The Middlesex County Bar Association Monthly Newsletter We are now deeply entrenched in the Holi- day Season. Normally, this is a time for gath- erings with both family and friends. A time for rushing to crowded retail stores to ϐind the best deals on the perfect gifts. A time for holiday par- ties, ofϐice parties and a time for hu- man interaction. But this is 2020 and this year is anything but normal. We are also deeply entrenched in the sec- ond wave of COVID-19, which has sad- ly derailed our hopes of ϐinally getting back into the courtroom to conduct both criminal and civil jury trials be- fore the end of the year. Chief Justice Rabner’s November 16th Order states that all in-person jury trials and grand jury proceedings will be suspended indeϐinitely. While plans for the return to conducting live jury trials has been placed on hold, over the past months, Judges, courthouse staff and practi- tioners have been working together tirelessly to plan and prepare the courthouse for their return. On November 10th the Middlesex County Bar Association hosted a webi- nar with over 270 attendees entitled “Trying Cases-In-Person under COVID- 19 Restrictions.” The CLE was moder- ated by George Shamy, Esq. and pre- sented by our Assignment Judge, Hon. Michael Toto, as well as Judges Hap- pas, Flynn, Jimenez and Cresitello. The stellar panel explained the newly minted COVID-19 petite juror ques- tionnaire, emphasized the importance of the pre-trial conference, showed photos of the new courtroom layout, and explained how to deal with intro- ducing and publishing evidence. It was an extremely informative CLE, helping us as we migrate through this new era of COVID-19 and created a solid foun- dation upon which to build as we enter the new calendar year and hopefully make our eventual way back to trying cases. The MCBA is thankful for the hard work of all our Judges. We are thankful for the strong bench/bar relationship this County enjoys. Equally important is our support for their judicial inde- pendence. Recently, that very topic has garnered some attention in the media. While the judicial nomination process is by nature political in the sense that judges are nominated by the Governor and conϐirmed by the Senate, we can- not overlook the fact that, as the third branch of government, it is critical to our constitutional system of checks and balances that judges be afforded the right to remain independent. When judges preside over cases and apply the law in the manner they believe most fair and just, even against the popular will of the people, they are doing their job. But when unpopular decisions result in political accounta- bility, what invariably results is the surrender of the administration of im- partial justice. Once considerations outside simply right and wrong and the proper application of the law creep in, judicial independence is threatened. TheMCBAisthankfulforthehardworkofallourJudges.Wearethankfulforthestrongbench/barrelationshipthisCountyenjoys.Equallyimportantisoursupportfortheirjudicialinde-pendence.Recently,thatverytopichasgarneredsomeattentioninthemedia.WhilethejudicialnominationprocessisbynaturepoliticalinthesensethatjudgesarenominatedbytheGovernorandcon irmedbytheSenate,wecan-notoverlookthefactthat,asthethirdbranchofgovernment,itiscriticaltoourconstitutionalsystemofchecksandbalancesthatjudgesbeaffordedtherighttoremainindependent.

Whenjudgespresideovercasesandapplythelawinthemannertheybelievemostfairandjust,evenagainstthepopularwillofthepeople,theyaredoingtheirjob.Butwhenunpopulardecisionsresultinpoliticalaccounta-bility,whatinvariablyresultsisthesurrenderoftheadministrationofim-partialjustice.Onceconsiderationsoutsidesimplyrightandwrongandtheproperapplicationofthelawcreepin,judicialindependenceisthreatened.Judgesmustfeelsecureintheknowledgethattheirdecisionsand

TheinternetandsocialmediahavebecomeprimaryenginesofFirstAmendmentspeech,economicactivi‐ty,andmaintainingsocialandfamilyrelationships.WellbeforeCOVID-19andthepracticeof

physical“socialdistancing,”Americancourtsacknowledgedtheincreasingimportanceofaccesstoacomputer/smartdeviceandtheinternetineverydaylife.Indeed,our“newnormal”amidthepandemic(andconcernsoffuturepandemics)hasacceleratedsociety’sdependenceonsocialnetworks.Inthis“newnormal,”peopleincreasinglyrelyontheirsmartdevicesandinternetac-cessforcompletingeverydayactivitiessuchasbanking,pur-chaseofticketsformasstransportation,groceryshopping,medi-calcare,andincreasingly,accesstosocialmediaplatforms.

Theevolutionofcomputers,smartdevices,andtelecommu-nicationshasresultedinubiquitousengagementine-commerceandsocialmediausageonagrandscale.Today,networkscon-nectusersaroundtheworldinwaysthatwereunfathomabletwentyyearsago,andthepowerofamobilesmartdeviceinthehandsofachilddwarfseventhemostsophisticatedcomputernetworksavailableaslittleas25yearsago.AlthoughthenotionofaccesstosocialmediaasaconstitutionallyprotectedactivityintheUnitedStatesmayhavebeenunforeseentwentyyearsago,courtsnowacknowledgeaccessasabasicright.Thisarticleex-ploresrecentcaselawandthelegaltrajectoryofsocialmediaasaconstitutionallyprotectedactivity.RejectingBlanketBansonSocialMediaAccess

Asdigitaldependencyhasbecomewidespread,courtshavebeenforcedtoaddressthebasicneedforaccesstocomputers,theinternet,andmostrecently,socialmedianetworks.Inthelasttenyears,therehasbeenaseriesofstateandfederalcasesthathaverefutedblanketrestrictionsdenyingaccesstothese.Consequently,nowanyrestrictionsplacedonaccesstocomput-ersandtheinternetmustbeexactinglytailoredto“legitimateandcompellingneedsofsociety”beforeanysuchrestrictionsmaybeimposed.ThecourtsarerecognizingthattheinternetandsocialmediaarenowprimaryenginesofFirstAmendmentspeech,economicactivity,andmaintainingsocialandfamilyre-lationships.RecentCaselawConcerningSocialMediaAccess

AccesstosocialmediaisattheheartoftherecentNewJer-seySuperiorCourtopinioninStatev.R.K.,DocketNos.A-2022-18T2/A-2024-18T2,2020WL1982276(decidedApril27,2020).ItisnocoincidencethatthisopinionshouldissueasCOVID-19becomesastateandnationalhealthemergencyandsocialdistancinghasdramaticallystimulatedpeopletousesocialmediatocommunicateandconnectwiththosephysicallydis-tancedfromthem,includingcolleagues,familyandfriends.

Evenconvictedsexoffenderscannotbesubjecttoa“blanketsocialmediaprohibition”withoutaclearlyarticulatedandspe-ci icjusti ication.Ourcourtshavecon irmedthataccesstosocialmediaisaconstitutionallyprotectedactivitythatmayonlyberestrictedwhensuchprohibitions:(1)arenarrowlytailored,(2)

Givensocialdistancingasthe“newnormal,”andsociety’sincreasingdependenceondigitalparticipationinpolitical,eco-nomicandsocialactivity,accesstotheinternetandsocialmediaisnowrecognizedasanecessarypartoflifeandaconstitutional-lyprotectedactivity.

Mythsaboutwritingabound.Thisisespeciallytrueforlegalwriting.SothismonthI’lltalkabout iveso-calledrulesyoucan—andoftenshould—ignore.Myth#1–JudgesExpectMetoSoundLikeaLawyer

Eventhoughallsortsofbooks,articles,andlegal-edclassestellattorneystoavoidlegalese,it’samazinghowmuchofitstillseepsintobriefsandotherlegalwriting.Indeed,manylegalwritersthinktheyneeditto“soundlikealawyer.” Yetresearchshowstheopposite:Legaleseactuallyturnsjudgesoff.Studiesshowthatbriefswrittenusingtraditionallegaleseareperceivedtobe“substantivelyweakerandlessper-suasive”thanthosewritteninplainlanguage.2Andhere’sthekicker:Thejudgesandtheirstaffswhoparticipatedinthestudyassumed“thattheattorneyswhowroteinlegalesepossess[ed]lessprofessionalprestigethanthosewhowroteinplainEng-lish.”3 Thelesson:Don’tthinkyouneedtosoundlikealawyer.Skipthelegalese.

Myth#2–YouShouldIncludeinYourBriefEverythingYouUncoveredinYourResearch Ireadabriefrecentlywherethewriterspentnineparagraphstalkingaboutthepurposeofastatuteanditslegislativehistory.I iguredthelegalargumentturnedonhowthestatutewouldbeinterpreted.Itdidn’t.Infact,thewriternevereventriedtolinkthestatute’spurposeandhistorytotheargument.Whatawast-edeffort. IfIaskedtheattorneywhyheincludedallthisstuff,I’dproba-blyhearsomethinglikethis:“Iresearchedthelegalissuefordays,andIthoughtitwouldbeimpressivetoshowthedepthofmyresearch.”ButIwasn’timpressed.Thegoalwhenyouwriteabriefissimple:Convincethejudgetoruleinyourclient’sfavor.Everyword,sentence,andparagraphshouldbeusedtopropelthejudgetowardthatresult.

Now,I’mnotsayingjudgesdon’tlookforwell-researchedargu-ments.Theydo.Butwhenyouincludeeverythingyouuncov-eredinyourresearch—whetherrelevanttoyourargumentornot—youmakeyourbrieflesseffective,notmoreeffective.Myth#3–NeverStartaSentenceWith“But”or“And” You’lloftenhearpeoplesaythatyoucan’tuseconjunctionslikeand,or,but,yet,ornortostartasentence.Nonsense. ScanthefrontpagesofTheWallStreetJournal,TheNewYorkTimes,orUSAToday,andyou’llseeplentyofstorieswherepro-fessionalwritersbreakthisso-calledrule.Andforthosewhothinktheformalityoflegalwritingprovidesshelterforit,takealookatopinionsfromtheUnitedStatesSupremeCourt.AsImentionedinmylastcolumn,ChiefJusticeJohnRobertsandJus-ticeElenaKagan,forexample,oftenstartsentenceswiththesesnappytransitions.

HowtoSayIt:LegalWritingThatPersuades

Butforsomereason,despiteitsdebunking,4themythpersists. That’snottosayyouwanttostarteverysentencewiththesetypesofconjunctions(knownascoordinatingconjunctions).Likeanywritingtool,usethemwhentheywork—whentheyhelpmakeyourpointeffectively. Forexample,sayyouwanttospotlightacontrast.Usetheperiodattheendofthe irstsentencetocreateanabruptstop(that’swhatperiodsdo),andthenbeginthenextsentencewithbut:

Before:Mostpeopleenjoywatchinglate‐nighttelevision,butI’mnotmostpeople.

Last year your participation resulted in the collection of $12,650 which the Middlesex County Board of Social Services used to help thirty-seven elderly and disabled individuals residing in Middlesex County. Your kindness gave hope to the mother of an autistic nine-teen year old man; to a Hurricane Maria victim who was still struggling to find a perma-nent home for herself and her children; and to a woman who, after retiring early to care for her ailing mother, fell and fractured a hip and was unable to return to work because of her own medical complications. You helped a blind woman pay an outstanding utility bill. And you provided warm clothing for a family's children. You cared. Thank you for being there for these people.

Financial donations should be received at the bar association office no later than Friday, December 18th.
