Kalb's Q&A for Contractors By Shauna Krause & David Kalb, Capitol Services, Inc.

Whether in nevada or California a solar contractor can’t light up your life, without the proper license, but which one is right for the job? We offer clarification on the rules for selling home improvements in California. Another contractor gives us the ‘key’ to a slim chance on ‘locking down’ an exam waiver…

Q: We’re solar contractors in nV and have a question on the best classifi-cation to apply for in CA. We called the Contractors Board in Sacramento and they told us your state has a “C-46” (Solar) license. We called back a second time and the new person who answered said we could get the “C-46” or an electrical license “C-10.” We found you on the Internet and you look to have a lot of experience in these issues. In your opinion, which license would be best?

A: In order to shed some light on this topic, I am sending you an “Industry Bulletin” from 2010. The CSLB published this a few years ago to respond to questions regarding which classifications are authorized to perform solar projects. This “Fact Sheet” lists 7 different classifications that can properly perform some or all aspects of solar energy projects.

The “C-46” is a broad classification, which allows contractors to “install, modify, maintain, and repair thermal and photovoltaic solar systems”. “C-10” contractors are “authorized to perform any solar projects which generate, transmit, transform or utilize electrical energy in any form for any purpose”. “A” (General Engineering) and “B” (General Building) contrac-tors are also authorized to install solar energy systems.

The real question is what classification you can qualify for. In addition, depending on the license classification you hold in nV, you may be eligible to secure a waiver of the trade test. I hope this information helps. Call us if you have any further questions.

Q: I have a question and my business partner referred me to your company. What is California’s rule for home improvement salesman? Some places I’ve worked treat them as independent contractors and others treat them as employees.

A: In CA, a Home Improvement Salesperson (HIS) is a person employed by a licensed contractor to solicit, sell, negotiate, or execute home im-provement contracts. A Home Improvement Salesperson can work for a number of contractors and sell a variety of goods and services, but must be registered with the CSLB separately for each contractor for which he/she is employed.

Q: I got a solicitation in the mail (not from your company) stating that the CSLB allows individuals to request a waiver of the exams if they have been

an Officer of the corporation or a “key employee” for at least five years. Do you know if this is true and what is a “key” employee?

A: That is true under certain circumstances. The CSLB only allows this waiver request for individuals seeking to replace the Qualifying individual on an existing license, not for the purposes of obtaining a new license. According to B&P code 7065.1(c), in order to qualify for this waiver the following conditions must exist:

1. For five of the seven years immediately preceding the application for replacing the Qualifier, the corporation or LLC must have continually employed the new Qualifying individual in a supervisory capacity in the same classification(s) being applied for.

2. For five of seven years immediately preceding the application, the corporation or LLC has held an active license in good standing in the same classification(s) being applied for.

3. The corporation or LLC has not requested a waiver under this subdivi-sion within the past five years.

As far as what it meant by “key employee”, I believe the company that you received the solicitation from is referring to item 1. While knowledge is power, knowing where to go for the answers is half the battle. First - my apologies for not sending my weekly update out last Friday. Actually, it was written the day before (on Thursday)! After spending over an hour writing it, I went to save it and my Word program erased it – completely! After the expletives subdued, when I realized that my efforts were doomed and I was going to have to re-write EVERYTHInG, I contacted my computer geek who informed me that it was time to “upgrade” to Windows 7, which, according to him, would solve “all” my problems!

Well, much to my chagrin, I lost all of Friday and almost all of this week, because everything had to be re-installed on my computer! And, worst of all, my Outlook groups were lost, meaning I’ve had to re-create, literally, hundreds of names in my groups! So, if you receive this update more than once, please let me know so I can go in and try to correct the mess. And people ask me why I drink!

Each year about this time I remind you that every employer in California is required to post myriad state and federal employee notices on your wall in a conspicuous place; AnD, you also are required to provide your employees with other myriad pamphlets to boot! Hey, don’t shoot the messenger! I get that it is absolute nonsense which no one will read, but laws are laws and you want to make this as quick and painless as possible. And the California Chamber is here to make it cheap and easy! Plus, it’s always nice when I can help out my friends over at the Chamber!no matter how many employees you have in California, your business is required to post employment notices in a central location and distribute certain pamphlets.

In one convenient kit, Cal Chamber provides a single poster with the 16 California and federal notices every California employer must post, plus 20 copies of each of the five pamphlets employees must receive.

As of 11/21/12, here’s what the Chamber knows regarding 2013 poster updates:• There is a legally required update to the Discrimination and

Harassment notice.• There are legally required updates to the Workers’

Compensation notice that reflect new workers’ compensation reforms and that have been approved by the Division of Workers’ Compensation. Implementation of workers’ compensation reform measures will continue during 2013. As a result, there are potential additional mandatory changes after January 1, 2013.

• The Cal/OSHA notice has changed.• The Employee Polygraph Protection Act notice has changed.• There are pending changes to the FMLA and PDL notices. If

approved for 2013, these will be mandatory changes.• The nLRA posting requirement remains suspended until

further notice due to federal court cases.

Q: What other information must be distributed to employees?A: Required notices include:1. For Your Benefit (DE 2320). This pamphlet explains

California’s Unemployment Insurance and Disability Insurance programs and must be distributed when an employer discharges or lays off an employee, or places an employee on a leave of absence.

2. State Disability Insurance Provisions (DE 2515). This pamphlet explains an employee’s disability insurance rights and must be distributed to all new hires and again if an employee goes out on disability leave.

3. Workers’ Compensation Rights & Benefits pamphlet. Give all new employees the Workers’ Compensation pamphlet at time of hire.

4. Sexual Harassment pamphlet. Every California employee and independent contractor must receive a sexual harassment information sheet from his/her employer.

5. Paid Family Leave pamphlet. This pamphlet explains California’s Paid Family Leave program. Give it to new employees and employees requesting time off for a covered reason.

6. Earned Income Tax Credit notification. All employers are required to notify all of their employees of the federal Earned Income Tax Credit (EITC).

7. notice to Employees (DE 35). This notice informs employees that their employer is required to send copies of Employee’s Withholding Allowance Certificate (Form W-4 [federal] or DE 4 [state]) to the Franchise Tax Board (FTB) if the certificate meets certain conditions.

The California Chamber of Commerce has released the attached updated legislative pictorial roster which provides photos of all elected officials in California for the 2013 legislative session, including yours!There were nineteen same-party races in the state legislature in november.The Assembly freshmen include 38 members who are new to the

state Legislature.There are 80 members in the state assembly, and 22 of them (27.5%) were termed-out in 2012. Of them, 17 were Democratic and 5 were Republican.In addition to the 22 California state representatives who left office because of term limits, 6 California state senators were also termed-out.In the General Election, Democrats gained the legislative supermajority with 54 Democrats in the Assembly and 29 in the Senate. The last time Democrats held a supermajority of the Senate was 1965.The 2011-12 legislative session adjourned sine die at midnight on Friday, november 30th. Legislators convene for the 2013-14 Organization Session at noon this coming Monday, December 3.In close races, the roster includes candidates who were ahead at press time. IRSandSocialSecurityAdministrationReleaseNewIndexedFigures for 2013The Internal Revenue Service (IRS) and Social Security Administration have released the cost-of-living (COLA) adjustments that apply to dollar limitations set forth in certain IRS Code Sections. The Consumer Price Index rose enough since the third quarter of last year to warrant an increase in some indexed figures for 2013.Social Security and Medicare Wage BaseFor 2013, the Social Security wage base increases to $113,700 from $110,100 in 2012. Unless Congress acts to extend the current reduction in the tax rate for employee withholdings, they will increase to 7.65 percent in 2013 from the 5.65 percent withheld in 2012. The Social Security rate of 6.2 percent is applied to wages up to the maximum taxable amount for the year; the Medicare portion of 1.45 percent applies to all wages.Indexed Compensation LevelsThe indexed compensation levels for determining who is considered highly compensated or a key employee remains unchanged for 2013 (in thousands): 2010 2011 2012 2013 Highly Compensated Employee $110 $110 $115 $115Top Paid Group of 20% $110 $110 $115 $115Key Employee, Officer $160 $160 $165 $165

401(k) PlansIn 2013, the maximum for elective deferrals increases to $17,500. The catch-up contribution for those 50 or older remains at $5,500 for 2013 (no change from 2012). That means if you are age 50 or over during the 2013 taxable year, you may generally defer up to $23,000 into your 401(k) plan.

Health FSAWe have an additional indexed figure to track starting in 2013. It’s the annual limit for participant salary reductions for the health flexible spending account (FSA). For plan years starting on or after January 1, 2013, the participant salary reduction amount to the cafeteria plan’s health FSA portion of the plan may not exceed $2,500. This cap does not include employer contributions. However, employer flex credits that may be converted to cash must be added to the participants’ health FSA elections.

Adoption Credit Unless Congress acts, this tax credit will expire at the end of 2012. Parts of the adoption tax credit, under IRS Code Section 23, will expire on December 31, 2012. The remaining section of Code Section 23 will allow for a $10,000 credit for adoption of a child with special needs, regardless of expenses.A “special needs” adoption, which becomes final during a taxable year, will be deemed to have qualified expenses in an amount equal to the excess (if any) of $10,000 over the aggregate qualified adoption expenses actually paid or incurred.There will be no adoption-related benefits allowed under a cafeteria plan arrangement starting January 1, 2013, unless Congress updates current legislation.Because the credit is set to expire at the end of 2012, no indexed figures were released for the 2013 taxable year.

Health Savings Account (HSA) Minimum deductible amounts for the qualifying high deductible health plan (HDHP) increase to $1,250 for self-only coverage and $2,500 for family coverage in 2013. Maximums for the HDHP out-of-pocket expenses increase to $6,250 for self-only coverage and $12,500 for family coverage.Maximum contribution levels to an HSA also increased for 2013 to $3,250 for self-only coverage and $6,450 for family coverage. The catch-up contribution allowed for those 55 and over is set at $1,000 for 2013. Remember, qualifying HDHPs and no other impermissable coverage (such as coverage under another employer’s plan or from a health care flexible spending account that is not specifically compatible with an HSA) are required in order to fund an HSA.

Archer Medical Savings Account (MSA) For a high deductible insurance plan that provides self-only coverage, the annual deductible amount must be between $2,150 and $3,200 for 2013. Total out-of-pocket expenses under a plan that provides self-only coverage cannot exceed $4,300. The annual deductible amount must be between $4,300 and $6,450 for a plan that provides family coverage in 2013, with out-of-pocket expenses that do not exceed $7,850.

Although new MSAs are not allowed, maximum contributions to an existing MSA that are attributable to a single-coverage plan is 65% of the deductible amount. Maximum contributions for a family-coverage plan are limited to 75% of the deductible amount. MSA contributions must be coordinated with any HSA contributions for the taxable year and cannot exceed the HSA maximums.

Dependent and/or Child Day Care Expenses Just a reminder that although the day care expense limit associated with a cafeteria plan is not indexed, the tax credit available through a participant’s tax filing was raised in 2003. The day care credit must be filed on Form 2441 and attached to the 1040 tax filing form.For 2013, unless Congress acts, the limits for the day care tax credit expenses will be reduced and based on $2,400 of expenses covering one child and $4,800 for families with two or more children. If one of the parents is going to school full time or is incapable of self-care, the non-working spouse would be “deemed” as earning $200 per month for one qualifying child and $400 for two or more qualifying children. This “deemed” earned income is used whether a person is using the employer’s cafeteria plan or taking the day care credit.The cafeteria plan day care contribution limit is $5,000 for a married couple filing a joint return, or for a single parent filing as “Head of Household.” For a married couple filing separate returns, the limit is $2,500 each.The day care credit is reduced dollar for dollar by contributions to or benefits received from an employer’s cafeteria plan. An employee may participate in their employer’s cafeteria plan and take a portion of the day care expenses through the credit if they have sufficient expenses in excess of their cafeteria plan annual election, but within the tax credit limits.

Long-Term Care For a qualified long-term care insurance policy, the maximum non-taxable payment is now $320 per day for 2013.Finally, by participating in a cafeteria plan, the participant will be lowering their income for the Earned Income Tax Credit (EITC). Holiday Safety in the Workplace Stay safe while celebrating the season

It’s the holiday season – a time for decorations and festivities to celebrate the season. While we welcome your displays of holiday spirit, it is important to keep safety in mind. Here are some holiday safety guidelines to follow to ensure we all celebrate the season safely. Holiday Decorations

• Mixing and matching lights can create a fire hazard; keep outside lights outdoors and inside lights indoors.

• Discard any light strings that have cracks, exposed wire or loose connections.

• Do not connect more than three sets of lights to an extension cord.
