I. The Local GO\o"CmJllent a.grees upon request of the USN in whose cu.stody a prisoner is held, to provide transportB.tioo and escort guam services for federal prisonas housed at their faciLity to and from the U.S. Cowthouse. !he Local Government agr~ to the fuUowing:

1. Transportation and t:sCOrt guard SeMceS will be perfonned by a.lIeast two (2) armed qualified officers employed by the Local Govenun.cnt \Dlder their policies, procedures., llI\d practices, and win augment such practices as may be requested by the USM to enhance speGific requirements for security, prisoner monitoring. and contraband control;

b. Upon arrival at the courthouse, transportation and escort guard will turn federal prisoners over to De-puty U.S. Marshals only upon presentation by the deputy of proper law enforoement credentials;

c. The LoC<l1 Gl)vcmrocnt \\111 09t transport fedenl prisoners 10 any U.S. Counhouse without a specific request from the USM who will provide the prisoner's llame, the U.s. CaW\house. and the date the prisoner is to be IJ"ansponed.

The purpose of this lntcrgovemmenta! Service Agreement (IGA) is to establish B forr.nal binding {elation~hip betWeen th& United States Marshals Service (USMS) and (lther federal ~ agencies (the Federal Goverrunent) and Middltsex County, New J~rscy (the Local Government) for the detention of persons charged v..ith or convicted of violations of federal law or held -.s material wituess~ (fedual prisoners) at the Middlesex County Adult Correction Center (the facility).

The Local OovCIlUl1ent agrees to accept and provide for the s~ure custody, care and safekeeping of federal prison~ jn a~ordance with state and local b.w, standards.. polieie$, procedures, or court oroet'S applicable to the operations of the facility. The USMS considers all federal prisoners medtumitnaximum security-type prisoners that arc housed within th~ confines of the facility, a.t a level appropriate for prisoners considered a risle of flight, a danger to the community, or wanted by o1htt jurisdictions.

ARTICLE lJ - ASSIGNMENT AND CONTRACTING OF CA'ffiGQRlCt\L PROJE,cteD-SUPPQRTeO EFfORI

4, The contract or agreement must, at a minimum, state the acti.vitios to be performed. the time schedule., the project policics, and the flow-through requirements that are applicable to the contractor or other recipient. otherpoUcies and procedures to bE: followed, the dollar. limitation of the agreement, and 1bt cost principles to be usl!d in dctc.mrining allowable. costs. ~ contract or other written agreem£f1t must not affect tbe recipient's overall responsibility for the duration of the project and accountability to the go'Vurunent.

ARTICLE UI - MEDICAL SERVICES

1. 2. The Local Government agrees to notify tht United States Marshal (USM) as 5000 as possihle of all ancrgency medical cases requuing removal of a prisoner from the facility and to obtain prior authorization foT' removal for al' oth~r m~dica1 services required.

3. Wben.8. federal ptisoner is being transferred via the USMS airlift) br.Ishe wilt bo pl"ovided with thr~ (3) to seven (7) days of prescription medication which will be dispensed from the detention. f:tcility. When possible, generic medications should be prescribed.

4. Medil;al records must travel with the federal prisoner. If the records are maintained a.t a medical con tractor IS facitity, it is the detention facility's rtSp<lnsibility to obUiin them before a federal prisoner is moved.

5. Federal prisoner! will not be charged And are Mt required to pay thelr own medical expenses. These elCpenses will ~ paid by the Fedenl Govtrnment.

6. The Local Government agrees to notify the USM as soon as possible when a fed~ pri$oner is involved in an escape, attempted esape, OT conspiracy to escape from the faoility.

ARIICLf: IV . RECEIVING AND DISc.HAruJE

1. The Local Government agrees to accept as federal prisoners tnose persons committed by fcdertllb.w enforcement officers for violations (If federal laws only upon prescntati(\n by the officer ofptoper \a~ enforcement credentials.

2. The Low Government agre~ to release federal prisoner:s only 10 law enforcement oflice~s of agencies initially committing the prisono( (Le., DEA., INS , etc.) Of to a Deputy USM. Those prisoners who are remanded III custody by a. USM may only be rel6Ucd to B. USM or an. agent ~puified by the UBM of the Judicial District.

3. The Federal Goverrunent agrees to m.ain.tain federal pri.9oner population levels at or below the level established by the facility adrnin!!1Tator.

4. Federal prisont~ may not be released from the facility or placed in tht. custody of state or loca.l officials for auy realon except for medical emergency situations. Fed~aJ prisoners sought for a state or lo~at court prooocding must be ac.quired through a Writ of Habeas CoIl'US 01 the InteIstate Agreeme.nt of DetaiDers and then only with the concurrence of the District USM.

ARTICLE VI ~ TEMPORARY PER PtEM RATE AND ECONOMIC PRlC~ AD.alSIMEhU'

l. A temporary jail day rate of S 72.00 has been established for a period of six (6) months, eltpiIing on May 31, 2002, pending reswts of the audlt of actual ~ allowable costs associated wifu the operation of the facility. ThcJaH day rate for subsequent periods wit! be adjusted based on the ac:tuB.l operational costs for the facility which could results i.n the rate clcert:asing.. increasing. Ot (emaining unch~ged.

2. The Federal GovemTne.r:t.t shall reimburse the Local Government at the per diem rate i4~rrt.ific:d on page one (1) of this ~ent. A~ the establi$hment of a per djem rate, the rate may be renegotiated not more than once per year, after the agreement bas been in efkct for twelve (l2) months.

3. The rate C()vers one (1) penon pe:r ''prisoner day .... The Fcde;ril Oover;mnent may not b<!: billed fur two (2) days when a prisoner is admitted ODe e.vening and removed tltt following moming. The Local Government may bill for the day offtrrtval. but not for th~ day of departure.

4. When a race incr~ is desired. the Local Government sha1.1 submit 8. writteD request to the USM at least sixty (60) d:!ys prior to t.htl desired effective date of the ra:te adjustment. The Local Government agrees to ptovide additional cost infonnation to support the requested rate increa!e and to permit an audit of accounting record$ upon request of the U5MS.

5. Criteria used to evatuatt the increase or decrease in the peT diem rate shall be those spe.cified in the Offioe of Mmagermnt and Budget (OMS) Circular A-S7, Cost Prindp1es for State, Local, and lDdian Tribal Governments.

6. The tffective date of the rate modiflcation will be negotiate4 and $pecifted on the lOA Modification forro approved and s.igned by a USMS Contract Specialist. The effE:ctive d~ will be established on the fi.m day of the month fot accounting purposes. Payments at the modified ra~ will be paia upon the rotum of the signed modific.ation by the authorized Local Government officiBl to the USM.

ARTICLE IX - ACCOUl'{IING SYSTEMS AND FINANCIAL RECORDS

The USMS may apply inwest, pen.alties, and administrative costs to a delinquent debt owed by a debtor pursuant to th~ Federal Claims Collection Standards.

ARTICLE XI - GOvERNh$ff FURNISlf8D PROPERTY

t. It is the intention of the. USMS to furnish excess federal propertY to local governments for the specific purpose of irnproving jail conditions and services.
