(1) the term ‘‘agency’’ has the meaning given 1

the term in section 551 of title 5, United States 2

Code; 3

(2) the term ‘‘NICS’’ means the National In-4

stant Criminal Background Check System; and 5

(3) the term ‘‘relevant Federal records’’ means 6

any record demonstrating that a person is prohibited 7

from possessing or receiving a firearm under sub-8

section (g) or (n) of section 922 of title 18, United 9

States Code. 10

TITLE I—COMBATING GUN 11

CRIME, NICS REAUTHORIZA-12

TION, AND NICS IMPROVE-13

MENT 14

SEC. 101. REAUTHORIZATION AND IMPROVEMENTS TO 15

NICS. 16

(a) IN GENERAL.—Section 103 of the NICS Im-17

provement Amendments Act of 2007 (18 U.S.C. 922 note) 18

is amended— 19

(1) by redesignating subsection (e) as sub-20

section (f) and amending such subsection to read as 21

follows: 22

‘‘(f) AUTHORIZATION OF APPROPRIATIONS.—There 23

are authorized to be appropriated to carry out this section 24

$20,000,000 for each of fiscal years 2013 through 2017.’’; 1

and 2

(2) by inserting after subsection (d) the fol-3

lowing: 4

‘‘(e) ACCOUNTABILITY.—All grants awarded by the 5

Attorney General under this section shall be subject to the 6

following accountability provisions: 7

‘‘(1) DEFINITION.—In this subsection, the term 8

‘unresolved audit finding’ means a finding in the 9

final audit report of the Inspector General of the 10

Department of Justice that the audited grantee has 11

utilized grant funds for an unauthorized expenditure 12

or otherwise unallowable cost that is not closed or 13

resolved within 12 months from the date when the 14

final audit report is issued. 15

‘‘(2) AUDITS.—Beginning in the first fiscal 16

year beginning after the date of enactment of this 17

subsection, and in each fiscal year thereafter, the In-18

spector General of the Department of Justice shall 19

conduct audits of recipients of grants under this sec-20

tion to prevent waste, fraud, and abuse of funds by 21

grantees. The Inspector General shall determine the 22

appropriate number of grantees to be audited each 23

year. 24

‘‘(3) PRIORITY.—In awarding grants under this 1

section, the Attorney General shall give priority to 2

eligible applicants that did not have an unresolved 3

audit finding during the 3 fiscal years before sub-4

mitting an application for a grant under this sec-5

tion.’’. 6

(b) MODIFICATION OF ELIGIBILITY REQUIRE-7

MENTS.—The NICS Improvement Amendments Act of 8

2007 (18 U.S.C. 922 note) is amended— 9

(1) in section 102(b)(1)— 10

(A) in subparagraph (A), by striking ‘‘sub-11

paragraph (C)’’ and inserting ‘‘subparagraph 12

(B)’’; 13

(B) by striking subparagraph (B); and 14

(C) by redesignating subparagraph (C) as 15

subparagraph (B); 16

(2) in section 103(a)(1), by striking ‘‘and sub-17

ject to section 102(b)(1)(B)’’; and 18

(3) in section 104(d), by striking ‘‘section 19

102(b)(1)(C)’’ and inserting ‘‘section 102(b)(1)(B)’’. 20

SEC. 102. AVAILABILITY OF RECORDS TO NICS. 21

(a) GUIDANCE.—Not later than 45 days after the 22

date of enactment of this Act, the Attorney General shall 23

issue guidance regarding— 24

(1) the identification and sharing of relevant 1

Federal records; and 2

(2) submission of the relevant Federal records 3

to NICS. 4

(b) PRIORITIZATION OF RECORDS.—Each agency 5

that possesses relevant Federal records shall prioritize 6

providing the relevant information contained in the rel-7

evant Federal records to NICS on a regular and ongoing 8

basis in accordance with the guidance issued by the Attor-9

ney General under subsection (a). 10

(c) REPORTS.—Not later than 60 days after the At-11

torney General issues guidance under subsection (a), the 12

head of each agency shall submit a report to the Attorney 13

General that— 14

(1) advises whether the agency possesses rel-15

evant Federal records; and 16

(2) describes the implementation plan of the 17

agency for making the relevant information con-18

tained in relevant Federal records available to NICS 19

in a manner consistent with applicable law. 20

(d) DETERMINATION OF RELEVANCE.—The Attorney 21

General shall resolve any dispute regarding whether— 22

(1) agency records are relevant Federal records; 23

and 24

(2) the relevant Federal records of an agency 1

should be made available to NICS. 2

SEC. 103. DEFINITIONS RELATING TO MENTAL HEALTH. 3

(a) TITLE 18 DEFINITIONS.—Chapter 44 of title 18, 4

United States Code, is amended— 5

(1) in section 921(a), by adding at the end the 6

following: 7

‘‘(36)(A) Subject to subparagraph (B), the term ‘has 8

been adjudicated mentally incompetent or has been com-9

mitted to a psychiatric hospital’, with respect to a per-10

son— 11

‘‘(i) means the person is the subject of an order 12

or finding by a judicial officer, court, board, commis-13

sion, or other adjudicative body— 14

‘‘(I) that was issued after— 15

‘‘(aa) a hearing— 16

‘‘(AA) of which the person re-17

ceived actual notice; and 18

‘‘(BB) at which the person had 19

an opportunity to participate with 20

counsel; or 21

‘‘(bb) the person knowingly and intel-22

ligently waived the opportunity for a hear-23

ing— 24

‘‘(AA) of which the person re-1

ceived actual notice; and 2

‘‘(BB) at which the person would 3

have had an opportunity to participate 4

with counsel; and 5

‘‘(II) that found that the person, as a re-6

sult of marked subnormal intelligence, mental 7

impairment, or mental illness— 8

‘‘(aa) was a danger to himself or to 9

others; 10

‘‘(bb) was guilty but mentally ill in a 11

criminal case; 12

‘‘(cc) was not guilty in a criminal case 13

by reason of insanity or mental disease or 14

defect; 15

‘‘(dd) was incompetent to stand trial 16

in a criminal case; 17

‘‘(ee) was not guilty only by reason of 18

lack of mental responsibility under section 19

850a of title 10 (article 50a of the Uni-20

form Code of Military Justice); 21

‘‘(ff) required involuntary inpatient 22

treatment by a psychiatric hospital; 23

‘‘(gg) required involuntary outpatient 24

treatment by a psychiatric hospital based 25

on a finding that the person is a danger to 1

himself or to others; or 2

‘‘(hh) required involuntary commit-3

ment to a psychiatric hospital for any rea-4

son, including drug use; and 5

‘‘(ii) does not include— 6

‘‘(I) a person who is in a psychiatric hos-7

pital for observation; or 8

‘‘(II) a voluntary admission to a psy-9

chiatric hospital. 10

‘‘(B) In this paragraph, the term ‘order or finding’ 11

does not include— 12

‘‘(i) an order or finding that has expired or has 13

been set aside or expunged; 14

‘‘(ii) an order or finding that is no longer appli-15

cable because a judicial officer, court, board, com-16

mission, or other adjudicative body has found that 17

the person who is the subject of the order or find-18

ing— 19

‘‘(I) does not present a danger to himself 20

or to others; 21

‘‘(II) has been restored to sanity or cured 22

of mental disease or defect; 23

‘‘(III) has been restored to competency; or 24

‘‘(IV) no longer requires involuntary inpa-1

tient or outpatient treatment by, or involuntary 2

commitment to, a psychiatric hospital; or 3

‘‘(iii) an order or finding with respect to which 4

the person who is subject to the order or finding has 5

been granted relief from disabilities under section 6

925(c) or under a program described in section 7

101(c)(2)(A) or 105 of the NICS Improvement 8

Amendments Act of 2007 (18 U.S.C. 922 note). 9

‘‘(37) The term ‘psychiatric hospital’ includes a men-10

tal health facility, a mental hospital, a sanitarium, a psy-11

chiatric facility, and any other facility that provides diag-12

noses by licensed professionals of mental retardation or 13

mental illness, including a psychiatric ward in a general 14

hospital.’’; and 15

(2) in section 922— 16

(A) in subsection (d)(4)— 17

(i) by striking ‘‘as a mental defective’’ 18

and inserting ‘‘mentally incompetent’’; and 19

(ii) by striking ‘‘any mental institu-20

tion’’ and inserting ‘‘a psychiatric hos-21

pital’’; and 22

(B) in subsection (g)(4)— 23

(i) by striking ‘‘as a mental defective 1

or who has’’ and inserting ‘‘mentally in-2

competent or has’’; and 3

(b) TECHNICAL AND CONFORMING AMENDMENT.— 6

The NICS Improvement Amendments Act of 2007 (18 7

U.S.C. 922 note) is amended— 8

(1) by striking ‘‘as a mental defective’’ each 9

place that term appears and inserting ‘‘mentally in-10

competent’’; 11

(2) by striking ‘‘mental institution’’ each place 12

that term appears and inserting ‘‘psychiatric hos-13

pital’’; and 14

(3) in section 102(c)(3)— 15

(A) in the paragraph heading, by striking 16

‘‘AS A MENTAL DEFECTIVE OR COMMITTED TO 17

A MENTAL INSTITUTION’’ and inserting ‘‘MEN-18

TALLY INCOMPETENT OR COMMITTED TO A PSY-19

CHIATRIC HOSPITAL’’; and 20

(B) by striking ‘‘mental institutions’’ and 21

inserting ‘‘psychiatric hospitals’’. 22

SEC. 104. CLARIFICATION THAT FEDERAL COURT INFOR-1

MATION IS TO BE MADE AVAILABLE TO THE 2

NATIONAL INSTANT CRIMINAL BACKGROUND 3

CHECK SYSTEM. 4

Section 103(e)(1) of the Brady Handgun Violence 5

Prevention Act (18 U.S.C. 922 note) is amended by add-6

ing at the end the following: 7

‘‘(F) APPLICATION TO FEDERAL 8

COURTS.—In this paragraph— 9

‘‘(i) the terms ‘department or agency 10

of the United States’ and ‘Federal depart-11

ment or agency’ include a Federal court; 12

and 13

‘‘(ii) for purposes of any request, sub-14

mission, or notification, the Director of the 15

Administrative Office of the United States 16

Courts shall perform the functions of the 17

head of the department or agency.’’. 18

SEC. 105. REPORTS AND CERTIFICATIONS TO CONGRESS. 19

(a) NICS REPORTS.—Not later than October 1, 20

2013, and every year thereafter, the head of each agency 21

that possesses relevant Federal records shall submit a re-22

port to Congress that includes— 23

(1) a description of the relevant Federal records 24

possessed by the agency that can be shared with 25

NICS in a manner consistent with applicable law; 26

(2) the number of relevant Federal records the 1

agency submitted to NICS during the reporting pe-2

riod; 3

(3) efforts made to increase the percentage of 4

relevant Federal records possessed by the agency 5

that are submitted to NICS; 6

(4) any obstacles to increasing the percentage 7

of relevant Federal records possessed by the agency 8

that are submitted to NICS; 9

(5) measures put in place to provide notice and 10

programs for relief from disabilities as required 11

under the NICS Improvement Amendments Act of 12

2007 (18 U.S.C. 922 note) if the agency makes 13

qualifying adjudications relating to the mental 14

health of an individual; 15

(6) measures put in place to correct, modify, or 16

remove records available to NICS when the basis on 17

which the records were made available no longer ap-18

plies; and 19

(7) additional steps that will be taken during 20

the 1-year period after the submission of the report 21

to improve the processes by which relevant Federal 22

records are— 23

(A) identified; 24

(B) made available to NICS; and 25

(C) corrected, modified, or removed from 1

NICS. 2

(b) CERTIFICATIONS.— 3

(1) IN GENERAL.—The annual report require-4

ment in subsection (a) shall not apply to an agency 5

that, as part of a report required to be submitted 6

under subsection (a), provides certification that the 7

agency has— 8

(A) made available to NICS relevant Fed-9

eral records that can be shared in a manner 10

consistent with applicable law; 11

(B) a plan to make any relevant Federal 12

records available to NICS and a description of 13

that plan; and 14

(C) a plan to update, modify, or remove 15

records electronically from NICS not less than 16

quarterly as required by the NICS Improve-17

ment Amendments Act of 2007 (18 U.S.C. 922 18

note) and a description of that plan. 19

(2) FREQUENCY.—Each agency that is not re-20

quired to submit annual reports under paragraph 21

(1) shall submit an annual certification to Congress 22

attesting that the agency continues to submit rel-23

evant Federal records to NICS and has corrected, 24

modified, or removed records available to NICS 25

when the basis on which the records were made 1

available no longer applies. 2

(c) REPORTS TO CONGRESS ON FIREARMS PROSECU-3

TIONS.— 4

(1) REPORT TO CONGRESS.—Beginning Feb-5

ruary 1, 2014, and on February 1 of each year 6

thereafter through 2023, the Attorney General shall 7

submit to the Committees on the Judiciary and 8

Committees on Appropriations of the Senate and the 9

House of Representatives a report of information 10

gathered under this subsection during the fiscal year 11

that ended on September 30 of the preceding year. 12

(2) SUBJECT OF ANNUAL REPORT.—Not later 13

than 90 days after the date of enactment of this 14

Act, the Attorney General shall require each compo-15

nent of the Department of Justice, including each 16

United States Attorney’s Office, to furnish for the 17

purposes of the report described in paragraph (1), 18

information relating to any case presented to the 19

Department of Justice for review or prosecution, in 20

which the objective facts of the case provide probable 21

cause to believe that there has been a violation of 22

sections 922 and 924, United States Code, and sec-23

tion 5861 of the Internal Revenue Code of 1986. 24

(3) ELEMENTS OF ANNUAL REPORT.—With re-1

spect to each case described in paragraph (2), the 2

report submitted under paragraph (1) shall include 3

information indicating— 4

(A) whether in any such case, a decision 5

has been made not to charge an individual with 6

a violation of sections 922 and 924, United 7

States Code, and section 5861 of the Internal 8

Revenue Code of 1986, or any other violation of 9

Federal criminal law; 10

(B) in any case described in subparagraph 11

(A), a description of why no charge was filed 12

under sections 922 and 924, United States 13

Code, and section 5861 of the Internal Revenue 14

Code of 1986; 15

(C) whether in any case described in para-16

graph (2), an indictment, information, or other 17

charge has been brought against any person, or 18

the matter is pending; 19

(D) whether, in the case of an indictment, 20

information, or other charge described in sub-21

paragraph (C), the charging document contains 22

SEC. 106. INCREASING FEDERAL PROSECUTION OF GUN VI-4

OLENCE. 5

(a) IN GENERAL.—Not later than 90 days after the 6

date of enactment of this Act, the Attorney General shall 7

establish in jurisdictions specified in subsection (c) a pro-8

gram that meets the requirements of subsection (b), to 9

be known as the ‘‘Nationwide Project Exile Expansion’’. 10

(b) PROGRAM ELEMENTS.—Each program estab-11

lished under subsection (a) shall, for the jurisdiction con-12

cerned— 13

(1) provide for coordination with State and 14

local law enforcement officials in the identification of 15

violations of Federal firearms laws; 16

(2) provide for the establishment of agreements 17

with State and local law enforcement officials for the 18

referral to the Bureau of Alcohol, Tobacco, Fire-19

arms, and Explosives and the United States Attor-20

ney for prosecution of persons arrested for violations 21

of section 922 or section 924 of title 18, United 22

States Code, or section 5861 of the Internal Rev-23

enue Code of 1986, relating to firearms; 24

(3) provide for the establishment of multi-juris-1

dictional task forces, coordinated by the Executive 2

Office of the United States attorneys to investigate 3

and prosecute illegal straw purchasing rings that 4

purchase firearms in one jurisdiction and transfer 5

them to another; 6

(4) require that the United States attorney des-7

ignate not less than 1 assistant United States attor-8

ney to prosecute violations of Federal firearms laws; 9

(5) provide for the hiring of agents for the Bu-10

reau of Alcohol, Tobacco, Firearms, and Explosives 11

to investigate violations of the provisions referred to 12

in paragraph (2), United States Code, relating to 13

firearms; and 14

(6) ensure that each person referred to the 15

United States attorney under paragraph (2) be 16

charged with a violation of the most serious Federal 17

firearm offense consistent with the act committed. 18

(c) COVERED JURISDICTIONS.— 19

(1) IN GENERAL.—Subject to paragraph (2), 20

the jurisdictions specified in this subsection are— 21

(A) the 10 jurisdictions with a population 22

equal to or greater than 100,000 persons that 23

had the highest total number of homicides ac-24

cording to the uniform crime report of the Fed-25

eral Bureau of Investigation for the most recent 1

year available; 2

(B) the 5 jurisdictions with such a popu-3

lation, other than the jurisdictions covered by 4

paragraph (1), with the highest per capita rate 5

of homicide according to the uniform crime re-6

port of the Federal Bureau of Investigation for 7

the most recent year available; and 8

(C) the 3 tribal jurisdictions that have the 9

highest homicide crime rates, as determined by 10

the Attorney General. 11

(2) LIMITATION.—The 15 jurisdictions de-12

scribed in subparagraphs (A) and (B) shall not in-13

clude any jurisdiction other than those within the 50 14

States. 15

(d) ANNUAL REPORTS.—Not later than 1 year after 16

the date of enactment of this Act, an annually thereafter, 17

the Attorney General shall submit to the Committee on 18

the Judiciary of the Senate and the Committee on the Ju-19

diciary of the House of Representatives a report con-20

taining the following information: 21

(1) The number of individuals indicted for such 22

violations of Federal firearms laws during that year 23

by reason of the program. 24

(2) The increase or decrease in the number of 1

individuals indicted for such violations of Federal 2

firearms laws during that year by reason of the pro-3

gram when compared with the year preceding that 4

year. 5

(3) The number of individuals held without 6

bond in anticipation of prosecution by reason of the 7

program. 8

(4) To the extent the information is available, 9

the average length of prison sentence of the individ-10

uals convicted of violations of Federal firearms laws 11

by reason of the program. 12

(5) The number of multi-jurisdiction task forces 13

established and the number of individuals arrested, 14

indicted, convicted or acquitted of charges for viola-15

tions of the specific crimes listed in subsection 16

(b)(2). 17

(e) AUTHORIZATION OF APPROPRIATIONS.— 18

(1) IN GENERAL.—There are authorized to be 19

appropriated to carry out the program under this 20

section $15,000,000 for each of fiscal years 2014, 21

2015, and 2016, which shall be used for salaries and 22

expenses of assistant United States attorneys and 23

Bureau of Alcohol, Tobacco, Firearms, and Explo-24

sives agents. 25

(2) USE OF FUNDS.— 1

(A) ASSISTANT UNITED STATES ATTOR-2

NEYS.—The assistant United States attorneys 3

hired using amounts authorized to be appro-4

priated under paragraph (1) shall prosecute vio-5

lations of Federal firearms laws in accordance 6

with subsection (b)(2). 7

(B) ATF AGENTS.—The Bureau of Alco-8

hol, Tobacco, Firearms, and Explosives agents 9

hired using amounts authorized to be appro-10

priated under paragraph (1) shall, to the max-11

imum extent practicable, concentrate their in-12

vestigations on violations of Federal firearms 13

laws in accordance with subsection (b)(2). 14

SEC. 107. PROSECUTION OF FELONS AND FUGITIVES WHO 15

ATTEMPT TO ILLEGALLY PURCHASE FIRE-16

ARMS. 17

(a) TASKFORCE.— 18

(1) ESTABLISHMENT.—There is established a 19

task force within the Department of Justice, which 20

shall be known as the Felon and Fugitive Firearm 21

Task Force (referred to in this section as the ‘‘Task 22

Force’’), to strengthen the efforts of the Department 23

of Justice to investigate and prosecute cases of con-24

victed felons and fugitives from justice who illegally 1

attempt to purchase a firearm. 2

(2) MEMBERSHIP.—The members of the Task 3

Force shall be— 4

(A) the Deputy Attorney General, who 5

shall serve as the Chairperson of the Task 6

Force; 7

(B) the Assistant Attorney General for the 8

Criminal Division; 9

(C) the Director of the Bureau of Alcohol, 10

Tobacco, Firearms, and Explosives; 11

(D) the Director of the Federal Bureau of 12

Investigation; and 13

(E) such other officers or employees of the 14

Department of Justice as the Attorney General 15

may designate. 16

(3) DUTIES.—The Task Force shall— 17

(A) provide direction for the investigation 18

and prosecution of cases of convicted felons and 19

fugitives from justice attempting to illegally 20

purchase a firearm; and 21

(B) provide recommendations to the Attor-22

ney General relating to— 23

(i) the allocation and reallocation of 24

resources of the Department of Justice for 25

investigation and prosecution of cases of 1

convicted felons and fugitives from justice 2

attempting to illegally purchase a firearm; 3

(ii) enhancing cooperation among 4

agencies and entities of the Federal Gov-5

ernment in the investigation and prosecu-6

tion of cases of convicted felons and fugi-7

tives from justice attempting to illegally 8

purchase a firearm; 9

(iii) enhancing cooperation among 10

Federal, State, and local authorities re-11

sponsible for the investigation and prosecu-12

tion of cases of convicted felons and fugi-13

tives from justice attempting to illegally 14

purchase a firearm; and 15

(iv) changes in rules, regulations, or 16

policy to improve the effective investigation 17

and prosecution of cases of convicted felons 18

and fugitives from justice attempting to il-19

legally purchase a firearm. 20

(4) MEETINGS.—The Task Force shall meet 21

not less than once a year. 22

(5) TERMINATION.—The Task Force shall ter-23

minate on the date that is 5 years after the date of 24

enactment of this Act. 25

(b) AUTHORIZATION FOR USE OF FUNDS.—Section 1

524(c)(1) of title 28, United States Code, is amended— 2

(1) in subparagraph (H), by striking ‘‘and’’ at 3

the end; 4

(2) in subparagraph (I), by striking the period 5

at the end and inserting ‘‘; and’’; and 6

(3) by inserting after subparagraph (I) the fol-7

lowing: 8

‘‘(J) the investigation and prosecution of cases 9

of convicted felons and fugitives from justice who il-10

legally attempt to purchase a firearm, in accordance 11

with section 107 of the Protecting Communities and 12

Preserving the Second Amendment Act of 2013, pro-13

vided that— 14

‘‘(i) not more than $10,000,000 shall be 15

available to the Attorney General for each of 16

fiscal years 2014 through 2018 under this sub-17

paragraph; and 18

‘‘(ii) not more than 5 percent of the 19

amounts made available under this subpara-20

graph may be used for the administrative costs 21

of the task force established under section 107 22

of the Protecting Communities and Preserving 23

the Second Amendment Act of 2013.’’. 24

SEC. 108. LIMITATION ON OPERATIONS BY THE DEPART-1

MENT OF JUSTICE. 2

The Department of Justice, and any of its law en-3

forcement coordinate agencies, shall not conduct any oper-4

ation where a Federal firearms licensee is directed, in-5

structed, enticed, or otherwise encouraged by the Depart-6

ment of Justice to sell a firearm to an individual if the 7

Department of Justice, or a coordinate agency, knows or 8

has reasonable cause to believe that such an individual is 9

purchasing on behalf of another for an illegal purpose un-10

less the Attorney General, the Deputy Attorney General, 11

or the Assistant Attorney General for the Criminal Divi-12

sion personally reviews and approves the operation, in 13

writing, and determines that the agency has prepared an 14

operational plan that includes sufficient safeguards to pre-15

vent firearms from being transferred to third parties with-16

out law enforcement taking reasonable steps to lawfully 17

interdict those firearms. 18

SEC. 109. STRAW PURCHASING OF FIREARMS. 19

(a) IN GENERAL.—Chapter 44 of title 18, United 20

States Code, is amended by adding at the end the fol-21

lowing: 22

‘‘§ 932. Straw purchasing of firearms 23

‘‘(a) DEFINITIONS.—For purposes of this section— 24

‘‘(1) the term ‘crime of violence’ has the mean-25

ing given that term in section 924(c)(3); 26

‘‘(2) the term ‘drug trafficking crime’ has the 1

meaning given that term in section 924(c)(2); and 2

‘‘(3) the term ‘Federal crime of terrorism’ has 3

the meaning given that term in section 2332b(g). 4

‘‘(b) OFFENSE.—It shall be unlawful for any person 5

to— 6

‘‘(1) purchase or otherwise obtain a firearm, 7

which has been shipped, transported, or received in 8

interstate or foreign commerce, for or on behalf of 9

any other person who the person purchasing or oth-10

erwise obtaining the firearm knows— 11

‘‘(A) is prohibited from possessing or re-12

ceiving a firearm under subsection (g) or (n) of 13

section 922; 14

‘‘(B) intends to use, carry, possess, or sell 15

or otherwise dispose of the firearm in further-16

ance of a crime of violence, a drug trafficking 17

crime, or a Federal crime of terrorism; 18

‘‘(C) intends to engage in conduct that 19

would constitute a crime of violence, a drug 20

trafficking crime, or a Federal crime of ter-21

rorism if the conduct had occurred within the 22

United States; or 23

‘‘(D) is not a resident of any State and is 1

not a citizen or lawful permanent resident of 2

the United States; or 3

‘‘(2) willfully procure another to engage in con-4

duct described in paragraph (1). 5

‘‘(c) PENALTY.—Any person who violates subsection 6

(b) shall be fined under this title, imprisoned not more 7

than 15 years, or both. 8

‘‘§ 933. Trafficking in firearms 9

‘‘(a) DEFINITIONS.—For purposes of this section— 10

‘‘(1) the term ‘crime of violence’ has the mean-11

ing given that term in section 924(c)(3); 12

‘‘(2) the term ‘drug trafficking crime’ has the 13

meaning given that term in section 924(c)(2); and 14

‘‘(3) the term ‘Federal crime of terrorism’ has 15

the meaning given that term in section 2332b(g). 16

‘‘(b) OFFENSE.—It shall be unlawful for any person 17

to— 18

‘‘(1) ship, transport, transfer, or otherwise dis-19

pose of 2 or more firearms to another person in or 20

otherwise affecting interstate or foreign commerce, if 21

the transferor knows that the use, carrying, or pos-22

session of a firearm by the transferee would violate 23

subsection (g) or (n) of section 922, or constitute a 24

crime of violence, a drug trafficking crime, or a Fed-1

eral crime of terrorism; 2

‘‘(2) receive from another person 2 or more 3

firearms in or otherwise affecting interstate or for-4

eign commerce, if the recipient— 5

‘‘(A) knows that such receipt would violate 6

subsection (g) or (n) of section 922; or 7

‘‘(B) intends to use the firearm in further-8

ance of a crime of violence, a drug trafficking 9

crime, or a Federal crime of terrorism; or 10

‘‘(3) attempt or conspire to commit the conduct 11

described in paragraph (1) or (2). 12

‘‘(c) PENALTIES.— 13

‘‘(1) IN GENERAL.—Any person who violates 14

subsection (b) shall be fined under this title, impris-15

oned not more than 15 years, or both. 16

‘‘(2) ORGANIZER.—If a violation of subsection 17

(b) is committed by a person acting in concert with 18

other persons as an organizer, leader, supervisor, or 19

manager, the person shall be fined under this title, 20

imprisoned not more than 20 years, or both.’’. 21

(b) TECHNICAL AND CONFORMING AMENDMENT.— 22

The table of sections for chapter 44 of title 18, United 23

States Code, is amended by inserting after the item relat-24

ing to section 931 the following: 25

(c) DIRECTIVE TO THE SENTENCING COMMISSION.— 1

Pursuant to its authority under section 994 of title 28, 2

United States Code, and in accordance with this section, 3

the United States Sentencing Commission shall review and 4

amend its guidelines and policy statements to ensure that 5

persons convicted of an offense under section 932 or 933 6

of title 18, United States Code, and other offenses applica-7

ble to the straw purchases and firearms trafficking of fire-8

arms are subject to increased penalties in comparison to 9

those currently provided by the guidelines and policy state-10

ments for such straw purchasing and firearms trafficking 11

offenses. In its review, the Commission shall consider, in 12

particular, an appropriate amendment to reflect the intent 13

of Congress that straw purchasers without significant 14

criminal histories receive sentences that are sufficient to 15

deter participation in such activities. The Commission 16

shall also review and amend its guidelines and policy state-17

ments to reflect the intent of Congress that a person con-18

victed of an offense under section 932 or 933 of title 18, 19

United States Code, who is affiliated with a gang, cartel, 20

organized crime ring, or other such enterprise should be 21

subject to higher penalties than an otherwise unaffiliated 22

individual. 23

SEC. 110. INCREASED PENALTIES FOR LYING AND BUYING. 1

Section 924(a)(1) of title 18, United States Code, is 2

amended in the undesignated matter following subpara-3

graph (D) by striking ‘‘five years’’ and inserting the fol-4

lowing: ‘‘5 years (or, in the case of a violation under sub-5

paragraph (A), not more than 10 years)’’. 6

SEC. 111. AMENDMENTS TO SECTION 924(a). 7

Section 924(a) of title 18, United States Code, is 8

amended— 9

(1) in paragraph (2), by striking ‘‘(d), (g),’’; 10

and 11

(2) by adding at the end the following: 12

‘‘(8) Whoever knowingly violates subsection (d), 13

(g), or (n) of section 922 shall be fined under this 14

title, imprisoned not more than 15 years, or both.’’. 15

SEC. 112. AMENDMENTS TO SECTION 924(h). 16

Section 924 of title 18, United States Code, is 17

amended by striking subsection (h) and inserting the fol-18

lowing: 19

‘‘(h) Whoever knowingly receives or transfers a fire-20

arm or ammunition, or attempts or conspires to do so, 21

knowing that such firearm or ammunition will be used to 22

commit a crime of violence (as defined in subsection 23

(c)(3)), a drug trafficking crime (as defined in subsection 24

(c)(2)), a Federal crime of terrorism (as defined in section 25

2332b(g)), or a crime under the Arms Export Control Act 26

(22 U.S.C. 2751 et seq.), the International Emergency 1

Economic Powers Act (50 U.S.C. 1701 et seq.), or the 2

Foreign Narcotics Kingpin Designation Act (21 U.S.C. 3

1901 et seq.), shall be imprisoned not more than 15 years, 4

fined in accordance with this title, or both.’’. 5

SEC. 113. AMENDMENTS TO SECTION 924(k). 6

Section 924 of title 18, United States Code, is 7

amended by striking subsection (k) and inserting the fol-8

lowing: 9

‘‘(k)(1) A person who, with intent to engage in or 10

promote conduct that— 11

‘‘(A) is punishable under the Controlled Sub-12

stances Act (21 U.S.C. 801 et seq.), the Controlled 13

Substances Import and Export Act (21 U.S.C. 951 14

et seq.), or chapter 705 of title 46; 15

‘‘(B) violates any law of a State relating to any 16

controlled substance (as defined in section 102 of 17

the Controlled Substances Act, 21 U.S.C. 802); 18

‘‘(C) constitutes a crime of violence (as defined 19

in subsection (c)(3)); or 20

‘‘(D) constitutes a Federal crime of terrorism 21

(as defined in section 2332b(g)), 22

smuggles or knowingly brings into the United States, a 23

firearm or ammunition, or attempts or conspires to do so, 24

shall be imprisoned not more than 15 years, fined under 1

this title, or both. 2

‘‘(2) A person who, with intent to engage in or to 3

promote conduct that— 4

‘‘(A) would be punishable under the Controlled 5

Substances Act (21 U.S.C. 801 et seq.), the Con-6

trolled Substances Import and Export Act (21 7

U.S.C. 951 et seq.), or chapter 705 of title 46, if the 8

conduct had occurred within the United States; or 9

‘‘(B) would constitute a crime of violence (as 10

defined in subsection (c)(3)) or a Federal crime of 11

terrorism (as defined in section 2332b(g)) for which 12

the person may be prosecuted in a court of the 13

United States, if the conduct had occurred within 14

the United States, 15

smuggles or knowingly takes out of the United States, a 16

firearm or ammunition, or attempts or conspires to do so, 17

shall be imprisoned not more than 15 years, fined under 18

this title, or both.’’. 19

SEC. 114. MULTIPLE SALES REPORTS FOR RIFLES AND 20

SHOTGUNS. 21

Section 923(g)(5) of title 18, United States Code, is 22

amended by adding at the end the following: 23

‘‘(C) The Attorney General may not require a licensee 24

to submit ongoing or periodic reporting of the sale or other 25

disposition of 2 or more rifles or shotguns during a speci-1

fied period of time.’’. 2

SEC. 115. STUDY BY THE NATIONAL INSTITUTES OF JUS-3

TICE AND NATIONAL ACADEMY OF SCIENCES 4

ON THE CAUSES OF MASS SHOOTINGS. 5

(a) IN GENERAL.— 6

(1) STUDY.—Not later than 90 days after the 7

date of enactment of this Act, the Attorney General 8

shall instruct the Director of the National Institutes 9

of Justice, to conduct a peer-reviewed study to ex-10

amine various sources and causes of mass shootings 11

including psychological factors, the impact of violent 12

video games, and other factors. The Director shall 13

enter into a contract with the National Academy of 14

Sciences to conduct this study jointly with an inde-15

pendent panel of 5 experts appointed by the Acad-16

emy. 17

(2) REPORT.—Not later than 1 year after the 18

date on which the study required under paragraph 19

(1) begins, the Directors shall submit to Congress a 20

report detailing the findings of the study. 21

(b) ISSUES EXAMINED.—The study conducted under 22

subsection (a)(1) shall examine— 23

(1) mental illness; 24

(2) the availability of mental health and other 1

resources and strategies to help families detect and 2

counter tendencies toward violence; 3

(3) the availability of mental health and other 4

resources at schools to help detect and counter ten-5

dencies of students towards violence; 6

(4) the extent to which perpetrators of mass 7

shootings, either alleged, convicted, deceased, or oth-8

erwise, played violent or adult-themed video games 9

and whether the perpetrators of mass shootings dis-10

cussed, planned, or used violent or adult-themed 11

video games in preparation of or to assist in car-12

rying out their violent actions; 13

(5) familial relationships, including the level of 14

involvement and awareness of parents; 15

(6) exposure to bullying; and 16

(7) the extent to which perpetrators of mass 17

shootings were acting in a ‘‘copycat’’ manner based 18

upon previous violent events. 19

SEC. 116. REPORTS TO CONGRESS REGARDING AMMUNI-20

TION PURCHASES BY FEDERAL AGENCIES. 21

Not later than 1 year after the date of enactment 22

of this Act, the Director of the Office of Management and 23

Budget, shall report to the Speaker of the House of Rep-24

resentatives, the President Pro Tempore of the Senate, 25

and the Chairmen and Ranking Members of the House 1

and Senate Committee on Appropriations and the Com-2

(2) a summary of all purchases, solicitations, 10

and expenditures on ammunition by each Federal 11

agency; 12

(3) a summary of all the rounds of ammunition 13

expended by each Federal agency and a current list-14

ing of stockpiled ammunition for each Federal agen-15

cy; and 16

(4) an estimate of future ammunition needs 17

and purchases for each Federal agency for the next 18

fiscal year. 19

SEC. 117. REDUCTION OF BYRNE JAG FUNDS FOR STATE 20

FAILURE TO PROVIDE MENTAL HEALTH 21

RECORDS TO NICS. 22

Section 104(b) of the NICS Improvement Amend-23

ments Act of 2007 (18 U.S.C. 922 note) is amended— 24

(1) by striking paragraphs (1) and (2); 25

LINE.—Beginning on the date that is 5 years 8

after the date of enactment of the Protecting 9

Communities and Preserving the Second 10

Amendment Act of 2013, the Attorney General 11

shall withhold 10 percent of the amount that 12

would otherwise be allocated to a State under 13

section 505 of the Omnibus Crime Control and 14

Safe Streets Act of 1968 (42 U.S.C. 3755) if 15

SEC. 118. FIREARM COMMERCE MODERNIZATION. 19

(a) FIREARMS DISPOSITIONS.—Section 922(b)(3) of 20

title 18, United States Code, is amended— 21

(1) in the matter preceding subparagraph (A), 22

by striking ‘‘located’’ and inserting ‘‘located or tem-23

porarily located’’; and 24

(2) in subparagraph (A)— 25

lows and inserting ‘‘Act.’’; and 19

(2) by adding at the end the following: 20

‘‘(m) Nothing in this chapter shall be construed to 21

prohibit the sale, transfer, delivery, or other disposition 22

of a firearm or ammunition— 23

‘‘(1) by a person licensed under this chapter to 1

another person so licensed, at any location in any 2

State; or 3

‘‘(2) by a licensed importer, licensed manufac-4

under this chapter, at a temporary location de-6

scribed in subsection (j) in any State.’’. 7

(c) RESIDENCE OF UNITED STATES OFFICERS.— 8

Section 921 of title 18, United States Code, is amended 9

by striking subsection (b) and inserting the following: 10

‘‘(b) For purposes of this chapter: 11

‘‘(1) A member of the Armed Forces on active 12

duty, or a spouse of such a member, is a resident 13

of— 14

‘‘(A) the State in which the member or 15

spouse maintains legal residence; 16

‘‘(B) the State in which the permanent 17

duty station of the member is located; and 18

‘‘(C) the State in which the member main-19

tains a place of abode from which the member 20

commutes each day to the permanent duty sta-21

tion of the member. 22

‘‘(2) An officer or employee of the United 23

States (other than a member of the Armed Forces) 24

who is stationed outside the United States for a pe-25

riod of more than 1 year, and a spouse of such an 1

officer or employee, is a resident of the State in 2

which the person maintains legal residence.’’. 3

SEC. 119. FIREARM DEALER ACCESS TO LAW ENFORCE-4

MENT INFORMATION. 5

(a) IN GENERAL.—Section 103(b) of the Brady 6

Handgun Violence Prevention Act (18 U.S.C. 922 note), 7

is amended— 8

(1) by striking ‘‘Not later than’’ and inserting 9

the following: 10

‘‘(1) IN GENERAL.—Not later than’’; and 11

(2) by adding at the end the following: 12

‘‘(2) VOLUNTARY BACKGROUND CHECKS.— 13

‘‘(A) IN GENERAL.—Not later than 90 14

days after the date of enactment of the Pro-15

tecting Communities and Preserving the Second 16

Amendment Act of 2013, the Attorney General 17

shall promulgate regulations allowing licensees 18

to use the national instant criminal background 19

check system established under this section for 20

purposes of conducting voluntary, no fee em-21

ployment background checks on current or pro-22

spective employees. 23

‘‘(B) NOTICE.—Before conducting an em-24

ployment background check relating to an indi-25

vidual under subparagraph (A), a licensee 1

shall— 2

‘‘(i) provide written notice to the indi-3

vidual that the licensee intends to conduct 4

the background check; and 5

‘‘(ii) obtain consent to conduct the 6

background check from the individual in 7

writing. 8

‘‘(C) EXEMPTION.—An employment back-9

ground check conducted by a licensee under 10

subparagraph (A) shall not governed by the 11

Fair Credit Reporting Act (15 U.S.C. 1681 et 12

seq.). 13

‘‘(D) APPEAL.—Any individual who is the 14

subject of an employment background check 15

conducted by a licensee under subparagraph 16

(A) the result of which indicates that the indi-17

vidual is a prohibited from possessing a firearm 18

or ammunition pursuant to subsection (g) or 19

(n) of section 922 of title 18, United States 20

Code, may appeal the results of the background 21

check in the same manner and to the same ex-22

tent as if the individual had been the subject of 23

a background check relating to the transfer of 24

a firearm.’’. 25

(b) ACQUISITION, PRESERVATION, AND EXCHANGE 1

OF IDENTIFICATION RECORDS AND INFORMATION.—Sec-2

tion 534 of title 28, United States Code, is amended— 3

(1) in subsection (a)— 4

(A) in paragraph (3), by striking ‘‘and’’ at 5

the end; 6

(B) in paragraph (4), by striking the pe-7

riod at the end and inserting ‘‘; and’’; and 8

(C) by inserting after paragraph (4) the 9

following: 10

‘‘(5) provide a person licensed as an importer, 11

manufacturer, or dealer of firearms under chapter 12

44 of title 18 with information necessary to verify 13

whether firearms offered for sale to such licensees 14

have been stolen.’’; and 15

(2) in subsection (b), by inserting ‘‘, except for 16

dissemination authorized under subsection (a)(5) of 17

this section’’ before the period. 18

(c) REGULATIONS.—Not later than 90 days after the 19

date of enactment of this Act, and without regard to chap-20

ter 5 of title 5, United States Code, the Attorney General 21

shall promulgate regulations allowing a person licensed as 22

an importer, manufacturer, or dealer of firearms under 23

chapter 44 of title 18, United States Code, to receive ac-24

cess to records of stolen firearms maintained by the Na-25

tional Crime Information Center operated by the Federal 1

Bureau of Investigation, solely for the purpose of volun-2

tarily verifying whether firearms offered for sale to such 3

licensees have been stolen. 4

(d) STATUTORY CONSTRUCTION; EVIDENCE.— 5

(1) STATUTORY CONSTRUCTION.—Nothing in 6

this section or the amendments made by this section 7

shall be construed— 8

(A) to create a cause of action against any 9

person licensed as an importer, manufacturer, 10

or dealer of firearms under chapter 44 of title 11

18, United States Code or any other person for 12

any civil liability; or 13

(B) to establish any standard of care. 14

(2) EVIDENCE.—Notwithstanding any other 15

provision of law, evidence regarding the use or non- 16

use by a person licensed as an importer, manufac-17

turer, or dealer of firearms under chapter 44 of title 18

18, United States Code of the systems, information, 19

or records made available under this section or the 20

amendments made by this section shall not be ad-21

missible as evidence in any proceeding of any court, 22

agency, board, or other entity. 23

SEC. 120. INTERSTATE TRANSPORTATION OF FIREARMS OR 1

AMMUNITION. 2

(a) IN GENERAL.—Section 926A of title 18, United 3

States Code, is amended to read as follows: 4

‘‘§ 926A. Interstate transportation of firearms or am-5

munition 6

‘‘(a) DEFINITION.—In this section, the term ‘trans-7

port’ includes staying in temporary lodging overnight, 8

stopping for food, fuel, vehicle maintenance, an emer-9

gency, medical treatment, and any other activity incidental 10

to the transport. 11

‘‘(b) AUTHORIZATION.—Notwithstanding any provi-12

sion of any law (including a rule or regulation) of a State 13

or any political subdivision thereof, a person who is not 14

prohibited by this chapter from possessing, transporting, 15

shipping, or receiving a firearm or ammunition shall be 16

entitled to— 17

‘‘(1) transport a firearm for any lawful purpose 18

from any place where the person may lawfully pos-19

sess, carry, or transport the firearm to any other 20

such place if, during the transportation— 21

‘‘(A) the firearm is unloaded; and 22

‘‘(B)(i) if the transportation is by motor 23

vehicle— 24

‘‘(I) the firearm is not directly acces-1

sible from the passenger compartment of 2

the motor vehicle; or 3

‘‘(II) if the motor vehicle is without a 4

compartment separate from the passenger 5

compartment, the firearm is— 6

‘‘(aa) in a locked container other 7

than the glove compartment or con-8

sole; or 9

‘‘(bb) secured by a secure gun 10

storage or safety device; or 11

‘‘(ii) if the transportation is by other 12

means, the firearm is in a locked container or 13

secured by a secure gun storage or safety de-14

vice; and 15

‘‘(2) transport ammunition for any lawful pur-16

pose from any place where the person may lawfully 17

possess, carry, or transport the ammunition, to any 18

other such place if, during the transportation— 19

‘‘(A) the ammunition is not loaded into a 20

firearm; and 21

‘‘(B)(i) if the transportation is by motor 22

vehicle— 23

‘‘(I) the ammunition is not directly 1

accessible from the passenger compartment 2

‘‘(ii) if the transportation is by other 9

‘‘(c) STATE LAW.— 11

‘‘(1) ARREST AUTHORITY.—A person who is 12

transporting a firearm or ammunition may not be— 13

‘‘(A) arrested for violation of any law or 14

any rule or regulation of a State, or any polit-15

ical subdivision thereof, relating to the posses-16

sion, transportation, or carrying of firearms or 17

ammunition, unless there is probable cause to 18

believe that the transportation is not in accord-19

ance with subsection (b); or 20

‘‘(B) detained for violation of any law or 21

any rule or regulation of a State, or any polit-22

ical subdivision thereof, relating to the posses-23

sion, transportation, or carrying of firearms or 24

ammunition, unless there is reasonable sus-25

picion that the transportation is not in accord-1

ance with subsection (b). 2

‘‘(2) PROSECUTION.— 3

‘‘(A) BURDEN OF PROOF.—If a person as-4

serts this section as a defense in a criminal pro-5

ceeding, the government shall bear the burden 6

of proving, beyond a reasonable doubt, that the 7

conduct of the person was not in accordance 8

with subsection (b). 9

‘‘(B) PREVAILING DEFENDANT.—If a per-10

son successfully asserts this section as a defense 11

in a criminal proceeding, the court shall award 12

the prevailing defendant reasonable attorney’s 13

fees.’’. 14

(b) TECHNICAL AND CONFORMING AMENDMENT.— 15

The table of sections for chapter 44 of title 18, United 16

States Code, is amended by striking the item relating to 17

section 926A and inserting the following: 18

‘‘926A. Interstate transportation of firearms or ammunition.’’.

TITLE II—MENTAL HEALTH 19

SEC. 201. REAUTHORIZATION AND ADDITIONAL AMEND-20

MENTS TO THE MENTALLY ILL OFFENDER 21

TREATMENT AND CRIME REDUCTION ACT. 22

rest or confinement or before any court; or 2

‘‘(III) in the case of a veterans treat-3

stance abuse disorder or co-occurring men-7

tal illness and substance abuse disorder; 8

and 9

‘‘(ii) has been unanimously approved 10

for participation in a program funded 11

under this section by, when appropriate, 12

the relevant— 13

‘‘(I) prosecuting attorney; 14

‘‘(II) defense attorney; 15

‘‘(III) probation or corrections 16

official; 17

‘‘(IV) judge; and 18

‘‘(V) a representative from the 19

relevant mental health agency de-20

scribed in subsection (b)(5)(B)(i). 21

‘‘(B) DETERMINATION.—In determining 22

whether to designate a defendant as a prelimi-23

narily qualified offender, the relevant pros-24

ecuting attorney, defense attorney, probation or 25

corrections official, judge, and mental health or 1

substance abuse agency representative shall 2

take into account— 3

‘‘(i) whether the participation of the 4

defendant in the program would pose a 5

‘‘(ii) the criminal history of the de-8

fendant and the nature and severity of the 9

offense for which the defendant is charged; 10

‘‘(iii) the views of any relevant victims 11

to the offense; 12

‘‘(iv) the extent to which the defend-13

ant would benefit from participation in the 14

program; 15

‘‘(v) the extent to which the commu-16

nity would realize cost savings because of 17

the defendant’s participation in the pro-18

gram; and 19

‘‘(vi) whether the defendant satisfies 20

the eligibility criteria for program partici-21

pation unanimously established by the rel-22

evant prosecuting attorney, defense attor-23

ney, probation or corrections official, judge 24

agency representative.’’. 2

(2) TECHNICAL AND CONFORMING AMEND-3

MENT.—Section 2927(2) of the Omnibus Crime 4

Control and Safe Streets Act of 1968 (42 U.S.C. 5

3797s–6(2)) is amended by striking ‘‘has the mean-6

ing given that term in section 2991(a).’’ and insert-7

ing ‘‘means an offense that— 8

‘‘(A) does not have as an element the use, 9

attempted use, or threatened use of physical 10

force against the person or property of another; 11

or 12

‘‘(B) is not a felony that by its nature in-13

volves a substantial risk that physical force 14

against the person or property of another may 15

be used in the course of committing the of-16

fense.’’. 17

(b) EVIDENCE BASED PRACTICES.—Section 2991(c) 18

of title I of the Omnibus Crime Control and Safe Streets 19

Act of 1968 (42 U.S.C. 3797aa(c)) is amended— 20

(1) in paragraph (3), by striking ‘‘or’’ at the 21

end; 22

(2) by redesignating paragraph (4) as para-23

graph (6); and 24

with a moderate or high risk of recidivism and a 7

need for treatment and services; or’’. 8

(c) ACADEMY TRAINING.—Section 2991(h) of title I 9

of the Omnibus Crime Control and Safe Streets Act of 10

1968 (42 U.S.C. 3797aa(h)) is amended— 11

(1) in paragraph (1), by adding at the end the 12

following: 13

‘‘(F) ACADEMY TRAINING.—To provide 14

support for academy curricula, law enforcement 15

officer orientation programs, continuing edu-16

cation training, and other programs that teach 17

law enforcement personnel how to identify and 18

respond to incidents involving persons with 19

mental health disorders or co-occurring mental 20

health and substance abuse disorders.’’; and 21

(2) by adding at the end the following: 22

‘‘(4) PRIORITY CONSIDERATION.—The Attorney 23

General, in awarding grants under this subsection, 24

shall give priority to programs that law enforcement 25

personnel and members of the mental health and 1

substance abuse professions develop and administer 2

cooperatively.’’. 3

(d) ASSISTING VETERANS.— 4

Section 2991 of the Omnibus Crime Control 5

and Safe Streets Act of 1968 (42 U.S.C. 3797aa) is 6

amended— 7

(A) by redesignating subsection (i) as sub-8

section (n); and 9

(B) by inserting after subsection (h) the 10

following: 11

‘‘(i) ASSISTING VETERANS.— 12

‘‘(1) DEFINITIONS.—In this subsection: 13

‘‘(A) PEER TO PEER SERVICES OR PRO-14

GRAMS.—The term ‘peer to peer services or 15

programs’ means services or programs that con-16

nect qualified veterans with other veterans for 17

the purpose of providing support and 18

mentorship to assist qualified veterans in ob-19

taining treatment, recovery, stabilization, or re-20

habilitation. 21

‘‘(B) QUALIFIED VETERAN.—The term 22

‘qualified veteran’ means a preliminarily quali-23

fied offender who— 24

‘‘(i) has served on active duty in any 1

branch of the Armed Forces, including the 2

National Guard and reserve components; 3

and 4

‘‘(ii) was discharged or released from 5

such service under conditions other than 6

dishonorable. 7

‘‘(C) VETERANS TREATMENT COURT PRO-8

GRAM.—The term ‘veterans treatment court 9

program’ means a court program involving col-10

laboration among criminal justice, veterans, and 11

mental health and substance abuse agencies 12

that provides qualified veterans with— 13

‘‘(i) intensive judicial supervision and 14

case management, which may include ran-15

dom and frequent drug testing where ap-16

propriate; 17

‘‘(ii) a full continuum of treatment 18

services, including mental health services, 19

substance abuse services, medical services, 20

and services to address trauma; 21

‘‘(iii) alternatives to incarceration; 22

and 23

‘‘(iv) other appropriate services, in-24

cluding housing, transportation, mentoring, 25

employment, job training, education, and 1

assistance in applying for and obtaining 2

available benefits. 3

‘‘(2) VETERANS ASSISTANCE PROGRAM.— 4

‘‘(A) IN GENERAL.—The Attorney General, 5

in consultation with the Secretary of Veterans 6

Affairs, may award grants under this sub-7

section to applicants to establish or expand— 8

‘‘(i) veterans treatment court pro-9

grams; 10

‘‘(ii) peer to peer services or programs 11

for qualified veterans; 12

‘‘(iii) practices that identify and pro-13

vide treatment, rehabilitation, legal, transi-14

tional, and other appropriate services to 15

qualified veterans who have been incarcer-16

ated; and 17

‘‘(iv) training programs to teach 18

criminal justice, law enforcement, correc-19

tions, mental health, and substance abuse 20

personnel how to identify and appro-21

priately respond to incidents involving 22

qualified veterans. 23

‘‘(B) PRIORITY.—In awarding grants 1

under this subsection, the Attorney General 2

shall give priority to applications that— 3

‘‘(i) demonstrate collaboration be-4

tween and joint investments by criminal 5

justice, mental health, substance abuse, 6

and veterans service agencies; 7

‘‘(ii) promote effective strategies to 8

identify and reduce the risk of harm to 9

qualified veterans and public safety; and 10

‘‘(iii) propose interventions with em-11

pirical support to improve outcomes for 12

qualified veterans.’’. 13

(e) CORRECTIONAL FACILITIES; HIGH UTILIZERS.— 14

Section 2991 of the Omnibus Crime Control and Safe 15

Streets Act of 1968 (42 U.S.C. 3797aa) is amended by 16

inserting after subsection (i), as so added by subsection 17

(d), the following: 18

‘‘(j) CORRECTIONAL FACILITIES.— 19

‘‘(1) DEFINITIONS.— 20

‘‘(A) CORRECTIONAL FACILITY.—The term 21

‘correctional facility’ means a jail, prison, or 22

other detention facility used to house people 23

who have been arrested, detained, held, or con-24

victed by a criminal justice agency or a court. 25

‘‘(B) ELIGIBLE INMATE.—The term ‘eligi-1

ble inmate’ means an individual who— 2

‘‘(i) is being held, detained, or incar-3

cerated in a correctional facility; and 4

‘‘(ii) manifests obvious signs of a 5

mental illness or has been diagnosed by a 6

qualified mental health professional as hav-7

ing a mental illness. 8

‘‘(2) CORRECTIONAL FACILITY GRANTS.—The 9

Attorney General may award grants to applicants to 10

enhance the capabilities of a correctional facility— 11

‘‘(A) to identify and screen for eligible in-12

mates; 13

‘‘(B) to plan and provide— 14

‘‘(i) initial and periodic assessments of 15

the clinical, medical, and social needs of in-16

mates; and 17

‘‘(ii) appropriate treatment and serv-18

ices that address the mental health and 19

substance abuse needs of inmates; 20

‘‘(C) to develop, implement, and enhance— 21

‘‘(i) post-release transition plans for 22

eligible inmates that, in a comprehensive 23

manner, coordinate health, housing, med-24

ical, employment, and other appropriate 1

services and public benefits; 2

‘‘(ii) the availability of mental health 3

care services and substance abuse treat-4

ment services; and 5

‘‘(iii) alternatives to solitary confine-6

ment and segregated housing and mental 7

health screening and treatment for inmates 8

placed in solitary confinement or seg-9

regated housing; and 10

‘‘(D) to train each employee of the correc-11

tional facility to identify and appropriately re-12

spond to incidents involving inmates with men-13

tal health or co-occurring mental health and 14

substance abuse disorders. 15

‘‘(k) DEMONSTRATION GRANTS RESPONDING TO 16

HIGH UTILIZERS.— 17

‘‘(1) DEFINITION.—In this subsection, the term 18

‘high utilizer’ means an individual who— 19

‘‘(A) manifests obvious signs of mental ill-20

ness or has been diagnosed by a qualified men-21

tal health professional as having a mental ill-22

ness; and 23

‘‘(B) consumes a significantly dispropor-24

tionate quantity of public resources, such as 25

emergency, housing, judicial, corrections, and 1

law enforcement services. 2

‘‘(2) DEMONSTRATION GRANTS RESPONDING TO 3

HIGH UTILIZERS.— 4

‘‘(A) IN GENERAL.—The Attorney General 5

may award not more than 6 grants per year 6

under this subsection to applicants for the pur-7

pose of reducing the use of public services by 8

high utilizers. 9

‘‘(B) USE OF GRANTS.—A recipient of a 10

grant awarded under this subsection may use 11

the grant— 12

‘‘(i) to develop or support multidisci-13

plinary teams that coordinate, implement, 14

and administer community-based crisis re-15

sponses and long-term plans for high uti-16

lizers; 17

‘‘(ii) to provide training on how to re-18

spond appropriately to the unique issues 19

involving high utilizers for public service 20

personnel, including criminal justice, men-21

tal health, substance abuse, emergency 22

room, healthcare, law enforcement, correc-23

tions, and housing personnel; 24

‘‘(iii) to develop or support alter-1

natives to hospital and jail admissions for 2

high utilizers that provide treatment, sta-3

bilization, and other appropriate supports 4

in the least restrictive, yet appropriate, en-5

vironment; or 6

‘‘(iv) to develop protocols and systems 7

among law enforcement, mental health, 8

substance abuse, housing, corrections, and 9

emergency medical service operations to 10

provide coordinated assistance to high uti-11

lizers. 12

‘‘(C) REPORT.—Not later than the last 13

day of the first year following the fiscal year in 14

which a grant is awarded under this subsection, 15

the recipient of the grant shall submit to the 16

Attorney General a report that— 17

‘‘(i) measures the performance of the 18

grant recipient in reducing the use of pub-19

lic services by high utilizers; and 20

‘‘(ii) provides a model set of practices, 21

systems, or procedures that other jurisdic-22

tions can adopt to reduce the use of public 23

services by high utilizers.’’. 24

(f) GRANT ACCOUNTABILITY.—Section 2991 of the 1

Omnibus Crime Control and Safe Streets Act of 1968 (42 2

U.S.C. 3797aa) is amended by inserting after subsection 3

(i), as so added by subsection (e), the following: 4

‘‘(l) ACCOUNTABILITY.—All grants awarded by the 5

Attorney General under this section shall be subject to the 6

following accountability provisions: 7

‘‘(1) AUDIT REQUIREMENT.— 8

‘‘(A) DEFINITION.—In this paragraph, the 9

term ‘unresolved audit finding’ means a finding 10

in the final audit report of the Inspector Gen-11

eral of the Department of Justice that the au-12

dited grantee has utilized grant funds for an 13

unauthorized expenditure or otherwise unallow-14

able cost that is not closed or resolved within 15

12 months from the date when the final audit 16

report is issued. 17

‘‘(B) AUDITS.—Beginning in the first fis-18

cal year beginning after the date of enactment 19

of this subsection, and in each fiscal year there-20

after, the Inspector General of the Department 21

of Justice shall conduct audits of recipients of 22

grants under this section to prevent waste, 23

fraud, and abuse of funds by grantees. The In-24

spector General shall determine the appropriate 1

number of grantees to be audited each year. 2

‘‘(C) MANDATORY EXCLUSION.—A recipi-3

ent of grant funds under this section that is 4

found to have an unresolved audit finding shall 5

not be eligible to receive grant funds under this 6

section during the first 2 fiscal years beginning 7

after the end of the 12-month period described 8

in subparagraph (A). 9

‘‘(D) PRIORITY.—In awarding grants 10

under this section, the Attorney General shall 11

give priority to eligible applicants that did not 12

have an unresolved audit finding during the 3 13

fiscal years before submitting an application for 14

a grant under this section. 15

‘‘(E) REIMBURSEMENT.—If an entity is 16

awarded grant funds under this section during 17

the 2-fiscal-year period during which the entity 18

is barred from receiving grants under subpara-19

graph (C), the Attorney General shall— 20

‘‘(i) deposit an amount equal to the 21

amount of the grant funds that were im-22

properly awarded to the grantee into the 23

General Fund of the Treasury; and 24

‘‘(ii) seek to recoup the costs of the 1

repayment to the fund from the grant re-2

cipient that was erroneously awarded grant 3

funds. 4

‘‘(2) NONPROFIT ORGANIZATION REQUIRE-5

MENTS.— 6

‘‘(A) DEFINITION.—For purposes of this 7

paragraph and the grant programs under this 8

part, the term ‘nonprofit organization’ means 9

an organization that is described in section 10

501(c)(3) of the Internal Revenue Code of 1986 11

and is exempt from taxation under section 12

501(a) of such Code. 13

‘‘(B) PROHIBITION.—The Attorney Gen-14

eral may not award a grant under this part to 15

a section organization that holds money in off-16

shore accounts for the purpose of avoiding pay-17

ing the tax described in section 511(a) of the 18

Internal Revenue Code of 1986. 19

‘‘(C) DISCLOSURE.—Each nonprofit orga-20

nization that is awarded a grant under this sec-21

tion and uses the procedures prescribed in regu-22

lations to create a rebuttable presumption of 23

reasonableness for the compensation of its offi-24

cers, directors, trustees and key employees, 25

shall disclose to the Attorney General, in the 1

application for the grant, the process for deter-2

mining such compensation, including the inde-3

pendent persons involved in reviewing and ap-4

proving such compensation, the comparability 5

data used, and contemporaneous substantiation 6

of the deliberation and decision. Upon request, 7

the Attorney General shall make the informa-8

tion disclosed under this subparagraph available 9

for public inspection. 10

‘‘(3) CONFERENCE EXPENDITURES.— 11

‘‘(A) LIMITATION.—No amounts author-12

ized to be appropriated to the Department of 13

Justice under this section may be used by the 14

Attorney General, or by any individual or entity 15

awarded discretionary funds through a coopera-16

tive agreement under this section, to host or 17

support any expenditure for conferences that 18

uses more than $20,000 in funds made avail-19

able by the Department of Justice, unless the 20

Deputy Attorney General or such Assistant At-21

torney Generals, Directors, or principal deputies 22

as the Deputy Attorney General may designate, 23

provides prior written authorization that the 24

funds may be expended to host the conference. 25

‘‘(B) WRITTEN APPROVAL.—Written ap-1

proval under subparagraph (A) shall include a 2

written estimate of all costs associated with the 3

conference, including the cost of all food, bev-4

erages, audio-visual equipment, honoraria for 5

speakers, and entertainment. 6

‘‘(C) REPORT.—The Deputy Attorney Gen-7

eral shall submit an annual report to the Com-8

mittee on the Judiciary of the Senate and the 9

Committee on the Judiciary of the House of 10

Representatives on all conference expenditures 11

approved under this paragraph. 12

‘‘(4) ANNUAL CERTIFICATION.—Beginning in 13

the first fiscal year beginning after the date of en-14

actment of this subsection, the Attorney General 15

shall submit, to the Committee on the Judiciary and 16

the Committee on Appropriations of the Senate and 17

the Committee on the Judiciary and the Committee 18

on Appropriations of the House of Representatives, 19

an annual certification— 20

‘‘(A) indicating whether— 21

‘‘(i) all audits issued by the Office of 22

the Inspector General under paragraph (1) 23

have been completed and reviewed by the 24

appropriate Assistant Attorney General or 1

Director; 2

‘‘(ii) all mandatory exclusions required 3

under paragraph (1)(C) have been issued; 4

and 5

‘‘(iii) all reimbursements required 6

under paragraph (1)(E) have been made; 7

and 8

‘‘(B) that includes a list of any grant re-9

cipients excluded under paragraph (1) from the 10

previous year.’’. 11

‘‘(m) PREVENTING DUPLICATIVE GRANTS.— 12

‘‘(1) IN GENERAL.—Before the Attorney Gen-13

eral awards a grant to an applicant under this sec-14

tion, the Attorney General shall compare potential 15

grant awards with other grants awarded under this 16

Act to determine if duplicate grant awards are 17

awarded for the same purpose. 18

‘‘(2) REPORT.—If the Attorney General awards 19

duplicate grants to the same applicant for the same 20

purpose the Attorney General shall submit to the 21

Committee on the Judiciary of the Senate and the 22

Committee on the Judiciary of the House of Rep-23

resentatives a report that includes— 24

‘‘(A) a list of all duplicate grants awarded, 1

including the total dollar amount of any dupli-2

cate grants awarded; and 3

‘‘(B) the reason the Attorney General 4

awarded the duplicate grants.’’. 5

(g) REAUTHORIZATION OF APPROPRIATIONS.—Sec-6

tion 2991(n) of title I of the Omnibus Crime Control and 7

Safe Streets Act of 1968, as redesignated in subsection 8

(d), is amended— 9

(1) in paragraph (1); 10

(A) in subparagraph (B), by striking 11

‘‘and’’ at the end; 12

(B) in subparagraph (C), by striking the 13

period and inserting ‘‘; and’’; and 14

(C) by adding at the end the following: 15

‘‘(D) $40,000,000 for each of fiscal years 2015 16

through 2019.’’; and 17

(2) by adding at the end the following: 18

‘‘(3) LIMITATION.—Not more than 20 percent 19

of the funds authorized to be appropriated under 20

this section may be used for purposes described in 21

subsection (i) (relating to veterans).’’. 22

SEC. 202. ADDITIONAL PURPOSES FOR FEDERAL GRANTS. 23

(a) MODIFICATIONS TO THE EDWARD BYRNE MEMO-24

RIAL JUSTICE ASSISTANCE GRANT PROGRAM.—Section 25

(b) MODIFICATIONS TO THE COMMUNITY ORIENTED 6

POLICING SERVICES PROGRAM.—Section 1701(b) of title 7

I of the Omnibus Crime Control and Safe Streets Act of 8

1968 (42 U.S.C. 3796dd(b)) is amended— 9

(1) in paragraph (16), by striking ‘‘and’’ at the 10

end; 11

(2) by redesignating paragraph (17) as para-12

graph (19); 13

(3) by inserting after paragraph (16) the fol-14

lowing: 15

‘‘(17) to provide specialized training to law en-16

forcement officers (including village public safety of-17

ficers (as defined in section 247 of the Indian Arts 18

and Crafts Amendments Act of 2010 (42 U.S.C. 19

3796dd note))) to recognize individuals who have 20

mental illness and how to properly intervene with in-21

dividuals with mental illness and to establish pro-22

grams that enhance the ability of law enforcement 23

agencies to address the mental health, behavioral, 24

under the care and custody of jails and prisons; 7

and’’; and 8

(4) in paragraph (19), as redesignated, by 9

striking ‘‘through (16)’’ and inserting ‘‘through 10

(18)’’. 11

SEC. 203. CONDITIONS FOR TREATMENT OF CERTAIN PER-12

SONS AS ADJUDICATED MENTALLY INCOM-13

PETENT FOR CERTAIN PURPOSES. 14

(a) IN GENERAL.—Chapter 55 of title 38, United 15

States Code, is amended by adding at the end the fol-16

lowing: 17

‘‘§ 5511. Conditions for treatment of certain persons 18

as adjudicated mentally incompetent for 19

certain purposes 20

‘‘In any case arising out of the administration by the 21

Secretary of laws and benefits under this title, a person 22

who is mentally incapacitated, deemed mentally incom-23

petent, or experiencing an extended loss of consciousness 24

shall not be considered adjudicated as a mental defective 25

under subsection (d)(4) or (g)(4) of section 922 of title 1

18 without the order or finding of a judge, magistrate, 2

(b) TECHNICAL AND CONFORMING AMENDMENT.— 5

The table of sections at the beginning of chapter 55 of 6

title 38, United States Code, is amended by adding at the 7

end the following: 8

‘‘5511. Conditions for treatment of certain persons as adjudicated mentally in-

competent for certain purposes.’’.

TITLE III—SCHOOL SAFETY 9

SEC. 301. SHORT TITLE. 10

This title may be cited as the ‘‘School Safety En-11

hancements Act of 2013’’. 12

SEC. 302. GRANT PROGRAM FOR SCHOOL SECURITY. 13

Section 2701 of title I of the Omnibus Crime Control 14

and Safe Streets Act of 1968 (42 U.S.C. 3797a) is amend-15

ed— 16

(1) in subsection (b)— 17

(A) in paragraph (1)— 18

(i) by striking ‘‘Placement’’ and in-19

serting ‘‘Installation’’; and 20

(ii) by inserting ‘‘surveillance equip-21

ment,’’ after ‘‘detectors,’’; 22

(B) by redesignating paragraph (5) as 23

paragraph (6); and 24

retary of Education, or the designee of the Sec-11

retary, shall establish an interagency task force to 12

develop and promulgate a set of advisory school 13

safety guidelines. 14

‘‘(2) PUBLICATION OF GUIDELINES.—Not later 15

than 1 year after the date of enactment of the 16

School Safety Enhancements Act of 2013, the advi-17

sory school safety guidelines promulgated by the 18

interagency task force shall be published in the Fed-19

eral Register. 20

‘‘(3) REQUIRED CONSULTATION.—In developing 21

the final advisory school safety guidelines under this 22

subsection, the interagency task force shall consult 23

with stakeholders and interested parties, including 24

parents, teachers, and agencies.’’. 25

SEC. 303. APPLICATIONS. 1

Section 2702(a)(2) of title I of the Omnibus Crime 2

Control and Safe Streets Act of 1968 (42 U.S.C. 3

3797b(a)(2)) is amended to read as follows: 4

‘‘(2) be accompanied by a report— 5

‘‘(A) signed by the heads of each law en-6

forcement agency and school district with juris-7

diction over the schools where the safety im-8

provements will be implemented; and 9

‘‘(B) demonstrating that each proposed use 10

of the grant funds will be— 11

‘‘(i) an effective means for improving 12

the safety of 1 or more schools; 13

‘‘(ii) consistent with a comprehensive 14

approach to preventing school violence; and 15

‘‘(iii) individualized to the needs of 16

each school at which those improvements 17

are to be made.’’. 18

SEC. 304. AUTHORIZATION OF APPROPRIATIONS. 19

Section 2705 of title I of the Omnibus Crime Control 20

and Safe Streets Act of 1968 (42 U.S.C. 3797e) is amend-21

ed by striking ‘‘2001 through 2009’’ and inserting ‘‘2014 22

through 2023’’. 23

SEC. 305. ACCOUNTABILITY. 24

Section 2701 of title I of the Omnibus Crime Control 25

an annual certification— 18

‘‘(A) indicating whether— 19

‘‘(i) all audits issued by the Office of 20

the Inspector General under paragraph (1) 21

have been completed and reviewed by the 22

appropriate Assistant Attorney General or 23

Director; 24

‘‘(ii) all mandatory exclusions required 1

under paragraph (1)(C) have been issued; 2

and 3

‘‘(iii) all reimbursements required 4

under paragraph (1)(E) have been made; 5

and 6

‘‘(B) that includes a list of any grant re-7

cipients excluded under paragraph (1) from the 8

previous year.’’. 9

SEC. 306. PREVENTING DUPLICATIVE GRANTS. 10

Section 1701 of title I of the Omnibus Crime Control 11

and Safe Streets Act of 1968 (42 U.S.C. 3796dd) is 12

amended by adding at the end the following: 13

‘‘(l) PREVENTING DUPLICATIVE GRANTS.— 14

‘‘(1) IN GENERAL.—Before the Attorney Gen-15

eral awards a grant to an applicant under this part, 16

the Attorney General shall compare potential grant 17

awards with grants awarded under parts A or T to 18

determine if duplicate grant awards are awarded for 19

the same purpose. 20

‘‘(2) REPORT.—If the Attorney General awards 21

duplicate grants to the same applicant for the same 22

purpose the Attorney General shall submit to the 23

Committee on the Judiciary of the Senate and the 24

resentatives a report that includes— 2

‘‘(A) a list of all duplicate grants awarded, 3

including the total dollar amount of any dupli-4

cate grants awarded; and 5

‘‘(B) the reason the Attorney General 6

awarded the duplicate grants.’’. 7
