Privacy Statement For students - I understand that: The Coaching Institute is required to provide Australian Government agencies, through the Australian Skills

Quality Authority student information and training activity data which may include information I provide at

enrolment.

The Australian Skills Quality Authority may use the information provided to it for planning, administration,

policy development, program evaluation, resource allocation, reporting and/or research activities. For these

and other lawful purposes, they may also disclose information to its consultants, advisers, other government

agencies, professional bodies and/or other organisations.

Provision of Services I fully understand the training and support services and the content as listed in the table of values that will be

provided to me in my enrolled course with The Coaching Institute.

Policy and Procedures The Coaching Institute reserves the right to review and amend policy and procedures as required. Students are to comply with all current policy documents and procedures. Welcome to The Coaching Institute

Thank you for becoming a member of The Coaching Institute. You are joining the most accredited coaching

institute in Australia, and we have both National and International accreditations available through our

programs. We are also the only award-winning coaching school in Australasia. Our purpose is to provide the most outstanding coaching training, materials and support for students looking

Students must complete The 8 units of competency required as part of pre-requisite are covered in 10069NAT Certificate IV in Life Coaching before starting the Diploma.

Your Options All programs commence with the Starter Kit manual and the “Foundations of Coaching Success” training.

1. Select the course that suits you. There is no pre-requisite for the 10069NAT Certificate IV in Life

Coaching

2. 10119NAT Diploma of Life Coaching offers the most comprehensive and advanced program available and includes recognition in Meta Dynamics™ and 10069NAT Certificate IV in Life Coaching.. The Coaching Institute Culture The Coaching Institute’s culture is our greatest success! We are quirky, creative, have fun and expect to

deliver great results. We play music at our events. There is sometimes dancing. We ring bells, play games

and laugh often.

We are not a conservative organisation that is restricted by the ‘status quo’ or history. We prefer to focus on

where we’re heading, and making sure we are delivering great service to our many members throughout the

world!

If you are looking for a conservative, quiet, introverted and reserved training experience, we are not for you.

We don’t believe coaches succeed by holding back or waiting to feel ‘comfortable’. In fact, our experience

has taught us that the best results come when there is an atmosphere of fun and experiential learning.

We are driven by and love our ten values. We have these values on our walls, on our doors and in our

manuals. We talk about them, relish them, and use them as a guide to how we’re going. They can give you a

valuable insight into how we do things and whether how we do our thing is how you like to do your thing!

By signing my Student Acceptance Form I acknowledge that:

The training may raise emotional issues as part of the training and certification. It is not intended to

provide a therapeutic environment or be a substitute for ongoing counselling or psychotherapy, and

that any unresolved issues which may surface and which may warrant counselling will be at my

expense.

There may be sexually explicit content and strong language used throughout the training. I

understand that some discussions may be confronting and that I will participate only to the extent I

feel comfortable. If I find a discussion too confronting I will notify a facilitator and leave the room if

necessary.

Privacy The Privacy Act 1998 essentially says that all personal information you provide to us will be secured and will

not be shared or disclosed to anyone without your written consent. This also applies to you in terms of you

not providing information about someone to a third party.

The Coaching Institute is required to provide the Australian Government, through the Australian Skills Quality

Authority (ASQA), with student and training activity data which may include information you provide on the

enrolment form. Information is required to be provided on instruction from ASQA. ASQA may use the

information provided to it for planning, administration, policy development, program evaluation,

communication, resource allocation, and reporting and/or research activities. For these and other lawful

purposes, ASQA may also disclose information to its consultants, advisers, other government agencies,

professional bodies and/or other organisations.

Video and still photographs may be taken for training and/or marketing purposes at face to face events. By

signing your Student Acceptance Form you give approval to be filmed and photographed unless you advise

us otherwise by signing a waiver at the event.

Protecting our student’s privacy is important to us.

of our courses and which will safeguard the welfare of all participants in our programs;

• Our marketing of all programs is carried out with integrity, is accurate and conducted in a professional

manner;

• Recruiting participants in an ethical and responsible manner;

• Raising our standard of service to the participants and we will uphold the services that are currently

provided to you;

• Our employees, representatives and service providers conducting our services in an honest, efficient,

fair and transparent manner;

• Responding to our participants queries and concerns in a timely manner;

• Developing innovative ways to delivery coach training;

• Responding to feedback provided by our students;

• Ensuring facilitators are knowledgeable and well respected coaches;

Your Responsibilities As A Student We require all participants in our program to conduct themselves in an ethical and responsible manner at all

times when communicating with The Coaching Institute staff, facilitators, mentors and other students. You have the responsibility to not disrupt participants in their study and in the performance of their tasks. In your own study you are expected to –

• Take responsibility for your own study timetable • Approach your chosen program with personal commitment and integrity • Complete all required assignments honestly • Submit work that is your own in its entirety and adopting an individual approach to assessment • Not use the copyrighted materials of The Coaching Institute and claim it as their own • Be respectful when contacting and communicating with other students and members of The

Coaching Institute team.

Students who are found in breach any of these obligations or any other inappropriate actions will be advised

verbally, in the first instance then in writing of their breach and to set our expected levels of behaviour and

conduct in the future. If, after a verbal warning of inappropriate conduct is given and the student chooses to

continue to behave in a way that is still inappropriate, the student will be asked to leave either the training

session, teleclass or in serious misconduct situations the course in its entirety. If this occurs, all fees will

become due. Should the student wish to re-attend the training, teleclass or be reinstated, that decision will be

at the discretion of The Coaching Institute. Request for Re- attendance or Reinstatement will incur a fee of

$250.

Academic Misconduct All students are expected to maintain high standards of academic honesty and integrity. Academic

misconduct is defined as attempts by students to cheat, plagiarise or otherwise act dishonestly in

undertaking an assessment task, or assisting other students to do so. Students are considered guilty of

cheating if they seek to gain advantage by unfair means such as copying another students’ work, or in any

way mislead a trainer and/or assessor about their knowledge, ability, or the amount of original work they

have completed.

Where a staff member identifies or suspects academic misconduct, the assessment will not be accepted and

the matter referred to the Operations Manager who will investigate the allegation and determine the course

of action. Consequences may range from a verbal warning to removal from course without refund. The

Operations Managers decision will be final.

Occupational Health and Safety Students have an obligation under The Occupational Health and Safety Act 2004 (VIC) and The Occupational Health and Safety Regulations 2017are made under the Act.

• Students MUST NOT act in a manner which endangers the health and safety of themselves or any

other person while at a course or session being run by The Coaching Institute;

• Students MUST carry out safety directions given by members of the The Coaching Institute;

• Students MUST NOT wilfully or recklessly interfere with anything provided in the interests of health

and safety at The Coaching Institute.

NOTE: Students who do not comply with these legal requirements are in breach of the Acts and can be fined under its

legislative requirements. Such persons are also in breach of the Student Rules and can face disciplinary action.

Receiving Support You may need support from time to time that isn’t covered in the curriculum. As a student with The Coaching

Institute you have access to a dedicated support team who provide any assistance they can to you

throughout your program. A phone call, email or post on our face book page is all it takes to have contact

with your WOW Team. They are here to serve you.

You will also receive and have access to –

• Mentor coaches

• Face to face events – check the schedule with the WOW Team for events in your area

• Regular bonus classes • Personal Success Planning Sessions

Disciplinary Action The Operations Manager will investigate any occurrences of students suspected of unacceptable behaviour.

Action may include discussions, warning and/or removal from the course without a refund.

Anti-Discrimination & Sexual Harassment Anti-Discrimination It is the policy of The Coaching Institute to ensure that the Discrimination Acts of the State and Federal Governments are adhered to. These acts include, but are not limited to: Age Discrimination Act, Disability Discrimination Act, Racial Discrimination Act and Sex Discrimination Act. The Coaching Institute is an equal opportunity employer. All appointments are made on their merits, without regard to race, age, sex, marital status or any other factor not applicable to the position. Employees are valued according to how well they perform their duties, their ability and enthusiasm to maintain organisational standards or service. The Organisation does not tolerate any form of discrimination. All persons on site (including visitors) have the right to an environment free of discrimination and harassment.

Sexual Harassment The policy of The Coaching Institute is that sexual harassment is an unacceptable form of behaviour, which

will not be tolerated under any circumstances. We believe that all persons on site (including visitors) have the

right to an environment free of intimidation and sexual harassment. Under the Sex Discrimination Act 1984, sexual harassment is against the law. Sexual harassment may

cause the loss of trained and talented employees, damage staff morale and productivity. The Coaching Institute employees must ensure that all persons on site (including visitors) are treated

equitably and are not subject to sexual harassment. They must also ensure that people, who make

complaints, or act as witnesses, are not victimised in any way. What to do if you are discriminated against or sexually harassed You have the right to feel safe and to have full opportunity to achieve your potential in your study. Don’t let

harassment interfere with your life. If you are being harassed seek help immediately. There are several options. Choose the course of action you feel most comfortable with. Do not ignore

discrimination or sexual harassment, thinking it will go away – often discrimination just gets worse and

silence may give the impression that discrimination or sexual harassment is acceptable.

Complaints, Grievances and Appeals A grievance, complaint or appeal is deemed to be dissatisfaction with the procedures, outcomes or the

quality of service provided by employees of The Coaching Institute in relation to the following processes:

• student enrolment;

• the quality of training delivery;

• training/competency assessment, including recognition of prior learning;

• issuing of results, certificates and/or statements of attainment;

• any other activities associated with the delivery of training and assessment services; and • other issues such as discrimination, sexual harassment, student amenities, etc.

The Coaching Institute seeks to prevent grievances, appeals and complaints by adhering to The Coaching

Institutes policy & procedures, relevant regulatory requirements and the Student Handbook. Complaints,

grievances and appeals are treated seriously, investigated thoroughly, and dealt with according to the

nature, severity and merit of the complaint. The underlying principles of this policy are:

• The complaints and appeals process will be fair, accessible, visible, comprehensive, responsive,

accountable and constructive.

• The complaints process is free of charge.

• Privacy and confidentiality will be maintained and anonymity where requested.

• The resolution of a complaint/appeal is the responsibility of all parties concerned.

• It is our policy to ensure that each:

• Complaint, grievance appeal and its outcome is recorded in writing; •

• The student will remain enrolled whilst the process is ongoing; and

• Appellant is given a written statement of the appeal outcomes, including reasons for this decision.

Prior to submitting a complaint, students are to obtain a copy of our Complaints Resolution policy available

from the web site or from Student Support.

Student feedback is one of the techniques used to obtain information from students undertaking our training.

Your feedback enhances student learning and support, and to identify where courses need improvement. All

of The Coaching Institute’s training incorporates Student Feedback forms distributed at face-to-face training

sessions, with further opportunity throughout the course so that you can give us feedback about your

learning experience. We value your comments and suggestions. The Coaching Institute supports and utilizes the Data Provision Requirements which form part of the VET

Quality Framework. Quality Indicators have been designed to help Registered Training Organisations

(RTOs) conduct evidence-based and outcomes-focused continuous quality improvement, and assist

registering bodies assess the risk of an RTO’s operations. All learners will be requested to participate in an

annual online Learner Engagement Survey and to provide feedback after attendance at face to face

trainings. Additional feedback opportunities occur around the mid-course point and at course completion.

Enrolment To enrol in The Coaching Institute’s programs you must complete an Acceptance Form, and read both the

terms and conditions and this document. Terms and conditions apply to every student enrolled with The

Coaching Institute. If you need a copy, you can download both of these documents and view our policies in

full in The Coaching Institute’s Policies and Procedures section of the website. Enrolment will not be

accepted until the student has signed and agreed to the Terms and Conditions and the instructions within the

Student Handbook.

Students are to provide a copy of photo identification at enrolment. Photo I.D may be in the form of a

passport, drivers licence or other official document approved by TCI. Students are required to provide their

Unique Student Identifier (USI) number at the time of enrolment and give permission to RTO to verify the

USI. Students are required to complete LLN assessment to identify any special needs and or support.

Students with a disability TCI as a Registered Training Organisation is obliged by law to provide reasonable adjustment to ensure maximum participation of learners with a disability in teaching, learning and assessment activities. However, a reasonable adjustment in teaching, learning and assessment activity needs to be justifiable and must uphold the original integrity of the qualification. To ensure the participation of all students, TCI is obliged to:

• ensure that course activities are sufficiently flexible; • provide additional support to learners where necessary; and • where a learner cannot participate, offer a reasonable substitute within the context of the overall course.

Reasonable adjustment applied to participation in teaching, learning and assessment activities may include:

• customising resources and activities within the training package or accredited course • modifying the presentation medium • learner support • use of assistive / adaptive technologies • making information accessible both prior to enrolment and during the course • monitoring the adjustments to ensure learner needs continue to be met.

Reasonable adjustment to learning and assessment activity may incur additional costs. Process: For consideration for reasonable adjustment, students are to declare and provide proof of their disability and request reasonable adjustment at enrolment. A meeting will be arranged between student and trainer/assessor to determine if adjustments are required. Trainers/assessors are to record any agreed reasonable adjustment to training and assessment on the students file.

Fees In Advance The Coaching Institute complies with the Standards for Registered Training Organisations (RTOs) 2015 (Standard 7, Clause 7.3). The RTO may accept payment of no more than $1,500 from each individual student prior to the commencement of the course.

How We Will Support You as a Student Once you are a student with The Coaching Institute we understand that circumstances may change, you

may need a little break or other unforeseen issues may arise. So we have developed ways to make it as

easy as possible for students to achieve success as a student of The Coaching Institute.

Training Attendance for Successful Completion Securing Your Spot In Your Training To commence training, you must have made the minimum payment for that training. You may do this by a

PayWay variation. Any student who has not finalized their payment method prior to the training event will be

unable to attend the training. Cheques on the day are not accepted. Please check with Student Support

“Wow Team” for minimum amounts. This is because substantial Intellectual Property is being imparted by The Coaching Institute and must be

fully recompensed. For students enrolled in 10119NAT Diploma of Life Coaching a minimum of 9 months course participation is required & a certain amount of fees need to have been paid for eligibility to attend How to Run a Successful Workshop or Meta Dynamics™ NLP Certification Training. Participation Students are reminded that these training events are an integral part of the training and assessment required for successful completion and ultimately the award of a qualification. As such, students are to be punctual in their attendance at nominated events and demonstrate an active level of participation during the event. The trainer’s observation of students attendance and participation will be recorded and contribute to the final assessment results. Students demonstrating poor attendance and unsatisfactory levels of participation will be given a formal warning and provided with feedback on how to improve. If, at the trainers’ discretion, an unsuitable level of attendance and/or participation continues to be observed, the student may be asked to leave the training and/or be withdrawn from the course. Change of Training Dates If you are enrolled in one of The Coaching Institute’s trainings, you may request to transfer your enrolment to

the next training date available. You can transfer your training once per enrolment in that course. For advice, contact: [email protected].

Note: If you transfer you are not entitled to a refund of the training fees if you then withdraw from the training.

Trainings are non transferable to anyone for any reason.

Trainings Cancellation Policy The cancellation policy applies to all training events with the exception of Foundations of Coaching Success

training.

With the ever-increasing demand of students booking in to attend our training events, we need to ensure that

when you have confirmed a position at an event you are committed. Due to the substantial costs of

conducting face to face training events, including administration fees and staff support, a cancellation fee of

$500 will apply for withdrawal within 30 days of the event commencement. This is the minimum notice period

we are required to give if a reduction in the attendance numbers occurs.

For events that are streamed live, a cancellation fee of $250 will apply.

Your Fees and Financing The Coaching Institute is a private training provider which provides its programs on a full fee paying basis.

As part of our Fees Policy you must read the Terms and Conditions and Student Handbook carefully and

understand your commitment in terms of non-refundable deposits and ongoing course fees that you will be

responsible for even if you chose to discontinue your course. There are no fee exemptions. The Coaching Institute will not apply for Government grants, VET Fee Help or funding on behalf of a

potential student. Grants and/or external funding is the sole responsibility of the student and The Coaching

Institute’s fee schedules and terms and conditions apply regardless of how the student fees are raised. The Coaching Institute accepts payments through PayWay. No direct debits are accepted for ongoing

payments. For enquiries, changes or details regarding your payment option, please contact

[email protected]. Various services provided by The Coaching Institute attract fees. These are called Service Fees and are set

out on page 19 of this handbook. Course related fees are listed within your Course Information. Associated

administration and fees (if applicable) are listed below.

The Coaching Institute makes every effort to ensure students are aware of course fees and the ongoing

financial commitment required to ensure successful completion of courses. On enrolment and prior to

acceptance of payment of course fees a credit check is completed on all students. Enrolment will only

proceed on return of a positive credit check. The Coaching Institute reserves the right to review enrolment or

course upgrades and may provide advice to the student to reconsider. In cases where an enrolment or

upgrade has proceeded at the students request then the responsibility for the decision is solely with the

student.

Refund of Fees

A refund may only be available if you withdraw from your course within 14 days of your enrolment. Notice of

your application to withdraw must be in writing and must be received by The Coaching Institute within 14

days of the date of confirmation of your enrolment. Significant intellectual property is imparted upon enrolment in each of the programs and as such, your

eligibility for a refund and the amount of your refund (if any), will be determined according to the table below.

All refunds (if any) are calculated from the date we receive your written request to withdraw. Please note that

in any event, the course deposit is non-refundable. Any refunds entitled to the student will take from 6 – 8

weeks to process.

1. When a unit of competency has been assessed and a Competent/Not Yet Competent result

determined a refund will not be applied to that unit.

2. Where attendance has been recorded at a face to face training or online class a refund will not be

As an example:

Student pays $4997 for Certificate IV in Life Coaching, receives a starter kit ($997), attends FOCS ($2000)

and has had 2 assessments assessed ($500) then the refund to the student will be $1500.

Failure to Pay Because all students pay their course fees by instalment, they need to be aware that if those instalments are

in default for two months then the whole amount of the course fee immediately becomes due and payable.

For students with more than one credit account, default on one account will cause suspension of all

accounts.

If this happens, The Coaching Institute has the right to begin proceedings to have the balance of the funds

recovered. Once debt collection has commenced, the student will be responsible for all costs or expenses

incurred during the recovery of the debt, made payable direct to The Coaching Institute.

Withdrawing From Your Course/Premature Course Release Throughout any of the accredited programs a student can withdraw at any time, for any reason. However,

fees are likely to be due to The Coaching Institute because the bulk of the intellectual property is imparted to

you shortly after your enrolment into The Coaching Institute’s programs. Fees are calculated based on services made available to you up to the day written notice of withdrawal is

received by Student Services. Students are to advise Student Support Team of their intention to withdraw.

Please note, that fees are calculated based on provision of services as agreed, and not on whether a student

has attended the classes made available to them.

of Not Satisfactory. Students intending to pursue the full qualification are to submit no later than the following month with a late fee payable as follows:

3. Failure to submit the following month will result in a Not Yet Competent awarded for that unit of

competency. Students can continue in the course, submitting assessments as they become due but at the end of the enrolment period will receive a Statement of Attainment for successfully completed units only. Students will not be awarded a Testamur for the full qualification if a Not Yet Competent result has been recorded on any unit of competency.

4. Assessments initially graded as Not Satisfactory will be returned to the student for a second attempt.

Students are to resubmit within 14 days for assessments to be considered. The Not Satisfactory grading will be automatically recorded on all late assessments.

5. Due to either a training package change or update to an accredited course, an update could be made to the assessment tools and or the course. Students will be advised and provide with all details in case of transitioning situation.

Accreditation

As a registered training organisation, our courses are nationally accredited and can provide recognition

for our participants. The qualifications we offer include –

• 10069NAT Certificate IV in Life Coaching

• 10119NAT Diploma of Life Coaching

Certificate or Diploma Qualification We will issue your certification documentation within 30 calendar days of you being assessed by our

assessor as competent, provided all agreed fees you owe to TCI have been paid. Students successfully

completing a qualification will be awarded a Testamur recognising the qualification achieved. Where the

student partially completes the course, a Statement of Attainment will be issued recognising each unit of

competency completed and paid for in full. These initial certificates are provided to the student at no

additional cost. You may, however, apply for a certified copy of your record/transcript or additional

certificates for a fee of $100 at any time after completion of your course by emailing

[email protected].

In cases where the original documents have been lost or stolen a statutory declaration affirming and

detailing the loss or theft of the document must accompany the application and that if the original

document(s) is/are located; the replacement documentation will be returned to TCI. In cases where a

student has changed their name, and wishes to reflect this on their award documentation, the applicant is

required to return the original documents, together with proof of their change of name. Accepted forms of

proof include certified copies of the applicant's name birth certificate, marriage certificate, divorce degree,

passport or change of name decree. Replacement documents may take up to 21 days to approve,

prepare and print.

Recognition of Prior Learning (RPL) and Credit Transfer (CT) All students enrolled in training with The Coaching Institute will be offered RPL/CT prior to

commencement of studies. This process will form part of the student’s induction program. Applications for

RPL/CT must be received within 28 days of attendance at the Foundations of Coaching Success. Late

applications will not be considered.

Definitions Recognition of prior learning (RPL) - An assessment process that assesses an individual’s non-formal

and informal learning to determine the extent to which that individual has achieved the required learning

outcomes, competency outcomes, or standards for entry to, and/or partial or total completion of, a

qualification.

Credit transfer (CT) - assesses the initial course or subject that an individual is using to claim access to,

or the award of credit in, a destination course. The assessment determines the extent to which the client’s

initial course or subject is equivalent to the required learning outcomes, competency outcomes, or

standards in a qualification.

For students requesting RPL/CT, the completed application form F 1 - Application for Recognition of Prior

Learning and Credit Transfer is to be submitted to the Compliance Manager who will arrange the

assessment process and advise the applicant in writing of any additional evidence that may be required.

If, after examining the evidence provided by the applicant, the assessor requires further evidence, the

applicant may be requested to participate in formal testing. This may involve written and or verbal

assessment to assist in determining performance outcomes.

A non-refundable assessment fee of $300.00 per unit of competency is charged for RPL and is payable

on application. There is no charge for credit transfer although applicants are advised that if credit transfer

is unsuccessful, students may opt to revert to an RPL assessment.

On completion of assessment the student will be advised of the outcome in writing and the student’s

records amended accordingly. Information for students Although recognition of prior learning may be granted, the course programs are delivered holistically.

Therefore, students are expected to participate in every session unless RPL/CT has been granted for the

following:

• Practitioner of Meta Dynamics™ • Meta Dynamics™ Profiling Certification • Meta Dynamics™ Facilitation Skills Training

In this instance the student is not required to attend this training and the associated course fees will be

deducted from the total course investment. For the units of competency taken from the Training Package BSB07, credit will only be considered for

qualifications held containing units having the same code and unit descriptor as required in The Coaching

Institutes delivery of the qualification or equivalent as listed in the Training Package. This is because

specific units are delivered throughout our program as an integral part of that program. Higher

qualifications, State based awards and revised units of competency may not be compatible.

Appeal Students who are not satisfied with the assessor’s determination of RPL/CT may appeal against the

decision by accessing and following The Coaching Institutes complaint resolution procedure.

Deferrals

Course Deferral

We recognise there are situations when students may need to defer their studies for a short period of

time. The Coaching Institute is able to defer your course for a period of up to three (3) months in

situations such as the following: • Unexpected international travel • Illness or serious injury • Death of an immediate family member • Irreconcilable marital breakdown

To apply for a deferral of your course you must send written notification to The Coaching Institute

advising the reason for your deferral request and the length of time (up to three (3) months) you will need.

Verbal and email requests are not accepted. Evidence of your deferral reason may be requested at the

discretion of the Coaching Institute Directors. If approved, your assessment planner will be adjusted to

accommodate your absence and your course completion date extended accordingly. For more details

Payment Deferral

Should you experience hardship such as loss of income or illness, you may defer your PayWay

payments. Payments can be deferred for one month only. To arrange a payment deferral contact

[email protected] at least seven (7) working days before your PayWay payment is

due. See The Coaching Institute Membership Only website for more details.

Transfers/Change of Name and Address We are required to hold your full legal name in our records. If for any reason you change your name after you

enrol with us, you need to provide us with details of your name change and a verified copy of the document

to support the change.

State legislation requires you either produce a new birth certificate (if you were born in Victoria) or a change

of name certificate (if you were born overseas). Your certificate will show your previous name, your new

name, and a history of your name changes.

Complete the Change of Details form which can be downloaded from the Member’s Only website, The

Coaching Institute Policies and Procedures section. If you change your address or any contact details, you need to inform us to ensure that all communication

continues to reach you. In the case of TCI sending resources to the incorrect address as a result of not being

informed of a change of address, the student will be billed for delivery costs. Remember, the primary form of communication between The Coaching Institute to its students is via email.

Access to Student Records Students can view their files or the information contained therein on request in writing to the Operations

Manager.

Third party access to student files is restricted to the student’s appointed Power of Attorney or Financial

Power of Attorney. Request for access must be in writing to the Operations Manager with evidence of Power

of Attorney or Financial Power of Attorney.

Once approved, students or their nominated third party will be invited to view the file on the premises at Suite

40 Albert Square, 37-39 Albert Rd, Melbourne. Under no circumstances are files to be removed from the

premises. Relevant documents of interest to the student may be copied and removed with the permission of

the Operations Manager.

Students unable to attend the premises, such as interstate and overseas students, are to submit a request in

writing to the Operations Manager for the transmission or dispatch of document copy. TCI will dispatch

documents to these students within 3 days of receiving the request.

After Course Completion Student files are retained on the premises for a period of six months after course completion. Once this period has elapsed, files (excluding submitted assessment evidence) are relocated to archive and retained for 30 years. Submitted assessment evidence is retained for a period of six months after course completion then destroyed. Students requiring return of submitted assessment documentation are to apply in writing to TCI administration after course completion and before the expiration of the 6 month retention period. A $20 postage and handling charge will apply to all material and is payable on application. Documents will be dispatched to the student on expiration of the 6 months retention period.

Legislation and Standards That May Impact On Your Studies There is a range of government legislation and regulations that may impact on your learning with The

Coaching Institute. The most relevant of these are: Sex Discrimination Act 1984 (Cth)

The Sex Discrimination Act deals with discrimination on the grounds of sex, marital status, pregnancy,

potential pregnancy, breastfeeding, family responsibilities or involving sexual harassment. In summary, TCI

cannot refuse a person’s application to study, nor can we discriminate in respect of the terms or conditions

on which we are prepared to admit a person as a student on any of the above grounds. TCI cannot deny or

limit access to any benefit provided by TCI, nor expel or subject a student to any other detriment on the basis

of any of the above grounds. Finally, it is of course unlawful for a member of staff to sexually harass a

student or a prospective student of TCI and the act also covers the sexual harassment by a student of

another student or a staff member.

Work Health and Safety Act 2011 (Cth)

The Work Health and Safety Act applies to you when you are on TCI premises in any state or territory other

than Victoria or Western Australia. The Act operates under the principle that staff and students should be

given the highest level of protection against harm to their health, safety and welfare from hazards and risks

arising from a workplace as is reasonably practical. It serves to secure the health and safety of staff,

students and workplaces by protecting workers and students through the elimination or minimisation of risks

arising from work.

Occupational Health & Safety Act 2004 (Vic)

This Act applies when you are at TCI HQ in Melbourne and its objects are to secure the health, safety and

welfare of employees and students at TCI HQ, to eliminate risks to the health, safety or welfare of staff and

students and to ensure that the health and safety of members of the public is not placed at risk by the

conduct of undertakings by TCI employers.

Occupational Health and Safety Regulations 2017 (Vic)

The objectives of these Regulations include furthering the objects of the Occupational Health and Safety Act

2004 by providing for health and safety in relation to workplaces and hazards, activities and things at

workplaces and providing procedures for the resolution of health and safety issues at workplaces.

Age Discrimination Act 2004 (Cth)

The objects of the Age Discrimination Act include the elimination, as far as possible of discrimination against

persons on the ground of age in the areas of work, education and the provision of goods, services and

facilities, to promote recognition and acceptance within the community of the principle that people of all ages

have the same fundamental rights and to remove barriers to older people participating in society. This means

that TCI cannot discriminate against a person on the ground of their age by refusing their application for

admission as a student, or in respect of the terms and conditions on which it is prepared to admit the person

as a student. TCI cannot deny or limit a student’s access to any benefit provided by TCI, nor can it expel or

subject a student to any other form of detriment on the basis of that student’s age.

Disability Discrimination Act 1992 (Cth)

The objects of the Disability Discrimination Act include the elimination, as far as possible of discrimination

against persons on the ground of disability in the areas of work, education and access to premises, the

provision of goods, facilities and services and to promote recognition and acceptance within the community

of the principle that persons with disabilities have the same fundamental rights as the rest of the community.

TCI cannot refuse a person’s application to study, nor can we discriminate in respect of the terms or

conditions on which we are prepared to admit a person as a student on the basis of disability. TCI cannot

deny or limit access to any benefit provided by TCI, nor expel or subject a student to any other detriment on

the basis of disability. Finally, TCI cannot develop curricula or training courses having a content that will

exclude a person from participation or subject the person to any other detriment or accredit curricula or

training courses having such content unless avoidance of any of the above mentioned discrimination would

impose an unjustifiable hardship on TCI.

Privacy Act 1988 (Cth)

The Privacy Act makes provision with respect to the collection, holding, use, correction, disclosure or transfer

of your personal information (including information relating to credit reporting or the use of information held in

connection with credit reporting).

Copyright Act 1968 (Cth)

The Copyright Act provides legal protection for people who express ideas and information in certain forms,

specifically, original literary, dramatic, musical and artistic works. Copyright protects the form or way an idea

or information is expressed, not the idea or information itself. Copyright is made up of a bundle of exclusive

economic rights to do certain acts with an original work or other copyright subject-matter. These rights

include the right to copy, publish, communicate (e.g. broadcast, make available online) and publicly perform

the copyright material. The most important of the exceptions to copyright infringement permits ‘fair dealing’

with a work for the purpose of research or study. In the case of ‘fair dealing’ copying of part of a work is

permitted and the Act sets out the extent of copying allowed.

Racial Discrimination Act 1975 (Cth)

The Racial Discrimination Act aims makes it against the law to treat a person unfairly, or to discriminate

against a person, on the grounds of race, colour, descent, national or ethnic origin. The Act also makes racial

hatred against the law. The Act protects against discrimination in many areas of public life, including training

and education – enrolling or studying in a course at a private or public school, college or university. The Act

also protects you if you are harassed because of your race. As a service provider, TCI cannot refuse or fail

on demand to supply its services to another person or refuse or fail on demand to supply those services

except on less favourable terms or conditions than TCI would otherwise supply those services on the basis

of any of the above grounds. Furthermore, TCI will not do any act if that act is reasonably likely, in all the

circumstances to offend, insult, humiliate or intimidate another person or group of people and the act is done

on the basis of any of the above grounds.

Standards for Registered Training Organisations (RTOs) 2015

The essential standards for continuing registration include the provision of quality training and assessment,

adherence to principles of access and equity, management systems that are responsive to the needs of

students, staff and stakeholders, governance arrangements to ensure compliance with the VET Quality

Framework, compliance with and staff and student knowledge of relevant Commonwealth, State or Territory

legislation and regulatory requirements, provision to students of comprehensive fee and refund policy

information and ethical, accurate and consistent marketing and advertising.

Occupational Safety and Health Act 1984 (W.A.)

This Act applies to you when you are on TCI premises in Western Australia. The principal objective of this Act is to promote and secure the safety and health of staff and students in the TCI workplace through the promotion and improvement of standards for occupational safety and health.

Occupational Safety and Health Regulations 1996 (W.A.)

These regulations have the effect of spelling out specific requirements of the Occupational Safety and Health Act and setting minimum requirements for specific hazards, work and administrative practices in relation to work safety and health.

OCCUPATIONAL HEALTH & SAFETY LEGISLATION – EXPLANATION

In recent times, the commonwealth and each state and territory of Australia had its own occupational health

and safety legislation and each piece of legislation was quite different. In a bid to create greater consistency

and harmonisation of OHS laws, the Federal Government conducted a comprehensive national review into

work health and safety laws across Australia and in June 2011, the Model Work Health and Safety Act (the

WHS Act) was created. Rather than launch a federal takeover of OHS laws, the idea was that each state and

territory would seek to enact the WHS Act, the supporting regulations and codes of practice. To date, seven

jurisdictions – the Commonwealth, New South Wales, Queensland, South Australia, Tasmania, the ACT and

the Northern Territory have enacted the Act. While the Victorian Government supports the principle of

national harmonisation and continues to work towards best practice legislation, it has confirmed that Victoria

will not adopt the WHS Act in its current form. Similarly, WA has indicated that it will not adopt specific

aspects of the Act. This means that Victoria and Western Australia continue to have their own OHS

legislation. Accordingly, the Victorian, Western Australian and WHS Act are all included here.

Victorian Student Number (VSN)

The Victorian Government has legislated and implemented a Victorian Student Number (VSN) for students in

Victoria.

Since 2009 the VSN is a student identification number that has been assigned by the Department of

Education and Training (DET) to all students in government and non-government schools and to students

below the age of 25 undertaking Vocational Education and Training with a TAFE, Registered Training

Organisation (RTO) or Adult and Community Education (ACE) provider (referred to collectively as VET

Providers).

The VSN provides the capability to gather:

Accurate knowledge of student movement and retention rates; and

Patters of student premature departure.

This information plays an important role in planning future investment in education and training.

All VSNs and associated information held within the Victorian Student Register (VSR) is subject to strict

privacy protocols covering access to and use of information.

If you already have a VSN, this will need to be provided by you during your first Personal Success Planning

Session (PSPS – a welcome interview/information session with a member of our student support Team). If

you do not have a VSN or you do have a VSN but cannot remember it, education/training information

provided by you will enable a VSN to be assigned or confirmed.

The operation of the VSN is managed by the Victorian Curriculum and Assessment Authority (VCAA).

Unique Student Identifier (USI) From 1st January 2015 all students enrolled in an Australian Vocational Education & Training (VET) course

must apply for a Unique Student Identifier (USI) from the USI Registrar. A USI is a reference number that

gives you access to your USI account. A USI will link your USI account to the National Vocational Education

and Training (VET) Data Collection, allowing you to see all of your training results from all providers including

all completed training units and qualifications.

Your USI will stay with you for life and be recorded with any nationally recognised VET course that you

complete after 1st January 2015. You will need to obtain the USI and provide to The Coaching Institute for

verification. Please note, we are prohibited from issuing certificates, statements of attainment of nationally

recognised qualifications to students who have not provided their USI.

Therefore, your application to enrol in one of our courses implies consent for the RTO to use personal

information provided by you during the enrolment process to verify your USI provided by you. Obtaining your

USI is a convenient, online process and you should be able to obtain your USI within a few minutes.

It is recommended you have at least one and preferably two forms of ID ready from the list below when

lodging your application:

1. Driver’s Licence

2. Medicare Card

3. Australian Passport

4. Visa (with Non-Australian Passport) for international students

5. Birth Certificate (Australian)

6. Certificate of Registration by Descent

7. Citizenship certificate

8. Immi card

bodies performing functions relating to VET for: o the purposes of administering and auditing Vocational Education and Training (VET), VET

providers and VET programs; o education related policy and research purposes; and o to assist in determining eligibility for training subsidies o VET Regulators to enable them to perform their VET regulatory functions; o VET Admission Bodies for the purposes of administering VET and VET programs; o current and former Registered Training Organisations to enable them to deliver VET courses

Once we have received your forms and you’ve completed all payment details you will receive your pre

learning pack via express post and also a New Member Code which will give you immediate access to your

pre learning pack, including the manual, CD’s and a DVD welcome from the founder Sharon Pearson.

Included in your posted Starter Kit will be all the details you need to attend your “Foundations of Coaching

Success” training, as well as accommodation recommendations if you are coming from interstate.

You will then be booked in for an interview with a member of the Student Support Team – this interview is to

clarify your goals as a result of completing your chosen program and to ensure we know how you would like

to be supported throughout your training at The Coaching Institute.
