Garner Police Department
Memorandum
To: Hardin Watkins, Town ManagerMembers of Town Council
From: Eric L. Copeland, Deputy ChiefCC: Brandon V. Zuidema, Chief of Police
Todd Marr, SergeantBrian McLean, K-9 OfficerJudy Bass, Town Clerk
Date: January 10, 2011
Re: Disposal of Police Canine
This memorandum is a request to have one of the Departments Police K9sdesignated as disposable property by the Town Council.
Tosca, a nine (9) year old Belgian Malinois, is currently assigned to Officer BrianMcLean. Tosca was originally purchased with asset forfeiture funds inSeptember 2003. Officer McLean has served the department well as a K9Officer since June 2005 and is the second handler to serve with Tosca.
In speaking to Sergeant Todd Marr, the Canine Program Coordinator, Tosca is atthe end of her useful purpose as a Police K-9 and recommends that she beretired. Given her age and physical condition, Tosca could not be assigned toanother handler for retraining.
Officer McLean has agreed to provide a retirement home for Tosca at no furtherexpense to the Town of Garner. It is my recommendation that Tosca be:
1. designated as disposal property,2. her value be assigned at $1 and
3. her ownership be transferred to Officer Brian McLean for her assignedvalue.
I am requesting that this item be placed on the January 18, 2011 Council meetingagenda. Should Council approve this request, Chief Zuidema would like to honorTosca and Officer McLean for their service at the February 7, 2011 Councilmeeting.
Please let me know if you have any questions.

Perimeter buffers are not required between propertiesdeveloped or zoned for single family homes.

extension to properties to the north and south as theydevelop.
Sewer was previously allocated, in 2005, for thissubdivision from the Type II category, homes with aminimum of 2100 square feet.
Street Access/ Sidewalks: One point of access for this subdivision is proposed offCreech Road. Again, the design will allow interior roadconnections as properties to the north and south develop.Creech Road will be widened on both sides toaccommodate a left turn lane into the site. The roadimprovements were previously reviewed and approvedby NCDOT at which time it was determined that wideningon both sides of the road is preferred to avoid thepotential of a sight distance problem should the widening
occur on only one side. The plans have beenresubmitted to NCDOT; we understand there has beenverbal approval and are awaiting written confirmation.
Curb and gutter construction with sidewalk will beprovided along the Creech Road frontage. Sidewalks areproposed along one side of the local streets (55 b/b) andboth sides of connector streets (60 b/b) within thesubdivision.
General Comments:
This subdivision was approved by the Town in 2005; however, the permit expired. The owner isstill interested in developing the property and has resubmitted the plans for approval.
Storm-water management Inverness Subdivision is subject to nitrogen rules only. The projectslightly exceeds the 6.0 pound/acre/year threshold so a water quality BMP is required for a portionof the site. The project will utilize an extended detention pond in order to control both the 1 yearstorm peak flow and to reduce the nitrogen export below the 6.0 pounds/acre/year threshold. Theproject will pay a fee-in-lieu to the North Carolina Ecosystem Enhancement Program in order toreduce the nitrogen export down to the required limit of 3.6 pounds/acre/year. Other than the 1year storm for nitrogen purposes, no storm-water quantity BMPs are required.
The Engineering Department has been requesting a detail of the proposed level spreader toinsure the design meets current standards. The detail shown does not provide enoughinformation to determine if it can be accommodated where proposed; communication continuesbetween engineers for a resolution prior to the public hearing.

MEMORANDUM
To: Hardin Watkins, Town Manager
From: Judy Bass, Town Clerk
Date: January 13, 2011
Subject: Board of Elections
The Board of Elections is beginning preparations for the 2011
Municipal Election. They have contacted the various governmentagencies regarding the candidate filing fee and Early Voting
sites.
The Towns current fee for candidate filing is $10.00, which has
not changed for many years. Attached to this memo, you will find
a list of filing fees for Wake County towns which was compiled by
the Board of Elections. If the Council chooses, this fee may be
modified.
During Municipal Elections, the Board of Elections will provide
Early Voting at their office on Salisbury Street in downtown
Raleigh. If the Council wishes to provide an early votinglocation in the town, the municipality must provide funding for
the site. Should the Council choose to offer an early voting
location, you will need to determine the number of days and the
hours that voting is held. In the 2009 municipal election, the
Council chose to provide early voting at Pearl Street the last
week before Election Day from 3:00 P.M. to 7:00 P.M. The cost
for five days from 3:00 P.M. to 7:00 P.M. is $7,450 and five days
from 11:00 A.M. to 7:00 P.M. is $8,093.50.
I will ask the Council to: 1) decide to keep or modify the
candidate filing fee and 2) decide whether or not to provide
early voting and if so, the hours of voting.
Let me know if you have any questions.

Attached is the Statement of Revenues and Expenditures for the period July1, 2010 throughDecember 31, 2010.
Ad valorem tax revenues are $996,000 less than last year. This appears to be a timingdifference. Tax collections for the first week of January exceed collections for the same periodlast year. Current year tax collections after the first week in January were 91.25% of taxes billedcompared to 90.93% last year.
The report indicates several departments where year to date expenditures exceeded 50% oftheir annual budget. I have included an analysis, by division, of expenses that explain theoverages. The items identified as of November 30 continue to cause expenditures to exceed theexpected amounts. The items include:
1. Major one time expenditures. These include equipment, insurance premiums andcontracts
2. Additional salaries including benefit payout in the inspection department for employeesincluded in the Reduction in Force policy
3. Contracts from the prior year. Additional monies will be budgeted for these amounts. If you have questions please let me know.
