PUBLICATION OF MENTAL HEALTH CARE AMENDMENT BILL, 2012
The Minister of Health intends to introduce table the Mental Health Amendment Bill, 2012 in
Parliament, this year.
Interested persons are invited to submit any substantiated comments or representations on the
proposed draft amendment to the regulations, to the Director - General of Health, Private Bag
X828, Pretoria, 0001 (for the attention of the Cluster Manager: Legal Services), within one
month of the date of publication of this notice.

MENTAL HEALTH CARE AMENDMENT BILL, 2012
GENERAL EXPLANATORY NOTE:

BILL
To amend the Mental Health Care Act, 2002 so as to amend and insert certain
sections; to provide for the delegation of powers by the head of the national
department to officials in the national department; and to provide for matters
connected therewith.
BE IT ENACTED by the Parliament of the Republic of South Africa, as follows:-
Amendment of Act 17 of 2002
1. The Mental Health Act, 2002 (Act No. 17 of 2002), is hereby amended by
the insertion after section 72 of the following section:
"Delegation of Powers
72A. (1) The head of the national department may. in writing.
delegate any power conferred upon him or her by this Act to any
person in the employ of the national department, except the
powers referred to in sections 5, 13(2), 41, and 49.
(2) The head of the national department may, at any time-

(a) withdraw a delegation made under subsection (1);
or
(b) withdraw or amend any decision made in the
exercise of such delegated power.
(3) A decision made in the exercise of any delegated power,
unless withdrawn or amended is deemed to have been
made by the head of the national department. ".
Repeal of laws
2. Chapter 8 of the Mental Health Act, 1973 (Act No. 8 of 1973) is hereby
repealed as a whole.
Short title and commencement
3. This Act is called the Mental Health Care Amendment Act, 2012, and comes
into operation on a date determined by the President by proclamation in the
Gazette.

PROPOSED CATCHMENT MANAGEMENT STRATEGY
The Breede-Overberg Catchment Management Agency was established in 2005 in terms ofChapter 7 of the National Water Act, 1998 (NWA). One of the initial functions of a catchmentmanagement agency, as stipulated in section 80 of the NWA, is to develop a CatchmentManagement Strategy.
After a comprehensive stakeholder participation process, a Catchment ManagementStrategy was drafted for the Breede-Overberg Catchment Management Agency (BOCMA)and submitted to the Minister of Water and Environmental Affairs. The Minister of Water andEnvironmental Affairs has given her written consent, in accordance with section 8(4) of theNWA, to publish the Catchment Management Strategy for comment.
The Catchment Management Strategy is available on the BOCMA website,www.bocma.co.za and at the offices of the BOCMA at 51 Baring Street, Worcester.
The BOCMA will also ensure that copies of the Catchment Management Strategy areavailable at accessible locations throughout the Breede-Overberg area. These locations willbe advertised in the regional and local newspapers of the Western Cape.
In accordance with section 8(5)(a) of the NWA, the Breede-Overberg CatchmentManagement Agency hereby invites comments to be submitted on the proposed CatchmentManagement Strategy.

SUMMARY OF THE CATCHMENT MANAGEMENT STRATEGY
The Breede-Overberg Catchment Management Agency (BOCMA), established in terms ofthe National Water Act of 1998, is the lead agent for water resource management within theBreede Water Management Area. As lead agent, BOCMA plays a central role in protecting,using, developing, conserving, managing and controlling water resources while alsocoordinating with government, sector partners and stakeholders. The Breede WaterManagement Area is situated in the south-west corner of South Africa and falls entirelywithin the Western Cape Province. While the water management area derives its name fromthe largest river within its boundaries, namely the Breede River, a significant portion of thewater management area consists of the rivers of the Overberg.
The BOCMA is responsible for the development of a Catchment Management Strategy(CMS). The CMS guides the actions of the BOCMA and as well as other institutionsconducting water resources related activities, and participation and coordination withpartners is key to the success of the strategy. This CMS is a step towards safeguarding ourwater resources to meet our aspirations, while considering the complexities that futuregenerations will face.
There is a compelling social, economic, environmental and water resources motivation for aCatchment Management Strategy in the Breede-Overberg at this time, given theconvergence of historical developments, future uncertainties and the changing environmentfor water resources management in this area.
Water resources are stressed with current requirements approaching or exceedingaverage available water resources. The situation is exacerbated by the region being awinter rainfall region where the timing of water availability does not coincide with thetiming of peak demand. Development of new storage infrastructure or supply sources isexpensive, with the increasing requirements from Cape Town and potential climatechange effects placing additional pressure on the system.
The fundamental challenge in these stressed catchments is to support the desperatelyneeded social redress and economic development, while maintaining the environmentalfunctioning of the nationally important aquatic ecosystems found in this region. This must bedone while recognizing broader changes, including shifting policy in South Africa, anunstable economy, uncertain climate, and evolving technology.
While there are numerous challenges, there are also opportunities that may be leveragedfrom a proactive and holistic approach to the planning and management of water resourcesin this region. These include a focus on representivity where all demographic groups areinvolved in the transformation process, participatory decentralization where decision-makingreflects local understanding and needs, cooperative management between sectorparticipants, and using water as a catalyst for growth and development.
The Vision for the Breede-Overberg catchment was developed through a series of worksessions with a broad and diverse range of stakeholders, and was formulated in the contextof a broader development vision for the region. The Vision for the Breede-Overberg WaterManagement Area is captured by:
"Quality water for all, forever"

Stakeholders expanded this into the following three vision statements reflecting the balancebetween protection and development achieved through joint action:
Protecting our rivers, groundwater, wetlands and estuaries in a healthy and functioningstate for nature, people and the economySharing our available water equitably and efficiently to maintain existing activities,support new development and ensure redress, while adapting to a changing climateand world.Cooperating to jointly nurture, take responsibility and comply, so that our waterresources are well managed, under the leadership of a strong Breede-Overberg CMA.
These statements are based on an understanding that water will shape the growth anddevelopment of the Breede Valley and Overberg region, and that the future of the region islinked to that of Cape Town, the Western Cape and the country as a whole. It alsorecognises that responses to the challenges and opportunities of change in the natural andsocial environment will determine how residents live and work together.
The vision statements around protecting, sharing and cooperating, provide the unifyingframework for the CMS by serving as the Strategic Areas of focus for development of thestrategy. The Strategic Areas and corresponding visions are given effect through supportingMeasures, Objectives and Actions. The Measures to support each Strategic Area arerepresented as follows:

It recognizes that water isfundamental to growth and development and it emphasises the interconnectedness of thevarious plans and actions needed to support the implementation of this strategy.

I, Bomo Edna Edith Molewa, the Minister Of Water and Environmental Affairs hereby, in terms of Section5(1) of the National Water Act, 1998 (Act No 36 of 1998) invite written comments on the establishment ofthese water management areas within 90 days of the gazette notice, establish the water managementareas and determine their boundaries as contained in the Schedule hereto as a component of theNational Water Resource Strategy. Included are the old water management areas (Table A.1) forcomparison with the current water management areas (Table A.2). All the comments are to be forwardedto the Director-General, attention to the Chief Director: Institutional Oversight.

TheWater Management Area boundary then runs South East to meet thewatershed between quaternary catchments D73A and D73B. The
boundary then follows this watershed and that between D73A and D71B,until it meets the boundary of the Hay district. It follows this boundary until itmeets the watershed between D71B and C92C. The Water ManagementArea boundary continues along this watershed until it meets the boundaryof the Orange Vaal Water User Association. It continues south-easterly on
this boundary until it meets the watershed between C92B and C51M whereit follows this watershed and that between C92B and C51L. Thereafter itfollows the watershed between C51L and C91E. It continues on this

It follows the boundary of the mentioned WUA in a westerlydirection to a point, west of the Langberge, 19 kilometres west ofBeeshoek, near Postmasburg. The Water Management Area boundary
then runs South East to meet the watershed between quaternarycatchments D73A and D73B. The boundary then follows this watershedand that between D73A and D71B, until it meets the boundary of the Haydistrict. It follows this boundary until it meets the watershed between D71Band C92C. The Water Management Area boundary continues along thiswatershed until it meets the boundary of the Orange Vaal Water UserAssociation. It continues south-easterly on this boundary until it meets thewatershed between C92B and C51M where it follows this watershed andthat between C92B and C51L. Thereafter it follows the watershed betweenC51L and C91E. It continues on this watershed until it reaches the farmboundary of Wolwe Dam 87. The Water Management Area boundary thenfollows the mentioned farm boundary up to the farm boundary ofVaalboschhoek 85. It the follows successive farm boundaries as they meet,progressively moving in a westerly direction, namely: Weltevrede 117,Vaalpan 118, Koppiesdam 119, Spijt Fontein 122, Kareebosch 130,Osfontein 121, Benaauwheidsfontein 442, Olifantskop 196, Sussana 197,and Olifantsdam 170. The Water Management Area boundary then followsthe eastern boundary of Olifantsdam 170 in a northerly direction to includethe farm Olifantsrug 293 until it meets the watershed between C91E andC52L. Hereafter, the Water Management Area boundary follows theboundaries of the drainage regions as mentioned initially in this description.

Ek, Bomo Edith Edna Molewa, MP, in my hoedanigheid as Minister van Waterwese enOmgewingsake hiermee in terme van afdeling 5(1) van die Nasionale Water Wet, 1998(Wet nr. 36 van 1998), nooi alle geskrewe kommentare oor die stigting van hierdiewaterbestuursgebiede, binne 90 dae van die goewermentskennisgewing uit. Dievasstelling van die waterbestuursgebied asook die bepaling van hul grenslyne soosingesluit in die skedule sal as 'n komponent van die Nasionale Waterhulpbronstrategiedien. Ingesluit is die ou waterbestuursgebiede (Tabel A.1) in vergelyking met diehuidige waterbestuursgebiede (Tabel A.2). Alle kommentare moet aan die DirekteurGeneral aangestuur word vir aandag die Hoof Direkteur: Institusionele Oorsig.

Dit volg diegrens totdat dit by die waterskeiding ontmoet tussenD71B and C92C. Die Waterbestuursgebied grensverleng langs hierdie waterskeiding tot by die grenswaar dit die Oranje Vaal Watergebruikers Verenigingontmoet. Dit verleng suid-oos on hierdie grens totdatdit by die waterskeiding tussen C92B en C51M waardit voig die waterskeiding en dat tussen C92B enC51L ontmoet. Daarna volg die waterskeiding tussenC51L en C91E. Dit voig hierdie waterskeiding totdatdit die plaas se grens van Wolwe Dam 87 bereik. Dit

The Accounting Standards Board (the Board) invites comment on two documents whichhave been issued by the International Public Sector Accounting Standards Board (IPSASB)for comment. These two documents have been issued locally by the Board as concurrentexposure drafts. The two exposure drafts on which the Board invites comment are:
ED 101 Consultation on IPSAS Work Program 2013-2014.
ED 102 Public Sector Combinations.
As the work of the IPSASB is used to inform the local standard-setting agenda and, theIPSASs are used as a basis when developing local pronouncements, it is critical that theBoard receives input on these two documents. All those affected by, or who are interested inany of these documents, are encouraged to provide a written response to the Board.Responses should be received by the Board by the 19th of October 2012 for ED 101 and12th October 2012 for ED 102.

1 INTERPRETATION AND DEFINITIONS
Definitions
1.2 In the Rules, unless the context otherwise requires or indicates: -
'Issuer' means an entity which issues Eligible Securities, including a Foreign Incorporated Company;

2.7 The Controlling Body must make, and may amend, Rules that comply with section 39 of the Act and must supervise
compliance with the Rules by Participants.
2.8 The Controlling_ Body must publish proposed Rules, any new Rule or amendment to the Rules and the date when
such new Rule or amendment shall become effective, in notices to all Participants and Issuers, where affected.
2.9 If Participants or Issuers wish to object or propose amendments to a proposed Rule, they must lodge an objection
or proposed amendment with the Controlling Body, accompanied by an explanation of the reasons for the objection or
proposed amendment, within 15 (fifteen) Business Days.
2.10 The Controlling Body shall consider all objections and proposed amendments received from Participants and
Issuers before submitting the proposed Rule for approval by the Registrar.
[2.8 The Controlling Body must notify the Participants, and Issuers, where affected, of any new Rule or amendment to
the Rules indicating when such new Rule or amendment shall become effective.]
[2.17] 2.20 The non-receipt of a notice under this Rule by a Participant or Issuer does not invalidate the Rule or Directive
concerned.
3.7.7 [If the application is rejected, the Controlling Body must within a reasonable time notify the applicant of the
rejection and provide the reasons for such rejection to the Applicant.] Where the Controlling Body has determined that
an application should be rejected, it must, within a reasonable time, provide notice of its intended decision, together
with the reasons for that decision, to the Applicant. The Applicant shall then have the right, within 5 (five) Business
Days, to state its case, in either written or oral form, to the Controlling Body as to why its application should not be
rejected. After considering any representations made, or in the absence of any representations being submitted within
the prescribed period, the Controlling Body shall make its final decision on the matter.
3.10.1 The Controlling Body may suspend or terminate the participation of a Participant in terms of the Act under the following
circumstances:

3.10.6 [The CSD must give reasons to the Participant for its termination] Where the Controlling Body has determined
that the participation of a Participant should be suspended or terminated, it shall first issue a notice of suspension,
together with the reasons for that decision, to the Participant. The notice of suspension shall be effective immediately
upon delivery to the Participant.
3.10.7 The Participant shall then have the right, within 5 (five) Business Days, to state its case, in either written or oral
form, to the Controlling Body as to why the suspension of its participation should be lifted, and, in addition, why its
participation should not be terminated. After considering any representations made, or in the absence of any
representations being submitted within the prescribed period, the Controlling Body shall make its final decision on the
continued suspension and/or termination of the participation of the Participant.
[3.10.7] 3.10.8 The CSD must give immediate notice of the suspension and / or termination to the Registrar and other
Participants, within the category of Participants in which the Participant has been suspended and I or terminated, and the
effective date of such suspension and I or termination.
6. ACCOUNTS OTHER THAN MONEY MARKET SECURITIES ACCOUNTS
Information in respect of accounts and the Uncertificated Securities Register
6.8.7 Participants must retain records of Securities Accounts for a minimum period of 7 (seven) years from the
date when such Securities Accounts ceased to have any Securities holdings.

7. MONEY MARKET SECURITIES OWNERSHIP REGISTER
7.3 MM Securities Accounts
7.3.13 Subject to 7.3.16.3, a Client may only operate its MM Securities Account through the Participant that opened the
MM Securities Account in the Securities Ownership Register on behalf of such client.
Appointment of a Secondary Participant
7.3.14 Where a MM Securities Account has been opened, a Client may appoint a Secondary Participant, that has
agreed to act as such and as stipulated by Directive. On assenting to act as a Secondary Participant, such
Participant must conclude a mandate with the Client containing the minimum provisions as stipulated in the
Rules and Directives, and confirm in writing to the CSD that it has assented to act as a Secondary
Participant and has concluded the required mandate.
7.3.15 Where a Secondary Participant has been appointed in accordance with Rule 7.3.14, such Secondary
Participant must open and administer a MM Securities Account in the event of an Insolvency Proceeding
against such Client's Primary Participant, in accordance with the Rules and Directives.
7.3.16 Where a Secondary Participant has been appointed in accordance with Rule 7.3.14:
7.3.16.1 the Participant that opened and is responsible for administering the MM Securities Account shall be
deemed to be the Primary Participant;
7.3.16.2 the Secondary Participant must administer the MM Securities Account in the event of an Insolvency
Proceeding against a Client's Primary Participant, in accordance with the Rules and Directives.
7.3.16.3 the Client may only operate its MM Securities Account through its Primary Participant. In the event of
an Insolvency Proceeding against the Client's Primary Participant, such Client may only operate its MM
Securities Account through the Secondary Participant appointed in accordance with Rule 7.3.14, and in
accordance with the Rules and Directives.
Movement of Securities from Primary Participant to Secondary Participant

7.3.17 Notwithstanding the provisions of Rule 7.3.16.3, in the event of an Insolvency Proceeding against a Client's
Primary Participant, the CSD must, upon instruction by the Secondary Participant, as stipulated by
Directive, move the unencumbered Securities held in a MM Securities Account administered by a Primary
Participant to a MM Securities Account administered by a Secondary Participant appointed in accordance
with Rule 7.3.14.
7.3.18 The movement of Securities held in the MM Securities Accounts from the Primary Participant to the
Secondary Participant, in accordance with 7.3.17, does not constitute a change in ownership, and transfers
no greater rights or lesser obligations to the account holder.
7.4 Information and Reporting in respect of MM Securities Accounts
7.4.1 Each Participant must maintain in respect of each Client and every MM Securities Account must have, the
following details:
7.4.1.1 Unique Client Code;
7.4.1.2 Client Identification Data, name and address of the Client;

12.1 If during the course of or after any investigation, the Head of Supervision is satisfied on the basis of the information in her
possession, that there are grounds for an allegation of improper conduct, she may refer the matter to the Regulatory Committee
[or directly to the Tribunal in terms of the Rule 12].
12.2 Where the Head of Supervision determines that a Participant or other person bound by the Rules has failed to comply with
the Rules or Directives she may give notice to the Participant or other person of her intention to impose a fine or take
such enforcement action as set out in the relevant Directive. [impose a fine or take any enforcement action, as set out
in the relevant Directive.] Any notice given by the Head of Supervision under this Rule must contain the reasons for her
decision, as well as a clear indication of the fine or other enforcement action that is contemplated.
12.3 A Participant or other person may, within 5 (five) Business Days after receipt of a notice issued under Rule 12.2,
make written or oral representations to the Head of Supervision in respect of the imposition of the fine or other
enforcement action contemplated in the notice.

[12.3] 12.4 After considering the representations of the Participant or other person, or in the absence of any
representations being submitted within 5 (five) Business Days, [Tithe Head of Supervision may impose the fine or take the
enforcement action as stipulated by the Directive, or decide not to impose such fine or take such action.
[12.4] 12.5 The Head of Supervision may direct that other Participants be notified of any action taken in terms of Rule [12.2]
12.4.
[12.5] 12.6 Within 5 (five) Business Days of a decision made by the Head of Supervision in terms of Rule 12.4, the
affected Participant or other person may appeal such decision to the Regulatory Committee. (Any person in respect of
whom the Head of Supervision has imposed a fine in terms of Rule 12.2 may demand, within a period of 3 (three)
Business Days after the imposition of such fine, that the matter be heard de novo by the Regulatory Committee.' If the
matter is appealed,[heard by the Regulatory Committee, publication and] notification of the decision of the Head of
Supervision to other Participants must be postponed until the matter has been finally determined [by the Regulatory
Committee].
Disciplinary Powers of the Regulatory Committee
[12.6] 12.7 The Regulatory Committee may deal with [a]any matter referred directly to it by the Head of Supervision in terms of
Rule 12.1, or any matter on appeal as [following a demand] contemplated by Rule [12.5]12.6.

[12.7] 12.8 In the case of matters referred to it under Rule 12.1:-
12.8.1 Where, after reviewing the evidence presented to it by the Head of Supervision, the Regulatory
Committee is of the opinion that [considers] an act of improper conduct appears on the face of it to have
been committed [by a Participant], it shall give notice to the relevant Participant or other person of its
intention to impose one or more of the penalties stipulated in the Act and the Rules. Any notice given
by the Regulatory Committee under this Rule must contain the reasons for its decision, as well as a
clear indication of the penalty that is contemplated.[it may impose any one or more of the penalties
stipulated in the Act and the Rules.]
12.8.2 The Participant or other affected person may, within 5 (five) Business Days after receipt of a notice
issued under Rule 12.8.1, make written or oral representations to the Regulatory Committee in
respect of the improper conduct and/or the imposition of the penalty contemplated in the notice. The
Regulatory Committee may also call upon the Participant or other affected person to provide any
relevant or additional information which it deems necessary.

[12.8 The Regulatory Committee may not impose any penalty on a person charged with improper conduct unless -
12.8.1 the allegation has been put to the person under investigation; and
12.8.2 such person has been given an opportunity of explaining (either orally or in writing) his or her conduct, after
being warned that any explanation may be used in evidence against him or her.]
12.8.3 After considering the representations of the Participant or other affected person, or in the absence of
any representations being submitted within 5 (five) Business Days, the Regulatory Committee may
make its final decision on the improper conduct andlor the imposition of a penalty. The decision of
the Regulatory Committee shall not be constrained by any previous decision that it has made.
12.8.4 The Regulatory Committee may direct that any action taken by it in terms of Rule 12.8.3 be published,
and to whom it will be published.
12.9 In the case of matters referred to it under Rule 12.6:-
12.9.1 the Regulatory Committee shall weigh the evidence presented by the Head of Supervision against the
representations of the Participant or other affected person submitted in terms of Rule 12.3, together
with any additional evidence or representations as it may call upon the Head of Supervision or the
Participant or other affected person to submit.
12.9.2 having considered the evidence, the Regulatory Committee shall make a decision on the matter. The
decision of the Regulatory Committee shall not be constrained by any previous decision of either the
Head of Supervision or of the Regulatory Committee itself.
12.9.3 notice of the decision, together with the reasons therefor, shall be given in writing to the Head of
Supervision and the Participant or other affected person.
12.9.4 The Regulatory Committee may direct that any action taken by it in terms of Rule 12.9.2 be published,
and to whom it will be published.
[12.9] 12.10 Within 15 (fifteen) Business Days of a decision made by the Regulatory Committee in terms of Rule 12.8.3
or 12.9.2, the Participant or other affected person may appeal such decision to the board of appeal established in terms
of section 26 of the FSB Act. [Any person in respect of whom the Regulatory Committee has imposed a penalty in terms
of Rule 12.7 may demand, within a period of 10 (ten) Business Days after the imposition of such penalty, that the matter
be heard de novo by the Tribunal, in which event publication and notification of the decision of the Regulatory
Committee must be postponed until the matter has been determined by the Tribunal.]If the matter is appealed,

[12.18] 12.11 When any person has been found guilty of improper conduct by the Regulatory Committee [or Tribunal] pursuant
to the Rules, the Regulatory Committee [or the Tribunal]:
[12.18.1] 12.11.1 may, by a simple majority, impose any one or more penalties stipulated in the Act, provided that the
Regulatory Committee [or the Tribunal] may suspend the imposition of the penalty for a period of time, as it deems fit;
[12.18.3 may, where the Participant or officer, employee of a Participant has been found guilty of improper
conduct, on such conditions as the Regulatory Committee or the Tribunal deems fit, order that particulars of
the offence and or finding of the Regulatory Committee or the Tribunal and or the penalty imposed to be
advised to Participants, and or published in the media or by other means, provided that if publication is
ordered, the respondent must be given an opportunity to make representations to the Regulatory Committee
or the Tribunal in this regard.]
[12.20] 12.13 Should a Participant or other person [, officer, employee or agent of a Participant] fail to pay any fine imposed
by the Head of Supervision[Jor the Regulatory Committee [or the Tribunal, or any fine imposed pursuant to an admission
of guilt,]within 20 (twenty) Business Days after being informed of the amount of the fine[, or after the signing of an admission
of guiltjthe Controlling Body may, after serving notice of not less than 5 (five) Business Days on such person:
[12.22] 12.15 The Controlling Body may charge interest on any overdue fine imposed on a Participant or other person under
the Rules at the prime lending rate offered by the CSD's principal bank.
[12.23 A Tribunal may, upon good cause shown and subject to such conditions as the Tribunal may impose, review any
penalty which it may have previously imposed on any person.]

The Health Professions Council of South Africa has, under section 61A of the Health
Professions Act, 1974 (Act No. 56 Of 1974), made the rules in the schedule.
SCHEDULE
Definitions
1. In these rules "the rules" means the rules relating to the registration by medical
practitioners and dentists of additional qualifications published as Board Notice 35 of
1999 under Government Gazette No: 19890 of 31 March 1999 as amended by Board
Notices. 46 of 2005 published under Government Gazette No: 27592 of 20 May 2005,
34 of 2006 published under Government Gazette No: 28779 of 05 May 2006, 22 of 2007
published under Government Gazette No: 29689 of 16 March 2007, 130 of 2010
published under Government Gazette No: 33540 of 17 September 2010, and 109 of
2011 published under Government Gazette No: 34362 of 17 June 2011, and any word
or expression to which a meaning has been assigned in the rules shall have that
meaning, unless the context otherwise indicates.
