INSTRUCTIONS TO BIDDERS
1. GENERAL: Sealed Bids are invited through PPRA's / NHA's Websites as well
press advertisement from GST / NTN registered firms having sufficient
experience in the relevant field for Janitorial Services Contract at
Regional Office, General Manager (Motorways) M-2 & M-3, NHA Kallar
Kahar and at allied offices on Motorways (M-2 & M-3):

2. BID DOCUMENTS
Bid documents which include Instruction to Bidders, Terms
and Conditions of Contract Agreement, Bid Application Form
(Appendix-A), Price bid (BoQ) (Appendix-B), Scope of Work / Terms of
Reference (ToR) (Appendix-C) and detail of required staff can be
downloaded / obtained from PPRA & NHA websites www.ppra.org.pk &
nha.gov.pk.
3. DOCUMENTS COMPRISING THE BID: The Bids shall comprise of Two Envelops as under:
i. Pre-Qualification / Technical Bid (Envelop-A).
ii Price Bids (Envelop-B).
a. Pre-Qualification / Technical Bid (Envelop-A):
The interested Firms are requested to submit following
documents for prequalification of the subject works along with
supporting evidence and the same shall be evaluated as per following
criteria:

(i) Office establishment and infrastructure details of firm (10 Points).
(ii) Firm registration with company registrar office and GST (10 Points).
(iii) Past Experience (General & Relevant Services at Public Offices & Infrastructures (20 Points).
(iv) Financial Capabilities of Firm (30 Points).
a. Bank Statement and or Audited Balance Sheet for last one year
b. NTN Certificate
c. GST Registration
(v) Personnel Capabilities of Firm (10 Points).
(vi) Working Methodology Statement (10 Points).
(vii) Past Performance & No Litigation, Affidavit on Judicial Stamp Paper to the effect
that firm has neither been black listed nor any contract rescinded due to non-
fulfillment of contractual obligations in the past (10 Points).
The minimum qualification score shall be 70 points.
b. Price Bids (Envelop-B):
The price bid shall comprise BoQ, Bid Application Form, ToR and the Bid.
Bid Application Form duly completed in all respect and signed.
c. The Envelops should be marked clearly of its purpose in bold and legible letters to avoid inconvenience.
4. SUBMISSION & OPENING OF BIDS:
The Prequalification Documents (Envelop-A) along with sealed
Tender Documents (Envelop-B) shall be received and be placed
in the tender box placed in Conference Hall of General
Manager (Motorways) M-2 & M-3 NHA Kallar Kahar office on
May 09, 2016 up to 1130 hours. The PQ documents
(Envelop-A) shall be opened on same day at 1200 hours by the
Tender Opening Committee in the presence of bidders or their
authorized representatives, whereas the Tender / Price
Bids (Envelop-B) shall be kept sealed and locked. After
evaluation of prequalification the Tender / Price Bids
(Envelop-B) of qualified firms only (having obtained 70 points)
shall be opened later on a notified date & time, while the bids
of unqualified firms shall be returned unopened.
(ii) Bidders are required to submit one sealed copy of Price bid
(Envelop-B). Original shall be opened at the time of bid
opening and duplicate will be kept sealed and opened only if
some ambiguity / complication arise. Both envelops must be
clearly marked as "ORIGINAL" and "DUPLICATE".

5. PRE-QUALIFICATION / TECHNICAL EVALUATION CRITERIA:
The Pre-Qualification / Technical Bid (Envelop-A) shall be evaluated on
the basis of technical expertise, experience etc as highlighted above at
Para-3(ii). The minimum qualification passing score shall be 70
points. So the firms obtaining 70 points shall be declared qualified
and their price bid shall be opened accordingly. Whereas, the
price bids of disqualified firms shall be returned unopened.
6. BID SECURITY:
(i) All bids must be accompanied with the Bid Security
amounting to Rs 100,000/- in shape of pay order or
demand draft in favour of General Manager (Motorways) M-2 &
M-3, National Highway Authority Kallar Kahar. The bids
without Bid Security shall be declared as non responsive.
(ii) The same shall be released to unsuccessful Bidder within
seven (07) days of evaluation of Bids. However, Bid Security of
successful Bidder shall be kept with NHA till completion of the
Contract Agreement.
7. ACCEPTANCE / REJECTION OF BIDS:
On the basis of evaluation, the successful Bidder will be informed
accordingly with intimation to others the grounds for rejection of their
Bids. A confirmed Work Order will be issued to successful Bidder
only.
8. VALIDITY OF BIDS:
All quoted rates should remain valid for Sixty (60) days from date of
submission of Bids. The successful Bidder shall be bound to mobilize
his team to Regional Office, General Manager (MWs & BoT) M-2 & M-3,
NHA Kallar Kahar and allied offices within a month time (i.e. 30 days)
of issuance of a confirmed order, failing which his Bid shall be
considered rejected and Security Deposit shall be forfeited.
9. AWARD OF CONTRACT:
On the basis of evaluation, the successful bidder shall be offered a
Letter of Acceptance indicating terms and conditions.

10. PERFORMANCE SECURITY / CASH SECURITY DEPOSIT:
(i) A sum of Rs 200000/- (Rupees Two Hundred Thousand
only) shall be deposited by the Contractor within two
weeks (15-days) of issuance of Letter of Acceptance in
shape of CDR / DDR / Pay Order in favour of
GM (Motorways) M-2 & M-3, National Highway Authority,
Kallar Kahar.
(ii) If, the contractor fails to carry out due services as per
schedule, the work shall be carried out by the client and
amount / expenditure in this regard shall be deducted
from monthly Invoice / Security Deposit of the
Contractor.
(iii) The performance security / Cash security deposit shall
remain valid and deposited with NHA till completion of
services/works and shall be released one (01) month after
completion of services.
11. CONTRACT AGREEMENT:
If accepted, both the parties shall enter into a Contract by signing
Contract Agreement (Draft at Annexure-C).
12. PERIOD OF CONTRACT:
The Contract shall be made initially for a period of two (02) years
which shall be extendable on yearly basis subject to satisfactory
performance of the Contractor and approval of the Competent
Authority.
13. DISPUTES:
In case of any dispute between the parties, a BS-20 officer of the
authority shall be appointed as "Arbitrator" with the approval of
Competent Authority. Decision of the "Arbitrator" shall be binding
upon the parties.
14. MODE OF PAYMENT:
Payment to the Contract against monthly invoice shall be made
within ten (10) days. Deduction shall be made for any losses to the
assets of authority if proved to have been occurred due to negligence
of contractor staff.

15. TERMINATION OF CONTRACT:
The Contract can be terminated by serving Two (02) months advance
notice by either side (The Client or The Contractor). However, the
Authority reserves the right to terminate Contract immediately, if, any
serious defaults is noted on the part of Contractor. In this way, no
advance notice shall be required and Security Deposit of the
Contractor shall be forfeited.
16. DISQUALIFICATION:
Incomplete/fake documentation and the contract wrong information
shall make the firm liable for debarring from this as well as future
contracts in NHA even after award of work.

TERMS AND CONDITIONS OF CONTRACT AGREEMENT
SECTION 1
SCOPE OF SERVICE
1.1 The firm M/s _________ will provide under mentioned Janitorial Services for Regional Office, General Manager (MWs & BoT) M-2 & M-3, NHA Kallar Kahar and Allied Offices (The Employer):-
a. The work under this Contract shall be cleaning & janitorial
services of Regional Office, General Manager (MWs & BoT)
M-2 & M-3, NHA Kallar Kahar and allied offices of Motorways
(M-2 & M-3) i.e. cleaning of floors, rooms, cabins, toilets,
windows glasses, light fixture, boards, name plates, glasses
panels in outer side of all the offices and surrounding
areas of the premises through skilled and experiences
staff in order to ensure standard cleanliness.
b. All the consumable material for execution of above work i.e.
liquid soap, sweep, bleach. Vim powder, room air freshener
for toilets, tissue rolls, phenyl balls and liquid tins,
antiseptic spray, glint, dusters shall be provided/ arranged
by the Contractor at his own cost.
c. The Contractor shall arrange all tools and equipment used
for the work i.e. mop, brooms, wipers, baskets, window wipers,
dustpans, cobweb remover, scraper, ladder, brushes,
gloves, scrubbing machines, wet 8x dry vacuum cleaner along
with standard trolley for each floor at his own cost.
d. Eight Hours for all working days. The staff shall start work half
an hour before office timings or as desired by NHA Office
concerned.
e. Skilled / Experienced worker in proper uniform with
label Cards showing their identity shall be deployed. List of
staff along with their CNIC shall be provided to NHA
Administration Section before deployment. Any replacement
shall be intimated in advance with consent of the concerned
NHA office.
f. If Firm is unable to provide requisite numbers of staff, notice
for non compliance will be issued to the firm under
intimation to the licensing authority. After issuance of three
non compliance notices the employer reserves the right to
terminate contract agreement at any time.
g. If staff found performing more than 8 hours duty or office
working hours of NHA even other than NHA Premises,
the wage of that particular duty will not be paid to the
company and strict action shall be taken against the firm.
1.2 The firm personnel shall be healthy and medically fit with Category-A.
1.3 The janitors / sweepers / Personnel will hold valid Computerized National
Identity Cards. All janitors / sweepers / Personnel shall be selected
carefully by the M/s _______________ The Janitors / Sweepers / Personnel
shall be employees of the M/s _______________ and shall perform
duties for the Employer as per terms of contract.

1.4 The M/s _________________ shall observe the applicable
Labour Laws and enactments in operation and enforce from
time to time.
1.5 The M/s _______________will maintain a reserve pool of
personnel short-listed to be called upon short notice to meet
additional requirement if any or replacement/ substitute of
any person(s).
1.6 The M/s _______________will ensure that personnel do not
indulge in unionism, strikes, undesirable activities, political
agitation and unapproved group religious activities.
1.7 Personnel will be posted on static places of duty or as
requirement of the Employer. The M/s ____________will
provide services in NHA Regional and Site offices on same
terms and conditions / rates as and when required/
formally requested by the employer.
1.8 Personnel as required will be employed in area of
responsibility according to the requirement of the Employer.
1.9 Maximum age limit (s) for staff/personnel will be adhered to
not more than 45 years.
1.10 The M/s _______________ must arrange strict checking of
their staff once during a shift on daily basis through
supervising officers other than deployed at site.
1.11 An indemnity bond in the prescribed Performa of NHA on
Rs 50/- Stamp Paper shall be executed by the
M/s _______________to meet losses and damages, in case of
any loss and damage due to the negligence of all or any of the
personnel of "The M/s _______________" during the subsistence
of running contract in favor of the Employer; qua loss and
damage incurred to the person and property of "The
Employer". Moreover, indemnity from litigation by "The
M/s ___________to its employees shall also be accorded in due
course.
1.12 The M/s ______________shall not employ any person who:-
a. Has been convicted of any offence involving moral turpitude
or dismissed from government service.
b. Is not fit and proper person to be employed?

1.13 The M/s _______________ should select their reliever carefully
and provide full particulars of the personnel along with copies
of CNIC and verification to the Employer for approval.
Frequent change of staff would not be allowed.
1.14 The Employer reserve the right to discharge the
deployment of any person by the M/s _______________
without giving any reason and the M/s _______________
will withdraw and replace the discharged person
immediately to the Employer.
1.15 The M/s _______________has made no misstatement with
regard to performance of its obligation under this
M/s ______________________and there is no fact known to
the M/s _________________________or its agents or
employees which would materially affect the Employer's
decision in executing this Contract.
1.16 The M/s _______________shall maintain insurance with
responsible and reputable companies in such amounts and
covering such risks as is prudent and is usually effected by
entities or individuals engaged in operations similar to that
of the M/s _______________and shall furnish the Employer
with evidence of compliance upon the request.
1.17 That there are no judicial or departmental proceedings
pending, or to the best of its knowledge threatened for the
liquidation or insolvency of the M/s _______________or that
could materially or adversely affect the performance by the
M/s _______________of its obligations under this Contract.
1.18 The execution, delivery and performance of these
obligations vide running Contract by the
M/s _______________ does not constitute a violation of any
law, court ruling, governmental regulations, decision of an
arbitrator of competent jurisdiction or contractual
obligation applicable or relating to it and its assessments or
business.

SECTION 2
CURRENCY OF CONTRACT 2.1 Contract will be for the period of two (02) years
(Extendable on satisfactory performance to contractor up
to maximum of five years).
2.2 Contract will come into force from the date of signing of
Contract Agreement or June 01, 2016 and the
M/s _______________ should deploy personnel on that date
(0800 hours).
2.3 The Employer may in writing, terminate contract upon
serving 30 days notice, and the same shall stand
terminated forthwith upon expiry of 30 days from the date of
issuance of such notice unless said notice is withdrawn by
NHA or payment of half month contract price based on last
month verified bill to the M/s _______________
2.4 In case, the M/s _______________ intends to terminate
running contract, 60 days prior notice will be served to
the Employer or payment of 30 days contract price based
on previous month verified bill to the NHA.
SECTION 3
PAYMENTS
3.1 Staff for services will be provided at fixed monthly cost
of Rs. _____.The Minimum salary wages of Labour as notified
by the Govt of Pakistan shall be followed by the contractor.
3.2 The M/s _______________ shall issue to the Employer a
consolidated Invoice by the last day of current month and
payment will be made to the M/s _______________within a
reasonable period of receipt of invoice. Payment to
M/s _______________shall is made after deduction of all
applicable taxes, levies etc.
3.3 The Employer may also make pro rata deduction from the
invoiced amount on account of the absence of any staff
being absent from duty or otherwise engaged in unauthorized
or other activities which may be harmful for the Employer,
which shall be determined by sole reference to Employer.

3.4 Personnel will be considered to be on effective pay Roll of
the M/s _______________ from the date they report at the post
of the Employer.
3.5 Pay to the personnel will be disbursed by the
M/s _______________________ vide their own arrangements by
or before 3rd of each month, without awaiting for payment of
monthly invoice, while no personnel would bear any lien against
Employer.
3.6 The Firm (Contractor) M/s _______________shall pay the
salary to the employees through Cross cheques
(payee A/c only) and shall attach the same with the
invoice along with the detail of tax deduction from
salary at source, otherwise, the invoice shall not be
processed and strict action shall be taken.
3.7 Payment towards workers Insurance, Social Security and
EOBI or any other dues that may become applicable will
be paid by the M/s _______________ at no extra cost to the
Employer.
SECTION 4 INSPECTION AND DISCIPLINE
4.1 Besides the Supervisor of M/s _______________the
Employer will also exercise supervision on personnel
and report any misconduct of personnel to the
M/s _______________for prompt remedial measures.
4.2 The M/s _________________will replace any person(s) as and
when desired by the Employer upon written request and
provide appropriate substitute at once.
4.3 In case of any dispute, joint inquires shall be
held to fix the responsibility by the parties. However
decision of the Employer will be irrevocable.
4.4 Personnel deployed at locations/ offices will be surprise
checked by M/s _______________ thrice a day and report on
prescribed profroma will be furnished to the Employer on daily
basis.

SECTION 5
MISCELLANEOUS
5.1 The M/s _______________ will provide postal address,
telephone and fax contact numbers of their offices to the
Employer.
5.2 The Employer shall provide Medical First Aid to
personnel while on duty through local arrangement or
otherwise.
5.3 The M/s _______________ will provide medical services to
the personnel on their own terms and conditions.
5.4 The M/s _______________ will ensure that each Personnel
renders 8 hours duty or for the duration of the working
hours in a day in Employer premises and not anywhere
else.
5.5 The M/s _______________ is to ensure that all pre-
requisite is to be completed before deputing of personnel at
NHA premises. List of all deployed personnel along with
reserve pool will be provided to Employer before
commencement of contract.
5.6 The M/s _______________ is to ensure proper
maintenance of equipment and submit serviceability
certificate to Employer quarterly.
5.7 In case of grant of leave to staff the replacement would be
provided by the M/s _______________without any extra
charges.
5.8 In case of extra requirement of staff the M/s __________ will
be bound to provide the staff within three days on submission
of demand by the Employer. However, in case of
emergency the M/s _______________ will take steps
at his best to provide extra staff on short notice of the
Employer.

SECTION 6 ARBITRATION
6.1 In case the parties are unable to agree upon and appoint
a Sole Arbitrator, the Sole Arbitrator shall be
appointed in accordance with the provisions of the
Arbitrator Act, 1940, as amended from time to time.
6.2 The cost of Arbitration proceeding, including the fees
of the Sole Arbitrator and any costs of proceedings
imposed by the sole Arbitrator shall be borne equally
by both Parties. Notwithstanding the foregoing, each
party shall bear its own legal costs.
6.3 Decision of Arbitrator(s) /Umpire shall be final and
binding upon the parties.
SECTION 7 NOTICES
7.1 All notices to be served under the Contract shall be in
writing and delivered by hand or registered post / courier
service at the address herein below; Mailing; Address of
NHA GM (MWs & BoT) M-2 & M-3, National Highway
Authority, Kallar Kahar Service Area (North Bound)
M-2, District Chakwal Ph # 0543-588129, Fax # 0543-588196.
SECTION 8
GOVERNING
8.1 This contract shall be governed by and construed in
accordance with the laws of Pakistan and conditions
spelled out in this Annexure will be binding on the
parties.
8.2 The parties can amend the contract terms and
conditions through written request and mutual
understanding upon the approval of the Competent
Authority.

8.3 No failure or delay on the part of the Employer to
exercise any power, right or remedy under this Contract
shall operate as a waiver thereof nor shall any single or
partial exercise by the Employer of any power
right or remedy preclude any other or further exercise
thereof or the exercise of any power right or remedy.
The remedies provided in this Contract are cumulative
and are not exclusive of any remedies provided by the law.
8.4 The M/s _______________shall not assign this Contract or
its rights and obligations hereunder to any other
person or entity, except with the prior written
permission of the Employer.
8.5 Headings in this Contract are for convenience only
and shall not be used to interpret or construe its
provisions.
8.6 This Contract along with its annexure constitute the
complete and final obligations between the
M/s__________ and the Employer and supersedes any
and all prior agreements, understandings,
communications and arrangement whether oral or
written between the parties with respect to the subject
matter hereof.
8.7 If any provision of this Contract is held to illegal or
invalid under present or future laws or regulations
effective and applicable during the term of this Contract,
such provision shall be fully severable and this
Contract shall be construed as if such illegal or invalid
provision had never comprised a part of this Contract
and the remaining provisions of this Contract shall
remain in full force and shall not be affected by the
illegal or invalid provision or by its severance from this
Contract.

(APPENDIX-C)
SCOPE OF WORK/Terms of Reference (TOR) DEFINATION:
The work under this Contract shall be cleaning & janitorial services
of Regional Office, General Manager (Motorways) M-2 & M-3, NHA
Kallar Kahar and allied offices of Motorways (M-2&M-3) i.e. cleaning
of floors, rooms, cabins, toilets, windows glasses, light fixture,
boards, name plates, glasses panels in outer side of all the offices
and surrounding areas of the premises through skilled and
experiences staff in order to ensure standard cleanliness.
CONSUMABLE MATERIAL:
All the consumable material for execution of above work i.e.
liquid soap, sweep, bleach. Vim powder, air freshener for toilets,
tissue rolls, phenyl balls and liquid tins, antiseptic
spray, glint, dusters shall be provided/ arranged by the
Contractor at his own cost.
TOOLS AND EQUIPMENT:
The Contractor shall arrange all tools and equipment used for
the work i.e. mops, brooms, wipers, baskets, window wipers,
dustpans, cobweb remover, scraper, ladder, brushes, gloves,
scrubbing machines, wet four (4) dry vacuum cleaner along with
standard trolley for each floor at his own cost.
TIMINGS:
Eight Hours for all working days. The staff shall start work
half an hour before office timings or as desired by NHA Office
concerned.
DEPLOYMENT OF STAFF:
Skilled/ Experienced worker in proper uniform with lapel Cards
showing their identity shall be deployed. List of staff alongwith their
CNIC shall be provided to NHA Administration Section before
deployment. Any replacement shall be intimated in advance with
consent of the concerned NHA office. Deployment shall be made as
per below detail:

SERVICES
DAILY SERVICES:
(i) Sweeping, cleaning and mopping of floors, rooms, cabins, corridors, kitchens, dining halls, conference hall, lobbies, glass panels, carpets and surroundings areas.
(ii) Washing and cleaning of all toilets, commodes, urinals, wash basins with standard material.
(iii) General cleanliness of offices, light fixtures, furniture and accessories etc.
WEEKLY SERVICES:
Cleaning and dusting of all windows glasses and frames with standard detergent to keep them neat clean & shiny. FORTNIGHTLY SERVICES:
(i) Spraying disinfectants in the toilets, urinals in order to kill all bad odorous.
(ii) Vacuum cleaning of all carpets/curtains.
MONTHLY SERVICES: (i) Washing of all floors, wash rooms including walls etc. (ii) Dusting/ cleaning of doors, window glasses from outer side. (iii) Cleaning/ sweeping of roofs. HALF YEARLY SERVICES:
(i) Polishing of marble & ships floors.
(ii) Fumigation of the building and surrounding area.
STORE CUM OFFICE:
Space for store cum office shall be provided by NHA as per availability.

National Highway Authority, Ministry of Communication, Government of
Pakistan Kallar Kahar, District Chakwal (hereinafter called the employer) on
the one part and _________________________ (hereafter called the Contractor
on the other part).

2. Whereas bids / offer have been received by the Employer for
Contract # JS-16 for provision of janitorial services at main office Kallar
Kahar and attached / allied offices at M-2 & M-3 amounting to

3. Therefore in connection of the promises, convents and agreement
hereinafter contained and to be performed by the parties hereto, the said
parties hereby covenants and agreed as follows:
a) In consideration of the covenants and agreement to be kept
and performed by the contractor, and for the faithful
performance of this contact and the completion of the work
according to the specifications, and conditions herein
contained, the employer shall pay and the contractor shall
receive and accept as full compensation for everything
furnished and done by the contractor under this agreement,
the contract price stipulated in the Letter of Acceptance at the
time and in the manner prescribed by the conditions of the
contact.
b) Said work shall be started within same day after issuing of
letter of commencement, and contractor shall complete the
work within twenty-four (24) months after the commencement
date. In this agreement words and expressions shall have the
same meanings as are respectively assigned to them in the
conditions of the contract hereinafter referred to.

4. The following documents shall be deemed to form and be read and
construed as part of this agreement.
a. The Contract and Appendices.
b. The priced Bill of Quantities.
c. Standard Specification.
d. The addenda if any.
e. Letter of Acceptance.
f. Conditions of the contract.
5. In witness where of the parties hereto have executed this contract
as of the day and year herein above set forth to be filed in the office of the
employer.
