property is used for Residential House.

The Original lease was executed on 23.07.1973 for renewal at the option of lease upto 90 years w.e.f. 17.01.1973. 1st term of 30 years expired on 16.01.2003. Now, the Lessees have requested to renew the 2nd term of 30 years of lease w.e.f. 17.01.2003.

Present annual rent is Rs. 581.58 per annum. As per Clause III, of original lease, the renewal of lease shall be granted only at such rents within a percentage of enhancements of 50%. After renewal of lease the rent will be Rs. 872.37 per annum. Connected papers are placed on the table.

As per site inspection of the Technical Staff of this office there is no unauthorised construction or no encroachment on Govt. land or no sub division of site or change of purpose is involved in the subject property.

Public notice already published in two local news papers on 12.07.2013. The Co-owner Shri Raju Laxman Pyaram vide his application dated 15.07.2013 raised an objection stating that the persons submitted Release Deed have no documentary evidence showing the title to the said property or occupancy rights. However,

This office vide letter No. 2230/SBR dated 26.08.2013 have requested to the objector to submit documentary evidence in support of objection within 10 days of receipt of this letter failing which this office will process the case for mutation. The objector instead of submitting the documentary evidence has once again raised objection vide his letter dated 15.7.2013 and 11.01.2014 not to mutate the property in the names of legal heirs. Thereafter this office vide letter No. 2236 New Modikhana/2014 dated 18.01.2014 informed the objector that as per GLR maintained by this office the names of legal heirs is already in GLR.

Since the objector did not produce the documentary evidence in support of his say inspite of repeated requests made by this office, the release deed may please be accepted for mutation of the said property. The details of Mutation is enclosed in Annexure ‘A’.

21. BUILDING PLAN : BUNGALOW NO. 12 STAVELY ROAD : PUNE

CANTT. To consider building application dated 21.08.2013 with revised

plans from Mr. Atul J Goel, POAH of property bearing B. No. 12 Stavely Road, Pune Cantt. requesting for sanction for re-construction of main bungalow with additional 10% builtup area under the Revised Land Policy 09.02.1995. The proposed bungalow consists of ground floor and partly first floor for residential purpose. The area / FSI statement is as under :-

RESOLUTION NO. 21 : Considered. Resolved to approve the revised building plan under Section 238 of The Cantonments Act, 2006. The sanctioned building plans should be absolute in every particular. Promoters & Land Developers Pvt. Ltd. for demolition of existing dilapidated bungalow and outhouse and proposed reconstruction of main bungalow consisting ground plus first floor for which the DEO, Pune Circle, Pune has raised an objection under Section 238 (3) of the Cantonments Act, 2006 vide letter bearing No. H/265/IV/24 dated 15.05.2014.

Land Developers Pvt. Ltd. for demolition of existing dilapidated bungalow and outhouse and proposed reconstruction of main bungalow consisting ground plus first floor were forwarded vide this office letter dated 09.12.2013 to DEO, Pune Circle, Pune for obtaining his views under Section 238 (3) of the Cantonments Act, 2006. The DEO, Pune Circle, Pune vide letter dated 15.05.2014 have enclosed the copy of Directorate letter No. 1306/DE/SC/L/Pune/1 dated 08.05.2014 wherein it is stated that the GOC-in-C, SC has not given consent to the proposed construction and has rejected the building plans on the ground that that the de-hiring sanction given by COS itself is questionable, hence subsequent events pertaining to the property including transfer of lease hold rights by the former lessee after getting the property back from LMC remain a matter of investigation. The DEO further stated that the Competent Authority, the GOC-in-C, SC, Pune for sanctioning, addition/alteration to the subject building on the land in question as per Lease Condition 5-A to Clause I after Condition (5) of amended deed made on 17.04.1939 to the lease in Schedule VI in 1925, which is supplemental to the indenture of lease executed on 24.11.1937 has not given consent to the proposed construction and has rejected the building plans.

RESOLUTION NO. 22 : Considered. Board noted the objections received from DEO, Pune Circle Pune under Section 238 (3) from land point of view. Resolved to reject the building plan submitted by M/s. Futura Promoters & Land Developers Pvt. Ltd. for demolition of existing dilapidated bungalow and outhouse and proposed reconstruction of main bungalow consisting ground plus first floor.

23. REGULARIZATION OF UNAUTHORISED CONSTRUCITON : GLR SY. NO. 453 : BUNGALOW NO. 5-B STAVELY ROAD : ST. MARY’S HIGH SCHOOL ; PUNE CANTT.

No. 453 is classified as B-3 land held on Old Grant Terms situated outside the notified Civil Area and placed under the management of DEO, Pune Circle, Pune.

Note : Earlier in the year 2005, the proposal for regularization of unauthorized construction was forwarded to the competent Authority for obtaining sanction of acceptance of composition fee. The DEO, Pune Circle, Pune vide letter dated 11.04.2014 has returned the earlier proposal informing that the proposal is almost 8 years old and at this stage it is not possible to regularize of same in absence of the present status of unauthorized construction in the subject property. The DEO, Pune further informed that the applicant / HOR be intimated to submit fresh proposal showing all unauthorized construction to be regularized. Accordingly, this office forwarded a letter dated 29.05.2014 to the School Authorities to submit a fresh proposal.

RESOLUTION NO. 23 : Considered. Resolved to recommend regularization of the unauthorized construction @ 20% of the total cost of unauthorized construction carried out in the subject property bearing B. No. 5 B Stavely Road, GLR Sy. No. 453. Necessary proposal be forwarded to the Competent Authority for obtaining concurrence to acceptance of the composition fee @ 20% of the total cost of unauthorized construction.

Note :The building plans for construction of demolition of existing building and proposed construction of 2 storied building with partly parking on ground floor and partly first floor for residential purpose were sanctioned by the Board vide CBR No. 17 dt.12/01/2012. The plans were communicated to the party vide this Office letter dt.23/02/2012. However, party was not able to start the construction due to tenants objection and the matter is in small cause court , Pune District and further informed that matter expecting a settlement / judgment in near future. Note : Pune Traffic Police vide letter dated 18.12.2013 requested to widen one particular corner at Golibar Maidan Chowk as it has become highly congested and causing severe inconvenience to the traffic. This office requested DEO, Pune Circle, Pune to handover area admeasuring 300.00 sq.ft. of land at south side corner of the property bearing B. No. 14 Castellino Road in order to widen the road corner at Golibar Maidan Chowk in the larger interest of the general public.

RESOLUTION NO. 27 : Considered. CEE stated that several complaints have been received from Police Authorities requesting to widen the Golibar Maidan Chowk at the north-east corner of Bungalow No. 14 Castellino Road. He further stated that this corner is an accident prone area and hence the same is required to be widened. Matter discussed. Resolved to seek reclassification of the land admeasuring 300 sq.ft. within the premises of Bungalow No. 14 Castellino Road, GLR Sy. No. 533 from Class B-3 to Class C land. Resolved that DEO may be asked to execute an MOU with the PMC authorities before granting sanction and it may be incorporated in the MOU that PMC would give water supply to the Cantonment residents as per the requirements and also augment the existing supply using the proposed ESR. Further they may also include in the MOU that PMC would replace the existing pipelines in order to improve the water supply. The Board opined that DEO, Pune Circle may also direct PMC to furnish an undertaking instead of MOU if it is administratively more convenient and appropriate.

30. RESUMPTION OF BUNGALOW NO. 5 ALEXANDRA ROAD : GLR

The tree trunk is creating a pressure on the boundary wall of Gul Co-Op. Hsg, Soc. Ltd. The members of Gul Co-Op. Hsg, Soc. Ltd. Wish to remove the said peepal tree from site for the following reasons. 1. The tree trunk is damaging the compound wall. 2. The old Peoples, Children’s may get injured & cars may get

damaged. 3. The members wish to increase the parking space for cars within

the society. The tree is in balanced condition. May not be consider for complete removal of tree.

It is also observed that the applicant illegally carried out chopping of branches of Peepal tree, Gulmohar tree & Neem tree on 25th Dec, 2013. Police complaint were registered vide letter No. 3-1/ ENGG/GDN/13-14/211 dated 1st Jan, 2014.

As per CRS:- Among 20 occupants 16 Nos. flat holders have paid property tax for the year 2012-13 from the Gul Co-Op. Hsg, Soc. Ltd As per CEE: - There are no unauthorized constructions in the property Gul Co-op. Hsg, Soc. Ltd. As well as H.No.611, Sachapir street, Pune. As per GLR: - The applicant is forwarded through to the representative of HOR. The property is an old grant.

Case-iii : Inspected the site of Prop. No. 928, Synagogue street, Pune. There is one bottle palm tree situated the back side margin of the society. This tree is well grown. Leaves of this tree are approaching towards the windows. The tree is not in a dangerous position so also resident have recently removed the leaves of said palm tree. May not be consider for complete removal of tree.

As per CRS:- out of 64 tenements 48 have paid property tax for the year 2012-2013; i.e. 16 tenement have not paid the tax. As per CEE:- No unauthorized construction in the subject property. As per GLR:- The land is in free hold category.

Case- iv :. Inspected the site of 18/3, Jahangir baugh, Pune. There is an bungalow structure which is surrounded by many huge trees. The big branches of these tree have overhanged. Applicant wish to remove one Rita tree from the base on account that tree is very much close to the wall. Secondly heavy pruning of big branches of Gulmohar (01 No), Jamun (02 Nos), Tamarind (01 No), karanj (02 Nos) & Jagali badam (01 No) is demanded. As the trees are grown wildly, pruning is necessary. May not be consider for complete removal of tree.

As per CRS:- There are no dues balance with respect to Tax for the year 2012-13. As per CEE:- No unauthorized construction in the subject property. As per GLR:- GLR could not be obtained as the land is out of Notified civil area i.e. collector land under management of Cantt. Board.

Case-v : One huge rain tree is situated in between the two properties i.e. H.No. 236 & 237, Sholapur Bazar, Pune Camp, Pune-01.

The tree is very old & tree trunk & roots have created a pressure towards wall of H.No. 237. As H.No.237 is a having Kachha House type structure, so also kitchen & Bathroom are towards east side which is favorably nourishing the tree roots. Secondly the building structures surrounding this tree are such a that the growth of tree had occurred only towards & over the H.No. 237. It had observed many times during the Monsoon season that the rain water enters in the H.No 237 through the wall cracks & from ground due to its sunken position than the road level.

There is long dispute between these two residents. Mr. Dallaya the HOR of the Prop. No. 236 & Shri. Vasant N.Chowdhary who is tenant from Prop. No. 237. The HOR of the Prop. 237 is Mr. Mohommedmiya Shaikh Mohiddin. Every time house owner of 236 create an environment so as to make it difficult for removal of branches or tree from site, Secondly the removal of branches are not easy due to electric poles & wiring surrounding the house structure.

The applicant Shri. Chowdhary (H.No. 237) is applying prior to 2005 for removal the said Rain tree; many times the permission for removal of branches were granted (Viz, 25/06/2004 & 31/03/2009) vide CBR No.4 dated 20/06/2011 the said rain tree was auctioned (Auction Notice No.3/1/HS-GDN/02/10113 held on 16/07/2011) The removal of tree could not be carried out due to strong objections and interference from neighbours; NGO parties & tree lovers etc. The tree is not in a position to get fell down but the part of the wall adjacent to tree may get collapse. Now the applicant again applied for removal of said rain tree (all the previous reference are enclosed herewith) As per CRS:- There are no dues balance with respect to Tax for the year 2012-13. As per CEE: - There are no unauthorized constructions in the property. As per GLR: - The applicant is forwarded through to the representative of HOR. The property is an old grant. RESOLUTION NO. 32 : Considered. Board opined that no sanction may be given for cutting / removal of trees. Board considered the aforesaid applications case by case and resolved as under :- (i) Resolved to reduce the height of the Silver Oak tree from top

level by pruning the requisite branches without damaging the life of the tree.

(ii) Resolved to prune only one branch of Neem tree leaned towards the building.

WASTE FROM SHIVAJI MARKET AND SLAUGHTER HOUSE To consider the question of disposal of day to day animal waste like

poultry waste, goat / sheep waste & large pet animals waste generating from Chhatrapati Shivaji Market and Slaughter House of Pune Cantonment Board. The daily waste generation is in the range of 500 kg per day, which causes unhygienic condition for the residents nearby vicinity. It is also mandatory to dispose off all the animal waste as per the norms of Central Pollution Control Board. At present there is no such specific facility within the Pune Cantonment or in proximity for disposal of animal waste. Therefore it is recommended to provide incinerator for disposal of animal waste. The estimated cost for installation of incinerator would be approximately Rs. 90.00 lakhs.

35. PERMISSION FOR ROAD CUTTING FOR PUNE CCTV PROJECT

OF HOME DEPARTMENT, STATE GOVERNMENT OF MAHARASHTRA

Dated 05.50.2014 received from M/s. Allied Digital Services Limited (ADSL) on behalf of Home Department, Government of Maharashtra requesting to grant permission for road cutting in Cantonment Area at 17 locations of total length 6986 mtrs. The total excavation will be 3493 cu. Mtrs. and the total cost of road cutting @ Rs. 1800 per cmt is Rs. 62,87,400/-. The Board vide CBR No. 15 dated 18.12.2013 resolved to waive off the road cutting charges for installation of outdoor CCTV cameras under Lashkar Police Station and Wanowrie Police Station in Cantonment area and in this regard CEO is authorized to issue the permission as being sought for by Police Authorities.

President Cantonment Board pointed out that Cantonment Board is not receiving any grants from the State Government / share in basic tax assessment from the Government of Maharashtra unlike Municipal Corporations and other local bodies. President Cantonment Board further pointed out that incurring expenditure on reinstatement shall be additional financial burden on the Cantonment Board. Matter further discussed. Resolved to grant permission for the road cutting for laying cables of CCTV system subject to the condition that the Maharashtra State Government either reinstate the damaged roads or allot funds to Cantonment Board to meet the expenditure for reinstatement. a. To consider the issue of transfer of Fruit Stall bearing No. 35 at Chhatrapati Shivaji Market in the name of Mrs. Sajiya Sameer Shaikh (Niece of Mr. Hanif Dongri Saheb i.e. Brothers daughter), who have cleared their outstanding dues and have also submitted undertaking cum indemnity bond.

Note : The subject stall stands in the name of Mr. Hanif Dongri Saheb. Mrs. Sajiya Sameer Shaikh has submitted affidavit / NOC of Mr. Illiyas Son of Shaikh Mohammed Hanif, true copy of licence fee paid, true copy of death certificate in respect of Mr. Hanif Mohammed Dongri, true copy of shop act licence and electricity bill, Xerox copy of general power of attorney. As per the legal advice, the applicant has cleared all the outstanding dues and has published a public notice inviting objections in two local newspapers dated 18.12.2013. Note : The subject stall stands in the name of Mr. Sk Aboo Sk Md. To consider the rates received from registered vendors approved by the President vide note dated 21.04.2014 for the supply of medicines required by SVPCGH. The rate enquiry (RE) No.1/2014 in response to the calling of quotations from registered vendors was opened on 20th May 2014.

40. GUIDELINES FOR GRANTING FINANCIAL CONCESSIONS TO

SVPCGH PATIENTS

Reference CBR No. 1 (HC 3 dated 24.02.2014) dated 28.02.2014. To consider the guidelines for granting financial concessions to SVPCGH patients. The Board vide above referred resolution had resolved that detailed guidelines be prepared for exercising the power to consider exceptional cases for granting financial concessions to SVP CGH patients. The guidelines perused by the CEO are placed on the table. RESOLUTION NO. 40 : Considered. RMO explained in detail the various strategies to be adopted for considering the grant of financial concession to the SVP CGH Patients. Matter discussed. President Cantonment Board opined that the proposal be reviewed and directed that while reworking on the guidelines, the Hospital Authorities to keep in mind that maximum concession be given to Cantonment residents and BPL only. Resolved that RMO alongwith Col. Chaudhary – MOi/C may re-work on the guidelines framed and place before Board.

outstanding octroi compensation from the Pune Municipal Corporation from the year 2006 to 2012 (6 years) amounting to Rs. 24,79,30,919/-.

Note : The Board vide above referred resolution had resolved to forward a letter to the Pune Municipal Corporation Authorities demanding the outstanding octroi. Accordingly, this office vide letter dated 23.12.2013 and 25.2.2014 has requested Pune Municipal Corporation to make the payment of difference amount, but reply is still awaited. RESOLUTION NO. 46 : Considered. CEO informed the Board that inspite of several requests the PMC authorities are not releasing the outstanding octroi Compensation. Matter discussed. Connected papers are placed on the table. RESOLUTION NO. 47 : Considered. Mater discussed. The Board noted that the Revenue Section has not put up its report and analysis of the highest bid received. The Board further noted that Shri. S A Kadam, CRS (offg.) is not present. Matter further discussed. Board noted that there is not much of an increase in the rates accepted in the previous year and highest bid received this year. The President Cantonment Board inquired whether the highest bidder can be asked to increase the bid. Matter further discussed. The Board came to the conclusion that the highest bid offered by M/s. Solapur Construction & Fabrication Pvt. Ltd. is not upto the mark in comparison to the previous year accepted rates. The Revenue Section is directed to put up a detailed report regarding the analysis and reasonability of the highest bid as well as other conditions to be examined by the Board to arrive at an appropriate decision within a week keeping in view the interest of Cantonment Board and general public. Matter discussed. The Board resolved that the matter be placed again before the Board with the report of the Revenue Section to enable it to take appropriate decision. Further resolved to grant extension to the existing contractor for a further period of two months or till the finalization of the contract, whichever is earlier subject to the condition of 10% enhancement on the previous accepted rates. 53. ENGAGEMENT OF HYDRAULIC MECHANIC ON TEMPORARY

BASIS To consider the question of engaging one Hydraulic mechanic

purely on temporary basis at a consolidated remuneration of Rs. 10,000/- per month for the Workshop Department of the Board initially for a period of six months.

Connected office report is placed on the table. Note : There are around 15 vehicles, which are operated

hydraulically. Due to constant use leakage in hydraulic system gets generated, hence frequent repairs has to be carried out. In hydraulic system there are certain components such hydraulic cylinder, main valve, control valve, hydraulic filters, main hydraulic pump etc, which are to be repaired by specialized hydraulic mechanic. RMO stated that there are no specific Government Resolutions with reference to remuneration in respect of honorary doctors. Further the Board noted that due to the peculiar conditions, two dental centres being run, ECHS empanelment, a dedicated Dental Surgeon is required to be engaged duly fixing the honorarium sufficient enough to ensure that they continue with the SVP CGH without disruptions. 70. DEVELOPMENT OF PLAY PARK AT BHIMPURA LANE NO. 29

To consider the question of development of play and park at the site bearing GLR Sy. No. 390/1167 (part) at Bhimpura Lane No. 29 for the children residing in the vicinity of that area. The estimated cost supply and installation of play equipments and benches would be around Rs. 3,00,000/- approx. and for garden illumination would be around 2,00,000/-. Note : As per site inspection of the Technical Staff of this office the property is at present being used for Residential-cum-Commercial purpose. As per Original Lease the purpose of property was for Dwelling house whereas the present usage is for Residential cum Commercial purpose which amounts to breach of the lease condition. In the subject case One Co-HOR has purportedly committed breach and not all. There are three Lessees namely Kishan P. Daryanani 2. Mrs. Manju Kishan Daryanani 3. Mr. Israr Abdulla Khan Pathan. Lessee at Sr.No. 1 & 2 are in possession of first floor and lessee at Sr.No. 3 is in possession of ground floor and he is using the ground floor as Residential cum Commercial purpose. RESOLUTION NO. 73 : Considered. The Board noted the fact that one of co-lessee has committed breach of the lease conditions by using the property for residential cum commercial purpose. The Board also noted that there is no change in purpose in the portion occupied by the applicant, who is legal heir of another co-lessee. Action is required to be taken for determination of lease after obtaining necessary sanction of the Competent Authority. However, since it a case of mutating the lease hold rights on the names of the legal heir, the Board felt it is necessary that legal heirs are brought on record first so as to enable this office to take action against the legal heirs as per the directions received from the Competent Authority. Resolved to enter the name of the legal heir of one of the co-lessee in the GLR being maintained by the Board.

74. RENEWAL OF LEASE IN RESPECT OF PROPERTY BEARING

HOUSE NO. 2-A MOLEDINA ROAD GLR SY.NO. 245-A : PUNE CANTT.

To consider the question of renewal of lease in respect of property bearing H.No. 2-A Moledina Road, GLR Sy.No. 245-A, Pune Cantonment in favour of Manisha Terrace Coperative Housing Society Limited. The Deed of Assignment is Registered at HVL-II at Sr.No. 2874/87 dated 21.08.1987.

As per record the Original Lease was given to Bai Banubai Framji Patel for a term of 30 years renewable at option of Lease upto 90 years under Schedule VIII of CLAR 1937 commencing from 13.08.1950 renewed for further period of 30 years in Schedule IV of CLAR 1937 w.e.f. 13.06.1977 under the authority of Directorate of Defence Lands and Cantonments letter No. 5050/II/DLC dated 29.11.1979. Thereafter renewal for a further period of 30 years was sanctioned upto 12.06.2007. The Lessee has transferred the lease hold rights to Atur India Private Limited and Atur India Family benefit Trust by an Agreement without obtaining NOC from this office which is one of the conditions of the lease. Thus, there appears to be bonafide mistake on the part of the Lessee for not taking NOC from this

office. As such, Deed of Sale is not authenticated as far as this office is concerned. Meanwhile, M/s Atur India Private Limited has submitted an application on 16.08.2006 and requested to transfer the Leasehold rights in favour of Manisha Terrace Co operative Housing Society. The mutation did not affected for the reason that there was breach in lease condition. Considering the facts, this office vide letter No. B.No. 2-A Moledina Road dated 18.01.2014 taken up the matter with PD,DE and requested to advice whether violation of Lease condition can be exempted by imposing penalty as levied by Govt., whether this can be renewed by the Legal heirs and whether fresh sanction can be given for execution of lease. The PD,DE vide their letter No. 5050/DE/SC/L/Pune/I dated 11.04.2014 have asked this office to note that it is required to make a case fit either for renewal of Lease or determination of lease. Further, they have also asked to submit a proposal /statement of case to condone the lease condition, if required.

The first period of lease of 30 years executed by Bai Banubai F. Patel in the GLR. After violation of lease is condone the property is to be transferred on the name of Manisha Terrace Co- Operative Housing Society Ltd., in the GLR after following due procedure of transfer and Lease is to be renewed on the name of Manisha Terrace Co-Operative Housing Society for a further period of 30 years w.e.f. 13.06.2007 to 12.06.2037. RESOLUTION NO. 74 : Considered. The Board noted that the lessee has not obtained NOC from the Board for sale of the subject property, which is a violation of lease conditions. Matter discussed. Resolved to recommend condonation of the breach done by the HOR. Further resolved to forward proposal to the competent Authority citing the various facts of the case alongwith the violation of lease condition to condone the breach, if deemed appropriate and also to seek directions of the Competent Authority for going ahead with the mutation for entering the name of Manisha Terrace Co-operative Housing Society Ltd.

76. MUTATION OF OLD GRANT PROPERTIES INVOLVING

RESIDENTIAL-CUM-COMMERICAL USAGE The Board has been mutating the Occupancy Rights in respect of

Old Grant properties being used for Residential-cum-Commercial purposes following due process till 2009. The Board was adopting following guidelines given by the Directorate vide letter bearing No. 17838/DE dated 04.11.2004 to mutate the properties :-

a) Whether the premises was in use as shopping establishment prior to 23/03/1968.

b) Whether the premise is being assessed as shopping establishment and tax revenue is being recovered accordingly.

c) Whether the premise is registered as shopping establishment under the Sales Tax Act of the State Govt. and Trade Licence has been issued by the Board.

d) Whether the Building has been sanctioned for Residential cum Commercial purpose by the Cantt. Board/CEO prior to 1968.

During the year 2009, the matter has been referred to the Higher Authorities seeking directions that whether the property held under the terms of Old Grant/ Lease can be mutated / transferred from an individual to legal person or vice-versa & what should be the criterion to determine the use of land – entries in GLR, a building plan sanctioned or the present status. Since then mutations has not been done in properties involving residential cum commercial usage. Time and again matter is being referred to Higher Authorities and PD DE in turn has referred the matter to DGDE for their decision / orders / policy guidelines. The office of the Directorate vide letter dated 09.07.2013 and 01.10.2013 has informed that the decision in the subject matter is still awaited.

Letter bearing No. Lands/Misc/2012 dated 10.02.2011, 10.03.2011, 27.04.2011, 08.12.2011, 25.10.2012, 29.11.2012, 12.07.2013 and 20.12.2013 has been already forwarded to PD DE, SC for obtaining guidelines / directions for mutation of properties held on Old Grant Terms involving Residential-cum-commercial purpose.

In the mean while matter has been also referred to M/s. Mulla & Mulla for opinion vide letter dated 12.07.2013. M/s. Mulla & Mulla vide letter dated 23.08.2013 has opined as under :– “The provisions of Section 81 (2) of the C.A. 2006 deals with devolution of the property on death of a person preliminarily liable for payment of tax of the property to the Cantonment Board. In that case the interest of the deceased is devolved on its legal heirs. Moreover on the death of original HOR, if the names of legal heirs are not incorporated in the GLR, then it will not be possible to take action on account of violation of any terms of the old grant of change of purpose or against any unauthorized construction, because the action is to be taken by serving a notice on the legal heirs of the deceased HOR. Keeping in view this position, it is necessary that legal heirs are to be brought on record through the proposal of mutation of holder of occupancy rights of the property.” It is specifically, stated in the said opinion that mutation on inheritance involving unauthorised construction and residential cum commercial use shall not affect the rights of Cantonment Board to take action against legal heirs.

The same was also informed to the Directorate urging them to issue

directions in respect of atleast mutation in cases of legal heirs. PD DE, SC during his annual inspection has advised that the

pending proposals in respect of legal heirs may be considered on case to case basis where their sanctity has been verified prior to 1962 and appropriate decision may be taken.

In view of the above, the details of the following cases for mutation

through inheritance are placed before the Board is enclosed as Annexure ‘C’. This case has to be examined on the basis of documents that the usage of property for commercial basis is prior to 1962.

RESOLUTION NO. 76 : Considered. Matter discussed in detail. The Board noted that these cases of mutation are pending since long as the properties are being used for residential-cum-commercial purpose. Resolved that documentary proof from the concerned HORs be obtained that the property is being used for residential-cum commercial purpose prior to 1962 and thereafter these cases on case to case basis may be forwarded to the Directorate with due recommendation and seek necessary instructions so as to enable the Board for mutating the names of legal heirs / purchasers in the GLR being maintained in the Board.
