When buying a property, the title to thatproperty will either be a freehold orleasehold title. Your property lawyer will beable to advise you whether your property isa freehold or leasehold title.

Purchasing a property with a freehold titlemeans that you will own an estate in land andare able to have ownership for an indefiniteduration. The holder of an estate in fee “simpleabsolute in possession” is known as a“freeholder”.

Purchasing a property with a leasehold titlemeans that you will own an estate in landwhich will be for a fixed maximum duration.Therefore an interest in a leasehold title will befor a limited period. A term of years absolute isknown as a “lease or leasehold” estate and iscarved out of the freehold estate.

It is usual for flats to be held with a leaseholdtitle. In such cases the landlord (thefreeholder) or their appointed agent maycollect an annual ground rent and sometimescharge a monthly fee known as a servicecharge. Such costs are attributable towards

the upkeep and maintenance of any structuralparts or common areas of a development.

As a leasehold title is for a limited period oftime, it is essential to ensure that you have agood term of years left to run on the lease.Ideally a lease will have initially been grantedfor a term of 999 or 125 years. The longer thelength of term left to run on a lease isobviously more attractive to any futurepurchaser of a property. It is also essential forlending purposes where a buyer may need amortgage to facilitate a purchase of aleasehold title. It is usual for a high streetlending institute to require a minimum of 70years unexpired lease term from the date ofthe mortgage. If a term of years is less than70 years, then ideally you would want toapproach your Landlord to enter into a leaseextension of the term of years. However, giventhe complex nature of Landlord and Tenantlaw, it would be advisable to instruct yourproperty lawyer to act in this capacity for you.

The governmenthas amended theTaxation ofPensions Bill,paving the wayfor inheritablepensions.At the end of September the Chancellorsurprised many people by announcing at theConservative Party conference new rules fortreatment of money purchase death benefitsfrom April 2015. Among those caught on thehop was the Treasury, which issued a rushedpress release that was widely criticised asconfusing matters further.

In mid-October the government introducedthe Taxation of Pensions Bill to parliament,but this made fewer changes to deathbenefits than had been suggested by the MrOsborne and the Treasury. The missing detailemerged in early November with a raft ofamendments tabled by David Gauke, FinancialSecretary to the Treasury. The main effect ofthese for money purchase pension schemes isthat from 6 April 2015:

On death before age 75:•There will normally be no tax charge on anylump sum payment, whether or not an incomewas being drawn;•Alternatively any unused or drawdown fundremaining on death may be used to providetax-free flexi-access drawdown income for anydependant(s) or nominee(s) of the deceased.

If death occurs on or after age 75:•There will generally be a flat 45% tax chargeon any lump sum payment;•Alternatively the fund remaining on death maybe used to provide taxable flexi-accessdrawdown income for any dependant(s) ornominee(s) of the deceased.

•On the death of a flexi-access drawdownrecipient, be it a dependant or nominee, theoptions (and tax treatment) are the same forpassing on the residual fund to therecipient’s nominee(s).

•The same tax rules will apply thereafter toall successive beneficiaries as the fundmoves down through generations, until it ispaid out as a lump sum or exhausted bywithdrawals.

The consequences of these changes are stillbeing thought through and you should notconsider taking any action until the legislationis finalised. However, it does already appearthat the estate planning role of pensions is setto increase further and your existing pensiondeath benefit strategies may need to bereviewed.

Every year we make New Year Resolutions,which may be one or a collection of goodintentions to change. Perhaps do less ormore, whether that’s eating better, gettingfitter, being stressed, being calmer or gettingrid of phobias. For all these good intentions,old routines, beliefs and habits can have adetrimental effect on our chances of success.

Expectations play a large part too and if theyare too high this causes problems whenprogress is less than expected. It’s at thistime when we’re likely to give up, decide itcan’t be done and return to our old ways.Realistic goals are essential as there is nopoint expecting to achieve what’s unlikely ortoo difficult. Regular and positive successesreally help to keep us on track and motivated.

Mind coaching and therapy, which includeshypnotherapy and NLP, can help us makeour resolutions become reality. The strategiesand therapies are effective and gentlemethods of changing old routines, habits andbeliefs. It’s very similar to upgrading oldsoftware or changing an old record for a moreup to date and useful one.

The major part of our beliefs, habits androutines are held in our minds. These are theareas that need to be improved in order tohelp give ourselves a much better chance ofsuccess. Mind therapy is a very useful tool forthis.

We head into 2015 with sometrepidation. As many will be aware, milkprices have fallen significantly since thistime 12 months ago and are expected tocontinue to drop well into 2015.

Although only a smallpercentage of UKproduction is tradedinternationally,commodity prices doinfluence the pricethat we receive. Theworld currently hassurplus productionand the UK iscontributing to this,as we, along withother EU countries,prepare for life without milk quotas.Supermarket price pressure do not help thedomestic market either.

As members of Long Clawson Dairy, wehave been given - and taken up - the optionof locking our milk price for several monthsgoing forward. As long as we produceroughly to our forecast, at least we knowjust about what our income will be until themiddle of summer.

Grain prices have also been low thisseason, although this helps the dairyenterprise as feed costs are reduced. Weare feeding wheat to the cows now, and wesell what is left over in the summer. At leastwe will have a good volume to sell - for theprevious harvest we ended up buying wheatin as our harvest was so poor.

Farmers also face significant change in thesupport payment regime, as the SinglePayment changes to the Basic Payment.Perhaps more worrying than this is that weare the ‘guinea pigs’ for a change insecurity access for online governmentschemes. Anyone who uses GovernmentGateway – eg for self assessment taxreturns, business VAT or PAYE, an in ourcase, cattle movements, single paymentand other agricultural applications – willundergo this change, but the BasicPayment system is the first to adopt it.Reports so far are extremely worrying, withthe earliest tranches of beta testers being

left frustratedand unable toverify theiridentities online– usingestablishedcredit checkingagencies -despite callingthe helplines. Atelephoneapproach is nowbeing trialled,hopefully

everything will be resolved before we needto submit Basic Payment applications.

As I write this between Christmas and NewYear, the snow and frost are still with us,beautiful to look at although making morework. We have been very fortunate withmild weather to date, enabling us to keepdry cows outside grazing – now beingsupplemented with hay. An early start to thegrazing season will help keep milkproduction costs down, but are we in for alate, cold snap delaying spring growth?

34 Blissful bedroomsYour bedroom is a retreat, a special placein which to relax, unwind and express yourtrue personality. Our tips will help youmake it as comfortable, functional andbeautiful as possibleFirst, think about how you useyour bedroom – is it just forsleeping, or do you listen tomusic, watch TV, makephone calls or even work?You will need to allocatespace for each differentfunction. Then, consider theatmosphere you want tocreate – would you prefer a light, bright andairy room, or one that is dark and dramatic? Ingeneral, soft and gentle colours areconsidered most restful, and it is a good ideato avoid loud patterns and clashing shades. Afeature wall (perhaps behind the bed head),with either one strong paint colour or aninteresting wallpaper pattern, can be a greatway to provide interest without going over thetop.

In high-traffic areas such as halls and livingrooms, carpet (if used at all) needs to be hard-

wearing and practical. In a bedroom, however,wear and tear is not such a factor, spills arenot such a risk and bare feet are more likely tobe the norm. All of which means that this is the

ideal place to give your toes atreat and opt for a sumptuous,deep-pile carpet. That said,natural or painted woodenfloorboards with a few rugsscattered about (on each sideof the bed in particular) is analternative with masses ofcharacter.

Whether you use curtains,blinds or shutters, your windows should bewell-covered, both for privacy and to avoidearly-morning sunlight waking you up.Sumptuous curtains with a blackout lining willdo the trick, as will louvered shutters – whichalso offer an extra element of security. Rollerblinds are plain and simple, and ideal wherespace is restricted, while Roman blinds pull upin lovely soft folds that give an attractivelydraped effect. 35If in doubt, the only way to calculate exactlyhow much storage you need is to take a tapemeasure and calculate square footage for longand short hanging, folded clothes, shoes,blankets, linens and other items. Plan theinterior of a wardrobe with the utmost precision,and look for gadgets such as tie racks, beltracks and pull-out trays. If you’re really short ofspace, clever storage ideas include under-beddrawers, stacking boxes, canvas “tidies” hungon the back of the door, plastic shoe racksstacked inside the wardrobe, and a bambooladder leant against the wall for scarves, sparebed linen or clothes.Subtle, flattering lighting is best for a bedroom,and if yours is not quite how you would like ityou can make some quick, easy andinexpensive changes such as adding a tablelamp or two in the corners, and fitting a dimmerswitch to a central pendant. FOR A REALLY GOOD NIGHT’S SLEEP• Choose as big a bed as you can, asdisturbance from a partner is one of the mostcommon causes of sleeping complaints.

Next time you’re sitting in atraffic jam, or waiting at thelights, take a little look aroundyou – I’m willing to wageryou’ll be surrounded bycountless illuminated, bowedheads of motorists checkingtheir phones.

I’ve found it’s incredibly rare totake a trip with any driverthese days and for them not tofiddle with their phone at leastonce during the journey. Withmusic streaming services likeSpotify working through caraudio systems, social mediastreams constantly pingingaway with notifications, not tomention text messages andemails, the temptation totouch the phone is too hardfor most to resist.Can you honestly say thatyou’ve never touched yourphone while driving? I can’t.

And I’m pretty sure everysingle driver on the roads witha phone will say the same.In fact, a recent survey backsup that theory. British CarAuctions recently quizzed 445motorists and 95 per cent ofthem said they’d seen anotherdriver using a mobile phone.Some 82 per cent of them hadseen someone texting oremailing too and to makematters worse 42 per centadmitted to doing itthemselves.The official advice is to turn itoff, but the problem with thatis phones have becomeintrinsically linked to our cars.Most modern models offerBluetooth connectivity that letsyou take calls at the wheel,stream music from yourhandset, while some even letyou access the web from thecar using your phone’s signal.

Could it be the case that carmanufacturers are sendingout the wrong message? When you’re having aconversation on handsfree areyou REALLY paying attentionproperly? I contacted theAssociation of Chief PoliceOfficers to ask them whatwould happen to a driver whohad an accident while talking,perfectly legally, on ahandsfree kit.

A spokesman said thelikelihood was that the driverwould be prosecuted fordriving without due care andattention or, in more extremecases, for dangerous driving.And it’s already happened.One case in 2008 involvedlorry driver Mervyn Richmond,49, who had been talking tohis mother for 23 minutesusing Bluetooth in his cabwhen he ran into the back of aTransit van, killing itspassenger. He was jailed forfour-and-a-half years for

dangerous driving.Roger Vincent, of the RoyalSociety for the Prevention ofAccidents, told The Daily Mailat the time: ‘When you areusing any mobile while drivingyou are four times more likelyto have an accident.’ FOURtimes.So here’s my idea. I think it’stime for a manufacturer tointroduce a device that stopsyour phone working when theengine is on. A sort ofenforced airplane mode thatmeans no calls, texts, emailsor data can be received, butmusic can still be played if it’splugged in. That port could bein the glovebox, in a box thatis automatically locked whenthe engine is running perhaps.Sounds extreme, I know, butcar manufacturers have aresponsibility to ensure driversknow how dangerous usinghandsfree is, let alone

touching the phone andwriting a text message.It would take a bravemanufacturer to make themove, but marketed correctlyit could be a winner. I actuallylook forward to long haulflights knowing I won’t get asignal and can enjoy somequality time spent unshackledfrom my iPhone. Cars couldbecome the sole isolationzone of the modern world.The only part of yourconnected life that’sunplugged, a location to enjoysome thinking time without thedistraction of Facebook oremails from the boss; a placeto simply enjoy the journey.But is there a car maker braveenough to make the movefirst?

Treat the one you loveon February 14th tosucculent pan-friedsteak with a luxurioussweet red wine sauce.

Serves two

Cook the baby new potatoes in a pan of lightlysalted water for 10-15 minutes until just tender.

Meanwhile, crush the peppercorns coarselyusing a pestle and mortar or the end of a rollingpin. Press firmly over both sides of the steaks.Set a griddle pan over a medium heat to preheat.

Brush both sides of the steaks with oil. Place thesteaks on the hot griddle pan and cook over ahigh heat for 1 minute on each side until seared.Reduce the heat and continue cooking for afurther 2-4 minutes on each side until the steaksare cooked to your liking. Remove the steaksand cover and leave to rest for 2-3 minutes.

Place the redcurrant jelly and red wine in asmall pan and heat gently until the jelly hascompletely dissolved. Stir in the corn flourmixture and simmer for a further minute untilslightly syrupy.

Drain the potatoes, toss with the butter andparsley and season to taste. Spoon the sauceover the steaks. Serve with the potatoes andsteamed vegetables.

Ingredients:• 150g baby new potatoes• 2 tsp black peppercorns• 2 x 250g rib eye steaks, trimmed of excess fat• 2 tsp olive oil• 3 tbsp redcurrant jelly• 3 tbsp red wine• 1 tsp cornflour blended with 1tbsp cold water• 15g butter• 2 tsp fresh chopped parsley

TIP : Sirloin, fillet or rump steak can be used in placeof the rib eye. Make sure both steaks are an eventhickness and always bring the steaks to room tem-perature for about 15 minutes before cooking. Rest-ing the steaks for a few minutes after cooking willalso help to ensure they are meltingly tender.

54Most plants in British gardens are good andhardy, but when conditions becomeparticularly miserable even these may suffer.So whether your garden is already covered insnow and ice, or simply suffering from a slightfrosting, it’s time to make surethat it’s wrapped up warm.

Plants in containers areparticularly vulnerable to winterdamage as their roots are notprotected beneath the soil butinstead are relatively exposedwith only the container and alayer of compost to protectthem. This leaves the roots inserious danger so, if thegarden soil is not frozen solid,plunge pots in water. If it’s too heavy to movethen wrap it up well in several layers of bubblewrap polythene or old curtains – it may notlook pretty but it’ll do the job.Most shrubs and trees in your garden will be‘hardy’ in the UK, able to withstand all but themost harsh weather but if very harsh weatheris forecast or there has been a spell of mildweather which may have encouraged the plantto produce some soft, new growth, then drape

a double layer of horticultural fleece over thetop growth of the plants and anchor it well.A double fleece layer can of course be usedon plants in beds and borders too. Make sureyou weigh down the edges of the fleece well

with bricks, or use metal pegs atintervals along its length. Largerindividual plants in borders canbe given good, individualprotection if you use four sturdycanes to create a framework,wrap with netting or chicken wireand fill the central space aroundthe plant with dry bracken, strawor leaves.Many wall shrubs, for examplethe pineapple broom, are grownin this relatively warm and

sheltered spot because they aren’t thehardiest of plants. To dramatically reduce anyrisk of cold damage you can make a similar‘cage’ of mesh around these and again fill itwith dry material so that the plant insideremains snug. It is essential with any suchprotection that you don’t use materials thatcannot ‘breathe’ or else it may become dampinside and the plants will start to deteriorate.

55Evergreens in containers and in open groundmay suffer from drought as well as foliage orstem growth – during the cold weather theycontinue to need a fair amount of water and ifthis is frozen solid in the soil, they soonsuffer. Deep mulch applied to the soil surfaceon the root area before the ground becomesfrosted will help immensely. During milderspells, if the soil is dry, give them a drink too.

Although most fruit trees such as apples,pears, cherries and plums are definitelyhardy, they are also prone to damage.Although quite tough, the newly openedblossom and the buds themselves may bedamaged, with late frosts being most harmfulbecause the buds are further developed. Afleece cover will help here too. If you live in aparticularly cold part of the country and areplanting new fruit plants buy them from alocal specialist nursery which know localconditions, and try to buy late floweringvarieties where possible.If your garden is inclined to be a bitwindswept, it may be worth investing in somefleecy jackets for your favourite shrubs.These are made from fleece and are likemassive bags, complete with a drawstring atthe open end. Just pop them over the plantand tighten the drawstring. Alternatively use adouble layer of ordinary fleece, such as thetype we offer on my website, wrap it aroundand cut to size before clipping or tying inplace.Outdoor taps and pipework are likely to needprotection too, and if left open to the elementscould result in burst pipes and expensivebills. I suggest turning outside taps off at themains, but if this isn’t feasible or logical, domake sure any exposed pipework is properlyinsulated. Your local builder’s merchant orDIY store is worth a visit for this job - wellinsulated pipes and garden taps could saveyou a fortune.

Every two weeks In Leicestershire we throwaway enough waste to fill the Royal AlbertHall. Becoming a waste action volunteer forLeicestershire County Council, gives you thechance to help stop this by providing yourlocal community with advice on reducing theirwaste.Karen Webb, a waste action volunteer, said:“Once we’re trained, we can focus on areaswe’re interested in. I’ve enjoyed advisingpeople how to use their leftovers, teachingscouts how to compost and use recycledmaterials as well as attending events. 61More than 15,000homes and busi-nesses acrossLeicestershire nowhave access to fibre broadband, thanks to thecounty council and BT’s £18.8 million Super-fast Leicestershire project.

Melton Borough Council is a key partner ofthe project which has already made fibrebroadband available to homes and busi-nesses in Bottesford as well as almost 2,000new homes and businesses in Melton Mow-bray. This builds on BT’s commercial rolloutwhich has already made fibre broadbandavailable to more than 10,500 homes andbusinesses in Melton Mowbray.

Mrs Pam Posnett, Leicestershire CountyCouncil Cabinet Lead for Rural Broadband,said, “We are making excellent progress todeliver our vision that all premises in Leices-tershire can access superfast broadbandspeeds by 2018.“Superfast broadband is critically important toour businesses and communities. It will boosteconomic growth, improve access to servicesand help transform public service delivery.”

Superfast fibre broadband is the new genera-tion of broadband – much faster, more reli-able and it uses a different technology. Whilstmost traditional broadband (known as ADSL)is delivered via copper telephone lines, su-perfast fibre broadband uses fibre optic cableas part of the link between the customer andthe telephone exchange. Through this peoplecan access download speeds of up to50Mbps.

There are lots of benefits to superfast broad-band for both residents and businesses; forexample everything online will be quicker, soif you use services such as iPlayer you won’twaste time while the program buffers. Or, ifyou have several people in a house using theinternet at the same time, there won’t be adrop in service.
