1. That I am an attorney duly licensed in the State of Arkansas and employed by William N. Carter, P.A., with offices at 2311 Biscayne Drive, Suite 320, Little Rock, Arkansas.

2. That the petition to classify Andrew Roy Gibb p/k/a "Andy Gibb" as a third preference alien (I-140), to which this Affidavit is attached, was prepared by me at the request of the alien beneficiary and the petitioner, R. S. 0. Records, Inc~

3. That the alien is an exclusive recording artist for R. S. 0. Records, Inc., 8335 Sunset Boulevard, Los Angeles, California, a major international record label.

4. That the alien is exclusively represented by the William Morris Agency, Inc., 1350 Avenue of the Americas, New York, New York, one of the world's largest theatrical employment agencies, in the television and concert fields.

5. That the Robert Stigwood Organisation, 1775 Broadway, New York, New York, is one of the world's largest entertainment companies and is the manager of the alien with respect to his professional career.

6. That the alien recorded a song entitled "I Just Want To Be Your Everything", which was released by R. S. 0. Records, Inc. , and which climbed to the #1 position on the charts in the three leading trade periodicals, Billboard, C~i:;llbox, and Record World, and remained in the top ten for sixteen (16) weeks.

7. That the aforementioned song was certified gold by the Recording Industry Association of America (R. I.A. A.) on August 9, 1977, i.e., one-half million copies were sold as Qf the date of certification.

8. ·. That the alien recorded a long-playing album, "Flowing Rivers", which was released by R. S. 0. and which was certified gold by the R. I. A. A. on November 2, 1977.

9. That a second single recording from the same album, "(Love Is) Thicker Than Water" was released and achieved the No. I position in Billboa.rd, Cashbox, and Record World, and was certified gold.

10. That, in addition to his vocal performances, the alien composed eight of the ten recordings included on the long-playing album and co-wrote" (Love Is) Thicker Than Water" with Barry Gibb, the alien's brother and. member of the Bee Gees.

11. That a song entitled "Shadow Dancing", recorded and co-written by the alien, is currently No. 22· in Billboard, Record World, and Cashbox after only three weeks on the charts.

12. That the alien was nominated for the following awards:

I used to feel that a I ittle bit, twinges of it, when I would always get billed as the brother of. the Bee Gees in all my shows. That went on for a while and I sort of had to expect it-them being famous and me not. And being their only youngest brother. I didn't complain. I think that's going to fade away eventually because my

ROCKET: Did it surprise you to have a· number one stngle on. your very first album? · GIBB: Oh God yes! It was incredible. When ·1 first did the song I was confident, I thought it was an.umber one song. But it's really hard to ac­cept the fact that I could ·have a number one record myself. ROCKET: When you ·write a song do . you have someone specific in mind? GIBB: Not really. Actually, nobody was in mind for "Everything."· My brother Barry wrote that We were all sitting in Bermuda at our manager's house. And we sat down and wrote four together, of which one was "Love is Thicker Than. Water'' and Barry was strumming in the back­ground doing "I Just Want to be Your Everything." And we knew in­stantly that it was a r:,umber one record. He put the lyrics to it later that night. ROCKET: Are your songs personal statements on ·1ove? GIBB: Not really, not so much. on this album. ROCKET: When did you feet you were ready to record? · GIBB: I was 16 at the time. I spent a few years in Australia. You can get to the top in Australia and never get heard outside the country which is a shame. I had a record out there. ·1 ROCKET: How do you cope with a sudden burst of fame? , l : GIBB: I just try to keep my head to­gether, keep level headed about it. Keep on going. It's been incredible, it really has. ROCKET: You're a special type of star_;the sort who will get the very enthusiastic fans .. Are you b.esieged? GIBB: Yes, but luckily they don't know where I live! I don't have any hassles with people coming around. But phone calls all the time. I pick up the phone and either they hang up, or they giggle. Giggling for a few minutes. It goes on all the time even into the early hours of the morning. I usually get it worse on tour. That's when it becomes unbearable. ROCKET: And on stage? GIBB: They worry me sometimes. They get so much emotion inside them. Crying. It's emotional to see them from the stage. It's hard to sing and watch them at the same time. To see kids at that age crying -that much broken up over a con­cert-it makes me feel pretty strange. They lose their mind and get hyster­ical-it's really frightening some­times. ROCKET: What are you trying on the new album?

GIBB: You're going to notice that I'm R&B and latin influenced than • st country one. My brothers are

Profile: Al'.lDY GIBB

It is not exceptional for the youngest member of a

musically gifted family to follow in the footsteps of his

older brothers. It is uncommon in the case of Andy Gibb however,

to grow up the brother of the prestigious Bee Gees, and yet

develop a style so distinct and uniquely his. It is equally

uncommon for anyone at this stage of his life to possess a talent

so mature. Andy's striking presence combines both the romance

of youth and the confi9ence of sophisticated musical creativity.

His sensitive lyrics and. unpretentious manner convey a charm

that wil_l steal every yo~ng girl's heart. At the same time,

his tightly woven arrangements and country-rock style express

the self-assured sa.vvy of a musician whose career has finally

begun to take its turn.

It would be safe to assume that Andy's extraordinary

background has made some contribution to his precocious

development. The path that his life has taken is hardly the

usual one. In fact, one could- easily say that Andy has

journeyed.in his brief eighteen years, distances that many

of us wili not cover in a lifetime. Although .born in

Manchester, United KingdoI.n in 1958, hi_s family moved to

Australia while Andy was still very young. He returned to

the United Kingdom in 1967 at the age of nine, and picked up

his first guitar. Between·the years of 1970 and 1974 Andy's

adventures led him to the remote island of Ibiza off the coast

of Spain, and eventually to the Isle of Man. Hav:i,ng played in

a few clubs during his travels~ he began to play professionally

when back in the United.Kingdom. After a few local gigs, he

confidently c;:hose Australia. to be the proving ground of his

career; and with a keen sense of determination Andy returned

there in 1975. Playing his own material as we.11 as old Bee

.Gees numbers, Andy formed a group that toured all over the

country, taking billings with groups like Sweet and The Bay ) .

City Rollers.

One might easily get the impression that Andy would be

jaded by such good fortupe-but_he is not one to stand back

and let life come to him. On the contrary, anyone who has

met Andy immediately recognizes the vitality with which he

embraces every experience. Indeed, each song he writes reveals

the importance he attac~es to what is otherwise.a :fleeting

moment. The profound feeling of Andy's songs is rarely seen in

any writer, let alone one of eighteen. After finally re­

cording. so~e of his material in Australia, there was no question

that he was more than ready to put together his first album.

Robert Stigwood was quick to appreciate his ability and they

signed a recording aI.ld management contract in 1976.

Signing with Robert Stigwood had set into motion a

••• • wave of events that carried Andy's career still one step

further. Firstly, there was a reunion with his brother Barry

who he had not seen in several years. Never before was Andy

able to relate to his brother on equal ground as a proven

musician with ar1 identity all his own. It was an exhilarating

experience for each of them, both personally and professionally,

and together they headed for the recording studio in Miami.

There, at Criteria Studios, with Barry assisting the production,

Andy recorded two songs which they wrote together, along with

eight others he•had written himself. The momentum which had

begun when Andy left Australia continued as he started his work at

Criteria. The country-ropk fee_]. which characterized his music,

has been expanded with a sophisticated rhythm and blues quality.

With guitar and keyboards predominating in most songs, Andy's

vocals take on an evocative and mesmerizing nature which draws

the listener into his sensitive lyrics and compelling rhythms.

Andy's albumentitied, "Flowing Rivers" will be released

by RSO Reco~ds in th~ near future. Andy Gibb is a musician

w.hose talents coincide with the high standards of other artists

on the RSO Records roster. The company's main concern is to

develop themseives as a unique and selective label, and regard

Andy as a fr~sh and in.spiring addition to their company. Andy

feels that the support and creative freedom, essential for the

The IO-song 55-minule sel was brought lo a frantic close with "I'll Be Good To You ... the band"s lirsl gold single, and "Get The Funk Gutta Me Face:· the group·s bes! rocker. For these two numbers the band was joined by the Floaters. who provided vocal support, and Mi­chael Jackson, who jumped around amd made young girls scream.

In its portion of the show. the Floaters dis­played.good voices. excellent and energetic cho- . reography, a good band and no creativity. The group ·s chart lopping single, "Float On:· was the only song in the JO-song set which was not previously recorded by som'eone else. As the Pips went into a production number ""Street Brothers" with tight harmony to an ever so loose uptempo, semi-novelty lune. the crowd went wild. Each member showcased his own in· dividual talents in lhis one.

Knight took the same opportunity to go solo. taking --second Hand Rose .. and transforming ii into "Second Hand Song.'' followed by a short monolog on Barbra Streisand which led to "Ev· ergreen .. and smoothly into .. The Way We Were." The house was on its feel.

As the entire group slid into "Use My lmagi· nation" and ··1 Heard II Through The Grape­vine," a piano was brought onstage lo the sur· prise ol lhe audience. The crowd had not been advised of Ray Charles· appearance.

Charles. who was recently reviewed her.e. took the stage with his Raelettes for the next 35 minutes. He was re1oined onstage by Knight for

Gayle. a young woman who on every account is a most attractive performer. filled this 300 seat room to capacity for her four shows on her two-night Sept. 17-18 engagement.

She is one of the few performers ever to play the Boarding House who would be equally at home in a Las Vegas setting. and her appear­ance drew many middle-aged fans who normally do not frequent this club.

She rewarded them with a set of 14 tunes. which were preceded by her-backing band doing several introductory numbers of its own. The en­tire program consumed about 90 mintues.

Crystal's best asset-as ii should be for any singer-is her voice. which on several tunes like ··ru Get Over You .. and "Go! My Sweet Baby On My Mind" she really let stretch out.

Though-some of her stage patter was a touch on the saccharine side. she is basically solid. composed and appealing in her presence and mannerisms.

Her set opened with "love The Nigh I Away." followed by two well-known songs. "Rolling lo My Sweet Baby"s Arms .. and the softer ballad "Rodeo:· a song best known in the Judy Collins version.

The current hit. --oon'I It Make My Brown Eyes Blue .. came near the end of the set. and though this was obviously the most recogmzed tune. the audience seemed lo respond to the firs! chords of almost ever song. The encore was a pretty lune titled --when I O,eam ...

MEMPHIS - Al Bell, former owner and chairman of Stax Records. has filed a malrcious prosecution suit here against the Union Planters National Bank, asking $20 million in damages.

Union Planters accused Bell in 1975 of conspiring with a former bank officer to defraud the bank of $18.9 million. Beu was exonerated and cleared of all charges on Augus1 2, 1976.

When grant of permanent residence becomes fina.l, the- copy returned by the Visa Control Office which allocates the visa number shall be appropriately endorsed, and placed in the file. In such cases the triplicate copy, which was re• fained in the file, sha.11 be noted to show the date permanent residence status is granted and for• warded together with completed Form 1-59 to the State Director of Selective Service in the case of every male· alien between the a.9es 18 and 26 or between the ages of 18 and 35 in the case of a doctor, dentist or other medical specialist. If not required for this purpose, it shall be destroyed. In cases where permanent residence Is granted without referral to the Visa Control Office, except where Selective Service is to be notified, only._ an original 1 • 181 need be prepared and placed in the file: In other ccises where outstanding instructions require the form 1 • 181 to be forwarded to the Visa Control Office, it shall be prepared in duplicate and the original placed in the file, except when an additional copy is required to notify Selective Service.

PREFERENCE: Under Sedlon 245, the priority date will be the filing date of one of the first six preference petitions. ·

NONPREFERENCE: Under Section 245, the priority date shall be fixed by the following fadors, whichever Is the earliest; (1) the priority date accorded the applicant by the consular officer as a nonpreference immigrant; {2) the date on which appJtcation Form 1-485 is properly fl~e,d, If the appUcant establishes that he is a member of a profession or a person with exctfpflonal .ability_ In fhe sciences or the arts not included in t~--~pa,rtme.nt of Labor's Schedule A{29 CFR 60) provided a certification is issued on that basis, or that he is within Schedule A, or that the
