Prior to the Call to Order, the Board Secretary read the following statement:

1. & 2. CALL TO ORDER AND PLEDGE OF ALLEGIANCE

The Board of School Directors of the Harrisburg School District held a regular meeting on Monday, June 20, 2016 in the boardroom of the Administration Building, 1601 State Street, Harrisburg, PA 17103 pursuant to due notice to each Board Member. Danielle Robinson, President, Board of School Directors, called the meeting to order at 6:50pm followed by the flag salute.

3. ROLL CALL & ANNOUNCEMENTS – continued

Ms. Robinson state an executive session was held this evening from 5:30-6:45pm to receive information

regarding the following matters: Amendment to the License Agreement with Fitness U, L.L.C. to provide a facility in Strawberry Square for certain exercise and physical education classes of SciTech Campus of Harrisburg High School; Independent Contractor Agreements; Fourth Amendment to Sales Agreement re: 236 S. Cameron Street; and other legal matters.

4. APPROVAL OF JUNE 20, 2016 AGENDA

Motion: Ms. Green moved to amend the June 20, 2016 agenda to correct item 9.3A.2. The correct address of the property for sale is “623 Radnor Street, City of Harrisburg” according to the repository bid. Motion: Mr. Thompson moved to approve the amended June 20, 2016 agenda as presented. Second: Mr. Roy Discussion: Mr. Kennedy-Shaffer shared his concern that Item 10.10 was under consideration, that the AFSCME agreement should be given a priority to administrator raises, and that as a new board member he was not a part of the discussion of the salary adjustments for Act 93 personnel. He would like more information and time to consider the matter. Mr. Krupp shared this concern and asked if this was a time sensitive matter. Mr. Gretton stated that the proposed salary adjustments in Item 10.3 are effective July 1, 2016, that they would be made retroactive if approved after that date. He too would like to see an AFSCME agreement soon. Mr. Roy asked if there is a cost to provide retroactive salary adjustments. Mr. Gretton stated there is not. Ms. Robinson called for a motion on the matter. Motion: Mr. Wilson moved to postpone Item 10.10 until the next voting meeting. Second: Mr. Kennedy-Shaffer Discussion: Ms. Robinson stated that the salary adjustments were approved by the Board last fall and that this is a vote to implement the adjustments. She does not agree that because the adjustments were approved by former board members that the action should not be implemented. By implementing these adjustments, the district will move forward to getting staff all staff settled with appropriate compensation, something the district needs to get into place. Mr. Gonzalez expressed his support of Ms. Robinson’s position, that we should stay the course and enact the salary adjustments. Mr. Roy stated he agrees with Mr. Gonzalez, that the Board is a continuous body with no break in action.

6. PUBLIC COMMENT-AGENDA ITEMS (Time limit of three minutes per person) Sylvia Rigal-609 Curtin Street-questioned why the funds for the Rotary Club Pancake Breakfast Fundraiser

had not been spent and questioned the need and cost for Independent Contractors-Hasan, Sampson, and Dunson. She also asked if funds raised by one of our schools for Flint, Michigan were sent. She also noted that under Personnel Actions one of the nurses is being hired to work in the summer programs at two schools during the same shifts. Karen Snider, Executive Director of the Foundation for Public Schools, stated a check from the Pancake Breakfast Fundraiser was given recently to Saundra James-Goodwin, the district’s social worker who coordinates services for homeless students and families.

Class of 2016 Commencement Ceremony Dr. Knight-Burney announced that the Premier Charter School held its first graduation on June 5, 2016.Mr. Thompson and Mr. Roy attended. 7.2 Harrisburg Public Schools Foundation-Karen Snider, Executive Director

Ms. Snider reported that Downey School is recommended to receive the KaBoom Playground, as the Melrose site was deemed not suitable. Official word is forthcoming. August 20 is the build date, rain or shine. Ms. Snider distributed materials on the Parents as Partners program, funded by the Greater Harrisburg Foundation with Race to the Top grant funds. The purpose of the program is get children ready for school. The award was $200,000 over a three-year period. Scott

7. REPORTS

7.2 Harrisburg Public Schools Foundation-Karen Snider, Executive Director-continued School requested assistance from the Foundation for musical instruments and Ms. Snider intends to seek support from the Harrisburg Symphony. Dr. Knight announced a donation of an electric piano to Scott School from Barry Manilow.

7.3 Academic, Instruction, and Student Services Committee-Judd Pittman, Chair Mr. Pittman was not in attendance. Ms. Robinson shared the following:

1. There is no meeting in July unless called asked for by the Superintendent. 2. Committee meetings will be held first Thursday of every month at 5:30pm 3. Mr. Pittman thanks staff for their commitment to academics and professional growth for

2015-16 year. 4. Mr. Pittman thanks students for an inspiring graduation. 5. Mr. Pittman acknowledges Jaimie Foster and Rose Sampson for crafting a professional

development framework for 2016-17. 7.4 Ad Hoc Negotiations/Human Resources Committee-Danielle Robinson, Chair

Ms. Robinson announced a meeting of the human Resources Committee was held today to review the personnel actions. She announced three meetings are planned in the near future to continue AFSCME negotiations. Mr. Kennedy-Shaffer stated the AFSCME agreement should be a priority.

7.5 Budget, Facilities, and Finance Committee-Matthew Krupp, Chair Mr. Krupp stated meetings were held on June 6 and June 13. The Committee had a presentation from Equity First, a non-profit organization on June 13. An update on bond refinancing will be presented this evening. The next Committee meeting will be held on July 11, 2016 at 5:30pm.

7.6 Community Relations Committee-Ellis Roy, Jr. Chair Mr. Roy stated the next meeting will be held on June 22, 2016. The topic for the evening will be SROs for the school district. He emphasized this is at discussion stage and that no commitments have been made. He also emphasized that clear guidelines would need to be established for this initiative. Mr. Roy stated his understanding is that the city will fund the SROs but needs approval by the district to move forward. Mr. Kennedy-Shaffer stated his sense from Council is that it needs to be a shared cost. Mr. Robinson reminded the Board that meetings were held last year on this topic and the Board decided to go in a different direction from SROs. Since that time, we have hired a Security Manager and are building other partnerships and initiatives for responsible behavior in the schools.

7.7 Policy and Procedure Committee-Alan Kennedy-Shaffer, Chair Mr. Kennedy-Shaffer stated there are no policies on the agenda this evening. Governor Wolf has signed an executive order regarding the employment of the disabled. President Obama has signed an executive order regarding treatment of transgender people. Mr. Gonzalez and Mr. Roy also commented.

7.8 Harrisburg Community College Delegate Report-Melvin Wilson, Jr. Mr. Wilson expressed how impressed he was with graduation ceremonies. He praised the administration for the career development programs in the district. He stated that (74) seniors have declared HACC as their college of choice. Mr. Wilson asked HACC President for assistance in recruiting librarians to the District.

7.9 Capital Area Intermediate Unit Delegate Report-Ausha Green Ms. Green updated the Board on recent activities and highlights of the most recent meeting on May 26.

7.10 Chief Recovery Officer -Dr. Audrey Utley Dr. Utley reported that the District’s Second Amended Recovery Plan was approved and signed by the Pennsylvania Department of Education on June 9, 2016.CRO Advisory Committee meetings will resume in August. The District has met two of the Recovery Plan goals: Adopting a two-year professional development plan and a curriculum management plan.

At this time, Nick Falgione, PNC Bank, and Jay Wenger, Susquehanna Financial Group, presented a bond refunding analysis including a bond sale report and bond details. Questions and answers were followed by extensive discussion. As a result, the Board agreed to move Item 9.4 to this point in the meeting. Mr. Thompson praised and thanked Mr. Falgione and Mr. Wenger for their work on behalf of the District. 9.4. Approve the Resolution re: SPSBA School Revenue Bonds, Series A and B of 2016

9.3I Elizabethtown College MOU – approve a five-year renewal of the MOU with

Elizabethtown College to provide interns for Occupational Therapy Services. This is a renewal of a long-standing relationship with the college to provide services to the district.

9.3J David Bateman Contract – approve a contract with David Bateman for an in-service

presentation to the administrative leadership group on July 22, 2016 at a cost of $950.00 for the day.

9.3K Wolf Bus Company – approve a contract with Wolf Bus Company to provide two (2)

buses on July 8, 2016 for a trip to Baltimore, MD at a cost of $2,362.50. This experience is part of the summer SIG program and is offered at no cost to students or the district.

9.3L Withdrawal from PSHIC – provide administration along with the Solicitor the directive to take appropriate action to withdraw from the current agreement with PSHIC in order to secure savings under the health insurance plans. The district entered into the agreement with the intent that savings on stop-loss insurance and premiums would be realized. Increased fees for oversight (Benecon) and the lack of response from the administrator have diminished those savings. At this time placement with Highmark independently or possibly through a risk-sharing group would benefit the district in the future.

Associates for the review and energy project oversight of Steele School renovations on behalf of the district at a cost of 2.5% of the project costs. This would include review of the lighting, HVAC, roofing, and any other portions of the contract that are related to energy savings.

9.3N General Liability Insurance – Approve the proposal from McGowan Governmental

9.7 Approve 2016-2017 Homestead and Farmstead Exclusion Resolution

HARRISBURG SCHOOL DISTRICT 2016-2017 Homestead and Farmstead Exclusion Resolution

RESOLVED, by the Board of School Directors of the Harrisburg School District, that homestead and farmstead exclusion real estate tax assessment reductions are authorized for the school year beginning July 1, 2016, under the provisions of the Homestead Property Exclusion Program Act (part of Act 50 of 1998) and the Taxpayer Relief Act (Act 1 of 2006), as follows:

1. Aggregate amount available for homestead and farmstead real estate tax reduction. The following amounts are available for homestead and farmstead real estate tax reduction for the school year beginning July 1, 2016:

a. Gambling tax funds. The Pennsylvania Department of Education (PDE) has notified the School District that PDE will pay to the School District during the school year pursuant to Act 1, 53 P.S. § 6926.505(b), as a property tax reduction allocation funded by gambling tax funds, the amount of $2,771,689.74.

b. Philadelphia tax credit reimbursement funds. PDE has notified the School District that PDE will pay to the School District during the school year pursuant to Act 1, 53 P.S. § 6926.324(3), as reimbursement for Philadelphia tax credits claimed against the School District earned income tax by School District resident taxpayers, the amount of $2,977.88.

c. Aggregate amount available. Adding these amounts, the aggregate amount available during the school year for real estate tax reduction is $2,774,667.62.

2. Homestead/farmstead numbers. Pursuant to Act 50, 54 Pa. C.S. § 8584(i), and Act 1, 53 P.S. § 6926.341(g)(3), the County has provided the School District with a certified report listing approved homesteads and approved farmsteads as follows:

a. Homestead property number. The number of approved homesteads within the School District is 6,315.

b. Farmstead property number. The number of approved farmsteads within the School District is 0 (zero).

c. Homestead/farmstead combined number. Adding these numbers, the aggregate number of approved homesteads and approved farmsteads is 6,315.

3. Real estate tax reduction calculation. Dividing the paragraph 1(e) aggregate amount available during the school year for real estate tax reduction of $2,774,687.62 by the paragraph 2(c) aggregate number of approved homesteads and approved farmsteads of 6,315 (before considering the assessed value of approved homesteads and approved farmsteads having an assessed value below the preliminary calculation of the maximum real estate assessed value reduction amount to be established as the homestead and farmstead exclusion amount), the preliminary calculation of the maximum real estate tax reduction amount applicable to each approved homestead and to each approved farmstead is $439.38.

9. OTHER FISCAL MATTERS 9.7 Approve 2016-2017 Homestead and Farmstead Exclusion Resolution-continued

Based on calculations provided by the School District Business Office from the best available information and carefully evaluated by the School Board, considering the assessed value of approved homesteads and approved farmsteads having an assessed value below the preliminary calculation of the maximum real estate assessed value reduction amount to be established as the homestead exclusion and the farmstead exclusion amount, an additional aggregate amount of $149,268 will be available during the school year for real estate tax reduction applicable to approximately 41 homesteads and farmsteads, resulting in an additional real estate tax reduction amount available for each homestead and farmstead of $0.65. Adding this additional amount to the preliminary calculation of the maximum real estate tax reduction amount of $439.38, the final maximum real estate tax reduction amount applicable to each approved homestead and to each approved farmstead is $440.03.

4. Homestead exclusion calculation. Dividing the paragraph 3 maximum real estate tax reduction amount of

$440.03 by the School District real estate tax rate of 27.80 mills (.02780), the maximum real estate assessed value reduction to be reflected on tax notices as an homestead exclusion for each approved homestead is $15,715.

5. Homestead/farmstead exclusion authorization – July 1 tax bills. The tax notice issued to the owner of each

approved homestead within the School District shall reflect a homestead exclusion real estate assessed value reduction equal to the lesser of: (a) the County-established assessed value of the homestead, or (b) the paragraph 4 maximum real estate assessed value reduction of $15,715. For purposes of this Resolution, “approved homestead” shall mean homesteads listed in the report referred to in paragraph 2 above and received by the School District from the County Assessment Office on or before May 1 pursuant to Act 1, 53 P.S. § 6926.341(g)(3), based on homestead/farmstead applications filed with the County Assessment Office on or before March 1. This paragraph 5 will apply to tax notices issued based on the initial tax duplicate used in issuing initial real estate tax notices for the school year, which will be issued on or promptly after July 1, and will not apply to interim real estate tax bills.

6. Homestead/farmstead exclusion authorization – interim real estate tax bills. No homestead exclusion will

apply to any interim tax bill except an interim tax bill applicable to a property that includes an approved homestead listed in the report received by the School District from the County Assessment Office on or before May 1, but not included in the tax assessment reflected in the July 1 tax bill for the property. In most cases, the assessment of approved homesteads will be reflected in July 1 tax bills. However, in any case when there is an approved homestead that is not included in the assessment reflected in the July 1 tax bill, and when an interim real estate tax notice is issued later based on an interim assessment including the approved homestead, the interim tax notice shall reflect a homestead exclusion real estate assessed value reduction calculated under paragraph 5, except that the paragraph 4 maximum real estate assessed value reduction will be prorated in the same manner as the real estate tax is pro- rated. Assuming the interim tax notice reflects taxation as of July 1, as will occur in most such cases, the full amount of the paragraph 4 maximum real estate assessed value reduction will apply. In the extraordinary case where the new interim tax assessment is effective after July 1, the paragraph 4 maximum real estate assessed value reduction will be pro-rated in the same manner as the real estate tax reflected in the interim tax bill is pro-rated.

The Administration recommends approval of the 2016 – 2017 ACT 93 employees’ salary increases as presented.

Motion: Mr. Roy moved to approve Item 10.10 as presented. Second: Mr. Thompson Discussion: Mr. Kennedy-Shaffer stated he could not support raises for management before an agreement with AFSCME was completed, as AFSCME workers are the least compensated. Mr. Gretton stated an agreement has been proposed to AFSCME but it was turned down. The current agreement expires June 30, 2016. Mr. Gretton Stated Act 93 has an agreement that was approved by the Board last fall. Mr. Kennedy-Shaffer expressed frustration that negotiations with HEA and AFSCME have taken too long. Mr. Robinson pointed out that the item under consideration is the implementation of the Act 93 salary adjustments approved by the Board last fall. She objected to the characterization that one group (Act 93) is more important than another job classification and emphasized the Board’s perseverance to getting all employees compensated fairly. Mr. Kennedy-Shaffer moved to table item 10.10 but was called out of order because the same motion failed earlier in the meeting. Mr. Krupp stated he supports Mr. Kennedy-Shaffer and requested to see the Act 93 agreement. Mr. Kennedy-Shaffer cited the May 31, 2016 minutes as evidence of his support to make AFSCME negotiations a priority before Act 93. Ms. Robinson repeated her stance that she will not pit one work group against another. All employees must be fairly compensated. 12.4 Approve 2015-2016 Act 80 DAYS Waivers for End of Year Student Membership Report Submission to Pennsylvania Department of Education Explanation: Approval for the following ACT 80 Day Waivers (early dismissal and full) will be in support of the Board of School Directors’ approved 2015-2016 calendar dates and must be included in the submission of end of year membership reports to the Pennsylvania Department of Education. A separate Board vote is required to submit for Pennsylvania Department of Education Act 80 Day Waiver approvals in support of the previously approved 2015-2016 school calendars. Act 80 provides the option for school districts to have early dismissals and full days for Professional Development or Parent Conferences as long as the required number of hours for elementary and/or secondary is met. If this request is approved by the Board, the PDE Form 4085, Request for Section 1504 (Act 80) Exception, will be submitted to the Department of Education to request a waiver of the full 180 day requirement.

13. PUBLIC COMMENT-NON-AGENDA ITEMS (Time limit of three minutes per person)

Sylvia Rigal-609 Curtin Street-commented on the news that someone is buying the old Bishop McDevitt High School building with plans to open a charter school for the performing arts. She stated she has not heard positive comments about a similar school that was voted down in the York School District. The Board agreed to hear the public comment of Karen Burney-2016 Bellevue Road without completing a comment slip in advance. Ms. Burney shared her complaints and asked for assistance to remedy a problem with a district administrator.

Ms. Robinson cautioned the Board about the perception members put forth. The Board cares about all employees. Mr. Kennedy-Shaffer announced his forthcoming resignation from the Board. He is going to graduate school in Colorado. He stated it was an honor and privilege to serve on the Board and is proud of the accomplishments the Board made. Board members offered their appreciation and thanks for his service and dedication. 14. ADJOURNMENT Mr. Roy moved at 8:59pm to adjourn, seconded by Mr. Gonzalez. One Legislative (voting) Meeting is held every third Monday of the month with two meetings in August only (no regular meeting is scheduled for July)
