1 BACKGROUND AND INTRODUCTION
1.1 Background
Khumani Iron Ore Mine (Khumani) is situated 15km south of Kathu, adjacent to the Khumba
Iron Ore Mine. Khumani compromises of four (4) farms, namely Parson (Portions 2, 6 and the
Remainder of Parson No. 564), King (Portions 1, 2, 3 and the Remainder of King No.561),
Bruce (Portions 3, 4, 5 and the Remainder of Bruce No. 544) and Mokaning (Portions 1, 2,3,4,5
and the Remainder of Mokaning No. 560).
The right to mine was granted to Assmang (Limited) in terms of the Mineral and Petroleum
Resources Development Act, 2002 (Act No 28 of 2002) (MPRDA) in January 2007. Construction
of the mine was initiated after approval was received from the Northern Cape Department
of Environment and Nature Conservation (NCDENC) in June 2006 on the farm Parson and the
first train was loaded with iron ore at Khumani in May 2008. The overall mining area over
which Khumani operates is approximately 9000ha. Today the mine is a fully operational
opencast mining operation, with an approved capacity of producing 16 million tons of iron
ore per annum.
The iron ore is mined from a series of open pits on the farms Bruce and King by conventional
drill, blast and loading into trucks for hauling to the primary crushers. From there, it is
transferred by conveyor, to Run of Mine (ROM) stockpiles, ahead of the beneficiation plant
(Parsons Plant), located on the farm Parson.
Through Khumani’s ongoing commitment to optimise its existing mineral resources, the
design and operational team has identified the need for two (2) additional process facilities
required to optimise beneficiation and still meet its approved production allocation. These
facilities include the Off-Grade 2 Plant (approved in terms of the NEMA during October 2013)
and the proposed WHIMS 2 Plant (part of this application). The new infrastructure will result
in the need for ancillary infrastructure associated with the activities.
Khumani submitted an application for environmental authorisation in terms of listed activities
to the NCDENC (Ref No.NC/EIA/17/JTG/GAM/KAT2/2014) on Thursday 31 July 2014. The
Environmental Impact Report (EIR) has been developed in accordance with the requirements
of the National Environmental Management Act, 1998 (Act No. 107 of 1998) (NEMA) and the
Mineral and Petroleum Resources Development Act, 2002 (Act No. 28 of 2002) (MPRDA).

2 PUBLIC PARTICIPATION PROCESS
This section of the report documents the process, which were followed to date with respect
to consultation of Interested and Affected Parties (I&APs)/stakeholders and the Government
Authorities.
2.1 Purpose of Public Participation
The Public Participation Process (PPP) is a requirement of the EIA/EMP process and ensures
that all relevant I&APs are consulted and involved. The process ensures that all stakeholders
have an opportunity to raise their comments as part of an open and transparent process,
which in turn ensures for a complete comprehensive environmental study.
The purpose of PPP and the engagement process is to:
Introduce the proposed project;
Explain the EIA/EMP and PPP processes to be undertaken;
Determine and record public issues and concerns;
Provide opportunities for public input and gathering of local knowledge;
Inform a broad range of stakeholders about the project and the environmental
process to be followed;
Establish lines of communication between stakeholders and the project team;
Identify all the significant issues in the project; and
Identify possible mitigation measures or environmental management plans to
minimise and/or prevent environmental impacts, associated with the project.
Once the concerns of I&APs have been established, the EIA phase of the project will aim to
address these concerns.
2.2 Interested and Affected Party Consultation
2.2.1 Identification of I&APs/Stakeholders
A comprehensive list of I&APs who have been previously contacted for previous Khumani
projects has been updated by GCS through a process of networking, newspaper
advertisements and site notices.

NOTIFICATION OF AN ENVIRONMENTAL AUTHORISATION PROCESS IN TERMS OF THE NATIONAL ENVIRONMENTAL MANAGEMENT ACT (ACT NO. 107 OF 1998) FOR THE KHUMANI IRON ORE MINE PARSONS AND KING INFRASTRUCTURE EXPANSION PROJECT NEAR KHATHU, THE NORTHERN CAPE PROVINCE

Notice is hereby given in terms of Regulation 54 of the Environmental Impact Regulations published in Government Notice R.543 in Government Gazette
No.33306 of 18 June 2010, under Section 24(5) of the National Environmental Management Act, 1998 (Act No.107 of 1998) (NEMA) of the Environmental
Impact Assessment (EIA) process, to be undertaken by GCS Water and Environmental (Pty) Ltd (GCS) on behalf of Assmang Limited. The proposed project
will involve infrastructure expansions on the Khumani Iron Ore Mine, near Kathu, Northern Cape Province. The proposed infrastructure upgrades will take place
on the Portion 2 of the farm Parsons 564RD and the Remainder of the farm King 561RD.
The following authorisations are required:
Environmental Authorisation for the following activities listed in terms of section 24 (2) the National Environmental Management Act, 1998
(Act No. 107 of 1998) (NEMA);
Updating of the approved Environmental Management Programme (EMP) in terms of the Mineral and Petroleum Resources Development
Act, 2002 (Act No. 28 of 2002) (MPRDA).
Water Use Licence Application in terms of the National Water Act, 1998 (Act No. 36 of 1998) (NWA).
The NEMA activities, which are triggered by the proposed expansions, are listed under Regulations R544 and R545, and as such, require an application for an
Environmental Authorisation in terms of NEMA.
Listed activity as described in GN R.544, 545 and 546 Description of project activity that triggers listed activity
GN R.544 Item 11: The construction of: (ix) Infrastructure or structures covering 50 square metres or more, where such construction occurs within a watercourse or within 32 metres of a watercourse, measured from the edge of a watercourse, excluding where such construction will occur behind the development setback line.
Parsons: There are non-perennial pans within the proposed footprint of the Low Grade Stockpile area on the farm Parsons that will be affected. King: there is a non-perennial channel in the vicinity of the proposed new Low Grade Stockpile.
GN R.544 Item 22: The construction of a road, outside urban areas, (i) with a reserve wider than 13,5 meters or, (ii) where no reserve exists where the road is wider than 8 metres
New haul roads to be constructed on farms Parsons and King, which will also include internal roads for construction and maintenance purposes.
GN R.544 Item 28: The expansion of existing facilities for any process or activity where such expansion to will result in the need for a permit or license in terms of national or provincial legislation governing the release of emissions or pollution, excluding where the facility, process or activity is included in the list of waste management activities published in terms of section 19 of the National Environmental Management Waste Act 2008 (Act 59 of 2008).
The creation of the Low Grade Stockpile and infrastructure on Parsons and the Low Grade Stockpile on King will require a License in terms of section 21(g) and 21 (c & i) of the National Water Act, 1998 (Act No. 36 of 1998).
GN R.545 Item 5: The construction of facilities or infrastructure for any process or activity which requires a permit or license in terms of national or provincial legislation governing the generation or release of emissions, pollution or effluent and which is not identified in Notice No. 544 of 2010 or included in the list of waste management activities published in terms of section 19 of the National Environmental Management: Waste Act, 2008 (Act No. 59 of 2008) in which case that Act will apply.
Parsons: Establishment of the Low Grade Stockpile with additional infrastructure. King: Establishment of the Low Grade Stockpile and the Overburden Dump.
GN R.545 Item 15: Physical alteration of undeveloped vacant or derelict land for residential retail, commercial, recreational, industrial or institutional use where the total area to be transformed is 20 hectares or more, except where such physical alteration takes place for: (i) Linear development activities; or (ii) Agriculture or afforrestation where activity 16 in this Schedule will apply.
The project will comprise the development of mining related surface infrastructure in areas on both farms Parsons and King where no previous mining activity took place.
GN R.546 Item 14: The clearance of an area of 5 hectares or more of vegetation where 75% or more of the vegetative cover constitutes indigenous vegetation, except where the removal of vegetation is required for. 1. Purposes of agriculture or afforestation inside areas identified in spatial instruments adopted by the competent authority for agriculture or afforestation purposes.
The removal of indigenous trees on both farms Parsons and King, for the development of infrastructure and creation of stockpiles.
You are invited to participate in the Public Participation Process by registering
as an Interested and Affected Party (I&AP), as well as to provide any
comments on the proposed project and/or environmental process in writing on,
or before 10th October 2014. All I&APs will also be notified and given the
opportunity to have a look at the draft NEMA Scoping Report that will be
submitted to the relevant department for consideration.

2.2.2.2 Media advertisement
An advertisement regarding the proposed project, including background information, the
assessment process being followed was placed in the DFA newspaper, on 17 September 2014.
A copy of the advert is provided in Figure 2-2. A further Advert was place in the Volksblad to
inform the Public of the inclusion of Bruce into the current application Figure 2-3.

INTRODUCTION
The purpose of this Background Information Document (BID) is to
provide all Interested and Affected Parties (I&APs) with
information in respect of the Assmang Limited: Khumani Iron
Ore Mine Infrastructure Expansion Project.
In addition to the aforesaid, the BID aims to:
Introduce and explain the Scoping and Environmental
Impact Assessment (S&EIA) Process, as well as other
related parallel environmental processes;
Introduce and explain the Public Participation Process
(PPP), which is prescribed by the National Environmental
Management Act, 1998 (Act No. 107 of 1998) (NEMA);
Provide information on the Mineral and Petroleum
Resource Development Act, 2002 (Act No. 28 of 2002)
(MPRDA); the NEMA; and the National Water Act, 1998
(Act No. 36 of 1998) (NWA) for the Khumani Iron Ore Mine
Infrastructure Expansion Project;

What is an EIA/EMP and what does an EIA/EMP contain?
The National Environmental Management Act, 1998 (Act No. 107 of 1998) (NEMA) and the Mineral and Petroleum Resource Development Act, 2002 (Act No. 28 of 2002) (MPRDA) prescribes the processes to be followed when compiling the Environmental Impact Assessment (EIA) and the Environmental Management Programme (EMP), in respect of the NEMA listed activities and mining operations respectively, which forms the legal basis of this authorisation.
The process aims to ensure that all relevant factors are considered when evaluating the potential environmental impacts of a project, as well as developing appropriate environmental management measures to mitigate these impacts.
The purpose of the EIA is to assess the current environment in which a proposed activity will take place and assess all potential impacts in terms of its extent, duration, intensity and significance relating to the specific activity. The EMP describes the goals and objectives for environmental management to minimise or eliminate the potential environmental impacts; the action plans to bring effect to those goals and objectives; the procedures to be implemented to ensure integration of environmental management into the daily operations; as well as a plan to raise awareness of employees and the surrounding community with regards to environmental management.

BACKGROUND
The Khumani Iron Ore Mine (Khumani) is situated 15km south of Kathu, adjacent to the Kumba Iron Ore Mine (also
referred to as “Sishen Iron Ore”) and compromises of four farms, namely; Parsons 546, King 651, Bruce 544 and Mokaning
560 RD. The proposed upgrades will be located within the approved Khumani mining area (See Figure 1 and Figure 2). The
following portions of the farms comprises Khumani;
Parson (Portions 2, 6 and the Remainder of Parson No. 564 RD);
King (Portions 1, 2, 3 and the Remainder of King No.561 RD);
Bruce (Portions 3, 4, 5 and the Remainder of Bruce No. 544 RD); and
Mokaning (Portions 1, 2,3,4,5 and the Remainder of Mokaning No. 560RD).
The mine falls within two Local and District Municipalities; the farm Mokaning is situated within the Tsantsabane Local
Municipality (NC085), which forms part of the Siyanda District Municipality. The farms Parsons, Bruce and King are situated
within the Gamagara Local Municipality (NC01B1), which forms part of the John Taolo Gaetsewe District Municipality
Neighboring towns and villages include Olifantshoek, Beeshoek, and Dingleton. The overall mining area in which Khumani
operates is approximately 9000ha.
PROJECT DESCRIPTION
Through Khumani’s ongoing commitment to optimise its existing mineral resources, the operational team has identified the
need for two additional process facilities required to optimise beneficiation and still meet its approved production
allocation. Referring to Figure 1 and Figure 2, these facilities include the Off-Grade 2 Plant (already approved in terms of
the relevant environmental legislation) and the proposed WHIMS 2 Plant (referred to as “C” on the provided maps). The
new infrastructure will result in the need for ancillary infrastructure associated with the activities. The Off-Grade 2 Plant
has been applied for in terms of Regulation 543 and 545 of the NEMA and the environmental permit was awarded in October
2013.
New Infrastructure on farm Parsons
(Letters indicated in brackets in this section refers to the map reference)
Referring to Figure 1, design changes to the approved Off-Grade 2 Plant have indicated the necessity for the addition of the
Tertiary By-pass Stockpile area (E) and the Low- Grade Reclaim Facility (B). The WHIMS 2 Plant (C) will be an additional
plant to the already approved WHIMS Plant. This facility will make use of existing infrastructure as well as infrastructure
presented in this application.
The improvement in the processing technique on Khumani has also resulted in the opportunity to reprocess all material
previously regarded as discard material. As a result, the existing and approved Discard Dump on the farm Parson will now
expand and become a Low Grade Stockpile (A) to accommodate the existing and additional material which will be
reclaimed in the future. The expansion of the area from the approved area to the new area will require a change from
110.8ha to approximately 356.3ha.
Three conveyors and a bin (D) which will also include the required service roads will be constructed. The first conveyor will
convey low grade material from the Off Grade 2 Plant to the bin. Low grade material will then be conveyed from the bin to
the Low Grade Stockpile (A) and to the Tertiary By-pass Stockpile (E). The New Parsons Low Grade Conveyor (F) will convey
low grade material from the existing Parsons Plant to the bin. The Reclaimed Product Conveyor (G) will convey reclaimed
material from the Low Grade Reclaim System (B) to the new WHIMS 2 Plant (C). Additional infrastructure will include the
construction of a water storage tank, additional stormwater facilities (separating clean and dirty water), haul roads and
22kV powerlines.
New Infrastructure on farm King
Referring to Figure 2, on farm King a new Overburden Dump (H) and a new Low Grade Stockpile (J) will be required. In
addition to these, ancillary infrastructure to these areas will also be required which include a storm water management
system and haul roads.
Summary
This application includes the by-pass and reclaim infrastructure (B, D and E) for the Offgrade 2 Plant (already approved),
the WHIMS 2 Plant (C), the creation of the Low-Grade Stockpile (A), the additional conveying infrastructure (F) and (G) for

the Low-Grade Stockpile. Ancillary infrastructure will include the construction of a water storage tank, additional
stormwater facilities, expansion of the existing clean and dirty water channels, additional conveyors from the existing
Parsons Plant, haul roads and 22kV powerlines.
A new Overburden Dump (H) and a new Low Grade Stockpile (J) will be required on the farm King. Further infrastructure
includes associated stormwater management facilities and haul roads.
These additional activities on both the farms King and Parson will require approval under NEMA, the National Water Act,
1998 (Act No. 36 of 1998) (NWA) and an Amendment to the Environmental Management Programme (EMP) in terms of the
Mineral and Petroleum Resources Development Act, 2002 (Act No. 28 of 2002) (MPRDA). The activities will not influence the
production output or Mining Works Programme of the mine.
PROPOSED SPECIALIST INVESTIGATIONS
The specialist investigations listed in Table 1 are currently being undertaken for the proposed development (in terms of the
MPRDA, NEMA and the NWA).

REGULATORY CONTEXT
The environmental authorisation processes are being run in parallel as far as practically possible to streamline the process
in terms of the required stakeholder consultation associated with each authorisation process. Accordingly, the following
environmental authorisation processes and stakeholder engagement processes will be undertaken concurrently for the
Khumani Infrastructure Expansion Project:
Environmental Authorisation amendment in terms of the MPRDA;
Environmental Authorisation in terms of the NEMA; and
Water Use License Application in terms of the NWA.

The regulatory context for the proposed project is summarized in Table 2 below.

THE NATIONAL ENVIRONMENTAL MANAGEMENT ACT (NEMA)
Section 24(1) of NEMA requires that the potential consequences of, or impacts on the environment when undertaking listed activities must be considered, investigated, assessed and reported on to the competent authority. Where environmental impact assessment has been identified as the instrument to be utilised in achieving the aforementioned, an application for environmental authorisation needs to be obtained. The identified activities are listed under Government Notice (GN) R544, R545, R546 and R547 of the NEMA Regulations respectively.
The listed activities (Table 3) which are triggered by the proposed mining operation are contained in Listing Notice 1 (GN R544) and Listing Notice 2 (GN R545). Activities contained in Listing Notice 1 require a Basic Assessment (BA) process to be followed whilst activities in Listing Notice 2 require a Scoping and EIR (S&EIR) process to be followed. For the purposes of this application, all items listed under Listing Notice 1 will be addressed in the required EIA process applicable to proposed Listing Notice 2 activities.
THE MINERAL AND PETROLEUM RESOURCES DEVELOPMENT ACT (MPRDA)
The environmental authorisation process, required in terms of the MPRDA, considers the project as a whole including all activities related to the proposed Khumani Infrastructure Expansion Project. The EIA/EMP developed in terms of the MPRDA will address all the environmental impacts and proposed management measures associated with the proposed mining operation, as well as provide background on the current environmental conditions on site.
In terms of Section 39(1) of the MPRDA, every person who has applied for a mining right in terms of Section 22 must conduct an EIA and submit an EMP within 180 days of the date on which he or she is notified by the Regional Manager to do so. There also rests an obligation on the applicant to notify and consult with interested and affected parties within 180 days from the date of the notice. Khumani is required to conduct an environmental assessment for all new activities in terms of the Khumani Infrastructure Expansion Project and submit a Scoping Report and EIA/EMP to the DMR in the Northern Cape for authorisation.
THE NATIONAL WATER ACT (NWA)
The NWA stipulates that activities which have the potential to impact on a water resource and which do not constitute Schedule I water uses (e.g. abstraction of groundwater for domestic use in a household); cannot be authorized in terms of the General Authorisation notices; or which are not existing lawful water uses require authorisation by means of a water use license (WUL) issued by the Department of Water Affairs (DWA). In accordance with the requirements of the NWA, an Integrated Water Use License Application (IWULA) will be compiled for the Khumani Infrastructure Expansion and submitted to the DWA to ensure the legality of the identified water uses associated with the proposed operation.
The water uses, in terms of Section 21 of the NWA, which may be applied for by in respect of the operation include the following:
Section 21(a) - Taking water from a water resource;
Section 21(b) - Storing water;
Section 21(c) - Impeding or diverting the flow of water in a watercourse;
Section 21(f) - Discharging waste or water containing waste into a water resource through a pipe, canal, sewer, sea outfall or other conduit;
Section 21(g) - Disposing of waste in a manner which may detrimentally impact on a water resource;
Section 21(i) - Altering the bed, banks, course or characteristics of a watercourse; and
Section 21(j) - Removing, discharging or disposing of water found underground if it is necessary for the efficient continuation of an activity or for the safety of people.

PUBLIC PARTICIPATION PROCESS
Public involvement is an essential part of any environmental assessment process. You have been identified as an I&AP who
may want to receive information regarding the above-mentioned project. You will be given the opportunity to provide your
input into the environmental assessment process and to receive information. All comments will be recorded and presented to
the project team and regulatory authorities. You will receive feedback on how your comments have been taken into account
and the outcome of the assessment.
I&APs include any person who will be directly or indirectly involved and/or affected by the project. To be recognized as an
I&AP one must register with GCS to be added to the stakeholder database for the project. You may communicate via fax,
email or telephone to obtain further information or comment on the proposed Khumani Infrastructure Expansion. All
registered I&APs will be kept informed of the decision taken by the DMR, NCDENC and DWA.

Proposed steps in the process are as follows:
Step 1:
Notify I&APs and identify issues
Notify I&APs of the project proposal;
Identify any issues/concerns of I&APs;
Provide I&APs with a BID on the project, including a locality map and a Registration and
Comment Sheet; and
I&APS are required to register their interest in the project to receive further project
information.
Step 2:
I&AP review of Draft Scoping
Report
Issues and concerns raised by I&APs are contained in a CRR for inclusion in the DSR;
The DSR is released for a 40 day commenting period; and
All registered I&APs on the project database are notified in writing of the opportunity to
comment.
To assist I&APs with their understanding of the project, a public meeting or consultation in a similar manner , to which all
I&APs are invited or will be involved, will be held during the review period. Copies of the report will be made available on the
request from GCS.
Step 3:
Final Scoping Report
Comments received from I&APs during the review process are considered in the compilation
of the FSR; and
The FSR is released for a 21 day commenting period before it is submitted to NCDENC.
Step 4:
Draft EIR and EMPr for I&AP
review
Compilation and release of a DEIR for a 40 day review period.
Step 5:
Final EIR and Draft EMPr
The FEIR, including the CCR and Draft EMPR will be compiled for submission to NCDENC for
decision making.
The FEIR is released for a 21 day commenting period before it is submitted to NCDENC.
Step 6:
Environmental Authorisation
and Appeal Period
All registered I&APs will be notified in writing of the decision by the NCDENC regarding the
environmental authorisation, being positive or negative for the project. With the
environmental authorisation all I&APs will also be notified of the appeal period, as well as
the manner of appeal.
Public Notification A major part of the PPP is to notify members of the public of the proposed activities,
particularly those who may be directly or indirectly affected by the proposed project. This will
be achieved via the following means:
The placement of an advertisement in a regional newspaper, i.e. the DFA;
Notices, in English and Afrikaans will be placed at the site;
Distribution of BIDs to landowners and occupiers of land adjacent to the proposed
prospecting area and to I&APs on request; and
Local authorities will be notified in writing and automatically registered as I&APs.
Documents for Public Review The DSR will be made available for public review and comment to registered I&APs for the
legislated 40 day period. All registered I&APs will be notified of the availability and until which
date comments may be forwarded to GCS.

2.2.4 Issues Trail
Issues may be raised throughout the environmental authorisation through various consultation
activities. This is an ongoing process and the issues trail in the IRR will therefore be updated
as comments and responses from the authorities and public are made regarding specific issues
about the project. All issues and comments will be formally addressed in the Final EIA/EMP
reports as well as in the IRR.
No Comments were received during the Scoping phase.
2.2.4.1 Review The draft ESR has been made available for Public review and comments for a 40 day period
from 23 October 2014 till 28 November 2014. The report were also made available on the
GCS Website www.gcs-sa.biz .
Proof of notification is detailed overleaf.
The Draft EIA report will be made available to I&AP’s for a 30 day review period from 2
October 2015 till 2 November 2015 on the GCS Website www.gcs-sa.biz.

Notice is hereby given in terms of Regulation 54 of the Environmental Impact Regulations
published in Government Notice R.543 in Government Gazette No.33306 of 18 June 2010,
under Section 24(5) of the National Environmental Management Act, 1998 (Act No.107 of
1998) (NEMA) of the Environmental Impact Assessment (EIA) process, to be undertaken by
GCS Water and Environmental (Pty) Ltd (GCS) on behalf of Assmang Limited for proposed
infrastructure expansions of the Khumani Iron Ore Mine, near Khathu in the, Northern Cape
Province. The proposed infrastructure upgrades will take place on the farm Parsons 564 and
King 561, Bruce 544, Mokaneng 560.
GCS has been appointed as the independent Environmental Assessment Practitioner (EAP) for
the proposed Parsons And King Infrastructure Expansion Project at Khumani Iron Ore Mine
and is currently in the process of conducting the environmental authorisation processes and
public participation process related to the said project.
The NEMA activities which are triggered by the proposed expansions are listed under
Regulations R544 and R545, and as such require an application for an Environmental
Authorisation in terms of NEMA. The listed activities are: GN R.544 No. 11, 22, 28; GN R. 545
No. 5 and 15; and GN R. 546 No. 14, as previously advertised.
In conjunction with the NEMA Environmental Authorisation, the following authorisation are
required for the proposed activity:

• Updating of the approved EMP in terms of the Mineral and Petroleum Resources
Development Act, 2002 (Act No. 28 of 2002) (MPRDA).
• Water Use Licence Application in terms of the National Water Act, 1998 (Act 36 of
1998)
The draft Environmental Scoping Report is now available for public review and comment until
the 21st of November 2014. The report can be obtained from the GCS website: www.gcs-
