Bill Introduction Deadline a Week AwayFriday, February 26th, is the last day that new bills

can be introduced by members of the Legislature.

As is typically the case, the vast majority of bills

will be introduced over the next week, with the

likely final number reaching close to 3,000 bills

between the two houses.

To ‘date’ myself, “back in the day before

computers,” lobbyists had mail boxes in the Capitol.

We paid for a bill service that physically placed all

of the day’s new bills that came into print in your

box to review. During the last week of new bill

introductions, you would have to go to the front

counter in the bill room to pick up your ‘tower’ of

new bills each day, because the ‘stack’ wouldn’t fit

in your mailbox!! Ah, I can remember it vividly!

The smell of the fresh ink and the feel of being

overwhelmed thinking about having to read each

and every bill in the stack to ascertain whether the

bill had an impact on a client!

“Back in the day,” it was also a time when I had to

physically go to the bill room each day to pick up

a daily file for both the Senate and Assembly. The

daily file was your physical link to keep you posted

on forthcoming hearings on bills based on the date

and the committee(s) or floor (Senate or Assembly).

Times have certainly changed! Now through my

electronic bill service, I simply sit at my desk and

review a summary of each new bill that has been

introduced over the past 24 hours (or whenever it

was introduced) on my computer. For each bill I tag

as being of potential interest to one of my clients, the

system then tracks that bill and I receive all updates

during the remainder of the legislative session

informing me of amendments (which I can read

online), when the bill will be heard, the committee

analysis on the bill and literally, “everything you

ever wanted to know, but were afraid to ask!”

Besides saving countless trees from destruction, it

makes me a better lobbyist since I have access 24/7

to all of the latest information about every bill, and

all of the ‘goings-on’ at the Capitol. Technology

is truly amazing and has certainly had a dramatic

impact on the life of lobbyists and every other

denizen within the Capitol!

IRS Makes it Easier for Small Businesses to Apply Repair Regulations to 2014 and Future YearsThe Internal Revenue Service has made it easier

for small business owners to comply with the final

tangible property regulations.

Requested by many small businesses and tax

professionals, the simplified procedure is available

beginning with the 2014 return taxpayers are filling

out this tax season. The new procedure allows

small businesses to change a method of accounting

under the final tangible property regulations on a

prospective basis for the first taxable year beginning

on or after Jan. 1, 2014.

Also, the IRS is waiving the requirement to

complete and file a Form 3115 for small business

taxpayers that choose to use this simplified

procedure for 2014.

“We are pleased to be able to offer this relief to small

business owners and their tax preparers in time for

them to take advantage of it on their 2014 return,”

said IRS Commissioner John Koskinen. “We

carefully reviewed the comments we received and

especially appreciate the valuable feedback provided

by the professional tax community on this issue.”

The new simplified procedure is generally available

to small businesses, including sole proprietors,

with assets totaling less than $10 million or average

annual gross receipts totaling $10 million or less.

Details are in Revenue Procedure 2015-20, posted

today on IRS.gov.

The revenue procedure also requests comment on

whether the $500 safe-harbor threshold should be

raised for businesses that choose to deduct, rather

than capitalize, certain capital expenses.

Closing the Design-Build Gap between the Public and Private Sectors

Use of the design-build project delivery method has

increased significantly in the United States over

the last decade. According to research findings

released last year by the Design-Build Institute of

America, more than half of all US non-residential

construction projects above $10 million are now

being completed using design-build. These findings

are no surprise given the relative scarcity of

construction funding during the latest recession and

the proven advantages that design-build has over

more traditional delivery methods.

Owners from both the private and public sectors are

drawn to design-build because it streamlines project

delivery through a single contract with a design-

build team that assumes singular responsibility for

completing the project, typically for a fixed price.

Combining design and construction under one

contract allows owners to start working on earlier

construction packages (e.g., civil site work and

foundations) before detailed design is completed

for later construction packages. Among other

advantages, this “fast tracking” provides for a

compressed construction schedule, which reduces a

project’s overall administrative and financing costs.

Combining the design and construction disciplines

also allows for innovation in solving common cross-

disciplinary problems.

Solar Regulation Implementation FAQ Now Available

The League of California Cities has posted on its website a frequently asked questions (FAQ) document for a new law requiring that cities speed up and streamline the permitting and inspection of rooftop solar energy installations. AB 2188 (Muratsuchi) imposes a number of new requirements with which cities must comply before Sept. 30.

The League strongly opposed this measure as it moved through the Legislature and was ultimately signed by Gov. Jerry Brown. For background information on AB 2188 see the article “Citing Climate Issues, Local Solar Processing Mandate Bill Signed.”

The Capitol Connection Q&A for Contractors By Shauna Krause, Capitol Services, Inc.

We ‘fix up’ an answer for a homeowner who plans

on ‘flipping out’ in Newport Beach. Another

contractor is ‘generally’ interested in replacing

his RMO, without being put to the ‘test’ or

disassociating his current Qualifier…

Q: I am 50% owner and President of a painting

company. Our Responsible Managing Officer

(RMO) is not disassociating but I would like to

replace him nonetheless. I have been listed on the

license since it was issued in 2009. I also have an

Inactive “B” (General Building) license. I have

never been the Qualifier for a “C-33” (Painting)

license. Is an exam going to be required?

A: You can request a waiver of the trade exam based

on the fact that you have been listed as an Officer on

the license for over 5 years. Keep in mind that it’s

a request and not automatic, but as long as you can

document the required experience, in most instances

the waiver will be approved.

You can only have one Qualifier for each

classification so if your RMO is not disassociating he

will no longer be listed as an RMO, but he can still

remain on the license as an Officer.

Q: I have worked for a General Building contractor

here in Newport Beach for about 7 years but I don’t

have my own license. I am planning on buying a

“fixer-upper” house and renovating it so that I can

turn around and sell it. Do I need a license to do the

remodel? I was hoping that I would qualify for the

owner-builder exemption.

A: B&P Code section 7044 states that you cannot

qualify for the owner builder exemption if the

improvements are intended for the sale of the

property. In order to self-perform the renovations

I would suggest applying for your own license.

The State requires that you document four years of

experience and since you have worked for a General

Contractor for 7 years, you will likely qualify for a

contractor’s license. If you need further help get back

in touch.

Just FYI, seeing that you reside in Newport Beach,

the CSLB just recently put out a News Release

stating that home remodeling is booming in Orange

County and, that in Costa Mesa, the amount of

building permits pulled has increased 21% over the

past three years.

That being said, the Newsletter went on to report

that the CSLB teamed up with other local agencies

in Orange County to conduct undercover stings

and combat unlicensed activity. The CSLB issued

citations to many unlicensed phony contractors for a

range of criminal acts including unlicensed activity,

illegal advertising, and several were also cited by

Costa Mesa Code Enforcement for not having a city

business license. Needless to say, it is risky business

to do contracting work over $500 without a license!

Stretching

Why stretch?

• Stretching is useful for both injury prevention and injury treatment.

• If done properly, stretching increases flexibility, this can directly translate into reduced risk of injury. A muscle/tendon group with a greater range of motion will be less likely to experience tears when used actively.

• Stretching is thought to improve recovery and may enhance athletic performance.

• Stretching improves your balance, coordination, and circulation. This increases blood flow to your muscles often speeding the recovery process after muscle injuries.

• Flexible muscles can improve your daily performance in tasks such as lifting and bending.

• Stretching promotes better posture. Frequent stretching keeps your muscles from getting tight, allowing you to maintain proper posture and minimize aches and pains.

• Stretching can relieve stress by relaxing the tense muscles that often accompany stress.

• Stretching before work tasks helps you focus on working safely.

• Target major muscle groups: When you are stretching, focus on your calves, thighs, hips, lower back, neck and shoulders.

‒ Stretch muscles and joints that you routinely use at work or play.

• Warm up first: Stretching muscles when they are cold increases your risk of injury, including pulled muscles.

‒ Warm up by walking while gently pumping your arms, or do a favorite exercise at low intensity for five minutes.

‒ Stretch after you exercise — when your muscles are warm and more receptive to stretching.

• Know how often to stretch: As a general rule, stretch before and after a manual task or exercise.

‒ If you do not exercise regularly, you might want to stretch at least three times a week to maintain flexibility.

‒ If you have a problem area, such as tightness in the back of your leg, you might want to stretch every day or even twice a day.

• Know when to exercise caution: If you have a chronic condition or an injury, you may need to alter your approach to stretching.

‒ If you have a strained muscle, stretching it may cause further harm.

‒ Discuss the best way to stretch with your medical provider.

Estiramiento

¿Por qué estirarse?

• El estiramiento es útil tanto para la prevención de lesiones como para el tratamiento de las mismas.

• Realizado de forma adecuada, el estiramiento incrementa la flexibilidad, lo que se traduce directamente en una reducción del riesgo de lesión. Un grupo de músculos/tendones con un rango mayor de movimiento tendrá menos posibilidades de experimentar desgarres cuando se lo usa activamente.

• Se cree que el estiramiento mejora la recuperación y puede mejorar el rendimiento atlético.

• El estiramiento mejora su equilibrio, coordinación y circulación. Esto incrementa el flujo sanguíneo hacia sus músculos lo que, con frecuencia, acelera el proceso de recuperación después de lesiones musculares.

• Los músculos flexibles pueden mejorar su rendimiento a diario en tareas tales como levantamiento de pesas y flexiones.

juego.

• Primero realice un ejercicio de calentamiento: Estirar los músculos cuando están fríos incrementa su riesgo de lesión, incluyendo los músculos desgarrados. ‒ Realice un ejercicio de calentamiento caminando mientras levanta suavemente

sus brazos o realice su ejercicio favorito con una intensidad baja durante cinco minutos.

‒ Estire después de su ejercicio—cuando sus músculos ya entraron en calor son más receptivos al estiramiento.

• Sepa con qué frecuencia estirar: Como regla general, estire antes y después de una tarea manual o ejercicio. ‒ Si no ejercita regularmente, podría necesitar estirar, al menos, tres veces por

semana para mantener la flexibilidad. ‒ Si tiene un área con problemas, como por ejemplo una tensión en la parte

In the event of an emergency, our first responders will be overwhelmed. It is critical for citizens to be prepared to take care of themselves, their neighbors, and their community for at least 3 days, and preferably 5-7.

For those of you who wish to step beyond preparing your home and reach out to help your community in an emergency, train to be a Community Emergency Response Team (CERT) member.
