Title and commencement. 1.(1) These regulations may be cited as the Merchant Shipping Regulations 1988. (2) These regulations shall come into operation on such day as the Governor may by notice in the Gazette appoint, and different days may be so appointed for different provisions and for different purposes. Safety of Life at Sea Regulations. 2.(1) Subject to sub-regulation (2), the regulations in force in the United Kingdom and specified in the Schedule to these regulations shall mutatis mutandis apply in relation to–

(a) ships registered in Gibraltar to the same extent as if such ships were registered in the United Kingdom, and

(b) ships not registered in Gibraltar while they are in Gibraltar.

(2) The regulations referred to in sub-regulation (1) shall not apply in relation to–

(a) ships of war and troopships; (b) cargo ships of less than 500 tons gross tonnage; (c) ships not propelled by mechanical means; (d) wooden ships of Primitive build; (e) pleasure yachts not engaged in trade; (f) fishing vessels.

(3) The references to the regulations specified in the Schedule shall be construed as references to those regulations as amended or any provisions enacted in substitution therefor from time to time. Modifications. 3. Without derogation of the generality of sub-regulation 2(1) in applying the regulations referred to in that sub-regulation

(a) the references in those regulations to the Secretary of State shall be taken as references to the Minister responsible for shipping;

(b) the references to the Department of Transport shall, unless

inconsistent with the context, be taken as references to the Captain of the Port;

(c) the references to any other officer or authority in the United

Kingdom shall be taken as references to such person or authority as the Minister responsible for shipping may, by notice in the Gazette, determine.
