Introduction: Department of Public Safety and University Policies
The Department of Public Safety, located in the power plant building directly across from parking lot 6, operates 24 hours a day year-round and is composed of professional police, security, and Public Safety personnel. Sworn Department of Public Safety officers investigate all violations of local and state laws including Massachusetts Chapter 90 governing motor vehicles, and are empowered to carry firearms and make arrests. Our police officers are vested with full law enforcement powers and receive the same initial training as municipal law enforcement officers In the Commonwealth of Massachusetts. Officers are required to attend the Massachusetts Criminal Justice Training Council Police Recruit Academy and are supplemented by ongoing in-service training each year. Officers frequently attend in-depth training in a wide variety of specialized topics such as crime prevention theory, the investigations of sexual assaults and bias- related incidents and all other incidents requiring police assistance.

TheDepartmentofPublicSafetymaintainsacloseworkingrelationshipwiththeDartmouthPoliceDepartment,aswellasstateandfederallawenforcementagencies.Asacourtesy,weroutinelyexchangeinformationonarrestsandseriouscrimeswithbothstateandlocalpoliceadjacenttotheUniversity.Theserialnumbersandidentifyingdescriptionofallstolenmotorvehicles,officeequipmentandotherstolenpropertiesfromourcampusisreportednationwidethroughtheNationalCrimeInformationCenter(NCIC).
Potentialcriminalactionandemergenciesoncampusshouldbereporteddirectlybyanystudent,faculty,stafforvisitor.

Wefeelthatmostviolationscommittedoncampusarepreventable.Aspartoftheuniversity‘seducationalmission,theDepartmentofPublicSafetyattemptstoteachandeducatemembersofthecampuscommunityonhowtoreducetheirchancesofbecomingavictimofpersonalorpropertycrime.Forthisreason,thedepartmenthasaCrime Prevention UnitwithacertifiedCrimePreventionOfficer/Coordinatordedicatedfull-timetoseveralCrimePreventionPrograms.

Lighting/Brush Surveys.Thesesurveysareconductedbiannuallytoevaluatethesafetyconditionsoftheuniversity.TheserecommendationsarethenforwardedtofacilitieswhotakeappropriateactiontocorrectanyrepairsaffectingthesafetyandsecurityoftheUniversity.TheFacilitiesandPhysicalPlantDepartmentmaintainsallbuildingsandgroundsfortheUniversityandinspectscampusfacilitiesregularly.

Confidential Reporting Procedures
IfyouarethevictimofacrimeanddonotwanttopursueactionwithintheUniversitysystemorthecriminaljusticesystem,youmayconsidermakingaconfidentialreport.Withyourpermission,aUniversitypoliceofficercanfileareportonthedetailsoftheincidentwhilenotrevealingyouridentity.Aconfidentialreportwillkeepthematterconfidential,whiletakingstepstoensurethefuturesafetyofyourselfandothers.Thisinformation,willallowthedepartmenttokeepanaccuraterecordofthenumberofincidentsinvolvingstudents,employeesandvisitors.Itwillalsohelpdetermineifthereisapatternofcrimewithregardtoaparticularlocation,method,orassailant;andalertthecampuscommunitytopotentialdanger.Reportsfiledinthismannerarecountedanddisclosedintheannualcrimestatisticsfortheinstitution.
Victims of Crimes of Violence
Theinstitutionwill,uponrequest,disclosetotheallegedvictimofacrimeofviolenceasthattermisdefinedinSection16ofTitle18,UnitedStatesCode),oranonforciblesexoffense,thereportontheresultsofanydisciplinaryproceedingconductedbysuchinstitutionagainstastudentwhoistheallegedperpetratorofsuchcrimeoroffense.Iftheallegedvictimisdeceasedasaresultofsuchcrimeoroffense,thenextofkinofsuchvictimshallbetreatedastheallegedvictimforpurposesofthisparagraph.
Community Policing
TheUMassDartmouthDepartmentofPublicSafetyiscommittedtobuildingpartnershipswiththecommunity.Ourdepartment’scommunity policingphilosophyisbasedcrimeprevention,problemsolving,andformingpartnershipsinthecommunity;policeandtheuniversitycommunitymustworktogethertoidentify,prioritizeandsolveproblemswiththegoalofimprovingtheoverallqualityoflifeinthecommunity.TheDepartmentwilloperationalizethisconceptthoughincreasedvisibilityandfacetofaceinteractionwithmembersofthecommunity.

On-Campus Student HousingThereare13ResidenceHallsand2townhousecomplexesoncampus.AllResidenceHallsentrancesarelockedtwenty-fourhoursadayandalltrafficenteringandexitingthebuildingsisrestrictedtothemaindoorways,exceptinanemergencysituation.Eachresidencehallhasadeskstaffedbyanattendantduringeveninghours.Accesstoeachapartmentorroomisregulatedbytheresidents.Academicbuildingsaresecuredatapproximately10:30pmeachnightbysecuritypersonnel.

Violence in the Workplace
ItistheintentoftheuniversityofMassachusettsDartmouthtoprovideasafeandsecureenvironmentfortheentireuniversitycommunitybyimplementingpreventativemeasures,holdingviolatorsaccountable,andtoprovideassistanceandsupporttovictims.Violenceintheworkplacecanbedefinedastheactsofthreatsorviolencethatariseoutofeitherdisputesorantagonisticinterpersonalrelationshipsbetweenemployees,visitors,customers,and/ortheiremployeesinandaroundtheplaceofemployment.Workplaceviolencecanbecategorizedintothreeareas:strangerviolence,clientviolence,andemployeeviolence.Personalharassment(includingstalking),abusivebehavior,andviolencearenottoleratedintheworkplaceandmaybesubjecttocriminalprosecutionunderMGLChapter265,Section43aandotherrelevantstatutes.CallPublicSafetywithanyquestionsorconcernsatext.8107.

Sex Offense Policies and Procedures
Sexual AssaultThepossiblesanctionsforrape,acquaintancerape,orothersexoffenses(forcibleornon-forcible)areaddressedbytheUMassDartmouthStudentJudicialCodeandtheUniversity’sSexualHarassmentPolicy:www.umassd.edu/studentaffairs/judicialaffairsThepriorityofanysexualassaultvictimshallbetogettoasafeplaceandobtainmedicaltreatment.TheDepartmentofPublicSafetyencouragesallvictimstoreporttheincidentinatimelymanner.Filingareportwillnotnecessitatecriminalprosecutionnorwillthissubjectthevictimtoscrutinyorjudgmentalactionsbythepolice;reportingallowsformedicaltreatment,collectionofphysicalevidence,andaccessingcounselingservicesfrompersonsspeciallytrainedintheareaofsexualassaultintervention.Iftheincidenttakesplaceintheresidencehalls,theresidentassistantwillcontacttheuniversitypolice.Inordertopreserveevidence,clothesshouldnotbelaunderedandashowershouldnotbetaken.

Sexual Harassment
Sexualharassmenthasbeendefinedastheunwelcomesexualadvances,requestsforsexualfavors,andotherverbalorphysicalconductofasexualnature.Theseconstitutesexualharassmentwhen:1.submissiontosuchconductismadeeitherexplicitlyorimplicitlyatermorconditionofemployment;2.submissiontoorrejectionofsuchconductbyanindividualisusedasthebasisforemploymentdecisionsaffectingthatindividual;or3.suchconducthasthepurposeofunreasonablyinterferingwithanindividual’sworkorcreatinganintimidating,hostile,oroffensiveworkingenvironment.Althoughthisdefinitionfocusesonemployment,thesametypesofunwelcomeconductintheclassroomconstitutesexualharassmentandareprohibited.Sexualharassmentcanoccurinasituationwhereonepersonhaspoweroveranother,butitcanalsooccurbetweenequals.Bothmenandwomencanbesexuallyharassed,althoughwomenaremoreoftenvictimized.Harassmentunderthethirdpartofthedefinitionoftenconsistsofcallousinsensitivitytotheexperienceofwomen.AnymemberoftheUMassDartmouthcommunityfoundtohaveviolatedtheuniversity’ssexualharassmentpolicywillbesubjecttoarangeofdisciplinaryactionuptoandincludingpossibleterminationordismissal.Retaliationagainstindividualswhofilecomplaintsorparticipateintheinvestigationofasexualharassmentcomplaintisunlawfulandwillnotbetolerated.
UMassDartmouthhasaSexualHarassmentComplaintProcedurewhichprovidesforinvestigationandinformalandformalresolutionprocesses.Allcomplaintswillbeinvestigatedinafairandexpeditiousmanner.Everyeffortwillbemadetoinvestigateeachcomplaintinamannerrespectingtheprivacyofthoseinvolved.

Student ConductTheUniversityrespectsthelawsandordinancesoftheciviljurisdictionwithinwhichitlies.TheUniversitydoesnotstandinlocoparentisforitsstudents,noristhecampusconsideredasanctuaryfromcivillaw.SeriousactsoffelonycommittedbystudentsonthecampusoftheUniversity,initsbuildings,oratUniversity-sponsoredeventswillbereportedtotheproperlawenforcementagencyasisrequiredbylaw.
HazingTheUniversityisrequiredbystatelawtoissuetoeachstudentthefollowingsectionsofthelawpertainingtohazing.

Section17.Whoeverisaprincipalorganizerorparticipantinthecrimeofhazing,asdefinedherein,shallbepunishedbyafineofnotmorethanthreethousanddollarsorbyimprisonmentinahouseofcorrectionfornotmorethanoneyear,orbothsuchfineandimprisonment.Theterm“hazing”asusedinthissectionandinsectionseighteenandnineteen,shallmeananyconductormethodofinitiationintoanystudentorganization,whetheronpublicorprivateproperty,whichwillfullyorrecklesslyendangersthephysicalormentalhealthofanystudentorotherperson.Suchconductshallincludewhipping,beating,branding,forcedcalisthenics,exposuretotheweather,forcedconsumptionofanyfood,liquor,beverage,drugorothersubstanceoranyotherbrutaltreatmentorforcedphysicalactivitywhichislikelytoadverselyaffectthephysicalhealthorsafetyofanysuchstudentorotherperson,orwhichsubjectsuchstudentorotherpersontoextremementalstress,includingextendeddeprivationofsleeporrestorextendedisolation.
Notwithstandinganyotherprovisionsofthissectiontothecontrary,consentshallnotbeavailableasadefensetoanyprosecutionunderthisaction.

Section18.Whoeverknowsthatanotherpersonisthevictimofhazingasdefinedinsectionseventeenandisatthesceneofsuchcrimeshall,totheextentthatsuchpersoncandosowithoutdangerorperiltohimselforothers,reportsuchcrimetoanappropriatelawenforcementofficialassoonasreasonablypracticable.Whoeverfailstoreportsuchcrimeshallbepunishedbyafineofnotmorethanonethousanddollars.

Eachinstitutionofsecondaryeducationandeachpublicorprivateinstitutionofpostsecondaryeducationshallfile,atleastannually,areportwiththeregentsofhighereducationandinthecaseofsecondaryinstitutions,theboardofeducation,certifyingthatsuchinstitutionhascompliedwithitsresponsibilitytoinformstudentgroups,teamsororganizationsandtonotifyeachfulltimestudentenrolledbyitoftheprovisionsofthesectionsseventeenandeighteenandalsocertifyingthatsaidinstitutionhasadoptedadisciplinarypolicywithregardtotheorganizersandparticipantsofhazing,andthatsuchpolicyhasbeensetforthwithappropriateemphasisinthestudenthandbookorsimilarmeansofcommunicatingtheinstitution’spoliciestoitsstudents.Theboardofregentsand,inthecaseofsecondaryinstitutions,theboardofeducationshallpromulgateregulationsgoverningthecontentandfrequencyofsuchreports,andshallforthwithreporttotheattorneygeneralanysuchinstitutionwhichfailstomakesuchreport.
Firearms and Weapons
PossessionoffirearmsontheUniversitypropertyisregulatedunderMGL,Chapter269,Section10j.Firearmsofanytype,assembledordisassembled,ammunition,knives,machetes,javelins,martialartsdevices,clubs,oranydevicewhichcanbeconsideredhazardoustothewelfareofmembersoftheuniversitycommunityarestrictlyprohibitedoncampus.Anyviolationofstatelawsortownordinancesprohibitingthemanufacture,sale,purchase,transportation,possession,concealment,oruseoffirearms,cuttinginstruments,explosives,incendiarydevices,orotherdeadlyweaponswillresultinprosecutionandwillbesubjecttoseveredisciplinaryaction,upto,andincluding,dismissalfromtheuniversity.

Drugs and Alcohol
TheUniversityseekstoencourageandsustainanacademicenvironmentthatbothrespectsindividualfreedomandpromotesthehealth,safetyandwelfareofallmembersofitscommunity.Inkeepingwiththeseobjectives,theUniversityhasestablishedapolicyalongwithguidelinesgoverningthepossession,sale,andconsumptionofalcoholicbeveragesontheUniversitycampuswhileconformingtothelawsoftheCommonwealthofMassachusetts.ThesaleofalcoholicbeveragesisallowedonlyinlicensedareasandonlyunderstrictguidelinesinaccordancewiththerulesandregulationsoftheUniversity.
TheUniversitydoesnotcondonepossession,useof,ordistributionofmarijuana,L.S.D.orotherhallucinogensandnarcoticsbyanyoneinanyUniversityfacility.Anyindividualknownpossessing,usingordistributingsuchdrugsissubjecttodisciplinaryactionandpossiblearrest,imprisonmentorfineaccordingtoMassachusettsGeneralLaw.
Massachusettslawforbidsthesaleorservingofalcoholicbeveragestopersonsunder21yearsofage.Thelawalsoforbidsfalsifyingidentitycardsandmisrepresentingageinordertoobtainalcohol.TheUniversityenforcesthelawsregardingillegaluseofalcoholanddrugs.Thespecificlegislationregardingthelocal,stateorfederalsanctionsfortheunlawfulpossessionordistributionofillicitdrugsandalcoholareonfilewiththeDepartmentofPublicSafety,ViceChancellorforStudentAffairs,andtheDeanofStudents.
Theyinclude:1. CH94C,Controlledsubstances,whichinclude“marijuana,cocaine,morphine,opium,heroin,etc.”andalsolistscriminalpenaltiesoranyprohibitedmisuseofthesubstances.Theseincludeforfeitureofpropertyaswellasimprisonmentandothercriminalandcivilpenalties.
2. CH138,AlcoholicLiquors,regulatessaleofliquorstominor,useoffalseidentificationcardtoobtainliquor,makingfalsestatementsastoagetoobtainliquorandoperationofmotorvehiclescontainingalcoholicbeverages.Lawsregardingdrivingwhileundertheinfluenceofliquoralsoapply.
3. TheordinanceoftheTownofDartmouthprohibitpublicconsumptionofalcoholicbeverages.
TheDepartmentofPublicSafetyhasnostatutoryauthorityoveroff-campusresidents.DartmouthandotherlocalpolicealongwiththeMassachusettsStatePoliceDepartmentshareconcurrentjurisdiction.TogetherthesepoliceagenciesshareanexcellentmutualworkingrelationshipwiththeDepartmentofPublicSafetyandasrequired,mutualaidisrenderedamongtheagencies.

Consuming and Transporting Alcohol
Anypersonconsumingalcoholicbeveragesoutsideofalicensedand/orsanctionedareashallbeorderedtodisposeofsaidbeverage.Theviolationwillresultintheindividual(s)beingreportedtotheViceChancellorforStudentAffairsordesigneeforpossibledisciplinaryactionandsubjecttocriminalprosecution.
Anypersonpossiblyunder21yearsofagewhoisobservedtransportingalcoholicbeverages,shallberequiredbyapoliceofficertoprovideproofofage.Ifthepersoninfactisunder21yearsofage,thepoliceofficershalldetermineiftheyarecurrentlyauniversitystudent.Ifso,theyshallbeinformedbythepoliceofficerthattheviolationshallresultinactiontakenbytheViceChancellorforStudentAffairsordesigneeandsubjecttocriminalprosecution.
Inanyevent,thepoliceofficershallconfiscatethealcoholicbeveragesanddisposeofthem.Thelegallyunder-agedindividualcaughtwithalcoholmaybechargedwithaviolationofMassachusettsGeneralLaw,i.e.,minorinpossessionofalcoholicbeverages.
Drug and Alcohol Education and Referral
TheintentionoftheUniversityistosupportstudentsandstaffindemonstratingresponsibleconductinthebestinterestoftheirpersonalhealthandwellbeing,thecommunity’swellbeingandtherightsofothers.
TheUniversitypromotesattitudesandbehaviorthatcreateauniversityatmosphereofcivilityanddiscourageanybehaviorthatisabusivetoothers.
TheUniversityprovidesalcoholanddrugeducationcounseling,interventionandreferralservicestostudents,faculty,staffandadministrators.TheProgramconsistsofthreeareaseducation,counseling,andreferral.
TheUniversityprovidesorientationforincomingstudentsaboutalcoholanddrug-relatedissuesanduniversitypolicy.Italsooffersworkshopsforresidencehallsstaffregardingassessmentofalcoholtroubledstudents.
TheCounselingCenterprovidesindividualandgroupcounselingsessions,andregularlyscheduledmeetingsforAdultChildrenofAlcoholicsandAlcoholicsAnonymous.Thereferralprogramprovidesliaisonwithlocalalcoholanddrugtreatmentprogramsandutilizationofotheruniversitycounseling,healthandacademicresources.
Referralsaremadetolocaltreatmentprogramsinvolvingalcoholanddrugabuse.TheprogramalsoprovidesforfurtherutilizationofotherUniversitycounselingsuchashealthandacademicresources.

The Jeanne Clery Crime Awareness and Campus Security Act 1998
TheJeanneCleryDisclosureofCampusSecurityPolicyandCampusCrimeStatisticsActof1998asamendedrequiresthatcollegesanduniversitiespublicizecampuscrimestatisticsandinterimreportsofseriouscrimeincidents.Thesepublicizedstatisticsaremeanttowarnstudents,employees,andapplicantsoftheprevalenceofcampuscrime.Employeesandstudentsmustbegiveninterimcrimereportswhichincludestatisticsonmurder,forciblesexoffenses,non-forciblesexoffenses,robbery,aggravatedassault,burglary,larceny(theft),andmotorvehicletheft.Theannualreportmustalsodescribehowtoreportcrimesandemergenciesoncampus.

Sex Offender Registry
TheFederalCampusSexCrimesPreventionAct,enactedonOctober28,2000,requiresinstitutionsofhighereducationtoissueastatementadvisingthecampuscommunitywherelawenforcementagencyinformationprovidedbyaStateconcerningregisteredsexoffendersmaybeobtained.ItalsorequiressexoffendersalreadyrequiredtoregisterinaStatetoprovidenotice,asrequiredunderStatelaw,ofeachinstitutionofhighereducationinthatStateatwhichthepersonisemployed,carriesonavocation,volunteersservicesorisastudent.

Missing Persons
ThepolicyoftheUniversityofMassachusettsDepartmentofPublicSafetyisfullyinvestigateallreportsofmissingpersonsandtorecordallfactualcircumstancessurroundingthedisappearance.Departmentpersonnelshallexerciseparticularcareininstancesinvolvingmissingchildrenandthosewhomaybeunabletotakecareofthemselves.Uponreceivingareportofamissingperson,aninvestigationwillcommenceimmediately.
Reporting Missing Persons
Ifamemberoftheuniversitycommunityhasreasontobelievethatastudentwhoresidesinon-campushousingismissing,heorsheshouldimmediatelynotifyTheUMassDepartmentofPublicSafety.TheUniversityofMassachusettsDepartmentofPublicSafetythoroughlyinvestigatesallpersonsincludingstudentsreportedasmissingandworkscollaborativelywithadjoiningjurisdictionsToreportamissingpersondialX9191fromacampustelephone,useoneofbluelightemergencytelephonesoncampusordial(508)999-9191fromoff-campus/cellphones.YoualsocanreportamissingpersoninpersonattheUMassDartmouthDepartmentofPublicSafetywhichisstaffedwithprofessionalpersonnel,24/7.
If the Missing Person is a student, Public Safety will follow these procedures:• Ifthemissingstudentresidesinon-campushousing,theDPSPolice SupervisorwillnotifytheResidentAdvisor(RA)ortheResidentDirector(RD) fortheareainwhichthestudentishoused.TheRAshouldbedirectedto contactneighborsandfriendsintheimmediatevicinityofthestudent’sroom andreportanyfindingstoDPS. Localpolicewillbecontactedforthwithofthedeterminationthatthe studentismissing.
• Thereisnowaitingperiodtoreportamissingperson.
• If themissing student residing on-campus has been reportedmissing, DPS willnotifythestudent’sdesignatedemergencycontactwhichismaintainedin COIN and Housing databases. In addition to registering and emergency contact,studentsresidinginon-campushousinghavetheoptiontoidentify, confidentially,anindividualtobecontactedbyDPSintheeventthestudent isdeterminedtobemissingformorethan24hours. Students arereminded to updatetheiremergencycontactinformation inbothdatabasesasneeded.
• TheDPSSupervisor,uponconfirmationthatastudentismissingandcannot belocated,shallnotifytheOfficeofStudentAffairsAdministratoroncalland ensurethemissingstudententeredintoNCIC.
• If the student is under 18 yearsold, the StudentAffairs Administrator on call will immediatelynotifya custodialparent or legal guardianwithin24 hoursofthedeterminationthatthestudentismissing,inadditiontonotifying anyadditionalcontactpersondesignatedbythestudent. Themissingstudent willalsobeenteredintoNCICbyDPS.
If a student over 18 years old has not designated an emergency contact, thelawenforcementagencywherethestudent’sprimaryresidenceislocatedwillbenotifiedbyDPS.

For international students, the DPS Supervisor will contact the Office ofInternationalStudentProgramsforassistance.
TheDPSSupervisorwillalsocheckhospitaladmissionsandtheadjoiningpoliceagenciesforfurtherinformationregardingthemissingperson.Further,DPSwillalsocontactCounselingCenterintheeventthatthestudenthasbeenreceivingcounseling,aswellasStudentHealthServicesandOutPatientEmergencyRoomsinareahospitals.
Ifthestudentlivesoff-campus,theDPSSupervisorwillcontacttheAdministratoronCallinStudentAffairswhowill attempt contactthelandlordof thepropertytoobtain the names of neighbors or fellow residents, assuming this information isnotalreadyknown.Thelandlordshallbeaskedtoaccompanypoliceofficerstotheapartmentof themissingstudent.TheDepartmentofPublicsafetywillenlistthesupportoflocalpolicedepartmentsasneeded.
Emergency Notification Procedures
ThepurposeofthispolicyistocomplywiththeDepartmentofEducationrequirementsregardingtimelynoticeofcertaineventsasdescribed20U.S.C.s.1092(f),knownastheJeanneCleryDisclosureofCampusSecurityPolicy,alongwiththeCampusCrimesStatisticsAct(1998).TheseactsalongwiththeHigherEducationReauthorizationAct(2008)requireanyactswhichhaveoccurredonornearcampus,requirecampuspoliceofficerstokeeptheinstitutioninformedonatimelybasisofcrimesandotherimminentthreatsthatmayrequiretimelywarning.
ItisthepolicyoftheUniversityofMassachusettsDartmouthDepartmentofPublicSafetytofullycomplywiththeprovisionsandintentofthe“CleryAct”,inregardstothetimelynotificationofourcampuscommunity,ofanycontinuingthreatstotheirsafety,inordertoaidinthepreventionofsimilaroccurrences.
Thedecisiontoissueanalertshallbedecidedonacasebycasebasisinlightofallthefactssurroundinganincidentorcrime,includingfactorssuchasthenatureoftheincident/crime,thecontinuingthreattothecampuscommunity,andthepossibleriskofcompromisinglawenforcementefforts.
PROCEDURAL TERMS - Alert Types
Therearetwoalerttypescoveredbythispolicy,whichareusedtonotifythecampuscommunity.
1.CampusAlertsareissuedtonotifythecampuscommunityofimminentorongoingthreatstosafety,securityorhealth.Theyaredisseminatedwiththegoalofnotifyingasmanypeopleaspossible,asrapidlyaspossible.(i.e.activeshooter,bombthreat,dangerouschemicalrelease,etc.)
2.CrimeAlertsprovide“timelywarnings”,incompliancewiththeCleryAct.Theyareissuedwheneveracrimeorseriesofcrimes,oncampusorinthesurroundingcommunities,isconsideredtoposeacontinuingrisktostudentsandemployees.(i.e.,robberies,burglary,assault,hatecrime,etc.,aslistedinsection5.A.)
Delivery Methods

providenotice,accurateinformationandaninstructionwithminimumdelayduringanemergencyiscrucial.Toaccomplishthistask,universityhasselectedRave/MyAlert,amulti-contactcommunicationservicewhichallowsUniversityofMassachusetts-Dartmouthcampusleadersandsecuritypersonneltodelivertimesensitivenotificationstostudents,facultyandstaffduringunforeseeneventsoremergencies.Thissystemcomplementstheexistingcampusemergencyresponseplanswhicharecontinuouslyupdatedtoberesponsivetobothman-madeandnaturaldisasters.UniversityandcampusleadershaveintegratedcomputerinformationsystemswiththeRave/MyAlertSystem.
Timely Warnings
Intheeventthatasituationarises,onoroffcampus,that,inthejudgmentoftheChiefofPolice,constitutesanongoingorcontinuousthreat,acampuswide“TimelyWarning”willbeissued.ThetimelywarningwillbeissuedthroughtheUniversityemailsystemtostudents,faculty,andstaff.TheChiefofPolicewilldetermineawarrantedTimelyWarningonacasebycasebasis.
Dependingontheparticularcircumstancesofthecrime,especiallyinallsituationsthatcouldposeanimmediatethreattothecommunityandindividuals,theDepartmentofPublicSafetywillprovidetheUniversityCommunitywithmoreimmediatenotificationusinganexteriorpublicaddress/emergencynotificationsystemand/ortheemergencypersonalnotificationsystem,MyAlert.
AnyonewithInformationwarrantingatimelywarningshouldreportthecircumstancestotheDepartmentofPublicSafetybyphoneatX9191(oncampus)or508-999-9191(offcampus)orinpersonattheDispatchCenterwithinthePublicSafetybuilding.
TheRave/MyAlertsystemwillbeusedwhenitisdeterminedthatthereisasignificantemergencyordangeroussituationsinvolvingimmediatethreattothehealthorsafetyofstudentsorstaffoccurringonorimmediatelyadjacenttothecampus.

Hate Crimes
Thelawrequiresthereleaseofstatisticsbycategoryofprejudiceconcerningtheoccurrenceofhatecrimesinthecrimeclassificationslistedintheprecedingsectionandforothercrimesinvolvingbodilyinjurytoanypersoninwhichthevictimisselectedbecauseoftheactualorperceivedrace,gender,religion,sexualorientation,ethnicity,ordisabilityofthevictim.
InAugustof2008HEOAS488,20U.S.C.S1092(f)(1)F(ii)modifiedtheabovehatecrimestoincludethefollowingadditionalcrimesunderthehatecrimecategory:
Larceny Theft:Theunlawfultaking,carrying,leading,orridingawayofpropertyfromthepossession,orconstructivepossession,ofanother.
Threats:Intimidation(IncludesStalking)tounlawfullyplaceanotherperson

Simple Assault:Anunlawfulphysicalattackbyonepersonuponanotherwhereneithertheoffenderdisplaysaweapon,northevictimsuffersobvioussevereoraggrievedbodilyinjuryinvolvingapparentbrokenbones,lossofteeth,possibleinternalinjury,severelaceration,orlossofconsciousness.

TheHigherEducationOpportunityAct(HEOA)requirestwo(2)newsafety-relatedrequirementsoninstitutionsthatparticipateinfederalstudentfinancialaidprogramswhichfollow:

Fire:Rapidoxidationofcombustiblematerialaccompaniedbyheat,lightandsmokeofcombustiblematerial,whichisfoundoutsideofitsnormalappliance,whetherornotitisextinguishedpriortoarrivalofemergency.
Fire-related Deaths:Numberofpersonswhowerefatalitiesbecauseofafireincident,includingdeathresultingfromanaturaloraccidentalcausewhileinvolvedinfirecontrol,attemptingarescue,orpersonsescapingfromthefirescene(anindividualwhodieswithinone(1)yearofinjuriessustainedasaresultofafire).

Fire Policies for On-Campus Student Housing
Decorations, Displays, and Hazardous SubstancesHighlycombustiblematerialsusedfordecorationspresentaseriousfirehazard.Inordertopreventfires,thefollowingsafetystandardsareapplicable:

ceiling,firedetectororlights.Clothdecorationsand/orbannersmustmeet fireresistancestandards.• Ovens,toastersandothersourcesofignitionshouldnotbeplacednear curtains,posters,orotherflammablematerials.• Firearms,ammunition,chemicalexplosives,fireworksandotherlethal weaponsareprohibited.• Nonaturaltreesorboughs,hay,straw,andotherflammabledecorations maybebroughtintoanyUniversitybuilding.Artificialtreesthatareflame proofedmaybeused.• Bathroomsmustbeclearofalldecorationsatalltimes.Personalitems shouldnotbestoredincommunitybathrooms;assuchitemshinder personalsafetyandthethoroughcleaningofbathroomsbycustodialstaff.• Hallwaysmustbekeptclearandunobstructedatalltimestofacilitatequick exitfromstudentrooms.• Duetopotentialfirefromoverheating,ultraviolet(black)lightsmaynotbe usedinUniversitylightingfixtures.Electrical Appliances Electricalapplianceswhichare(1)ULlisted;(2)equippedwiththermostaticcontrols,and(3)ratedat1200wattsorlessarepermittedintheresidencehalls.Itisnecessarytolimitthewattageandusageofcertainappliancesinstudentroomsbecauseofthepotentialfirehazard,astheresidencehallscircuitsarelimitedto15amperes.Wheneverthetotalamperageononecircuitexceedsthatfigure,thefuseorcircuitbreakerislikelytoturnoff.Continuousoverloadingcreatesexcessiveheatinthewiring,causingitsinsulationtodeteriorateandincreasingthepossibilityoffire.Allelectricalappliancesandequipmentshouldbeunpluggedbeforeleavingyourroomforanyvacationperiod.RestrictedAppliancesRestricted AppliancesUniversityfiresafetyandsanitationregulationsprohibittheuseofsometypesofappliancesinstudentroomseventhoughtheymaybecommonlyfoundathome.Amongtheitemsnotallowedforeitherstorageoruseare:opencoilheaters,immersioncoilsforheatingliquids,potterywarmers,deep-fatandFrenchfryers,rotisseries,electricgrills,ovens,hotplates,stoves,anytypeofexposedburner,largepowertools,campingstoves,andcharcoalgrills.Studentsmaystorethefollowingitemsintheirrooms,providingthatsuchequipmentisusedonlyindesignatedareas(laundryrooms/kitchenetteareas)oftheresidencehall:irons,frypans,electricskillets,smalltoastertypeovensandtoasters.Itisimpossibletolistallelectricalappliancesthatarehazardousforuseintheresidencehallsasageneralguidelineanyapplianceisprohibitedifitisratedover1200wattsorifithasanexposedheatingelement.Underallcircumstancestheusershouldexercisereasonableprecautionsandbepresentatalltimesduringuse.Appliancesshouldbeusedinamannerprescribedbythemanufacturer.Damageorinjuryresultingfromtheuseofanyapplianceorequipmentintheresidencehallsistheresponsibilityoftheuser.Microwave Ovens Smallmicrowaveovensthatcarrythe“UL”sealofapprovalarepermittedincommonareasandstudentrooms.Electric Blankets Electricblanketsarepermittedforuseinstudentroomsprovidedtheyareusedaccordingtothemanufacturers’instructions.Blanketsshouldbeunpluggedwhennotinuse.

Halogen Light Bulbs and LampsHalogenlightbulbsandlampsarenotpermittedinanyon-campusresidence.
Firearms/Weapons/Dangerous Items Firearmsofanytype(assembledordisassembled),ammunition,knives,machetes,javelins,martialartsdevices,paintballguns,clubs,oranydevicewhichmaybeconsideredhazardoustothewelfareofmembersoftheresidentialcommunityarestrictlyprohibitedinresidenceareas.Residentsinpossessionoforusingsuchitemsaresubjecttoseveredisciplinaryactionuptoandincludingevictionfromhousingand/ordismissalfromtheUniversity.TheUniversityalsoreservestherighttorefersuchcasestothecivilauthoritiesforcriminalprosecution.Studentsenrolledinacademicprogramsthatrequiretheuseofartist’stoolsareexpectedtostoresuchitemsinanacademicbuildingorstudio.Inaddition,studentswhobelongtoanyon-campusclubsororganizationsmaynotstorerelateditemsconsideredfirearms/weapons/dangerousitemsinanyResidenceHallroomorbuilding,commonspacesandareassurroundingthebuilding.
Safetyprecautions,aswellasStateLaw,prohibittheuseorpossessionoffireworks,explosives,oranyothersubstancesthatmayinjure,discomfortordisturbotherindividuals.Anyonecaughtinpossessionof/orusingsuchmaterialsissubjecttodismissalfromon-campushousingand/ortheUniversity.UMassDartmouthreservestherighttoturnsuchcasesovertothecivilauthoritiesforprosecution.
Grills**Barbecuegrillsofanytypeare“(exceptChartwellunits)”prohibitedthroughoutthefirstyear,OakGlen,PineDaleandWoodlandapartmentareas.GrillsprovidedbytheUniversityintheCedarDellCommunitiesaretheonlygrillsapprovedforresidentialuseoncampus.InfrontofeachCedarDellCommunityCenter,therearethreestandalonegrillsforthispurpose.Residentsareresponsibleforthecleaningofthegrillsaftereachuseincludingdisposingofthecharcoal(afterithascooleddown)andanyothermaterialsassociatedwiththecookout.
Prohibited Room or Apartment Furnishings and Items StudentsshouldseekguidancefromtheirRDregardingquestionsaboutfurniturePRIORtomovingitinsothatUMassDartmouthcanbesureitmeetsourfiresafetystandards.Ifapproved,anofficialnotewillbeplacedinthestudent’sfile.Failuretocomplywiththesesafetyregulationswillresultinimmediateconfiscationandjudicialconsequences.Listedbelowareafewitemsconsideredprohibitedinallresidentialfacilities.TheOfficeofHousingandResidentialLifereservestherighttoidentifyotheritemsdeemedunsafeorinappropriateatanytimeduringtheyeartomaintainthesafetyandsecurityofthecommunity,andrequiredthatstudentsremovetheitemsfromtheresidentialfacilities.

• Firedrillsareconductedtwiceayear,onceatthebeginningofeachsemester,andevaluatedbytheofficeofResidentialLifeandalsobytheUMassDartmouthDepartmentofPublicSafety.
• Allfirealarmsshouldbeconsideredasanactual“real”fire,andthebuildingmustbeevacuatedimmediately.Individualsareresponsibleforevacuatingthemselvesfromthebuildingandshouldleavebythenearestand/orsafestexit.Studentsshouldfamiliarizethemselveswithemergencyexits.Ifthesituationpermits,buildingstaffwillassistintheevacuationprocessandlockingroomdoorsastheyleave.Incaseoffire,studentsshouldpullthenearestfirealarmandthencall508.999.9191(PublicSafety)whentheyhavesafelyexitedthebuilding.Evacuatethebuildingbythesafestandnearestexit.Ifpossible,bepreparedtodirectemergencypersonneltothesuspectedcause.Atnotimeshouldyouputyoursafetyinjeopardy.

Fire Drill and Emergency Evacuation RulesIntheeventofafireoranyotheremergencythatwouldwarrantthecompleteevacuationofabuilding,allstudentsandfacultyofthebuildingmustparticipatewithnoexceptions.

• Evergreen, Willow, Hickory, Birch, Ivy, Aspen, Pinedale and Oak Glenn Halls all have complete automatic sprinkler systems. The four traditional halls Roberts, Chestnut, Maple Ridge and Elmwood only have sprinklers in some storage/trash rooms. The Cedar Dell Town house dorms all have complete automatic sprinkler systems.
• Roberts, Chestnut, Maple Ridge, Elmwood, Pine Dale, Oak Glenn and the Cedar Dell Halls are all protected by Edwards EST3 fire alarm systems.
• Evergreen, Willow, Hickory, Birch, Ivy, and Aspen Halls are all protected by Notifer fire alarm systems. • All building fire alarms are monitored by the Campus Public Safety Department using Keltron Radio receivers. All general alarms are also
received by the local fire department. • Each residential hall is tested annually both for fire alarms and sprinklers and copies of test results are kept on file in the HFO’s
Department.• Fire extinguishers are located in each suite that has a kitchen and also at other locations throughout the buildings.

Clery Crime Definitions
Murder and Non negligent Manslaughter - The willful (non-negligent) killing of one human being by another. Negligent Manslaughter - The killing of another person through gross negligence.
Sex Offense Forcible (F) - Any sexual act directed against another person, forcibly and/or against that per-son’s will; or not forcibly or against the person’s will where the victim is incapable of giving consent: forcible rape; forcible sodomy; sexual assault with an object; forcible fondling and attempted rape.
Sex Offense Non Forcible (N)–Unlawful,non-forciblesexualintercourse:incest;statutoryrape.
Robbery - The taking or attempting to take anything of value from the care, custody, or control of a person or persons by force or threat of force or violence and/or by putting the victim in fear.
Aggravated Assault - An unlawful attack by one person upon another for the purpose of inflicting severe or aggravated bodily injury. This type of assault is usually accompanied by the use of a weapon or by means likely to produce death or great bodily harm. (It is not necessary that injury result from an aggravated as-sault when a gun, knife, or other weapon is used which could and probably would result in serious personal injury if the crime were successfully completed.)
Burglary -Theunlawfulentryofastructuretocommitafelonyoratheft.Forreportingpurposesthisdefi-nition includes: unlawful entry with intent to commit a larceny or felony; breaking and entering with intent to commit a larceny; housebreaking; safecracking; and all attempts to commit any of the aforementioned.
Motor Vehicle Theft - The theft or attempted theft of a motor vehicle. (Classify as motor vehicle theft all cases where automobiles are taken by persons not having lawful access even though the vehicles are later abandoned—including joyriding.)
Arson - Any willful or malicious burning or attempt to burn, with or without intent to defraud, a dwelling house, public building, motor vehicle or aircraft, personal property of another, etc
Disciplinary Referrals - Incidents in which a student was not arrested but was referred for campus disci-plinary action for liquor law violations, drug law violations, and illegal weapons possession. Do not include disciplinaryreferralsforviolationofuniversitypolicyiftherewasnoviolationofthelaw.Forexample,ifa student of legal drinking age violates a “dry campus” policy and is referred for disciplinary action, this statistic should not be included in the crime statistics.
Liquor Law Violation - The violation of laws or ordinances prohibiting: the manufacture, sale, trans-porting, furnishing, possessing of intoxicating liquor; maintaining unlawful drinking places; bootlegging; operating a still, furnishing liquor to a minor or intemperate person; using a vehicle for illegal transportation of liquor; drinking on a train or public conveyance; any attempts to commit any of the foregoing violations. This list does not include public drunkenness and driving under the influence.
Drug Law Violation-ViolationsofStateandlocallawsrelatedtothepossession,sale,use,growing,manufacturing, and making of narcotic drugs. The relevant substances include; opium or cocaine and their derivatives (morphine, heroin, codeine); marijuana; synthetic narcotics (Demerol, methadone's); and danger-ous no narcotic drugs (barbiturates, Benzedrine).
Weapon Law Violation - The violation of laws or ordinances regulating weapons.
Hate Crimes - Any crime that manifests evidence that the victim was intentionally selected because of the victim’s actual or perceived race; religion; gender; sexual orientation; ethnicity or physical/mental disabilities. (The following crimes only apply to hate crime reporting). Simple Assault - Assaults and attempted assaults where no weapon was used and which did not result in serious or aggravated injury to the victim. (This only applies in hate crime reporting). Larceny-Theft - The unlawful taking, carrying, leading, or riding away of property from the possession or constructive possession of another. Vandalism-Towillfullyormaliciouslydestroy,injure,disfigure,ordefaceanypublicorprivateproperty,real or personal, without the consent of the owner or person having custody or control by cutting, tearing, breaking,marking,painting,drawing,coveringwithfilth,oranyothersuchmeansasmaybespecifiedbylocal law. Intimidation - To intentionally say or do something which would cause a person of ordinary sensibilities to be fearful of bodily harm.
