IT IS ORDERED THAT:

1. An order dispensing with the forms, service and time periods prescribed in terms of Uniform Rules and directing that the matter as one of urgency in terms of Rule 6(12) of the Uniform Rules of Court, as we as dispensing with forms and time periods;

2. In respect of the 1st Respondent, an order that interim order be published in one edition of both the Daily Dispatch and Isolezwe, being Newspapers both circulated and widely read in the Dutywa Area and;

2.1 The Applicant is to make the full set of founding papers available for inspection at the Appli-cant’s Administrative offices at 454 Streaffield Street, Dutywa, from the date of receipt of the interim order until the date of the return day set by the Coud

2.2 The Applicant is ordered to erect boards on portion of ERF 1 Dutywa and display the orders prominently on such boards, in both the English and Xhosa language.

3. A rule nisi is be and hereby isssued, calling upon the Respondents to show cause on 8 December 2020, why an order in the following terms cannot be made final:-

3.1 Interdicting and restraining the Respondents from entering upon or commencing to occupy and / or demarcate the property of the Appli-cant, being ERF 1 Dutywa.

3.2 Interdicting and restraining the Respondents from commencing to erect or occupy any structure on ERF 1 Dutywa, which belongs to the Applicant.

4. An order that 3.1 and 3.2 operate as an interim relief pending the return day.
