T he property incl ud es a cree k t hat is part of th e head w ater s of Fay Cree k, on e of t he most important tr ib utaries of S almon Cree k. T he pro pe rt y is owne d  by Don Sherer, a semi-retired lawyer from Palo Alto. His wife Joyce is an exceptionally talented artist. The appraisal determined that there are approximately 700 redw oods on t he property, many of w hic h are old grow t h and old second g ro w t h T he ease men t pr ohib its t he harvesting of r edwoods, t he sub d ivision o f t he  property, any construction within the groves, and all com mercial us es, w hil e allowi ng low impact recreat ional uses su ch as hiking and nat u re st ud y. T he enh a ncem ent of the groves is encouraged by allowing the removal of non- nat ive spec ies and the planting of nat i ves. T he easement explicitly assigns all water rights not retained  b y th e owne r to t he land t rus t for t he purp ose of maint aining maximum flo w in Fay Creek. T his w ill be of  particular benefit to the salmonids whose spawning grounds were badly silted up in the 1980’s. A conservation easement not only benefits landowners  by preserving their land as they want it to be in  perpetuity, it also provided tax benefits. Since land trusts are 501(c)3 charities the appraised value of an easement that is donated counts as a charitable contribution for income tax purposes. The value of the property is reduced by the value of the easement, thus reducing the owner’s property taxes as well. Last August Congr ess  passed the Pension Protection Act, part of which allows an easement donor to spread his or her tax deductions over 15 years (see “Good Laws!” below), but the law expires at the end of 2007, so now is a good time to think about donating an easemen t!
