On January 16, 2015, the Board of Stewards offered a hearing to Owner/Trainer Jim A. Tracy

to which he waived his right to a hearing on the allegations stated, and split sample testing.

After considering the evidence, the Stewards hereby find the following:

The official blood and urine sample #106673 taken on 12/10/2014 was reported by

Truesdail Laboratories, Inc. official Testing Laboratory to contain Detamidine. Specifically,

blood sample contained 74.7 ng/ml,

The sample was taken from "Tactical Gift" which ran in the 5'" Race on 12/10/14 finishing

1st. This norse is a Ch. F. 4 yo. By Tactical Cat out of Idol Gift.

The Stewards conclude that Jim A. Tracy has violated sectionls) 178·1·51.l.9, which reads,

"The trainer is the absolute insurer of and responsible far the condition of the horses he

or she enters in an official workout or a race, regardless of the acts of third parties. If

testing or analysis of urine, blood or other bodily substances or tissues prove positive

showing the presence of any prohibited drug, meditation or substance, the trainer of the

horse may be fined, suspended, have his or her occupational permit revoked, be

prohibited access to all grounds under the jurisdiction of the Racing commission, or may

be otherwise disciplined. In addition, the owner of the horse, the foreman in charge of

the horse, the groom, and any other person shown to have had the care, attendance of

the horse may be fined, suspended, have his or her occupational permit revoked, be

prohibited access to all grounds under the jurisdiction of the Racing Commission, or may

be otherwise disciplined."

The Penalty Guidelines set forth in Table 178-1 of the Thoroughbred Racing Rules provide a

49.6.a.l.A, which reads. "Not to exceed the following permitted serum or plasma threshold

concentrations which are consistent with administration by a single intravenous injection at

On Wednesday, March 11, 2015 the stewards, consisting of Ismael Trejo, Larry

Dupuy and Robert Lotts declared the 3'd Race a no contest after a spi ll and two

riders went off t heir mounts. Robert Lotts and Larry Dupuy observed the race and

subsequent events through binoculars as steward, Ismael Trejo continued to

watch on the TV monitor.

All three stewards decided that for the reason of safety to a fallen and motionless

rider and an unsecured loose horse that the race be declared a no contest race. "

The warning lights were activated and did work, and announcements were made.

The jockeys were interviewed and stated they did not see the warn ing lights, and

did not hear the announcements, with exception of rider Katie Crews.

All three stewards agreed that safety was the main concern for the action taken

by the Board of Stewards.

On April 28, 2015, Having been afforded a Board of Stewards hearing and having waived his

right to a formal hearing and after considering the evidence, the Stewards hereby find the

following:

The official blood sample 122557 taken on 04/11/2015 was reported by Truesdail

Laboratories to contain Xylazine, which is a Class 3 drug, with a Penalty "B" designation. The

permissible threshold for Xylazine is 0.01 ng. /ml. Sample number 122557 contained 83 ng.

/ml. of the drug, which is above the permissible threshold. The sample was taken from

"Luke Bopin Prophet", the number (6) horse that ran in the (8"') race on April 11, 2015

finishing lst. The horse is owned by Ashley Tobin and trained by Edwin Lee Tobin.

The Owner /Trainer did not elect to have a split sample tested.

The Stewards conclude that Edwin Lee Tobin has violated section(s) 178-1-49.4.a.2 of the

Thoroughbred Racing Rule, 178W.Va.CSR.1. which reads," Controlled therapeutic

medications in excess of established threshold concentrations as set forth in the

Association of Racing Commissioners International Controlled Therapeutic Medication

Schedule, Version 1.0, contained in table 178-lF at the end of this rule." This

medication/prohibited substance violation is the permit holder's first offense for a

medication/substance violation carrying a Category "B" penalty. The permit holder has

accumulated O points under the multiple medications violation point system prior to this

ruling. The points assessed for the medication /substance violation are N/A pursuant to

section 49.3 m. of 178 of W.Va C.S.R.l.

The Penalty Guidelines set forth in Table 178-1 of the Thoroughbred Racing R.ules provide a

minimum penalty of 15 days, SSOO fine and loss of all purse monies and a maximum penalty

of 60 days suspension, $1000 fine, and loss of purse for the underlying offense. However,

the Stewards determine the appropriate penalty for the underlying offense on case by case

basis by considering mitigating and aggravating factors.

In addition, because the permit holder has accumulated O points prior to this ruling and o

points connection with this ruling for a current total of 0, N/A points, under multiple

medication violation section 49.m.6 of 178 W.Va. C.S.R.1. This penalty is in addition to the

penalty imposed by the Stewards for the underlying offense.

The following is the Stewards' analysis of the mitigating/aggravating factors in this matter.

The official blood and urine sample 1Z2815taken on 05/22/2015 was reported by Truesdail

Laboratory. Official Testing Laboratory to contain Ketoprofen above the authorized levels.

Specifically, blood sample contained 48+1nanograms/ml and urine sample contained_O_. The

sample was taken from Good Night Angel which ran in the First Race on May 22, 2015, finishing First.

The horse is a Bay filly by Touch of Gold-Oneminutetomidnite by Street Cry.

The Stewards conclude that Alexander Rodrigue• has violated section(s) 178-1-26.2, which reads,

"Trainer responsibility as to the condition of the horse. As further set forth in subdivision 51.1.a of

Jockey, Sylvestor Carmouche Ill was afforded a hearing on September 23, 2015, regarding

allegations set forth in a Board of Stewards hearing notice dated September 18, 2015, for

Rule Violation 178-1-24.11.w, which reads, "Has fa iled to pay a required fee, fine or cost,

and 178-1-24.11.gg, which reads, "has engaged in conduct unbecoming or detrimental to

the best interests of racing"

Mr. Carmouche Ill fa iled to pay a fine of One Hundred ($100.00), regarding Ruling #58,

dated March 24, 2015,( failing to make his reported weight) and subsequently was

suspended by the BOS, (Re: Ruling #130 dated July 23, 2015). Ruling (#58) still remains

unpaid.

At this time Mr Carmouche Ill has (102) racing violations. He has failed to show proof of

some serious allegations and charges that have allegedly been dismissed, (attempted

murder, arson and animal cruelty).

The BOS are concerned with integrating Mr. Carmouche Ill back into an environment that

has proven too be counterproductive and certainly not in his best interest. For the reasons

listed above, Mr. Sylvester Carmouche Ill will remain suspended for acts detrimental to the

best interest of racing.
