    WHAT’S NEW

    Waitangi Treaty Grounds/Te Pitowhenua proposed as a National Historic Landmark

    Heritage New Zealand has publicly

    notified the proposal to recognise

    Waitangi Treaty Grounds/Te

    Pitowhenua as a National Historic

    Landmark/ Ngā Manawhenua o

    Aotearoa me ōna Kōrero Tūturu.

    2018 National Assessment RMA Plans And Policies – Heritage Provisions

    Heritage New Zealand has recently re- assessed

    how well RMA plans identify and protect historic

    heritage. This fifth national assessment tracks

    changes between mid-2015 and mid-2018. Plans

    were assessed against the indicators in Heritage

    New Zealand’s Statement of Performance

    Expectations 2018-2019 (SPE 2018 ) and HNZPT

    best practice Sustainable Management of

    Historic Heritage (SMHH) guidance.

    The 2018 Assessment evaluated plans against a

    range of indicators and continues to focus on

    risks to historic heritage and plan provisions that

    facilitate safety upgrades (e.g. earthquake

    strengthening). It also examines the framework

    linking regional policy statement objectives and policies to objectives, policies and rules

    in district plans. Key findings:

    Destruction of scheduled Māori heritage as a non-

    complying activity for at least higher-ranked items

    Regulatory incentives for retention of heritage 59%

    The 2018 Assessment found that even some of the recently notified or operative plans

    contain one or more key deficiencies. Other key findings include:

    almost half of the plans lack assessment criteria for scheduling historic heritage

    in district plans

    nearly two-thirds of plans have no specific provisions for enabling earthquake

    scheduling of historic heritage, including three proposed new plans

    around 14,000 historic heritage places and areas are scheduled and protected

    by rules in district and regional plans, and a further 8,000 archaeological sites

    are identified in plans.

    Appointment of New Manager Heritage Listing

    Dr Michelle Horwood has been appointed as the new Manager Heritage Listing within

    Heritage New Zealand’s Policy Team, based in Wellington. Michelle has a PhD in

    Museum & Heritage Studies from Victoria University, where her research explored

    relationship-building between Māori communities and museums, Michelle previously

    worked as a Lecturer in Heritage and Museum Studies at EIT in Gisborne, and also spent

    a number of years as a curator at Whanganui Regional Museum.

    Michelle is supported by Joanna Barnes-Wylie who has recently returned from parental

    leave to the role of Senior Listing Advisor.

    Changes Introduced by the Land Transfer Act 2017

    Heritage New Zealand is in the process of updating the legal descriptions for all New

    Zealand Heritage List entries to reflect the change in terminology from Certificate of Title

    (‘CT’) to Record of Title (‘RT’). This change was introduced by the Land Transfer Act 2017

    which took effect on 12 November 2018. The updated legal descriptions will be reflected

    on the List Online (http://www.heritage.org.nz/the-list) from February 2018 and in the

    Quarterly Update to this Annual Information (to be distributed in April 2019).

    1. INTRODUCTION

    1.1. What are Heritage Covenants?

    A heritage covenant is a voluntary agreement between Heritage New Zealand and a

    property owner which provides for the protection, conservation and maintenance of a

    historic place, area or site. The property owner retains full ownership of the property.

    Heritage covenants are executed under Section 39 of the Heritage New Zealand Pouhere

    Taonga Act 2014. Once executed, heritage covenants are noted on relevant Records of

    Title and thus bind subsequent owners of the place. Any breach of this covenant is an

    offence under the Heritage New Zealand Pouhere Taonga Act 2014. Heritage covenants

    are therefore a very important mechanism for long-term heritage protection.

    1.2. Types of Places Covered by Heritage Covenants

    To date Heritage New Zealand has entered into 233 heritage covenants with property

    owners. About a third of these covenants apply to residential properties, where the

    owners have worked to restore their historic homes and want their work to be

    protected if they later decide to sell the property.

    Some covenants apply to former post offices (such as in Auckland, Ponsonby, Tauranga,

    Havelock, Oamaru, Lawrence, and Port Chalmers), due to government policy in

    covenanting some historic properties before they disposed of them.

    Other covenants cover such places such as stables, farm stations, rock art sites, and

    archaeological sites. For example several Māori pā sites are protected by covenants,

    either at the request of the property owners or as a condition of a resource consent

    imposed by local authorities under the Resource Management Act 1991.

    1.3. Other Types of Covenants

    There are covenants other than heritage covenants that can protect historic properties.

    For example, open space covenants, executed under the QEII National Trust Act 1997,

    protect land containing special landscape features, and conservation covenants can be

    negotiated between landowners and the Department of Conservation or a local

    authority to protect landscape and/or heritage values. Other mechanisms to protect

    historic properties include heritage orders and granting reserve status to land.
