Introduction

In this assignment, I will be discussing the legal and ethical issues in relation to use of business information. I will be using EE to demonstrate this. The laws I will be dealing with are computer misuse act 1990, freedom of information act 2000 and data protection act 1998.

About EE

EE aim to deliver the UK’s best service, through their websites and customer service apps, over the phone and in-store. They have over 11,000 customer service and retail employees who are trained experts in mobile device operating systems. Every year, their service centres teams have over 86 million conversations with our customers, and more than 40 million customers come through the doors of our more than 600 retail stores. Online, we have over 35 million visits per month to our websites.

Computer Misuse Act 1990

This is when an individual does not have unauthorised access to computer material. As a result he/she could face punishable by 6 months' imprisonment or a fine.

Freedom of Information Act 2000

The Freedom of Information Act 2000 (FOIA) gives a general right of public access to all types of 'recorded' information held by public authorities, sets out exemptions from that general right, and places a number of obligations on public authorities.

Data Protection Act 1998

Data may only be used for the specific purposes for which it was collected. Data must not be disclosed to other parties without the consent of the individual whom it is about, unless there is legislation or other overriding legitimate reason to share the information (for example, the prevention or detection of crime). It is an offence for Other Parties to obtain this personal data without authorisation. Individuals have a right of access to the information held about them, subject to certain exceptions (for example, information held for the prevention or detection of crime).

Ethical issues

Use of email

Email are confidential documents normally between to people that should never be shared. EE only use to communicate with customers and colleagues.

Whistleblowing

A whistle-blower occurs when an employee makes a complaint about a business practise to senior member of staff internally or externally via media e.g. press. Employees tend to whistle-blow when they feel fraud, crime, danger or any other serious risk that could impact on customers, colleague’s shareholders, the public, the environment or the organisations reputation. Whistle-blowers may receive legal protection through the public interest Act, but the offence being reported must constitute a deliberate attempt to break the law.

Use of internet

EE take use of internet extremely seriously. They as an organisation:

Does EE sponsor fair trade or a charity?

Unfortunately there was incident that occurred in April 2011 whereby EE was suspended it’s as they took 10 per cent of charitable donations to cover its costs, and claims it is now working on an alternative, and more sustainable, model.

The operator still maintains that it never made any money from the practice, but in the face of a media bandwagon it had no option but to suspend the collections immediately while it comes up with a better plan.

The partner charities include Comic Relief, Sport Relief, Children In Need, Royal British Legion and UNICEF. Those charities, the operator reckons, soak up the "vast majority" of charitable giving by text message, but collecting money costs money – so the thousands of other charities were expected to cough up a 10th of the gifts to cover the collection costs.

Every fundraising mechanism costs money, but EE got caught out as the only operator charging charities for the service. That created a perfect storm for stories about the big bad corporation which was stealing from little charities – but not big charities: how perfect can a pantomime villain get?

EE tells us that it is more concerned with the £700m lost by donors who did not take advantage of Gift Aid (which enables charities to claim back the tax on donations), and the operator is apparently working on a donation system which will redress that problem.

But while it does that, EE is suspending the collection of its 10 per cent cut, so every penny texted will go to the charity of choice, at least until the operator can find another way to cover its costs.

To conclude in my findings I have found that EE Cover every criteria and are heavily involved in protecting their customers. There have been situations where by they have been breaking the law which is the using charity money to pay off debts and breaking the data protection act as they sold customers details to other businesses. Overall, they are a well-established company and known for good customer service.
