Mechanics Lien Release

Mechanics liens are a form security offered by state’s legislative policy to secure the contractor and materialmen from non-paying or untimely paying project owners and general contractors on provided construction services. Mechanics liens give a contractor the right to lien the project owner’s real property.

Once the claimant has been paid, the property owner should request a lien release. These forms are often forgotten since there is not always an obligation to file them unless they are requested. Sometimes they must even be requested in writing, depending on state’s laws.

A sub-contractor can also file a lien on the owner’s real property for the lack of payments by their general contractors, even if the property owner has made all payments to the prime contractors.

What should a Lien Release include?

After a mechanics lien is filed with the county property records office, the only way to remove the lien is by filing a lien release signed and notarized by the same claimant that filed it in the first place. The lien release must be filed exactly in the same county office otherwise it would not be valid.

A lien release should include the name of the project, common address and/or the legal property description and the recorded document number given to the claimant in the lien filed.

A lien release should only be filed once the payment has been satisfied. If more than one lien was filed and the payment received only satisfied one of them, the other liens should be kept in place.

Lien release is often mistaken by a lien waiver. These are totally different forms and contractors should only sign each of those when they are 100% sure of their meaning and purpose.
