Bangsa yang mengarah kepada perbaikan dan terjalinnya
perdamaian ant&rbangsa, yang menjadi salah satu tujuan
Perserikatan Bangsa Bangsa. Kalau “Universal Declaration
on Human Rights" bisa dijadikan contoh, maka penerapan
deklarasi ini secara iamgguh-tsungguh akan menghindarkan
kita dari krisis Timur Tengah, krisis Namibia, krisis
Malvinas, serta lain-lain krisi?;. Karena doklarasi ini
sebetulnya menjamin suatu hak danar, y.«iit,u hak penfintuan
nasib sendiri (rights of self-determination).i
Di bidang self-determination, terlihat suatu per-
juangan yang panjang sebelurn Majelis Umum PBB' berhasil
mengukuhkannya sebagai hak semua bangsa. Usaha pertama
Majelis Umum PBB untuk memberikan ketegasan tentang
prinsip self-determination sebagai hak tercantum dalam
resolusi Majelis Umum PBB 637 A (VII) 16 December 1952I
mengenai "The Right of Peoples and Nations to Self-
Determination“. Resolusi Majelis Umum PBB 1514 (XV) 14
Desember 1960 mengenai "Declaration on the Granting of
Independence to Colonial Countries and Peoples" dengan
tegas menyatakan, bahwa prinsip self-determination meru-
pakan hak semua bangsa, dart atas dasar hak inilah kemer
dekaan harus diberikan.

Perumusun semaoarn itu lceinbali dimuat rlalam pasal
I dari resolusi ten tang [Jak-Hak Asasi Manusia, yaitu
resolusi Majelis Urnurn PBB 2;.:00 A (XXI) 16 Desember 1966
t.entang "The Int^rnahi.ona] Covenant on Economic, Social,
and Cultural Rights" dan “The Internationa] Covenant on
Civil and Political Rights”, Resolusi Majelis Umum PBB
2625 (XXV) 24 Oktober 1970 mengenai “The Declaration of
Principles of Internationa] Law Concerning Friendly Re
lation and Cooperation' among States" kembali memuat hak
penent,uan nasib sendiri.
Self-determination biasanya menunjuk kepada ke-
merdekaan (independence), tetapi resolusi Majelis Umum
PBB 1541 (XV) 15 Desember 1960 rnengakui bahwa rakyat
suatu daerah yang belum berpemerintahan sendiri boleh
mernilih "free association or integration with an inde
pendent State" sebagai alternatif dari pelaksanaan self-
determination, di samping "independence". Resolusi ini
mengajukan persyaratan khusus dalam pelaksanaan self-
determination, yakni persyaratan "free and voluntary
choice" dan "democratic processes".
Kepulauan Cocos (Keeling) - suatu “Non-Self-Go
verning Territory" dengan Australia sebagai "adminis
tering power" - telah rnelaksanakan hak penentuan nasib
sendiri pada tanggal 14 April 1984 dalam suatu referen
dum dengan has! 1 mayor i*tas suara (87,7 %) inenyatakari in
tegrasi dengan Australia. Memang kecil peristiwa itu,

begitu pula tempat peri stiwa itu terjadi. Tetapi peris
tiwa i tu pen ting bag i perkembangan hukum internas i o nal,
khususnya hukum kebiasaan international.
Seperti kita ketahui, Majelis Umum PBB hanya ber-
•tugas mftmberi rekomendasi yang tidak mengikat. Resolusi
yang dikeluarkan Majelis Umum PBB bukan merupakan suatu
perjanjian yang mengikat secara hukum pada anggota-ang-
gota PBB. Tetapi, meskipun tidak berwenang meng'el.uarkan
keputusan yang rnengikat, bukan berarti Majelis Umum PBB
tidak rnampu mengembangkan hukum internasional. Salah
satu cara Majelis Umum PBB dalam mengembangkan hukum
internasional adalah melalui praktek negara-negara yang
berpednrnan pada resolusi dan deklarasi. yang dikeluarkan-
nya. Diantaranya merigenai self-determination.
2. Penjelasan Judul
Judul : "Integrasi Kepulauan Cocos (Keeling) de~
ngan Australia Sebagai Salah Satu Alternatif Dari Right
of Self-Determination", telah mencerminkan inti permasa-i
lahannya.
Integrasi merupakan salah satu alternatif dari
hak self-determination yang dapat menentukan status
"full measure of self-government" bagi suatu daerah yang
belum berpemerintahan sendiri. Ketentuan ini tercantum
dalam resolusi Majelis Umum PBB 1541 (XV) 15 Desember
1960.

bangsa atau kelompok rakyat untuk menentukan sendiri
status politiknya serta bebas melaksanakan perkombangan
ekonoiiii, rjosial, dan kebudaya?innya.
3. Alasan Perni 1 ihan J udul
Integrasi Kepulauan Cocos (Keeling) dengan Aus
tralia rnerupakan kasus self-determination yang sangat
menarik di bidang hukum internasional. Sampai saat ini,
masih terdapat perbedaan pendapat tentang self-determi
nation di kalangan ahli hukum internasional. Apakah hak
self-determination rnerupakan hak dalam arti hukum atau
hanya rnerupakan prinsip yang harus dihormati.
Di sarnping itu, Kepulauan Cocos (Keeling) hanya
berupa kumpulan pulau-pulau karang keoil yang luas tanah
seluruhnya hanya sekitar 13 kilometer persegi. Letaknya
pun kira-kira 2680 kilometer dari pantai barat. Austra
lia. Dan penduduknya dibelenggu oleh sejenis perbudakan
di tangtin pernilik pulau itu, keluarga Cl un ies-Rosa.

Penulisan ini, dimaksudkan untuk mengungkapkan
upaya penduduk wuatu "Non-Gelf-Governing Territory" me-
laksanakan hak se 1 f-de t e rmi n a t ion. Dari pengungkapan ini
akan terlihat; jelac, bahwa pelaksan&an hak self-determi
nation banyak bergantung pada peranan dan kemauan "admi
nistering power". Walaupun, seperti kita ketahui, hak
self-determination adalah hak penduduk wilayah yang ber- i
san^kutan, bukan hak "administering power".
Penulisan ini rnerupakan studi kasus yang bersifat
rnenerangkan dengan pendekatan dari segi hukum internasi-
onal Metode yang digunakan bersifat ekletis antara
induksi dan deduksi dengan prosedur pengumpulan data
yang bertumpu pada Gt u d i literatur, dokumen dan majalatr
ilmiah dengan ditunjang doktrin atau ajaran yang relevan

Bab I berupa tinjauan terhadap konsep self-de
termination, sehingga kita ketahui lebih dulu bagairnana
hak self-determination menurut hukum international. Juga
dibahas perkernbangan hak self-determination yang semula
rnerupakan pri noip yang harus dihorrnati, kemudian berkem-
bang menjadi hukum kebianaan internasional (internatio
nal customary law), sebagai pernbuka bagi Bab II yang me-

rupakan tinjauan khusus herhad^p masalah integrasi seba
gai salah satu alternatif d.ari hak self-determination.
Pandangan yang didapat dari Bab II ini adalah
yang semula u&l tf-determina+i on rnendapat pengertian yang
sarna dengan "independence", kernudian berkembang dengan
diberikannya alternatif lain sebagai irnplementasinya,
yaitu "free association or integration with an indepen
dent State or the emergence into any other political
stags''. Pembahasan - Bab II ini merupakan dasar untuk
mernbahas pokok permasalahan skripsi ini, yaitu Bab III.
Di dalam Bab III, akan diuraikan latar belakang
atau sejarah Kepulauan Cocos (Keeling), sehingga dapat
diketahui statusnya sebelum berintegrasi dengan Austra
lia. Setelah mengetahui status suatu daerah, dapat di
ketahui pula apakah penduduk daerah tersebut mempunyai
hak untuk menentukan nasib sendiri.
Berdasarkan hak self-determination tersebut^ akan
ditinjau prosedur dan proses integrasi .Kepulauan Cocos
(Keeling) dengan Australia. Pembahasan akan didasarkan
pada resolusi-resolusi Majelis Umum PBB yang menyangkut
dekolonisasi. Akan dibahas pula apakah integrasi terse
but, sebagai implementasi hak penentuan nasib sendiri
(self-determination), memenuhi syarat-syarat yang diten-
tukan dalarn resolusi-resolusi Majelis Umum PBB yang
bersangkutan. Terutama resolusi-resolusi Majelis Umum
PBB 1514 (XV) 14 Desember 1960, 1541 (XV) 15 Desember

SELF-DETERMINATION DAN PERKEMBANGANNYA
Suatu hal yang tidak dapat diabaikan tentang hak
asasi manusia adalah adanya prinsip penentuan nasib sen-
diri (self-determination). Prinsip self-determination
rnerupakan bag i an yang tidak dapat dipisahkan dari hak
asasi manusia. Rancangan “International Covenants on H u
man Rights" telah mencantumkan ketentuan-ketentuan seba-2
gai berikut :
1. Semua rakyat merniliki hak atas penentuan nasib sendiri. Berdasarkan hak itu mereka bebas menen- tukan status politik mereka dan bebas melaksana- kan perkembangan ekonomi, sosial dan kultural rnereka.
2. Negara-negara anggota konvenan ini, termasuk yang mempunyai tugas memerintah daerah yang tidak berpemerintahan sendiri dan daerah-daerah perwalian, memajukan direalisasikannya hak penentuan naaib sendiri dan penghormatan terahadap hak tersebut, cesuai dengan peraturan-peraturan Per- serikatan Bangsa Bangsa.
Prinsip self-determination rnerupakan proses yang
berkembang secara evolusioner, yang rnerupakan penerapan
tingkah laku yang "auto-determination", misalnya dalam
negara kota Yunani. Perang agama antarsekte Kristen di-
lengkapi dengan hak "self-determination" seperti yang3
tercantum da];nn Perjanji.an Wr-st Pha]ia tahun 1648.

Sejak tahun 1739, prinsip ini, sebagai prinsip
yang diterapkan seoara umum, tel ah rnempunyai tempat
dalam pemikiran demokratis. Di akhir abad ke-XVII, self-
determination rnenjadi isu yang hang at di Eropa ketika
pelbagai kelornpok rakyat berjuang untuk rnendirikan nega-
ra merdeka, dan di benua Ame/rika, Kanada berusaha mele-4

Dalam tahun 1915, Presiden Wilson mengemukakan
gagasan “self-government". Baru pada tahun 1918. Wilson
menggunakan istilah "self-determination", seperti yang
tercantum dalam usul naskah Presiden Wilson untuk5
Konvensi Liga H.mgsa Bangsa pasal III :

Sewaktu Presiden Wilson dirninta untuk inenjelaskan
gagasannya di Konperensi Perdamaian di Paris, dia mene-
rnui kesulitan karena sifat self-determination yang mudah
berubah, seperti dikatakan Michla Pomerance "The Wilso
nian conception of self-determination may, obviously, be
viewed in a myriad of ways, depending on the angle of6
the viewer".
Di saruping adanya perbedaan pendapat tentang pe-
ngertian self-determination, juga terdapat perbedaan
pendapat menegnai penerapah prinsip self-determination.

Negara-negara Sekutu mau menerima sejauh hanya diterap-* ’
kan di negara-negara Jerman, Austro-Hongaria, Turki, dan7
bekas Kerajaan Rusia. Karena banyak yang menentang dan*
meragukan kegunaan gagasan dari Wilson, maka self-d©ter
ra in at ion telah dilupakan dan dikubur sesudah Konperensi,
Perdamaian Paris dan t. idak dimuat dalarri Konvenai. Liga.
Bangsa Bangsa.
Akibat kegagalan di atas, oleh Hitler self-deter
mination dij&dikan dasar untuk menjalankan kebijaksana-*
annya yang ekspansionis dan aneksasionis di tahun 1930-8
an, yang mendorong pecahnya Per;ang Dunia II. *
Setelah berakhirnya Perang Dunia II, dengan di~
tandatanganinya Piagam PBB di San Fransisco tanggal 26
Juni 1945, self-determination dicantumkan dalarn pasal 1
(2) dan pasal 55 Piagam PBB. Tetapi, di dalam kedua
pasal tersebut tidak dijelaskan apa yang dimaksud dengan
self-determination,
Menurut Gleb Starusheriko, self-determination mern-9
punyai dua aspek, yaitu :
1. The international aspect of the .principle of self-determination presupposes the right of a people (or nation) to (a) secede and form an independent-state; (b) secede and joint, another state; and (c) remain in state as a federal, autonomous, etc., member.
2. •James Crawford herpendapat bahwa istilah self-10
determination rnempunyai dua.arti, yaitu :
1. Persamaan kedaulatau negara terutama hak negara untuk mernilih sendiri bentuk pemerintahannya tan- pa ad a uwnpur Imigan.
2. Hak rakyat untuk mernilih sendiri b«snt,tjV. peuier i n - taharmya tanpa mengindahkari keinginan negar* yang munjadikan daerah itu bag:iun dari wi.layahtiya.
Femikiran "self-government" Wilson merupakan cam-
puran kesimpulan yang dapat diistilahkan dengan "inter
nal self-determination", yakni kebebasan untuk mernilih
sendiri bentuk pemerintahannya, dan "external self-de-
termination", yakni hak setiap rakyat untuk mernilih sen
diri kesatuan politiknya dan bebas dari campur tangan11
asing.
Sedang menurut Ian Brownlie, pada umumnya self-12
determination berarti :
,"... the arrangement by a group of individuals of their life together in their own way, and preserving the character of the group. It may be invoked by a whole people as a right to independence, ... or by a religious, ethnic, cultural or linguistic group within the state, as a right to effective representation in the government or to organization as a separate political or social unit
"International Covenant on Civil and Political
Rights” dan "International Covenant on Economic, Social
and Cultural Rights" menetapkan bahwa sernua rakyat rnern-
punyai hak untuk mfenetukan nasib sendiri, oleh karena
itu mereka bebas menentukan atatus pulitik mereka dtrn

mengembahgkan ekonomi, sosial, dan kebudayaan mereka,
serta mengoJah kebudayaan dan sumber alarn mereka.
Dari beberapa pendapat di atas, secara • ringkas
dapat dikatakan bahwa self-determination adalah upaya
suatu bangsa untuk menentukan sernua masalah yang berke-
naan dengan si stem negara tersebut tanpa campur tang an
negara lain.
2. Sel f-Determination Sebatfai Hak
Permasalahan yang sampai kini belurn rnendapat
suatu penyelesaian yang memadai ialah apakah hak self-
determination rnerupakan hak dalam arti hukum atau hanya
rnerupakan suatu prinsip. Ada yang berpendapat bahwa hak
self-determination rnerupakan hak dalam arti hukurn, ada
pula pendapat yang menyatakan bahwa self-determination
rnerupakan prinsip yang harus dihormati.
Xlrnu hukum memandang hak sebagai suatu kekuasaan
berdasarkan hukum atau suatu kewenangan subyek hukum un-
tuk berbuat atau tidak berbuat sesuatu atau untuk menun-
tut dari subyek hukum lain suatu tindakan tertentu.
Dalam konteks hukum internasional, Rudoplh von Xhering
mendefinisikan hak sebagai kepentingan yang terlindung13
secara hukum.
Prinsip adalah asas yang menjadi dasar untuk ber-
piki.r, bertindak, dan sebagainya. Jadi di dalam hak,
subyek hukum dapat menuntut dilaksanakannya hak

tersebut. Sedangkan di dalam prinsip, subyek hukum tidak
dapat menuntut pelaksanaan prinsip tersebut.
Seperti diketahui, Majelis Umum PBB bukan badan
legislatif, sehingga tidak dapat mengeluarkan keputusan14
yang mengikat secara hukum terhadap anggotanya. Walau-
pun demikian, bukan berarti Majelis Urnurn PBB tidak marripu
berperan dalam pembentukan dan pengembangan hukum inter-
nasional, sebagaimanan dikatakan Rosalyn Higgins :
The lack of a legislative competence in the Assembly does not, of course, mean that the Assembly is incapable, through its practice, of contributing to the
I development of customary international law. The resolutions and declarations of international organs, repeated with sufficient frequency and bearing the characteristic of 'opinio juris', can establish a general practice recognised as legal custom.
Jadi agar praktek negara.dan organisasi; interna
sional dapat berkembang menjadi hukum kebiasaan interna
sional harus memenuhi dua unsur, yaitu 'repeated with
sufficient frequency' dan adanya ’opinio juris sive
necessitatis'. Sedangkan Merrie Faye Witkin rnernberikan16
batasan sebagai berikut :
For a principle or practice to develop into a general rule of international law, it must fulfill the requirements of 1) repeated aplication over time; 2) acceptance by a large majority of states; 3) performance with conviction that the practine is binding.
Dari pendapat-pendapat di atas, dapat dikatakan
bahwa agar praktek negara atau organisasi international
berkembang munjadi hukum kebiasaan internasional harus
memenuhi dua unsur, yaitu praktek tersebut harus dilaku-

kan berulangkali dan adanya pendapat yang menerima
praktek tersebut sebagai hukum ('opinio juris sive
necesssitatis’j.
Di dalam situasi yang nyata, memang sulit untuk
menentukan setelah berapa kali atau berapa lama dapat
dikatakan telah terbentuk suatu kebiasaan, karena memang
tidak ada ketentuan yang pasti. Mengenai masalah ini di-
gambarkan oleh Hakim Tanaka dalam kasus Afrika Barat Da-17
ya sebagai berikut : •
In former days, practice, repetition and 'opinio juris sive necessitatis’, which are the ingredients of customary law might be combined together in a very long and slow process extending over centuries. In the communication and information, the formation of a custom through the medium of international organizations is greatly facilitated and accelerated; the establishment of such a custom would require no more than one generation or even far less than t h a t . ..
Sejak berdirinya PBB tahun 1945, self-determina
tion telah dilaksanakan di pelbagai kawasan di dunia.
Sebagai ilustrasi dapat ditampilkan : Maroko, Aljazair,
Tunisia, Zimbabwe (Rhodesia Selatan), Indonesia (Irian
Barat dan Timor Timur), Somalia, Malaysia (Sabah dan
Sarawak)', Burma, Ilongaria, Siprus, Toga, Fiji, Samoa
Barat, Kepulauan Cook, dan baru-baru ini Kepulauan Cocos
(Keeling).
Dari suara yang diberikan pada resolusi Majelis
Umum PBB yang rnenyangkut self-determination, dapat dike-
tahui bahwa rnayoritas negara telah menerima prinsip
self-determination. Misalnya resolusi Majelis Umum PBB

Dili hat secara praktis, sulit menentukan motivasi
tindakan suatu negara. Apakah tindakan tersebut didasar-
kan suatu kewa.iihan hukum atau berdasar alasan politis.
Oleh karen* sal it menentukan motivasi tindakan. suatu19
negarft, Hakim Fitzmaurice berpendapat bahwa :
. . .' it is beleived to be a sound principle that, in the long run, it is only the actions of states that build up practice, just as it is only practice (constant and uniform, as the Court has said) that constitutes a usage or custum, and builds up eventually a. rule of customary international law.
Selanjutnya Kelseri dan Guggenheim mengembangkan
apa yang disebut “single element theory" dalam pemben-20

... State practice is sufficient to priduce a rule of customary law, and. psychological element or 'opinio juris1’ does not also have to be proved to exist ( 'corpus’ without * animus’ ) ... or more precisely that the ’corpus’ of State practice is only required to prove the existence of the 'animus’ ...

demikian, hak self-determination merupakan hak dalam

Istilah integrasi berasal dari kata latir/. “inte-
grare" yang herarti "wenjadikan utuh" (to make whole),
Secara umum, Ensiklopedi Indonesia mengartik&n integrasi
sebagai "penyatuan secara terencana dari bagian-bagian
yang herb&dfi men.iadi suatu kesjatuan yang serasi at.au21
satuan dari tingkatan yang lebih tinggi".
Webster Dictionary rnengartikan integrasi sebagai
"incorporation of diverse groups or individuals into a
well-ordered community or society whose behavior is22
based on similar standards". Sevang menurut Black's
Law Dictionary, integrasi berarti "the act or process of*
making whole or entire. Bringing together different23
groups (as races) as equals".
Dalam bidang ilmu politik terdapat dua pengertian
tentang integrasi., yaitu "The State of cobesian which
e>:ist in a political community as demonstrated by a high
degree of mutual political interaction among the members
of that community based on consent rather than coercion"
dan "the process of asimilating segregated groups into a24
rest of the community".

Dalam pengertian hukum internasional, integrasi
dijurnpai st*oara eksplisit dalam resolusi Majelis Umum
PBB 1541 (XV) 15 December 1960 dan resolusi Majelis Umum
PBB 2625 (XXV) 24 Oktober 1970 yang rnerupakan implemen-
tasi dari pasal 73 Piagarn PBB. Tetapi, di dalam kedua
resolusi tersebut tidak dijf«laskan secara terperinoi apa
yang dimaksud dengan integrasi.
Michael B. Akehurst, dalam menafsirkan arti inte
grasi yang dimuat dalam resolusi Majelis Umum .PBB 1541
(XV) 15 Desember 1960, secara singkat mengatakan "inte
gration means that the territory becomes part of an in-25
dependent State".
Sebagai suatu penafsiran, maka integrasi dalam
hukum internasional berarti salah satu proses pencapaian
status "self-government" dalam rangka pelaksanaan hak
self-determination suatu daerah yang tidak
berpemerintahan sendiri.
2. Integrasi Salah Satu A l t e rxvati£_...5elf-Determination
Salah satu tujuan resolusi Majelis Umum PBB 1514
(XV) 1960 adalah menghapus kolonialisme, yang dianggap
mer^jadi penghalang utama kerja sama internasional, per-
kernbangan ekonomi, sosial, dan budaya rakyat daerah-dae-
rah jajtihan serta ketertiban dan perdarnaian dunia. Reso
lusi Majelis Umum PBB 1514 (XV) 14 December I960 rnenen-26

2. All peoples have the right to self-determination; by virtue of that right they freely determine their political status and freely pursue their economic, social, cultural development.
3. Inadequacy of political, economic, social or educational preparedness should never .serve as a pretext for delaying independence.
4. All armed action or repressive measures of all kind directed againts dependent peoples shall cease in order to enable them to exercise peacefully and freely their right to complete independence, and the integrity of their national territory shall be respected.
5. Immediate steps shall be take, in Trust and Non- .Self-Governing Territories or all otherterritories which have not yet attained independence, to transfer all powers to the peoples of those territories in accordance with their freely expressed will and desire, without any distiction as to rece, creed or clour, in order to enable them to enjoy complete independence and freedom.
Pada waktu perurausan resolusi ini, negara-negara
kolonial (antara lain Inggris, Perancis, Afrika Selatan,
Amerika Serikat, Portugal, dai*i Spanyol) mempertanyakan
apakah rakyat daerah yang bersangkutan secara politis,
ekonomi, sosial dan edukatif siap untuk merdeka. Dengan
adanya ketentOan paragraf 3 di atas, “preparedness" yang
dipertanyakan negara-negara kolonial itu tidak lagi
menjadi hal yang penting. Bahkan ditegaskan dalam
paragraf 5 bahwa kemerdekaan harus segera diberikan ada
atau tidak persiapan untuk itu. Dengan demikian,
berdasarkan resolusi ini, self-determination mendapat
pengertian yang saraa dengan "independence'*, , yang menjadi
alasan mengapa negara-negara kolonial bersikap abstain
dalam resolusi ini.
Dengan dikeluarkannya resolusi Majelis Umum PBB

1541 (XV) 19G0, diberikan altf-rnatif lain sebagai, imple-
meritasi self-determination, yang salah satu diantaranya
adalah integrasi. Jadi untuk mencapai “full measures of
self-government", rakyat daerah yang bersangkutan dapat
rnemilih alternatif yang paling sesuai dengan kehendak
rnereka. Swpanjang pilihan tersebut. adalah .integra^i, re-
solusi Majelis Umum PBB 1541 (XV) 15 Desemher 1960 mene-27
tapkan pula prinsip-prinsip Lain sebagai berikut :
•Principle VII Integration with an independent State should be on the basis of complete equality between the people of the erstwhile Non-Self-Governing Territory and those of th« independent country with which it is integrated. The peoples of both territories should have equal, status and right of citizenship and equal guarantees of fundamental rights and freedom without any distinction or discrimination; both should have equal rightw and oppurtunities for representation and effective at all levels in the executive, legislative and judicial organs of government.
Principle IXIntegration should have corne about in the following circumstances :(a) The integrating territory should have attained
an advanced stage of self-government with free political institution, its peoples would have the capacity to make a responsible choice through informed and democratic processes;
(b) The integration should be the result of the freely expressed wishes, of the territory's peoples acting with full knowledge of the change in their status, their wishes having been expressed through free and voluntary coice and democratic processes impartially conducted and based on univerla adult suffrage. The United N a tions eolud, when it deems it necessary, supervive these processes.

"demooratins process" harus dipenuhi. Perwujudan dua
persyaratari tersebut dapat teraapai apabila terlibat
pihak ketiga yang bertindak sebagai pengamat. Tanpa ke-
terlibatan pihak ketiga sulit untuk menentukan apakah
pelaksanaan hak self-determination itu merupakan basil
"free and voluntary choice" dan "democratic process".
Dalam hal ini, adalah wajar apabila pihak ketiga terse-

Integruui dicantumkan kembali dalam resolusi Ma
jelis TJrnum PBB 2625 (XXV) 24 Oktober 1970 yang antara28
lain menetapkan :
The establishment of a sovereign and independent State, the free association or integration with an independent State or the emergence into any other political status freely determined by a people constitute modes of implementing the right of self- determination by that people.
Perumusan tersebut merupakan pandangan dari suatu
panitia yang dibentuk Majelis Urnum PBB untuk membuat
deklarasi yang akhirnya diterima sebagai resolusi
Majelis Umum PBB 2625 (XXV) 24 Oktober 1970 tentang "The
Declaration of Principles of International Law
Concerning Friendly Relation and Cooperation Among
States"., Panitia berpendapat bahwa perwujudan hak self-
determination harus ditekankan pada kehendak rakyat (the
will of people) yang belum tentu ingin merdeka dan mem-
puny a i. pemerintaban sendiri. Dari pada terlepas
terapung-apung di lautan internasional tanpa adanya

dukungan dan raenempatkan diri dalam suatu* hahaya
dianeksir oleh negara yang lebih kuat beberapa wilayah
tetap ingin berkedudukan sebagai wilayah koloni. Oleh
karena itu, panitia memberikan alternatif sebagai
implementasi hak self-determination dengan “free
assooiation or integration with and independent State or29
the emergence into any political status".
Jadi, hak self-determination yang semula diarti-
kan dengan "independence"., setelah dikeluarkannya reso-
lusi Majelis Tlmurn PBB 1541 (XV) 1960 dan resolusi Maje-
i is Urnurn PBB 2625 (XXV) 1970 dapat berarti "free
association or integration with an independent State or
the emergence into any political status" sebagai i'mple-
mentasinya. Perluasan alternatif ini bisa dirnengerti,
sebab tidak semua wilayah koloni, baik secara demografi
maupun teritorial, mampu berdiri sendiri sebagai negara
merdeka.

Kepulauan Cocos (Keeling) terletak di Samudera
Hindia pada 12 derajab 05 rnenit 3 intang selatan dan 96
derajat 53 rnenit bujur tirnur, kira-kira 2688 kilometer
pantai '‘barat- Australia atau kira-kira 1000 kilometer
barat daya Jakarta.
Kepulauan Cocos (Keeling) terdiri dari 2? pulau5
karang keoil yang terbagi.dalam dua bagian. Di sebelah
utara adalah pul.au tungg&l yang diberi narna North
Keeling dan tidak berpenghuni..Di sebelah selatan, kira-
kira 24 kilometer dari Pulau North Keeling, terdiri dari
sekelompok pulau karang yang mengelilingi sebuah laguna.
Hariya dua pulau yang dihuni, yaitu Pulau West dan Pulau30
Home.
Pulau West dihuni oleh pegawai official Represen
tative Pemerintah Australia, para petugas lapangan ter-
bang, mercusuar, stasiun teleknmunikasi, hostel, dan be-
berapa orang yang bekerja pada perusahaan miriyak Inggris
"SHELL”. Pulau Home dihuni olch keluarga John Clunifts-
Ross dan penduduk keturunan campur-baur Jawa, Melayu,

Sunda, India, Cina, Afrika, dan Eropa yang berkerja di
perkebunan kelapa rnilik keluarga John Clunies-Ross. Luas
tanah seluruh Kepulauan Cocos (Keeling) hanya sekitar 14
kilometer persegi.i
Kepulauan Cocos (Keeling) pertarna kali diketemu-
kan oleh Kapten William Keeling, komaridan kapal "Red
D r a g o n 1' dari East India Company, pada tahun 1609. Kepu-
lauan tersebut•kosong sampai tahun 1826, .ketika Hare
datang rnembawa sekitar 90 budak laki-laki dan perempuan.
Alexander Hare adalah warga negara Inggris yang pada
jaman Raffles dianggap banyak berjasa dalam merebut Jawa
dari Belanda. Pada tahun 1827, datang rombongan kedua
yang dipirnpin oleh Kapten John Clunies-Ross, seorang. pe-
laut Scotlandia, bersarna istri dan 6 orang anaknya, 1231
orang Inggris, seorang Jawa serta seorang Portugis.*
Hare dan Clunies-Ross masing-masing membuka per-
,kebunan kelapa yang menjadi penghasilan utarna kepulauan
Cocos (Keeling) sampai sekarang. Kepulauan itu akhirnya
diberi nama Kepulauan Cocos, Kepulauan Kelapa. Clunies-
Ross dalam waktu-waktu tertentu datang ke Batavia menca-
ri tenaga tambahan untuk * mengurusi kebun k e l a p a n y V
Antara Hare dan Clunies-Ross kemudian terjadi perseli-
sihan mengenai pemilikan Kepulauan Cocos (Keeling). Ba
nyak pekerja Hare yang pindafr bekerja di perkebunan
Clunies-Ross karena tertarik upah yang lebih tinggi dan
kondisi yang lebih baik. Akhirnya pada tahun 1831., Alex-

ander Bare meninggalkan Kepulauan itu menuju Singapura32
dan meninggal di situ.
Pada tahun 1836, Charles Darwin rnengunjungi Kepu
lauan Couos (Keeling), ketika bapak Teori Evolusi itu
sedang mengadakan perjalanan keliling dunia untuk mempe-
lajari terbentuknya kepulauan karang. Charles Darwin
rnenggambarkan para pekerja di perkebunan milik Clunies-
Ross sebagai ‘'nominally in a state of freedom as regards
their personal treatment but in most other point they33
are considered slaves".
Karena takut akan diduduki negara lain, Clunies-
Ross mengajukan permintaan kepada Ratu Inggris supaya
dapat memiliki kepulauan tersebut bersama-sama dengan
Inggris. Tetapi permintaan Clunies-Ross ditolak. Justru
Kepulauan Cocos (Keeling) secara resmi dinyatakan menja
di bagian dari British Dominion oleh Kapten Fremantle di
atas kapal Inggris HMS Juno tanggal 1 Maret 1857. Baru
di akhir bulan Mfci. 1857, Kapten Fremantle menyadari ke-
keli ruannya, karena misi dia seberiarnya menancapkan ben-
dera Inggris di Kepulauan’ Cocos di gugusan Kepulauan
Andaman. Oleh Inggris kepulauan tersebut diserahkan k e
pada Colony of Ceylon pada tahun 1878. Tetapi delapan
tahun kemudian, penguasaan atas Kepulauan Cocos
(Keeling) dipindahkan lagi, kali ini oleh Inggris34
diserahkan kepada Government of the Straits Settlement,

1886, Ratu Victoria menganugerahkan seluruh tanah di Ke
pulauan Cocos (Keeling) kepada ouc-u John Clunies-Ross,
George, dengan syarat antara lain, bahwa Ratu Inggris
berhak menggunak&n tanah-tanah dari kepulauan itu tanpa
sewa untuk kepentingan umum, dan Clunies-Ross dilarang
mengikatkan tanah-tanah tersebut kepada siapa pun, kecu-
ali keluarganya, tanpa adanya persetujuan terlebih dulu
dari Ratu Int'gris. Kepulauan Cocos (Keeling) dipersatu-
kan ke dalam penieri ntahan Settlement of Singapore pada
tahun 1903. Te+.api ketika pada Perang Dunia II Singapura
diduduki tyntara Jepang, penguasaan kepulauan ini dise-35
rahkan lagi kepada Colony of Ceylon.
Sejak William Keeling rnenemukan af.nl knF;ong di
tengah samudera itu, Kepualaun Cocos (Keeling) memang
dianggap sangat strategis, dan selalu digunakan huat pos
samudera kapal-kapal Inggris yang mengarungi autara
Timur Tengah, India, Kepulauan Indonesia, dan Laut Cina
Selatan. Pada awal Perang Dunia I, kapal penjelajah
Jerman "Emden“ menyerang kepulauan itu, tetapi ditengge-
lamkan kapal perang Australia "Sydney". Bulan Maret
1942, di tengah Perang Dunia II., pemborn-pemborn Jepang
menyerang pulau-pulau itu sehingga merusakkan stasiuni
telekomunikasi yang dibangun tahun 1901. Antara tahun
1944-1945, Airfield Construction Squadron dari Angkatan
Udara Australia (RAAF) membangun lapangan terbang di
Pulau West guna menghadapi pembom-pembom Jepang. Setelah

Perang dunia II berakhir, penduduk Pulau Home dirasakani
terlalu padat. Sehingga antara tahun 1948-1951, sekitar
1600 penduduk dipindahkan ke Sabah,. Singapura, dan
Pualau Christmas. Hal ini niengakibatkan penduduk
Kepulauan Cocos (Keeling) tinggal beberapa ratus orang36
saja, sampai rjekarang.
Dengan suatu persetujuan tanggal 2 Nopember 1951
Pemerintah Australia membeli tanah yang dipakai untuk
lapangan terbang di Pulau West dari Clunies-Ross. Sejak
tanggal 1 September 1952, lapangan terbang tersebut d i
pakai sebagai persinggahan (stop over) penerbangan ko-
mersial Australia dari Sydney ke Johannesburg.
Pada t£inggal 23 Nopember 1955, Kepulauan Cocos
(Keeling) oleh pemerintah Inggris diserahkan kepada Pe
merintah • Australia yang kemudian diberi status sebagai
teritory dengan nam* resmi Territory of Cocos (Keeling)
Islands. Penyerahan ini dilakukari dengan sufttu Rri-t.ish
Order in Council yang dibuat oleh Ratu Elisabeth II ber-
dasarkan Cocos (Keeling) Islands Act 1955 of the United
Kingdom dan Commonwealth of Australian Cocos (Keeling)37
Islands Act 1955.
2. Progedur dan Proses Integrasi
Keadaan Kepulauan Cocos (Keeling) tidak banyak
diketahui orang sampai tahun 1957, ketika Hasluck,
sebagai Menteri External Territories Australia, rnengun-

jungi kepulauan itu tanggal 12 - 17 Januari 1957.
Hasluck rnelaporkan, penduduk kepulauan tersebut
dibelenggu oleh sejenis perbugjakan di tangan keluarga
Clunies-Ross yang memerintah dengan gaya feodal. Rumah,
pakaian dan perawatan kesehatan seadanya mernang diberi-
kan secara cuma-cuma. Pendidikan pun diberikan secarat
cuma-cuma, tetapi hanya sekedar bisa baca perintah dan
tugas sehari-hari. Sejak umur 15 tahun, para penduduk
diharuskan bekerja di perkebunan kelapa railik keluarga
Clunies-Ross. Upah para pekerja dibayarkan dalam bentuk
keping-kepi.Mg plastik yang dibubuhi tandatangan Tuan
John, panggilan warga setempat kepada John Clunies-Ross.
Semua warga Pulau Home dilarang mengunjungi Pulau West
tanpa ijin dari Tuan John. Menurut Hasluck, Clunios-Ross
tidak mengakui kekuasaan Australia di seluruh kepulauan
itu, terutama di tanah perkebunannya. Dia merasa mewari-
si kepulauan itu, yang diberikan kepada keluarga nenek
moyangnya oleh Ratu Victoria pada tahun 1886. Dia hanya
mau berhubungan dan berurusan dengan Ratu Inggris.
Hasluck mencoba menjelaskan tentang penyerahan kepulauan
tersebut dengan mengatakan bahwa Kepulauan Cocos
(Keeling) tetap berada di bawah kekuasaan Ratu Inggris,
tetapi kalau dulu pengelolaan dan pengawasannya dilaku-
kan oleh Pemerintah Inggris, sekarang dilakukan oleh
Pemerintah Australia. Jika dia atau penduduk lain rnentfi-
rirnkan surat kepada Ratu Inggris mengenai masalah

Kepulauan Cocos (Keeling), rnaka Ratu Inggris akan menye-
rahkan surat mereka kepada Gubernur Jendral Australia
untuk dibahas. Clunies-Ross menganggap hal tersebut di
atas hanyalah rekaan Pemerintah Australia >dalam upaya
mengambil-alih self-government atas kepulauan tersebuti
dari tangan penduduk setempat.
Walaupun ditegaskan bahwa Pemerintah Australia
akan tetap menjamin semua hak miliknya, Clunies-Ross
tetap tidak mau rnengakui kekuasaan Australia dan tetap
mempertfthankan cara-cara yang feodalistis dalam berhubu-
ngan dengan penduduk. Menurut pengamatan Hasluck, ada
suatu ambisi dan kepentingan pribadi sehingga Clunies-
Ross tidak mau rnengakui kekuasaan Australia. Karena,
dalam pandangan Clunies-Ross, tanpa cara-cara yang feo
dalistis akan sulit mengusahakan perkebunan dan memper-39
tahankan kekuasaannya.
Kunjungan Hasluck tidak merubah keadaan Kepulau
an Cocos (Keeling) dan Pemerintah Australia pun tidak
berusaha merubah1 status quo kepulauan itu. Padahal Aus
tralia sebagai "administering power", berdasarkan pasal
73 Piagam PBB, berkewajiban memberikan laporan kepada
Sekretariat Jendral PBB mengenai perkembangan wilayah
yang bersangkutan serta memajukan kehidupan politik,
ekonomi, sosial dan pendidikan penduduknya. Tetapi "The
reports have been'utterly misleading and only New York's
pre-occupation can explain why they escaped detection

and censure".^
Pada bu'Jan Juni dan Desember 1958, 109 penduduk
Pulau Home beremigrasi ke Pulau Christmas. Beberapa saat
kemudian, sebagian besar dari penduduk yang beremigrasi
tersebut pitid*h ke Australia.
Kftpulauan Cocos (Keeling) kembali menarik perha-
tian banyak orang ketika A.G. Kerr, pejabat senior dari
Departemen External Territories, mengunjungi dan meng-
ungkapkan keadaan yang dijumpainya di sana pada bulan
November 1971. Dalam laporannya kepada Andrew J’eacock,
waktu itu Menteri External Territories, antara lain di-
sebutkan bahwa kehidupan penduduknya tidak berubah sejak
kunjungan Has luck tahun 1957. Penduduk yang keturunan
campur-baur itu tetap miskin, buta huruf, dan terkung-41
kung tidak bisa ke mana-mana. Menurut pendapat pendu-
duk setempat, dunia ini dibagi menjadi dua bagian, yaitu42
Pulu dan Negeri. Pulu atau pulau adalah kepulauan tern-
pat mereka tinggal. Negeri adalah bagian dunia lain di
luar tempat tinggal mereka.
Dalam laporan itu juga disinggung masalah upah
pekerja yang hanya kira-kira 2 dollar Australia seming-
gu, itu pun masih tetap dibayarkan dalam bentuk keping-
keping plastik. fJpah sebesar itu hanya laku ditukarkan
dengan beras, gula atau kebutuhan kecil-kecil di toko
milik keluarga Clunies-Ross. Setiap kejahatan terhadap
perkebunan maupun terhadap masyarakat, rnisalnya rnerusak

sarana perkebunan atau mencuri, dijatuhi hukuman yang
ditentukan Clunies-Ross sendiri. Hukuman tersebut rnisal-
nya “bekerja selama dua minggu tanpa upah" atau "menguro-
pulkan sejenis kumbang, yang menjadi harna kelapa, sela-43
ma seminggu tanpa menerima upah". Jadi ClunieH-Rnss
selalu mendapat keuntungan dari setiap kejahatan yang
terjadi.
Di akhir laporannya, A.G. Kerr rnenyatakan bahwa
secara keseluruhan penduduk Kepulauan Cocos (Keeling)
merupakan budak keluarga Clunies-Ross. Memang dibentuk
eemacam dewan pemerintahan bagi penduduk setempat, teta
pi semua anggota dipilih dan diketuai oleh Clunies-Ross
sendiri. Clunies-Ross juga menolak hukum Australia di- |
berlakukan di kepulauan itu, karena hal itu dianggapnya
sebagai intervensi terhadap persoalan intern warga Kepu-44
lauari Cocos (Keeling).
Dalam bulan Januari 1972, Clunies-Ross mengirim
surat kepada Sekretaris External Territories dengan mak-
sud minta pengakuan self-governing atas Kepulauan Cocos
(Keeling) serta mengusulkan dibentuk hubungan seperti
Kepulauan Cook dengan Selandia Baru (free association)
antara Kepulauan Cocos (Keeling) dengan Australia.
Selain kedua hal tersebut di atas, Clunies-Ross
rnenyatakan h&iiwa tuntutan Australia atas Kepulauan Cocos
.(Keeling) tidak didasarkan alasan yang kuat. Secara geo-i
grafis, kepuaJauan itu tidak termasuk wilayah negara ma -

na pun. Secara historis, ketika diketemukan nenek moyang
Clunies-Ross kepulauan itu kosong (tidak berpenghuni).
Pada waktu itu, nenek moyar/g Clunies-Ross tidak dibiayai
atau didukung oleh suatu negara, tetapi rnerupakan petua-
langan pribadi. Tigapuluh tahun kemudian, Inggris meng-
aneksir kepulauan itu, yang kemudian terbukti adanya ke-
keliruan karena yang dimaksudkan sebenarnya adalah Kepu
lauan Cocos di gugusan Kepulauan Andaman. Jadi, menurut
pendapat Clunies-Ross, kekuasaan Australia didasarkan
atas aneksasi Pemerintah Inggris. Di masa kini, dasar
yang dapat diterima adalah perundingan yang bebas (free
ly negotiated) antara pihak-pihak yang bersangkutan.
Setelah menggambarkan keadaan Kepulauan Gocos
(Keeling) yang aman, teratur, self-government, mengem-
bangkan sistem sosial yang sesuai dengan kebutuhan dan!
keadaan penduduk, surat Clunies-Ross diakhiri dengan me-
nyatakan bahwa yang dibutuhkan penduduk adalah pengakuan45
self-government, bukan intervensi dari Australia.
Andrew Peacock mengunjungi Kepulauan Cocos
(Keeling) pada bulan September 1972, yang kemudian meng-
hasilkan dua kesepakatan antara Pemerintah Australia
dengan Clunifts-Ross. Pertama, Clunies-Ross rnengakuj k e
kuasaan Australia atas Kepulauan Cocos (Keeling) dengan
syarat Pemerintah Australia menjamin serta mengbormati
hak milik Clunies-Ross. Kedua, guru-guru Australia boleh
mengajar penduduk Pulau Home dengan syarat Clunies-Ross

sendiri yang wewawancarai dan mernilih calon guru yang
lulus di Perth dan guru-guru tersebut beserta keluarga-46
nya tidak boleh tinggal di Pulau Home.
Suatu delegasi (Visiting Mission) dari Komi be 24
PBB (Komite Dekolonisasi) mengunjungi Kepulauan Cocos
(Keeling) pada tanggal 7 - 1 0 Agustus 1974. Delegasi
tersebut dipimpin oleh Koume dari Pantai Gading . dengan
anggota wakil dari Trinidad dan Tobago dan Indonesia.
Delegasi PBB itu mengecam Pemerintah Australia setelah
melihat kepi noctngan-kepincangan yang terjadi. Mengapa
Australia mentolerir pembayaran upah pekerja dengan
keping-keping plastik. Mengapa upah pekerja dibayarkan
kepada Clunies-Ross apabila pekerja tersebut dipekerja-
kan, misalnya, di lapangan terbang milik Australia di
Pulau West. Seharusnya pegawai Official Representative
dipilih yang mengerti Bahasa Melayu, sehingga dapat me-47
ngetahui keinginan penduduk yang sebenarnya. Pendidik-
an yang diberikan kepada penduduk pun dinilai sangat
rendah, meskipun ada beberapa guru Australia yang membe-V .
rikan pelajaran.
Menurut pengamatan anggota dari Indonesia, Moham
mad Siddik, rendahnya pendidikan berpengaruh pula dalam48
kehidupan beragama. Antara lain dikatakan :
”... the chief priest finds difficult to get the people to pay attention... to Mohammedan, laws and religion... this clearly the result of lack education. In fact the Cocos Islanders makes seem to visit the Mosque only during Ramadhan - the fasting month"

Kenyataan tersebut menunjukkan bahwa Pemerintah
Australia tidak sungguh-sungguh dalam menjalankan fung-
sinya sebagai "administering power". Hal ini berkaitan
dengan kepentingan Australia di kepulauan tersebut, yang
tentu saja tidak ingin terganggu apabila dilakukan peru-
bahan-perubaha sesuai dengan pasal 73 Piagarn PBB. Secara
ekonomis, Kepulauan Cocos (Keeling) meiaang tidak ada ar-
tinya bagi Australia. Tetapi, dari segi geostrategic sa-
ngat penting arti’nya bagi Australia dan sekutu-
sekulunya, terutama AS dan Inggris. Kepulauan Cocos
(Keeling) dipergunakan sebagai pos pengarnatan Samudera
Hindia dalam watu jaringan denga pangkalan mi liter AS di
Kepulauan Diego Garnia.
Di dalam laporannya, delegasi PBB mendesak Peme-
rantah Australia agar segera melaksanakan perubahan-pe-
rubahan sesuai pasal 73 Piagarn PBB. Mengingat pengetahu-
an penduduk yang masih rendah, dianjurkan supaya
tindakan-tindakan yang akan diambil tidak dilaksanakan
dengan tergesa-gesa, tetapi juga tidak selambat-lambat49
tahun sebelurnnya.
Dengan adanya tekanan dari PBB, Pemerintah Austa-
lia mendesak Clunies-Ross melakukan perubahan-perubahan ;
yang diperlukan. Sesuai 'anjuran PBB, pelaksanaannya di-
lakukan secara bertahap. Upah para pekerja disesuaikan
dengan peraturan perundangan yang berlaku di Australia
dan dibayar dengan mata uang Australia, tidak dengan ke-

ping-kepirig plastik. Gury-guru Australia beserta keluar-
ganya diijinkan tinggal di Pulau Horne. Hubungan antara
Pulau Horne dengan Pulau West diperlancar dengan adanya
kapal-kapal kecil yang dioperasikan oleh Pemerintah
Australia. Sebelumnya angkutan kapal dioperasikan oleh
keluarga Clunies-Ross.
Pada tahun-tahun berikutnya, Pemerintah Australia
berusaha melepaskan ketergantunan penduduk kepada kelu
arga Clunies-Ross. Salah satunya adalah membeli sebagian
besiar tanah-tanah dari Clunies-Ross, keouali tanah milik
keluarga Clunies-Ross seluas enam hektar beserta . rumah
dan seg&la miliknya di atas tanah tersebut, tahun 1978.
Pengelolaan tanah-tanah itu kemudian diserahkan kepada
penduduk Cocos setelah dibentuk The Cocos Islands Co
operative Society pada bulan Januari 1979. Pada bulan
Juli 1979, dibentuk dewan pemerint&han bagi warga Cocos
yang disebut The Cocos (Keeling) Islands Council. Tugas
dewan tersebut antara lain memberikan pertimbangan' kepa
da "administering power" rnengenai semua masalah yang50
menyangkut kepentingan penduduk setempat.
Delegasi dari Komite 24 PBB kembali mengunjungi
Kepulauan Cocos (Keeling) pada bulan Juli 1980. Delegasi
yang dipimpin oleh K. Yere dari Pantai Gading itu antara
lain melaporkan, telah banyak perkembangan yang dicapai
sejak kunjungan delegasi pertama tahun 1974 terutama di
bidang sosio-ekonorni. Delegasi PBB mendesak Pemerintah

Australia untuk rneningkatkan pengernbangan bidang poli-
tik dan pendidikan sampai penduduk seternpat siap me'lak-
sanakan hak self-determination.
Menteri Dalam Negeri Australia, Tom McVeigh, me-
ngunjungi Kepulauan Cocos (Keeling) bulan November 1932
guna ! memlm-arukan kereungkinan di 1 aksanakarmya self-de-
termintion. Setel&h bertemu dengan The Cocos (Keeling)
Is! and« CouiK-i 1 , disepakati bahwa self-determination di-
lak.stmakan tahun 19133. Tetapi, karena pada bulan Maret

Untuk menjelaskan kepada penduduk Cocos mengenai
ketiga alternatif dari self-determination, pada bulan
Oktober 1903 di’keluarkan ketentuan yang disebut "The act
of Self-D^terrnination Options” (teks selengkapnya lihat
Lampirnn IT). Dalam ketent.uan tersebut dijelaskan ketiga
alternatif senuai resolusi Majelis Umum PBB 1541 (XV) 15
December 1900, yaitu M independence*, free association or
integration“ dengan segala konsekuensinya.

Menteri Luar Megeri Australia, Bill Hayden, memberitahu-
kan bahwa penduduk Kepulauan Cocos (Keeling) telah siap

Sekretaris Jendral PBB, mengundang delegasi dari Kornite
24 PBB untuk merundingkan persyaratan dan waktu pelaksa-
naan hak self-determination septa sekaligus mengawasi52
pelaksanaannya.
Pada wiclang tanggal 7 December 1983, Majelis Umum
PBB memutuskan (38/420), menunjuk Sekretaris Jendral PBB
untuk menentukan dan mengirimkan delegasi guna mengawasi
pelaksanaan self-determination sesuai dengan resolusi
Majelis Umum PBB 1541 (XV) 15 Desember 1960. Kepada
“administering power'1 dan penduduk setempat diharapkan
segera menetapkan ketentuan pelaksanaan self-determina
tion.
I Pada tanggal 14 Maret 1984, dikeluarkan ketentu
an pelaksanaan self-determination yang disebut "Referen
dum (Self-Determination) Ordinance 1984" (teks seleng-
kapnya lihat Larnpiran III). Dalam pasal 4 (1); ordonansi
tersebut ditetapkan bahwa referendum akan • dilaksankan
pada tanggal 6 April 1984. Berdasarkan resolusi Majelis
Umurn PBB 637 A (VII) 1952, self-determination dapat di-
laksanakan dengan plebisit atau cara-cara dernokratis
lain.

Cocob (Keeling) pada tanggal 3 April 1984 untuk melihat
persiapan referendum sekal igus rnengawasi pe]aksanaannya.
Delegasi tersebut dipimpin sendiri oleh Ketua Komite 24
PBB, AbduJ Koroma dari Sierra Leone, dengan anggota Ra-
drodro (Fiji), Nebojsa Dirnitrijevic (Yugoslavia), Maria53
Eugenia Trujillo (Venezuela).
Menurut pengarnatan delegasi PBB, v/alaupun pendu
duk mengerti arti ketiga alternatif yang ditawarkau, te
tapi mereka tidak Tnemahami konsekuensinya. Berulang kali
hal ini ditanyakan dan penduduk mlnta saran apa yang se-
baiknya dipilih. Sesuai dengan kedudukannya, delegasi
PBB menjelaskan konsekuensi pilihan mereka dan menegas-
kan bahwa mereka sendiri yang harus menentukan pilihan
tersebut tanpa pengaruh siapa pun. Sejak lama Clunies-
Ross berusaha mempengaruhi penduduk agar mernilih "free
association".
Dari 261 pemilih yang terdaftar, sernua rnernberikan
suara dalam referendum tanggal 6 April 1984. Dari sesuai
pasal 22 Referendum (Self-Determination) Ordinance 1984,
basil pemungutan suara diumumkan pada tanggal 7 April54
1984 sebagai berikut :

Dengan demikian, mayoritas suara (87,7 %) menghendaki

integrasi dengan Australia. Pada tanggal S April 1984,
delegasi PBB rneninggalkan Kepulauan Cocos (Keeling) ber-
sama ernpat wakil penduduk Cocos untuk membioarakan sernua
konsekuensi dari pilihan mereka dengan Australia.
Di dalarn laporannya, delegasi PBB antara lain me-
nyatakan, bahwa pemungutan suara dilaksanakari dengan wa-
jar dan tidak melihat adanya usaha dari Australia untuk
meinaksa penduduk memilih integrasi. Seianjutnya dikata
kan, ditinjau dari latar belakang dan tingkat kedewasaan
politik penduduk, delegasi PBB berpendapat bahwa yeoara
uniurn penduduk mengerti arti ketiga alternatif yang diso-
dorkan ke hadapan mereka.
Dengan demikian, secara keseluruhan pelaksanaan
self-determination tersebut memenuhi persy&rat&n yang
ditentukan dalam prinsip IX resolusi Majelis Umum PBB
1541 (XV) 15 Desember 19G0, yaitu "free and voluntary
choice'' dan "democratic processes" serta dilaksanakan di
bawah supervisi atau perjgawasan PBB.
Pada sidang ke 39 tanggal 5 Desember 1985, hasil
referendum Kepulauan Cocos (Keeling) diterima Majelis
Umurn PBB dalarn resolusi nomor 39/30 (teks selengkapnya
lihat Larnpiran IV). Sebelumnya, pada sidang Komite keem-
pat Majelis Umum PBB tanggal 7 November 1984, Parson bin
Yapat, Ketua Cocos (Keeling) Islands Council, antaraP,v* U

1. Kesimpu i.an
Salah satu penghambat proses perkembangan prinsip
self-determination adalah sifatnya yang mudah berubah.
Tafsir tentang prinsip self-determination bisa berbeda
antara pihak yang satu dengan yang lain, tergantung
sudut pandang si penafsir. Akibatnya, tidak ada kesepa-
katan mengenai pengertian prinsip self-determination
serta penerapannya. Sehingga prinsip self-determination
tidak dioantumkan dalam konvftnsi Liga Bangsa Bangsa.
Prinsip self-determination mengalami perkembangan
yang pesat setelah dicantumkan dalam Piagam PBB, yaitu
dalam pasal 1 (2) dan pasal 55. Lebih-lebih setelah
negara-negara Afro-Asia yang baru merdeka diterima men-
jadi anggota PBB. Sehingga menciptakan mayoritas baru
dalam Majelis Umum PBB, yang biasa disebut "Mayoritas
Dunia Ketiga dalam Majelis Umum". Denman dikuasainya
forum Majelis Umum PBB oleh negara-negara Dunia Ketiga,
Majelis Umum PBB berhasil mengeluarkan resolusi tentang
hak self-determination, yaitu resolusi 1514 (XV) 14
Desember 1960. Dengan semakin banyaknya pelaksanaan hak
self-determination berdasarkan resolusi tersebut di

atas (lihat halaman 14), hak se3 f-determination berkern-
bang menjadi hukum kebiasaan international. Dengan demi-
kian, hak self-determination adalah hak dalam arti hu
kum.
Dalam resolusi Majelis Umum PBB 1514 (XV) I960,
self-determination diartikan dengan “independence"/ yang
menyebabkan negara-negara kolonial bersikap abstain.
Dengan dikeluarkannya resolusi Majelis Umum PBB 1541
(XV) 15 Pesember 1960 dan resolusi Majelis Umum PBB 2625
(XXV) 1970, diberikan alternatif lain sebagai implemen-
tasinya, yaitu “free association or integration with an
independent State". Vang menjadi pertimbangan diberikan-
nya alternatif tersebut di atas adalah, tidak semua
wilayah yang belum merdeka raampu berdiri sendiri sebagai
negara merdeka. Hal tersebut bisa dikarenakan faktor
ekonomi* demografi, maupun teritorial, seperti halnya
warga Kepulauan Cocos (Keeling) yang mernilih integrasi
dengan Australia.
Ditinjau dari kondisi Kepulauan Cocos (Keeling),
satu-satunya pilihan yang dapat dilaksanakan adalah
integrasi. Dari segi ekonomi, karena kecilnya wilayah
dan tiadanya sumberdaya alam, untuk mencukupi kebutuhan
warganya akan bergantung pada bantuan Australia,
Clunies-Ross atau pihak lain. :Dari segi geopolitik,
Kepulauan Cocos (Keeling) akan menjadi ajang perebutan
pengaruh negara lain mengingat pnyisinya yang yangat

strategis. .Jadi, pilihan "Independence" dalam arti "na
tional sovereignty" akan'berarti penundukan d i r i : pada
salah satu negara dengan konsekuensinya yang akan jauh
uteny intpang dari kemerdekaan yang diinginkan serf,a rne-
ngingkari arti kemerdekaan itu sendiri.
Pilihan "free association" jelas akan memberikan
peluang b a g i Cluni es-Ross untuk kembali melaksanakan
cara-oara yang feodalistis terhadap penduduk aoternpat.;
Justru kondisi ini yang ingin dicegah dengan pelsksanaan
hak self-determination.
Agar tidak menimbulkan perbedaan penafsiran dan
untuk menjamin kepastian hukumnya, perlu diadakan kon-
vensi tentang hak self-determination, sebagaimana h&lnya
hukum diplomatik maupu'n hukum laut. Dalam konvensi^ter
sebut bisa pula dimasukkan prinsip-prinsip lain, misal-
nya prinsip nondiskriminasi.
Osaha dekolonisasi bukanlah penoapai&n status
politik sem&ta-mata, tetapi menyangkut pula pengembangan
aspek ekonomi, sosial, dan budaya penduduk yang *ber-
.sangkulan. Oleh karena itu, bagi Pemerintah Australia
yang penting adalah membangun kehidupan yang layak bagi
warga Kepulauan Cocos (Keeling) yang dapat ,menjamin
teratas inya k et e r be 1 akan g a n dan keterg ant.ung an • yang
telah tereipta selama ini.

An Ordinance relating to the conduct of a referendum
PAR T I— PRELIMINARY
Short title
1. This Ordinance may be cited as the Referendum (Self- determination) Ordinance 1984.'
Interpretation
2. In this Ordinance, unless the contrary intention appears
“absent vote” means a vote cast at a mobile polling station by an elector referred to in sub-section 16 (1);
“elector” means a person whose name is on the roll;
“Gazette” means the Government Gazette of the Territory;
“Committee of Appeal” means the Committee constituted under sub-section 8(1);

“referendum” means the referendum conducted for the purposes of this Ordinance;
“referendum day” means 6 April 1984;
“the roll” means the electoral roll prepared, under subjection 5 *( I), for the purposes of the referendum.
PART II— ADMINISTRATION
Returning Officer and scrutineers
3. (I) The Administrator shall, by notice published in the Gazette, appoint a person to be the Returning Officer in relation to the referendum.
(2) The Administrator shall, by notice in writing published in the Gazette, appoint not less than 2 persons to be scrutineers in relation to the referendum.
PARI III— H O L D I N G O F R E F E R E N D U M
The referendum
4. (I) for the purpose of ascertaining the preference of the electors in relation to proposals relating to the peace, order and good government of the Territory, there shall be a referendum which, subject to this Ordinance, shall be held on 6 April 1984 in the Territory.
(2) The proposals to be put to the electors at the referendum shall be the proposals set out in the ballot paper in the Schedule.
Electoral roll
5. (1) The Minister shall, by notice published in the Gazette, appoint a person to prepare an electoral roll for the purposes of the referendum.
(2) A notice for the purposes of sub-section (1) shall contain the name and the address of the person appointed under that sub-section.
(3) An elector is entitled to vote in the referendum.
(4) The names of the persons who are, when the roll is prepared, enrolled on the electoral roll prepared and maintained under sub-section 17 (2) of the Local Government Ordinance 1979 shall be entered by the person appointed under sub-section (1) on the roll.
(5) Where the person appointed under sub-section (1) is aware of the name of a person whose name does not appear on the roll but who is entitled to be an elector, he shall, before the roll is published under sub-section (7), enter the name of that person on the roll.
(6) Where the person appointed under sub-section (1) is aware of the name of a person whose name appears on the roll but who is not entitled to be an elector, he shall, before the roll is published under sub-section (7), remove the name of that person from the roll.

(7) The person appointed under sub-section (1) shall cause the roll lo be published in the Gazette not later than 16 March 1984.
Alteration of roll— upon application
6. (1) A person who is entitled to be enrolled, but whose name does not appear on the roll, may claim to have his name entered on the roll.
(2) A claim referred to in sub-section (1) shall be made orally or in writing to the person appointed under sub-section 5 (I) so as to be received by him before 5 o’clock in the afternoon of 26 March 1984.
(3) Where the person appointed under sub-section 5 (1) is of the opinion that a person who has made a claim under sub-section (1) is eligible to be an elector, he shall cause the name of that person to be entered on the roll.
(4) Where the person appointed under sub-section 5 (1) is of the opinion that a person who has made a claim under sub-section (1) is not eligible to be an elector, he shall reject the claim and shall give notice of the rejection to the claimant forthwith.
(5) The person appointed under sub-section 5(1) shall not accept a claim under sub-section (1) received by him after 5 o’clock in the afternoon of 26 March 1984.
(6) No alteration under this section shall be made to the roll between 6 o’clock in the afternoon on 26 March 1984 and the day on which the result of the referendum is declared.
Alteration of roll— in certain circumstances without application
7. (1) Subject to sub-section (4), the person appointed under sub-section 5(1) shall remove from the roll the name of any person who—
(a) is dead; or
(b) ceases to be eligible to be an elector.
(2) Where the person appointed under sub-section 5(1) removes, under paragraph (1) (b), a name frofh the roll, he shall inform the person concerned as soon as possible of the removal of his name from the roll.
(3) Subject to sub-section (4), the person appointed under sub-section 5(1) may correct a name on the roll where he is informed of a change in that name.
(4) No alteration under this section shall be made to the roll between 6 o’clock in the afternoon on 26 March 1984 and the day on which the result of the referendum is declared,
Appeals
8. (1) The Minister may, by notice published in the Gazette, appoint 3 persons to constitute a Committee of Appeal.

(2) A person-(a) who has made a claim under sub-scction 6(1) and whose claim has
been rejecled under sub-section 6 (4);
(b) who, not being a person referred to in paragraph (a), has made a claim under sub-section 6(1) and whose name has not been entered, or is not correctly entered, on the roll; or
(c) whose name has been removed from the roll,
may apply to the Committee of Appeal for an order under this section.
(3) An application under this section may be made either orally or in writing and shall be made to the Committee of Appeal, or in writing to the Returning Officer who shall forward such an application received by him to the Committee of Appeal, before referendum day.
(4) The Committee of Appeal shall hear and determine an application made under this section.
(5) In hearing and determining an application made under this section -
(a) the procedure of the Committee of Appeal shall, subject to this Ordinance, be determined by the Committee;
(b) the proceedings shall be conducted with as little formality and technicality, and with as much expedition, as the requirements of this Ordinance, and a proper consideration of the application, permit; and
(c) the Committee is not bound by rules of evidence.
(6) Where the Committee of Appeal hears and determines an application made under this section, it may order that the name of the applicant be entered, correctly entered or reinstated*on the roll, as the case requires.
(7) The person appointed under sub-section 5(1) shall give effect to an order made by the Committee of Appeal under this section.
Persons entitled to have their names entered on the roll
9. A person—
(a) who has attained the age of 18 years;
(b) whose principal place of residence is on Home Island in the Territory; and
(c) whose principal place of residence was on Home Island in the Territory during the whole of the period of 12 months immediately preceding 26 March 1984,
is, subject to the provisions of this Ordinance, entitled to have his name entered on the roll.
P A R T IV— V O T I N G
Voting at the referendum
10. (1) The referendum shall be by secret ballot.

(2) Subject to section 17, the voting at the referendum shall commence at 8 o'clock in the morning on referendum day and shall conclude at 3 o'clock in the afternoon on that day.
Polling places and staff
11. (1) The poff for the referendum shaff be tafcen ai such p/ace or pfaces as the Returning Officer, by notice published in tht Gazette, appoints.
(2) The Returning Officer may, in a notice referred to in sub-section (I), appoint a mobile polling station solely for the taking of absent votes and shall, in the notice appointing t hat mobile polling station, state the days on which and the times and places, whether inside or outside the Territory, at which that mobile polling station will be open to receive absent votes.
(3) Subject to this section, the Returning Officer shall appoint a Presiding Officer for each polling place.
(4) Where the Returning Officer appoints more than 1 polling place, he may be the Presiding Officer at a polling place.
(5) Where the Returning Officer appoints only 1 polling place, he shall be the Presiding Officer at that polling place.
(6) The Returning Officer may appoint a poll clerk to assist the Presiding Officer at a polling place.
(7) At each polling place there shall be 1 or more separate voting compartments.
(8) Subject lo sub-sections 13 (7), (9) and (11), a person who is not an elector about to vote shall not enter a voting compartment during the poll.
Penalty: $10.
(9) The Returning Officer shall not appoint a person under the age of 18 years to be a Presiding Officer or poll clerk.
(10) In this section, a reference to a polling place includes a reference to a mobile polling station.
Ballot papers, voting stamps and ballot boxes
12. (1) Subject to this section, the ballot papers to be used for the purposes of the referendum shall be substantially in accordance with the ballot paper set out in the Schedule.
' (2) Subject to this section, the Administrator shall determine the form of the voting stamps to be used for the purposes of the referendum.
(3) The Returning Officer shall furnish to each Presiding OlVicer a sufficient number of ballot papers and voting stamps.
(4) The voting stamps shall be identical in colour, configuration and detail, shall be specially printed for the referendum and each shall be capable of being affixed to the ballot paper to indicate a vote.

(5) The description of a proposal to be put lo the electors shall appear on the ballot paper under a symbol representing the proposal and there shall be sufficient space below the description for a voting stamp to be affixed in that space.
(6) The Presiding Officer shall initial each ballot paper on the back before delivering it to an elector voting at the polling place at which he presides.
(7) The Returning Officer shall furnish to each Presiding Officer a ballot box capable of being locked and with an opening in the top through which the ballot papers may be deposited.
(8) A ballot box furnished to a Presiding Officer under sub-section (7), other than an absent vote ballot box referred to in sub-section 17 (I), shall be displayed empty to electors present immediately before the commencement of polling and then it shall be locked and sealed and shall remain locked throughout the polling and its key shall be retained by a scrutineer.
Method of voting
13. (1) An elector may vote at any polling place or mobile polling station appointed by the Returning Officer.
(2) Subject to sub-section 15 (3), the Presiding Officer at a polling place shall deliver to each elector desiring to vote at that polling place a ballot paper initialled in accordance with sub-section 12 (6).
(3) Subject to sub-section 15 (3), the Presiding Officer at a polling place shall deliver to each elector desiring to vote at that polling place a voting stamp furnished to the Presiding Officer under sub-section 12 (3).
(4) Where the Presiding Officer has delivered a ballot paper and voting stamp to an elector in accordance with sub-sections (2) and (3) he shall place a mark against the name of that elector on a copy of the roll.
(5) An elector who has received a ballot paper and voting stamp under sub-sections (2) and (3) shall—
(a) enter a voting compartment;
(b) without leaving the compartment, affix the voting stamp in the space on the ballot paper below the proposal for which he wishes to vote;
(c) fold the ballot paper so as to conceal his vote; and
(d) in the presence of Presiding Officer, place the ballot paper in the ballot box.
(6) An elector may ask a Presiding Officer or poll clerk to identify the proposals on the ballot paper or to indicate to him the respective positions of the proposals on the ballot paper.
(7) When an elector makes a request referred to in sub-section (6) of a Presiding Officer or poll clerk, the Presiding Officer or poll clerk shall accompany the elector to a voting compartment and shall there comply with that request.

(8) In complying under sub-scction (7) with a-request, a Presiding Officer or poll clerk shall identify to ihe elector concerned each of the proposals on the ballot paper in the order in which it appears on the ballot papgr.
(9) Where the sight of an elector is so impaired that he is unable to vote without assistance or where the elector cannot vote without assistance for some other reason, the Presiding Officer, in the presence of a scrutineer or another person chosen by the elector and, if necessary, an interpreter, shall affix ihe voting stamp on the ballot paper in accordance with the wishes of the elector.
(10) A Returning Officer, scrutineer, interpreter or other person who assists an elector under this section shall not disclose to any person the nature of the vote of an elector exercised before him.
Penally: $20.
(11) Where a Presiding Officer or poll clerk complies, under sub-scction(7), with a request, a scrutineer and, if necessary, an interpreter may be present in the voting compartment.
Spoilt ballot papers
14. (1) If any voter, before depositing his ballot paper in the ballot box, satisfies the Presiding Officer that he has spoilt the ballot paper by mistake or accident, he is entitled, on giving it up, to receive a new ballot paper from the Presiding Officer, who shall there and then cancel the spoilt ballot paper, mark it accordingly and set it aside.
(2) Where a voter has affixed his voting stamp to a ballot paper that he has given up as a spoilt ballot paper he is entitled, when he receives a new ballot paper, to receive a new voting stamp from the Presiding Officer, who shall there and then cancel the voting stamp on the spoilt ballot paper.
(3) Spoilt ballot papers shall be retained by the Presiding Officer and handed by him to the Returning Officer in a parcel after the votes have been counted.
Questions
15. (1) A Presiding Officer at a polling place shall ask an elector inlending to vote at that polling place to state his full name and address, whether he needs assistance in casting his vote and whether he has already voted at the referendum, but shall not ask an elector any other question.
(2) A person shall not make a false statement in answer to a question asked of him in pursuance of sub-section (1).
Penalty; $20.
(3) A Presiding Officer shall not give a ballot paper or voting stamp lo a person unless -
(a) the person states his full name and address and that he has not already voted; and
(b) the name of the person is on the roll.

Absent vote application
16. (1) An elector who, on referendum day
(a) by reason of illness or infirmity, will be unable to attend at a polling place to vote;
(b) being a woman— because of pregnancy, will be unable to attend at a polling place to vote; or
(c) will be absent from the Territory,
may apply for an absent vote.
(2) An application under paragraph (1) (a) or (b) shall be made not earlier than 16 March 1984 and not later than 3 o’clock in the afternoon on 5 April 1984.
(3) An application under paragraph (1) (c) shall be made not earlier than16 March 1984 and not later than 3 o’clock in the afternoon on 3 April 1984.
(4) An application under sub-section (1) shall be made to the Returning Officer or to a Presiding Officer at a mobile polling station, shall state the reason for the application, and may be made either orally or in writing.
Mobile polling station
17. (1) A mobile polling station shall be equipped with a copy of the roll, a ballot box marked “Absent Vote Ballot Box", a voting compartment, ballot papers and voting stamps.
(2) Sections 12,13,14 and 15 apply to voting at a mobile polling station.
(3) The ballot box issued in respect of a mobile polling station shall be displayed empty to electors present immediately before the first absent vote is cast, then locked, sealed and not opened again until the commencement of the counting of votes.
(4) During the period commencing when the ballot box referred to in sub-section (3) is locked in accordance with that sub-section and ending immediately before the commencement of the counting of votes, the Returning Officer shall have custody of the key of the ballot box.
(5) An elector who applies for an absent vote under paragraph 16(1) (a) or (b) shall be visited by a mobile polling station on referendum day.
(6) An elector who has applied for an absent vote under paragraph 16(1) (c) shall vote at a mobile polling station on a day before referendum day.
(7) A mobile polling station shall not visit any elector after 3 o’clock in the afternoon of referendum day.

Counting the votes
18. (1) Subject to sub-section (2), immediately after the close of the poll at the referendum, the Presiding Officer at each polling place and mobile polling station shall bring, unopened, the ballot box from that place or station, as the case may be, to Ihe Returning Officer.
(2) The Presiding Officer at a mobile polling station, being a mobile polling station that is not open to receive votes on referendum day, shall cause the ballot box issued in respect of that station to be delivered to the Returning Officer on or before referendum day.
(3) When the Returning Officer receives the ballot boxes referred to in sub-section (I), he shall cause each of them to be opened, together with any ballot box received by him in pursuance of sub-section (2), and the total number of formal votes polled in favour of each proposal to be ascertained in the presence of scrutineers.
(4) The Returning Officer may appoint a person to assist him to count the votes.
(5) Subject to section 19, where an elector has placed his voting stamp below a proposal on the ballot paper, his vote shall be recorded in favour of that proposal.
Informal votes
19. (1) A vote shall be informal if—
(a) it is not authenticated by the initials of a Presiding Officer; or
(b) the intention of the voter can not be clearly ascertained from the ballot paper.
(2) Informal votes shall be rejected when the votes are counted.
Objections
20. (1) Where a scrutineer objects to a vote on the ground that it is informal, the Returning Officer shall mark the vote “admitted” or “rejected” according to his decision to admit or reject the vote.
(2) Sub-section (1) does not prevent the Returning Officer from rejecting a vote, being a vote in respect of which a scrutineer has not objected, as informal.
Recount
21. At any time before the declaration under section 22 of the result of (he referendum, the Returning Officer may, of his own motion, or shall, at the request of a scrutineer, direct a re-count of the votes cast at the referendum.

Declaration of result of referendum
22. Before 6 o’clock in the afternoon on 7 April 1984 the Returning Officer shall declare in public
(a) the number of formal voles polled in favour of each proposal; and
(b) the number of informal votes,
and the Returning Officer shall give to the Administrator a notice specifying the matter so declared and cause a copy of that notice to be published in the Gazette.
Validity of referendum
23. A court shall not declare the referendum to be void, or make any order- affecting the result of the referendum, on account of any delay in the conduct of the referendum, in the polling or in the declaration of the result, or on account of any absence or error of, or omission by, any person, being an absence, error or omission that did not, in the opinion of the court, affect the result of the referendum.
PAR T VII— C O M P U L S O R Y VOTING A N D OFFENCES
Compulsory voting
24. (1) As soon as practicable after the declaration under section 22 of the result of the referendum, the Returning Officer shall prepare, from the copies of the roll, a list of the names and addresses of persons who were electors and who did not vote and shall furnish the Administrator with the list so prepared.
(2) Within 1 month after the declaration of the result of the referendum, the Returning Officer shall cause to be given to each elector whose name appears on the list prepared in accordance with sub-section (1) a notice stating that the elector failed to vole and asking the elector to notify the reasons for that failure to vote.
(3) Each notice under sub-section (2) shall specify a date, not being a date less than 21 days after the date of the giving of the notice, by which the reasons for failure to vote are to be notified.
(4) An elector who has received a notice under sub-section (2) shall, on or before the date specified in the notice in pursuance of sub-section (3), notify the Administrator, cither orally or in writing, of his reasons for failure to vole.
(5) If an elector is unable, by reason of absence from his place of residence or physical incapacity, to notify the Administrator in accordance with sub-section (4), any other person who has personal knowledge of the facts may notify the Administrator and that notification shall, for the purposes of this section, be deemed to be compliance by the elector with the provisions of that sub-section.

(6) Upon receipt of a notification in accordance with sub-section (4) or(5), the Administrator shall endorse on the list prepared in accordance with sub-section (1), opposite to the nanie of the elector by or on behalf of whom the notification was given, a note that the notification was received.
(7) The Administrator shall endorse on the list prepared in accordance with sub-section (1), opposite lo the name of each elector to whom a notice under sub-section (2) has been given and from or on behalf of whom he has not received a notification in accordance with sub-section (4) or (5), a note to that effect.
(8) A list purporting to be prepared by the Returning Officer and endorsed by the Administrator in accordance with this section, and any extract from or copy of the list, purporting to be certified, by writing under the hand of the Administrator, to be a true and correct extract or copy, is evidence in any court—
(a) of the fact that an elector whose name appears on the list did not vote;
(b) that a notice under sub-section (2) was received by the elector; and
(c) that the elector did, or did not, as the case may be, comply with sub-section (4).
Offences
25. (1) An elector shall not—
(a) fail, without a valid and sufficient reason, to vote at the referendum;
(b) having received a notice under sub-section 24 (2), fail to comply with sub-section 24 (4); or
(c) state to the Administrator a false reason for having failed to vote.
Penalty: $4.
(2) A person shall not make a false statement to the Administrator in relation lo the failure of an elector to vote.
Penalty: $4.
(3) A person shall not—(a) vole more than once at the referendum;
(b) falsely personate any other person with a view to obtaining a ballot paper and a voting stamp or with a view to exercising a vote; or
(c) threaten, offer or suggest any violence, injury, punishment or other detriment in relation to—
(i) an enrolment;
(ii) support of or opposition to a proposal; or
(iii) the exercise of a vote.
Penalty: $20.
(4) A person other than—(a) an elcctor to whom a ballot paper has been issued; or

(b) a Presiding Officer acting in pursuance of sub-scction 13 (9), shall not alVix a voting stamp on a ballot paper.
Penalty: $20.
(5) A person shall not give, confer or procure or promise or ofTer to give, confer or procure money or other property or benefit of any kind to, upon or for an elector or another person—
(a) in order to influence the elector in his vote in the referendum;(b) in order to induce the elector to refrain from voting in the referendum;
or(c) in order to induce the elector to support or oppose a proposal to be pul
at the referendum.Penalty: $20.
(6) An elector shall not ask for, receive or obtain money or other property or benefit of any kind for himself or another person upon the understanding that —
(a) his vote al the referendum will be influenced as a result or given in a particular manner;
(b) he will refrain from voting in the referendum; or(c) he will support or oppose a proposal to be put at the referendum.Penalty: $20.
(7) Proceedings for an offence under this section shall not be instituted except by the Administrator or a person authorized in writing by the Administrator for that purpose.

Regulations
26. The Minister may make regulations, not inconsistent with this Ordinance, prescribing all matters which are necessary or convenient to be prescribed for carrying out or giving effect to this Ordinance.
