1 Particulars of Organization ,function and duties of PublicAuthority

The Municipal Council , NARASIMHARAJAPURA , consists of 11Councilors elected from the Wards, Councilors nominated byGovernment and the Jurisdictional MP/MLA/MLC as members .Thehead of the Council is the President elected from among the councilorsof the Wards . There is also a Vice-President elected from the wards.There is also a vice-president elected from among the Councilors toexercise such powers delegated to him by the president . Thecommissioner /Chief Officer appointed by the Govt. is the executivehead of the Council . The Municipality has Engineer / Engineers/Health Inspectors /Manager /FDA/SDA/Bill Collectors and PowraKarmikas.

The Council has obligatory functions such as maintenance ofroads, markets, public toilets , drainage , supply of drinking water ,cleaning of streets removal of garbage , regulation of buildings,slaughter houses, Public hygiene , Prevention of contagious diseases,Registration of births and deaths , street lighting , etc., anddiscretionary functions like maintenance of parks , gardens , libraries ,hospitals, providing entertainment in public places, slum up-gradations, promotion of cultural , educational and aesthetic aspectsurban poverty alleviation program sponsored by Government etc.,

2 Powers and Duties of the Officers 1. The Commissioner/Chief Officer as the executive head shallexercise such powers as may be delegated to him by the municipalCouncil under the provision of the Karnataka Municipalities Act.

2. He shall have the powers to grant, give of issue under his signatureall licenses and permission , extracts of the public documents /certificates which may be granted under the provisions of theMunicipal Act

3. He is also provided to withhold Or Suspend or Withdraw suchlicenses if found to be against the interest of Public or theMunicipality

4. He has power to Operate Municipal Funds, to receive, recover andcredit to the municipal fund, all fees, taxes colleted by themunicipality and to make payment towards execution of works andprocurements and disbursement of salaries to the staff and thehonorarium/meeting fees etc., to the Members of the Council.

5. He can invite tenders through Public Notice for execution of worksor procurement materials required by the municipal council

6. He can entered into a contact on behalf of the council .7. He also has the powers to transfer rights of the properties in favour

of the transferees of the municipal registers.

8. He has powers to enter an inspect buildings and to removeunauthorized construction , encroachments advertisement , preventnuisance, hazardous activities etc.,

9. He has power to sanction leave , advance to the staff and to oversee their works as controlling Officer.

10. The Assistant Executive Engineers of the Municipality has powersto sanction an estimate upto Rs 10 lakhs .

11. The Assistant Engineer has power to sanction an estimate upto Rs20,000/-

12. The Junior Engineer has power to sanction an estimate upto10,000/-.

All other staff of the Municipal Council do not have individual powersbut assist the Commissioner /Chief Officer to carry out his duties andfunctions

3 The procedure followed in theDecision making process,including channels of supervisionand accountability :

The proposals received by the Municipal Council in the matters ofexecution / repairs of infrastructure works are processed and examine bythe Commissioner / Chief Officer in terms of the provisions of theKarnataka Municipalities Act/ the instructions of the Government andplaced before the council for approval . The council ordinarily meets oncein a month . In urgent matters it can meet frequently . The Commissioner/Chief Officer is required to prepare the agenda for the meeting of thecouncil in consultation with the President and sent to all the members atleast 7days in advance . After approval of the proposal by the Council theCommissioner / Chief Officer can implement the decision if such decisionsare within the powers of the council in such reasonable time as may berequired .If the decisions required the approval of higher field Officers orthe Government the Commissioner / Chief Officer will accordingly seekthe approval . The Deputy Commissioner and the Director of MunicipalAdministration are vested with the supervisory powers and these officerscan suspend /set aside the decisions if found to be contrary to theprovisions of the Karnataka Municipalities Act. The Council and theCommissioner /Chief Officer are accountable for all happenings in themunicipality .

4 The Norms set for the dischargeof functions of the Municipality

The Municipal Council functions within the norms stipulated in theKarnataka Municipalities Act and Rules framed there under.

The programmes and policies of the Municipality are formulated by themembers of the Municipality who are non other than publicrepresentatives. The Municipality in certain occasions does consult themembers of the Public /Local welfare association / NGO’s necessary .

8 A statement of the boards ,councils, committees and otherbodies consisting of two or morepersons constituted as its part orfor the purpose of its advise andas to whether meetings of thoseboards, councils , committeesand other bodies are open topublic or the minutes of suchmeetings are accessible for public

A standing Committee consisting of 09 No of Councilors to deal with thematters of taxation , finance , public health, education , social justice, townplanning and accounts is constituted on ......... The minutes of themeetings of this committee are open to public expect those exemptedunder the provisions of the right to information Act, 2005.
