EXECUTIVE SUMMARY The applicant is seeking development consent for the upgrading of existing lighting facilities at North Sydney Oval, 283a Miller Street, North Sydney. The proposal will upgrade five (5) light poles with new and additional luminaires and an additional two new light poles are proposed. A total of seven (7) light poles are involved in this proposal. The lights are proposed to have a curfew time of 11.00pm. The light upgrade is required to enable North Sydney Oval to remain competitive with other major sporting venues, with regards to lighting standards for night time television cover. Development Application No. 2015/126 is reported to NSIPP because North Sydney Council is both the applicant and the owner of subject site used for the purposes of a Council recreational facility and the proposed works exceed $250,000 capital cost. Council’ notification of the proposal has attracted no (nil) submissions. The site is listed as a heritage item under the North Sydney LEP 2013. Council’s Conservation Planner has considered the proposal and has advised the proposal will have no adverse impact on the heritage significance of the site. North Sydney Oval buildings and surrounding have also recently been considered by the NSW Office of Environment & Heritage for inclusion as State listed heritage item in conjunction with the surrounding St Leonards Park. Council has been advised that the State Heritage listing is to be confirmed by gazettal on 31 July 2015. The listing is to include specified exemptions for sports field lighting upgrades and other specified works that are included within the St Leonards Park Plan of Management. The development proposal is reasonable in the particular circumstances and is recommended for approval subject to conditions.

DESCRIPTION OF PROPOSAL The proposed development forms part of the capital works program outlined in the North Sydney Oval Business Plan 2014. The objectives of the plan include management and promotion of the property to ensure that North Sydney oval is a first-class venue for major sporting events and also to accommodate the needs and expectations of the North Sydney local community. The aim of the proposal is to upgrade the existing lighting on the sports field to bring the lighting system up to standard for current match play and television broadcasting requirements in respect of cricket, football, and rugby. Four options were assessed but one only preferred option, has been put forward in detail. Option 1; Five (5) existing poles to be upgraded and two (2) new poles to be erected. The existing poles are to have new luminaires. The existing poles will not be increased in height and the new poles will match the height of existing poles. The proposal involves replacing all existing fittings atop the existing five (5) light poles. Additionally two (2) new poles would be erected, each at a height of 28m and fitted with 20 luminaires each. The 2 new poles are to be located in the garden bed behind the Hill Shelter and scoreboard and directly behind the Bob Stand in the concreted section of the Council Depot. The design proposes a total of seven (7) poles. There is no proposed change to the height of existing poles at 28m.

North Sydney Oval is located within St Leonards Park, adjacent to the Warringah Freeway (to the East). St Leonards Park and is south of Falcon Street. The locality comprises a mix of residential apartments and ‘character homes’, mixed use retail, bus service infrastructure, restaurants, cafes, schools, and community facilities including Stanton Library. Directly to the east of the site is ‘The Greens’ (former North Sydney Bowling club) and the Warringah Freeway. To the north of the site is St Leonards Park which abuts Falcon Street. Low to medium density residential development is located on the northern side of Falcon Street. To the West of the site, on the western side of Miller Street, is Marist Catholic Boys College North Shore, St Mary’s Church North Sydney. North Sydney Hotel lies to the North West. The closest residential buildings are located opposite on Miller Street to the west and on Ridge Street to the South of the oval. These consist of medium density 4 - 5 storey apartment developments and 1-2 storey detached dwelling houses and semi-detached dwellings. Further afield to the South of the site is Wenona School.

REFERRALS Heritage Council’s conservation planning Lucinda Varley, provided the following comments: The proposed lighting upgrade is considered to have an acceptable level of impact upon the heritage significance of North Sydney Oval and St Leonard’s Park. The proposal will have the following impacts upon the park’s heritage significance: Social Significance - The proposal will promote the park's social significance as one of

Australia's oldest continuously used cricket grounds in that the lighting upgrade will allow the on-going use of North Sydney Oval for major sporting events. Aesthetic Significance - The two additional proposed towers F and G will be the same height and style to match the existing poles and will be visible in views towards the heritage -significant Ken Irvine Scoreboard and Bob Stand respectively. The lights will be visible in views from within the oval and from a major pathway in St Leonard’s Park. The most significant impact will be the visual impact of proposed pole G adjacent to the Bob Stand as there is little vegetation to obscure its presence. On its merits, however, it is considered to be visually submissive to the Bob Stand and to the park as a whole as it will be tall and very slender with minimal bulk.
Proposed new pole F will be located adjacent to the heritage listed Ken Irvine Scoreboard and will require the removal of existing palm plantings. No objection is raised however, as the dense fig tree canopy and other palm plantings will assist in ameliorating the visual impact of the proposed pole. No objection is raised to the removal of the plantings as they are contemporary, not part of the original Victorian park plan and are easily replaceable Similarly, no objection is raised to the upgrade of the lighting on the existing lighting poles A, B, C, D and E as the existing lighting poles are to be re-used and the impact of the poles on the setting and curtilage of the heritage significant fabric is considered to be low. The upgrade of electrical connections within the existing buildings and within the oval (below ground) are also considered to be acceptable, as the works will have minimal visual impact and will also allow for the continued use of the oval. Historic Significance - No objection is raised to the proposal as the new lighting poles and the upgraded lighting on the existing lighting poles A, B, C, D and E will not detract from the historic use of the park as a recreation area and will allow for its viable usage as a major sporting venue. Rarity - The proposed works will not impact upon the significance of the park being a rare example of an intact Victorian public park.

Representativeness - The proposed lighting will have minimal impact upon the level of integrity as a Victorian park and its degree of intactness. CONCLUSION The proposal is considered to satisfy Clause 5.10 of NSLEP 2013 as the proposed works are considered to be of minor impact to the aesthetic significance of the North Sydney Oval buildings and St Leonard’s Park and are also reversible. The impact to the social significance of the park will be positive as the works will allow for the viable use of the site as a major sporting venue. There will be no adverse impact upon the historic, rarity or representative significance of the individually heritage-listed Ken Irvine Scoreboard, The Bob Stand or St Leonards Park as a whole. The following conditions are recommended: A3 No Demolition of Extra Fabric E4 Removal of Extra Fabric Heritage Fabric C1. Any necessary upgrade to electrical connections within the existing buildings must be
implemented with minimal impact to original heritage fabric of North Sydney Oval. Where the required electrical upgrade works require intrusion to the fabric of any building, details of the require work is to be provided to and approved in writing by Council’s Conservation Planner prior to the issue of the relevant Construction Certificate. The work is to be undertaken to the satisfaction of Council’s Director Open Space & Environmental Services (or his delegated representative).
(Reason: To retain the heritage significance of the site and its buildings) NSW Office of Environment & Heritage North Sydney Oval grandstands, associated buildings, infrastructure and surrounding have recently been considered by the NSW Office of Environment & Heritage for inclusion as State listed heritage item in conjunction with the surrounding St Leonards Park. Council has been advised that the State Heritage listing is to be confirmed by gazettal on 31 July 2015, being a date after submission yet prior to determination of this development application. The listing is to include site specific exemptions for sports field lighting upgrades and other specified works that are included within the relevant Plans of Management. The proposed works are consistent with the nominated site specific exceptions and will be undertaken in accordance with the St Leonards Park Conservation Management Plan, St Leonards Park Plan of Management and North Sydney Oval Plan of Management, to Council’s satisfaction. On the basis that Council remains the relevant authority for determination of the current development, the proposal can be determined on the basis that the works have been considered as appropriate given the heritage status of the site. The owners of adjoining properties and the Stanton Precinct were notified of the proposed development on 15 May 2015. No submissions were received in response to the notification. CONSIDERATION The relevant matters for consideration under Section 79C of the Environmental Planning and Assessment Act 1979 have been assessed in relation to the numerical controls in the NSLEP 2013 and NSDCP 2013, as detailed in the following compliance table. NORTH SYDNEY LEP 2013 Permissibility within the zone: The site is located within RE1 Public Recreation Zone in the NSLEP 2013. The proposal seeks to upgrade existing lighting facilities at North Sydney Oval. The proposed light pole upgrades are development ancillary to an existing recreation area and community facility and as such the proposal is permissible with the consent of the consent authority. Zone Objectives Public Recreation Zone The particular objectives of the Public Recreation Zone RE1 as listed in the Land Use table Zone RE1 Clause 1 of the North Sydney Local Environmental Plan 2013 (NSLEP) are to:
To enable land to be used for public open space or recreational purposes To provide a range of recreational settings and activities and compatible land

To protect and enhance the natural environmental for recreational purposes To ensure sufficient public recreation areas are available for the benefit and use
of residents of, and visitors to, North Sydney. The proposed development is consistent with these objectives, as are relevant. In particular the lighting will augment efficient use of the land for recreational purposes and add to the ability of the facility to be used for the benefit of the community. Building Heights The subject site is not highlighted on the NSLEP 2013 Height of Buildings Map. This notwithstanding there is no change to the existing height of the light poles, this being 28m. The proposed light poles are to match the height of the existing poles. Excavation of Land Minor earthworks are required for installation of the new pole footings and for the provision of new electricity connections (underground). Approximately 100m3 of soil is proposed to be excavated for these purposes. Clause 6.10 of the NSLEP 2013 has been considered as part of this assessment. The earthworks are not likely to cause any disruption to local drainage patterns or to soil stability. The proposed work is generally consistent with Clause 6.10 of the NSLEP 2013.This notwithstanding, comments from the Council engineers is recommended at CC stage in respect of all proposed earthworks. Preservation of Trees and Vegetation The proposed development includes the temporary removal, and subsequent transplanting of some trees and vegetation, therefore Clause 5.9 of the NSLEP applies to the application. The vegetation is required to be transplanted due to the location of proposed Pole F. The trees and vegetation to be moved includes Cocos Palms, Fan Palms and Washingtonia Robusta. It is recommended that the removal, replanting, and/or replacement of all trees be subject to consultation with Council’s Tree Protection Officer or arborist. The proposed replanting of existing park areas adjacent to the base of Pole F must be undertaken to the satisfaction of Council’s Director of Open Space and Environment Services Suspensions of Covenants, agreements and similar instruments The author of this report is unaware of any covenants, agreements or similar instruments that would prevent the proposed development. Heritage Conservation North Sydney Oval is currently listed as a heritage item of local heritage significance, item number I1125, and part of St Leonards Park which is listed as item number I0916, in Schedule 5 of the North Sydney Local Environmental Plan 2013.

The proposed changes are relatively minor with respect to the impact on the heritage significance of the oval. A Statement of Heritage Impact has been prepared (Graham Brooks and Associates), in respect of the proposal. The proposed development is consistent with the objectives of Clause 5.10 of the NSLEP 2013. Council’s conservation planner supports the proposal. Development in Zone RE1 or Zone RE2 This Clause applies to development in RE1 zone and provides that consent must not be given to development on land to which this clause applies unless the consent authority has considered the following:
(a) The need for the proposed development on the land
The proposed development is identified as a ‘primary need’ in the upgrading of North Sydney Oval in accordance with relevant night broadcasting standards. Approval will allow North Sydney Oval to be promoted as a ‘first class venue’ for sporting and community events.
(b) Whether the proposed development is likely to have a detrimental impact on the existing
or likely further use of the land
The proposed lighting upgrade would additionally facilitate the ongoing use of the land for sporting events. The works would not in any way compromise use for the purpose currently accommodated. The land is to be maintained as public open space available for hire by a variety of sporting clubs.
(c) Whether the height and bulk of any proposed building or structure has regard to the
existing vegetation and topography
The development does not propose to alter the height of existing light poles and the proposed light poles are to match those existing. The light poles are not expected to impact existing vegetation and topography (other than as already detailed above).
(d) Whether the proposed development will adversely impact on bushland and remnant
bushland The site is not identified as containing bushland.
(e) Whether the proposed development will adversely impact on stormwater flow The proposed works are unlikely to impact stormwater flow at the site.
(f) In the case of land in Zone RE1 Public Recreation, whether the proposed development will significantly diminish public access to, and use of, the public recreation area
The proposal will have no impact on the use and access to the site by the public. To the contrary, the proposal will facilitate increased access to the site by the public both in a physical context but also via television broadcast.

(3) Development consent must not be granted for development on land to which this clause applies unless the consent authority is satisfied that:
(a) The proposed development is consistent with the objectives of the zone of any adjacent land, and
The development is consistent with the zone objectives of land adjacent.
(b) The proposed development is not likely to result in any adverse impacts on development that is permissible on any adjacent land, and
The proposed development is not expected to cause an increased impact, from that existing, on development on adjacent land.
(c) The proposed development in consistent with the most restrictive development standards
applying to any adjacent land in the following zones in relation to the height of buildings, floor space ratios and setbacks:
The developed results in no change to existing heights, floor space ratios or setbacks as apply to North Sydney Oval. The proposal is also consistent with the objectives of Clause 4.3 Height of Buildings and Clause 4.4 Floor Space Ratio under the NSLEP 2013 as such objectives apply to adjacent land.
SEPP 55 and Contaminated Land Management Issues The subject proposal has been considered as regards relevant provisions in the Contaminated Lands Management Act. The view has been formed that contamination is unlikely given the long standing existing use of the site and other uses in the local area. Further investigation is unnecessary, in our opinion. SREP (Sydney Harbour Catchment) 2005 The subject site is within part of North Sydney that is required to be considered pursuant to SREP (Sydney Harbour Catchment) 2005 (a deemed SEPP). We note that no primary views to the site exist from the Harbour. The proposed development is acceptable as regards the provisions in this Policy. DEVELOPMENT CONTROL PLAN 2013 The application has been assessed against the relevant controls in NSWDCP 2013. Relevant Planning Area (North Sydney) The proposed site is located within the Civic Neighbourhood of the North Sydney Planning area. The proposed development is consistent with the desired future character of the area, encouraging the continued use of community facilities, recreational parks and open spaces by local residents and the wider population. The proposed development is generally consistent with Part C Section 2 of the NSDCP 2013. Waste Management

Waste generated from excavation is to be recycled and soil reused on site where possible. Waste disposal and landfill licensing documentation must be obtained for any waste material that cannot be reused on site. Replacement luminaires are to be recycled where possible. A waste management plan has been provided with the application. The details of the plan must be complied with for the life of the development. The development is generally consistent with Section 19 of the NSDCP. Tree and Vegetation Management The management of trees and vegetation has been addressed above. The proposal is generally compliant with Section 19 of the NSDCP 2013. PLANS OF MANAGEMENT The proposed works are consistent with the St Leonards Park Conservation Management Plan, St Leonards Park Plan of Management and North Sydney Oval Plan of Management, to Council’s satisfaction. SECTION 94 CONTRIBUTIONS There are no Section 94 Contributions payable for the proposed development. APPLICABLE REGULATIONS The following standards/regulations/guidelines are considered to be applicable to the proposed development:

Television 2005 MATERIALS The proposed light pole are proposed to be unpainted hot dip galvanised steel, on buried concrete foundations. Replacement and proposed luminaires are to be Thorn Altis 2kW Metal Halide fitting, unpainted silver. These details are consistent with materials/treatment/typologies for the existing lighting fixtures at North Sydney Oval. ALL LIKELY IMPACTS OF THE DEVELOPMENT All likely impacts of the proposed development have been considered within the context of this report. A Light Spill Study has been prepared by WSP and accompanied the application. This study certifies that the maximum glare rating for the field is 47 and therefore complies with AS2560.2.3 and the OP-31.

Glare The proposed luminous intensity is significantly higher than the permissible light technical parameter in AS 4282: 1987 Control of Obtrusive Effects of Outdoor Lighting. However it is noted that the overall illuminance will be less than the existing luminous intensity of the existing lighting system currently installed at the oval. In this context it is unlikely that nearby residential development will be unreasonably impacted by the upgrading of the lighting facilities. The lighting is only to be operating when required for booked sporting events and the lights are to be switched off by the curfew time of 11.00pm. The recommendations of all consultants’ reports are to be adopted. SUBMITTERS CONCERNS The proposal did not result in lodgement of any submissions. CONCLUSION The development application has been assessed against the North Sydney Local Environmental Plan 2013, the North Sydney Development Control Plan 2013 and the relevant State Policies and generally found to be acceptable. The proposal involves the installation of two (2) new light poles and upgrading of five (5) existing light poles at North Sydney Oval, to bring the oval up to competition night time broadcasting standards. The proposed upgrade does not achieve total compliance with the relevant Australian Standards for Control of Obtrusive Effects of Outdoor Lighting and Guide to Sports Lighting, however it does provide a not insubstantial improved lighting system from that which exists. After a careful examination, the proposed development has been assessed as being acceptable when measured against the provisions of NSLEP 2013, NSDCP 2013, and the North Sydney Character Statement. A recommendation for approval has been made in this instance given the absence of material environmental impacts relative to adjoining properties, consistency with relevant zone and other objectives and the merit of the proposal generally. DIRECTOR’S NOTE North Sydney Oval grandstands, associated buildings, infrastructure and surrounding have recently been considered by the NSW Office of Environment & Heritage for inclusion as State listed heritage item in conjunction with the surrounding St Leonards Park. Council has been advised that the State Heritage listing is to be confirmed by gazettal on 31 July 2015, being a date after submission, yet prior to determination of this development application. The listing is to include site specific exemptions for sports field lighting upgrades and other specified works that are included within the St Leonards Park Plan of Management. The proposed works are consistent with the nominated site specific exceptions and will be undertaken in accordance with the St Leonards Park Conservation Management Plan, St Leonards Park Plan of Management and North Sydney Oval Plan of Management, to Council’s satisfaction. It is for these reasons that NSIPP retains the relevant powers to determine the current application as the relevant Consent Authority. RECOMMENDATION PURSUANT TO SECTION 80 OF ENVIRONMENTAL PLANNING AND ASSESSMENT ACT 1979 (AS AMENDED) THAT North Sydney Independent Planning Panel, under the delegation of the General Manager as the consent authority, grant consent to Development Application No. 126/15 for the upgrade of lighting to North Sydney Oval involving improvement to lighting in respect of five existing poles and the installation of two new poles on land at 238A Miller Street, North Sydney subject to the following conditions:

Where the required electrical upgrade works require intrusion to the fabric of any building, details of the require work is to be provided to and approved in writing by Council’s Conservation Planner prior to the issue of the relevant Construction Certificate. The work is to be undertaken to the satisfaction of Council’s Director Open Space & Environmental Services (or his delegated representative).
(Reason: To retain the heritage significance of the site and its buildings) Compliance with Playing Field Obtrusive Lighting Report A4. The proposed development approved by this consent shall be carried out in strict
compliance with all recommendations stated within the Light Spill Report prepared by WSP Building Pty Ltd Rev 0, dated 30 March 2015 and received by Council on 1 May 2015.

Construction Management Program – Local Traffic Committee Approval
B1. A Construction Management Program prepared by a suitably qualified and experienced traffic consultant must be submitted and approved in writing by North Sydney Traffic Committee PRIOR TO THE ISSUE OF ANY Construction Certificate. Any use of Council property will require appropriate approvals prior to any work commencing. At a minimum, the Construction Management Program must specifically address the following matters:
a) A plan view (min 1:100 scale) of the entire site and frontage roadways
indicating: i. Dedicated temporary construction site driveway entrances and exits,
controlled by a certified traffic controller, to safely manage pedestrians and construction related vehicles in the frontage roadways and footways;
ii. The proposed signage for pedestrian management to comply with the relevant Australian Standards, including pram ramps;

iii. Turning areas within the site for construction and spoil removal vehicles, allowing a forward egress for all construction vehicles on the site;

v. Locations of hoardings proposed; vi. Location of any proposed crane standing areas; vii. A dedicated unloading and loading point within the site for all
construction vehicles, plant and deliveries; viii. Material, plant and spoil bin storage areas within the site, where all
materials are to be dropped off and collected; and ix. The provision of an on-site parking area for employees, tradesperson and
construction vehicles as far as possible.
b) A detailed heavy vehicle access route map through the Council area to Arterial Roads. Provision is to be made to ensure through traffic is maintained at all times.
c) The proposed phases of works on the site, and the expected duration of each
phase.
d) How access to neighbouring properties will be maintained at all times and the proposed manner in which adjoining property owners will be kept advised of the timeframes for completion of each phase of process.
e) The road is not to be used as a waiting area for trucks delivering to or awaiting
pick up of materials.
f) The proposed method of support to any excavation adjacent to adjoining properties, or the road reserve. The proposed method of support is to be designed and certified by an appropriately qualified and practicing structural engineer and must not involve any permanent or temporary encroachment onto Councils property.
g) Proposed protection for Council and adjoining properties. Details are to
include site fencing and the provision of “B” class hoardings over footpaths and laneways.
h) A Waste Management Plan. The Waste Management Plan must include, but
not be limited to, the estimated volume of waste and method of disposal for the construction and operation phases of the development, design of on-site waste storage and recycling area and administrative arrangements for waste and recycling management during the construction process.
All traffic control work and excavation, demolition and construction activities must be undertaken in accordance with the approved Construction Management Program and any conditions attached to the approved Program. A certificate of compliance with this condition must be obtained from Council’s development engineers.

The certificate and the approved Construction Management Program must be submitted as part of the documentation lodged with the application for approval of a construction certificate. A copy of the approved Construction Management Program and any conditions imposed on that Program, must be kept on the site at all times and made available to any officer of Council upon request. Notes: 1) North Sydney Council’s adopted fee for certification of compliance with this
condition shall be payable on lodgement, or in any event, prior to the issue of the relevant approval.
2) Any use of Council property will require appropriate approvals and demonstration of liability insurances prior to such work commencing.
3) Failure to provide complete and detailed information may result in delays. It is recommended that your Construction Management Plan be lodged with Council as early as possible, as a minimum six (6) weeks notice is required to refer items to the Traffic Committee.
4) Dependent on the circumstances of the site, Council may request additional information to that detailed above.
(Reason: To ensure appropriate measures have been considered for site access,
storage and the operation of the site during all phases of the demolition process in a manner that respects adjoining owner’s property rights and residential amenity in the locality, without unreasonable inconvenience to the community)

C4. A dilapidation survey and report (including photographic record) must be prepared by
a suitably qualified consultant which details the pre-developed condition of the existing public infrastructure in the vicinity of the development site. Particular attention must be paid to accurately recording any pre-developed damaged areas so that Council is fully informed when assessing any damage to public infrastructure caused as a result of the development. A copy of the dilapidation survey and report is to be submitted to the Certifying Authority for approval prior to the issue of any Construction Certificate. The developer may be held liable for all damage to public infrastructure in the vicinity of the site, where such damage is not accurately recorded and demonstrated as pre-existing under the requirements of this condition.
The developer shall bear the cost of carrying out works to restore all public infrastructure damaged as a result of the carrying out of the development, and no occupation of the development shall occur until damage caused as a result of the carrying out of the development is rectified. A copy of the dilapidation survey and report must be lodged with North Sydney Council by the Certifying Authority with submission of the Construction Certificate documentation. (Reason: To record the condition of public infrastructure prior to the
commencement of construction) Geotechnical Report C5. A report prepared by an appropriately qualified Geotechnical Engineer certifying that
the existing rock formations and substrate on the site is capable of: a) withstanding the proposed loads to be imposed; b) withstanding the extent of the proposed excavation, including any
recommendations for shoring works that may be required to ensure the stability of the excavation;
c) providing protection and support of adjoining properties; and

d) the provision of appropriate subsoil drainage during and upon completion of construction works

Building plans and specifications submitted for approval with any construction
certificate application must comply with (a), (b), (c) and (d) above and the certified report, including any recommendations made in the said certified report.
The Certifying Authority must ensure that the building plans and specifications
submitted, referenced on and accompanying the issued Construction Certificate, fully satisfy the requirements of this condition.
(Reason: To ensure the structural integrity of the subject site and adjoining sites
during the excavation process) Sediment Control C6. Where construction or excavation activity requires the disturbance of the soil surface
or existing vegetation, erosion and sediment control techniques, as a minimum, are to be in accordance with the publication Managing Urban Stormwater: Soils & Construction (4th edition, Landcom, 2004) commonly referred to as the “Blue Book” or a suitable and effective alternative method. A Sediment Control Plan must be prepared and submitted to the Certifying Authority for approval prior to the issue of any Construction Certificate and prior to any works commencing. The Sediment Control Plan must be consistent with the Blue Book and disclose:
a) All details of drainage to protect and drain the site during the construction
processes; b) All sediment control devices, barriers and the like; c) Sedimentation tanks, ponds or the like; d) Covering materials and methods; and e) A schedule and programme of the sequence of the sediment and erosion
control works or devices to be installed and maintained. f) Methods for the temporary and controlled disposal of stormwater during
construction.

All works must be undertaken in accordance with the approved Sediment Control plan. The Certifying Authority must ensure that the building plans and specifications submitted, referenced on and accompanying the issued Construction Certificate, fully satisfy the requirements of this condition.
(Reason: To protect the environment from the effects of sedimentation and
erosion from development sites) Waste Management Plan C7. A Waste Management Plan is to be submitted for approval by the Certifying Authority
prior to the issue of any Construction Certificate. The plan must include, but not be limited to: -
a) The estimated volume of waste and method of disposal for the construction and
operation phases of the development; b) The design of the on-site waste storage and recycling area; and c) Administrative arrangements for waste and recycling management during the
construction process. The approved Waste Management Plan must be complied with at all times in the
carrying out of the development.
(Reason: To encourage the minimisation of waste and recycling of building waste)
Work Zone C8. If a Work Zone is proposed, an application must be made to the North Sydney Local
Traffic Committee to install the ‘Work Zone’. A Work Zone permit is required to be issued by the Council prior to the issue of any Construction Certificate. Work Zones are provided specifically for the set down and pick up of materials and not for the parking of private vehicles associated with the site. Works Zones will generally not be approved where there is sufficient space on-site for the setting down and picking up of goods being taken to or from a construction site. If the Works Zone is approved by the Committee, the Applicant must obtain a written copy of the related resolution from the North Sydney Local Traffic Committee and submit a copy of this to the Certifying Authority to enable issue of the Construction Certificate.
Where approval of the ‘Work Zone’ is given by the Committee, the requirements of the Committee, including installation of the necessary ‘Work Zone’ signage and payment of any fees, must occur prior to commencement of any works on the site.

Further, at the expiration of the Work Zone approval, the developer is required to remove the Work Zone signs and reinstate any previous signs, all at the developer's cost. The requirements imposed by the Committee on the Work Zone permit (or permits) must be complied with at all times.
(Reason: Amenity and convenience during construction)
Bond for Damage and Completion of Infrastructure Works – Stormwater, Kerb and Gutter, Footpaths, Vehicular Crossing and Road Pavement
C41. Prior to the issue of any Construction Certificate, security deposit or bank guarantee must be provided to Council to the sum of $83,000.00 to be held by Council for the payment of cost for any/all of the following:
a) making good any damage caused to any property of the Council as a consequence of the doing of anything to which this consent relates,
b) completing any public work (such as road work, kerbing and guttering, footway construction, stormwater drainage and environmental controls) required in connection with this consent
c) remedying any defects in any such public work that arise within 6 months after the work is completed.
The security in accordance with the schedule contained later in these conditions and must be provided by way of a deposit with the Council; or a guarantee satisfactory to Council (such as a satisfactory bank guarantee).
The security will be refundable following the expiration of 6 months from the issue of any final Occupation Certificate or completion of public work required to be completed (whichever is the latest) but only upon inspection and release by Council’s Engineers.
Council shall have full authority to make use of the bond for such restoration works as deemed necessary by Council in circumstances including the following: -
• where the damage constitutes a hazard in which case Council may make use of the security immediately;
• the applicant has not repaired or commenced repairing damage within 48 hours of the issue by Council in writing of instructions to undertake such repairs or works;
• works in the public road associated with the development are to an unacceptable quality; and
• the Certifying Authority must ensure that security is provided to North Sydney Council prior to issue of any Construction Certificate.
(Reason: To ensure appropriate security for works on public land and an appropriate quality for new public infrastructure)

Insurance with a minimum cover of $20 million in relation to the occupation of public land and the undertaking of approved works within Council’s road reserve or public land, as approved by this consent. The Policy is to note, and provide protection/full indemnification for North Sydney Council, as an interested party. A copy of the Policy must be submitted to Council prior to commencement of any works. The Policy must be valid for the entire period that the works are being undertaken.
(Note: Applications for hoarding permits, vehicular crossings etc will require
evidence of insurance upon lodgement of the application.)
(Reason: To ensure the community is protected from the cost of any claim for damages arising from works on public land)
Sydney Water Approvals D2. Prior to the commencement of any works, the approved plans must be submitted to a
Sydney Water Quick Check agent or Customer Care Centre to determine whether the development application will affect Sydney Water’s sewer and water mains, stormwater drains and/or easements, and if further requirements need to be met. The approved plans will be appropriately stamped. The Certifying Authority must ensure that a Quick Check agent/Sydney Water has appropriately stamped the plans before the commencement of building works. Note: For Quick Check agent details please refer to “Your Business” section of Sydney Water’s web site at www.sydneywater.com.au then see Building and Renovating under the heading Building and Developing, or telephone 13 20 92. (Reason: To ensure compliance with Sydney Water requirements)
E. During Demolition And Building Work Vegetation Management E1. The removal of any trees or other substantial vegetation is to be approved and
undertaken under the supervision of Council’s Tree Protection Officer, or other suitably qualified consultant Arborist.
(Reason: To ensure compliance with DCP and LEP requirements)

Service adjustments E2. Where required, the adjustment or inclusion of any new utility service facilities must
be carried out by the person acting on the consent and in accordance with the requirements of the relevant utility authority. These works shall be at no cost to Council. It is the Applicants full responsibility to make contact with the relevant utility authorities to ascertain the impacts of the proposal upon utility services at the appropriate stage of the development (including water, phone, gas and the like). Council accepts no responsibility whatsoever for any matter arising from its approval of this application involving any influence upon utility services provided by another authority.
(Reason: To ensure the service requirements are met)
Road Reserve Safety E3. All public footways and roadways fronting and adjacent to the site must be maintained
in a safe condition at all times during the course of the development works, with no obstructions caused to the said footways and roadways. Construction materials and plant must not be stored in the road reserve without approval of Council. A safe pedestrian circulation route and a pavement/route free of trip hazards must be maintained at all times on or adjacent to any public access ways fronting the construction site.
Where public infrastructure is damaged, repair works must be carried out in when and as directed by Council officers (at full Developer cost). Where pedestrian circulation is diverted on to the roadway or verge areas, clear directional signage and protective barricades must be installed in accordance with AS1742-3 (1996) “Traffic Control Devices for Work on Roads”. If pedestrian circulation is not satisfactorily maintained across the site frontage, and action is not taken promptly to rectify the defects, Council may undertake proceedings to stop work.
(Reason: Public Safety)
Removal of Extra Fabric E4. Should any portion of the existing building, trees, or curtilage of the site which is
indicated on the approved plans to be retained be damaged for whatever reason, all the works in the area of the damaged portion are to cease and written notification of the damage is to be given to Council forthwith. No work is to resume until the written approval of Council to do so is obtained. Failure to comply with the provisions of this condition may result in the Council taking further action including legal proceedings if necessary.

Noise and Vibration E5. The works must be undertaken in accordance with the “Interim Construction Noise
Guideline” published by the NSW Environment Protection Authority, to ensure excessive levels of noise and vibration do not occur so as to minimise adverse effects experienced on any adjoining land.
(Reason: To ensure residential amenity is maintained in the immediate vicinity) No Removal of Trees on Public Property E6. No trees on public property (footpaths, roads, reserves, etc.) unless specifically
approved by this consent shall be removed or damaged during construction including for the erection of any fences, hoardings or other temporary works.
(Reason: Protection of existing environmental infrastructure and community
assets) Special Permits E7. Unless otherwise specifically approved in writing by Council, all works, processes,
storage of materials, loading and unloading associated with the development must occur entirely on the property. The developer, owner or builder may apply for specific permits available from Council’s Customer Service Centre for the undermentioned activities on Council’s property. In the event that a permit is granted by Council for the carrying out of works, processes, storage of materials, loading and unloading associated with the development on Council's property, the development must be carried out in accordance with the requirements of the permit. A minimum of forty-eight (48) hours notice is required for any permit: -
1) On-street mobile plant
Eg. cranes, concrete pumps, cherry-pickers, etc. - restrictions apply to the hours of operation, the area of operation, etc. Separate permits are required for each occasion and each piece of equipment. It is the developer's, owner’s and builder’s responsibilities to take whatever steps are necessary to ensure that the use of any equipment does not violate adjoining property owner’s rights.

2) Hoardings
Permits are required to erect Class A and Class B hoardings. If an ‘A’ Class hoarding is to alienate a section of Council’s property, that section will require a permit for the occupation of Council’s property.
(Reason: Proper management of public land)
3) Storage of building materials and building waste containers (skips) on
Council’s property
Permits to utilise Council property for the storage of building materials and building waste containers (skips) are required for each location. Failure to obtain the relevant permits will result in the building materials or building waste containers (skips) being impounded by Council with no additional notice being given. Storage of building materials and waste containers on open space reserves and parks is prohibited.
(Reason: Proper management of public land)
4) Kerbside restrictions, construction zones
Attention is drawn to the existing kerbside restrictions adjacent to the development. Should alteration of existing kerbside restrictions be required, or the provision of a construction zone, the appropriate application must be made and the fee paid to Council. Alternatives to such restrictions may require referral to Council’s Traffic Committee and may take considerable time to be resolved. An earlier application is suggested to avoid delays in construction programs.
(Reason: Proper management of public land)
Construction Hours E8. Building construction and works must be restricted to within the hours of 7.00 am to
5.00 pm Monday to Friday and on Saturday to within the hours of 8.00 am to 1.00 pm inclusive, with no work on Sundays and Public Holidays.
Demolition and excavation works must be restricted to within the hours of 8.00 am to 5.00 pm Monday to Friday only. For the purposes of this condition:
i. “Building construction” means any physical activity on the site involved in the erection of a structure, cladding, external finish, formwork, fixture, fitting of service installation and the unloading of plant, machinery, materials or the like.

ii. “Demolition works” means any physical activity to tear down or break up a structure (or part thereof) or surface, or the like, and includes the loading of demolition waste and the unloading of plant or machinery.
iii. “Excavation work” means the use of any excavation machinery and the use of
jackhammers, rock breakers, excavators, loaders, or the like, regardless of whether the activities disturb or alter the natural state of the existing ground stratum or are breaking up/removing materials from the site and includes the unloading of plant or machinery associated with excavation work.
All builders, excavators must display, on-site, their twenty-four (24) hour contact telephone number, which is to be clearly visible and legible from any public place adjoining the site.
(Reason: To ensure that works do not interfere with reasonable amenity
expectations of residents and the community) Out of Hours Work Permits E9. Where it is necessary for works to occur outside those hours allowed by these
conditions, an application may be made to Council's Customer Services Centre for a permit to carry out works outside of the approved hours. If a permit is issued the works approved must be carried out in accordance with any requirements specified in the permit. Permits will only be approved if public safety is at risk. Applications which seek a variation to construction hours solely to benefit the developer will require the lodgement and favourable determination of a modification application pursuant to the provisions of Section 96 of the Environmental Planning and Assessment Act 1979.
Notes: 1) Failure to obtain a permit for work outside of the approved hours will result in
on the spot fines being issued, or Council pursuing any action required (including legal proceedings) to have the out of hours work cease, without prior warning.
2) Applications for out of hour’s works should be lodged with Council no later than seven (7) calendar days prior to the date of the intended works.
3) Examples of activities for which permits may be granted include; • the erection of awnings, • footpath, road and other infrastructure works which can not be
carried out for public convenience reasons within normal hours, • the erection and removal of hoardings and site cranes, and • craneage of materials which cannot be done for public convenience
reasons within normal working hours. 4) Examples of activities for which permits WILL NOT be granted include;
• extended concrete pours • works which are solely to convenience the developer or client, and

• catch up works required to maintain or catch up with a construction schedule.

(Reason: To ensure that works do not interfere with reasonable amenity
expectations of residents and the community) Installation and Maintenance of Sediment Control E10. Erosion and sediment controls must be installed and maintained at all times in
accordance with the Sediment and erosion control plan submitted and approved with the Construction Certificate. Erosion and sediment measures must be maintained in accordance with the publication Managing Urban Stormwater: Soils & Construction (4th edition, Landcom, 2004), commonly referred to as the “Blue Book” and can only be removed when development activities have been completed and the site fully stabilised.
(Reason: To protect the environment from the effects of sedimentation and
erosion from development sites) Sediment and Erosion Control Signage E11. A durable sign, must be erected during building works in a prominent location on site,
warning of penalties should appropriate erosion and sedimentation control devices not be maintained. A sign of the type referred to in this condition is available from Council.
(Reason: To protect the environment from the effects of sedimentation and
erosion from development sites) Site Amenities and Facilities E12. Where work involved in the erection and demolition of a building is being carried out,
amenities which satisfy applicable occupational health and safety and construction safety regulations, including any WorkCover Authority requirements, must be provided and maintained at all times. The type of work place determines the type of amenities required.

construction safety regulations, including any WorkCover Authority requirements to prepare a health and safety plan. Site fencing must be installed sufficient to exclude the public from the site. Safety signs must be erected that warn the public to keep out of the site, and provide a contact telephone number for enquiries.

(Reason: To ensure the health and safety of the community and workers on the
site) Prohibition on Use of Pavements E14. Building materials must not be placed on Council's footpaths, roadways, parks or
grass verges, (unless a permit is obtained from Council beforehand). A suitable sign to this effect must be erected adjacent to the street alignment.
(Reason: To ensure public safety and amenity on public land)
Plant & Equipment Kept Within Site E15. All plant and equipment used in the undertaking of the development/ works, including
concrete pumps, wagons, lifts, mobile cranes, hoardings etc, must be situated within the boundaries of the site (unless a permit is obtained from Council beforehand) and so placed that all concrete slurry, water, debris and the like must be discharged onto the building site, and is to be contained within the site boundaries.

F. Operational Conditions Imposed Under Ep&A Act And Regulations And Other

must not be commenced until the developer has appointed a Principal Certifying Authority for the building work in accordance with the provisions of the EP&A Act and its Regulations.
(Reason: Statutory; To ensure appropriate safeguarding measures are in place
prior to the commencement of any building work, demolition or excavation)
Construction Certificate F3. Building work, demolition or excavation in accordance with the development consent
must not be commenced until a Construction Certificate for the relevant part of the building work has been issued in accordance with the provisions of the EP&A Act and its Regulations.
(Reason: Statutory; To ensure appropriate safeguarding measures are in place
prior to the commencement of any building work, demolition or excavation)
Occupation Certificate F4. A person must not commence occupation or use of the whole or any part of a new
building (new building
includes an altered portion of, or an extension to, an existing building) unless an Occupation Certificate has been issued in relation to the building or part. Only the Principal Certifying Authority appointed for the building work can issue an Occupation Certificate.
(Reason: Statutory) Critical Stage Inspections F5. Building work must be inspected by the Principal Certifying Authority on the critical
stage occasions prescribed by the EP&A Act and its Regulations, and as directed by the appointed Principal Certifying Authority.

Commencement of Works F6. Building work, demolition or excavation in accordance with this development consent
must not be commenced until the developer has given at least 2 days notice to North Sydney Council of the person’s intention to commence the erection of the building.

Excavation/Demolition F7. 1) All excavations and backfilling associated with the erection or demolition of a
building must be executed safely and in accordance with appropriate professional standards.
2) All excavations associated with the erection or demolition of a building must
be properly guarded and protected to prevent them from being dangerous to life or property.
3) Demolition work must be undertaken in accordance with the provisions of
AS2601- Demolition of Structures.
(Reason: To ensure that work is undertaken in a professional and responsible manner and protect adjoining property and persons from potential damage)
Protection of Public Places F8. 1) A hoarding and site fencing must be erected between the work site and
adjoining public place.
2) If necessary, an awning is to be erected, sufficient to prevent any substance from, or in connection with, the work falling into the public place.
3) The work site must be kept lit between sunset and sunrise if it is likely to be
hazardous to persons in the public place.
4) Any such hoarding, fence or awning is to be removed when the work has been completed.
5) No access across public reserves or parks is permitted.
Note: Prior to the erection of any temporary fence or hoarding over property owned
or managed by Council, written approval must be obtained. Any application needs to be accompanied by plans indicating the type of hoarding and its layout. Fees are assessed and will form part of any approval given. These fees must be paid prior to the approval being given. Approval for hoardings will generally only be given in association with approved building works, maintenance or to ensure protection of the public. An application form for a Hoarding Permit can be downloaded from Council’s website.

c) showing the name, address and telephone number of the Principal
Certifying Authority for the work.
2) Any such sign must be maintained while to building work or demolition work is being carried out, but must be removed when the work has been completed.

G. Prior To The Issue Of An Occupation Certificate Glare and Light Spill
G1. On completion of the installation of the lighting and prior to their full commissioning,
the lights are to be tested to assess if any luminous surfaces are in the field of view of residents. Where luminous surfaces are found to be in the field of view of residents, external shields must be fitted to minimise glare.
Validation of the testing of the lights and any measures implemented are to be provided to Council in writing prior to the issue of the Occupation Certificate.
(Reason: To ensure that lighting is shielded to prevent spill lighting and glare
nuisance to residential properties in the visual catchment of the park) Infrastructure Repair and Completion of Works G2. Prior to the issue of any Occupation Certificate any and all works relating to the
development:
a. in the road reserve must be fully completed; and b. to repair and make good any damaged public infrastructure caused as a result
of any works relating to the development (including damage caused by, but not limited to, delivery vehicles, waste collection, contractors, sub contractors, concrete vehicles) must be fully repaired;
To the satisfaction of Council Engineers at no cost to Council.

1.1 Lighting Design Basis
A lighting design has been carried out in order to replace the existing sub-standard training lights forNorth Sydney Oval. The sports lighting has been designed to meet the following levels of play:
r Professional Competition for Rugby League
r Professional Competition for Rugby Union
r Professional Competition for Soccer
¡ Broadcast level of National Competitions
The proposed upgrade has been designed following Australian Standard 2560.2.3:2002. Guide toSports Lighting Paft2.3 Lighting for Football (All Codes). This recommends an average illuminance of at
least 500 lux maintained for 'Professional Competition' levels.
The proposed lighting has also been designed to achieve the requirements of Free TV AustraliaOperational Practice OP - 31 Lighting Requirements for Colour Television, 2005.
1.2 Description of Proposed lnstallat¡on
The selected floodlight is the Thorn Altis with narrow, medium and wide beam reflectors. These aresymmetrical floodlights designed for controlled sports area lighting where control of light to suit highlevels of completion play broadcast of television is important. The optical system ensures a controlledthrow where required while reducing glare. These are high specification, high performance fittings withprecise control of light distribution to minimise glare, light spill, and upward light. A total of 136 floodlightshave been proposed.
The design has been limited to 70o tilt of the floodlight to meet recommended guidelines to limit glare,
while providing satisfactory lighting of the practice area. Luminaires have been aimed carefully to limit
any additional nuisance to the residential surrounds.
These floodlights use a special 2000W metal halide lamp providing high intensity 'white' light - 5000Kwith good colour rendering. The lamp parameters are suitable for televised sports.
The proposed design employs replacing all existing fittings atop existing poles. Additionally, a total of 2
new poles, each 28m high and fitted with 20 luminiares each will be required.
The proposed poles are GM modular tapered octagonal sheet steel columns on buried concretefoundations. Lamp control gear is internally mounted on the column. Poles will be either unpainted hot
dip galvanised steel or painted a dark colour. Lights will be unpainted silver.

1.3 Lighting Effects
1.3.1 Placement, and design of light fittings
The field area is 75 m x 100 m and to be used for Soccer and Rugby. Cricket lighting suitable for
national broadcast games has been reviewed but not considered for this development. The designproposes 7 poles. The 5 existing poles will be retained in their original locations. The two new poles
will be located in locations as agreed with Council. These are:
1. ln the garden bed immediately behind the Hill Shelter and scoreboard; and
2. Directly behind the Bob Stand in the concrete section of the Council depot.

The floodlights proposed have asymmetric optics for good control of light distribution. The Altis floodlight
has a powerful main beam at 1o elevation from the normal and 0o azimuth. All floodlights will be tilted to
no more than 70o in order to reduce the spill lighting into properties.
1.3.2 lllumination of playing area
Calculations show that the lighting levels on the field, with a maintenance factor of 0.87 have an average
E¡6 of 1600 lux, uniformity U1 (min/avg) of approximalely 70o/o and uniformity Uz (min/max) of 51.0%.
The calculated maximum glare rating forthe field is 47 and complies with 452560.2.3 and the OP-31.
The design will provide lighting of a good standard with sâtisfactory uniformity for the principal playing
area without over lighting.
1.3.3 Light spill
The lighting spill has been assessed against 454282:1997 Control of the Obtrusive effects of outdoor
lighting. References to the light technical parameters quoted within the standard are made through this
report.
The above standard makes the recommendation that the vertical illumination shall not exceed 25lux into
relevant boundaries in boundaries of commercial and residential areas duri

The following exercises were carried out to determine the spill illumination levels on the surrounding
areas:
1. Measure the illuminance (in lux) at propefty boundaries during night with all existing floodlightsswitched off.
2. Measure the illuminance (in lux) at property boundaries during night with all existing floodlightsswitched on.
3. Calculate the illuminance (in lux) at property boundaries with the proposed upgrade lighting.
4. All measurements were carried out using a calibrated lux meter with the meter held at
approximately 1.5m and facing the Oval.
5. All Calculations were carried out using a maintenance factor of 1.
The findings have been consolidated and highlighted as indicated in drawing SYD1445700-8201.
Calculations show that the vertical spill lighting at the property boundaries on all four sides is less than
100 lux. The maximum spills obtained on the property boundaries of the adjacent streets are as follows:
The above numbers indicate the highest values measured or calculated. N/A denotes a definitive value
could not be measured.
Propertres on Rrdge street and Falcon Street have the hrghest level ot shadrng provrded by the trees.
Falcon and Alfred street have significant lighting contributed by the streetlights in the vicinity.
The horizontal spill light on all sides is less than 30 lux on surrounding boundaries. This is slightly
higher than the control limit of 25lux, however, it is significantly lower than the levels produced by the
existing lighting on property boundaries.
The lighting will not be used during the curfew hours covered by clause 13.3.2 (of 454282).
All light spill calculations were carried out with a maintenance factor of 1.0.
1.3.4 Glare
Glare will be controlled by the use of light fìttings with a controlled main beam, mounted at a height of28m above the playing area.
The glare of the proposed installation has been evaluated according to AS 4282 - Control of the
obtrusive effects of outdoor lighting, lable 2.2, Maximum Luminous lntensity per Luminaire for Pre-
Curfew Operating Times.

For the field the controlling dimension is >75m and the size is large.
The maximum allowed luminous intensity in the control direction from each luminaire is 7,500 cd for
Level 1 control. Table 2.2 from the quoted standard states that Level 1 control is appropriate for
environmentally sensitive areas. The controlling dimension is greater than 25m, and therefore the stated
control direction is 7o below the horizontal. This is the comfortable viewing angle for those observing
from a significant distance away.
There are 3 separate optics from the Thorn Altis family proposed for the North Sydney Oval. For the
proposed Thorn Altis R1 optic floodlight with a maximum tilt of 70o, the main beam is limited to 70o from
the normal, i.e.20o below the horizontal. The intensity value from the photometric table for an elevation
of (90-70-7) = 130 is applicable for the Thorn Altis R1 optic.
The luminous intensity in the control direction for the different Thorn Altis floodlights at their proposed
maximum tilts are as follows:
1. Thorn Altis R1 at 70Degs: 76,000cd approximately
2. Thorn Altis R2 at 68Degs: 71,000cd approximately
3. Thorn Altis R3 at 68Degs: 82,000cd approximately
The numbers above are significantly higher than the permissible light technical parameter of 7,500cd
however, it should be noted that this is still an improvement on the existing lighting system currently
installed and operational at the Oval. The luminous intensity in the control direction for the existing Thorn
PRT2000 luminaire is estimated as follows:
4. Existing Thorn Mundial C/PRTs at 75Degs: 85,000 approximately.
1.3.5 Thresholdlncrement
The lighting will not affect road users. The maximum calculated threshold increment for Miller Street is
approximately 5%. A54282-lable2.2 permits a maximum threshold increment of 2Oo/o.
1.3.6 Hours of operation
The lighting will only be operated when required for booked sports events. The control system will allow
users to turn the lights on and off, and will count the number of hours operation, for which the user will be
charged. This provides an incentive to switch the lights off when not required.
ln addition, a time clock will switch the lights off after the curfew time of 11 p.m.
1.3.7 Pole height
The proposed new pole height of 28m is specifically chosen to match the existing pole assemblies. The
heights of the poles are lower than recommendations in Australian Standard 2560.2.3:2002. Guide to
Sports Lighting Part 2.3 Lighting for Football (All Codes).
1.3.8 Night sky viewing
The effect on night sky viewing is minimised, because the luminaire cowls are horizontal.
The amount of light directly emitted above the horizontal, into the night sky will be close to zero. Some
light, say aboul20o/o, is of course unavoidably reflected upwärds from the lit area.
