All mine survey plans required to be provided to the regulator under this notice must be prepared inaccordance with clause 122 of the Regulation, the Surveying and Spatial Information Regulation2017, and the requirements of the Survey and Drafting Directions for Mining Surveyors 2020 (NSWMines).

Secretary of the Department of Regional NSW with delegated authority under sections 227

and 228 of the Fisheries Management Act 1994 (“the Act”) and pursuant to sections 8 and 11 of the Act give notice of the following fishing closure for recreational fishers.

This notification is the Fisheries Management (Recreational Fishing Crab Gear – Port

Stephens) Notification 2020.

2. Commencement and duration

This notification commences on the date of publication and will remain in force for five

(5) years).

3. Revocation

Pursuant to section 11 of the Act, Section 8 Notification – Fishing Closure Recreational Fishing Crab Gear in Port Stephens published in NSW Government Gazette No 66 of 7 August 2015 at page 2388 and any notification revived as a result of this revocation is revoked.

4. Definitions

In this notification:

hoop or lift net has the same meaning as in clause 30 of the Fisheries Management (General) Regulation 2019.

recreational crab trap has the same meaning as in clause 39 of the Fisheries Management (General) Regulation 2019.

recreational fisher means a fisher who takes fish by any method, otherwise than for sale.

the Act means the Fisheries Management Act 1994.

waters of Port Stephens means the whole of the waters of Port Stephens and its tributaries, from a line drawn between the southern extremity of Yacaaba Headland to

the northern extremity of Tomaree Headland up to the tidal limits of the tributaries,

including that part of the waters of the Myall River to the downstream side of the Myall

Street Bridge at the town of Hawks Nest, as shown on the Map in Schedule 1 to this

notification.

Part 2 Fishing closure 5. Fishing closure

Pursuant to section 8 of the Act, all recreational fishers are prohibited from using a

hoop or lift net or a recreational crab trap to take fish from the waters of Port Stephens,

unless:

(a) the hoop or lift net is used or set only between sunrise to sunset, (b) crabs are taken using the hoop or lift net only during the hours of sunrise to

sunset,

(c) when using the hoop or lift net, no part of the net is suspended above the hoop(s) after the net has been set,

(d) when using the recreational crab trap, all entrances to the trap do not exceed a maximum internal diameter of 320mm.

SUBORDINATE LEGISLATION ACT 1989Proposed Charitable Fundraising Regulation 2020

Notice is given in accordance with section 5 of the Subordinate Legislation Act 1989 of the intention to make theproposed Charitable Fundraising Regulation 2020, under the Charitable Fundraising Act 1991.The objects of the proposed Regulation are to:

• introduces requirements to assess applications for authorities;• introduces fit and proper test to minimise the risk of charitable funds being mismanaged;• establishes procedures for proposed suspension or cancellation of an authority;• prescribes traceability measures to identify payments of fundraising appeals;• introduces record-keeping requirements;• prescribes particulars that must be included as part of financial reporting, including annual return and

audit requirements;• clarifies the matters that must be contained written agreements between traders and authority holders;• outlines new notification requirements;• incorporates the current Charitable Fundraising Authority Conditions that are fit for purpose.

It is intended that the proposed Charitable Fundraising Regulation will replace the Charitable FundraisingRegulation 2015. The Charitable Fundraising Amendment Act 1991 and the proposed Regulation will commenceby proclamation on a date yet to be determined.

1 Authorisation

This order authorises a pharmacist to supply the corresponding listed form of metformin on the prescription of an authorised practitioner where the form of metformin prescribed is in short supply (Short Supply Medicine), as notified by the Therapeutic Goods Administration’s Serious Shortage Medicine Substitution Notice, Reference Number SSSN 20-02:

2 Conditions

a. The Short Supply Medicine remains on a current notice that is published

by the Therapeutic Goods Administration as a medicine that is in short supply and that may be substituted for the other form of the Short Supply Medicine.

b. The patient must present with a valid prescription for the medicine to be substituted for.

c. It is not practicable for the patient to obtain a prescription for the substitute form/s of the medicine from a prescriber before the patient needs the supply of the prescribed medicine

d. The patient or his/her agent or carer must consent to receiving the

medicine/s supplied pursuant to the notice.

e. The pharmacist must be satisfied that in his/her professional judgement, after taking all reasonable steps to obtain all relevant information including discussing the matter with the prescriber if possible, that the patient is suitable to receive the different form of the medicine under the notice, considering factors such as known previous hypersensitivity or severe adverse reaction to excipients.

f. The pharmacist must make a reasonable attempt to inform the prescriber

of the change to the prescribed medicine, if possible before supplying the medicine.

g. The total quantity of active drug supplied and the total number of days’

treatment supplied must be the same as those specified (explicitly or implicitly) in the prescription.

h. The pharmacist must label the medicine/s with directions for the same daily dosage of active drug (totalled where two forms are supplied) that was specified in the prescription.

i. The pharmacist must record full details of the supply in the pharmacy’s

dispensing record system, including the medicine form prescribed and the medicine form/s which was/were supplied in its place.

j. The pharmacist must annotate the prescription with details of the form/s of

the medicine supplied. k. The medicine form/s supplied must be currently registered on the

Australian Register of Therapeutic Goods and as supplied by the licensed manufacturer/sponsor. However in order to comply with condition (g), the pharmacist may break or combine ARTG pack/s to make a quantity of tablets of the medicine which differs from the pack size/s specified in the Register.

3 Duration

This authority commences on the day it is signed and dated, and expires on the date that the prescribed medicine ceases to be on a current Serious Shortage Medicine Substitution Notice that is published by the Therapeutic Goods Administration as a medicine that is in short supply and that may be substituted for the other form of the Short Supply Medicine; or otherwise on a date that this authority is revoked.
