INNOVATION AWARD

Our 2018 Innovation Award went to The Tinnitus Clinic Ltd.

The Tinnitus Clinic is an adult audiology rehabilitation provider with clinics across the UK, who specialise in tinnitus and hyperacusis, both distressing long-term conditions.

The Tinnitus Clinic leads the world in introducing innovative tinnitus treatments to the market place, which are likely to bring benefit to the tinnitus population.

The company has created an online tool for potential patients to self-test their tinnitus tone, unique in its use in supporting pre-appointment thought patterns of the patient.

Identifying what their sound is like, can help a patient describe their condition to both their friends and families and to the clinician, involving the patient in their diagnosis at a very early stage.

“The self-diagnosis tool came about because we are acutely aware that describing tinnitus to either a professional or a close friend or family, is difficult if not impossible for people. This simple tool means that our audiologist has some advance notice of the type of sound the patient is experiencing , therefore giving the tool a clinical purpose. But importantly, it gives the patient ownership of the description and can alleviate anxiety simply because it gives them a language to describe the sound aspect of their symptoms.

“We continue to get excellent results for our tinnitus patients from our selection of evidence based treatments, and we will continue to search for new treatments which we hope can be more accessible to all patients, across all areas of health care.

“Thank you again, The Tinnitus Clinic is really proud to have won this award.- Josephine Swinhoe, Director , The Tinnitus Clinic

Kimal expands its

distribution facilities due

to unprecedented growthKimal Holdings Ltd., is an innovative manufacturer of customised procedure packs and vascular access devices to clinical departments across the world. Last month saw Kimal Holdings Ltd., take ownership of its brand new, purpose built distribution facility at the Worcester Six business park.

Last month saw Kimal Holdings Ltd. take ownership of its brand new, purpose built distribution facility at the Worcester Six business park off of Junction 6 of the M5 Motorway, 25 miles south west of Birmingham. Kimal’s Droitwich-based facility will subsequently close this month, with the team completing their transfer to Worcester Six by the end of March.

Kimal Holdings Ltd., is an innovative manufacturer of customised procedure packs and vascular access devices to clinical departments across the world. It all started in 1964, when Kimal began distributing products for well-known companies such as Cordis; and since then, the Company has grown, manufacturing over 2 million procedure packs and medical devices every year for a range of specialities; and its unique, ground-breaking central venous catheter technology is helping to reduce patient risk in hospitals across the world.

In 2015 it was decided that, due to the unprecedented growth that Kimal had experienced over the previous 5 years, and the subsequent outgrowing of capacity, investment in a new,

larger distribution facility was required. Kimal Holdings Ltd., therefore invested £3 million in the company’s new Worcester Six facility, which covers 140 sq. ft. There are also plans for a further £3 million investment at a later date.

With this new distribution facility, Kimal can continue to achieve double digit growth and it is hoped that with the company’s Worcester Six site now complete, Kimal can achieve its ambitious strategic objectives over the next 5 years.

What were the final items you picked up before leaving home this morning? Chances are that it was your keys. And a smartphone. In 20 years the smartphone has become almost indispensable, helping us in many areas of our lives. It is no longer a device just to call and text: you could argue that it’s a pocket office, replacing the need for a laptop; an entertainment portal, superseding the MP3 player; and a GPS navigation aid which has widely replaced stand-alone Sat-Navs. And then there are the thousands of apps to choose from, enabling us to further personalise the smartphone’s function.

Is it only a matter of time before the smartphone is an integral part of our healthcare regime too?

To date, the number of mobile applications categorised as ‘healthcare’ exceeds 45,000 on both the App Store and Google Play. And after a few years promoting several other health apps, the NHS will be launching its own in December 2018.

So on a practical level, how will the new app benefit patients? It could be as simple as being able to FaceTime a doctor. Telemedicine is a

growing sector, which the NHS is beginning to capitalise on (the official service, GPatHand, is currently restricted to London). Telemedicine takes advantage of the smartphone’s video, audio and GPS capabilities, and may help to reduce waiting times – as well as allowing access to GPs and specialists for those that are unable to travel to appointments.

Again at the lower end of the technological spectrum, the smartphone can be used as a portable reference database – the majority of medical apps on various ‘top ten’ lists are reference apps. As well as exposing the layman to a world of self-diagnosis, these apps can enable a health professional to travel to a patient and still access all of the necessary information.

One area where technology has already significantly transformed healthcare is in the monitoring and treatment of chronic illnesses such as diabetes. 30 years ago, a patient would be checking blood sugars with a urine dipstick and estimating approximate levels against a colour chart. Now, a patient can swipe their mobile over a

sensor in the upper arm and see the last eight hours of data, utilising the NFC capabilities of the more recent smartphones.

This kind of technology (smartphone-as-measuring device) could be, and is being, applied to many different fields. For example, a smartphone can monitor sleep quality using the built-in microphone and/or accelerometer. Simply placing the index finger on the camera can give an instant measurement of the heart rate by detecting a colour change in the finger when the heart beats – like the pulse oximeter found in hospitals.

Self-treatment and diagnosis is on the up and it is difficult to see this slowing any time soon. The smartphone is likely to play a key role in this, especially with the upcoming launch of the NHS app.

For the time being, the app has fairly basic functionality – patients can access their records, order repeat prescriptions and access 111 – all things that can be done over the phone. But the app has the potential to be much more powerful than this.

Perhaps in the future a patient may be able to photograph an injury or blemish and submit it with a few key words within an app. The app could then take advantage of image analysis software and a database stored on the smartphone to determine the most likely issue and remedy, without requiring the input of a professional and without any burden on the NHS.

So how can the intellectual property in these apps be protected? A large number of healthcare and medical apps currently available are reference guides, medication reminders or information logs. On a basic level, these apps would be excluded from patentability because they lack technical subject matter – they are likely to fall under the presentation of information, business method or method of diagnosis exclusions.

However, it is not impossible to patent a healthcare-related app, particularly if the app forms part of a system (such as with a blood pressure or heart rate monitor). Another option to protect an app could be by registering a design or a trade mark, as discussed here in a previous article.

Barker Brettell has a dedicated medical sector group. If you would like to discuss options for protecting your new invention (app or otherwise) please get in touch with one of the team, or contact your usual attorney.

Brexit and the need of an EU authorised representative for

UK medical devices

Membership NewsMEDICAL AND HEALTHCARE BUSINESS AWARDS FEBRUARY 2019

28 29

Of course all this is may be conjecture – and listening to the news may not help – but it looks like after the 29th March 2019 deadline an EU based Authorised Representative (EC Rep) will be needed if UK device businesses export devices to markets where a CE mark is required.

However, if a deal is struck between the EU and the UK, and it is passed by UK Parliament, an implementation period should commence allowing UK manufacturers until 31st December 2020 to continue to supply CE marked devices into the UK market as an alternative to the new proposed MHRA registration.

If they want to continue to sell into the EU, and other markets that demand the CE mark, they will need to appoint an EC Rep. This will need changes to technical information, including, but not limited to, packaging, product labels, IFU’s, brochures, CE Certificate, and Declarations of Conformity - in places where you would be expected to indicate the name and address of an EU based EC Rep.

In the event that UK Parliament votes against a deal that has been agreed between the EU and UK Government the UK could leave the EU immediately. This would mean no implementation period and the EU may not commit to a transition period. Therefore UK device manufacturers could potentially be locked out of the EU until such time that they have appointed an EU based EC Rep and updated device registrations. Therefore the 29th March 2019 could be a critical date.

UK manufacturers should be prepared to move quickly in the event of a no deal Brexit and even if a deal is struck there is no guarantee that EU Competent Authorities, or non UK customers, will accept CE marked devices after any UK only transition period.

Consultants, and particularly Advena Ltd (www.advernamedical.com) who have a second EU address, are available help to assure continuity with an EC Rep based in the EU.

Whether you like it or not, you should brace yourself for Industry 5.0. The term refers to people working alongside robots and smart machines. If that definition brought to mind the image of Will Smith battling evil robots in the movie “I, Robot,” here are a few things you need to know about Industry 5.0.

While science fiction is full of bad machines trying to kill humans or take over the world, in reality, robotics is practical. Think Roomba, the vacuum cleaner, and LoweBot, the robot that helps find or scan products in Lowe’s home improvement stores.

Industry 5.0 is about robots making humans work better and faster. It refers to the necessary interaction between people and machines. In the manufacturing world, robots usually perform monotonous work, such as welding and painting in car factories and loading and unloading heavy materials in warehouses.

The Danish company Universal Robots is the first to manufacture industrial robots that literally work alongside humans. Whereas most industrial robots

work behind safety caging, the company’s robots were first deployed alongside people in 2008.

3 Things to Remember

To understand Industry 5.0, here are three things you need to remember.

#1 Industry 5.0 is about humans, not robots.Robots are designed to help humans and make our lives better. Universal Robots uses the term “cobots” for collaborative robots to emphasize the importance of people in robotic technology.

“Industry 5.0 will make the factory a place where creative people can come and work, to create a more personalized and human experience for workers and their customers,” said Esben Østergaard, Universal Robots chief technology officer and co-founder, in an article published on Enterprise IoT Insights.

He thinks consumers will increasingly demand craftsmanship and personalization of products. Through automation and cobots, the manufacturing process can be streamlined to allow humans to create something special and unique. The use of robots will actually bring back the human factor to manufacturing, according to Østergaard.

#2 Industry 5.0 is meant to optimize human efficiency and productivity.Industry 4.0 is about the interconnectedness

of machines and systems for optimal performance. Industry 5.0 takes such efficiency and productivity further by honing the interaction between humans and machines.

A combined human and robot workforce will call for a new executive role, the chief robotics officer (CRO), who will be responsible for planning and managing all activities related to robotics and intelligent operational systems. A report by Myria Research forecasted that by 2025, more than 60 percent of manufacturing, logistics and supply chain, agri-farming, and the oil, gas and mining sectors will have CROs.

#3 Industry 5.0 is inevitable. When it comes to technology, there’s no turning back. The European Economic Social Committee (EESC) said it best: “The proliferation of robotic automation is inevitable.”

The committee, a European Union (EU) consultative body, acknowledged that Europe lagged behind the United States and China in artificial intelligence, and called for acceleration of artificial intelligence (AI) and robotics development in the region. “The EU should embrace digitalisation wholeheartedly for the sake of consumers, manufacturers, and employees alike,” it said.
