Who Qualifies for the Extended Credit?• First-time home buyers who purchase homes between

November 7, 2009 and April 30, 2010.

• Current home owners purchasing a home between November 7, 2009 and April 30, 2010, who have used the home being sold or vacated as a principal residence for five consecutive years within the last eight.

To qualify as a “first-time home buyer” the purchaser or his/her spouse may not have owned a residence during the three years prior to the purchase.

If you or your client purchased a home between January 1, 2009 and November 6, 2009, please see:2009 First-Time Home Buyer Tax Credit.

Which Properties Are Eligible?The Extended Home Buyer Tax Credit may be applied to primary residences, including: single-family homes, condos, townhomes, and co-ops.

How Much Is Available?The maximum allowable credit for first-time home buyers is $8,000.

The maximum allowable credit for current homeowners is $6,500.

How is a Buyer's Credit Amount Determined?Each home buyer’s tax credit is determined by two additional factors:

1. The price of the home. 2. The buyer's income.

Price: Under the Extended Home Buyer Tax Credit, credit may only be awarded on homes purchased for $800,000 or less.

Buyer Income: Under the Extended Home Buyer Tax Credit, which is effective on November 7, 2009, single buyers with incomes up to $125,000 and married couples with incomes up to $225,000—may receive the maximum tax credit.

As part of its plan to stimulate the U.S. housing market and address the economic challenges facing our nation, Congress has passed new legislation that:

• Extends the First-Time Home Buyer Tax Credit of up to $8,000 to first-time home buyers until April 30, 2010.

• Expands the credit to grant up to $6,500 credit to current home owners purchasing a new or existing home between November 7, 2009 and April 30, 2010.

Here is more information about how the Extended Home Buyer Tax Credit can help prospective home buyers become part of the American dream. If you have specific questions or need additional information, please contact a tax professional or the Internal Revenue Service at 800-829-1040.

These income limits have changed from the 2009 First-Time Home Buyer Tax Credit limits. If you or your client purchased a home between January 1, 2009 and November 6, 2009, please see: 2009 First-Time Home Buyer Tax Credit.

If the Buyer(s)’ Income Exceeds These Limits, Can He/She Still Get a Credit?Yes, some buyers may still be eligible for the credit. The credit decreases for buyers who earn between $125,000 and $145,000 for single buyers and between $225,000 and $245,000 for home buyers filing jointly.

The amount of the tax credit decreases as his/her income approaches the maximum limit. Home buyers earning more than the maximum qualifying income—over $145,000 for singles and over $245,000 for couples are not eligible for the credit.

Can a Buyer Still Qualify If He/She Closes After April 30, 2010?Under the Extended Home Buyer Tax Credit, as long as a written binding contract to purchase is in effect on April 30, 2010, the purchaser will have until July 1, 2010 to close.

Will the Tax Credit Need to Be Repaid? No. The buyer does not need to repay the tax credit, if he/she occupies the home for three years or more. Changes that will Affect YOU in 2010Oklahoma Supreme Court DecisionsDuring 2009, there were several Oklahoma Supreme Court decisions which had an impact on the real estate profession.

One of the cases was discussed in the Tulsa World Article of December 17, 2009, “Small employers at risk for bias lawsuits” by Kristen Brightmire. In the past, employers with less than 15 employees could not be sued for employment discrimination according to legislation passed by the Oklahoma State Legislature.

This year, the Oklahoma Supreme Court said that the Oklahoma Anti-Discrimination Act “can be the basis of a wrongful termination claim regardless of the number of employees.” If you have any employees, unlicensed assistant(s), you are encouraged to consider how this ruling may affect you.

Another ruling concerned the way square footage was handled in the case of Bowman vs. Presley. While the facts in the case were unique, the ruling by the Oklahoma Supreme Court set a precedent which was concerning. The NORES Bylaws, Rules and Regulations Committee, with input from several task forces, continues to monitor and review the issue and there are expected to be changes in the future regarding the way square footage is handled.

Federal MandatesSeveral federal mandates will be going into effect in 2010 which will impact the real estate profession:

In January, the new RESPA Rules will go into •effect. (See the December 2009 GTAR World for more information.)In April, the • EPA Renovation, Repair and Painting Rule will go into effect. (See the November 2009 GTAR World for more information.)

Code of EthicsThe National Association of REALTORS® (NAR) has approved a new Standard of Practice for Article 3 which will impact anyone who is involved with showing homes.

Standard of Practice 3-9: “REALTORS® shall not provide access to listed property on terms other than those established by the owner or the listing broker.”

The rationale for the new standard of practice by the NAR Professional Standards Committee was that, “This new Standard of Practice addresses misuse of lock boxes and other concerns related to unauthorized access to listed property.” Standard of Practice 11-1 and 12-5 have been expanded. Maximum discipline for those found in violationof theCodeofEthics remainafineofup to$5,000, suspension from membership for up to one year, or termination of membership for up to three years.

GTAR Objectives: Section 1. To unite those engaged in the recognized branches of the real estate profession for the purpose ofexertingabeneficial influenceupon theprofessionand related interests.

Section 2. To promote and maintain high standards of conduct in the real estate profession as expressed in the Code of Ethics of NAR.

Section 3.Toprovideaunifiedmediumforrealestateowners and those engaged in the real estate profession whereby their interests may be safeguarded and advanced.

Section 4. To further the interests of home and other real property ownership.

Section 5. To unite those engaged in the real estate profession in this metropolitan area with the Oklahoma Association of REALTORS® (OAR) and NAR, thereby furthering their own objectives throughout the state andnationandobtainingthebenefitsandprivilegesofmembership therein.

Section 6.Todesignate, for thebenefitof thepublic,those individuals authorized to use the terms REALTOR®, REALTORS®, and REALTOR-ASSOCIATE® as licensed, prescribed, and controlled by NAR.

Buyers More Likely to Visit Home Viewed Online (Source: National Association of REALTORS®; Sophia Stuart, Research Economist, December 2, 2009)

Accordingtothe2009ProfileofHomeBuyersandSeller,60 percent of buyers were likely to walk through a home they viewed online. Read the following from NAR’s Research department and consider how you can use the information to help your business.

The Internet has become an essential and •indispensable tool in the home search process with 90 percent of home buyers using it to search for homes, up 30 percentage points during the past six years.

Additionally, among buyers who reported •using the Internet, 76 percent reported using it frequently, an increase of 7 percentage points from 2008.

Furthermore, as a result of searching online, •buyers frequently request additional information orfindanagent.

Do you remember the days when the word twit was a form of ridicule, when a tweet was the sound a bird made, when socializing meant that you were going to spend time, in person with people? We didn’t have a Blog; having a cell phone meant that you were rich or very important, and only the crew of the Starship Enterprise had this thing in their ear (Blue Tooth) that they could communicate through—“beam

me up Scotty; it is hard to keep up.”Today we Blog, Twit, Tweet, connect with friends on Facebook that you haven’t seen in thirty years just so they can share with you every single thing that they are doing, and I mean important stuff like when they are taking their garbage out or washing the dog etc. We send text messages instead of calling, (I thought we had evolved past typing but no, now we are supposedtotypewithonefingeronaoneinchkeyboardandunderstandanabbreviatedlanguagethatonlymyteenagerreally understands), and all of this progress falls into the category of social networking. Social Networking is one of the ways to communicate with clients, customers, and the public, but none the less it is also advertising. This brings the need for licensees to be educated that the rules of disclosure, when advertising, also applies to this medium. While it is impossible to require that all tweets contain the required disclosure information, it is required that a person’s homepage, Blog or Facebook account, used for communication to clients, customers or advertisement to the public, comply. Just as if they have handed them a business card, it is not required every time they communicate with that client, but they must abide by the disclosure rules when advertising using their Blog, Facebook page, websites, emails, and any other forms of social networking.
