It was about this time last year that parts of the GTA were left reeling from severe rainfall, � ooding and

power outages, and homeowners were learning the hard way about home insurance and new-home warranties. Indeed, you wouldn’t dream of buying a new car, TV or other big-ticket item without � rst inquiring about the manufacturer’s warranty. And when it comes to buying a new home, you should be even more diligent.

Some people may be so excited about their purchase that they’re more interested in choosing � nishes than reading the � ne print of a sales agreement. Or maybe they assume all builders are created equal, and that certain things are covered, when in fact they may not be. Or it might be a lack

of awareness of just how new-home warranties work in Ontario.

Tarion Warranty Corp. is a non-pro� t company designed to protect the rights of new-home buyers and to regulate builders. With four main responsibilities – homeowner education, warranty enforcement, builder licensing, and identifying and prosecuting illegal building – it is, unfortunately, a necessary but extremely valuable body. It is also one you should get to know.

Just like for cars or electronic devices, all manufacturers and products are not created equal. Learning about your new-home builder’s warranty – before the time when you actually may need it – is a crucial part of the homebuying process.

Three simple steps to successConsider these pointers before heading out on your search

S hopping for a home online is a great way to narrow your search, but there’s nothing like visiting

the sites, models and sales o� ces to get down to the nitty-gritty. Before you venture out, here are some pointers:

First, be clear about what you want and expect in a new home and in your builder.

Remember, the range of prices in the new-home market generally re� ects di� erences in location, features and home styles. � ere’s no magic involved. If a builder’s pricing seems out of whack with others in the area, ask for an explanation. Higher prices could mean better quality materials, � nishings, features and service. Make sure that

the price you are paying will deliver the quality you want.

Second, understand exactly what is included with the home you are buying and what is optional. Ask the sales representative to show you samples, and request a “spec” sheet that clearly lists what is included, as well as any upgrade options.

� ird, evaluate any promises that have been made during your visit. Is the builder prepared to put them in writing? Hearsay comments should not be included as part of your evaluation process. Sit down with your sales representative, ask questions and discuss your Agreement of Purchase and Sale in detail – then take it to a lawyer before it’s � nalized.

Removing regulatory barriers is key to prosperity

In a recent column, I referenced the Ontario government’s review of four key pieces of legislation including the Growth Plan and the GreenbeltPlan.

The land and development industry is actively involved in the ongoing review process. We have a number of important recommendations to bring forward, all of which will significantly increase our industry’s ability to build quality complete communities across the GTA.

Among our list of recommendations is encouraging the province and municipalities to focus on removing barriers to intensification in areas that are ready for development. These regulatory barriers exist at municipal, regional and provincial levels, and are a significant source for delays in bringing new residential and commercial developments to market.

This is important because the province is forecasting that up to 100,000 people and 50,000 jobs will come to the GTA every single year for the next few decades; and through the Growth Plan the province mandates that much of that growth be accommodated through intensification in order to protect land in the Greenbelt.

Removing barriers would not only make it easier to comply with the existing policies it would also save time and money. It’s unfortunate but true that any delays in the development process result in additional costs for new-home buyers and business owners.

The first step is for municipalities to implement a “making this happen” strategy by pre-designating and pre-zoning lands where they want

intensification to occur. Zoning bylaws have to be updated and targeting development to certain corridors will help reduce unnecessary delays and costs, as well as improve housing choice for new-home buyers.

Building homes that people can afford to purchase and businesses that can remain competitive has been a growing challenge for our industry, partially due to the perpetual increase of government fees and charges on new homes. These fees are taxes on new homes paid by new-home buyers and make up approximately 20 per cent of the cost of a home, according to an Altus Group study conducted a few years ago.

Our association has advocated for fair and reasonable government fees and charge for several years. We understand that growth pays for growth, but new-home buyers already do their fair share. It is estimated that more than $1 billion in development charges is paid to municipalities across the GTA every year.

All these factors act as barriers to the implementation of the Growth Plan, and BILD is proud to be at the table with our government partners on behalf of the industry and new-home buyers. I’ll keep you updated on the proceedings in this column space as we work together to build a greater GTA.

Who and what to believe?

For homeowners, when someone says your home is drastically overvalued, naturally, you worry. If you’re a prospective homebuyer, such news might cause you to delay your purchase.   at’s the power of housing valuations.

  e problem is, who and what to believe?

Here are some recent examples of Canada’s housing valuations, from a variety of sources: Deutsche Bank: overvalued by 60 per centBank of Canada: overvalued by 30 per centInternational Monetary Fund: overvalued by 11 per centTD Bank: overvalued by 11 per centCanadian housing economist Will Dunning: undervalued by nine per cent

With such a wide variance in valuations, and using di� ering measures, who to believe, indeed?

“Far too many foreign economists try to make overly simpli� ed statements about foreign housing markets they don’t understand enough about,” Calum Ross, mortgage broker and real estate investor, told New Home Guide.

“Above and beyond the traditional measures, there are a number of less tangible measures, such as the stability of social, political and economic systems at the federal, provincial and municipal level.

“Canada represents one of single largest countries in the world and going from coast to coast, Canada is home to a very diverse group of people with local economics that are vastly di� erent,” Ross says. “Saying there is a Canadian housing market is no less ridiculous than saying there is ‘Canadian temperature.’”

  ankfully, Canada Mortgage and Housing Corp. (CMHC) added some context recently in its House Price Analysis and Assessment (editor’s note: for more information, � ip to page 56), which provided a market-by-market snapshot by Canada’s larger centres.   e report attached a risk level – low, moderate or high – for the major cities, using risk factors of overheating, acceleration in house prices, overvaluation and overbuilding.

With Regina and Winnipeg, of all places, being the only major centres earning “high risk” assessments, CMHC’s

report reminds everyone that housing markets must be assessed on a micro level, not wide-swathing national viewpoints. Canada’s most expensive market, Vancouver, earned a “low risk,” while Toronto, the other market often mentioned in conversations about overvaluation, was ranked as “moderate risk.”

“From a pure economic theory standpoint, when interest rates are low, then real asset prices will go up,” says Ross. “Real estate is one of the most interest-rate-sensitive sectors of the global economy. When it comes to mortgages, what we know is that people have a tendency to buy payments and be less concerned with total debt.   e lower interest rates and longer amortizations allow for lower payment and as long as payments stay a� ordable – many people won’t get caught up with the sticker shock of more expensive real estate prices.”

So, who to believe, next time you see a report on Canada’s housing valuations? Well, a Canadian source such as CMHC is a good start. Otherwise, as experts stress, remember to look at your individual market for a clearer indication, not the national assessment.

Empire Communities extends Empire Heroes Program TO COMMEMORATE 70TH ANNIVERSARY OF END OF SECOND WORLD WAR

This month marks the 70th anniversary of the end of the Second World War and Empire Communities is recognizing individuals who have served our country with the extension of the Empire Heroes Program.

“The Empire Heroes Program was launched in 2013 after marking 20 years of developing and building communities as a way for Empire to give back to these communities,” says Paul A. Golini Jr., co-founder and executive vice-president, industry

relations, Empire. The program assists those working in the hospital, law enforcement and other EMS services with purchasing a new home in neighbourhoods where Empire builds. With each home purchased through the Empire Heroes Program, Empire makes a $1,000 donation to the local hospital foundation.

“The Empire Heroes Program is open to police, firefighters, paramedics, doctors, nurses and other staff that are working in hospitals,” says Golini. “With the 70th anniversary of the end of WWII this year, it only made sense for us to extend the program to Canada’s Acting Members of the Armed Forces, Reservists and Veterans.”

On Thursday, May 14, Empire presented cheque donations to the Hamilton Health Sciences Foundation, Brant Community Healthcare System Foundation and St. Joseph’s Lifecare Foundation in the amount of $67,000, $10,500 and $10,500, respectively, as a result of the Empire Heroes Program.

These donations are a direct result of sales from Empire’s master-planned communities, including Lush and Victory in Stoney Creek, Summerlea in Binbrook and Wyndfield in Brantford.

Choosing between a � xed and variable rate mortgage is an exercise many homebuyers go through, particularly in times such as these when rates are low. Here are some tips that will work in any set of market conditions, and perhaps most importantly, will help you determine the best choice for your own personal risk tolerance and � nancial circumstances.

At any given time, Canada’s capital markets represent about three per cent or less of global capital markets, and our economy is heavily reliant on exports. For Canadian mort-gage consumers, no matter how closely we watch our own economy, we will always be subject to changes in our capital markets (debt and equity markets) as a result of shocks to the global system and particularly shocks to our key trading partner – the U.S.

What this means to the � xed versus variable decision is this: at any given time, there is a set spread between the di� erence in the discounted � ve-year � xed rate (the most popular long-term mortgage product) and the discounted variable rate product. � is spread can increase or decrease in response to movements in the overnight lending rate set by the Bank of Canada and the Government of Canada bond market. � is di� erence in rate represents the premium that mortgage consumers have to pay for the peace of mind that a longer term � xed mortgage o� ers. Conversely, the di� erence in savings for going variable represents the reward for taking on the extra risk of not locking in your rate and protecting yourself against future potential rate movements.

� e only thing a longer term � xed mortgage gives you is a guarantee against your rate and subsequently your payment moving for a longer period. It is essentially an insurance premium against interest rate risk, and like all insurance premiums, they change and are more or less valuable to di� erent market participants.

� e di� erence between this longer term � xed rate and the variable rates, rise and fall in di� erent market conditions. Traditionally, the di� erence between short and long-term rates is highest when in� ation is high – at some of these points in time, the di� erence was more than two per cent. When in� ation is extraordinarily low, the di� erence in these two rates has been as low as less than 0.5 per cent. Regardless of the di� erence in the two rates, the relative cost-bene� t analysis really comes down to your own tolerance for risk and how much you ultimately pay

Doing the mathCHOOSING BETWEEN FIXED AND VARIABLE RATE MORTGAGES

(cost) for that piece of mind, or stand to gain (save) from taking the extra risk.

Only you can gauge that decision, but if you want to do the math, it is fairly simple: just multiply your mortgage balance between the di� erence in the � xed versus variable.

For example – if you have a $100,000 mortgage and the di� erence between a competitive � xed rate mortgage and a variable rate mortgage is one per cent, then the additional premium per year for that peace of mind is $1,000 or $100,0000 x (the di� erence in interest rates). If this cost seems reasonable, you are likely suited for a longer term � xed mortgage. If it seems expensive, you might be best to go for a variable rate mortgage.

One � nal caveat: there is no amount of � nancial gain that ever warrants putting yourself under � nancial duress. When it comes to mortgage or � nancial decisions, smart consumers don’t take on more risk than they can � nancially handle. � e implication – if you can’t a� ord an upswing in rates, then going variable is not a sound decision in any economy.

MANY CANADIANS LOOKING TO LOCK IN

a long-term mortgageCanada’s continuing low interest rate environment has Canadians thinking now is the time to lock in a long-term mortgage.

A new poll from CIBC reveals the majority of Canadians, 74 per cent, would opt for a medium or long-term mortgage if they were to acquire, refinance or renew a mortgage today. Twenty-seven per cent think now is the time to look beyond the traditional five-year fixed mortgage for a term of up to 10 years.

“Canadians are recognizing that today’s historically low rates won’t last forever and some are looking for ways to bring predictability to their finances over the long term,” says Barry Gollom, vice-president, mortgages and lending at CIBC. “Most Canadians tend to opt for a fixed rate over five years when choosing a mortgage today. With more than one in four Canadians now saying they would choose a longer term of seven or 10 years, we may be seeing the start of a shift to longer terms.”

BENEFITS OF A LONG-TERM MORTGAGE Locking in to a fixed rate, medium or long-term mortgage can reduce the stress that can come with following interest rates.

“If interest rates rise in the next year or two, homeowners with shorter term mortgages or variable rate mortgages could see their payments move higher,” Gollom says. “Having a medium or longer term fixed rate can act as a measure of stability and protection – especially for those who have recently bought their first home.”

The prospect of rising rates may not be something Canadians have to worry too much about in the near term. During its interest rate announcement on April 15, the Bank of Canada announced it was going to hold its overnight lending rate at 0.75 per cent for another six weeks at least. (BoC’s latest announcement was scheduled for May 27, after press time.)

“The overnight rate has only been

sitting at 0.75 per cent for a little less than three months now, after Governor Stephen Poloz finally decided to cut it down from the one per cent it had held steady at for nearly 4.5 years,” SAYS Alyssa Richard, founder and CEO of RateHub.ca. “That decision was made in January, in an attempt to shield highly indebted Canadians from the negative impacts of the significant drop in oil prices (and job losses that have occurred as a result).”

CIBC says the shift to longer term, fixed rate mortgages signals growing interest by Canadians to gain greater control and certainty over their largest financial obligation. With a consistent and predictable mortgage payment at today’s low rates guaranteed for many years, Canadians may have the opportunity to pay down their mortgage faster and minimize interest costs, which will help to keep them on track for their broader financial goals.

“Finding an expert who can crunch the numbers on a variety of mortgage options while factoring in your other debts, your savings goals and your personal risk tolerance is an extremely important part of the evaluation process,” says Gollom.

CANADIANS’ MORTGAGE MOOD» 47 per cent would choose a medium

Toronto the top economy in Canada this year

Toronto is back. No, not as the centre of the hockey universe now that the Toronto Maple Leafs have hired Mike Babcock. Toronto is back as the top economy in Canada.

Thanks largely to a weaker Canadian dollar and a strengthening U.S. economy, Toronto will see its economic fortunes improve this year, according to the Conference Board of Canada’s Metropolitan Outlook: Spring 2015.

“For the first time since 1999, Toronto will boast the fastest growing metropolitan economy this year among the 13 cities covered in this edition of our report,” says Alan Arcand, associate director, centre for municipal studies.

With a gain of 2.9 per cent last year, Toronto’s economy grew at its fastest pace in four years, and is expected pick up steam over the next two years. The city’s economy is expected to expand by 3.1 per cent in 2015 and by 3.2 per cent in 2016, supporting employment growth of 1.9 per cent this year and 2.5 per cent next year.

The tourism sector is set for a big year, expected to benefit from the stronger U.S. economy, weaker loonie and the upcoming Pan Am/Parapan Am Games.

At the other end of the economic scale, lower oil prices will hurt growth in Calgary, Edmonton, Regina and Saskatoon.

REGIONAL HIGHLIGHTS FOR 2015

TORONTO: Decent gains in manufacturing and tourism will help the economy expand by 3.1 per cent.

HALIFAX: Economy is expected to grow by 3.1 per cent, fueled by strength in manufacturing and construction.

VANCOUVER: Strength in manufacturing, construction and consumer spending will support GDP growth of 3.1 per cent.

HAMILTON: Stronger growth in the services sector and construction output will support GDP growth of 2.7 per cent.

MONTREAL: GDP growth will reach 2.6 per cent, thanks in part to infrastructure projects.

WINNIPEG: GDP will grow 2.5 per cent, as services growth stays healthy and non-residential construction picks up.

VICTORIA: GDP will rise 2.1 per cent, driven by a turnaround in public administration and strong manufacturing.

REGINA: Prompted by the drop in oil prices, economic growth in Regina will slow to 1.9 per cent.

SASKATOON: GDP growth will be limited to 1.8 per cent because of weakness in the primary and utilities sector.

OTTAWA-GATINEAU: GDP will grow by 1.3 per cent, with strength in non-residential construction and high-tech services.

EDMONTON: The economy will contract by 0.8 per as a result of the drop in oil prices.

CALGARY: The oil price slump will hit the economy hard, with GDP set to drop by 1.2 per cent.

A The pride of homeownership is a dream for most Canadians.

Unfortunately, this may only be a dream for many and may never become a reality.

Some individuals may have difficulty qualifying for a mortgage, even with the creativity of many financial lenders. Rule number 1: Buy what you can afford, not what you can borrow. Price increases in the Toronto real estate market easily outpace the marginal increases in salaries of the average Toronto household.

Pooling the financial resources of several family members can be an excellent opportunity for first-time buyers to get into a home. Eventually, you can save sufficient equity to have your own dream home. Obviously, this does not come without making sacrifices and concessions. A dream home can quickly become a nightmare, particularly when your mother-in-law may not be your first choice in house mates.

Extended family arrangements are not uncommon for many immigrant families that have three generations under one roof. For some cultures, this is the norm. However, this form of living arrangement is not for everyone. Most couples marry to start a family, not to inherit two generations of families.

member(s) before making a commitment. Are the down payments equal? How will the equity of the home be divided in the event of a sale? Are the mortgage payments divided equally? What about other costs? What happens if one partner wants out? Whose names goes on title?

›› Does the extended family get along? Family relations can deteriorate faster than an old home with termites! Discuss these arrangements thoroughly with your spouse.

›› A meeting with a lawyer beforehand can ease tension later. Sometimes, it’s good to write things down and not have regrets later. Make no mistake, this is a business relationship.

›› Family financial resource pooling can be very successful for real estate and stock investments. Some of Canada’s wealthiest owners of real estate and public companies are family owned. It sometimes pays to keep it “all in the family.”

›› Your tax adviser can explain some pros and cons of pooling from a tax perspective. Compare the tax advantages of having extended families under one roof, with the loss of other tax credits and government programs.

›› How is the credit rating of the other family members? Pooling can help family members with less than excellent credit re-establish themselves.

Family dynamics are an important ingredient when families pool their financial resources. Real estate prices will always rise and fall, but families are priceless.

5 ways to build better GTA neighbourhoods

Midrise homes are key to the successful growth of GTA neighbourhoods, and there are five ways to make this happen, according to a new report from the Pembina Institute and the Ontario Home Builders’ Association.

The study identifies barriers to creating walkable, affordable and transit-connected homes for families, and recommends five simple changes to development rules to help increase the supply of family-friendly midrise homes.

Make Way for Midrise: How to Build More Homes in Walkable, Transit-Connected Neighbourhoods, shows how the GTA could build more medium-density housing where it is needed most. This is critical to accommodate the region’s growing population, while still providing affordable choices for families in central neighbourhoods.

“Our region has a very strong housing market, but for many people affordable choices are limited,” Mike Collins-Williams, director of policy for the OHBA, told New Home Guide. “For many homeowners and potential homebuyers, their affordable choices are limited to either highrise towers or traditional suburban neighbourhoods. Our recommendations would provide more choices by offering more locations for affordable midrise development which are often more suitable for neighbourhood avenues and main streets, as well as along rapid transit corridors.

“Midrise buildings are more human-scaled in terms of size. They fit into the character of neighbourhoods and animate sidewalk culture, in particular by providing street-level retail. They can also offer family-sized units. Midrise, mixed-use development is a valuable tool when creating neighbourhoods that support healthy lifestyles and local economies, since it can help increase walkability and put more people close to transit, while also supporting local business.”

The report notes important implications for upcoming transit projects, such as SmartTrack and the Hurontario-Main light rail line. Unless there are strong requirements for higher-density development along new transit lines, the region is squandering opportunities to create thousands of new homes and businesses in these GTA neighbourhoods where people want to live and work.

The report identifies five additional changes to make midrise development more economically viable.1| Require minimum densities along rapid transit lines2| Eliminate minimum parking requirements3| Pre-approve midrise development along avenues and

transit corridors4| Require retail planning before midrise is built5| Make parkland dedication rules more equitable

“A number of rules, regulations and financial constraints make building midrise cost-prohibitive, compared to other options,” says Collins-Williams. This means developers often choose to build highrise instead, to generate better returns on their investment by selling more units. If developers do take on the higher costs of midrise buildings, these are ultimately passed on to homebuyers, making the units too costly for many families.

“It doesn’t have to be this way,” Collins-Williams says. “The provincial government recently revised the building code to allow for wood frame construction up to six storeys – a simple policy change that will help encourage midrise development. But there are real challenges, some organized community groups are opposed to any changes in their neighbourhoods (NIMBYism) and fight midrise proposals. Some municipalities are resistant to pre-zoning for midrise as they prefer to have control over all new proposals and to obtain section 37 density bonusing money, which means midrise homes take longer to go through the planning process and are more expensive to bring to the market.”

Some municipalities, for example, still plan for and require more parking than is necessary, even though many people are choosing to own just one car per household and in transit accessible locations, no car at all.

“Such a plan would deliver more affordable homes in walkable, transit-connected neighbourhoods. Our recommendations also mean a shift towards more transit accessible and oriented development, rather than auto-centric, and would provide a wide range of housing options for people living in the region.”

Before you go new-home shopping, visit your bank, trust company or other financial institution to see what amount of mortgage you qualify for.

Take your significant other, if you have one, because everyone’s income and assets help. Once you know how much you can borrow, secure the best rate you can and lock it in for as long a period as possible. Don’t be afraid to negotiate – the banks want and need your business. Don’t be afraid to shop around for rates and lock-in periods.

You should also visit the condo sales centre armed with your knowledge and check what mortgage rate and term the builder is offering. Take note that the builder may have brought the rate down to make his package more attractive or forced his bank as part of his deal with them to offer special rates. Remember, if your bank’s offered rate and terms are close, you may be able to negotiate a better deal with the builder. If you do not take the builder’s mortgage you may

be able to get some leverage in your overall negotiations as the builder may save money by not having to pay his bank for the better rate. Question this and make sure you understand all of the financing details. Regardless of where you go to get financing, get your commitment in writing!

When you walk into that sales centre, all ready to buy that beautiful

new condo, perhaps the most important piece of the puzzle you need to have is security in your financial arrangements. A tragedy waiting to happen occurs when you sign an unconditional offer, give your hard-earned, harder-saved deposit to the builder and later find out you do not qualify for the mortgage. In other words, don’t buy the home unless you have a mortgage commitment or a conditional deal. This leads us into the next part of the discussion – what happens if your financing goes wrong?

An Agreement of Purchase and Sale for the purchase of land is a legal contract, and once it is signed it binds both parties to certain obligations. If either party does not hold up to their end of the arrangement, they can be held liable to the other party for either specific performance or damages. Firstly, if the purchasers default, they will likely lose their deposit. The builder will then have the option of suing to force them to close the deal and pay all legal fees related thereto, or sue them for any damages the builder might suffer before he resells the condo (for items such as interest, changes and price differential) and legal fees. Sometimes, in a booming market, kindhearted builders will release purchasers who have made a mistake or encountered personal tragedies. But don’t count on it!

The moral of the story is to make sure you have financing, or that the offer is conditional for a few days on both financing and review by a lawyer. It is critical you get the right advice, and only a lawyer can provide legal advice. That is the law. When you select a lawyer, find one who cares about you and a long-term relationship.

Ikea recently partnered with Jillian Harris to showcase its new Sektion kitchen system – which provides endless possibilities for personalization to suit any space. We adore Jillian’s pretty and feminine-inspired cooking space, and we got a chance to ask her all about it!

New Home Guide: What is your favourite detail about this Ikea kitchen? Jillian Harris: The drawers-inside-drawers that provide maximum storage! I love how they are removable and adjustable. This makes it easy to store your dishes in drawers so that no reaching or looking is necessary.

NHG: How can homeowners keep organized in the kitchen? JH: I put a reminder in my calendar once every six months to look at everything in my cupboards and drawers to see what I’m using – and how often – and organize accordingly. I find ways to section my cupboards and drawers by using Tupperware containers or other storage containers.Lots of labels are really important to me too, as they make everything quick, easy and organized. Another secret of mine is keeping like items stored together. For example, I have a drawer that opens things and cuts food like knives, scissors, and bottle openers and a drawer that “stirs” with items like spatulas, spoons and whisks.

NHG: How can homeowners add style to their cooking space without breaking the bank? JH: Adding a touch of fresh herbs and plants you can cook with is a great way to get creative. Also, changing countertop pieces to inexpensive on-trend items such as unique cutting boards, vases and vintage trays.

NHG: What’s the best meal you’ve ever eaten? JH: I have eaten a ton of great meals, but I’d have to say Spaghetti Bolognese will always have a place in my heart as my favourite meal to eat!

NHG: If you could invite anyone famous (living or past) for dinner who would it be? What would be on the menu? JH: It would probably be my great grandpa because I’ve heard from everyone in my family that he was such a great guy. I would make him some pork chops, sauerkraut and home-made perogies. If I had to choose someone famous it would be Oprah, Taylor Swift and Martha Stewart.
