Regardless of your age or physical health, it is impor-
tant to designate someone you trust to manage your property and assets on your behalf in the event you become incapacitated. Signing a Durable Power of At-torney does not mean you are signing your rights away. You are still able to act on your own behalf provided you are capable of doing so. The document simply makes it possible for an authorized individual to handle fi nancial aff airs for you if you need assistance. It is important to keep in mind that ap-pointing someone as your legal agent under a Durable Power of Attorney is a very serious matter since it gives the agent the ability to sign your name and access your fi nances. Most people choose a responsible and trust-worthy relative to act as the agent, such as a

spouse, sibling, parent or child. Th is person does not need to be a fi nancial professional, but should understand that he or she is legally obligated to act as a fi duciary and in your best interests. If you become incapacitated and do not have a Durable Power of Attorney, the man-agement of your property and assets may need to be deter-mined by a court-appointed conservator. Not only can go-ing to court be very expensive, but it can also cause delays in the management of your
property. Obtaining a Durable Power of Attorney is relatively inexpensive and is easy to change later, if necessary. Since emergencies can happen at any time without warning, it is always best to be prepared. If the unexpected happens, you may fi nd that a Durable Power of Attorney is one of the most important documents you have ever signed.
