A OFFICIAL GAZETTE SOVERNMENT PRINTING AOEMGY I ENGLISH EDITION ftn+~#+-E ZrhB m^mmmsmsf No. 1221 MONDAY, APRIL 24, 1950 Price 28.00 yen MINISTERIAL ORDINANC E- Ministry of Labor Ordinance No, ll April 24, 1950 ^ Partial amendment to the Enforcement Or- dinance 'ofx Unemployment Insurance Law (Min- istry of Labor Ordinance No. 8 of 1949) shall be made as follows; ' Minister of Labor SUZUKI Masabumi The proviso to Article 1 shall be amended as follows : However3 the business concerning the pay- ment of insurance benefits for.the qualified recipient stipulated in Article 18 paragraph 1 of the Law (hereinafter called the "qualified recipient") or the said business to be conducted in accordance with the provisions of Article 38-(3) paragraph 2 or Article 38-(4) paragraph 1 and paragraph 2 of the Law for the insured person provided for in Article 38-(3) paragraph 1 or Article 38-(4) paragraph 1 of thev Law (hereinafter called the "insured day-laborer ") shall be managed by the Chief of the 'Public Employment Security Office in the area where the qualified recipient's domicile or temporary domicile is located (hereinafter called the " com- petent Public Employment Security Office'*). Article 10 paragraph 1 shall be amended as follows : The certificate provided for in Article 49 paragraph 2 of the Law shall be the Separation Notice of the Insured Person of Unemployment Insurance (Form'No. 8) (hereinafter called the "Separation Notice") distributed in advance arcfbng the employers by the chief of the com- petent Public Employment Security^ Office within which jurisdiction the working-place is located, with every necessary matters filled in it. The following paragraph shall be added to Article 10 paragraph 4: 5 The employer must keep records on receipts and disbursements of tyie " Separation Notice" and submit reports if required by the chief of the competent Public Employment Security Office. The following one paragraph shall be added to Article 25: 2 In case the chief of the competent Public Employment Security Office recognizes neces- sity of investigation to confirm the fact that the qualified recipient has made earnings by his labor or has been employed, stipulated in Article 17-(4) of the Law, the Chief of the competent Public Employment Security Office may postpone the payment of the insurance benefit until the next pay-day. The following proviso shall be added to the body of Article 29: However, in case the qualified recipient is not accompanied by his family and his term of employment is very short or under special circumstances, the removal expenses provided for in Article 32 is not paid. "(Means the Head-Office, Branch and Agency and the same hereinafter)" in Article 40 para- graph 1, shall be amended as "(means the Head- Office, Branch, Agency and Revenue Agency and the same hereinafter)." " The Chief of the Public Employment Security Office" in Article 46-(2), shall be amended as "the Chief of the competent Public Employment Security Office." "The Chief of the Public Employment Security Office" in Article 46-(3), shall be amended as "the Chief of the competent Public Employment ' Security Office." " The Chief of the Public Employment Security Office " in Article 46-(4) paragraphs 1 and 2, shall be amended as "the Chief of the competent Public Employment Security Office " respectively. Partial amendment to the Enforcement Or-dinance 'ofx Unemployment Insurance Law (Min-istry of Labor Ordinance No. 8 of 1949) shall bemade as follows;

The proviso to Article 1 shall be amended asfollows :

However3 the business concerning the pay-ment of insurance benefits for.the qualifiedrecipient stipulated in Article 18 paragraph 1of the Law (hereinafter called the "qualifiedrecipient") or the said business to be conductedin accordance with the provisions of Article38-(3) paragraph 2 or Article 38-(4) paragraph1 and paragraph 2 of the Law for the insuredperson provided for in Article 38-(3) paragraph1 or Article 38-(4) paragraph 1 of thev Law(hereinafter called the "insured day-laborer ")shall be managed by the Chief of the 'PublicEmployment Security Office in the area wherethe qualified recipient's domicile or temporarydomicile is located (hereinafter called the " com-petent Public Employment Security Office'*).Article 10 paragraph 1 shall be amended as

Supplementary' Provisions :

This Ministerial Ordinance shall come into force as from May 1, 1950.The Separation Notice delivered in accordance with the provision of Article 10 before theenforcement of this Ministerial Ordinance, shall be -regarded until May 31, 1950 as the Separa-tion Notice which has same efect as that provided for in Article 10 paragraph 1 of theamended Law*The report or application submitted, before the enforcement of this Ministerial Ordinance,in accordance with, the provisions of Article 4S-(2) or Article 46-(3) before the amendment,shall be regarded as having been submitted in accordance with the provisions of Article46-(2) or Article 46-(3) after the amendment has been made and-the Insured Day-laborer'sPocket Book delivered in accordance with the report or application shall be regarded ashaving been delivered in accordance with'the provisions of Article 46-(4) after the amend-ment has been made*
