Greetings,
We are the landlord for Gate of Maple medical Plaza located at 2200 Rutherford RD , Vaughan and have concerns in regards to the notice of application minor variance file number :A268/16 .
We have made decision to purchase the Plaza in Aug , 2012 based on due diligence process that included the factor of analyzing number of other medical buildings and medical clinics existed in the surrounding area. Since then another medical building was erected on Rutherford just 1.5 KM west of Keele st in which we lost 3 major Doctors and blood lab resulting in multiple vacant clinics that have not been occupied for almost one year due to difficulties of finding medical professionals who are willing to relocate from their existing locations.
To permit the use of regulated health professional in EM3 zone which is a cross the street from our building will just increase the competition and will open the door for the applicant and others to apply for such process in which may further negatively affect our rent roll especially when other landlord target my existing tenants with incentives and attractive proposals to convince them to relocate.

Proposed Variances: 1. To permit the use of a Professional Office (Office of a Regulated Health Professional – 2 Practitioners).
By-law Requirements: 1. A Professional Office (Office of a Regulated Health Professional) is not a permitted use.
Official Plan: VOP 2010 designation: “Employment Commercial Mixed-Use” and within a Primary Intensification Corridor in Employment Areas. Office uses are permitted within the designation. The proposal conforms to the Official Plan.
Comments: The Owner is requesting permission for the offices of a Regulated Health Professional Use in the EM3 Retail Warehouse Employment Zone. The office of a Regulated Health Professional is not permitted within an EM3 Zone. The Development Planning Department has no objection to permit a Regulated Health Professional Use (2 practitioners) within Unit 1 of the subject lands. Office Uses are permitted within the Employment Commercial Mixed-Use designation in VOP 2010. Sufficient parking has been provided on the subject lands to accommodate the Regulated Health Professional Use (2 practitioners). The proposal is also consistent with previous approvals in the immediate area. On this basis, the Development Planning Department is of the opinion that the proposal is minor in nature, meets the intent of the Zoning By-law, and is desirable for the appropriate development of the land. Recommendation: The Development Planning Department supports the proposal.

COMMENTS:
PowerStream has received and reviewed the proposed Variance Application. This review, however, does not imply
any approval of the project or plan.
All proposed billboards, signs, and other structures associated with the project or plan must maintain minimum clearances to the existing overhead or underground electrical distribution system as specified by the applicable standards, codes and acts referenced. In the event that construction commences, and the clearance between any component of the work/structure and the adjacent existing overhead and underground electrical distribution system violates the Occupational Health and Safety Act, the customer will be responsible for 100% of the costs associated with PowerStream making the work area safe. All construction work will be required to stop until the safe limits of approach can be established. In the event construction is completed, and the clearance between the constructed structure and the adjacent existing overhead and underground electrical distribution system violates the any of applicable standards, acts or codes referenced, the customer will be responsible for 100% of PowerStream’s cost for any relocation work.
