CHAPTER I

GENERAL PROVISION

Article 1

What is meant in this Lawby:

1. Husbandry shall be all matters relating to source of

physical power, seeds, seedling and/or germs, food,

husbandry tools andmachine, livestock cultivation, har­

vesting, postharvesting, processing, marketing and its

exploitation.

2. Animal health shall be all matters relating to animal

healthcare, animalmedication, animal healthservice,

control and management of animal disease, disease

prevention, medical reproduction, medical conserva­

tion, animal medicine and animal health apparatus,

andfoodsecurity.

3. Animal shall beanimalor wild animalwhich the entire

or part of its live cycle is on (and, water, and/or air,

either reared orwithin its habitat.

4. Rearedanimalshallbe animalwhich part or the Whole

5. Uvestock shallbe rearedanimalwhich product is allo­

cated for food producer, basic material for industry,

service, and/or its derivative product that relates to

argriculaturalmatters.

6. Wild animal shall be all animalsthat live on land, wa­

ter and/or air which are still haVing wild nature, that

are either live freely or reared by human being.

7. Genetic resources shall be plants, animals,or micro­

organism consisting of units that function as genetic

naturecarrier, that either hasactual or potentialvalue

for creating groove, clump or new species.

8. Animalgerms hereinafter referred to as germs shall

be animal reproduction material that may be in the

form of cement, sperm, ova, shooted egg, and em-

bryo.

9. Microorganism shall be microorganism that may be

useful for animal food industry and/or veterinary

biomedic industry.

10. Animal germs hereinafter referred to as animal has

superior nature shall be animal having superior na­

ture, bequeathing andcomplying with certain require­

mentsfor breeding development.

11. Animalcluster hereinafter referred to as animal clus­

ter shall be group of animals from one species that

has special phonotype characters and may be be­

queathedto its offsprings.

12. Prospective animal hereinafter referredto asnon-germ

animalthat has superior nature to be rearedfor pro­

duclnqpurpose.

13. Animalproduct shall be all products originating from

fresh animal orprocessed for consumption purpose,

for pharmaceutical, agriculture and/orotheruseto fulfill

humanneedand benefit.

14. Breedershall be individual IndonesiancItizenor cor­

porateoperatinghusbandry business.

15. Husbandry companyshall be individualperson or cor­

porate, either in the form of legalentity or non·legal

entity, duly established and domiciled in the territory

of the Unity State of the Republic of Indonesia that

manages husbandry business in certain criteria and

scale.

16. Business in the field of husbandry shall be activites

that produceproductsand servicethat support bust­

ness on livestockcultivation.

17. Castration shall be action that prevents the testical to

function byeliminatingor detaching its function.

18. Artificial inseminationshall be the technology for in­

serting the spermor cement into healhtyfemale live­

stock reproductionmechanism in order to germinate

the ovumusing insemination device with the objective

to inseminatethe livestock.

19. Uvestock improve breedingshallbea series of activles

to changethe geneticcompositionon a group of live­

stock from one cluster or groove in order to accom­

plishcertainobjective.

20. Local livestockshall be the product of cross-breeding

or overseas introduction that has been cultivated in

Indonesia up to the fifth or more generationthat has

been adapted to the environmentand/or localman­

agement.

21. Business in the field of animal healthshall be activities

that produce productsand service that supportthe ef­

fort to accomplish animal health.

22. Food shallbesingleor mixedfood material, eitherpro­

cessed or not processed, given to the animal to live,

produceand multiple breeding.

23. Food material shall be products of agriculture, fishery,

husbandry, or othermaterialreasonably usedasfood,

either processed or non-processed.

24. Public breeding zone shall beState-owned zone or zone

madeavailable bythe Government or zonegrantedby

individual or company allocated for livestock husbandry

by small scale community so that the livestock may

breed freely.

25. Any person shall be individual person or corpora­

tion in the form of legal entity or non-legal entity

that operates in the field of husbandry and animal

health.

26. Veterinary shall be all matters relating to animaland

animaldisease..

27. Veterinary medical shall beactivities conducted byvet-

erinarian.

28. Veterinarian bodyshall beGovemment institution and/

or institution duly established by the Government in

making top technical decision concerning animal in­

volving veterinarian professionalism startingfrom iden­

. tification of problem, decidepolicy, coordinateimple-

mentationof the policy, up to control the operational

technique in the field.

29. Veterinarian shall bea person haVing professionalism

in the fieldof veterinary, certificate of competency, and

veterinarian medical authority inproviding animal health

service.

30. Authorized veterinarian shall beveterinarian appointed

bythe Minister, Governor or Regent or Mayoraccord­

ing to their respective authoritybased ontheir respec­

tive range of duty in provldinq service in the contextof

implementing animal health.

31. Reproduction medical shall be application of medical

byveterinarian in the implementation of animal health

in the field of animalreproduction.

32. Conservation medical shallbeapplication of medial by

veterinarian in the implementation of animal healthin

the field of conservation of wild life..

33. Biomedical shall bemedical implementation by veteri­

narian in the field of phannaceutical biology, medical

sclentifical developmentor biological industryfor hu­

manhealthand welfare.

34. Animal disease shall be health disturbance to animal

whichamongother things, caused by geneticdefect,

degenerative process, methabolism disorder, trauma,

intoxication, parasite infection, andpathogen microor­

ganism infection suchas virus, bacteria, fungus, and

rickets.

35. Infectiousanimaldisease that is infectedbetween the

animal andanimal,animaland human being, andani­

mal and other animal disease carrier agent by direct

contactor in~firect contactwith agentmechanism like

water, air, land, food,device, andhuman being, orwith

biological agent such as virus, bacteria, amoeba, or

fungus.

36. Strategic animal disease shall be animaldisease that

mayinfiicteconomical loss, uproarto the people, and/

or animaldeath in high rate.

37. Zoonosist shall bedisease that mayinfectfromanimal

to human beingor the other way round.

38. Veterinary communityhealth shall beall mattersthat

relate to animal andanimal productthat eitherdirectly

or indirectlyaffectshumanhealth.

39. Animal medicine shall be preparation that maybeuse

to cure animal, to set free all symtoms, or modify

chemical process in the bodycovering biologic prepa­

ration, pharmaceutical, premix, and natural prepara­

tion.

40. Husbandry toolsand machines shall beall equipment

used relating to husbandry activities andanimal health,

41. Animal health instrumentand machines shall bevet­

erinarian apparatus prepared and used for animalas

aid instrument in the provisionof animal health ser­

vice.

42. Animal welfareshallbe all matters relating to animal

physical and mental conditionsbased on the natural

behavior of animal that needs to be appliedand en­

forced for animal protection from any unreasonable

actionof anyperson againstthe animalthat is benefi­

cialto human being.

43. Animal health agent shall be person that runsactivi­

ties in the field of animal health based on the veteri­

narian medical competence andauthoritywhich by hi­

erarchy isinaccordance with the fonnaleducation and/

or certifiedtraining on animalhealth.

44. Animal health technology shall beall mattersthat re­

late to the developmentand application of science,

techonology, engineering, and industry in the field of

animal health.

45. Central government shallbe President of the Republic

of Indonesia that holds poweroverthe Government of

the UnitaryStateof the Republic of Indonesiaas re­

ferred to in the 1945 Constitution of the Stateof the

Republic of Indonesia.

46. Minister shallbeministerwhoseduty and responsibil­

ity are in the field of husbandry and animalhealth.

47. Regional Government shall be the Governor, Regent!

Mayor, and regional apparatus asoperatingelements

of regional administration.

48. Regional Administration shall be implementation of

administrative matters by regional governmentand

the house of the people's representatives based on

the principles of autonomy and assisting duty with

the principles of extensive authonomy in the system

andthe principles of the UnitaryStateof the Republic

of Indonesia as intended in the 1945 Constitution of

the UnitaryStateof the Republic of Indonesia.

49. Thenational animal health system hereinafter referred

to asSiskeswanas shall bethe system of animal health

elements in goodorder that interrelated soasto es­

tablishentirety that prevails nationwide.

CHAPTER IT

PRINGPLES AND OBJECTIVES

Article2

(1) Husbandry andanimalhealthshallbeconducted in all

territoriesof the UnityState of the Republic of Indone­

sia separately and/or integratedly with plantfoodcul­

tivation, hortikulture, plantation, fishery, forestry or

other related fields.

(2) Implementation of husbandry andanimal health shall

bebased onbenefitandcontinuity, security and health,

people oriented and just, transparently and integra­

tion, independent, partnership, and professional.

Article 3

Implementationof husbandry andanimal health

shall begoverned with the objectiveto:

a. manage animal resources with prestige, accountabil­

ity, and continuously for the maximum welfareof the

people;

b. suffice the need for animal-origin food,goods, andser­

viceindependently, competitively, andcontinuously for

improvement of the welfare of the breeders and the

people towardthenation pchievement forfooddefense;

c. protect, secure, and/or guaranteethe territory of the

Unitary State of the RepUblic of Indonesia from any

threat that may perturb the health or live of human

being, animal, plants, and the environment;

d. develop .....

ersandthe community; and

e. providelegalsecurityand certainty to enter into busi­

ness in the fieldof husbandry and animalhealth.

RESOURCES

PartOne

Land

Article4

Toguarantee certainty lrr the implementation of

husbandry andanimal health, it isnecessary to have avail­

ablelandthat complies with the technical requirement for

husbandry andanimal health.

Article 5

(1) Theprovision of land referredto in Article4 hasbeen

included in the space layoutof the territory in accor­

dance with the provisions in the statutory regulation.

(2) In the eventof a change madeto the territorial space

layoutthat causes a change to the landallocation for

husbandry and animalhealth, the replacement land

must be made available first of all in another place

that complies with the requirement for husbandry and

animal healthandagroecosystem.

(3) Exception shall be made from the provision on the

change to the space layout referred to in paragraph

(2) for landfor husbandry and animalhealthfor edu­

cation and/or research activities anddevelopment.

Article6

(1) Existence and benefit of the land that has been de­

cided aspublicherdingzonemust be preserved con­

tinuously,

(2) The publicherding zone referred to in paragraph (1)

shallfunctionas:

a. producerof food plants;

b. place for natural marriage, selection, castration,

andartificial insemination services;

c. place for animalhealthservice, and/or

d. placeor object for research and development of

hUsbandry andanimalhealthtechonology.

(3) The regencylmunicipality regional government

whereinits regionhasavailable landthat canprovide

and give priority to small scale livestockcultivation

shall be obliged to decide a plot of land as public

herdingzone.

(4) The regencylmunicipality regional governement shall

develop a kind of joint operationbetween husbandry

exploitation andfood plantsexploitation, holticulture,

fishery, plantation, and forestryand othersin utiliZing

the landsuch zoneasthe source of cheap foodfor the

livestock.

(5) Further provision on the provision andmanagement of

the publicherding zone referred to in paragraph (3)

shall be stipulated in regencylmunicipality regional

regulation.

Water

Article 7

(1) Thewater used for husbandry and animal healthpur­

poses must comply with the requirement for water

standard qualityaccording to itsallocation.

(2) In the case of available water is limitedat certain pe­

riodandthe zone,the animalneedfor water must be

prioritized after the community's need has been com­

plied With,

Genetic Resource

Article 8

(1) Genetic resource shall COIlSIitI.Irethe Indonesian nation's

asset controlled by the State and is utilized for the

maximum welfare of the people.

(2) Thecontrolof genetic resource by the State referred

to in paragraph (1) shallbe taken careof by the GoV­

ernment, regional administration of the province, or

regency/municipality regional administration in accor­

dance with the original circularof the geneticresource

concemed.

(3) Genetic resource shallbe managedby utilizingit ation

andpreservation activities.

(4) Thegenetic resource referredto in paragraph (3) shall

be madebycultivation dan refinery.

(5) Genetic resource preservation referred to in paragraph

(3) shallbe madeby conservation within and/or out­

sideits habitatandother efforts.

(6) Managementof genetic source of food plants shall com­

ply with the statutory regulationon plantscultivation

system.

Article9

(1) Anyperson utilizinqgeneticresource as referredto in

Article8 paragraph (4) shall be obliged to enter into

agreement with the Statecontrolling operatoron ge­

netic resource concerned as referred to in Article 8

paragraph (2).

(2) Theagreement referred to in paragraph (1) shall stipu­

late, among other things, distribution of profit from

the result of utiliZing the genetic resource and em­

powermentof the surrounding community in its utili-

zatlon.

(3) Utilization of geneticresource originating from wild life

shallcomplywith the statutory regulation on preser­

vation of natural resource and biological matter and

its ecosystem.

Article 10

(1)Thecultivation and refining referred to inArticle 8 para­

graph (4) shall be conducted by the Government, re­

gionalgovernmentof province, regency/municipality

regional government, the community, and/or corpo­

rate.

(2) TheGovernment shall be obliged to protectthe cultiva­

tion and refining businesses referredto in paragraph

(1).

(3) The cultivation and refining referred to in paragraph

(1) mustoptimize utilizationof various biological mat­

ters and preservation of geneticresource originating

from Indonesia.

(4) The Government and regional governmentshall de­

velop andsupervise everyperson conducting theculti­

vationand refiningas referred in paragraph (3).

Article 11

(1) Every person or national institution importingand/or

exporting genetic resource to and from the territory

of the UnitaryStateof the Republic of Indonesia shall

be obliged to obtain permit from the Minister in ac­

cordance with the provisions in the statutory regula­

tion.

(2) The provision referred to in paragraph (1) isalsovalid

for international institutionimporting and/orexporting

geneticresource to and from the territory of the Uni­

tary State ofthe Republic ofIndonesia.

(3) other than the provision referred to in paragraph (2), any foreign institution wishing to import and export genetic

resource, must first have agreement with the Government on transfer of genetic material in accordance with the

provisions in the statutory regulation.

Article 12

(1) Furtherprovision on geneticresource referred to in Article8 throughArticle11 shallbegovernedbyor shall be based

onGovernment Regulation.

(2) Furtherprovision on utilization and preservation of genetic resource includinganimal genetic resource and genetic

engineering shallbegovernedby law.

Germ,seed, andOvule

Article13

(1) Provision anddevelopmentof germ, seed, and/or ovuleshall beconducted by prioritizingdomesticproductandand

people orientedeconomic capability.

(2) TheGovernment shallbeobligedto develop seedling business and/or nurseryby involvingthe roleandparticipation

of the community in order to guaranteeavailable germs,seeds, and/or ovule.

(3) If no seedling and/or nurseryare developed yet by the community, the Government shallestablish seedling and/or

nursery units.

(4) Everygermor seedcirculatingmust bearvalidgermorseed certificatestating remarks on the historyandcharacter­

isticsof certainsuperiority,

(5) Thegermor seed validcertifICate referredto in paragraph (4) shall be issued bygerm or seed accredited certification

institutionor asappointedby the Minister.

Article14

(1) TheGovernment shall stipulate policy onnational nurs­

ery to motivate availability of certified seeds and/or

ovuleand supervision in its procurement andcircula­

tioncontinuously.

(2) The Government shall establish an area for germs/

seeds inanarea that potentially will produce cluster of

livestock with superiorquality andvarious typesof prod­

uctsand/or reproduction.

(3) The area for seed/ovule referred to in paragraph (2)

shall be determined bythe Minister byconsidering the

typesand clusters of livestock, agroclimate, popula­

tion density, social economy, culture, and knowledge

aswellastechnology.

(4) Further provision onpolicy for national nursery referred

to in paragraph (1) shallbegoverned in Government

Regulation.

Article15

(1) In certain circumstances importof germs and/orseeds

from overseas may be madein order to:

a. improve qualityandgeneticvariety;

b. develop knowledge andtechnology;

c. overcome shortgerms or seeds domestically; and/

or

d. coverthe requirements of research and develop­

ment.

(2) Import of germs or seedsmust complywith the re­

quirements for quality and animal health and the

statutory regulation on animal quarantine and ob­

serve the policy allocation for seeds as referred to

in Article 14.

(3) Anyperson importing the germsand/orseeds referred

to in paragraph (1) shallbe obliged to obtain permit

from the Ministerthat is in charge of tradingmatters

after obtaining recommendation from the Minister.

(4) Further provision on the requirements for animal qual­

ity health referred to in paragraph (2) shall be gov­

erned in Regulation of the Minister.

Article 16

(1) Export of germs, seeds and/orovulefromthe territory

of the Unitary State of the Republic of Indonesia to

overseas may be made if domestic needs have been

fulfilled andandlocal livestock preservation issecured.

(2) Any person conducting the activities referred to in

paragaraph (1) shallbe obliged to obtainpermitfrom

the Minister inchargeof trading mattersafterobtain­

ing recommendation from the Minister.

Article 17

(1) Quality improvementof germsand/or seeds shall be

made by establishing unpolluted groove and/orestab­

lishing new unpolluted furrow by cross-wise and/or

apply modern biotechnology.

(2) The modern biotechnology referred to in paragraph

(1) may be made so long that it does contravene reli­

gious norm and no inflicting loss to the variety of hu­

man biology, health, environment, and the people; as

well as the welfare of the animal.

(3) Application of modern biotechnology referred to in

paragraph (1) conducted specifically to produce ge­

netic-engineered livestock must comply with the pro­

vision referred to in paragraph (2) and the statutory

regulation on the biological security of genetic-engi­

neered product.

Article 18

(1) In the context of suffixing availability of seeds, the pro­

duction female ruminant livestock shall be selectedfor

refinery, while unproductive female ruminant livestock

shall be allocated as beef cattle.

(2) Productive female ruminant livestock shall be prohib­

ited from butchery since this is a well livestock pro­

ducer,except for research, refining, or control and and

prevention of animal disease.

(3) The Government and regency/municipality regional

government shall provide fund to trap productive

female ruminant livestock exported by the people

and accommodate the livestock at the technical op­

erator unit in the area for breeding and to make

(4) Further provisionon selection and elimination referred

to in paragraph (1) and trapping of'productive female

ruminant livestockas referred to in paragraph (3) shall

be governed in Regulation of the Minister.

Food

Article 19

(1) Any person conducting livestock cultivation shall be

obliged to suffice the need for his livestock food and

health.

(2) The Government and regional government shall be

manage husbandry businessof the breeder to suffice

and comply with the need for good food for his live­

stock.

(3) Tofull the good need referred to in paragraph (2), the

Government shall manage prioritize domestic indus­

trial development.

Article 20

(1) Supervision in the procurement and distribution of food

material and plants or food plants classified as food

material shall be conducted in coordincation inter­

agency or department.

(2) The coordination referred to in paragraph(1) shallcover

provision of land for the purpose of food plants cultiva­

tion, procurement of local foodi, and import of food

from overseas.

(3) Procurement and/or cultivation of plants shall be .

conducted by means of monoculture and/or

intergrated planting system with other types of

plants with due consideration of the ecosystem in

accordance with the statutory regulation on plants

cultivation system.

(4) In the context of procurement of food and/or food

material classified as food material, the Government

shall prioritize local base-food.

Article 21

The Minister shall stipulate the highest limit of

content in physical, chemical, and biological material in

the food and/or and/or food material.

Article22

(1) Any person producing food and/or food material for

commerdal drculationshallbe obligedto obtain busi­

ness license.

(2) Anyfoodmade for commercial circulation mustat least

comply with the standard or minimum technical re­

quirementand security of the food and comply with

the provision inthe method of manufacturing good food

asstipulated in Regulation of the Minister.

(3) The foodreferred to in paragraph (2) musthavelabel

in accordance with the statutory regulation.

(4) Anyperson shall be prohibited from:

a. circulating food that isgoodfor consumption;

b. using and/orcirculating ruminant foodthat contains

food material in the form of blood, meat, and/or

bones; and/or

c. using food that is mixedwith certain hormonand/

or foodantibioticsupplement.

(5) Furtherprovision referred to in paragraph (4) letter c

shall bestipulated in Regulation of the Minister.

Article23

Any food and/or food material from overseas or

exported from fhe country must complywith the pro­

vision of technical and helath requrirements and the

statutory regulation on quarantine.

PartThree

InstrumentandMachinery for Husbandry

Article 24

(1) The Government shall deterimethe type andstandard

of instrumentand machinery for husbandry whichcir­

culation needs surveillance.

(2) Instrument andmachinary produced and/or imported

intothe territory of the UnitaryStateof the Republic of

Indonesiamust prioritizethe safetyandsecurity of its

user.

(3) Instrumentandmachinery for husbandry produced and/

or imported to the territory of the UnitaryStateof the

Republic of Indonesia referred to paragraph (2) which

circulation needs surveillance must betestedbeforeit

circulated.

Article25

(1) Any person producing or importing instrument and

machinery from oversease for circulation must pro­

videspareparts.

(2) TheGovernment shall manage andfacilitate thegrowth

of local instrument and machinery industry for hus­

bandry.

(3) The Government shall manage and supervise pro­

curementand ciruclation of instrument and machin-

ery.

Article 27

(1) Cultivation isbusiness to reardomestic animal andpro­

duceanimal product.

(2) Cultivation maybe developed ina cultivation zone based

on the provision of space layout as referred to in Ar­

ticle 5.

(3) Determination of cultivation area referred to in para­

graph (2) shall be governed based on Regulation of

the Ministerasguided by the statutory regulation on

space layout.

(4) Cultivation utilizing wild life shall be implemented in

accordance with the statutory regulation on preserva­

tion of biological resource and its ecosystem.

Article 28

(1) TheGovernment shalldeterminethe animal produced

by cultivationthat utilizeswild life as livestock so long

its geneticpopulation isstableand no longerdepend­

ing on the type ofits population in its natural habitat.

(2) Wildlife either from natural habitat or resulting from

breedingmay be utilized in the cultivation to produce

domestic animal so long it is in accordance with the

provisions in the statutory regulationon preservation

of wild life.

(3) The wild life referred to in paragraphs (1) and (2) is

excluded from wild life which whole or part of its life

span is in water.

Article 29

(1) Livestock cultivation maybeconducted bythe breeder,

husbandry companyand certain party for special in­

terest.

(2) Thebreeder caltivating livestock with the typeandnum­

ber below a certain business scale shall be granted

husbandry business listby regency/municipality regional

government.

(3) Anyhusbandry company cultivating livestock with the

type and numberof livestock above acertain business

scale must have business licence for husbandry from

regency/municipality regional government.

(4) The breeder, husbandry business and certain party

exploiting livestock with a certainbusiness scale shall

be obligedto follow the procedure for good livestock

cultivation withoutinterfering public orderinaocordance

With the provision in the quideline stipulated by the

Minister.

(5) TheGovernment shallbeobligedto protect local hus­

bandry business from unfair competition among the

market players.

donesian legal entity or non legalentity.

in paragraph (1) may enter into joint operation with

tion on capital investmentand other relevenatstatu­

tory regulation.

Article31

(1) The breeder may excercise business partner on live­

stock cultivation based on agreement that mutually

need, strengthening, beneficial each other and jUdi­

ciously.

(2) The business partnership referred to in paragraph (1)

maybeentered into:

a. between the breeders;

b. between the breederand husbandry business;

c. between the breeder and the company in other

fields; and

d. between husbandry business and the Government

or Reg ional Government.

(3) TheGovernment andRegional Government shall man­

agethe partnership referred to in paragraph (2) with

dueobservance of the provisions in the statutoryregu­

lationon business partnership.

Article32

(1) The Government and regional government shall

endevour that asmanypeople aspossible conduct live­

stockcultivation.

(2) TheGovernment and regional government shall facili­

tate and manage cultivation development conducted

by the breeders and certain party having specific in­

terest.

(3) TheGovernment and regional governmentshall man­

Article33

Furtherprovision on cultivation referred to in Ar­

ticle 27 up to Article 32 shall be governed in Presidential

Regulation.

PartFive

Harvest, Post-Harvest, Marketing and

Husbandry Result Process Industry

Article34

(1)Thebreeder andhusbandry business shall conduct good

harvesting systemin order to obtaingoodproduction

result in highamountand quality.

(2) Harvesting cultivation result mustcomplywith the re­

quirement for animal health, biological security, and

religious norm, ethicsand estatics.

Article35

(1) TheGovernment and regional government shall facili­

tate development of small andmedium scale post-har­

vestanimal product unit.

(2) The Government and regional government shall facili­

tate thedevelopment of post-harvest business unitthat

utilize animal product as food basic material, food,

pharmacy, and industry.

productdomestically and overseas.

(2) The marketing referred to in paragraph (1) must be

given priority to manageimprovementof production

andconsumption of animalprotein in the accomplish­

ment of availability of balance nutricious food for the

people bykeepimprovingthe welfareof the business

players on husbandry.

(3) Overseas exportofanimalor livestock andanimal prod­

uctsreferred to in paragraph (1) shall be madeif local

production and"supply sufficiethe need for the people

consumption.

(4) Import of animalor livestock and animalproductfrom

overseas shall be madeif domestickanimal products

andsupply or livestock is insufficient to fulfill the need

for the people consumption.

(5) TheGovernment shall be obligedto createhealthbusi­

ness atmosphere for the animalor livestock and ani­

malproduct.

Article37

(1)TheGovernment shall manage andfacilitate the growth

of animal product industry by prioritizing the use of

localbasic material.

(2) The Government shall manage development of

health business partnership between processing

industry and the breeders and/or cooperativesthat

produce animal product used as basic material for

industry.

(3) Furtherprovision referredto in paragraph (1) shall be

madein accordance with the statutory regulation on

industry, exceptfor mattersgoverned in this Law.

Article38

Furtherprovision on harverst, post-harvest, mar­

ferred to in Article 34 up to Article 37, exceptthosegov­

erned in the provision in the statutoryregulation on indus­

try, shall be governedin Regulation of the Minister.

CHAPTER V

ANIMAL HEALTH

PartOne

Control andPrevention of Animal Disease

Article39

(1)Control and prevention ofanimal disease constitute imple­

mentation of animal health andenvironmental health in

the formof observance and identification, prevention,

safeguarding, eradication and/ormedication.

(2) Animal health matter shallbe approached with main­

tenance, healthimprovement, (promotion), prevention

of disease, cure of disease, and health rehabilation,

andconducted entirely, integrated andcontinuously.

(3) In the context of effective control and prevention of

animal disease referred to in paragraph (1), various

approaches in animal health matter as referredto in

paragraph (2), the Government shall develop a policy

on animal health nation-wide in order to guarantee

integrated and continuous animal health in various

ecosystem environments.

(1) Animal disease observance and identification referred

to in Article 39 paragraph (1) shall be conducted

through surveillance and mapping, investigation and

early warning, examination and testing, and report­

ing.

(2) The Ministershall determine the type of animal dis­

ease, the map and status of the animal disease and

exoticdisease that threthensthe healthof animal,hu­

manbeing,and the environment based on the result

of surveillance and identification asreferredto in para­

graph(1).

(3) Survelllance and identificationof animal disease shall

beconducted by accredited veterinary.

(4) In the absence of laboratory referred to in paragraph

(3), the Ministershall designatea laboratory for sur­

veillance and identification of animaldisease.

(5) The Minister shallstipulatea gUideline for sUlVeillance

and identification of animaldisease referredto in para­

graph(1).

Article41

Prevention of animaldisease referred to in Article 39

shall beconducted based on the provision in the statu­

tory regulation on animalquarantine.

Article42

(1) 5uIVeillance of animaldisease referred to in Article39

shallbeconducted by:

a. strategic determination of infectious animal disease;

b. allocating safeguarding zonefor animaldisease;

c. applying biosafety and biosecurity procedures;

d. immunizing the animal;

e. supervising animal traffic,animal product, andother

animaldisease carrieroutsidethe quarantine work

area,

f. implementationof emergencyalert by the veteri­

narian;and/or

g. applicationof early alertness.

(2) Further provision on safeguarding of animaldisease

referred to in paragraph (1) shall be governed in Regu­

lation of the Minister.

(3) In the contextof safeguarding from animaldisease at

productionanimal centersand/or wild life, the Minis­

ter shalldecidea safeguarding zonefree from animal

disease.

(4) The Government shall developand manage supervi­

sory system system of veterinary information in the

implementation of supervisoryand provideavailable

dataand information on animaldisease.

(5) Anyperson importingand/or exportinganimal, animal

product,and/or disease carriermedia shall beobliged

to comply With the technical requirement of animal

health.

(6) TheMinistre shallstipulatemanagement of veterinary

emergency alert to anticipateevent of infectious ani­

maldisease particularlyexotic disease.

Article43

(1) The Ministershall determine the type of strategic in­

fectious animaldisease insafeguarding theanimal dis­

ease referred to in Article 42 paragraph (1) letter a.

(2) The Governmentand regional government based on

their respective authority shall safeguard strategic

ease referred to in paragraph (1).

Article44

(1) Eradjcation of animal disease referred to in Article 39

shall coverclosure of the area, limitinganimal traffic,

animal immunization, isolation ofsickanimal oralleged

to be sickanimal, eradication of carcasses, eradica­

tion of animal disease, andanimal de-population,

(2) The de-population referred to in paragraph (1) shall

be conducted with due observanceof the status of

animal preservation and/orthe statusofqualityof ani­

malgenetic.

(3) Nocompensation shall be provdedbythe Government

to any person conducting de-population against his

animal which positively hasbeen infected with disease

as referred to in paragraph (1).

(4)TheGovernment shall provide compensation to healty

animal based on the guideline that eradication of ani­

maldisease epidemic shall be conducted byde-popu­

lation.

(5) Further provision on eradication of animal disease as

referred to in paragraphs (1) through(4) shall begov­

erned in Regulation of the Minister.

Article45·

(1) Any person, including livestock, animal owner, andhus­

bandrybusiness maklngbusiness on husbandry that

acknowledges occurrence of infectious animal disease

shallbe obliged to reportsuchoccurrence to theGov­

ernment, Regional government and/or the local au­

thorized veterinarian.

(2) The Minister shalldetermine statusof the areaas in­

fected area,alleged infected area,andarea freefrom

infectious animal disease, aswellasa gUideline on its

eradication.

(3) The regional government of province shall supervise

application of the gUideline on eradication of animal

disease referred to in paragraph (2).

(4) Regency/municipality regional government shall stipu­

lateguideline oneradication of animal disease referred

to in paragraph (3).

Article46

(1) TheMinister shall stateandannounce to public onthe

occurrence of infectious animal disease in a certain

areabased on report of the Governor and/or regent!

mayorafterobtaining investigation resultfromveteri­

narian laboratory from veterinary authority in the local

region.

(2) In theeventthat anyarea isdeclared asepidemic area,

the regional governmel}t of province or regency ormu­

nicipality governmentshallbe obliged to close the in­

fectedarea,takeallmeasures of safeguarding, eradi­

cation, andallocation of sufficient fundotherthanthe

fund provided bythe Government.

(3) In the eventthat the infectious animal disease referred

to in jlaragraph (1) isexoticinfectious animaldisease,

all actions of eradication must.be takenagainstall ani­

malsthat havebeeninfected with dueobservance of

the statusanimal preservation concerned.

(4) Eradication of rareanimal and/orprotected animal shall

beconducted in accordance with the statutoryregula­

tion onpreservation of biological natural resource and

its ecosystem.

(5) Every person is prohibitedfrom exportingand/or im­

porting animal, animal product, and/ormedia that pos­

siblycarry other type of disease from infectious area

and/or area alleged to been infected to free-disease

area.

(6) The provision on eradication referredto in paragraph

(2) anderadication of animalreferred to in paragraph

(3) is exempted to livestock seeds produced by hus­

bandrybusiness nurserydeclared free by the veteri­

naryauthority.

(7) Declaration of free infectious disease inhusbandry busi­

ness on nursery bythe veterinary authorityreferred to

in paragraph (6) shall be stipulated in Regulation of

the Minister.

Article47

(1) Animal medication shall be the responsibility of the

animalowner, breeder, or husbandry business, either

themselves orwiththeassistlnceof animal healthforce.

(2) The animal medication referred to in paragraph (1)

using strong medine and/or parenthal medicine

must be given under the supervision of the veteri­

narian.

(3) Animal or group of animal that suffers incurable dis­

ease based on veterinarian visum must be given

euthanisia and/or eradicated by veterinaryforcewith

dueobservance of the provision on animal welfare.

(4) Animal or group of animals suffering infectious dis­

easeand incurable based on the visumconducted by

authorized veterinaryandendangering human lifeand

the environmentmust beeradicated at the request of

the animal owner, the Government, and/or regional

Government

(5) Nocompensation shall beprovided by the Government

for such animalbased.on the guidelineon animal suf­

fering disease epidemic that must beeradicated.

(6) The euthanasia or eradication of animal or group of

animals referredto in paragraphs (3) and(4) shall be

conducted by the veterinatiran and/or animal health

forceunderthe supervision of the veterinarian incom­

pliance with the provision on animalwelfare.

Article48

Further provision on observation, safeguarding,

eradication of animal disease, medication, and technical

requirement of animalhealth, including provision of com­

pensation as referredto in Articles 39through47 shall be

governed in Regulation of the Government.

PartTwo

Animal Medicine

Article49

(1) Based on preparation, animalmedicine maybeclassi­

fied in biological preparation, pharmaceutical, premix,

and naturalmedidne.

preparation, local isolation of the parentshall bekept

in the laboratory and/or research institutionandvet­

erinarian development.

(4) Toguarantee availability andcontinous premixprepa­

rationin small andmedium scale husbandry develop­

ment, the Government shall facilitate distributionof

domestic premix preparation.

(5) Further provision ondistribution of premixpreparation

referred to in paragraph (4) shall begoverned inRegu­

lationof the Minister.

Artide50

(1) Animal medicinemade available and prepared for

circulation purpose must bear registration num­

ber.

(2) Toobtainregistration numbre, everyanimal medicine

must be registered, assessed, tested and prOVided

qualitycertificate after having passed assessment and

testing.

(3) Themanufacturing, preparation, andtestingof medi­

calmedicine mustbeconducted underthesupervision

of veterinary authority.

(4) TheGovernment and regional governmentbased on

their respective authority shall supervise the manu­

facturing, preparation andcirculation of animal medi­

cine.

Article51

(1) Strong medicine used tosafeguard animal disease and/

ormedication of sick animal maybeobtained onlywith

veterinarian prescription.

(2) Use of strongmedicine must be conducted underthe

supervision of the veterinarian or animal health force.

(3) Every person is prohibited from using certain animal

medicine on livestock which product is for consump­

tion of human being.

(4) Further provision on prohibition fromusing certain ani­

malmedicine referred to in paragraph (3) shall begov­

erned in Regulation of the Minister.

Article52

(1) Any person attemptingbusiness in the manufacturing,

preparation, and/orcirculation ofanimal medicine shall

be obliged to to hold business license in accordance

with the provisions in the statutoryregulation.

(2) Every person is prohibited from manufacturing, mak­

ingavailable, and/orcirculating animal medicine:

a. in the form of biologic preparation which disease

does notexist in Indonesia;

b. which bears noregistration number;

c. which hasno labeland mark; and

d. which failsto comply with the qualitystandard.

Article53

(1) Manufacturing of biologic preparation which disease

does notexistin Indonesia for the purpose of protect­

ing national interestandassist in the control andpre­

vention of animal disease inotherothercountries must

(1) Preparation of animal medicine shallprioritize domes­

tic product.

(2) If the animal medicine referred to in paragraph (1)

maynot be produced or fails to suffice local needs, its

preparation maybe fulfilled by overseas product.

(3) Import of animal medicine for circulation in the ter­

ritory of the UnitaryStateof the Republic of Indone­

sia must comply with the requirements on circula­

tion of animal medicine as referred to in Article 50

paragraph (1) and the statutory regulation on quar­

antine.

(4) Exportof domestically produced animal medicine to

overseas mustprioritizethe nation'sinterest•

. (5) Further provision on import and export from and to

overseas asreferred to in paragraphs (2), (3) and (4)

shall be governed in Regulation ofthe Minister.

Article 55

(1) TheGovernment shalldeterminethe type andquality

standard of the device andmachinery for animal health

whichprocurement andcirculation need supervision.

(2) Device andmachinery for animal health manufactured

or Importedfor circulation in the territory of the Uni­

tary Stateof the RepubliC of Indonesiamust comply

with the provisions in the statutory regulation.

(3) Anyperson manufacturing, importingandcirculating

device andmachinery for animal health to the territory

of the Unitary State of the Republic of Indonesia as

referred to in paragraph (2) shall be obliged to pro­

videafter sale service andconduct transferof technol-

ogy.

(4) Furtherprovision on device and machinery for animal

health referredto in paragraphs (1) through(3) shall

be governed in Regulation of the Minister.

Health of veterinarians is implementation of ani­

complying with the provision inArticles 40through 47.

(3) Otherthanthe provision referredto in paragraph (2),

the controland prevention of zoonosis referredto in

paragraph (1) mustbeconducted in coordination with

the relevant Minister.

(1) In thecontextof guaranteeing secure, healthy, totally,

permitted animal product, the Governmentandregional

governmentaccording to theirrespectiveauthority shall

"be obliged to supervise, examine, test, standardize,

certifyandregister the animal product.

(2)The supervision andexamination of animal productshall

beconsecutively conducted at the production spot, at

butchering, at ammodating andcollection place, when

the productisstill fresh beforeit is put into preserva­

tionanddUring circulation after it ispreserved.

(3) Standardization, certification, andregistration of ani­

mal product must be conducted on animal product

which isproduced in and/or imported into the Unitary

State of the Republic ofIndonesiafor circulation from

the UnitaryState of the Republicof Indonesia.

(4) Animal product produced at and/or imported in the

UnitaryStateof the Republic of Indonesia for circula­

tion must certifiedbyveterinarian andmustbecerti­

fiedaspermittedfor consumption.

(5) Animal product exported fromtheUnitary State of the

Republic of Indonesia must bear veterinarian certifi­

cateandpermittedfor consumption certificate asre­

quired by the importing country.

(6) Furtherprovision on what referred to in paragraphs

(1) through(S) shall begovemed in Regulation of the

Minister.

(7) Forprocessed foodoriginating from animal, otherthan

obliged to comply withtheprovision referred to inpara­

graph(S)mustcomply with the provision in the statu­

tory regulation on food.

ArticleS9

(1) Anyperson importing animal product to the territoryof

the UnitaryStateof the Republic of Indonesia shall be

obliged to obtain license for import fromthe relevant

Minister on tradeafter obtaining recommendation for:

a. freshanimalproductfrom the Minister; or

b. processed animal product frommanagement of the

agency responsible forsupervision of medicine and

foodfrom the Minister.

(2) Thefresh animal product imported intothe territoryof

the UnitaryStateof the Republic of Indonesia referred

to paragraph (1) lettera mustcome from animal prod­

uctbusiness unit of the countryor zone of the country

that complies with the requirements and procedure

for importinganimalproduct.

(3) Processed animalproductto be importedto the terri­

tory of the UnitaryStateof the Republic of Indonesia

referred to in paragraph (1) letter b, that isstill haVing

the riskfrom spread of zoonosis maythreaten the health

of human being, must obtain recommendation of the

Ministerprior to license by the management of the

agency that is responsible onthe supervision of medi­

cineandfood.

(4) The requirement and procedure for importinganimal

product from overseas to the territory of the Unitary

State of the Republic of Indonesia as referred to in

paragraphs (2) and(3) shall referto international pro-

visions or norms based on risk analysis on animal

healthandveterinarians and prioritizethe nation's in­

terest.

(5) Furtherprovision on requirements and procedure for

importinganimalproductinto the territory of the Uni­

tary Stateof the Republic of Indonesia referredto in

paragraphs (1) through(4) shall begoverned in Regu­

lationof the Minister.

Article60

(1) Any person havinq business unit for animal product

shallbeobligedto submitapplication for veterinarian

control number to the regional government of prov­

incebased on the guideline stipulated bythe Minister.

(2) Regency/municipality regional government shall man­

age business unit that produces and/or circulates

animal product produced by small scale home in­

dustry that doesnot haveveterinarycontrol number

yet.

Article61

(1) Butchery of animalwhichmeat iscirculated must:

a. beconducted at the butchering house; and

b. comply with the methodof butchering according to

the normsof healthpracticed byveterinarians and

and welfareof the animal.

(2) In the contextof guaranteeing publicpeace of mind,

slaughtering of animal referred to in paragraph (1)

letter b must observe religious 'norm and faith of the

people.

(3) The Ministershallstipulate requirements for slaugh­

tering houseand procedure for decentslaughering of

animal.

(4) Theprovision on slaughtering referred to in paragraph

(1) lettera isexempted for slaugthering inthe interest

of religious festive days, customary ceremony, and

emergency slaugheting.

Article62

(1) Regency/municipality governmentshall beobliged to

own slaughtering house that complies with technical

requirement,

(2) The animal slaughtering house referred to in para­

graph (1) may be endevored by every person after

having obtained business license from the regent!

mayor.

(3) Animal slaughtering house referred to in paraqraph

(2) must beconducted underthe supervision of autho­

rizedveterinarian on supervision.

Further provision on supervision, examination,

testing,standardization andcertification of animalproduct

referred to in Artide 58 paragraph(1), procedure for im­

paragraph (1) letter b, Stateallocation and/or zone, busi­

nessunit of animal product, and procedurefor importing

freshanimalproductasreferredto in Article59paragraph

(2), and alertness and preventionof disasteras referred

to in Article64shallbe governed in Regulation ofthe Gov­

ernment.

AnimalWelfare

Article66

(1) In the interest of animalwelfareall measures shallbe

taken that relateto catchingandhandling, placement

and multiplication, care, transportation, slaughtering

dan killing, as well as reasonable treatment and ten­

der careof animal.

(2) The provisionon animal welfare referred to in para­

graph (1) shall be implementedwith humanitycover­

ing that:

a. catching and handling of wild life and its habitat

must comply with the provisions in the statutory

regulation on conservation;

misuse;

f. slughtering and killingof animalshall beconducted

properlysothat the animalfeel free from pain,fear

and under pressure, torture, and misuse;and

g. ill treatment, torturing and misuseof animal must

beavoided.

(3) The provision relatingto implementation of the animal

welfareshall beconducted for all typesof animalsthat

bearbackbone and someofthe animals that have no

backbone that canfeel pain.

(4) Furtherprovision onanimalwelfare referredto in para­

graphs (1), (2), and (3) shall be governed in Regula­

tion of the Minister.

Article 67

Theanimalwelfare referred to in Article 66 para­

graphs (1) and (2) shall Be implemented by the Govern­

ment and regional government.

CHAPTER VII

VETERINARY AUTHORTIY

Article68

(1) Implementationof animalhealth in all territoriesof the

Unitary State of the Republic of Indonesiashall need

veterinaryauthority.

(2) In the implementationof veterinaryauthority referred

to in paragraph (1), the Governmentshall stipulate

Siskeswanas.

(3) In the implementation of Siskeswanas referred to in

paragraph (2), the Governmentand/or regional gov­

ernment accordingto their respectauthority shallde­

cide authorized veterinarian, improve the roleandfunc­

tion of animal health implementing institution aswell

as implementcoordination with due observance of the

provision of the statutory regulation on regional ad­

ministration" also take role in the accomplishment of

animal health through the Siskeswanas referredto in

paragraph (2), the Ministermaydelegate hisauthority

to the veterinaryauthority.

(4) The authorized veterinary together with the profes­

sional veterinarian organization shall conduct

Siskeswanas by empowering animal health potential

force and manage the implementation of the veteri­

narianpractices in all territories of UnitaryStateof the

Republic of Indonesia.

(5) Otherthan implementing controland prevention of ani­

mal disease, health of the veterinarians, and/or ani­

malwelfare,the authorized veterinarian shall also pro­

vide animal health serviCe, governing animal health

force, conduct reproduction, preservation medically,

veterinary forensic, and comparison developmentof

animal by veterinarian.

(6) Further provisionon implementation of animalhealth

referredto in paragraphs (1) through (3) shall begov­

erned in GovernmentRegulation.

Article 69

(1) Animal health serviceshallcoverveterinary laboratory

service .

(2) Anyperson makingbusiness on animal health service

referredto in paragraph (1) shall be obliged to hold

business license from the Regent/Mayor

Artilce 70

(1) To fulfill the needfor animal health, the Government

shall govern and make available as well as provide­

places for animal health in all territories of the Unitary

Stateof the Republic of Indonesiaas needed.

(2) Animal health force referred to in paragraph(1) con­

sists of medical veterinarian and veterinary

paramedists.

(3) The medical veterinarian referred to in paragraph (2)

shall coverveterinarian andspecialist veterinarian.

(4) Veterinary paramedists referred to in paragraph (2)

mustholdanimal healthdiplomaand/or animalhealth

vocational certificate.

(5) Further provision onthe criteria of animal healthforce

referred to inparagraph (2) shall begovemed in Regu­

lationof the Minister.

Article71

(1) Medical veterinary force shall conductall matters on

animal health according to the medical veterinary com­

petence he/sheobtainsin veterinaryeducation..

(2) Veterinary paramedists force and animalveterinarian

shall conduct all matters on animal health based on

their competence andshallconductthis underthe su­

pervision ofthe veterinarian.

(3)The specialist veterinarian and/or veterinarian that has

obtained competence certificate from professional

veterians organization and/orcertificate recognized by

the Government may conductall matters on animal

health.

(4) In conducting all the mattersreferred to in paragraphs

(1) and (2), the animalhealth forceshall beobliged to

obey the codeof ethic and firmly holdhis/herprofes­

sionaloath or pledge.

Article 72

(1) The animal health conducting animal health service

shall beobligedto hold license certificate to run prac­

tice on animalhealth issued bythe Regent/Mayor.

(2) Toobtain license certificate to run practice on animal

health referredto in paragraph (1), the animal health

force concerned must apply for license certificate for

practiceto the Regent/Mayor supported bycertificate

of competence from the professional veterinarian or­

ganization.

(3) Foreign animalhealth forcemaypractice animal health

service in the territory of the UnitaryStateof the Re­

public of Indonesia based on bilateral agreement or

multilateral agreementbetween the Indonesian Gov­

ernment and foreign institution based on the provi­

sions in the statutory regulation.

Article 73

(1) TheGovernment shall be obliged to manage andfacili­

tate implementation of reproduction and preservation

medically, andveterinaryforensic.

(2) Medical reproduction, preservation andforensic, to the

extent they relate to widld life and/or animal that live

Article74

(1) In thecontextof improving the utilization of animal as

laboratory animal andmodelanimal for research and/

or utilization of animal organfor the welfareof human

beingmedical science of comparison on animalshall

beapplied.

(2) Application of medical science of comparison referred

to in paragraph (1) mustbe conducted:

a. underthe supervision of competentveterinarian;

b. according to ethicon animal andethicof veterinar­

ian; and

c. with dueconsideration of the welfareof animal.

Article75

Furtherprovision on animal health referredto in

Articles 70 through 74 shall be governed in Government

Regulation.

CHAPTER VIII

ENFORCEMENT OF BREEDERS AND BUSINESS ON

HUSBANDRYAND ANIMAL HEALTI-f

Article76

(1) Enforcement of breeders, business on husbandry, and

business onanimalhealthshall be conducted by pro­

viding facilities for business advancement onhusbandry

andanimal health aswell as improvement incompeti­

tion.

(2) The facility referredto in paragraph (1) shallcover:

a. access to the source of breeding, finance, capital,

science and technology as wellas information;

b. services on husbandry, animal health,andtechni­

cal assistance;

c. avoidance of charges that maycause high economi­

calcost;

d. management of partnership in improving synergy

inter-businesses;

e. createbusiness favorable atmosphere and/or im­

proveprivatebusiness;

f. prioritize utilization of domestic husbandry resource

andanimal health;

g. facilitate development of established husbandry

business zone;

h. facilitatepromotion andmarketing; and/or

i. protectionof priceand animalproductfrom over­

seas.

(3) The Government and regional government together

with the stakeholders on husbandry andanimal health

shall empowerthe breeders to improve the welfare of

the breeders.

(4) TheGovernment and regional government shall moti­

vateandfacilitate developmentof animal product stipu­

latedasstrategicfood material inaccomplishing food

defense.

(5) Furtherprovision on the facilities referred to in para­

graphs(1) and (2) shall be governed in or based on

Government Regulation.

Article77

(1) The Governmentand regional governmentshall protext

the breeders from action that contains explOitation by

other party for the purpose of obtaining reseaonable

income.

vent misuse of the policyon capital and/or fiscal for

the purpose of empowering the breeders, husbandry

business, andanimalhealthbusiness.

(3) TheGovernment and regional governmentshall enter

into partnership business on husbandry business and

animal health that caused exploitation thus inflicting

lossto the breeders and the people.

CHAPTER IX

DEVELOPMENT OF HUMAN RESOURCE

Article78

(1) Human resource on husbandry andanimal healthshall

cover theGovernment elements, regional government,

business operator, andall parties related to husbandry

andanimal health.

(2) Qualityof human resource on husbandry and animal

health referred to in paragraph (1) needs improve­

ment and development in order to improve the skill,

professionilsm, independence, dedication anddecent

manner.

(3) Quality development of human resource on husbandry

andanimal healthshall be implemented by means of:

a. education and training;

b. information publication; and/or

c. otherdevelopment with dueobservance of the need

for work competence, peopleculture,andaccord­

ing to the growth of science and technology.

(4) The Government and regional government through

educational institution and business circleshallfacili­

tate anddevelop education andtrainingaswellaspre­

vision of information relating to provision of compe­

tent human resource on husbandry andanimal health.

(5) The Government and regional governmentshall pro­

vide information on husbandry and animalhealth as

well as motivate the manage husbandry and animal

healthanddevelop roleof the people to conduct good

husbandry andanimalhealth.

(6) TheGovernment and regionalgovernmentshall con­

duct information provision and public education on

husbandry andanimalhealthbyattempting improve­

ment in nutrition awareness of the people in consum­

ing safe,healthy,solid and permissible animal prod­

uct.

(7) The Government shall develop and facilitate vari­

ous methods of development of human resources

on husbandryand animal health referred to in para­

graph (3).

(8) Furtherprovision on means of development of human

resource quality referred to in paragraph (3) letter c

shall be governed in Regulation of the Minister.

CHAPTER X

RESEARCH AND DEVELOPMENT

Article79

(1) The Government and regional government shall be

obliged to conduct research anddevelopment of hus­

bandry andanimalhealth.

(2) Research and developmentof husbandry and animal

health may be conducted bythe Government, regional

government institution, individual, community own ini­

tiative institution,or business circle or joint operation.

(3) TheGovernment and regional governmentshall man­

age and developgood joint operation inter-research

anddevelopment operatorson husbandry andanimal

health,either nationallyor intemationally.

(1) Foreign citizen indldlvuals and/or foreign legal entity

conducting research and developmenton husbandry

and animal health shall first obtain license from the

authorized governmentagencyin chargeof research

anddevelopment, andapplication of science andtech­

nology.

(2) Foreign citizen individual and/or legalentity referred to

in paragraph (1) in conducting research mustcooper­

ate with the local researcher or research institution.

Article81

The Stateshall provideprotection to intellectual

property rights resulting from applicationof inventionof

science andtechnology on husbandry andanimalhealth.

Article82

The research and technologyrelating to genetic

engineering on husbandry andanimalhealthmay be con­

ducted totheextentthey donotcontravene religioUS norms,

human health, animal health andgrowthandenvironment,

welfareof animal, and not inflicting lossto biological vari-

ety.

Article83

Provision on the implementation of research and

development aswellasapplication of science andtechnol­

ogyon husbandry andanimal healthshall complywith the

provision in the statutoryregulation.

CHAPTER XI

INVEST1GAllON

Article84

authorityas investigator in accordance with the provi­

sions in the statutory regulation.

(2) The Civil5ervant Official referred to in paragraph (1)

isauthorized to:

a. conductexamination on the authenticityof the re­

port or informationpertaining to criminal action on

husbandry andanimalhealth;

b. conduct examination of every person alleged tohave

committed criminal action on husbandry and ani­

mal health;

c. ask for information andevidence fromanyperson

pertaining to any event of criminal actionon hus­

bandryandanimalhealth;

d. conduct examination on accounting, record, and

other documentrelatingto criminalactionon hus­

bandryandanimalhealth;

e. conduct examination at certain placealleged to

have kept evidence of accounting, record and

other document and to conflscate the result of

violation that may institute evidencein the case

of criminal action on husbandry and animal

health; and/or

f. askexpert assistance in the implementation of the

duty to investigate criminal action onhusbandry and

animalhealth.

(3) The Civil5ervant Official referredto In paragraph (1)

shall notify when the investigation will be conducted

and shalldeliver the result of his/her investigation to

the publicprosecutor in accordance with the Civil Pro­

cedural Code.

Article 85

(1) Any person violating the provision referred to in

Article 9 paragraph (1), Article 11 paragraph (1),

Article 13 paragraph (4), Article 15 paragraph (3),

Article 18 paragraph (2), Article 19 paragraph (1),

Article 22 paragraph (1) paragraph (2), Article 23,

Article 24 paragraph (2), Article 25 paragraph (1),

Article 29 paragraph (3), Article 42 paragraph (5),

Article 45 paragraph (1), Article 47 paragraph (2)

or paragraph (3), Article 50 paragraph (3), Ar­

ticle 51 paragraph (2), Article 52 paragraph (1),

Article 54 paragraph (3), Article 58 paragraph (5),

Article 59 paragraph (2), Article 61 paragraph (1)

or.paragraph (2), Article 62 paragraph (2) or para­

graph (3), Article 69 paragraph (2), and Article

72 paragraph (1) shall be charged administrative

penalty.

(2) The administra penalty referred to in paragraph (1)

may be in the form of:

a. written reminder;

b. temporarily stop activity, producing, and/or circu­

lating;

c. revokingregistration number and withdrawing ani­

mal medicine, food, device and machinery, or ani­

mal product circulation;

d. revoking the license; or

e. charge penalty.

(3) Further provision on the procedure for charging ad­

ministrative penalty referred to in paragraph (2) let­

ters a throughd shall begovernedinGovernmentRegu­

lation.

(4) The amount of penalty referred to in letter e shall be

charged on any person that:

a. slaughters ruminated productive small female live­

stock at least Rp1.000.000,00 (one million Rupi­

ahs) and maximum Rp5.000.000,00 (five million

Rupiahs);

b. slaughters ruminated productive large female live­

stockat least Rp5.000.000,OO (five millionRupiahs)

and maximum Rp25.000.000,00 (twenty-five mil­

lion Rupiahs); and

c. violates other than those stated in letter a and b at

least Rp5.000.000,00 (five million Rupiahs) and

maximum Rp500.000.000,00(five hundred million

Rupiahs).

(5) The amount of penalty referred to in paragraph (4)

plus 1/3 (one-third) of the penalty if the violation re­

ferred to in paragraph (1) shall be chargted by the

authorized official or corporate.

CHAPTER XIII

CRIMINAl PROVISION

Article 86

Any person slaughtering:

a. productive small female ruminated livestock referred

to in Article 18 paragraph (2) shall be charged crimi­

nal action with criminal imprisonementof at least one

(1) month and maximum six (6) months and/or a fine

of at least Rp1.000.000,00 (one million Rupiah) and

maximum Rp5.000.000,00 (five million Rupiahs);and

b. productive large female ruminated livestock referred

to in Article 18 paragraph (2) shall be criminally im­

prisoned for at least three ( 3) months and maximum

nine (9) months and/or a fine of at least

Rp5.000.000.00 .....

Any person producing and/or circulating any de­

viceandmachinery without prioritizingthe safetyandse­

curity of the machine to the users referredto in Artide 24

paragraph (2) and/or not yet tested in accordance with

the provision referredto in Artide 24 paragraph (3) shall

be criminally imprisoned for at leastthree (3) monthsand

maximum 11 (eleven) months and a fine of at least

Rp50.000.000,OO (fifty million Rupiahs) and maximum

Rp500.000.000,OO (five hundred millionRupiahs).

for at least two (2) year and maximum five (5) year

and/or a fine of at least Rp150.000.000,OO (one hun­

(1) If the criminal action is committed by a corporateor

declared survives until its validity expires for further

justified with the provisions in this Law and its imple­

mentation regulation;

b. application to obtain registration numberreferred to in

letter a submitted andstill in process shallbesettled in

accordance with the provision in the statutory regula­

tion on husbandry andanimalhealth;

c. business licence for husbandry, business license for ani­

malmedicine, business license for animalslaughtering

business, license for animalhealth service, and license

for veterinarian practice shall remain valid to the ex­

tent that they do not contraveneand not revoked by

this Law; and/or

CHAPTER XV

CLOSING PROVISION

Allexisting implementing regulations of the statu­

tory regulation on husbandry and animal healthto the ex­

tent they do not contravene this Law shall survive until

. newimplementing regulationa arestipulated based on this

Law.

Theprovision onveterinarian practice andthe pro­

visionon veterinary not sufficientlygoverned in this Law

shallbegoverned by law.

Implementing regulations of this Lawshall be:

a. Government Regualtion andRegulation of the President

must havebeenstipulated within two (2) yearseffec­

tive as of this Law isenacted;

b. Regulation or Decision of the Ministermusthavebeen

stipulated within one(1) yearasof this Law isenacted;

c. Regional Government Regulation musthave been stipu­

HUSBANDRY AND ANIMAL HEALTH

I. GENERAL.

The Republic of Indonesia isa Stateof islands that has

tremendous various biological assets (mega biodiversity)

in the form of animal and plantsresources asa gift and

at the sametime mandated by the Oneand OnlyGod

and therefore all these need to be utilzied and pre­

served in accomplishing the welfare of the Indonesian

people, assetforth in the Preamble of the 1945Consti­

tution of the RepublicofIndonesia Year 1945.

In the contextand utilizingand preserving the biologi­

cal variety it is necessary to implement separate

husbandy andanimal healtheffort or integratedlywith

agricultural andplantationcultivation, fishery, and for­

estry, with approach to agrobusiness system, husbandry

andanimalhealthsystem, and applicationof the prin­

cipalof continuous, safetyand health, people oriented

and justice, transparency and integration, indepen­

dence, partnership, and professionalism.

Theforegoing must be implemented synergically in or­

derto protectandimprove thequalityof animal resouce;

provide safe, healthy, solid, andpermissible food in the

improvement of integrityof the people, animal,anden­

Vironment, provideService and industrial basicmate­

rial, develop scienfical knowledge and technology, im­

provethe State's revenue andexchange, expand busi­

ness opportunityandjob opportunity,and improvethe

the implementation of husbandry, it is necessary to

developnew perceptionand paradigm on husbandry

on investment, innovation, and empowerment so as

husbandrycontinueto exist and improvefor improve­

ment of the nation competitiveness to be equal with

other moredeveloped nations.

Toaccomplish the objectivein the development of ani­

mal health it is necessary developnew perception and

paradigm on animal health with the purpose of main­

taining animal health nationawide, the territory of the

must be protected from disease threat and/or distur­

bance to humanhealth, animaland plantshealth, and

theirecosystem; andguarantee safe, healthy, solid, and

permissible food originatingfrom animal.

Thegoverning in the implementation of husbandry and

animal health in one law is due to the existence of in­

terrelationand interdependence between the two sec­

tors. Besides the governingby one law shallestablish

one unit of national legalized system that facilitatethe

Government and Regional Government andall stake­

holders doingbusiness on husbandry andanimal health

in perceiving and implementing various provisions in

this Law. Furthermore, a change isalsotakingplace in

the administration based on the Lawon Regional Ad­

ministration that obliges re-structuring all matters in

the implementation of husbandry andanimal health.

Based on this consideration, the policyon implemen­

tation of husbandry shall be emphasized on the eco­

nomic social aspect, while implementation of hus­

bandry and animal health shall prioritize securityas­

pect from diseasethreat and effort to avoid risk that

perturbs the health of human being, animal, plants

and .

Thescope of goveming the implementtion ofhusbandry

shallcoverthe land or plot of land, water, genetic re­

source, germ,seed, ovule, food,device andmachinery

for husbandry, cultivation, harvest and post-harvest,

marketing, and process of husbandry product. While

the scope governing implementation of animalhealth

shall involve animaldisease, animal medicine, device

and machinery, health of veterinarian, welfare of the

animal, and veterinery authority. With respect to

strengthening the function, animalhealthservice, ani­

mal healthforce, medical reproduction, medical pres­

ervation, forensic by veterinarian and medical docter's

comparison.

Tosupportsuccess in the implementation ofhusbandry

andanimal health, it isalsogoverned empowerment of

the breeders, husbandry business and animal health

service, development of human resource, research and

gion and/or cross-province, the grant of business license

by the Regent/Mayor needs to be confirmedto the autho­

rizedveterinarianof the provinceconcerned.

The qualification for grant of the licenseshall be

b. Veterinarian Practice;and

c. Animal Health Laboratory andVeterinarians Health labo­
