For the guidance of all concerned and to fix the period in the suhmission01'appl icat ions. Ihe followi ng proced ures shall be observed:

I. Hcfore posting the otice of Vacancy, the Executive Judge (rorvacancies in the Office of the Clerk of Court) or the Presiding Judge (forvacancies in the hranch or st:'ltion), shall wait for the notification from theOITice of Administrative Services, Office of the Court Administrator(OAS-OC/\) except in the following instances:

I. vacancies in the newly created courts;} renew:'ll of temporary appointments;3. reappointment or reemployment (change of status of

employment from temporary to permanent).

The OAS-OCA shall notify the Executive Judge/Presiding Judge todirect the Clerk of Court of the Office of the Clerk of Court/Clerk ofCourt or the branch or station, to post notices of vacancies within five (5)days from receipt of the approval by the Chief Justice of the authority tofill vacancies in the lower courts. Within five (5) days from receipl of thenotice. the Executive Judge/Presiding Judge shall immediately informthe OAS-OC of the date of the start of posting.

2. The notice of vacancy shall be posted in three (3) conspicuou place~ill thc cuu rt 's premises and in ot her publ ic places for at least tell (10)conseculive working days. It shall include the qualification standards forIhe position and the checklist or requirements prepared hy the OAS-OC/\, necessary for the evaluation of the application. Within two (2)IT10ilths from Ihe expiration of the ten (10) day period for posting, Iheapplicant/s shall submit the reljuirements 10 the judge where the vacancyC.\lstS.

:1. II applications, together with the complete or incompleterequirement received by the Executive Judge/Presiding Judge, hall beindor ed to the OAS-OCA within the two-month period following thecxpiration of the ten-day period for posting. The indorsement shall beaccompanied hy a certification, under oath, by the ExecutiveJudge/Presiding Judge that lhe list submilted contains the name/s of allapplicant/s who applied for Ihe position.

The date of mailing shall be the determining factor to considerwhether the indorsement wa~ sent within the two-month period. Forapplication/s personally filed before the OAS-OC/\, the date of receipt bythe OAS-OCA is the conlrolling factor.

--I. All application/s directly filed with the OAS-OC/\ personally or selllthrough mail within the two-month period, shall be referred to theExccutive Judge or Presiding Judge for comment and/or appropriateaction within five (5) days from receipt of the application/s. TheExecutive Judge/Presiding Judge shall provide the applicant/s with achecklist of requirement to be submiLLed to the OAS-OCA within thesame period of two (2) months following the expiration of the ten-day

period for posting. Thereafter, the OAS-OCJ\ shall evaluate all theapplications and shall submit the list to the Selection and Promotion8nard-Lowcr Courts (SPB-LC) within fifteen (IS) days. Those withincomplete form or lacking requirement/s shall till he included in the list10 he submitted to the SPB-LC with a notation as to the lacking form or~requirement/.. If after assessment of competence and qualification ofcandidates, the applicant found by the SPB-LC to be the mo t qualifiedfor the position applied for has incomplete form and/or lackingrequirement/s, the SPH-LC may require the aid applicant to accomplishthe incomplete form and/or to submit the lacking requirement/so

All application/s received from the OAS-OCJ\ or personally filed withthe Executive Judge/Presiding Judge after the aforesaid two-monthperiod may still he endorsed by the Executive Judge/Presiding Judge tothe OAS-OCA for submission to the SPB-LC. The name/s of theaforesaid applicant/s shall be included in the list of candidate/s as long asthe resolution containing the list of candidate/s has not yet beensubmitted to the COurl hy the SPB-LC. A notation that the aforesaidapplication/s was/were submilted after the two-month period shall heindicaled.

6. For this purpo e, the Certificalion to be issued by the Clerk of Courtthat the vacant posilion tu he fillet.! has been posted in three (3)conspicuous places in the court's premises and other public places, suchas:

a) the Office of the Clerk of Court;b) branch of a court, for vacancies in the branch;c) general bulletin board; andd) such other conspicuous places.

for a period of at least ten (10) working days in accordance with Rep. Acto. 7041 shall he made under oath and shall indicate the date when the

notice was posted and the public places where it was posted.

7. Henceforth, all courts shall follow the prescrihed format of Notice ofVacancy and Certification of posting of vacancies. Copies of thl'afuresrlid formal are hereto attacheo for ready rel'erence.
