Minutes October 2, 2014 Call to Order Chair Shapiro called the meeting to order. Roll Call and Pledge of Allegiance Chair Shapiro, Vice Chair Richards, and Commissioner Castor were present. Chair Shapiro recognized Sherriff Russell Bono, Recorder of Deeds Nancy Becker, and Jury Commissioner Miriam Woods. Commissioner Castor led the Pledge of Allegiance. Commissioners’ Comments Commissioner Castor, with unanimous consent from Chair Shapiro and Vice Chair Richards, dedicated the Pledge of Allegiance to the late Trooper David Kedra of Pottstown, who was killed in an accidental training shooting on Tuesday, September 30 th , 2014. Approval of Minutes Vice Chair Richards made a motion to approve the minutes of the September 18, 2014 meeting of the Montgomery County Board of Commissioners. Commissioner Castor seconded the vote. Announcements, Commendations & Reports Announcement for 8 th annual community summit, “Cohesive Community Preparedness for Emergencies in Montgomery County” on October 29, 2014 - Ella Roush & Tim Elbertson Ms. Ella Roush, the Director of North Penn Collaborative, and Tim Elbertson, Outreach Coordinator, announced the summit, which is being held on the anniversary of Superstorm Hurricane Sandy. The event will give organizations the tools to better prepare for the next emergency situation. Mr. Elbertson thanked the Commissioners for their support. Authorization of an Easement Under the Future Chester Valley Trail in Upper Merion Township – Josh Stein Vice Chair Richards made a motion that that the Montgomery County Board of Commissioners authorizes the proper County officials to execute the necessary documents in order to grant an easement across the County’s Right-of-Way along the former East Penn Railroad corridor, to the owners of the property at 214 East DeKalb Pike in Upper Merion Township, for the purpose of connecting to a stormwater channel, as specified in the attached Exhibits, under certain terms and conditions and subject to approval by the County Solicitor. Commissioner Castor seconded the motion. There was no board comment. There was no public comment. Chair Shapiro brought the motion to a vote and it was adopted unanimously. The complete text of resolution 14-C. 358 can be found in the appendix of this document. Acceptance of Right-of-Way Dedicated to the County for the Ridge Pike Widening Project – Josh Stein Vice Chair Richards made a motion that the proper County Officials, in accordance with the authority conferred by law, are authorized to accept the dedication for public use the Right-of-Way owned by the Masonic Village and the Squire Ridge developments, along the north side of Ridge Pike between Barren Hill and Northwestern Avenue; together with the storm sewer lines constructed thereunder. Commissioner Castor seconded the motion. Vice Chair Richards noted that it was good to see that the ongoing project is moving forward. There was no further board comment. There was no public comment. Chair Shapiro brought the motion to a vote and it was adopted unanimously. The complete text of resolution 14-C. 359 can be found in the appendix of this document. Advertisement of Bids and RFPs Commissioner Castor made a motion to approve the following request for an advertisement of a RFP as described by the Chief Operating Officer, Lauren Lambrugo, and to authorize the proper County Officials to execute the same, subject to the approval of the County Solicitor: RFP on behalf of the County for Legal Research Services. Vice Chair Richards seconded the motion. Chair Shapiro noted that the RFP will streamline legal and digital services, and inquired if the RFP will save the county money. Ms. Lambrugo replied in the affirmative.

There was no further board comment. There was no public comment. Chair Shapiro brought the motion to a vote and it was adopted unanimously. Awards of Contract Commissioner Castor made a motion to approve the preceding awards of contract as well as the contracts for the Southeastern PA Regional Taskforce as described by the Chief Operating Officer Lauren Lambrugo, and to authorize the proper County Officials to execute the same, subject to the approval of the County Solicitor. Vice Chair Richards seconded the motion. Commissioner Castor inquired about the scope of the law regarding item #4, the Bog Turtle consultant. Vice Chair Richards replied that the Bog Turtle is an endangered species. There was no further board comment. There was no public comment. General Public Comment Ms. Doris Smith-Starks congratulated Vice Chair Richards for her call to action for women in government. Mr. Frank O’Donnell of Hatfield, PA, addressed an issue he had with his hearing device while placing a 911 call. After filing a complaint, Mr. Tom Sullivan, the Director of Public Safety, met with Mr. O’Donnell and gave a tour of the 911 facility. Mr. O’Donnell said that he was satisfied with the meeting with Mr. Sullivan but asked the Commissioners to alter the training materials for the 911 call center to better address the hearing impaired. He also recommended hearing devices for the Board of Commissioners meetings. Recorder of Deeds Nancy Becker noted that October 10th is Election Records Day, and that Montgomery County was one of the first counties to have electronic records available. She also noted the impending $100 million bank lawsuit regarding mortgage assignments. Commissioners’ Comments Chair Shapiro addressed Mr. O’Donnell’s concerns about the hearing impaired and said that the 911 hearing incident is being investigated; Commissioner Castor will present a report at the next Board of Commissioners meeting. Hearing devices will also be available at the next Board of Commissioner’s meeting.

Vice Chair Richards noted Nancy Weiman’s retirement party and said that she is sad to see Ms. Weiman leave her job but is happy that she will continue to serve on the prison board. Vice Chair Richards also announced over $250,000 in TCDI grants for DVRPC revitalization projects. Vice Chair Richards also announced the Montgomery County Commission on Women and Families event at Normandy Farms on October 23, 2014 that will recognize Joanne Kline and noted that more information is available on the website. Commissioner Castor commended the public safety department for being accredited and in compliance with allied health programs, and for being on track to have the radio system running in 2016 in accordance with the Motorola contract. Acquisition, zoning, and permitting are in progress for various jurisdictions, some of which are more difficult than others, but the project is still moving forward. Commissioner Castor also received a detailed audit from the Controllers for the 911 system. He commented on the thoroughness of the report, and indicated that each year the county has to pay more 911 costs out-of-pocket through operating funds and not from the state funds that are earmarked for the funding stream. The Board of Commissioners asked Commissioner Castor to testify to the Pennsylvania House regarding the funding issue. The matter has not moved in the state assembly and Commissioner Castor has issued a plea to the state legislature because the 911 system is putting a greater funding burden on all of the counties in Pennsylvania. Chair Shapiro attended a breakfast at the Kynetic Tech World Headquarters that featured technology CEOs from around the county. Chair Shapiro said that he is proud that Montgomery County has more tech jobs than any other county in Pennsylvania and credited specific programs that have been created to help technology companies grow in the region. Chair Shapiro also read excerpts from two letters from constituents regarding very positive feedback for the Navicate program, particularly for Bonnie Johns and Theresa Rines. Chair Shapiro also announced two upcoming county events. The first annual county employee talent show “Montco’s Got Talent” will be held on November 12th, 2014. Also, Montgomery County employees are participating in the Making Strides Against Breast Cancer walk on October 25th, 2014 with the team name “Montco Rack Pack.”

Upcoming Meeting Dates The next meeting of the Montgomery County Board of Commissioners will be at 10am on Wednesday, October 22, 2014. The following meeting will be at 10am on Thursday, November 6, 2014. Adjournment On motion of Commissioner Castor, seconded by Vice Chair Richards, the October 2, 2014 meeting of the Montgomery County Board of Commissioners was adjourned. On motion of Vice Chair Richards, seconded by Commissioner Castor, it was unanimously adopted that: WHEREAS, Montgomery County owns and maintains a network of recreational parkland and recreational trails; and WHEREAS, in 2010, the County acquired the Right-of-Way over the East Penn Railroad corridor through Upper Merion Township, for use as part of the Chester Valley Trail; and WHEREAS, the Right-of-Way crosses DeKalb Pike along the former Kunda Sign property, which was recently acquired by Statek (the “Statek Property”(; and WHEREAS, the owners of the Statek Property have proposed to demolish the existing property, and erect a new commercial retail building at the site; and have received preliminary approval from the township; and WHEREAS, the owners of the Statek Property require an easement under the County’s Right-of-Way in order to access an existing Stormwater channel, to mitigate any potential stormwater run-off issues; and WHEREAS, in exchange for this Right-of-Way, Statek has agreed to correct an existing issue where a driveway improperly encroaches on to the County’s property, and will extend the sidewalk directly to the location of the trail, allowing ease of access for future trail users. NOW THEREFORE BE IT RESOLVED that the Montgomery County Board of Commissioners authorizes the proper County officials to execute the necessary documents in order to grant an easement across the County’s Right-of-Way along the former East Penn Railroad corridor, to the owners of the property at 214 East DeKalb Pike in Upper Merion Township, for the purpose of connecting to a stormwater channel, as specified in the attached Exhibits, under certain terms and conditions and subject to approval by the County Solicitor.

WHEREAS, the County is the owner of a certain stretch of road in Springfield and Whitemarsh Townships, Montgomery County, Pennsylvania on Ridge Pike between Barren Hill Road and Northwestern Avenue (hereinafter “Ridge Pike”); and

WHEREAS, the Masonic Village and the Squire Ridge subdivisions are adjacent developments along the north side of Ridge Pike between Barren Hill Road and Northwestern Avenue; and

WHEREAS, both developments are constructing a new driveway

opposite Manor Avenue, which will require a minor widening of Ridge Pike; and

WHEREAS, the County is in the process of making improvements

to Ridge Pike that will require acquisition of the Right-of-Way in the immediate area; and

WHEREAS, the property owners are desirous of dedicating this

Right-of-Way to the County to help facilitate the continued improvements to Ridge Pike.

NOW THEREFORE BE IT RESOLVED by the County

Commissioners that the proper County Officials, in accordance with the authority conferred by law, are authorized to accept the dedication for public use the Right-of-Way owned by the Masonic Village and the Squire Ridge developments, along the north side of Ridge Pike between Barren Hill and Northwestern Avenue; together with the storm sewer lines constructed thereunder.

WHEREAS, the Board of Commissioners have previously adopted Resolution #13-C.308, awarding a contract to Lori Schreiber of Roslyn, Pennsylvania, for a Community Outreach Consultant for the Behavioral Health/Developmental Disabilities Department, for a total amount of $45,000.00, for a period of one (1) year ending October 10, 2014; and WHEREAS, the contract provided the County with options to extend the contract for three (3) additional one (1) year periods; and WHEREAS, Lori Schreiber of Roslyn, Pennsylvania has agreed to extend the contract for a first additional one (1) year period with no increase in price for a total amount of $45,000.00; and WHEREAS, it is the recommendation of the Behavioral Health/Developmental Disabilities Department to extend the contract for a first additional one (1) year period ending October 10, 2015. WHEREAS, the Assets & Infrastructure Department/Roads and Bridges Division has requested to use COSTARS Contract #CN00038338 to purchase Sodium Chloride (Road Salt) for County roads for the 2014-2015 Season; and WHEREAS, the Commonwealth of Pennsylvania has entered into COSTARS Contract with Morton Salt, Inc. of Chicago, Illinois, to supply Sodium Chloride to State Agencies and Political Subdivisions under Act 31, 1971 at State Contract prices; and WHEREAS, the estimated total lump sum price to supply Sodium Chloride (Road Salt) required by the Assets & Infrastructure Department/Roads and Bridges Division is $200,000.00. NOW THEREFORE BE IT RESOLVED, that a contract be authorized with Morton Salt, Inc. of Chicago, Illinois to supply Sodium Chloride (Road Salt), for an estimated total lump sum price of $200,000.00, for the 2014-2015 Season, all in strict accordance with Act 31, 1971 which precludes the need for advertised bidding.

WHEREAS, the Department of Assets and Infrastructure/Roads and Bridges Division has solicited Request for Proposal (RFP 14-25) Bog Turtle Specialist, for a period of two (2) years commencing on date of contract execution and may be extended for three (3) additional one (1) year periods; and WHEREAS, RFP 14-25 was issued to thirty (30) providers and eight (8) responses were received; and WHEREAS, the Department of Assets and Infrastructure/Roads and Bridges Division recommends entering into a contract with Liberty Environmental, Inc. of Reading, Pennsylvania to provide a Bog Turtle Specialist requested under RFP 14-25. NOW THEREFORE BE IT RESOLVED, that the proper County Officials, in accordance with the authority conferred by law, subject to the approval of the County Solicitor, are hereby authorized to enter into a contract with Liberty Environmental, Inc. of Reading, Pennsylvania, for pricing that will not exceed $3,600.00 per survey, for a period of two (2) years commencing on date of contract execution and may be extended for three (3) additional one (1) year periods.

On motion of Commissioner Castor, seconded by Vice Chair Richards, it was unanimously adopted that: WHEREAS, The Montgomery County Department of Behavioral Health/Developmental Disabilities (hereinafter “BH/DD”) provides services for BH/DD clients of Montgomery County; and WHEREAS, BH/DD has determined the scope and extent of such services and the providers listed below have submitted an individual budget, accepted and approved by the BH/DD Administrator and Deputy Administrator of Finance to provide these services for the contract period specified below; and WHEREAS, it is the recommendation of the BH/DD Administrator and Deputy Administrator of Finance to enter into the below listed contracts or amendments with these providers at the prescribed rates and contract periods:

On motion of Commissioner Castor, seconded by Vice Chair Richards, it was unanimously adopted that:

WHEREAS, on March 6, 2014, the Commissioners, by Resolution #14-C.92, agreed to extend the contract for one (1) additional year period with Atlantic Coast Communications NJ, Inc. of Pennsauken, NJ, to provide for installation, testing and maintenance of functional internal building networks (LANs) at County facilities throughout Montgomery County, PA, for the Information and Technology Solutions Department, with a price increase of four (4%) percent, for an estimated total lump sum price of $63,889.28; and WHEREAS, the Information and Technology Solutions Department requests an additional $100,000.00 for supplemental scope of work to existing contract which terminates April 1, 2015. NOW THEREFORE BE IT RESOLVED, that Resolution #14-C.92 dated March 6, 2014, be amended for a new total amount of $163,889.28.

WHEREAS, the Southeastern Pennsylvania Regional Task Force has requested Montgomery County, acting as the fiduciary for the Task Force, purchase 250 licenses for Shared Situational Awareness Software; and, WHEREAS, the Task Force solicited a Request For Proposals for the requested software; and, WHEREAS, Drakontas LLC. submitted a proposal that was deemed most advantageous to the County; and, WHEREAS, the cost for the licenses and required set up is $41,000; and,

WHEREAS, in the event of a bonafide and demonstrable

emergency the Task Force may need additional resources; and,

WHEREAS, this project is being funded under the Homeland Security Grant Program. NOW THEREFORE BE IT RESOLVED, that a contract be authorized with Drakontas, LLC. in the amount of $41,000 for the provision of Shared Situational Awareness Software. Additionally, in the event of a bonafide and demonstrable emergency, the Task Force may allocate an additional $7,000 toward this service for additional surge licenses.

WHEREAS, the Montgomery County Board of Elections has the authority and statutory duty to establish, discontinue and/or change the location of any polling location within the county in accordance with the Pennsylvania Election Code, 25 P.S. § 2726 referring to changes in polling locations; and

WHEREAS, the Montgomery County Board of Elections has complied with all of the applicable statutory obligations by ensuring said polling locations meet all federal Help America Vote Act (HAVA) requirements; and
