Dupont Do Nemours Powder company (of New Jersey) awl l-wenty-four other corporations and Bovcnieen individuals connected villi te corporations which are made de- fendants in the petition. The petition relates (hat all tiie defendants are engaged in interstate trade and commerce in gunpowder and other hi;;h explosives and ave violating the act of July 2, 1890, com- monly known as the Sherman anti- trust act. ft seeks to prevent acid restrain the unlawful existing agree- ments, contracts, combinations and ronspiracies in restraint of such trade iiid commerce, to prevent and restrain the attempts on the part of the de- fendants to monopolize such trade and dissolve the existing monopoly therein. The court is asked to determine whether public interests will be bet- Sir subserved by the appointment o! receivers to take possession of the property of the alleged trust with a view to bringing about, conditions in trade and commerce that will be in Inirmony with the law. This association enjoyed an uninterrupted iteration, it is said, until 1881, when a new agreement was entered into with the object of preventing new manufacturers from engaging in the powder business. History of the Combination. The petition recites many of tne operations of the bo-called powder trust leading up to the organization in Way, 1903, under the laws in the state of New Jersey of the E. I., Dupont Do- Nemours Powder company, with n capital stock of $50,000,000, as a hold- fag company for the purpose of ac- quiring the capital stocks of every corporation in the United States i" manufacturing and dealing in high ex- plosives. This New Jersey holding company, it is alleged, did acquire control of the companies operating in high explosives in the United States until all of the business of shipping and selling such commodities of sub- stantially seventy companies, which had from time to time since 1872 been separate competing concerns, is now Being carried on by three gigantic op- erating companies, namely, the East- ern Dynamite company, E, I. Dupont Be Nemours Powder company of Del- aware and the i.aflin & Rand Powder company. The defendants, it is alleged, al- io*: (1 y have a complete monopoly of &*• prod.iction and distribution smokeless ordnance powder, in addi- tion to the monopoly of i)5> per cent of tiie production and distribution of high explosives other than smokeless powder. The government asks, in Its prayer for relief, that these operating com- panies be enjoined and restrained, fMm operating and engaging in inter- state commerce in the United States ra; that receivers be appointed to take Over their business. The government asks also that con- toel of certain capitai stocks in other companies by the various holding com- panies shall be adjudged unlawful and wpid and that the'defendants shall be •©strained from carrying on alleged BBfair competition against twenty-six Independent firms which at the time of the filing of the petition were en- gaged in the manufacture, shipment and sale of blasting powder and dyna- mite in the United States in lawful oompetition with the defendants. Washington, July 31.—The govern­ment lias filed in llio United States Circuit court for llio district of Dela­ware, at Wilmington, a petition lgainst K. I. Duponl., De Ncmourr. & Co., the E. I. Dupont Do Nemours Powder company (of New Jersey) awl l-wenty-four other corporations and Bovcnieen individuals connected villi te corporations which are made de­fendants in the petition.

The petition relates (hat all o£ tiie defendants are engaged in interstate trade and commerce in gunpowder and other hi;;h explosives and ave violating the act of July 2, 1890, com­monly known as the Sherman anti­trust act. ft seeks to prevent acid restrain the unlawful existing agree­ments, contracts, combinations and ronspiracies in restraint of such trade iiid commerce, to prevent and restrain the attempts on the part of the de­fendants to monopolize such trade and ,« dissolve the existing monopoly therein.

The court is asked to determine whether public interests will be bet-Sir subserved by the appointment o! receivers to take possession of the property of the alleged trust with a view to bringing about, conditions in trade and commerce that will be in Inirmony with the law. The prayer in this respect is identical with thai: la the so-cailed tobacco trust petition.

It it: stated in the petition that, in 1X72 all except three of the concerns soiling high explosives in the United 3tat.es organized with the object of r?-;:iilating price,'i at which such com­modities should be sold and of driving {be other corporations out of business-by unfair competitive methods. This association enjoyed an uninterrupted iteration, it is said, until 1881, when a new agreement was entered into with the object of preventing new manufacturers from engaging in the powder business. In ihe meantime Mie three "would be" competitors are declared to have been compelled to jyiu the monopoly. History of the Combination.

The petition recites many of tne operations of the bo-called powder trust leading up to the organization in Way, 1903, under the laws in the state of New Jersey of the E. I., Dupont Do-Nemours Powder company, with n capital stock of $50,000,000, as a hold-fag company for the purpose of ac­quiring the capital stocks of every corporation in the United States i" manufacturing and dealing in high ex­plosives. This New Jersey holding company, it is alleged, did acquire control of the companies operating in high explosives in the United States until all of the business of shipping and selling such commodities of sub­stantially seventy companies, which had from time to time since 1872 been separate competing concerns, is now Being carried on by three gigantic op­erating companies, namely, the East­ern Dynamite company, E, I. Dupont Be Nemours Powder company of Del­aware and the i.aflin & Rand Powder company.

The defendants, it is alleged, al­io*: (1 y have a complete monopoly of &*• prod.iction and distribution o£ smokeless ordnance powder, in addi­tion to the monopoly of i)5> per cent of tiie production and distribution of high explosives other than smokeless powder.

The government asks, in Its prayer for relief, that these operating com­panies be enjoined and restrained, fMm operating and engaging in inter­state commerce in the United States ra; that receivers be appointed to take Over their business.

The government asks also that con-toel of certain capitai stocks in other companies by the various holding com­panies shall be adjudged unlawful and wpid and that the'defendants shall be •©strained from carrying on alleged BBfair competition against twenty-six Independent firms which at the time of the filing of the petition were en­gaged in the manufacture, shipment and sale of blasting powder and dyna­mite in the United States in lawful oompetition with the defendants.
