NOW, this matter comes before the Court on the Motion for Change of Venue, and the

Court having reviewed the Motion finds the following:

1. That the residence of the Ward is Sac County not Buena Vista County.

2. It is in the best interest of all parties to have the venue of this matter changed

to Sac County, Iowa.

3. That the Sac County Clerk of Court should open, copy and perform such actions

as may be necessary to transfer the court file including exhibits from Buena Vista County

to Sac County and issue new Letters of Appointment accordingly.

THEREFORE, IT IS ORDERED, ADJUDGED AND DECREED that the venue of the

Guardianship and Conservatorship is hereby changed to Sac County and the Clerk from Buena

NOW, this matter comes on for hearing upon the Voluntary Petition for Appointment of

Guardian and Conservator for Molly N. Wissink, and after being fully advised in the premises,

the Court finds the following:

1. The Proposed Ward is 18 years old.

2. She has executed the Voluntary Petition for Appointment of Guardian and

Conservator.

3. She has been treated regularly by David Crippin, M. D., since her delivery. A

copy of a letter from Dr. Crippin dated January 3, 2014 was attached as Exhibit “A” to the

Petition.

4. The evidence submitted to the Court along with the Petition indicates that Molly

N. Wissink understands the Petition for Guardianship and Conservatorship and that the

guardianship and conservatorship is needed.

5. The Petitioner has shown by clear and convincing evidence that Molly N.

Wissink’s decision-making capacity is impaired, and that although she is able to make some

routine daily decisions, she needs assistance with most decisions that impact upon her personal

safety, and to attend to or provide for basic necessities for herself such as food, shelter, clothing,

or medical care, without which physical injury or illness might occur.

6. The best interests of the Proposed Ward, Molly N. Wissink, require that a

Guardian and Conservator be appointed to assume the responsibilities for the physical care,

control, and custody of the proposed Ward.

7. That a limited guardianship is not appropriate pursuant to Iowa Code §633.635.

8. That a limited conservatorship is not appropriate pursuant to Iowa Code §633.637.

9. Based upon the evidence presented, the Court further finds that upon filing of the

Court Officer’s Oath, that Robin L. Wissink should be appointed as Guardian and Conservator

without bond.

IT IS THEREFORE ORDERED, ADJUDGED, AND DECREED that Robin L. Wissink

should be appointed as Guardian and Conservator for Molly N. Wissink concerning her health and

safety which shall be defined to include but not limited to:

A. Ensuring the Ward receives necessary medical services, including both routine

medical appointments and visits and emergency services;

B. Ensuring the Ward receives professional care, counseling, treatment or services as

needed;

C. In addition and upon application and Court approval, the Guardian may

authorize on behalf of the Ward:

(1) Changing, at the Guardian’s request, the Ward’s permanent residence if

the proposed new residence is more restrictive of the Ward’s liberties than

the current residence.

(2) Arranging the provision of major elective surgery or any other

nonemergency major medical procedure.

(3) Consent to the withdrawal of life-sustaining procedures in accordance with

Chapter 144A of the Iowa Code.

D. To apply for and handle government benefits and seek employment;

E. To make decisions about travel, contracts, and entering into marriage; and

F. To manage financial affairs and decisions.

IT IS FURTHER ORDERED, ADJUDGED AND DECREED that the Ward, Molly N.

Wissink does ______ retain the right to vote.

IT IS FURTHER ORDERED, ADJUDGED AND DECREED that the Ward, Molly N.

Wissink does ______ retain the right to enter into a valid marriage contract.

IT IS THEREFORE ORDERED, ADJUDGED AND DECREED that upon filing of the

Court Officer’s Oath, that Robin L. Wissink is to be named as the Guardian and Conservator in

this matter and the Clerk shall issue Letters of Appointment accordingly.
