Special Conditions1. No buildings shall be erected on the land nor shall addi-

The Commissioner shall not give his approvalunless he is satisfied that the proposals' are such as to devclopthe land 'adequately and satisfaotorily.2. 3. The grantee shall maintain hl good and substantial repairalld condition a1l buildings at any timo erected on the land.

4. Should the grantee give notlce in writing to the Commis-sioner of Lands that he/ she/ they is/are unable to compltte thebuildings within the period aforesaid, the Commissloner ofLands shall (at the prantee's expense) accept a surrender of theland comprised hermn :

Provided fur.ther that if such notico as aforesaid, shall bogiven (1) within 12 months of the commencement of the term,the Commissioner of Lands shall refund to the grantee 50 perctntum of the stand premium paid in respeot of the land, or(2) at any subsequent time krior to the expiration of tlzo saidbuilding m riod, tlze Commissloner of Lands shall refund to thegrantee 25 per centuln of the said stand premium. In the eventof notice being given after the expiration of tho said buildingpcriod, no refund shall be made.5. The land and buildings' shall only be used for light indus-

trial purposes with ancillary oflice.s and stores.6. Accommodation not exceeding 100 sq. ft. may be provided

for a caretaker or night watch' man.

7. The buildings shall not cover a greater area of tho landas laid down by the Local Authority in its by-laws.8. The land shall not be used for the purposes of any trade

or business which 'the Commissioner of Lands considers to betlangerous or oEensive.9. The grantee shall not subdivide the land.10. 'l'he granteo shall not sell, transfer, sublet, charge or partwith tho possession of the land or any part thereof or any

buildings th:reon excopt with the prior consent in writingof the President of the Republic of Kehya; no applkation forsuch consent (except in respect of a loan required for buildingpurposes) will be considered until Special Condition No. 2 hasbeen performed.11'1. The grantee &hrall pay to the Comrnissioner o.f Lands on

demand such s'um as the Commissioner may estimate to b: theproportionate cost of constructing a11 roads and drains andsewers serving or adjoining the land and shall, on completionof such construction and the ascertainment of the actual pro-portionate cost, either pay (withkn 30 days of demand) or berefunded the amount by which the actual proportionate costexceeds or falls short of tho amount as aforesaid.12. The grantee shall from time to time ?ay to the Commis-

sloner of Lands on demand such proportlon of th.e cost ofmaintaining al1 roads and drains serving or adjoining the landas the 'Commissioner may assess.13. Should thc Commkssioner of Lands at any time require

14. n e grantee shall pay such rates, taxes, charges, duties,assessments or outgoings' of whatever description as may beimposed, charged or assessed by any Governm ent or LocalAuthority upon the land or the buildings erected thereon

The land shall not be used for the purposes of any trade

Those workers whohave lef't employmen!t had no current contract o'f em ploymentwith 'tho Rexpodents when the Court announced i'ts award.Therefore the Court award cannot 'be an implied torm of theircontraot. The Court award becomes an implied term of con-traot of e'mployment only when there is a curren't contract ofemployment in force.Tn addition to 'the aforcsaid legal poskion the Court award
