The Louisiana Board of Ethics, at its December 15,2004 meeting, considered a staff reportregarding your failure to file a required campaign finance disclosure report in connectionwith the September 18,2004 election.

The Board, by a majority vote of its membership, ordered that a public hearing be conductedfor the purpose of exploring the following:

CHARGE IThat Deninah Webb-Goodwin, a candidate for Orleans Parish School Board, in theSeptember 18, 2004 election, may have violated Section 1505.18 of the CampaignFinance Disclosure Act ("CFDA") (La. R.S. 18:1505.1B) by failing to file thecampaign finance disclosure report required by the provisions of Section 1532 of theCFDA (La. R.S. l8:1532) to be filed by September 28,2004 reporting any and allelection day expenditures, and is therefore subject to civil penalties of $60 a day untilthe report is filed, not to exceed $2,000.

CIIARGE IIThat Deninah Webb-Goodwin, a candidate for Orleans Parish School Board, in theSeptember 18,2004 election, may have violated Section 1505.18 of the CampaignFinance Disclosure Act ("CFDA") (La. R.S. 18:1505.18) by failing to file thecampaign finance disclosure report required by the provisions of Section 1495.48(5)of the CFDA (La. R.S. 18:1495.48(5)) to be filed by October25,2004, and coveringthe reporting period beginning August 30,2004 through October 13,20A4 and istherefore subject to civil penalties of $60 a day until the report is filed, not to exceed$2,000.

The hearing will be held in the Louisiana Housing Finance Agency Building Board Room,2415 Quail Drive, I't Floor, Baton Rouge, Louisiana on March 10r 2005 at 9:00 a.m. Thispublic hearing will be conducted in accordance with the procedural requirements set forthin R.S. I 8:15 I 1.4C, provisions of the Administative Procedure Act and in conformity withthe Rules adopted by the Board, a copy ofwhich is enclosed. At the conclusion ofthis publichearing, the Board may impose additional civil sanctions of up to $10,000 as per R.S.18:1505.4A(4Xb).

Consideration of an Application for Rehearing in connection with a $8,000 Order against AlvinChris Declouette, an unsuccessful candidate for Representative District 40 in the Febrmry 24,2007 election who has failed to pay assessed late fees for the late filing of campaign financereports.


Comments:

Application for Rehearing was sent to Mr. Declouette on February 2,201,0.

The Board issued an Order at its November 13, 2008 meeting making the late fees totaling$8,000 assessed againtMr. Declouette final and absolute. Rule 1018 states that any person

aggrieved may apply to the Board for a rehearing in writing within 10 days from the date of theBoard's decision becomes final. A copy of the Order was sent to Mr. Declouette's residenoe onNovember 17,2008. Since the late fee was never paid, the Board then filed suit with the 19thJudicial District Court on December 18, 2009. Mr. Declouette contacted the Board, requesting a

rehearing. The request is untimely. This matter is now before the 19th Judicial District Court and

was scheduled for a Rule to Show Cause Hearing on February 8, 2010. The staffcontinued thehearing pending the outcome of his application for a rehearing. On January 19,2010, The Boardreceived correspondence from Mr. Declouette, urherein he requested that he be allowed td make

$100 monthly payments on the $8,000 assessed late fees. At this time one payment of $100 has

been received. (AMA)

Deny the request for rehearing.

$1018. Rehearings

A. Any person aggrieved may apply to the board for a rehearing, in writing, withinl0 days from the date the board's decision becomes final. The grounds for anapplication for a rehearing shall be that:

R.S. 18:1495.4D(l)) to be filed by February 17,2009, and is thereforesubject to civil penalties of $60 a day until the report is filed, not to exceed $2,000.

The hearing will be held in the LaSalle Building, LaBelle Room, 617 N. Third Street, I'tFloor, Baton Rouge, Louisiana. on July 29r20Ag at 9:00 a.m. This public hearing will beconducted in accordance with the procedural requirements set forth in R.S. 18:1511.4C,pfovisions ofthe Administrative Procedure Act and in conformity with the Rules adopted bythe Board, a copy of which is enclosed. At the conclusion of this public hearing, the Boardmay impose additional civil sanctions of up to $10,000 as per R.S. 18:1505.4A(4Xb).
