The purpose of this paper is to consult on proposed changes to the fees charged by the Isle
of Man Ship Registry. The proposals in this consultation will form the basis for new Merchant
Shipping (Fees) Regulations 2022 which will revoke and replace the existing Merchant
Shipping (Fees) Regulations 2020.

Section 1 - Introduction
This paper sets out the Ship Registry’s proposals to change its fees with effect from
1 April 2022.
For 2022/23 the Ship Registry proposes to:
make an inflationary increase of 2% to all existing fees (rounded up/down to the
nearest £1 or £5);
introduce a 15% discount from the annual registration fee for cargo ships,
commercial yachts and passenger ships capable of using alternative fuels;
introduce a 15% discount from the annual registration fee for cargo ships,
commercial yachts and passenger ships capable of using shore-side energy
(“cold ironing”);
introduce fees for pleasure yachts maintaining Large Commercial Yacht Code
compliance;
clarify fees for remote surveys;
introduce specific fees for interim ISPS, ISM and MLC verifications for
commercial yachts;
streamline Company audit fees, specify remote Company audit fees and align
MLC private seafarer and recruitment placement services fees;
clarify that launch or agents fees for mandatory general inspections of cargo
ships are charged at cost; and
remove redundant fee for discharge book.
Section 2 of this paper provides some background and further information about the
proposed changes to the fees.
Section 3 of this paper sets out the schedules from the current fees Regulations
marked with amendments and show the existing fee alongside the new fee.

Section 2 - Changes to Ship Registry Fees
Background
The Ship Registry has been gradually transitioning fees into a ‘front-loaded’ system where
the majority of fees are consolidated into an annual registration fee.
The 1 April 2017 saw a radical change to the way the Ship Registry carries out its flag state
inspections with a significant change to its fees structure to support this. In light of this, no
fees revision was carried out in 2018 to give time for the effects of the changes to be fully
realised.
In 2019 the Ship Registry increased the annual registration fee for cargo ships by 10%,
introduced new fees based on size for pleasure vessels, increased fees for STCW Certificates
and Liability Certificates and increased all other fees by 2%.
In 2020 the Ship Registry increased all fees by 2.6% and no changes were made to ship
registry fees in 2021.
References to “Schedules” in the following section are a reference to the Schedules of the current Merchant Shipping (Fees) Regulations 2020 which are included in section 3 of this paper marked up to show the proposed amendments and the current fee alongside the new fee. Proposal 1 – inflationary increase
The Ship Registry proposes to make an inflationary increase of 2% to all existing fees
charged by the Ship Registry (rounded up/down to the nearest £1 or £5);
Rationale:
Small, regular incremental increases ensure the fees keep pace with inflation.
The cost of operating an international ship register is increasing as IMO
introduces more regulations and greater scrutiny of Flag States (III Code).
Digitisation requires investment in digital platforms to stay ahead of the
competition.
The Ship Registry needs to balance its books to maintain a cost neutral platform.
Proposal 2 – 15% alternative fuel discount from annual registration fees (Schedules
2, 3 & 4)
The Ship Registry proposes to introduce a 15% discount from annual registration fees for
cargo ships, commercial yachts and passenger ships which are capable of using alternative
fuels. The fuels currently identified are:

Liquefied natural gas (LNG)Liquefied petroleum gas (LPG)
Methanol
Bio Fuel
Hydrogen
Batteries
Fuel cell systems
Wind assisted propulsion
Ammonia
Rationale:
The Ship Registry is committed to supporting ship owners and operators that are investing
in green technology including alternative fuel technologies which reduce emissions, are
considered to be bridging fuels (those fuels that reduce emissions but are not carbon free)
or are zero carbon fuels.
Proposal 3 – 15% shore – side energy discount from annual registration fees
(Schedules 2, 3 & 4)
The Ship Registry proposes to introduce a 15% discount from the annual registration fee for
cargo ships, commercial yachts and passenger ships capable of using shore-side energy
(cold ironing) to provide continuous electrical power to the ships emergency equipment,
refrigeration, cooling, heating, lighting and other equipment while the ship is at berth with
its main and auxiliary engines turned off.
Rationale:
The Ship Registry is committed to supporting ship owners and operators that invest in green
technology including ship and yacht systems that use shore-side energy (SSE), which has
the potential to eliminate ship engine emissions in port waters, reducing pollutants and
greenhouse gas emissions.
Note:
The existing 10% MARPOL Annex VI EEDI discount and the new 15% alternative fuel and 15% shore side energy discounts from the annual registration fees for cargo ships, commercial yachts and passenger ships are not cumulative. For a ship which meets more than one of these discount criteria, one discount (whichever is the higher), is applied to the annual registration fee.

Proposal 4 - pleasure yachts maintaining Large Commercial Yacht Code
compliance (Schedule 6)
The Ship Registry proposes to include a new provision in Schedule 6 of the fees Regulations
for Pleasure Vessels which maintain large commercial yacht code compliance. A pleasure
yacht which maintains large commercial yacht code compliance shall pay fees in accordance
with the survey and certification fees specified for a commercial yacht in Schedule 3
paragraphs 7 to 35. This does not affect the annual registration fee for a pleasure vessel
which shall continue to be paid at the same rate as a pleasure vessel.
Rationale:
The Ship Registry is currently working on proposals to enable a large yacht which is
predominantly registered as a pleasure vessel to more easily change its registration to a
commercial yacht for the purpose of undertaking commercial charters.
It is expected that a yacht taking advantage of this new scheme will still be registered as a
pleasure yacht for the majority of the time with occasional changes of registration to a
commercial yacht. A pleasure yacht which wishes to change its registration and operate as a
commercial yacht must be built to the same standards as a commercial yacht and be subject
the same survey regime – i.e. be in Large Commercial Yacht Code compliance.
As these types of yachts require the same survey and certification services as a commercial
yacht the fees for survey and certification services are charged at the same rate as for
commercial yachts.
Proposal 5 – fees for remote surveys
The Ship Registry proposes to clarify fees for surveys which are conducted remotely. The
general principal which is being applied is to charge the same fee for a remote survey as for
a “boots on deck” survey.
The existing fees Regulations were not drafted with remote surveys in mind, but in most
instances it is only necessary to remove phrases such as “the fee to attend” from the
Regulations in order to clarify that the specified fee applies to the provision of the service
remotely or in person.
Remote surveys fees have been specified in the fees Regulations (Schedules 2 and 3) for:
Cargo ships – pre-registration surveys, initial general inspections and additional
inspection fees; and
Commercial Yachts – other inspections, verifications and surveys
Rationale:
The Ship Registry has made major progress and invested in the use of remote survey
technology during the last few years. Remote surveys are expected to continue as part of the

overall package of services provided by the Ship Registry so we are taking this opportunity to
review and clarify the fees Regulations to reflect the use of remote surveys.
Proposal 6 - interim ISPS, ISM and MLC verifications for commercial yachts
(Schedule 3 new paragraphs 31 -34)
The Ship Registry proposes to introduce a specific fee of £105 per hour for the conduct of a
remote interim ISPS, ISM and MLC verifications of a commercial yacht. The fee for an in
person ISPS, ISM or MLC verification remains at £3,490 (+2% increase for 2022 = £3,560).
Rationale:
Interim ISPS, ISM and MLC verifications of commercial yachts are typically carried out at the
same time as other major inspections and are currently charged as a block fee of £3,490.
There are some circumstances however where an interim ISPS, ISM or MLC verification is
required on its own, for example when a commercial yacht changes manager. These
verifications are now most likely to be conducted remotely and a specific remote ISPS, ISM or
MLC verification fee of £105 per hour has therefore been added to the Regulations.
Proposal 7 - Company audit fees and MLC private seafarer and recruitment
placement services fees (Schedule 7)
(a) The Ship Registry proposes to streamline fees for Company audits conducted
outside of IOM, UK, Channel Islands or Republic of Ireland to £2,990.
Rationale:
Current fees for Company audits are set on a sliding scale depending on where in the world
the Company is based - for example, the fee to conduct a Company audit in Europe is
£2,930 and the fee to conduct the audit of a Company based in Australia is £4,430 (with
Surveyor travel charged at cost). The Ship Registry proposes to consolidate the fees for
audits conducted anywhere other than the IOM, UK, Channel Islands or the Republic of
Ireland into a standard fee of £2,990.
(b) The Ship Registry proposes to introduce remote Company audit fees of –
£750 for a Company based in the IOM; and
£2,050 for a Company based anywhere other than the IOM.
Rationale:
The remote audit fee of £2,050 is introduced based on the fee charged to conduct a
Company audit in the UK and will apply regardless of where in the world the Company is
based (other than IOM).
To encourage and support local companies providing ship management services from the
Island the fee for an audit of a Company based in the Island (remote or in person) will be
charged at the rate of £750.

(c) The Ship Registry proposes to align the MLC private seafarer and recruitment
placement services fee to £105 per hour.
Rationale:
The current fee for a MLC recruitment and placement services inspection is £96 per hour
and is increased to £105 to bring it into line with other hourly fees specified in the
Regulations.
Proposal 8 - launch fees and agents fees for cargo ship mandatory general
inspections (Schedule 2 new paragraph 15)
The Ship Registry proposes to clarify that any launch fees or agent’s fees for mandatory
general inspections of cargo ships will be charged at cost.
Rationale:
Cargo ships pay a consolidated annual registration fee for the provision of most technical
services including the conduct of mandatory general inspections. Whilst this fee was
intended to cover the cost of general surveyor travel there is occasionally some confusion
over whether the annual fee also includes the cost of launch fees. Launch fees are incurred
when a ship is not alongside and a launch is required to transport the surveyor from the
port to the ship/ship to the port - for example - a helicopter transfer or a rib launch.
For clarity it is proposed to specify that any launch fees incurred will be charged at cost to
the shipowner. That Agent’s fees will also be charged at cost to the shipowner is also added
for completeness.
Proposal 9 – seafarer’s discharge books (Schedule 9)
The Ship Registry proposes to remove the fee for discharge books.
Rationale:
The Ship Registry stopped issuing seafarer’s discharge books in 2019.

Coming into Operation: 1 April 2022
The Department for Enterprise, with the consent of Treasury, makes the following
Regulations under section 17(1) of the Merchant Shipping (Miscellaneous Provisions)
Act 1996.
1 Title
These Regulations are the Merchant Shipping (Fees) Regulations 2022.
2 Commencement
If approved by Tynwald, these Regulations come into operation on 1 April 2022.
3 Interpretation
Schedule 1 defines the terms used in Schedules 2 to 12.
4 Fees payable
The fee payable for a service or other function described in Schedules 2 to 12 is
the fee –
(a) specified in the Schedule in relation to that service or function; or
(b) otherwise determined under the Schedules.
5 Revocation
The Merchant Shipping (Fees) Regulations 20201 are revoked.

INTERPRETATION
In these Regulations —
“agents’ fees” means any fees charged by the vessel’s agent in providing
assistance to a surveyor when travelling to a vessel;
“alternative fuel” means LNG, LPG, methanol, ammonia, bio fuel, hydrogen,
hydrogen power to fuel (PtF), fuel cells, battery systems or wind;
“Americas zone” means any of the countries or offshore areas illustrated in
Schedule 12 as being part of the Americas zone;
“Asian zone” means any of the countries or offshore areas illustrated in Schedule
12 as being part of the Asian zone;
“Australasian zone” means any of the countries or offshore areas illustrated in
Schedule 12 as being part of the Australasian zone;
“cargo ship” means any ship which is not a passenger ship, pleasure vessel,
fishing vessel, small ship or commercial yacht;
“certificate of compliance for a large charter yacht” means a certificate of
compliance issued in accordance with the Large Commercial Yacht Code;
“commercial yacht” means a vessel which is registered or to be registered in the
Island under Part I or Part IV of the Merchant Shipping Registration Act 1991
and which is or is to be certificated in accordance with the Large
Commercial Yacht Code;
“Company” means —
(a) the owner of the ship; or
(b) any other organisation or person such as the manager, or the
bareboat charterer, who —
(i) has assumed the responsibility for operation of the ship
from the owner of the ship; and
(ii) on assuming such responsibility, has agreed to take over all
the duties and responsibility imposed by the ISM Code;
“Company ISM document of compliance audit” or “Company audit” means an
audit to verify a Company has and operates a safety management system
in accordance with the requirements of the ISM Code;
“Company ISM document of compliance” means a document of compliance
issued in accordance with the ISM Code, Part B, section 13;
“CSR” means a continuous synopsis record required by SOLAS Chapter XI-1
regulation 5;

“demise in registration” means registration of a vessel under Part IV of the
Merchant Shipping Registration Act 1991 (the demise Register);
“demise out registration” or “demised out” means registration of a Manx ship
in a compatible register in accordance with Part III of the Merchant
Shipping (Demise Charter Register) Regulations 19912;
“Department” means the Department for Enterprise;
“DMLC” means a declaration of maritime labour compliance issued in
accordance with Part 20 or Part 21 of the Merchant Shipping (Maritime
Labour Convention) Regulations 20133;
“European zone” means any of the countries or offshore areas illustrated in
Schedule 12 as being part of the European zone;
“fishing vessel” means a vessel registered or to be registered under Part III of
the Merchant Shipping Registration Act 1991;“gt” means gross tonnage;
“high speed craft safety certificate” means a certificate issued in accordance
paragraph 1.8.1 of the International Code of Safety for High Speed Craft
(HSC Code);
“IMO” means the International Maritime Organization;
“initial general inspection” means the inspection required by regulation 30 of
the Merchant Shipping (Survey and Certification) Regulations 2018;
“interim MLC certificate” means an interim certificate issued in accordance with
Part 20 of the Merchant Shipping (Maritime Labour Convention)
Regulations 2013, but does not include a DMLC;
“interim safety management certificate” means an interim certificate issued in
accordance with the ISM Code, Part B section 14;
“interim ship security certificate” means an interim certificate issued in
accordance with the ISPS Code, Part A section 19.4;
“ISM” or “ISM Code” means the International Management Code for the Safe
Operation of Ships and for Pollution Prevention (International Safety
Management Code), including all amendments made to that Code up to
and including those adopted by IMO resolution MSC.353 (92) on 21 June
2013 which came into force 1 January 2015;
“ISPS” or “ISPS Code” means the International Ships and Port Facility Security
Code adopted by Resolution 2 of the Conference of Contracting
Governments to the International Convention for the Safety of Life at Sea,
1974, on 12 December 2002 and which came into force on 1 July 2004, and

SD 552/99 , SD 269/04, SD 523/04, SD276/06, SD 818/06, SD 2014/0065, SD 2014/0238,

includes all amendments made to that Code up to and including those
adopted by IMO Resolution MSC.196 (80) on 20 May 2005 which came in
to force on 1 January 2009;
“Large Commercial Yacht Code” means Part A of the Red Ensign Group Yacht
Code January 2019 edition;
“major conversion” means a conversion of a vessel –
(c) which substantially alters the dimensions of a vessel; or
(d) which changes the type of the vessel; or
(e) the intent of which in the opinion of the Department is substantially
to prolong its life; or
(f) which otherwise so alters the ship that, if it were a new vessel, it
would become subject to the relevant existing vessel;
“mandatory general inspection” means the inspection required by regulation 31
of the Merchant Shipping (Survey and Certification) Regulations 2018;
“Manx ship” has the meaning given by section 1 of the Merchant Shipping
Registration Act 1991 and includes a ship registered under Part IV of that
Act (the Demise Charter Register);
“Maritime Labour Convention” or “MLC” means the Convention adopted on
the 23 February 2006 by the General Conference of the International
Labour Organization in Geneva, as amended by the 103rd session of the
International Labour Conference on 11 June 2014, which came into force
on 18 January 2017;
“Middle Eastern and Africa zone” means any of the countries illustrated in
Schedule 12 as being part of the Middle Eastern and Africa zone;
“MLC certificate” means a certificate issued in accordance with Part 20 of the
Merchant Shipping (Maritime Labour Convention) Regulations 2013 and
includes a DMLC;
“passenger” means every person carried on a ship other than –
(a) a person who is employed or engaged or works in any capacity on-
board the ship on the business of the ship; and
(b) a child under one year of age;
“passenger ship” means a ship which carries more than 12 passengers;
“passenger ship safety certificate” means a certificate issued in accordance with
SOLAS Chapter I regulation 12;
“pleasure vessel” has the meaning given by regulation 6 of the Merchant
Shipping (Pleasure Vessel) Regulations 20034;

“pre-registration survey” means the survey required by section 7 of the Merchant
Shipping Registration Act 1991;
“Register” means the register of ships kept in accordance with Parts I to IV of the
Merchant Shipping Registration Act 1991;
“safe manning document” means a document issued by the Department in
accordance with regulation 9 of the Merchant Shipping (Manning and
STCW) Regulations 20145;
“safety management certificate” means a certificate issued in accordance with
the ISM Code, Part B section 13.7;
“safety management system” means a structured and documented system
enabling Company personnel to implement effectively the Company
safety and environmental protection policy;
“ship security certificate” means a certificate issued in accordance with the ISPS
Code, Part A section 19.2;
“ship security plan” means the ship security plan required by the ISPS Code, Part
A section 9;
“small ship” means a ship registered or to be registered in the Island under Part
II of the Merchant Shipping Registration Act 1991;
“SOLAS” means the International Convention for the Safety of Life at Sea 1974
as adopted on the 1 November 1974 by the IMO International Conference
on Safety of Life at Sea, as amended by the 1988 Protocol which came into
force on 3 February 2000;
“technically managed from the Island” means –
(a) for ships of 500gt and over where the responsibility for the
operation of the ship and all the duties and responsibilities
imposed by the ISM Code are undertaken by the Company from
the Island; or
(b) for ships under 500gt where the day to day operation of the ship is
undertaken from the Island which includes –
(i) the statutory certification of the ship;
(ii) the operational safety of the ship;
(iii) the manning of the ship; and
(iv) anti-pollution measures,
“travel day” means a day where a surveyor is travelling to the location of the
vessel or office and during which no survey work is undertaken;
“waiting day” means a day where a surveyor has travelled to the location of the
vessel or office and is unable to commence work;

“working day” means 10 hours in a 24 hour period or any part of 10 hours
worked by a person; and
“wreck removal insurance certificate” means a certificate issued in accordance
with Article 12(2) of the Nairobi International Convention of the Removal
of Wrecks 2007 adopted in Nairobi on 18 May 2007.

CARGO SHIPS
ANNUAL REGISTRATION FEE
(1) Subject to paragraph (6), an annual registration fee is payable by all cargo
ships which are on the Register on the 1 April of each year in accordance
with Table 1.
(2) For a cargo ship which registers on a day other than the 1 April of a year,
the annual registration fee is payable on a pro-rata basis calculated daily
from the date of registration up to and including the next 31 March.
(3) A discount of 10% is applied to the annual registration fee specified in
Table 1 for a cargo ship which on the 1 April of that year exceeds the
MARPOL Annex VI EEDI reductions factors specified in Schedule 11,
Table 15.
(3) Subject to paragraph (4), the following discounts are applied to the annual
registration fee specified in Table 1 –
(a) a discount of 10% for a cargo ship which on the 1 April of that year
exceeds the MARPOL Annex VI EEDI reduction factors specified
in Schedule 11, Table 15; or
(b) a discount of 15% for a cargo ship capable of using alternative fuel;
or
(c) a discount of 15% for a cargo ship capable of using shore-side
energy (cold ironing) to provide continuous electrical power to the
ships emergency equipment, refrigeration, cooling, heating,
lighting and other equipment while the ship is at berth with its
main and auxiliary engines turned off.
(4) Where a ship meets more than one of the discount criteria specified in sub-
paragraphs (3)(a), (b) or (c) only one discount (whichever is the higher), is
applied to the annual registration fee.
(5) The annual registration fee is non-refundable.
(6) Paragraphs (1) to (5) of this Schedule do not apply to a demised out cargo
ship.

DEMISED OUT ANNUAL REGISTRATION FEE
(7) An annual registration fee of £2,095 £2,135 is payable by all demised out
cargo ships which are on the Register on the 1 April of each year.
(8) To avoid doubt, for a demised out cargo ship which registers on a day
other than the 1 April, the annual registration fee is due on the next 1 April
and is not payable on a pro-rata basis.
(9) A discount of 50% is applied to the annual registration fee specified in
paragraph (7) for a demised out cargo ship which is technically managed
from the Island.
(10) The annual registration fee is non-refundable.
PRE-REGISTRATION SURVEY, INITIAL GENERAL INSPECTION AND
ADDITIONAL INSPECTION FEE
(11) The fees to attend and carry out for a pre-registration survey, initial
general inspection or additional inspection will be charged in accordance
with Table 2.
(12) For the purposes of this Schedule, an additional inspection of a cargo ship
is any visit to a cargo ship to conduct any inspection, verification or survey
other than –
(a) a pre-registration survey, initial general inspection or mandatory
general inspection;
(b) an interim, initial, intermediate or renewal verification for
compliance with the ISPS Code;
(c) an interim, initial, intermediate or renewal verification for
compliance with the ISM Code; and

COMMERCIAL YACHTS
ANNUAL REGISTRATION FEE
(1) An annual registration fee of £2,095 £2,135 is payable by all commercial
yachts which are on the Register on the 1 April of each year.
(2) To avoid doubt, for a commercial yacht which registers on a day other
than the 1 April, the annual registration fee is due on the next 1 April and
is not payable on a pro-rata basis.
(3) A discount of 50% is applied to the annual registration fee specified in
paragraph (1) for a commercial yacht which is technically managed from
the Island.
(4) A discount of 10% is applied to the annual registration fee specified in
paragraph (1) for a commercial yacht which on the 1 April of that year
exceeds the MARPOL Annex VI EEDI reductions factors specified in
Schedule 11, Table 15.
(4) Subject to paragraph (5), the following discounts are applied to the annual
registration fee specified in paragraph (1) –
(a) a discount of 10% for a commercial yacht which on the 1 April of
that year exceeds the MARPOL Annex VI EEDI reduction factors
specified in Schedule 11, Table 15; or
(b) a discount of 15% for a commercial yacht capable of using
alternative fuel; or
(c) a discount of 15% for a commercial yacht capable of using shore-
side energy (cold ironing) to provide continuous electrical power
to the yachts emergency equipment, refrigeration, cooling, heating,
lighting and other equipment while the yacht is at berth with its
main and auxiliary engines turned off.
(5) Where a yacht meets more than one of the discount criteria specified in
sub-paragraphs (4)(a),(b) or (c) only one discount (whichever is the
higher), is applied to the annual registration fee.
(6) The annual registration fee is non-refundable.
FIXED FEE - NEW BUILD OR MAJOR CONVERSIONS
Commercial yacht under 500gt
(7) A new build or major conversion commercial yacht under 500gt may elect
to pay for the services and certificates specified in paragraph (9) as a fixed
fee.
(8) The fixed fee will be charged in accordance with Table 3.

(9) The fixed fee entitles the yacht to –
(a) an initial visit by the Department to the yard;
(b) a mid-term survey visit by the Department at the yard;
(c) a visit by the Department at the yard to conduct -
(i) a pre-registration survey or an initial general inspection;
(ii) an initial survey for compliance with the Large Commercial
Yacht Code; and
(iii) an inspection for compliance with MLC,
(d) the approval of the crew accommodation arrangements in
accordance with MLC;
(e) an assessment of the proposal for safe manning;
(f) the issue of –
(i) a certificate of compliance for a large charter yacht;
(ii) a safe manning document; and
(iii) an interim MLC certificate ( if requested).
(10) The fixed fee includes the cost of surveyor’s travel and subsistence except

(a) any port to ship or ship to port transfers; and

(11) To avoid doubt, the fixed fee does not include any classification society
fees.

COMMERCIAL YACHT FEES SCHEME
(19) A Manx ship which is a commercial yacht –
(a) of 500gt or over after successful completion of an initial ISM
verification; or
(b) under 500gt after successful completion of an initial MLC
inspection,
will be entered into the commercial yacht fees scheme and pay fees of £230
£235 per month.
(20) The commercial yacht fees scheme entitles a yacht to –
(a) two inspections by the Department in a 5 year period, to each
include (where relevant) –
(i) the conduct of intermediate or renewal verifications for
compliance with the ISM Code;
(ii) the conduct of intermediate or renewal verifications for
compliance with the ISPS Code;
(iii) the conduct of intermediate or renewal inspections for
compliance with MLC;

(iv) the conduct of any single periodical or renewal survey for
compliance with the Large Commercial Yacht Code; and
(v) the conduct of a mandatory general inspection,
(b) the issue of any certificate, document of compliance, report or
DMLC associated with paragraph (a), except for a CSR; and
(c) the issue of any ships statutory certificate replacing one previously
issued by the Department, except for –
(i) a CSR; or
(ii) the re-issue of a ships statutory certificate resulting from a
change to any of the particulars recorded on the CSR.
(21) The commercial yacht fees scheme includes the cost of surveyor’s travel
and subsistence except for –
(a) any port to ship or ship to port transfers; and
(b) any agents’ fees.
(22) Fees paid under this Schedule whilst the yacht is in the commercial yacht
fees scheme are non-refundable.
(23) The commercial yacht fees scheme does not include –
(a) the assessment and issue of any exemption certificate;
(b) the extension of any certificate;
(c) the assessment and issue of any letter of comfort, dispensation,
waiver or alternative arrangement; or
(d) any certificate of financial insurance for civil liability for oil
pollution damage (for example CLC or Bunkers) or a wreck
removal insurance certificate.
(24) If a surveyor has travelled to the location of a yacht, for each day after 1
day that a surveyor is kept waiting and is unable to commence work, an
additional fee of £545 £555 per day is payable.
OTHER INSPECTIONS, VERIFICATIONS AND SURVEYS
(25) The fee to attend and carry out –
Subject to paragraphs (26) and (31), the fees for -
(a) a pre-registration survey or initial general inspection;
(b) an interim or initial ISPS Code verification;
(c) an interim or initial ISM Code verification;
(d) an interim or initial MLC verification; and
(e) the initial Large Commercial Yacht Code survey,
will be charged in accordance with Table 5.

(26) The fee in Table 5 includes the conduct of any inspection, verification or
survey specified in paragraph (25) which is carried out on a yacht during
the same visit by the surveyor or during the same remote survey.
(27) The fee to attend and carry out any additional inspection of a commercial
yacht will be charged in accordance with Table 5.
(28) For the purposes of this Schedule, an additional inspection of a
commercial yacht is any visit to a yacht to conduct any inspection,
verification or survey other than –
(a) a pre-registration survey, initial general inspection or mandatory
general inspection;
(b) an interim, initial, intermediate or renewal verification for
compliance with the ISPS Code;
(c) an interim, initial, intermediate or renewal verification for
compliance with the ISM Code;
(d) an interim, initial, intermediate or renewal inspection for
compliance with the MLC Convention;
(e) the inspection for compliance with the MLC Convention specified
in paragraph (9)(c)(iii) for a commercial yacht under 500gt; or
(f) an initial, periodical or renewal survey for compliance with the
Large Commercial Yacht Code.

These Regulations prescribe the fees charged by the Isle of Man Ship Registry,
Department for Enterprise. They revoke and replace the previous fees Regulations
SD2020/0106 Merchant Shipping (Fees) Regulations 2020 and come into operation on 1
April 2022.
