NOTICE IS HEREBY GIVEN that Applicant, PayRock Energy, L.L.C., has filed an application in this cause request-ing the Corporation Commission of Okla-homa to enter an order, to be effective as of the date of the execution thereof or as of a date prior thereto, as follows: (i) authorizing and permitting an exception to the permitted well location tolerances in the “640-acre” horizontal well unit to be formed in Section 2, Township 16 North, Range 7 West of the IM, Kingfisher County, Oklahoma, for the Mississippian common source of supply, so as to allow a well to be drilled into, to be completed in and to produce hydrocarbons from such common source of supply, with the subsurface locations of the completion interval of such well in the common source of supply involved herein to be located within the subsurface location tolerance area as set forth below:

not closer than 165 feet from the south line and not closer than 1000 feet from the west line and not closer than 1000 feet from the east line and not closer than 165 feet from the north line of said Section 2,

and with such authorization and permis-sion running in favor of Applicant or some other party recommended by Applicant; and (ii) establishing a proper allowable for the proposed well involved herein as to the common source of supply covered hereby, which allowable Appli-cant requests be established as a full allowable with no downward adjustment made thereto. Such application further states that the primary objective of the proposed well covered hereby is the Mississippian common source of supply and that Applicant intends to drill such well horizontally in such common source of supply. Such application further states that during the drilling of the lateral of such proposed well, the wellbore thereof may exit from the Mississippian common source of supply and enter into the Woodford common source of supply. Such application further states that the requested subsurface location tolerance area for the completion interval in the lat-eral of such proposed well, as described above, is within the permitted well location tolerances to be established for the “640-acre” horizontal well unit to be formed for the Woodford common

source of supply in said Section 2 and that a location exception is not necessary for such well as to the Woodford common source of supply. Such application further states that there is currently pending before the Commission in Cause CD No. 201504103 an application of Applicant to form a “640-acre” horizontal well unit (containing approximately 544.34 acres) in said Section 2 for the Mississippian common source of supply.

Aug. 9 - Kingfisher Police Of-ficer Justin Conner took a report from a clerk at Jacket Express con-cerning a gas drive-off. The clerk advised that the driver of a green Jeep Wrangler with a brown top left without paying for $37.84 in fuel.

Aug. 12 - Officer Conner con-ducted a traffic stop at Main and Admire after observing a defective third brake light on a black Jeep. The driver, Jose De La Torre, 20, of 1200 Walton Trail, Kingfisher, was found to be driving with a suspended license. He was placed under arrest and transported to the Kingfisher County Jail.

Aug. 12 - Capt. Jeff Townsend took a report from a 30 year-old Kingfisher woman who said that she had been receiving threaten-ing messages from several other subjects via Facebook.

Aug. 13, 11:20 p.m. - Officer Aaron Schlegel conducted a traffic stop at Main and Robberts after observing a defective third brake light on a green SUV. The driver, Fernando Varelas Caro, 21, of 123 W. Airport Road, Kingfisher, was found to be driving with an invalid international driver’s license. Va-relas allegedly said that he bought the license on Penn Avenue in Oklahoma City for $185. Records indicated that Varelas had been cited for the same offense in the past. He was placed under arrest and transported to the Kingfisher County Jail.

Aug. 15, 7 p.m. - Officer Schle-gel conducted a traffic stop on 13th Street at Briscoe Park after observ-ing a vehicle traveling 49 miles per hour in the 35 MPH zone. The driver, Esteban Rocha-Contreras, 27, of Oklahoma City, was found to be driving without a valid license, and was only in possession of an old Mexico license. He was placed under arrest and transported to the Kingfisher County Jail.

Aug. 16 - Officer Justin Trumb-ley took a report from Ann Robles, of 422 N. Ninth Street, who advised that several identification papers for all her family are missing from her home.

Aug. 18 - Officer Schlegel re-sponded to a domestic dispute in the 1400 Block of S. Ninth Street.

Aug. 19 - Officer Schlegel conducted a traffic stop at Eighth Street and Erwin Avenue after ob-serving a vehicle with an expired tag. While obtaining information from the driver, the officer detected the odor of marijuana coming from the vehicle.

The driver was identified as Ty-ler Stephen Davis, 20, of Okarche. His passenger was Heidi Elizabeth Clark, 20, also of Okarche.

Since both Officer Schlegel and Officer Dustin Broderick could smell marijuana coming from the vehicle, it was open to a war-rant-less search.

After evidence was allegedly located throughout the vehicle,

both Davis and Clark were placed under arrest for possession of marijuana and possession of drug paraphernalia, and transported to the Kingfisher County Jail.

Aug. 20, 3:55 a.m. - Officer Conner conducted a traffic stop at Seventh and Seay after observing a vehicle with a defective headlight. The driver, Shawn Elliot Maggard, 30, of 320 S. Fifth, Kingfisher, ex-hibited slow speech and repeated himself to the officer.

Dispatch was unable to con-firm whether Maggard had a valid license or insurance on the vehicle. Officers requested Maggard to step out of his vehicle, and after some apparent delays, he did so. He was placed under arrest when officers observed that Maggard allegedly had a baggie of methamphetamine on the front seat where he was sitting. He was transported to the Kingfisher County Jail.

Aug. 20 - Sgt. Travis Gray took a report from George Frazier of Kingfisher who advised that someone had used his identity to purchase a RITZ camera through PayPal in the amount of $880.90. The camera was then delivered to a subject in Maricopa, Arizona, yet Frazier received the bill. Frazier said he has never heard of PayPal and has never opened an account with them. Both the Maricopa and Kingfisher police departments are coordinating on the case.

Schroder is married to Tyler Schroder, the son of Keith and Karen Schroder of Okarche, and they have one son, Dean Jeremiah.

In addition to her family,

Schroder’s principal, Darla Smith, and superintendent, Roydon Tilley, also attended last week’s program.

Schroder wasn’t the only person with Kingfisher County connections who played a part in the program.

Kingfi sher’s 2015 teacher of the year Julie Jackson also was recognized at the cere-mony, along with the other local district teachers of the year.

Vocalist and Holy Trini-ty Catholic School student Emily Faith Sanders, the

daughter of Chad and Shel-ley Sanders, performed the National Anthem.

A problem with the rural water district site is a wind turbine located on it, which would require additional expense in boring lines.

Raupe said exhaustive engineering studies have indicated the Mullins prop-erty is the best choice for the water plant.

The town’s wells are lo-cated there and the terrain is best suited for the project.

He said contacts with the rural water district have revealed it isn’t interested in the project.

“They say 80 percent of their water goes to cows and they’re not interested in additional expense. They feel they can take care of their problems themselves,” Raupe said. “We’ve had several meetings with them.”

Latest federal regulations have set the allowable nitrate in human drinking water at 10 parts per million, down from 15 ppm. Current rating of the Okarche water supply is 12 ppm.

Raupe said the regulating agencies appear to want a regional solution rather than just meeting the needs of

Okarche.“They want us to generate

more water than necessary to meet our needs.”

He said that if DEQ, which has seemed interested in helping Okarche, is forced to enforce its consent order that will likely mean EPA will come in and take charge of the project, achieving its goals but at a more expensive level.

Raupe said the town gov-ernment has been saving back money to pay for the cost of the new water plant.

The cost several years ago was estimated at $1.5 mil-lion, but infl ation has likely increased that amount.

Raupe indicated that all

pertinent information will be available at the special Sept. 10 meeting.

“We have complete empa-thy for the landowners but we will have to make a deci-sion that is best for Okarche.

Following the discussion on the water plant, the board continued with regular busi-ness, approving a 1.7 Cost of Living Adjustment (COLA) for seven employees.

Kingfi sher County com-missioners called for bids Monday to replace water and sewer lines to the courthouse under the courthouse park-ing lot.

Concrete has been re-moved from the parking area in a project to replace the parking lot around the courthouse and commission-ers fi gure replacing the aging lines at this point while they are clear of concrete will save potentially expensive repairs later.

Bid closing is 4 p.m. Fri-day, Sept. 25, and a pre-bid conference will be held at 2 p.m. Tuesday, Sept. 15, at the courthouse.

Keith Schroder said he was unaware of the county owning mineral interests in the vicinity cited by the companies interested in buying them (Section 18, Township 16 North, Range 9 West).

He said it could have oc-curred years ago in a right-of-way agreement but it would require a search of records to determine that.

Commissioners also ap-proved an annual fi nancial report to the state auditor and inspector of awards and expenditures of fund for the county emergency man-agement offi ce. The report showed receipt of $15,000 in federal funding.

Commissioners also ap-proved 18 applications for county road crossings or

right-of-way use for pipe-lines, 11 in District 1 (Jeff Moss, commissioner), six in District 2 (Ray Shimanek, commissioner) and one in District 3 (Schroder, commis-sioner).

County calls for water, sewer line bids

The Oklahoma Court of Civil Appeals has given District Judge Paul Woodward until later this month to provide a rationale as to why he granted a new trial in the lawsuit filed by Pridex Construction LLC against former Kingfi sher mayor Jack Stuteville.

Six months after a county jury’s unanimous verdict against Stute-ville awarded a total of $500,000 in damages to the Lonewolf construction company owned by Chris Poindexter in January 2014, Woodward granted Stuteville’s motion for a new trial.

Stuteville also argued in the alternative for a judgment not-withstanding the verdict, which is a request that the judge not only throw out the jury’s verdict but issue a judgment ending the lawsuit in Stuteville’s favor.

While the motion filed by Stuteville’s attorney was 75 pag-es long and argued 23 separate grounds supporting the request for a judgement notwithstand-ing the verdict and 16 different grounds supporting the new trial request, the judge’s order denied the fi rst motion and granted the second without stating a rationale for the decision.

Among other things, Stute-ville’s attorney argued in sup-port of the motion that evidence presented at trial was not legally suffi cient to prove the required

elements of the allegations that Stuteville conspired against Pri-dex, and through fraud and deceit, prevented the company from getting the bonds required by the city in order to be awarded a drainage improvement contract in Kingfi sher’s West Bottom.

The motion also argued that the judge’s instructions presented to the jury before deliberations began contained “fundamental errors” that prejudiced Stuteville’s defense.

Pridex fi led a motion request-ing clarifi cation or explanation of the order, which Woodward denied.

Pridex then appealed the new trial order, while Stuteville appealed the denial of his request for a judgment notwithstanding the verdict.

In a July 10 order, the appeals court halted the appeal and direct-ed Woodward to provide a written rationale for granting a new trial within 60 days of its order.

Quoting a 1966 state supreme court decision, the appeals court wrote in its July 10 order: “It is the better practice for a judge to indi-cate his views whether requested or not. We fi nd this advice partic-ularly appropriate when 16 dif-ferent arguments were advanced for a new trial, and the court’s rationale may not even have been based on these arguments.”

exander did this summer, shooting the principal pho-tography segments in and around Kingfi sher County, utilizing help from those two teachers who infl uenced him so much (photojournal-ism teacher Kurt Kaya and photography teacher Dr. A.J. Johnson).

“They were so helpful in every sense of the word, lending ideas, lenses, extras, you name it,” he said.

Alexander brought with him a team of fi lm school friends, including assistant director Jacob Campbell, and reconnected with old high school friends to help with the production.

KHS videography program product, served as principal photographer, Ty Chapman plays the lead role and Dil-lon Laster also helped with production.

Others who helped includ-ed the Kingfi sher Roundup Club members, who allowed Alexander to film action footage at this year’s rodeo, Grant, Kyle, Trey and Tyler Borelli, April Lumpkin, Clint Schroeder, Trena Gardner, Cindy Kottwitz and Butch Kottwitz.

Local champion bull rider Mitch Gardner also helped in the fi lming of riding sequenc-es and Chad Kochenower loaned his rodeo gear.

Barroom scenes were shot at the Hitchin’ Post at Kingfi sher.

His mother helped mar-shal the troops and resources and scout shooting locations.

“I like to call her Executive Producer Roxie,” Alexander quipped.

When it was all said and done, having a tight-knit rural community to rely

on meant the difference between producing a profes-sional fi lm and, well, “mak-ing a home video,” he said.

“It is really a collabora-tive effort in every sense of the word,” Alexander said. “Without everyone’s help, I would have fallen fl at on my face.”

He also credits the work ethic he brought with him from Kingfi sher to OU with allowing him to realize his dreams a little sooner than some of his peers.

“School has been nice, but what you don’t learn is that you have to keep your nose to the grindstone,” he said.

While Alexander said he enjoys every aspect of film-making, from brain-storming sessions during the screen play writing process to screening the finished product, “my favorite part is editing.”

“I really hate being behind the camera, which is why I was so lucky this time to have Micah in that role,” he said.

“This is the fi rst time I got to talk to the actors between takes, actually do some real directing.

“But I love editing. I sit in a dark room inside my house and before I know it, 18 hours have gone by,” he said.

“To me, editing is the equivalent of building with Legos when I was a kid,” he said. “I never know what it’s going to look like until the end, but it keeps coming together.”

Alexander is deep in the editing process now and looking forward to entering the fi nal result “in every fi lm festival I can fi nd.”

He also would like to arrange for a local screening.

And afterward?“I’ve got a few other proj-

ects rattling around in my head. I’m always looking for new ideas and stashing them away.

“I fi gured out if I’m go-ing to fi nd success in this business, I can’t sit around waiting for it to come to me.”

Cheryl Lea Jech Kramer

Cheryl Lea Jech Kramer left this life of suffering to do the 2 step with her Lord and Savior on Aug. 28, 2015.

Cheryl was born Jan. 20, 1948, to Chester W. and Ruby Jech in Kingfisher, Okla.

She grew up on a farm southwest of Crescent and graduated from Crescent High School. While in school she was a fun loving friend and a great basketball player. She participated in 4-H and was active in the local stock shows. In high school she was the FFA sweetheart and part of the football home-coming court.

After high school she attended Oklahoma State University, then finished her degree in teaching at Southwestern Oklahoma State University in 1976. She became a middle school English teacher and coach in Elizabeth, Colo., where she met Darrel Kramer and was married June 1978. They were blessed with two precious children, Kolby and Lacey.

They returned to Oklaho-ma and opened an animal hospital in Piedmont. Their work then took them to West Virginia and then back to Piedmont.

In 1993, Cheryl returned to Kingfisher and began working at the Kingfish-er Hospital. During these past years she has blessed coworkers and clients with her loving fun personality

OBITUARYat Mid Oklahoma Coop, Roserock Bank, Atwoods, and Okarche’s Center of Family Love. Cheryl had an awesome and lasting effect on all the people and family she encountered.

Anyone that knew Cher-yl was aware of her strong political activism. She had strong beliefs and worked tirelessly in these efforts. She was Mike Sanders’ strongest campaigner.

Cheryl began a coura-geous battle with cancer 13 years ago and has amazed her doctors, family and friends with her strength, faith and fortitude to not be defeated especially after the arrival of her grandson, Easton. She left this life with the dignity and courage that she began the battle. Her children were there with her every step of the way, plus special support from her two cousins, Jacque Wiese and Mary Bowerman.

Cheryl is preceded in death by her parents.

Those left to cherish her memory are her son, Kolby Kramer and his wife Danica; her daughter, Lacey Kuehn and her husband Chris; her precious grandson, Easton Ray; her brother, Bill Jech; her sister, Pam Davis and niece, Laura Davis; her pre-cious dogs, Roscoe and Tieg, and many Jech and Bennett cousins.

If you would like to make a gift in her memory, she wished that they go to, Center of Family Love in Okarche; Russell-Murray Hospice, Inc; or Wounded Warrior Project.

On Thursday Sept. 3 buri-al will be at 9 a.m. at Oak-land Knowles Cemetery, Crescent, followed by a celebration of her life at 11 a.m. at First Baptist Church, Kingfisher.

Rosalie Tice, 86, lifelong resident of Dover, died Tues-day, Sept. 1, 2015, at Cimar-ron Nursing Center in King-fisher. Services pending with Abernathy-Aaron Funeral Home in Crescent.

ance provider that received more than $65 million in taxpayer-funded loans from the federal government an-nounced last week that it is discontinuing operations at the end of the year.

The Nevada Health Co-Op will close its doors begin-ning Jan. 1 because of “chal-lenging market conditions.” The co-op will be the third of the 23 consumer-oriented and operated plans created under Obamacare to shutter.

“It is with deep sadness that based on challenging market conditions, the board made a painful decision to wind down operations of the Nevada co-op at the end of this year,” Stacey Hatfield, a member of the co-op’s board, said in a statement. “Rather than spending resources on next year’s uncertain mar-ket, we would rather make sure we protect our current members. This is all about providing the most afford-able, effective health insur-ance and service possible.”

Co-ops were created un-der Obamacare to foster competition in areas where few carriers offered plans. The Nevada Health Co-Op was created in 2012 along with 22 others serving 26 states. They began providing insurance coverage in 2014, with Obamacare’s first open enrollment period.

The 23 co-ops received $2.5 billion in loans from the Centers for Medicare and Medicaid Services to help get off the ground and remain solvent. The federal govern-ment awarded the Nevada Health Co-Op $65.9 million

in startup loans. It’s unclear whether the co-op will be able to repay the loans.

According to the Nevada Health Co-Op, it enrolled 14,000 consumers in 2014. However, the nonprofit in-surer projected it would enroll 33,748, according to a July audit of co-ops from the Department of Health and Human Services inspector general.

Under Obamacare, Unin-sured Rate Fell to Lowest Level in 50 Years. Why There’s More to That Number.

The analysis from the De-partment of Health and Hu-man Services also found that the Nevada Health Co-Op projected that it would make $371,000 in 2014. However, it lost more than $15 million.

“The biggest problem that they’ve got is that they can’t raise the capital they need to sustain initial operating deficits,” Ed Haislmaier, a se-nior research fellow in health policy at The Heritage Foun-dation, told The Daily Signal. “The government created the nonprofit cooperatives in such a way that there’s just no way for the cooperatives to get access to capital other than a government loan or subsidy.”

The Nevada Co-Op was not the only nonprofit insur-er to lose money in 2014. Of the 23 co-ops started in 2012, just one – Maine Commu-nity Health Options – was profitable. Additionally, 13 of the 23 co-ops enrolled sig-nificantly fewer consumers in 2014 than projected.

“They’re constrained,” Haislmaier said of the co-ops. “It was a badly done at-tempt to reinvent the wheel with some genius deciding to make it oval instead of round.”

The co-op will continue providing coverage to its customers through the end of the year, but customers will have to purchase cover-age from other health insur-ance companies for 2016. The Nevada Health Co-Op will continue to pay customers’ medical claims.

In addition to Nevada’s nonprofit insurer, two oth-er co-ops created under Obamacare announced they would be discontinuing op-erations.

Last month, the Louisiana Department of Insurance an-nounced that the Louisiana Health Cooperative would be closing its doors at the end of 2015. The Louisiana co-op received $65.8 million in taxpayer-funded loans from the Centers for Medicare and Medicaid Services.

In March, CoOportunity Health was liquidated after it reported higher medical claims than anticipated. The Centers for Medicare and Medicaid Services awarded CoOportunity with $145 million in loans.
