Princeville Well No.4, Well No. 1127-02
In accordance with Department of Land and Natural Resources, Commission on Water Resource Managemenfs Administrative Rules, Section 13-168, entitled "Water Use, Wells, and Stream Diversion Works", this document permits the pump installation for Princeville Well No.4 (Well No. 1127-02) at Powerline Road, Kauai, TMK 5·3-01 :27, subject to the Hawaii Well Construction & Pump Installation Standards (1/23/97) which include but are not limited to the following conditions:
1. The Chairperson to the Commission on Water Resource Management (Commission), P.O. Box 621, Honolulu, HI 96809, shall be notified, in writing, at least two (2) weeks before any work covered by this permit commences and staff shall be allowed to inspect installation activities in accordance with §13-168-15, Hawaii Admini~trative Rules.
2. The pump installation permit shall be for installation of a 400 gpm capacity, or less, pump in the well.
3. The permittee shall provide and maintain an approved meter or other appropriate means for measuring and reporting withdrawals and water levels, and appropriate devices or means for measuring chlorides and temperature. These data shall be measured monthly and reported to the Commission on a monthly basis, on forms provided by the Chairperson (attached).
4. The proposed use shall not adversely affect existing or future legal uses of water in the area, including any surface water or established instream flow standards. This permit or the authorization to pump water from a well shall not constitute a determination of correlative water rights. The permittee is notified and by this provision understands that the quantity of water taken from the well could be reduced by the Commission in the future. This permit is iiot a COffiiilit-neiit t'1at the pump capaciiy permitted here or even some lesser amount is guaranteed in the future.
5. The permittee shall complete and submit as-built drawings and Part II - (Permanent) Pump Installation Report of the Well Completion Report (attached) to the Chairperson within sixty (60) days after completion of work.
6. The permittee shall comply with all applicable laws, rules, and ordinances, and non-compliance may be grounds for revocation of this permit.
7. The pump installation permit application is incorporated into this permit by reference and is subject to the Hawaii Well Construction & Pump Installation Standards (1/23/97).
8. The permit may be revoked if work is not started within six (6) months after the date of approval or if work is suspended or abandoned for six (6) months, unless otherwise specified. The work proposed in the pump installation permit application shall be completed within two (2) years from the date of permit approval, unless otherwise specified. The permit may be extended by the Chairperson upon a showing of good cause and good-faith performance. A request to extend the permit shall be submitted to the Chairperson no later than three (3) months prior to the date the permit expires. If the commencement date is not met, the Commission may revoke the permit after giving the permittee notice of the proposed action and an opportunity to be heard.
9. If the well is not to be used it must be properly capped. If the well is to be abandoned then the permittee must apply for a well abandonment permit in accordance with §13-168-12(f) prior to any well sealing or plugging work.
10. Special conditions in the attached cover transmittal letter are incorporated herein by reference.

We understand that the project was deferred because water demands following Hurricane lniki were lower than projected, but have now returned to pre-Iniki levels. By this letter, your request is approved. The new expiration date is September 30, 2002.
Please remember to return a copy of the permit signed by your licensed contractor prior to commencing any work under this permit. Work performed without a fully signed permit is a violation of your permit approval conditions.

Enclosed is our executed Pump Installation Permit for Princeville Well No.4. As indicated on the form, the pump installation contractor is yet to be determined by competitive bid. Upon determination of the contractor, we will have the contractor execute the Pump Installation Permit, and we will forward a copy to your office.
By this letter we also request an extension of the referenced Permit. Our Well No.4 project was initiated in the early 1990's in response to a projected need for additional capacity for Princeville Utilities' water system due to increasing demands. However, after Hurricane Iniki struck in September of 1992, water demands dropped dramatically, and the project has been deferred ever since. However, water demands have now returned to pre-Iniki levels, and we now plan to begin outfitting of the well this year, with completion of the project scheduled for late 2001 For this reason, on January 14, 2000, the Board of Land and Natural Resources extended our Conservation District Use Permit (CDUP KA-2710) for this project until September 30,2002. A similar extension for our Pump Installation Permit would be most appreciated.

This includes ensuring that the pump installation contractor, or other party who installs the pump, submits a completed Part II of the Well Completion Report form (enclosed) within sixty (60) days after the pump installation work is completed. In accordance with Department of Land and Natural Resources, Commission on Water Resource Managemenfs Administrative Rules, Section 13-168, entitled "Water Use, Wells, and Stream Diversion Works·, this document permits the pump installation for Princeville Well No.4 (Well No. 1127-42) at Powerline Road, Kauai, TMK 5-3-01:27, subject to the Hawaii Well Construction & Pump Installation Standards (1123197) which include but are not limited to the following conditions:
1. The Chairperson to the Commission on Water Resource Management (Commission), P.O. Box 621, Honolulu, HI 96809, shall be notified, in writing, at least two (2) weeks before any work covered by this permit commences and staff shall be allowed to inspect installation activities in accordance with §13-168-15, Hawaii Administrative Rules.
2. The pump installation pennit shall be for installation of a 400 gpm capacity, or less, pump in the well.
3. The permittee shall provide and maintain an approved meter or other appropriate means for measuring and reporting withdrawals and water levels, and appropriate devices or means for measuring chlorides and temperature. These data shall be measured monthly and reported to the Commission on a monthly basis, on forms provided by the Chairperson (attached).
4. The proposed use shall not adversely affect existing or future legal uses of water in the area, including any surface water or established instream flow standards. This penni! or the authorization to pump water from a well shall not constitute a determination of correlative water rights. The permittee is notified and by this provision understands that the quantity of water taken from the well could be reduced by the Commission in the future. This pennit is not a commitment that the pump capacity permitted here or even some lesser amount is guaranteed in the future.
5. The permittee shall complete and submit as-built drawings and Part II - (Permanent) Pump Installation Report of the Well Completion Report (attached) to the Chairperson within sixty (60) days after completion of work.
6. The permittee shall comply with all applicable laws, rules, and ordinances, and non-compliance may be grounds for revocation of this pemit
7. The pump installation permit application is incorporated into this permit by reference and is subject to the Hawaii Well Construction & Pump Installation Standards (1123197).
8. The permit may be revoked if work is not started within six (6) months after the date of approval or if work is suspended or abandoned for six (6) months, unless otherwise specified. The work proposed in the pump installation pennit application shall be completed within two (2) years from the date of pennit approval, unless otherwise specified. The permit may be extended by the Chairperson upon a showing of good cause and good-faith performance. A request to extend the permit shall be submitted to the Chairperson no later than three (3) months prior to the date the permit expires. If the commencement date is not met, the Commission may revoke the permit after giving the permittee notice of the proposed action and an opportunity to be heard.

This well qualifies as a source which will serve as a source of potable water to a public water system (serving 25 or more people at least 60 days per year or has 15 or more service connections) and must receive Director of Health approval prior to its use to comply with Hawaii Administrative Rules (HAR), Title 11, Chapter 20, Rules Relating to Potable Water Systems, §11-20-29.
This well does not qualify as a source serving a public water system (serves less than 25 people or more people at least 60 days per year or 15 service connections) and if the well water is used for drinking, the private owner should test for bacteriological and chemical presence before initiating such use and routinely monitor the water quality thereafter. However, if future planned use from this source increases to meet the public water system definition then Director of Health approval is required prior to implementation.
If the well is used to supply both potable and non-potable purposes in a single system, the user shall eliminate cross-connections and backflow connections by physically separating potable and non-potable systems by an air gap or an approved backflow preventer, and by clearly labeling all non-potable spigots with warning signs to prevent inadvertent consumption of non-potable water. Backflow prevention devices should be routinely inspected and tested.
It does not appear that this well will be used for consumptive purposes and is not subject to Safe Drinking Water Regulations.

The Department of Health, Clean Water Branch has the following comments:
1. For Well-Drilling Activities
Any discharge to state waters of treated process wastewater effluent associated with well drilling activities is regulated by Hawaii Administrative Rules, Chapter 11-55, Appendix I, effective September 22, 1997. Treated process wastewater effluent covered by this general permit includes well drilling slurries, lubricating fluids wastewaters, and well purge wastewaters. This general permit does not cover well pump testing. The applicable Notice of Intent Forms and filing fee shall be submitted at least thirty (30) days before the start of discharge to the Department of Health, Clean Water Branch at 919 Ala Moana Boulevard, Room 301, Honolulu, Hawaii 96814-4920 or P.O. Box 3378, Honolulu, Hawaii 96801-3378. Inquiries may be directed to the Clean Water Branch at (808) 586-4309 or by fax at (808) 586-4352.
2. For Well Pump Testing
The discharger shall take all measures necessary to prevent the discharge of pollutants from entering state waters. Such measures shall include, if necessary, containment of the initial discharge until the discharge is essentially free of pollutants. If the discharge is entering a stream or river bed, best management practices shall be implemented to prevent the discharge from disturbing the clarity of the receiving water. If the discharge is entering a storm drain, the discharger must obtain written permission from the owner of that storm drain prior to discharge. Furthermore, best management practices shall be implemented to prevent the discharge from collecting sediments and other pollutants prior to entering the storm drain.

Remarks (cont1d): The,well consisted of 20-inch diameter, 20-foot long conductor pipe and 730 feet of, 12-inch diameter open hole. When the borehole was sounded, it was discovered that the borehole had collapsed to a depth of 235 feet (about 230 feet above the water table). The conductor pipe was pulled and the borehole was filled with neat cement.

In accordance with Department of Land and Natural Resources, Commission on Water Resource Management's Administrative Rules, Section 13-168, entitled 'Water Use, Wells, and Stream Diversion Works", this document permits the abandonment/sealing of Well No. 1127-01 at Princeville, Hanalei, Kauai, TMK 5-3-01 :13, subject to the following conditions:
1. The Commission on Water Resource Management, P.O. Box 621, Honolulu, Hawaii 96809, shall be notified in writing before any work covered by this permit commences.
2. The Well Abandonment Report form (attached) shall be submitted to the Commission on Water Resource Management within thirty (30) days after completion of the work.
3. The permittee shall comply with all applicable laws, rules, and ordinances.
4. The permit may be revoked if work is not started within six (6) months after the date of approval or if work is suspended or abandoned for six (6) months, unless otherwise specified. The work proposed in the well construction permit application shall be completed within two (2) years from the date of permit approval, unless otherwise specified. The permit may be extended by the Commission upon a showing of good cause and good-faith performance. A request to extend the permit shall be submitted to the Commission no later than three (3) months prior to the date the permit expires. If the commencement or completion date is not met, the Commission may revoke the permit after giving the permittee notice of the proposed action and an opportunity to be heard.
5. Special conditions in the attached cover transmittal letter are incorporated herein by reference.

Well Abandonment Report Princeville Well #3 (Well No. 1127-on
We received a well completion report for Princeville Well #3 (Well No. 1127-01) from Roscoe Moss Hawaii, Inc., indicating that the subject well has been abandoned since September 1992.
Pursuant to §13-168-16 liAR, the owner or operator of an abandoned well is required to properly fill and seal the well with cement in a manner approved by the Commission to prevent potential contamination of ground water resources. Be advised that the work may not commence until an application has been made and a wen construction permit has been obtained from the Commission on Water Resource Management. We have attached a well construction permit application for your use. In addition, we have enclosed the section from our proposed Well & Pump Installation Standards regarding well abandonment/sealing.

In accordance with the Department of Land and Natural Resources Administrative Rules, Section 13-168, entitled "Water Use, Wells, and Stream Diversion Works", your application to construct and test Princeville Well 2 (Well No. 1127-02), is approved subject to the following conditions:
1. The Commission on Water Resource Management (Commission), P.O. Box 621, Honolulu, HI 96809, shall be notified, in writing, before any work covered by this permit commences.
2. The permit shall be for construction and testing of the well only. The applicant shall coordinate with the Commission and conduct a pumping test in accordance with the protocol established by the Commission. A one-inch diameter (minimum) galvanized pipe shall be permanently installed, in a manner acceptable to the Commission, to accurately measure water levels. No permanent pump may be installed and no water withdrawn from the well without first obtaining a pump installation permit from the Commission.
3. The proposed well construction shall not adversely affect existing or future legal uses of water in the area, including any surface water or established instream flow standards. This permit or the authorization to construct a well shall not constitute a determination of correlative water rights.
4. The following shall be submitted to the Commission within 30 days after completion of the work:
a. Well Completion Report.
b. Elev,don (referenced to mean sea level) survey by a Hawaii-licensed surveyor.
c. As-built sectional drawing of the well.

d. Plot plan and map showing the exact location of the well.
e. Complete pumping test record; including time, pumping rate, drawdown, chloride content, and water quality data.
5. The applicant shall comply with all applicable laws, rules, and ordinances.
6. The permit application and staff submittal approved by the Commission at its meeting on March 16, 1994 shall be incorporated herein by reference.
7. The applicant shall contact the State Historic Preservation Division (Telephone: 587-0006) before starting any work on the project. The applicant shall obtain a written statement from the State Historic Preservation Division indicating that their concerns have been addressed, and a copy of that statement shall be sent to the Commission before work is started on the project.
8. This permit may be revoked if work is not started within six months of the date of issuance or if work is suspended or abandoned for six months. The work proposed in the permit application shall be completed within two years from the date of permit approval.

Princeville Water Systems, Inc. (PWS) has been attempting to locate another potable water source since 1991 under permits issued by the Commission. The first exploratory boring was completed under Permit No. 1127-01 and test results indicated that it had penetrated the same aquifer serving our existing system. The contractor was preparing to cap this well, and remobilize at another site selected by our hydrogeologist, Tom Nance Water Resources, Inc., when Hurricane Iniki struck KauaL Iniki's winds toppled the drill rig onto the adjacent concrete reservoir, damaging it and the tank. The drilling equipment was eventually shipped off the island for repairs. Both the reservoir and drill rig have now been repaired. We intend to make Well No. 1127-01 a monitoring well.
On November 24, 1993, PWS filed an application to relocate to an alternate site. (See attached letter.) We inadvertently failed to concurrently request an extension to this permit, which expired on December 20, 1993. PWS, like almost all businesses and residences on Kauai, suffered extensive damage to its facilities and records, severely hampering normal operations. As we approach normalcy, this is to request a two year extension to our permit. An extension would allow us time to obtain the required conservation district use permit and Hawaii Public Utilities Commission approvals as well as reorganize our drilling contract.

As a result of further analysis, we concluded that we needed to move Well No. 1127-02 further mauka (south), to enhance the probability of establishing a successful new well.

Relocation of the Site for Permitted Well 1126-03 at Princeville. Kauai
On December 20, 1991, the Commission on Water Resource Management granted well drilling permits for Well Nos. 1127-01 and 1126-03 to Princeville Water Systems, Inc. The new wells were required to enable pumpage from the two existing wells to be reduced and to supply planned new development. Our primary drilling site was Well No. 1127-01 next to the water system's existing tank. Well No. 1162-03 was chosen as a back-up site in the event that Well No. 1127-01 was not successful. "
The pilot hole for Well No. 1127-01 has been completed. If we terminate the well in the upper, Koloa series lavas, its yield is less than 200 GPM. When it is drilled deeper to increase yield, the well penetrates the same groundwater compartment already tapped by Princeville's two existing wells. These results establish that the back-up well site will be necessary but that the site originally chosen would not be appropriate. By this letter, we request that its location be moved as shown on the enclosed map. The well number at this new site would be 1127-02. The site is in the same parcel as the previous well site, TMK 5-3-01 :2, which is owned by the Princeville Development Corporation.
We would appreciate an expeditious response to this request so that we can move the drilling contractor to the new location. Thank you for your consideration.

In February 1992, our staff archaeologist for the county of Kauai, Ms. Nancy McMahon, met with Mr. Mike Loo of Princeville Corp. to inspect the project areas for the two well permits listed above. No historic sites were found in the area. The parcel has had its land surface extensively disturbed in the past, due to construction of a water tank. The other alternative area had its land surface disturbed in the past from cattle grazing and earlier cultivation by Mr. Titcomb during the 1800's.
Therefore, we now believe that the above projects will have "no effect II on significant historic sites.

Thank you for submitting the location maps of your proposed project.
No archaeological surveys have taken place in the project areas, so it is uncertain if significant historic sites are present. The proposed well locations and backup well location are located in areas that are rich in significant historic sites. Several heiau(s) have been found nearby (Bennett 1931).
Given the above, we recommend that an archaeological inventory survey be conducted for both project areas by a qualified archaeologist to determine if significant historic sites are in the project areas. This work should include representative subsurface testing if it appears likely that subsurface remains are present. If sites are found, their size, nature, function and age should be determined. Findings should be submitted to our office in a report format for review, and should include initial significance evaluations for any sites found. At that point we can better advise you regarding effects on significant sites and any mitigation that might be needed.

In accordance with the Department of Land and . Natural Resources Administrative Rules, Section 13-168, entitled "Water Use, Wells, and Stream Diversion Works", your application to construct and test Princeville Well 1 (Well No. 1127-01) at Tax Map Key: 5-3-01: 2, for private/municipal use, is approved subject to the following conditions:
1. The Division of Water Resource Management (DWRM), P.O. Box 373, Honolulu, HI, 96809, shall be notified, in writing, before any work covered by this permit commences.
2. The applicant shall contact the State Historic Preservation Division (Telephone: 587-0006) before starting any work on the project. The applicant shall obtain a written statement from the State Historic Preservation Division indicating that their concerns have been addressed, and a copy of that statement shall be sent to the Commission before work is started on the project.
3. This permit shall be for construction and testing only. No permanent pump may be installed and no water used from the well without the necessary pump installation permit from the Commission.

4. The proposed well construction shall not adversely affect existing or future legal uses of water in the area, including any surface water or established instream flow standards. This permit or the authorization to construct a well shall not constitute a determination of correlative water rights.
5. The following shall be submitted to DWRM within 30 days after completion of the well:
a. Well Completion Report.
b. Elevation (referenced to mean sea level) survey by a Hawaii-licensed surveyor.
c. As-built sectional drawing of the well.
d. Plot plan and map showing the exact location of the well.
e. Complete pumping test record, including time, pumping rate, drawdown, chloride content, and water quality data.
6. The applicant shall comply with all applicable laws, rules, and ordinances.
7. This permit may be revoked if work is not started within six months of the date of issuance or if work is suspended or abandoned for six months. The work shall be completed within two years of the date of issuance.

Thank you for the opportunity to review and comment on the subject documents. We have examined the applications and have the following comments to offer:
1. The application indicates that the subject wells will be for municipal use. If each well is to serve 25 or more individuals at least 60 days per year or will have a minimum of 15 service connections, the applicant will be required to comply with Title 11, Chapter 20, "Potable Water Systems," Hawaii Administrative Rules.
2. Section 11-20-29 of Chapter 20 requires that a new source of potable water serving a public water system be approved by the Director of Health prior to its use. Such an approval is based primarily upon the submission of a satisfactory engineering report which addresses the requirements set in Section 11-20-29.
3. The proposed wells are situated above the Underground Injection Control (UIC) line. Land areas above the UIC line are considered to contain underground sources of drinking water. Thus, it is essential that each well be designed and constructed to prevent the possibility of groundwater contamination. For example, each well should have a concrete well pad and full grouting to prevent seepage or floodwaters from migrating down the well shaft.

No historic sites are known to be present in the area planned for the pump. But a review of our files indicates that a heiau (site 139) exists nearby. No archaeological surveys have taken place in the project area, so we are uncertain if significant historic sites are present in the project area.
Given this information, we recommend that an archaeological inventory survey be conducted to determine if significant historic sites are present. Alternatively, if the parcel has had its land surface extensively disturbed in the past, the applicant should submit a description of this disturbance.
