FREQUENTLY ASKED QUESTIONS

I have found a property I like. How do I make an offer?

As we are required by law to submit all offers to Vendors in writing, we require that your offer be made in writing to us. This will establish your genuine interest in the property and help us to secure the property you desire.

My offer has been accepted. What happens next?

Once your offer is accepted, you need to execute a contract of sale. Contracts are exchanged either with a 5 day ‘cooling off’ period, or ‘unconditionally’ (66W). The type of exchange will depend on both the buyer and the seller and the circumstances surrounding the sale.

How much deposit do I need to pay?

Initially you may pay as little as 0.25% of the purchase price if you exchange with a cooling off period. An unconditional exchange is usually made with a 10% deposit. On occasion this is negotiated to 5% depending on the circumstances of the sale, however you are always liable for the full 10%.

What does ‘settlement’ refer to? When can I move into the property?

The settlement period is the time from exchange of contracts until the settlement date, when the title is transferred and you are the new owner of the property. The standard settlement period is 42 days (6 weeks) but this can be negotiated and varied, often between 4 weeks and 12 weeks.

Do I have to pay GST on my home purchase?

The purchase of an already established home does not attract GST. Commercial properties sold as a going concern do not attract GST however vacant commercial properties do.

Who legally advises me when buying or selling my home?

You can choose either to employ the services of a solicitor or a conveyancer. Conveyancers specialise in property transactions whilst solicitors will be able to advise you on a broad range of legal issues.

When should I organise a building and pest inspection “BPI”?

Some buyers will choose to have a BPI prior to commencing the negotiations while others negotiate the price first. It is up to the buyer to decide if and when they would like to complete the BPI. Sometimes the owners will make available a building and pest report which they have had done prior to marketing the home. These reports can be on-sold to the buyers from the inspector, generally at a discounted rate.

Can I buy a property prior to auction?

In most cases the owners will seriously consider offers prior to an auction. If your offer is accepted you will need to exchange contracts unconditionally.

If a tenant wishes to end a Residential Tenancy Agreement before the

end of the Fixed Term of the Agreement, the tenant must pay a “break

lease fee” of 6 weeks rent if less than half of the Term has expired, and

4 weeks rent if less than half of the Term is remaining. So, for example,

if the tenant wishes to break the lease when only 4 months of a

12 months Fixed Term Agreement has expired, 6 weeks rent is liable

to be paid as a break lease fee.
