Nothing contained herein shall be construed to limit the right of a Member to remodel the interior of the home, or to paint the interior of the home any color desired; provided, modifications or alterations to the interior of screened porches, patios and similar portions of a home visible from outside the home shall be subject to approval hereunder. In the event that the MC fails to approve or to disapprove such plans or to request additional information reasonably required within forty-five (45) days after submission, the plans shall be deemed approved.” Furthermore, in accordance with: Article IV: Building and Use Restrictions, Section 2: Change in Appearance “Unless prior written approval of the Modifications Committee described in Article XV, Section 2 …has been obtained, there shall be no change in appearance of any exterior wall, door, patio, terrace, screening, or any exterior surface, … which will adversely affect the uniform exterior appearance of the building in the opinion of the Association shall be prohibited;…”.

The Grand Oaks Community Association is a non-profit corporation, managed by a board of Directors elected by the Homeowners. The Community Standards (CS) are the standards for exterior modifications, improvements and maintenance and may be periodically updated and amended by the Board of Directors. The Community Standards shall be enforceable as a rule or regulation and be part of a Homeowner’s Manual addressing the current issues within the community. A comprehensive set of Rules and Regulations may be adopted and amended by the Board of Directors from time to time and be included in the Homeowner’s Manual.

The goal of the Community Standards is to maintain the ambiance of the Grand Oaks Community, maintain property

values in the Community, control the operational costs of the Association, minimize environmental impact and comply

with Federal, State and Local requirements.

The Declaration of Covenants, Conditions, Easements and Restrictions for Grand Oaks provides for and is the authority for these Community Standards. Specific references in the Covenants:

Conflicts: If there are conflicts between the provisions of Florida law, the Articles of Incorporation, the Declaration, the Bylaws or this Standards document, then the provisions of Florida law, the Declaration, the Articles of Incorporation, the Bylaws and this Standards document (in that order) shall prevail.

MODIFICATIONS COMMITTEE: (MC) In accordance with the Declaration of Covenants, Conditions, Easements and Restrictions for Grand Oaks, Article XV: Architectural Standards, Section 2: Modifications to Improved Homesites: “The MC, if established, shall have exclusive

modifications, additions, or alterations, shall be submitted to the MC for approval as to quality of workmanship and design

and finish grade elevation. Nothing contained herein shall be construed to limit the right of a Member to remodel the

interior of the home, or to paint the interior of the home any color desired; provided, modifications or alterations to the

interior of screened porches, patios and similar portions of a home visible from outside the home shall be subject to approval

hereunder. In the event that the MC fails to approve or to disapprove such plans or to request additional information

reasonably required within forty-five (45) days after submission, the plans shall be deemed approved.”

Furthermore, in accordance with: Article IV: Building and Use Restrictions, Section 2: Change in Appearance “Unless

prior written approval of the Modifications Committee described in Article XV, Section 2 …has been obtained, there shall

be no change in appearance of any exterior wall, door, patio, terrace, screening, or any exterior surface, … which will

adversely affect the uniform exterior appearance of the building in the opinion of the Association shall be prohibited;…”.

APPLICATION PROCEDURES:

Complete details may be found in Exhibit A: “Application Guidelines and Instructions for Modifications” located on pages 15 and 16.

Most modifications or improvements to the exterior of an Owner’s property require prior written approval of the Modifications Committee (MC). Application form (Exhibit G) “APPLICATION FOR ARCHITECTURAL and/or

LANDSCAPE CHANGE” is used for most requests. Application form (Exhibit H) “APPLICATION FOR

DECORATIVE LANDSCAPE OBJECTS and FLAGPOLES” is used only for adding Decorative Landscape Objects (see Section 17) or Flagpoles (see Section 9). Additional forms may be obtained from the MC.

The MC reviews the planned project and either approves, requests additional information or denies the request within thirty (30) days. In the event additional information is required, the committee shall have an additional 15 days after receipt of the information to either approve or deny the request. If the MC denies a request or refuses final approval, the Homeowner may appeal to the Grand Oaks Board of Directors. If the work is approved, the Owner, or the contractor on the Owner’s behalf, obtains all necessary permits. The Owner has 90 days after approval to complete the modification. If not completed, Owner must submit request for an extension. When the project is completed and passed all state and/or county inspections, the Owner shall notify the MC within 14 days for a final inspection. The purpose of this final inspection is to confirm that there is no deviation from the prior approved request as described in the Application. Deviation will warrant denial of the approval of the completed project and require modification at the Owner’s expense. No changes will be permitted by the Homeowner which will change the character of the home, restrict lawn maintenance or redirect water drainage, (excluding gutters and downspouts). Homeowners are encouraged to submit request forms directly to the Modifications Committee by either U.S. mail, email (provided that diagrams and colors may be transmitted electronically), or hand delivery. Committee members are prepared to answer Homeowners’ questions regarding these guidelines, review forms, approval processes, or time constraints. Modifications Committee members may visit your property before approving, during and/or after to inspect your project.

COMPLIANCE TIME TABLE SUMMARY: (Updated at a Special Meeting of the Board of Directors on March 23, 2017)

1. Within approximately 14 days after adoption, initial surveys for compliance will begin; periodic surveys will be

conducted thereafter. 2. Non-compliant homes will be given 15 days to comply.

Homeowners may appeal the committee determination to the Board. 3. After 15 days, Modifications Committee will re-inspect the home for compliance.

If continued non-compliant, the Modifications Committee recommends further action to the Board. 4. The Board will instruct the Property Manager to send the First Notice of Violation letter. 5. “First Notice of Violation” letter is sent by Property Manager allowing 30 days to comply. 6. After 30 days, “Second/Final Notice of Violation” letter is sent by the Property Manager allowing 15 days to comply. 7. After 15 days from the date of the second letter with no response from the Homeowner, the Board may impose a fine

for a compliance violation. 8. The Owner will be notified that a hearing in front of a Fine Committee to determine whether to confirm or reject the

fine levied by the board will be held within 14 days. By a majority vote of the “Fine Committee”, the fine is confirmed and levied by the Board.

1. Antennas and Satellite Dishes Applications for satellite dishes will be consistent with Federal Law Telecommunications Act of 1996, § 207, PL 104-104, 110 Stat 56, February 8, 1996 and 47 CFR § 1.4000. No antenna shall be placed or erected upon any Homesite except small satellite dishes. An (Exhibit G) Application for Architectural OR Landscape Change must be submitted and approved prior to installation. All installations must be in an unobtrusive location on the sides or rear of the home, at least 6 feet back from the front of the home. Any exposed wires must be painted the color of the home or surface they are on.

2. Awnings, Canopies, Sunscreens & Blinds Awnings, canopies, sunscreens and blinds mounted on the exterior of the home are not permitted, except those installed within the lanai. An (Exhibit G) Application for Architectural OR Landscape Change must be submitted and approved prior to installation within Lanai. Colors should be neutral and complementary to the home color.

3. Doors, Windows, Garage Doors and Keypads

a) Doors: Replacement doors must be of similar size and shape. The design of the door and proposed colors require MC application (Exhibit G) Application for Architectural OR Landscape Change to be submitted and approved. The front door must be painted according to the color guidelines originally provided during construction. All other utility or garage doors must be painted the same color as the home’s stucco color. (See Section 24 “Paint and Color Guidelines” for the list of approved colors). Electronic keypads or deadbolt locks may be installed without prior approval. The new keypad or deadbolt must match the existing door hardware. Ornamental windows/etchings must be approved by proper request submitted to the MC (Exhibit G).

b) Garage: Garage keypads in a neutral color may be installed without prior approval. All garages must have doors that are to be maintained in a useful, working condition. Garage doors must be kept closed at all times, except when a Homeowner is entering or exiting the garage, or working within the garage. No garage shall be converted to other usage.

c) Windows: Replacement of windows in the front of the house must be impact resistant windows and shall be of like size, shape and style to the original windows. All other windows shall also be of like size, shape and style of the original windows but do not need be impact resistant if hurricane protection is provided. A MC application (Exhibit G) Application for Architectural OR Landscape Change must be submitted and approved to replace windows, including changing non-impact windows to impact resistant.

• Glazing must be clear or neutral tinted. Windows must slide up and down to open.

• Window frame colors must be compatible with the house color, may be white or bronze, and must be anodized or powder coated.

• Window frames with an aluminum or silver finish are not permitted.

• Owner must maintain screens in windows and if replacing must be the same as original.

4. Drainage and Easements

Owners must not make any changes that would cause a blockage of any drainage flow as originally designed and constructed by the Developer. (See Exhibit E: Grand Oaks Subdivision Plat) No Perpetual easements as described in Declaration of Covenants, Article VII, drainage easement, swale, canal, lake, or pond may be obstructed, filled in or altered without prior written approval by the MC.

5. Driveways, Walkways and Entryways Driveways, walkways and entryways must be constructed of pavers. Replacing or resurfacing a driveway, walkway or entryway requires a MC application (Exhibit G) Application for Architectural OR Landscape Change to be submitted and approved. Clear sealing of pavers does not require approval. Replacements must match the existing footprint of the original structure. The replacement material color must be compatible with the overall color scheme of the house and of the community as a whole. The finished surface must be flush with adjacent sidewalk sections. An out-of-level installation is a tripping hazard, and the Owner is responsible to raise or lower the walkway or driveway to prevent a trip hazard.

Color staining or use of paint on driveways is prohibited. Owners must provide regular maintenance and cleaning for walkways, driveways and building exteriors, so that they are kept free from visible stains, mildew, mold, and debris and plant growth.

6. Exterior Lighting and Security Motion Sensors Exterior lighting changes of any kind for the house, sidewalk, driveway, garage, entryway, landscaping or security require approval. A lighting plan must be submitted with (Exhibit G) Application for Architectural OR Landscape Change. All lighting must not be visually obtrusive or directed outside the boundaries of the property.

• Adding or replacing wired electric light fixtures and/or motion sensors requires approval.

• All landscape lighting must be solar powered and must be installed so as to not interfere with landscape operations: a) Mulch bed lights: Maximum of (9), spaced at intervals of not less than six (6) feet, are permitted provided they

are installed in mulch beds in front of and at the sides of homes. Additional rear solar lights are permitted, provided they are spaced at intervals of not less than six (6) feet. Solar lights are permitted only in mulch beds adjacent to the home and not in the lamppost mulch bed or any mulch bed not adjacent to the home.

b) Pathway lights: Lights along pathways or adjacent to doorways may not be installed in any grass areas. c) Landscape spot lights: Maximum of (2) directed upward toward trees permitted in the front and (2) in the rear. d) House Security lights: Maximum of (1) directed toward the home permitted in the front and (2) in the rear. e) Permanently installed wired landscape lighting is not permitted.

Each home has a “Lamppost” style light that is the property of the Community Association, including the wiring of same to the dwelling, and the Association shall maintain the Lamppost and its wiring. Owner is responsible for cost of repairing damage to lamppost caused by Owner, guests or contractors hired by the Owner. The lightbulb in the lamppost and the GFI outlet are the property of the Homeowner and must be maintained by the Owner. Only white LED, 5000 Kelvin 60 watt equivalent bulbs with no color filters or lenses may be used in the Lamppost light fixture.

7. Fences and Walls Fences and walls are not permitted in accordance with Grand Oaks Covenants, Article IV; Section 2.

8. Fire Pit and Chiminea Outdoor fire pits and chiminea are not permitted on individual Homesites.

9. Flags and Flagpoles Homeowners may install one angled flagstaff holder to an exterior wall of their house without application to the MC, provided it is painted the same color as the wall. In accordance with Florida Statute 720-304 (2)(b), Owners may display the United States flag, the official flag of the State of Florida, MIA Flag or the official flag of any of the Armed Forces of the United States at any time in a respectful manner. Flags can be up to 4 ½ feet by 6 feet.

In addition to the “Official Flags”, Owners may fly from the flag staff holder tasteful flags and banners with national or religious holiday themes for one-week before and one week after the holiday. In addition, for one day only, Owners may fly from the flagstaff holder tasteful flags displaying school or sports affiliations in recognition of a sporting event, reunion or similar event.

Owners may permanently install one flagpole on their Homesite in accordance with Florida Statute 720-304. An application (Exhibit H) “APPLICATION FOR DECORATIVE LANDSCAPE OBJECTS and FLAGPOLES” and a site plan or drawing showing proposed location and all relevant easements must be submitted and approved. Flagpoles may not be located in any easement including the front yard utility easement. All costs for erecting, maintaining and any damage to any/all underground utilities will be at the residents’ expense. The flagpole shall be used only to display the United States flag, the official flag of the State of Florida, MIA Flag or the official flag of one of the Armed Forces, each being no larger than 4 ½ feet by 6 feet in accordance with display guidelines for the flag being flown. No additional ornamentation, bunting or objects may be attached to the staff or pole or any flag unless authorized, as appropriate, by the US President, the Florida Governor, and any Secretary of US Armed Forces or by law. When the flagpole is lighted at night, the light must be directed on the flag and not be a nuisance or an annoyance to the neighbors.

10. Generators Owners may install an exterior permanent emergency generator. A MC application (Exhibit G) Application for Architectural OR Landscape Change must be submitted and approved. The unit must be self-contained within a manufactured sound-deadening enclosure, be installed on the sides or rear of the home, and be screened from view by landscaping from the front and rear of the home. Portable electrical generators moved outside to be used only during or after storm conditions and moved back inside when power is restored do not require MC approval. Emergency generators may only be run during power outages and up to 15 minutes per week for unit testing.

11. Gutters, Downspouts & Splash blocks

Owners are encouraged to install gutters and downspouts on their home. All installations of gutters and downspouts must be performed by a Florida licensed and insured contractor. The gutter color and material must be bronze aluminum to match the soffit/trim. Downspouts can terminate on a splash block or into flexible hose to redirect water flow. Water flow must be directed to the swale between neighboring homes, or to another place on Owner’s property such that it does not flow onto a neighbor’s Homesite or cause erosion. The downspout may be of either white or bronze aluminum color. Splash blocks and flexible hoses must be within the mulch bed so as not to interfere with lawn mowing.

12. House Numbers and Plaques To facilitate ease of address identification by emergency response personnel, house numbers are 3 inch brass mounted on a 6 inch bronze plaque located on the front wall between the garage and walkway as originally installed by the builder. They must remain the original style and design and remain in the original location on the house. These numbers are to be maintained by the Owner. An additional set of numbers is mounted under the Owner’s mailbox and is maintained by the Association. No house numbers may be painted on curbs or any other location.

13. Hurricane Protection

With the exception of painting the builder supplied panels, Owners must file an application (Exhibit G) Application for Architectural OR Landscape Change to the MC for review and approval of plans to change hurricane shutters from what was initially installed by the Developer. All hurricane shutters must meet the applicable specifications as cited in the Miami-Dade County Building Code. They must be installed by a licensed contractor to meet these standards, inspected by the appropriate county authorities, and received a Notice of Approval (NOA). All permanent exterior mounting pins, channels, brackets, etc. must be painted to match the house or trim color. Graffiti is not permitted on any shutter.

All homes in Grand Oaks were originally constructed with “Impact Resistant” front windows, doors and garage doors. No additional Hurricane shutters may be installed on any front windows, doors or garage doors at any time. Depending on the shutter material, Owners may choose either: (A) Active storm protection or (B) Long term storm protection.

a) ACTIVE STORM PROTECTION: The following types of shutters may be put on side or rear windows, doors and lanai openings of the dwelling ONLY when there has been an announcement by the state government that a state of emergency exists including the Venice area; the Venice area has been included in the National Weather Service (NWS) five day “cone of uncertainty” for a tropical storm; or a hurricane watch or warning has been issued by the NWS for the Venice area. These devices must be removed no later than one week after either the NWS hurricane watch or warning is withdrawn or when Venice is no longer with the NWS “cone of uncertainty” for any future storm.

• Galvanized steel panels

• Bare aluminum panels

• Mesh fabric storm covers installed on openings outside lanai screen enclosures.

• Clear polycarbonate (i.e. Lexan) panels

b) LONG TERM STORM PROTECTION: The following types of shutters may be installed and used AT ANY TIME during hurricane season (June 1 – Nov. 30) on side or rear windows, doors and lanai openings of the dwelling. Approval must be obtained from the Board for any additional time periods.

• Roll down shutters that are white, beige, or complement the house in color

• Accordion shutters that are white, beige, or complement the house in color

• Aluminum panels that are white, beige, or complement the house in color

• Mesh fabric storm covers installed on openings inside lanai screen enclosures

14. HVAC System Replacement

Exterior HVAC equipment may be replaced or upgraded and does not require MC approval, provided that the new equipment is designed and rated for residential use and is installed on the existing concrete pad.

15. Lanai No structural changes to the lanai shall be permitted. Lanai cage must be constructed of bronze aluminum structural materials covered with black open mesh screening. No reflective or opaque materials may be used to substitute for screening or be attached to the cage. Replacement of the lanai cage requires a MC application (Exhibit G) Application for Architectural OR Landscape Change to be submitted and approved. Rescreening with approved material does not require approval. The portion of the home and any privacy wall inside the lanai cage must be painted the same color as the other exterior stucco walls. Painting of the lanai requires a MC application (Exhibit G) and approval. Lanai floors must be constructed of pavers or travertine. Replacing or resurfacing the lanai floor requires a MC application (Exhibit G) to be submitted and approved. Replacements must match the existing footprint of the original structure. The replacement material color must be compatible with the overall color scheme of the house and of the community as a whole. Clear sealing of the lanai floor does not require approval. 16. Landscape: Beds, Plantings, Common Areas & Irrigation System

Please refer to Exhibit B “Landscape Responsibility and Maintenance Policy” on page 17 for additional information. Any plants added by the Owner which are damaged by the Association or any of its contractors during fertilizing, weeding, trimming or pruning or any other landscape maintenance shall not be the responsibility of the Association or its contractor. a) Mulch Beds: All homes are landscaped with MC approved plans prior to occupancy. (See Exhibit F: Original Landscape

Plans for Valencia, Valencia Sunroom and Sabal Homes) No modifications to the shape and size are permitted to the mulch beds without prior approval from the Modifications Committee. Mulch beds may contain decorative landscape rocks and shells, garden objects or trellises within the mulch beds adjacent to the home as approved by the MC. (See Section: 17 “Landscape: Decorative Objects”). Rocks and shells may not be used as edging.

b) Plantings: Replacement of all plants and shrubs within the mulch beds as originally planted by the Developer shall be the responsibility of the Association. Owners may add additional plants at the Owner’s expense within the existing mulch beds after submitting a MC “APPLICATION FOR ARCHITECTURAL OR LANDSCAPE CHANGE” (Exhibit G) and receiving approval. Owners must provide a list including the location of any plants planted which were not part of the original builder provided plants. The Association is not responsible for those plants should they die or if they are injured in any way by Association landscapers. All new plantings must be “Florida Friendly” landscaping as described in the “Florida Friendly Landscape Database” (visit: http://floridayards.org/fyplants) and shall not create any requirement or limitation in conflict with any provision of a water shortage order. All flowers are the responsibility of the Owner to maintain and remove at the end of their growing season. No plantings may be added outside of existing mulch beds. Homeowners may not alter the existing irrigation system and the cost to repair damage to any underground systems caused by the Homeowner or their contractors is the responsibility of the Homeowner. Any plantings determined to be not “Florida Friendly” must be removed by the Owner or are subject to removal without compensation.

• Front yard must have an open landscape plan permitting visibility of the front of the house.

• The selection, density and location of plantings shall be suitable to achieve an aesthetically pleasing appearance consistent with the community as a whole. Selection of plantings shall be made to reflect the planting, light and soil conditions of the individual Homesite.

• No vines may be allowed to grow onto the walls or roof of the home or spread into any mulch bed.

• No trees may be planted or removed by Homeowners.

• Fruit and vegetable plants within the mulch beds are not permitted.

• No artificial grass, plants or other artificial vegetation shall be placed or maintained upon the exterior portion of any Homesite with the exception of holiday decorations (See Section 30 “Seasonal Decorations”) and door wreaths.

c) Common Areas: Owners may not alter plantings within any common areas, including, but not limited to, the landscape buffers along the privacy wall & fence, areas surrounding all lakes & ponds and the pool & clubhouse area. Homeowners may not add any plantings, garden objects, decorative rocks, edging, trellises or arbors to any common area.

d) Irrigation System: The Association shall maintain all landscaping of Homesites and irrigation systems. An underground sprinkler and drip system with automated controls with sufficient size and capacity to irrigate all turf and landscaped areas was installed at the time of construction. No alterations may be made to the irrigation system by Homeowners. Donuts around sprinkler heads may be installed without prior approval. However, notice should be given to the landscape committee for assistance with location of heads and proper installation. Donuts may only be gray or green color and made of concrete or plastic material. Any damage to underground systems caused by the Homeowner during installation or maintenance of donuts is the responsibility of the Homeowner. The cost to make any changes or to repair damage to the irrigation system which may be necessary in conjunction with approved alterations of landscape mulch beds is the responsibility of the Homeowner requesting the mulch bed alteration.

17. Landscape: Decorative Objects

Approval is needed for all Decorative Landscape objects including Rocks and Shells, Garden Objects, Exterior Artwork and Trellises on an individual case basis and approval is not guaranteed. All landscape objects must be placed within the planting beds immediately adjacent to the home and/or entryway; not on the lawn, driveway, and utility access or common areas. All moveable Landscape Objects must be placed in the garage or home during storms and when you are on vacation or gone for the summer so as not to become loose and cause damage to surrounding properties during storms. An application (Exhibit H) APPLICATION FOR DECORATIVE LANDSCAPE OBJECTS and FLAGPOLES must be submitted and approved prior to installation of any landscape object showing the size and location of the object requested. Limitations on landscape objects visible from the street help maintain the ambiance and harmony of Grand Oaks for all owners. A

maximum of six (6) seven (7) objects in any combination below are permitted:

a) Rocks and Shells: ° (3) Rock, rock structures or shells permitted visible from the street.

• Each Rock or Shell must not exceed one (1) cubic foot in total size.

• Color of landscape rocks must be earth tones; black or white may not be used.

• May not be used as edging.

b) Garden Objects: Maximum number allowed visible from the street: ° (1) Bench or Table/Chair ° (1) (2) Vase or Urn ° (3) (6) Potted Plants with or without plant stand ° (2) Lawn Birds ° (3) Animal Figurines (other) ° (1) Statuary, sculpture or pagoda ° (1) Shepard’s Hook with Hanging Plant

• Any damage to the object or dwelling caused by landscape operations is the responsibility to the homeowner.

• Statuary, figurines, pottery and etc. should be of natural material, including but not limited to: stone, concrete, terra cotta and clay. Plastic and rubberized material not permitted.

• The color of the material must blend with the existing color scheme of the residence or earth tones such as gray, brown, green & black.

• Fountains, bird baths or any type of container with standing water are not permitted.

• No objects, structures or hanging articles shall be placed on light posts except for seasonal decorations.

• Artificial Flowers are not permitted except as seasonal decorations (see Section 30 “Seasonal Decorations”).

c) Exterior Artwork or Wall Plaques:

° (1) Any Exterior artwork or wall plaques visible from the street Artwork located within lanai does not need approval.

d) Trellises

° (1) Trellis within the front mulch bed and one (1) trellis within the rear mulch bed, not in any easement (see section 4) or common area (see section 16c). The privacy wall and adjacent landscape buffer located at the rear of some homes is common area and not a part of the owners property.

• Trellises are limited to a maximum of 3’ high in the front and 5’ high in the rear mulch bed.

• The cost to repair any damage caused by the installation or maintenance of a trellis to any underground utility or buried irrigation system is the sole responsibility of the Owner.

• Approved materials are dark stained wood, fabricated or cast metal, and vinyl in dark bronze or brown or in the house or trim color.

• Only natural plants and vines planted in the ground and kept well-trimmed may be planted around or attached to the trellis. No vines may be allowed to grow onto the walls or roof of the home or spread into any mulch bed. No hanging baskets, pots or other decorative objects are permitted on the trellis.

• Maintenance of the trellis and plants growing on the trellis are the responsibility of the Owner.

• Arbors are not permitted on any Homesites.

18. Landscape: Edging, Curbing and Barriers

Landscape edging, curbing and barriers are prohibited within Grand Oaks with the exception of the following types: a) Aluminum, anchored with stakes, buried 4 inches, backfilled, rising no more than 2 inches above ground level. b) Valley View Industries Royal Diamond Plastic Lawn Edging, anchored with metal stakes, buried 4 inches,

backfilled and rising no more than 2 inches above ground level. (Available at Home Depot) Owners must submit a MC “APPLICATION FOR ARCHITECTURAL OR LANDSCAPE CHANGE” (Exhibit G) and receive approval prior to edging installation. The Grand Oaks Community Association may require that unapproved installations be removed at the Owner’s expense.

19. Landscape: Mulch and Stone The Association will periodically apply mulch to a depth of at least 2 inches to all planting beds, tree rings and street trees. All common area and individual Homesite mulch bed maintenance will include weeding by weed kill agents or hand pulling

when necessary and treatment of fire ant infestations. The Association will be responsible for edging of all walks, curbs, driveways and mulch beds to keep borders well defined. If an Owner wishes to add additional mulch, it must be of the same type, style and color as provided by the Association

If desired, Owners may remove mulch and replace it with stone only in the area between the garage and walkway, subject to the following requirements. Owners must submit a MC “APPLICATION FOR ARCHITECTURAL OR LANDSCAPE CHANGE” (Exhibit G) and receive approval prior to stone installation.

• Stone mulch is only allowed in the area between the walkway and garage that does not boarder any turf.

• Stone mulch must be in earth tones, 2 inches or less in diameter.

• Stones should be installed over a weed barrier to help with weed control and prevent intrusion of dirt.

• Stone in lieu of mulch will be the responsibility of the Homeowner to maintain.

20. Mailboxes Mailboxes are the property of the Association and shall be maintained by the Grand Oaks Community Association. Each mailbox has a post shared by two homes and interference with the mailbox serving the adjoining home is prohibited. No mailbox, paper box or other receptacle of any kind for use in the delivery of mail, newspapers, magazines or similar material shall be erected on any Homesite except those initially installed by the Developer and subsequent modifications made by the Association or authorized by the MC. Owner is responsible for cost of repairing damage to mailboxes caused by Owner, guests or contractors hired by the Owner.

21. Outdoor Kitchens (Not in Lanai) Outdoor kitchens located within the lanai do not require MC approval. Outdoor kitchens located outside of the lanai are not permitted.

22. Outdoor Patios

Patios and similar structures outside the lanai that were not installed by the original builder are not permitted. After MC application (Exhibit G) Application for Architectural OR Landscape Change and approval, secondary sidewalks, small paver entrance landings, stepping stones, and outdoor grill storage pads are permitted. With approval, Owners may construct a grill storage pad using pavers or concrete stepping stones near the rear of the home or along the outside of the lanai. Only one grill storage pad is permitted per home.

23. Outdoor Storage

No outside structures such as sheds, tree houses, boxes or containers are permitted except for storage containers located in the lanai area. All extra roof tiles and extra pavers should be stored in the Owners garage, and not in any mulch bed or in the mulch bed immediately aft of the air conditioner unit or on the air conditioner pad. After MC application (Exhibit G) and approval, a hose hanger may be installed on the side of the home adjacent to the hose bib.

• Compost bins are not permitted.

• Rain barrels and cisterns are not permitted. (See section 34 “Temporary Storage Containers” for guidelines on dumpsters or PODs)

24. Paint and Color Guidelines Owners must maintain the house and trim colors in a generally reasonable manner and repaint the home when paint deterioration is evident. Minor touch-up painting is permitted without approval if the original color is used. Painting of the house exterior walls, its trim, window frames, doors and any other surface requires a MC application (Exhibit G) APPLICATION FOR ARCHITECTURAL OR LANDSCAPE CHANGE to be submitted and approved. Owners must provide color names, numbers and manufacturer in their application.

Color Guidelines:

• All homes must remain painted within the original guidelines established by the Developer as shown on the following Exterior Paint Color Selections. The Board of Directors maintains a book of color samples:

• All paints to be used are SHERWIN WILLIAMS premium 100% acrylic exterior paints or equivalent.

• All paint used for exterior walls, trim and doors shall have a satin finish.

• Garage doors and all side doors on sides of a home must be painted the same solid color as the body of the house.

• Murals, motifs, vines and any other painted decorative elements are not permitted on outside walls and trim.

• Exterior home walls inside lanai area must be painted the same solid color as the rest of the body of the house.

• The MC may require the Owner to paint a sample area on the house or elsewhere in order to view the proposed color on a realistic basis if a different color than originally used is chosen.

• The MC shall require the Owner to repaint any surface for which prior approval has not been obtained and the color standards have not been met.

25. Play Equipment Permanently installed play structures are not permitted. With the exception of bicycles and water sports equipment used in the community pool, all portable play equipment and toys such as basketball hoops, soccer nets and jungle gyms may only be used within the Homeowners property and not in any street or common area. In consideration of neighbors, usage is restricted to daylight hours. All play equipment must be stored in the garage when not in use. 26. Pools and Spas No new Pools, whirlpools, or spas will be permitted. No changes to the size or orientation of existing pools are permitted.

Major maintenance activities, including but not limited to: repainting, resurfacing or other treatment of the pool; replacement or resurfacing of the pool deck including a change of materials; re-tiling or replacing pool coping; partial or complete replacement of cage screening fabric; replacement or additions of pool equipment located inside the pool cage, requires a MC Application for Architectural or Landscape Change (Exhibit G) be submitted and approved. Routine maintenance including cleaning, changing filters, pump repairs, etc. do not require approval.

27. Roofs

Barrel or flat slate style concrete roof tiles, depending on the home elevation (see Exhibit C), must be used and must coordinate with the exterior house walls.

• Owners must provide regular maintenance and cleaning for cement tile roofs, roof gutters, and building exteriors, using environmentally safe products, so that they are kept free from visible stains, mildew, mold and debris and plant growth.

• All HVAC, plumbing and other roof vents must be painted a color that matches the roof tile color or the predominant color of the roof tile.

• No ornaments may be placed on the roof except as may be provided in this Community Standards for certain holiday decorations.

• Replacing or sealing a roof requires MC approval. MC application (Exhibit G) APPLICATION FOR ARCHITECTURAL OR LANDSCAPE CHANGE must be submitted and approved before any work is performed.

• The only approved roof leak sealing process is “Perma-Seal” or equivalent which preserves the barrel tile characteristics.

• Heavy, thick coatings seen in older neighborhoods that obscure roof tile texture are NOT permitted.

28. Screen Doors Owners may install a retractable front screen door within the existing door frame after MC APPLICATION FOR ARCHITECTURAL OR LANDSCAPE CHANGE (Exhibit G) is submitted and approved. The color must coordinate with the existing color scheme of the home exterior. No work may be performed until approval is granted. No fixed screen or glass storm doors are permitted. Screen doors on front garage door openings are NOT permitted.

29. Shutters, Decorative (Other than Hurricane Protection) Decorative non-operative shutters are not permitted.

30. Seasonal Decorations Exterior decorations, including removable special lighting or modification to installed lighting, used to celebrate a seasonal or specific event may be exhibited not more than one week prior to, and must be removed completely not more than one week following, the holiday or event except that winter holiday decorations may be exhibited between November 15 and January 15. The bulb in the lamppost may not be changed for seasonal decorations and the glass lens must remain clear. Artificial plants and flowers may only be displayed as a part of seasonal decorations. Residents must place all decorations as to not interfere with lawn maintenance. See section 9 “Flags and Flagpoles” for guidelines pertaining to religious and national holiday flags, school and sports affiliation flags.

31. Signs All signs are prohibited including outside the home, in a window, on a vehicle or in the lanai, except for the following:

• In accordance with Florida Statue 720-304 (6) “Any parcel Owner may display a sign of reasonable size provided

by a contractor for security services within 10 feet of any entrance to the home” (Maximum of 1 yard sign two (2)

yard signs (one at front entrance and one at side OR back entrance placed within the mulch bed adjacent to the home) and 1 Sarasota County Sheriff window sticker)

• “Open House” and corresponding directional signs are permitted on the day of an open house. The Owner must contact the Board prior to the open house to arrange gate access.

• Owners may display one “resale” sign which must be of a consistent look throughout Grand Oaks. (See Exhibit D: “For Sale Signs”). The sign must show the lettering “FOR SALE” and the name of the real estate brokerage, the listing agent and a contact phone number and/or email address. If a home is for sale “By Owner”, they may state “By Owner” and their phone number and/or email address. Signs must be a consistent size of 12” high by 18” wide. The color will be the Grand Oaks “beige” background with brown lettering with a 3/8” dark brown band around the perimeter of the sign. All signs must be located within the “Lamppost” mulch bed.

Promotional signs from contractors are prohibited unless the contractor is actively working on site. Owners must remove signs if contractors install them at any other time.

32. Solar Systems In accordance with Florida Statute 163.04: Solar collection systems may be installed on the roof within an orientation to the south or within 45° east or west of due south if such determination does not impair the effective operation of the solar collectors. An application for Architectural Change (Exhibit G) must be submitted showing the location, materials and any other supporting documents as may be required. Any necessary permits and MC approval must be received prior to installation. All work must be performed by a professionally licensed and insured contractor.

33. Tanks No LPG, propane or other fuel tanks may be buried. Portable 20-gallon tanks (or smaller) typically used with outdoor grills when not attached to the portable grill must be stored inside the lanai or on the grill storage pad.

34. Temporary Storage Containers A MC application (Exhibit G) APPLICATION FOR ARCHITECTURAL OR LANDSCAPE CHANGE must be submitted and approved for temporary containers to accommodate shipping, moving, storage or construction debris for renovation or re-roofing projects. Dumpsters (or “roll-offs”), fabric temporary construction debris containers (“bagsters”), shipping containers, trailers, and temporary storage PODs are also subject to these regulations:

• The MC will approve a one-week initial period. The Owner may re-apply with reason to the MC for one-week extensions. A maximum of two initial approvals are permitted in any 12 month period.

• Owners are responsible for any damage caused by installation or removal of containers to any curbs, streets, verge trees, landscaping, mailboxes, street signs, lampposts, utility boxes or any other Association property not listed.

• Debris containers must be used for construction debris only. No garbage, yard waste, or hazardous materials are permitted; if any of these materials are present the container must be removed immediately.

• Maximum construction debris container size is 20 cubic yards (20 feet x 8 feet x 3.5 feet)

• All construction debris outside Owner’s home must be placed in the container by the end of each day. No construction debris may be stored on Owner’s Homesite.

35. Trees All trees have been planted by the Developer in accordance with the original landscape plan and are the responsibility of the Grand Oaks Community Association to maintain. No trees may be planted or removed by Homeowners.

36. Turf /Grass

The only approved turf for Owner’s Homesite is Zoysia grass and its variants. Other grass types are not permitted on owners Homesites. All turf maintenance including irrigation, fertilization, weed and pest control is to be performed only by the Association. Treatment of fire ant infestations is the responsibility of the Association.

37. Verge and Fire Hydrants The verge is the area between the sidewalk and the street, and is part of the common area. No plantings of any kind are permitted to be added by Homeowners in the verge area. In accordance with the Florida Fire Prevention Code, fire hydrants located within the verge must have a clearance of 7 ½ feet in front and to the sides of a fire hydrant and a 4 foot clearance to the rear of the hydrant. Parking is prohibited within 15 feet of a fire hydrant. 38. Wetlands, Lakes & Water Bodies; Docks & Seawalls All wetlands within Grand Oaks shall be left in their natural state and no alteration is permitted. All lakes, ponds and other waterbodies are aesthetic amenities only, and no other use including swimming, boating, playing or use of personal flotation devices shall be permitted. No seawalls, docks, boat houses, boat slips, davits, moorings or piers or any other structure intended to be used in connection with any waterbody shall be permitted. The Association shall not be responsible for any loss, damage or injury to any person or property arising out of the authorized or unauthorized use of lakes, ponds or other waterbodies within Grand Oaks. The lakes, ponds and other waterbodies contain littoral areas which are required by State and County regulations to be vegetated with native plants and maintained in perpetuity. Littoral areas aid in shoreline stabilization and nutrient uptake, and provide habitat for native animal species. No Owner shall alter vegetation growing upon a littoral area.

39. Remedies for Non-Compliance and Owner Responsibility Any unauthorized changes or additions of these standards will be subject to fines as described in Exhibit “I” Community

Standards Compliance Procedures and Fine Schedule. The Board of Directors has the power to remove all unauthorized changes or additions of those not in compliance with these Standards. Removal shall be at the Owners’ expense. In accordance with Florida Statute 720.305, all fines levied by the Board of Directors for non-compliance will be $100.00 per day until compliance is met, to a maximum fine of $1,000.00. Once the maximum fine is levied, the Association will begin legal proceedings. Owners shall hold harmless the Association and any contractor hired by the Association for damage caused to any addition, change or alteration the Owner makes after approval has been given.

Application Guidelines and Instructions for Modifications

Application Guidelines:

If you, as an Owner in the Grand Oaks Community Association, are contemplating making improvements, changes, additions or alterations to the exterior of your home or Homesite, you must first carefully review the Community Standards document to determine whether your proposed improvement requires Modifications Committee (MC) review and approval. If you are uncertain, please request guidance or clarification from a Committee or Board member. When approval is needed, determine the appropriate application form:

“APPLICATION FOR ARCHITECTURAL and/or LANDSCAPE CHANGE” (Exhibit G) is used for most requests.

“APPLICATION FOR DECORATIVE LANDSCAPE OBJECTS and FLAGPOLES” (Exhibit H) used only when requesting approval for Decorative Landscape Objects (see Section 17) or Flagpoles (see Section 9).

Complete the application following these guidelines and instructions.

The Modifications Committee is bound by the rules of the Association. The MC will make every effort to be flexible in its approvals, keeping its focus on the intent of the original design in order to maintain visual consistency and uniformity.

• Once completed, the application and any attachments must be submitted to the Modifications Committee for review and approval. This may be done through any Committee member.

• All applications must be thorough in order for the Committee to have a complete understanding of the requested proposal.

• A site plan and/or lot survey, together with all other necessary supporting documents should be included showing all features of the Homesite and dwelling which may affect the requested application. If the application does not involve an improvement, change or alteration which extends away from the dwelling and its appurtenances, then a site plan may not be required, but other relevant documents describing the work may be required.

• If a neighboring property might be impacted by the proposed project, the MC may contact any affected neighbor for their comments regarding the proposed project and will consider neighbors comments in their approval decision.

• Within 30 days of receiving the completed application, together with all necessary supporting documents, the Committee must (i) approve, (ii) request additional information or (iii) disapprove the requested application.

• If additional information is required, the Committee shall have an additional 15 days after receipt of the required information to either approve or disapprove the requested application.

• Upon receiving notice of Committee approval, the Owner is required to complete all work on the requested application within 90 days. If not completed, Owner must submit a request for an extension.

• Within 14 days of completion of all work on the application, the Owner shall notify the Committee of completion to enable the Committee to inspect the completed work for full compliance with the Application and Covenants.

• In the event the application or the completed project is denied approval, the Applicant may file and appeal with the Board of Directors.

3. Obtain and attach to the application any necessary supporting documents, such as a lot survey, site plan, modification drawings, photographs and color and type of special material to be used.

4. Obtain and attach to the application proof that the contractor, entity or person responsible for doing and completing the proposed work is insured for liability, is covered by the required workers’ compensation insurance and holds all required current licenses.

5. Owner Applicant should confirm that all required governmental permits have been obtained prior to the commencement of any work.

6. Submit the appropriate completed and signed original Application Form, along with all necessary attached documents, either in person or by email to any member of the Modifications Committee for its review and consideration.

7. Do not commence any work on the requested modification until the application is considered by the Committee and approved.

8. Once the Application is approved, applicant shall have 90 days after being notified of the approval to complete all work on the requested modification. If not completed, Owner must submit request for an extension.

9. Upon completion, Owner must notify the committee within 14 days that all work has been completed to enable the Committee to inspect the work for compliance.

10. If the Application or completed project is denied approval by the Modifications Committee, the Owner may appeal to the Board of Directors.

Inspections of Homes: Completed Projects:

Upon notification from the Homeowner to the Modifications Committee that a project has been completed, the MC will inspect the property to confirm the project is in compliance with the application submitted. Deviation from the original application will require corrective action from the Homeowner before final approval is granted.

The Modifications Committee will perform periodic surveys of the community for homes that are not in compliance with the Community Standards. A Homeowner not in compliance will be notified and instructed to complete an application for approval. If approval is not granted, the homeowner will be asked to make corrective actions or be subject to fines as determined by the Board of Directors.

Trees and Palms: All Common Areas and Individual Homes

All trees and palms located within Grand Oaks are the responsibility of the Association. The Association will trim, fertilize, remove and/or replace all trees and palms as needed. Owners may not plant or remove any trees. Plants, Shrubs and Bushes: Common Areas All plants, shrubs and bushes within the Grand Oaks Community common areas are the responsibility of the Association. The Association will be responsible for the removal and/or replacement of plants, shrubs and bushes as needed. The Association will trim and fertilize all plants, shrubs and bushes located in common areas. Fertilization will coincide with Sarasota County Ordinances. Owners may not alter plantings in common areas. Plants, Shrubs & Bushes: Individual Homes

All plants, shrubs and bushes located on Owners’ Homesites planted by the Developer that die of natural causes are the responsibility of the Association to remove and/or replace per the original landscape plans (See Exhibit F). After proper application and approval, Owners may add additional “Florida Friendly” plants as outlined in the Community Standards. No fruit or vegetable plants may be planted in mulch beds. The Association will be responsible for trimming and pruning all plants, bushes and shrubs to maintain a neat and attractive appearance. The Association will be responsible for fertilizing plants, shrubs and bushes on a regular basis to coincide with Sarasota County Ordinances. All landscaping requests by Owners for individual plant needs must be directed to the Association and not directly to the landscape contractor. The Association assumes no responsibility for Owners’ plants that die or for damage done to Owners’ plants caused by the landscape contractor. Owners must provide a list including the location of any plants planted which were not part of the original builder provided plants. The Association is not responsible for those plants should they die or if they are injured in any way by Association landscapers. The cost to repair any damage done to underground utilities or the irrigation system during Owner planting is the responsibility of the Homeowner. No modifications to the irrigation system by Owners are permitted. Owners may contact the Grounds Committee for arranging assistance with Landscape projects at the Owner’s expense. Mulch Beds: All Common Area and Individual Homes The Association will be responsible for all common area and individual Homesite mulch bed maintenance including weeding by weed kill agents or hand pulling when necessary. Treatment of fire ant infestations is the responsibility of the Association. The Association will be responsible for edging of all walks, curbs, driveways and mulch beds to keep borders well defined. New mulch will be applied to all areas when needed as determined by the Board of Directors. Turf/Grass: All Common Area and Individual Homes

The Association will be responsible for mowing and trimming of all turf areas. All turf will be fertilized to coincide with Sarasota County Ordinances and will be treated with herbicide, insecticide and pesticide and weed control. Treatment of fire ant infestations is the responsibility of the Association.

Compliance Procedures and Fine Schedule CONTINUING THE COMMUNITY STANDARDS Updated and Effective: 6-20-2017

NON-COMPLIANT INCIDENT: Whenever an incident is identified between periodic surveys, the following procedures will be followed:

a) The issue is recorded in the “Non-Compliant Incident Control Log” including the address, date reported, non-compliant standard number and description by the Committee Chair.

b) The Committee Chair sends a friendly “Non-Compliant Incident Notice” by email or US mail allowing a sufficient cure period to correct the non-compliant issue (usually 14 to 21 days) and outlining the required corrective action.

c) Upon expiration of cure period, 2 members of the MC re-inspect for compliance. d) If it is determined to remain non-compliant, the issue is documented with a photograph and written statement. e) The photograph documentation, a copy of the Non-Compliant Notice that was mailed and the written statement of

the follow-up inspection will be reported to the Board with a recommendation for further action. The Board will review the issue and if necessary, will (if existing, instruct the Property Manager to) send a violation notice.

PERIODIC COMPLIANCE SURVEYS: The Modifications Committee will periodically survey homes for compliance. Each survey will be performed by members of the Modifications Committee. The purpose of the periodic surveys is to confirm continued compliance with the Community Standards. a) Non-compliance issues found during the periodic surveys will be recorded with the date of survey, address, non-

compliant standard number, description and photo documentation. b) The Committee Chair sends a friendly “Non-Compliant Incident Notice” by email or US mail allowing a sufficient

cure period to correct the non-compliant issue (usually 14 to 21 days) and outlining the required corrective action. c) Upon expiration of cure period, 2 members of the MC re-inspect for compliance. d) If it is determined to remain non-compliant, the issue is documented with a photograph and written statement. e) The photograph documentation, a copy of the Non-Compliant Notice that was mailed and the written statement of

NOTICE OF VIOLATION AND FINE:

The following procedures take place after the Board has recommended further action: A. First Notice of Violation: The Property Manager (or Board if no Property Manager exists) will send a letter to the

Homeowner requesting the issue(s) be addressed, communicate regarding proposed date of compliance or report issues that go beyond the Homeowners ability to comply. Homeowners have 30 days to comply.

B. Second/Final Notice of Violation: After 30 days from the date of the first letter with no response from the Homeowner, the Board will instruct the Association Attorney to send a letter. The letter will indicate that the Homeowner must report correction of the violation or contact the Attorney with a date for compliance. This letter

serves as final notice to the continuing violation. The Attorney will report the Homeowner response to the Board. If Homeowner indicated they have complied, the Board will instruct the MC to inspect for compliance and report. If no response from the Homeowner, the Attorney will recommend that a fine be imposed.

C. Fine Procedure: Upon receipt of notification from the Attorney that there was no response from the Homeowner, the Board may impose a fine for a compliance violation. The Owner will be notified that a hearing in front of a Fine Committee to determine whether to confirm or reject the fine levied by the board will be held within 14 days. The committee is composed of three members appointed by the Board who are not officers, directors, or employees of the Association, or the spouse, parent, child, brother, or sister of an officer, director, or employee. The committee must approve the fine by a majority vote before the fine is levied. The Association must provide written notice to the Owner of the Fine Committee decision. All fines levied are $100.00 per day until compliance is met to a maximum fine of $1,000.00
