After sitting on the MCA board for 15 years I am honored to serve as President. Thank you to all the past MCA leaders who have set such a high standard for which the MCA is known for. I am looking forward to representing all of you, many of whom I’ve known for years and many of whom I look forward to meeting. Now, more than ever, I believe we need to come together to preserve the science, art and philosophy of chiropractic in Maryland.

The MCA has worked hard in the past to protect our profession and we need to continue to do so. There have been many initiatives in this state to whittle away our rights as chiropractors. Examples concern our scope of practice and reimbursement, to name only a few. As a profession we need to become an even stronger, cohesive group in order to maintain and strengthen our rights as providers so we may better serve our community.

This New Year, I am committed to see more involvement from you and your chiropractic brothers and sisters. Find out what you can do to help (be it large or small). We need you and want your input. We welcome new faces. I will go out of my way so anyone interested will feel comfortable and welcome at meetings and will want to become involved.

We look forward to achieving a common goal of promoting Maryland Chiropractors’ best interests. In doing so, we will also be benefitting the community as a whole.

So, what can your first 2012 action step be if you’re not already involved?

1. Call your district representative and let them know you are available to help out. 2. Consider attending District meetings.3. Become active on a committee by contacting a committee chair of your choice.

We all know we are part of the best healing profession there is. It is time to let everyone else know it. I’m proud of what we do. My goal is that we strengthen the MCA so we can enjoy practicing successfully in the state of Maryland.

MCA Insurance ReportBy Louis Crivelli, II, DCMCA Insurance Committee ChairmanHAPPY NEW YEAR! With the beginning of a new year, it’s always a good idea to review your insurance company contracts. Be on the lookout for any changes to coverage or participation requirements.

For those using the “old” paper HCFA forms (1500CS-90), BCBS had set a date of Nov. 1, 2011 to begin using the “new” paper HCFA forms (with NPI numbers). If you have not already done so, PLEASE register your NPI numbers with CareFirst.

We have received some reports that certain “bill review” companies have told doctors that they are in their PPO network. We would like to determine if these companies are engaging in silent PPO activities and take appropriate actions. If you have been told by a company that you are enrolled in their PPO, please ask them to provide your signed contract and then contact us.

Please remember to complete an “appeals timeline” when dealing with ASHN. Again, the cleaner this information is presented, the better the potential outcome.

If anyone has any experience and good research regarding children getting chiropractic care following injury, please contact me. I acquired a couple studies that are being used to deny care for children in personal injury/motor vehicle cases. We are working to compose some talking points and rebuttals for these papers and any assistance from doctors who see children frequently would be much appreciated.

As always, I’d like to thank all the members of the Insurance Committee who take time out of their busy schedules and volunteer their time and their brains so that we may all benefit. If you are interested in helping us to help you, please let me know.

The 2012 General Assembly Session began on Jan. 11, 2012 and the MCA legislative committee is geared up for a busy season. As I am sure you know, Maryland is once again facing budget issues, particularly in the area of transportation. We will be keeping an eagle eye out for any “revenue solutions” that would impact either health professionals or small business owners.

Other than the perpetual budget issues, the biggest thing on everyone’s mind these days is the implementation of the Affordable Care Act and the creation of the Maryland State Health Exchange. Lieutenant Governor, Anthony Brown, has been put in charge of this project and he got a bill passed last year that took broad steps to move Maryland out ahead of many other states in this area. Due to this action, Maryland has received a number of federal grants to pay for the initial start-up phases of the Exchange.

Over the course of the past year, numerous committees and policy work groups have been meeting to discuss the nuts and bolts of actually getting this program off the ground. A number of them are actually to the point of creating new regulations. We will monitor anything that comes out and make comments where appropriate.

By the next issue of the MCA newsletter we will have a good idea of which bills we will be dealing with this year. If we need you to send letters or make phone calls to your local legislators, we will notify you right away. Stay tuned.

Happy New Year! The 2012 legislative session started January 11. There are no fundraising political events during the 90 day session. I thank you for your support of the PAC. The PAC provides opportunities for legislators to get to know who we are. By attending legislators’ fundraisers we become familiar to these policy makers that can have a great influence on our practices. While attending an event for Lieutenant Governor Anthony Brown I had the opportunity to discuss issues with him and his brother, a chiropractor in New York, which has already made him receptive to our concerns. Doctors of chiropractic have long cautioned against the overuse of medication to treat musculoskeletal pain.

New HIPAA Rules Took Effect January 1, 2012

The provisions of the Health Insurance Portability and Accountability Act (HIPAA) of 1996 and enacted by Congress in 1996, cover all chiropractic practices. Every DC in practice should have a written HIPAA compliance

plan on file. To enhance the effectiveness of the security and privacy provisions of HIPAA, new rules took effect on Jan. 1, 2012 that establish new requirements in electronic data submission and storage. HIPAA Version 5010 is designed to reduce ambiguity, increase the consistency of information and enable more precise industry benchmarks. The Centers for Medicare and Medicaid Services (CMA) offers a side-by-side comparison between the existing and the new regulations and other helpful downloads.

HR 531 Offers New Pathway for DCs to Provide Needed Care in Areas with Health Shortages

Rep. Bruce Braley (D-IA) has introduced a bill in the House (HR 531), Access to Frontline Health Care Act of 2011, that would help address the inadequate distribution of health care professionals and facilities available to citizens in all parts of the United States. This legislation would authorize the participation of doctors of chiropractic in a federal program through which a portion of the doctor’s student loan obligation might be paid off by “frontline” service for a period of full-time service at a health care facility serving a frontline care facility in an underserved area. HR 531 places a new emphasis on interdisciplinary cooperation and offers a new pathway through which doctors of chiropractic can provide urgently needed services in underserved areas.

Neck Pain Study Reinforces Use of Chiropractic, Other Conservative Options

A new study published this month in the Annals of Internal Medicine finds spinal manipulative therapy (SMT) and exercise more effective at relieving neck pain than pain medication. The research reinforces the use of conservative care options as a first line of defense against pain, according to the American Chiropractic Association (ACA). The study divided participants into three groups that received either SMT from a doctor of chiropractic (DC), pain medication (over-the-counter pain relievers, narcotics and muscle relaxants) or exercise recommendations. After 12 weeks, about 57 percent of those who met with DCs and 48 percent who exercised reported at least a 75 percent reduction in pain, compared to 33 percent of the people in the medication group. After one year, approximately 53 percent of the drug-free groups still reported at least a 75 percent reduction in pain; compared to just 38 percent pain reduction among those who took medication. The study also found that despite experiencing limited pain relief, people in the drug group continued using a higher amount of medication more frequently throughout the follow-up period. This finding underscores concerns raised in an April 2011 government report that indicated prescription drug abuse in the U.S. has reached crisis level. “Doctors of chiropractic have long cautioned against the overuse of medication to treat musculoskeletal pain,” said ACA President Keith Overland, DC. “We continue to promote drug-free, conservative interventions for neck pain patients before referral for medical management that may result in side effects. Patients deserve to know that there are natural, drug-free options when it comes to pain relief.”

Getting Started with Myofascial Trigger Point Dry NeedlingBy David B. Fishkin, DC, MPHMyofascial Trigger Point Dry Needling is the most powerful clinical tool for the treatment of soft tissue subluxation. The soft tissue subluxation (STS) is to be differentiated from the synovial joint-based subluxation treated by the chiropractic adjustment. Just as loss of motion and fixation is integral to the concept of synovial joint subluxation, so too is dry needling integral to treatment of the soft tissue system, albeit a different path. Just as we use the adjustment to clear the fixation and impedance in the osseous system so is the dry needling technique equivalent in its power to clear the soft tissue fixation, its pathomechanics and biochemical imbalance.

In the soft tissue scenario you have macro trauma, micro trauma, acute and chronic catalysts just as in the synovial/osseous system that lead to a sequelae of biochemical/biomechanical events. These events can foment spasming, locking and shortening of soft tissue elements that can no longer respond to internal cues and many external attempts to restore function to a normal physiologic state. The theories proposed by Simons and Travel serve as the underpinning of understanding that what has been coined a trigger point is only the extreme pathologic manifestation of the soft tissue subluxation which occupies a broader area under the continuum of soft tissue dysfunction. We can now explain clearly that the soft tissue becomes subluxated, locked and fixated just as the synovial system does.

Reducing nervous system dysfunction via the soft tissue system is as critical as relieving it via the joint system. The work of Simons and Travel has contributed greatly to the understanding of this mechanism of muscle and soft tissue fixation. And other authors such and C. C. Gunn M.D. and Andrew Fischer, M.D. not only validate the chiropractic model but lend further support for nervous system dysfunction in the peripheral system throughout the soft tissues. And yet other authors such as Helene Langvine have written extensively about the broad communication of the fascial system and its effects on the body. Dry needling is a critical tool in treating these problems.

Direct and Effective

The approach of using fine solid needles to unlock and release the soft tissue structures is more direct and effective than other techniques available today. The difference I and those that I have trained have seen very positive clinical outcomes. Patients who walk in antalgic walk out greatly improved and chronic patients that previously were unresponsive now respond completely or stabilize. This is occurring at the front lines of practice and we have a number of case studies from the referred literature that I have posted on my website.

Sadly, only the doctors in sixteen states Maryland, Delaware, Virginia, North Carolina, South Carolina, Alabama, Connecticut, Florida, Utah, Illinois, Colorado, New Mexico, Rhode Island, New Hampshire, Oregon and Texas are currently permitted to take advantage of this fantastic approach.

Political and Legal Issues

In some cases because the state law does not permit penetration of the skin for any reason and in other states where it should otherwise be permitted, intra and inter professional politics are restraining the spread of this great clinical tool. That story will be told in a future article in DC.

MFTrPDN can be performed only by those doctors who are legally authorized to provide this service under their state law. This cutting edge technique will work with all approaches, whether you like to treat

patients on a symptomatic basis or corrective basis. This technique supports YOUR approach to patient care and is suited to those doctors who seek excellent clinical outcomes and management of challenging acute and chronic patients.

For the well-care doctor who desires to pre-emptively strike against the development of global dysfunction, this approach will support that goal. It will also improve your community profile as a primary care holistic doctor. Offering this service will broaden your appeal to patients who may not currently be seeking you out and as well as improving your service to current patients.

For the sports-oriented doctor there is no greater tool to keep the soft tissue system of your athletes at peak performance. You will learn that early detection and treatment of soft tissue dysfunction will lead to fewer injuries and better performance for your athletes. This technique can be brought to the field as easily as you bring your hands.

For the restorative and corrective oriented practice there is no better method to help achieve and maintain your goal than having this technique in your clinical toolbox. It will be much easier to retrain structural plasticity with the help of a cooperative soft tissue system. Rather than wrestle the structure against resistant soft tissue, you can ease the structure to its desired goal. Adjustments will occur with greater comfort and will hold longer.

For the pain doctor you have no better friend than MFTrPDN technique. I have seen many miraculous events with adjusting, but I have seen many more occur with this technique.

While it is true that we have many approaches to treating the soft tissue system, none is easier on both the patient and doctor than this one. Why, you might ask, is this the case?

Benefits

All soft tissue techniques whether purely manual or instrument-assisted work from the outside in with a good deal of labor and stress on the practitioner and a good deal of groaning from the patient. I understand that to some the idea of penetrating the tissue with a hair thin needle seems more traumatic than the other soft tissue techniques you use, but in reality it is more humane, more comfortable, and actually easier for the patient to tolerate and better yet, easier for you to administer. It takes no more time than any other passive set up and can be co-administered with many other passive modalities such as electrical modalities, diathermy, infra-red etc.

This approach will help increase your practice bottom line both directly and indirectly. For the cash practice or global fee type practice this technique is ideal because it is so efficient. Your interest in managing resources for a single fee will benefit from this approach. While there is no dedicated CPT code at this time this is a service that has value added appeal.

This technique has broad application throughout the body, has fewer contraindications than many of the current technologies and can be used with fracture patients, cancer patients, osteoporotic patients and patients with implanted electrical devices. If you are a new practitioner and limited in capital or are older and do not want to invest now in expensive technologies here is another good reason to adopt this technique. I think the only people who should not consider this technique are ones that never have a patient take off an article of clothing for treatment and those that do not tolerate change very well because this technique will change your life forever.

What is an IPN?• An IPN is a group of independent DC’s that come together and utilize single systems (credentialing, billing clearinghouses,

etc.) to enhance the delivery of healthcare services. It is established to create value for the healthcare system in which we participate. IPN’s that can create value for insurance companies, historically, have received higher rates of reimbursement. This is important for any DC, whether you take insurance or not. Even cash practices have patients that submit for reimbursement. The ability to reduce financial burdens for our patients is critical to our success as a profession.

Why?• It’s clear that Doctors of Chiropractic and their patients need to take control of the issues that face them every single day.

Having an association-owned IPN ensures that practicing doctors protect the rights of DC’s and their patients. • Other states have been very successful utilizing this model• Our ability to build stronger relationships with the companies that we deal with every day is greatly enhanced with a strong,

unified and large IPN.

How?• Over the last two years, leadership of the MCA and UVCA has been working on researching the most successful

association-owned IPN’s in the country. Hiring the most reputable anti-trust attorney in the country, Mr. John Miles from Ober|Kaler, we’ve now created the legal entity and associated documents, established IPN-provider contracts, met with vendors and network administrators, and hundreds of MCA and UVCA members have already signed letters of intent to join the IPN.

When?• We’ve already carried out district meetings in every single district in Maryland and Virginia. We are now doing our second round

of district meetings to inform doctors of our current progress. It’s imperative to get every single practicing doctor in Maryland and Virginia to attend this next round of meetings. It doesn’t matter if they are members of the MCA /or UVCA or not. They’re colleagues and they need to be informed about how both associations are working to protect DC’s and their patients.

The Legal/Legislative Committee reviews legislation affecting the practice of chiropractors; makes recommendations for statutory or regulatory changes on issues affecting the practice of chiropractic; and acts as the Association’s liaison before the Maryland General Assembly, and other State Legislative bodies. The committee reviews legal issues with Association’s legal counsel.
