Peter McGl ew's l etter dated 12 Hay 1983 to Mr . Michael P. Donahue, P.E. of this agency relative to the subject, and expands on our l etter dated 5 Hay 1983 . Enclosed is a copy of a memrandum dated 20 December 1982 rela- tive to the Interagency Selection Board meeting at which the firm of Camp. Dresser & McKee. Inc. wa s selected to continue the work at the Keefe site. The last paragrarh of the memorandum indicates the un- animous consensus of the Co11'111ittee relat i ve to continue with COM. Although not speci fi ca lly cit ed i n the mem . had another consult- ant , other than COM . been selected, the provisions of clause 13 under 40 CFR Sect ion 33.1030 could not ha ve been met relative to the new con- sultant's liability for the design work which had been p er formed by COM under the EPA contract. In the wastewater construction grants program, when a municipa l ity has changed consultants between Step 2 and Step 3 work, the former consultant remains responsible for design errors, omissions or deficiencies. Such a condition would have been unacceptable for the work at the KES site in view of the urgency as well as the nature of the work. The additional costs involved as well as the split responsibility would not have been acceptable or justifiable. Also, please be advised again that the New Hampshire System for Procurement of Engineering Services covered by the EPA HQ Certification Agreement executed in March 1976 is considered as a Competitive Negoti- ation method under 40CFR33.525. This 1s in response to Mr Peter McGl ews letter dated 12 Hay 1983 to Mr Michael P Donahue PE of this agency relative to the subject and expands on our l etter dated 5 Hay 1983

Enclosed is a copy of a memrandum dated 20 December 1982 relashytive to the Interagency Selection Board meeting at which the firm of Camp Dresser amp McKee Inc was selected to continue the work at the Keefe site The last paragrarh of the memorandum indicates the unshyanimous consensus of the Co11111ittee relat ive to continue with COM

Although not speci fi cally cited i n the mem had another consultshyant other than COM been selected the provisions of clause 13 under 40 CFR Section 331030 could not ha ve been met relative to the new conshysultants liability for the design work which had been performed by COM under the EPA contract In the wastewater construction grants program when a municipa l ity has changed consultants between Step 2 and Step 3 work the former consultant remains responsible for design errors omissions or deficiencies Such a condition would have been unacceptable for the work at the KES site in view of the urgency as well as the nature of the work The additional costs involved as well as the split responsibility would not have been acceptable or justifiable

A meet i ng of the Select ion Corrmittee was held on Friday December 17th at 1030 am regarding the selection of a prequali fi ed engishyneering consultant to oversee dnm and bulk waste removal from the Keefe En vironmental Services s i te Representatives of the Office of Wa ste Management and Office of State Planning were unable to attend

In general it was the unanirrous opinion of Comnittee members present that Camp Dresser amp McKee Inc should continue to be retained for engineering oversight of the cleanup project They had performed Step 1 and 2 work under the Environmental Protection Agency National Contract for the Water Supply and Pollution Control Corrm1ss ion and li ke other agency contractors Camp Dresser amp Mc Kee Inc would be responsible for interpr eting and implementing the plans and specifications per exist ing procurement proceedings

Mr Seufert was directed to begin negotiating with Camp Dresser amp Mc Kee Inc after a scope of work had been agreed to with Mr Roy Since si t e operat ions were planned fo r ea rl y spri ng it 1s ess entia l to expedi t e t he cont rac t

It was the unanimous consensus that to change from Camp Dresser amp McKee Inc to any other firm at this point woul d unnecessarily delay t he project and result i n additional costs for any other f i rm to familiarize i tself with the projeCt in an adequate manner to oversee this effort middot
