More than 350 business leaders gathered in Phnom Penh for the 2nd ASEAN EU Business Summit on April 1, 2012. The Summit was called a ‘great success’ by the EU Commissioner Karel De Gucht, Cambodia’s Senior Minister and ASEAN Economic Ministers Chair, Cham Prasidh.

Tan Sri Datuk Yong Poh Kon, FMM President who represented the Malaysian private sector highlighted in his presentation the importance of private sector engagement in the ASEAN and EU economic integration process and the myriad of opportunities emerging from such an economic integration. During the sector specific Dialogue, Tan Sri highlighted areas of mutual interest for both ASEAN and EU businesses and specifically identified key recommendations for a sustainable EU-ASEAN trade and investment relationship in the pharmaceutical and automobile industries.

Key recommendations from the private sectors of ASEAN and EU were:

• TheEUandASEANshouldconcludeon-goingbilateralFTAswithSingaporeandMalaysia and work towards a future FTA with the regional framework;

• FurtherdevelopmentofBusiness-to-BusinessandBusiness-to-GovernmentDialogues between the EU and ASEAN in order to create new trade and business opportunities and strong partnerships which support ASEAN's economic integration;

• TheEUandASEANtoenhanceregulatoryandtechnicalcooperationwithaviewto preventing and eliminating unnecessary barriers and promoting transparent regulations; and

• TheEUtocontinuetoprovidecapacitybuildinginbetterunderstandingoftheregulatory requirements for doing business in the EU and for ASEAN industry to be able to meet EU norms.

E W S H I G H L I G H T SnFollowing the announcement by YAB Prime Minister on the national minimum wage for the private sector on April 30, 2012, FMM issued two email advisories to members on May 2, 2012 andMay10,2012andacircularwasissuedvideGPR/12/2012datedMay16,2012withupdatesontheimplementation.Highlightsareasfollows:

Minimum wage for private sector employees would be as follows:

• PeninsularMalaysia–RM900orRM4.33perhour• Sabah,SarawakandFederalTerritoryofLabuan–RM800orRM3.85perhour

A. Implementation date

• Therateswilltakeeffectsix(6)monthsfromthedateofgazetteof the Minimum Wage Order.

• TheMinimumWageOrderhasNOTbeengazettedasattodate.

• A12-monthgraceperiodisgiventomicroenterprises(enterpriseswithsalesturnoveroflessthanRM250,000ORfulltime employees less than 5).

• Aflexibleimplementationmechanismisprovidedtoemployerswho are unable to implement the minimum wage within the timeframe given. These employers could appeal for an extensiontotheNationalWagesConsultativeCouncil.

Members would be notified as soon as the Order has been gazetted.

B. Minimum Wage Component

• Thetypesofallowancesorfixedcashpaymentsthatcouldbeabsorbed in the calculation for minimum wage have NOT been determined yet.

• FMMhasbeenmadetounderstandfromtheMinistryofHumanResources(MOHR)thataCommitteewouldbeformedsoontodeterminethesefixedallowancestoensurestandardizedimplementation.

• VerbalconfirmationfromtheMOHRisthatallowableallowances that can be absorbed into the calculation of minimum wage must fulfil three (3) criteria as follows:

i. The allowance to be absorbed must be in compliance with the definition of wages under Section 2 of the EmploymentAct1955;

ii. Theallowancemustbefixedandpaidregularlyeverymonth.

iii. The wages and allowances paid must be within the working hours.

FMMhassubmitteditsrequesttotheMOHRtositonthisCommittee.

Actual implementation at firm level could only be carried out WHENtheabovedetailsandotherrequirements,ifany,areconfirmed. While waiting for the confirmation of the above details, companies are advised to start preparing themselves.

FMM had highlighted that the TPP remains one of the most important new FTAs being negotiated as it provides the opportunity for Malaysia to strengthen its trading position with the US.Inthisregard,itisimportantforaflexibletimeframebegivento implement the commitments made in the TPP agreement. Early harvest schemes especially for certain chapters in the agreement such as government procurement and intellectual property should be considered by the TPP negotiators to allow countries adequate time to implement the TPP.

Both parties agreed that continuous engagement between the public and private sectors was important in ensuring an early and successful conclusion and implementation of the TPP.

UnitedStatesTradeRepresentativeRonKirkpaidacourtesycallonTanSriYongPohKon,FMMPresidentonApril26,2012.Ambassador Kirk and Tan Sri Yong discussed bilateral trade and investment opportunities between the United States and Malaysia,aswellasexchangedviewsonareasofinterestformanufacturers in the Trans-Pacific Partnership (TPP) Agreement. TheTPPisthe9-countryinitiativetowardahigh-standardandcomprehensive trade agreement which covers all the mainstays of a free trade agreement, including trade in goods, rules of origin, trade remedies, sanitary and phytosanitary measures, technical barriers to trade, trade in services, intellectual property, government procurement and competition policy.

consistentlybeensubjectedtonumerousunfairchargesandfees by the logistics service providers that have contributed to increasing the cost of doing business. While the authorities have studied specific aspects of the issues over the years, a resolution has not been so readily forthcoming as these ancillary charges fall within the purview of several agencies. A holistic approach to the matter is urgently required.

FMM remains of the view that the DGC or any other claim by the CDO should be borne and absorbed by the shipping lines who are their principals and therefore, fully responsible for depotoperations.Hauliersdonothaveanylegalstandingtopay the depot operators on behalf of shippers and thereafter collect the charges from shippers. Shippers and hauliers are not a party to any agreement for services provided by CDO. Shippers merely adhere to the requirement by shipping lines to collect and return empty containers to and from the respective container depots.

Therefore, the move by the Government to regulate the depot gate operators is a step in the right direction if a recurrence of the current problem is to be avoided. Strikes by hauliers’ drivers as a result of unilateral demands made by the CDO affectnotjustmanufacturersbuttheeconomyasawholegiventhesignificanceofexportsindrivingthegrowthoftheMalaysian economy.

The Federation of Malaysian Manufacturers (FMM) has been made to understand that the Government will be taking certain measures to regulate the deport gate operators and relevant logistics service providers to prevent arbitrary increases and imposition of new charges. We have been informed that these decisions were made following the strike by hauliers’ drivers whichhadadverselyaffectedtheimportandexportactivitiesof our members.

FMM had earlier highlighted its concern to the Government that the strike by the hauliers’ drivers on May 2, 2012, if not amicably resolved and in timely manner, would adversely impact economic activities and the economic performance of Malaysia.

We understand that the strike stems from the abrupt increase in Depot Gate Charges (DGC), imposed by the Container Depot Operators (CDO) without any prior consultation and justification.TheCDOisalsodemandingthehaulierstopaythe DGC on behalf of the shippers including manufacturers.

FMM had, through the various channels, raised this long standing issue and concerns with the relevant authorities including the Ministry of International Trade and Industry, Ministry of Transport, Ministry of Domestic Trade, Cooperatives and Consumerism, and recently, with the Malaysian Competition Commission. We have highlighted that shippers have

The above Seminar was organised with the aim to educate participants on the importance of rules of origin and correct procedurestoapplyfortariffreductionforexports/importstoFTApartnercountries.Atotalof86participantsattended the seminar.

Inhiswelcomeaddress,FMMVicePresident,YMRajaDato’AbdulAzizbinRajaMudaMusahighlightedconcernsthatself-certification would lead to greater falsification and forgery of documentation and declarations. FMM had several discussions with the Government to highlight the need for heavier penalties for defaulters who abused the system. FMM had proposed for the Customs Act to be reviewed to impose a fineofnotlessthanRM50,000orthreetimesthevalueofthegoods in respect of which offence was committed, whichever is

greaterorimprisonmentforthetermnotexceedingfiveyearsorboth fine and imprisonment. FMM had reiterated that the abuse of the self-certification system could be curbed if penalties under the Customs Act were further tightened.

Speakers from the Ministry of International Trade and Industry briefed participants on the latest updates on the FTAs to be signed with the European Union, Turkey, Chile, India and Australia. There were also presentations on the correct procedures for applications for preferential certificates of origin andcalculationoftherulesoforigin.ThespeakerfromRoyalCustoms Department briefed participants on the legislative enforcement and elements of proposed amendments to ProvisionsofCustomsLawsonSelfCertification.

ThenewlypublishedISO14051:2011providesageneralframework for Material Flow Cost Accounting (MFCA) which is a toolforquantifyingtheflowsandstocksofmaterialsinprocessesor production lines in both physical and monetary units.

MFCA is a relatively new field in environmental management inMalaysia.However,ithasproventobeapopulartoolandispracticedbymorethan300companiesinJapan,showingsuccessful cost reduction as well as enhancing environmental performance.ISO14051:2011istosupplementcontinualimprovementsforISO14001.

TheBriefingheldonApril18,2012,aimedatprovidingmemberswithanoverviewofMFCAandsharingofexperiencesby some of the local companies in the implementation of MFCA.

During the briefing, Malaysia Productivity Corporation (MPC) andCentrexTraining&Consultancyhighlightedapproachesinimplementing MFCA which includes:

• Determinationofthetargetedproduct/productionlinebasedon product’s revenue, waste quantity or other criteria;

• Determinationofprocessflowandquantitycentre;• Datacollectionanddatagapidentification(includingcost);

and• Improvement(kaizenactions).

The cost categories in MFCA are material, energy, system andwastemanagementcost.Malaysia’spilotMFCAproject,jointlysponsoredbytheAsianProductivityOrganisation,JapanProductivity Center and MPC concluded recently with five model companies,whichintotalachievedcostreductionofRM1.64million. Four out of the five model companies are members of FMM, namely Autokeen Sdn Bhd, KEU Control Engineering Sdn Bhd, Tenaga Cable Industries (M) Sdn Bhd and Tokyo Ferrite (M) Sdn Bhd.

MFCA implementation requires involvement of management, determinationofnecessaryexpertiseandestablishmentofaworking committee to monitor and review results.

The impacts of MFCA improvement have been identified as follows:

• Visualizationofmateriallosseswithinanorganisationaswellas supply chain;

• Improvedcoordinationandcommunicationonmaterialandenergy use in an organisation;

• Improvementinmaterialandenergyefficiency;• Reductioninenvironmentalimpact;•Managementsystemintegration.

MFCA is applicable to any organisation that uses materials and energy,regardlessoftheirproducts,services,size,structure,location,andexistingmanagementandaccountingsystems.

Green Technology Financing Scheme (GTFS) is a soft loan by the Government to facilitate the improvement of supply andutilizationofGreenTechnology(GT).GTreferstothedevelopmen and application of products, equipment and systems used to conserve the natural environment and resourceswhichminimizesandreducesthenegativeimpactofhuman activities.

TheGTFS,launchedin2010withRM1.5billionallocation,isscheduled to end in 2012. The Malaysian Green Technology Corporation (Green Tech Malaysia) has submitted a proposal to theGovernmenttoextendtheschemeuntil2014.Atotalof33applications have been approved since 2010 until March 31, 2012comprising24applications(RM418million)byproducersandnine(RM31million)byusersofGT.

Users of GT in particular those in the manufacturing sector are urged to be more aggressive in applying for the GTFS. As established business entities, manufacturers are in a better positiontoestablishviableandsustainableprojectsaswellasrepay loans compared with producers of GT.

These were among the points highlighted at the briefing on GreenTechnologyjointlyorganisedbyFMMandGreenTechMalaysiaonApril26,2012.SpeakersfromGreenTechMalaysia and Credit Guarantee Corporation (CGC) shared with participants the National GT Policy and financial assistance for green initiatives. Nasmech Technology Sdn Bhd related their experienceindevelopingagreenprojectandobtainingtheGTFS approval.

ProjectswithinMalaysiaintheidentifiedsectorsnamelyenergy(supplyandutilization),building,waterandwastemanagementandtransportation,whetherusinglocaland/orimportedtechnology are eligible for GTFS.

GTFS is coordinated by Bank Negara Malaysia. Green Tech Malaysiaissuestheprojectcertificate.CGCprovidesguaranteeon the loan approved by participating financial institutions. Green Tech Malaysia is also conducting briefings with bankers nationwidetoimproveunderstandingonGTprojects.

Duringtheprojectcertificationprocess,GreenTechMalaysiawouldcarryouttechnicalevaluation.Theprojectproposerswouldpresenttheprojectbrieftoagroupofbankers,whowouldevaluatethebankabilityoftheproject.

Onceaprojectisapproved,monthlyprogressreportsmust be submitted to Green Tech Malaysia throughout the implementation. An outcome report must be submitted every sixmonthsuponcommissioningtoensurethattheprojectcontinuestobegreenandenjoysalowguaranteefeeandthe2%interestsubsidy.

Projectproponentswerealsoadvisedtoobtainapprovalsfrom authorities where relevant e.g. the Department of Environment, local councils and state Governments before a loan is drawn down.

Customs Appeal Tribunal What is the Customs Appeal Tribunal?

TheCustomsAppealTribunal(TRK)whichwasestablishedonJune1,2007isanindependentbodysetuptohearappealsagainst the decisions of the Director General of Customs (DG) undertheCustomsAct1967,ExciseAct1976,SalesTaxAct1972andtheServiceTaxAct1975.

Itsobjectiveistoprovideanappealsystemwhichisimpartial,fair,transparentandexpeditiousfordissatisfiedpersonstoappeal against the decisions of the DG of Customs.

Any person dissatisfied with the decisions of the DG of Customs underthevariousActsmentionedearliercanappealexceptformatters relating to compound and the provision under section 128(3),CustomsAct1967.

Appeals against the decisions of the DG of Customs must be filed within 30 days from the date of notification of the decision.

An appellant can file an appeal at the Tribunal's office by filling up Form A (Notice of Appeal) in four copies together with a registrationfeeofRM100.00.Theformcanbeobtainedfromthe Tribunal's office or can be downloaded from the Federal Treasury website at http://www.treasury.gov.my or http://tribunalkastam.treasury.gov.my.

TheTribunalwillfixthedate,placeandtimeforhearing.Theparties will be informed of the date, time and place of hearing notlessthan14daysbeforethedayofhearing.

The Tribunal will assist parties in negotiating an agreed settlement before proceeding to hear the appeal. The Tribunal will deliver its decision to the parties after the hearing is concluded. The appellant or respondent can apply from the TribunalforwrittenreasonsoftheTribunal'sdecisionwithin28days of date of decision. The written reasons will be furnished within 30 days of such application. The Tribunal's decision can beappealedtotheHighCourt.

AnappellantmustpayalldutiesandtaxesasdeterminedbytheDG of Customs before the appeal is heard.

Reselling of raw materialHow do we resell raw material that we have imported with exemption of import duty and sales tax to another local manufacturer?

Themanufacturerhasbeengivenexemptionfrompayingimportdutyandsalestaxonitsrawmaterialsundersection14(2)CustomsAct1967.Ifthemanufacturerintendstoselltheraw materials locally then he has to apply to the State Director of Customs for approval. Upon approval, the manufacturer hastopaytheimportdutyandsalestaxconcernedbyusingthe Customs 1 form before he can sell to his customer. Assessmentontheamountofduty/taxinvolvedwillbebasedonthevalueasdefinedundersection2andsection19,CustomsAct1967andsection7,SalesTaxAct1972.

TheprogressoftheimplementationoftheREACH,basedontheoutcomesoftheEUCompetentAuthorityforREACHRegulation(CARACAL)MeetingonMarch21-23,2012,areasfollows:

a)RestrictiononDichloromethane

•Theuseofpaintremovercontainingdichloromethaneinconcentrationof0.1%andabovebyprofessionalswillbebannedasofJune6,2012.ThesamebanforgeneralpublicwasimposedonDecember6,2011;

•MemberStatesmaystillallowtheproducttobeusedbyspecificallytrainedprofessionals.However,theywillneed to specify health and safety provisions to protect the professional users; and

•TheEuropeanCouncil(EC)willsoonpublishalistofMember States that wish to derogate from this restriction. Thus far, Italy and Poland have indicated interest to use the derogation, whilst France, Denmark and Sweden have no intention to do so.

b)AmbiguityonRegistrationRequirementsforVegetableOils

and Fats derived from GMOs and for Polymers

•TheECwillprovideclarificationsontheexemptionof vegetable oils and fats derived from GMOs from registration andevaluationunderREACH.SeveralMemberStatessuch as Germany and France argued that the substances mustnotbeexemptedfromrequirementsunderREACH;and

•Ontheregistrationrequirementforpolymers,theECwill also prepare draft guidelines to clarify that the requirement is legitimate to meet health and environmental protection, asconfirmedbytheEuropeanCourtofJusticein2009.

c)RestrictiononShort-Chain-ChlorinatedParaffin(SCCP)

•TheECplanstoremoverestrictionsonSCCP(atoxicand carcinogenicmixture)undertheREACHtoEU’slegislationon Persistent Organic Pollutants (POPs);

•SCCPsarefrequentlyusedinindustrialapplicationssuchasintextiles,rubber,plastics,leatherpaintsandinmetalworkingfluids;and

•OnceplacedunderPOPsregulation,SCCPwouldeitherbesubjecttoabanorstrictrestrictioninproduction,export,importanddisposal.

d)ClarificationontheRoleoftheOnlyRepresentatives(OR)forThirdCountriesinREACH

•TheEChasclarifiedtoMemberStatesthatORareallowed to register and obtain authorisation, on behalf of manufacturers from third countries, based on the following reasons:

–IsinlinewiththeEU’sobligationsunderWTOTechnicalBarriers to Trade agreement, where manufacturers from third countries should not be deprived (discriminated againstEUproducers)fromusingOR;–Thirdcountries’manufacturersshouldnotbeforcedto

divulge sensitive information to any importers that they donottrust.Hence,theuseofORwilladdressthisproblem; and–EvenundertheREACHRegulation,theobligationsofORaresimilartothatimposedontheEU’simporters.

e)ApplicationofREACHforChemicalProductsExportedfromthe EU to Third Countries

•TheECclarifiedtoMemberStatesthattheREACHregulation is only applicable to products placed in the EUmarket.Assuch,chemicalsubstances,mixturesorarticlesexportedfromtheEUtothirdcountrieswillnotbecoveredundertheREACH;itisgovernedundertheEU’sregulationconcerningexportandimportofdangerous chemicals.

f)ReviewofREACHRegulationin2012

•TheEuropeanCommission(EC)willpresentareviewonREACHinJune2012,fiveyearsafteritsimplementation.The review will be based on the outcomes of the reports on twelve areas (including on the scope, impact of REACHtotheEUmarket,andapplicationofnano-technologyinREACH).

g)ExemptionfromREACHRegistrationforChemicalSubstancesusedinR&D

•ChemicalsubstancesintendedtobeusedforProductandProcessOrientatedResearchandDevelopment(PPORD),canbeexemptedfromtheregistrationrequirements for a period of five years. To benefit from theexemption,companiesmustsubmitaPPORDnotification to the EC.

TheEuropeanChemicalAgency(ECHA)hasintroducedmeasures and tools to facilitate downstream users to comply withtheirobligationsunderREACH.Obligationsofthedownstream users include:

Two regulations on food additives published by the European Commission (EC) recently were as follows: • Newspecificationsforfoodadditivesapprovedtobeusedin

food products; and• Proposedregulationonconditionstousealuminiuminfood

additives.

Under the new regulation on food additives, the specifications include description, synonym names, colours and purity criteria of the additives. In efforts to reduce intake of aluminium in food especially for children, the European Union has also proposed a regulation to outline new conditions to use aluminium-containing food additives. The conditions include on permissible colouring and level of concentration of the chemical substance.

The training programme on Slip, Trip and Fall Prevention was facilitated by Abdul Malek Bin Omar, Occupational Safety andHealthConsultantonFebruary16,2012.Thetrainingprogramme was aimed at creating greater awareness on the dangersofslip,tripandfallintheworkplace,identifyhazardsandinitiatepreventivestepstominimiseinjury.Employeeswere urged to work with their supervisors and co-workers to recognise,avoidandcontrolpotentialhazards.Accidentsresulting from slip, trip and fall are required to be reported to theDepartmentofSafetyandHealth(DOSH).
