    further investigation will be referred to the appropriate Town

    officials or staff and may be scheduled for a future agenda.

    December 21, 2010 in the Town Council Meeting Room

    CALL MEETING TO ORDER

    PRESENTATIONS: Recognition of Arnold Aiken, Garners First Town Manager

    Mayor Williams presented a proclamation which was read by Council Member

    Kennedy recognizing Arnold Aiken who was the first Town Manager hired in

    1962 when the charter was amended to establish the manager council form of

    government. Mr. Aiken said he was the sixteenth employee hired in the

    Town. The Town limits were from Aversboro to Lakeside Drive on one side

    and from Forest Hills to School Acres. The population was 3600. This

    brought on a lot of changes and there was a lot; being the first manager

    had its problems.

    The only traffic signal was at the intersection of Main and Perdue Streets

    and a caution light was at Aversboro and Forest Drives. The first project

    Mr. Aiken embarked on was to change the street light system from a 2000

    lumen bulb to 6000 mercury vapor. Mr. Aiken said he implemented the first

    personnel classification and pay plan and a retirement plan. The Council

    adopted the first planning and zoning ordinance and authorizedinstallation of a sewer system and passed a bond referendum for a new

    water system. Mr. Aiken said he made his home here and intends to stay.

    PETITIONS AND COMMENTS

    Phil Matthews, Vice President of the Wake County Commissioners and a

    former Town Council Member said it is an honor to be back representing the

    Garner citizens and extended greetings on behalf of the Wake County

    Commissioners. Commissioner Matthews plans to visit each municipality inWake County and beginning in his home town. He said he is excited about

    working with the Town and plans to be involved. Through Town invitations

    and the Retreat, he feels we can work hand in hand to make things happen.

    approval.

    Action: Tax Releases Approved

    Request to hold Public Hearing Inverness Subdivision (SUP-SB-10-01)

    Inverness Subdivision, a 19.8 acre tract of land to be located on the west

    side of Creech Road north of Creech Road Elementary School was approved in

    August 2005. A new owner purchased the property in 2007 and subsequently

    was granted all construction plan approvals after the special use permit

    had expired. The Town Attorney has concluded that the best course of

    action would be for the project to go back through the special use permit

    review process including a public hearing and notice to adjacent property

    owners. In light of these circumstances, the project engineer hasrequested an accelerated review process that would set a public hearing

    date for January 18, 2011.

    OLD/NEW BUSINESS

    UDO Text Amendment UDO-10-04 Regarding Procedures for ReasonableAccommodation

    Presenter: Brad Bass, Planning Director

    This amendment to the Unified Development Ordinance (UDO) proposes changes

    to Section 3.17 regarding Special Exceptions.

    Mr. Bass reported that the Town Council conducted a public hearing on

    December 6, 2010 to review a text amendment to the Unified Development

    Ordinance (UDO) regarding the above noted matter. After conducting

    the hearing it was referred to the Planning Commission for its review

    and recommendation. The Commission reviewed the text amendment attheir December 13

    meeting and recommended approval as submitted.

    The proposed amendment would establish procedures for individuals

    seeking a reasonable accommodation from the Town that is consistent

    with the Federal Fair Housing Act. The Federal Fair Housing Act

    Mr. Bass presented a summary of the proposed amendment as follows:

    1. Creates a new section entitled 3.17 Special Exceptions; and2. Authorizes the Board of Adjustment to review requests for special

    accommodation and grant a special exception from UDO requirementsprimarily as it relates to disabled or handicapped homes; and

    3. Requires a formal application to be filed which follows the same proceduresthat are used for variances (quasi-judicial public hearing, notice toadjacent property owners, sign posted on property, legal advertisement ofthe hearing, etc.); and

    4. Establishes the following approval criteria the Board of Adjustment mustuse in order to grant a special exception:

    (a) "Reasonable. An accommodation will be determined to be

    reasonable if it would not undermine the legitimate purposes and

    effects of existing zoning regulations and the benefits that the

    accommodation would provide to the handicapped, and if it will not

    impose significant financial and administrative burdens upon the

    Town and/or constitute a substantial or fundamental alteration of

    the Town's ordinance provisions); and

    (b) "Necessary." An accommodation will be determined to benecessary if it would provide direct or meaningful therapeutic

    amelioration of the affects of the particular disability or

    handicap), and would afford handicapped or disabled persons equal

    opportunity to enjoy and use housing in residential districts in the

    Town.

    Mr. Bass said a copy of the ordinance amending the Unified Development

    Ordinance is enclosed for the Town Councils review and adoption

    consideration. There were no public comments made at the public

    hearing or at the Planning Commission meeting regarding the amendment.

    The Planning Commission, the Town Attorney and staff believe the text

    amendment is necessary in order to be consistent with the Federal Fair

    Housing Act, therefore we recommend approval of the request as

    submitted.

    Mayor Pro Tem Behringer said that she hopes now measures are in place

    so that other facilities will have to go through this process.

    COUNCIL REPORTS

    Council Member Marshburn

    He commended the Town Manager and those responsible forsetting up the employee recognition awards.

    He said he will be attending the N.C. League of MunicipalitiesAdvocacy Goals Conference.

    He said the Christmas events were pleasurable; this has been agood year for entertainment.

    Mayor Pro Tem Behringer

    She reported attending the Garner Revitalization Retreat withpeople from the Main Street organization. The scope for next

    year was presented; it is very impressive and if everything

    gets done, we will all notice.

    She said all of the Christmas events were well attended. Sheasked everyone to go downtown to see the elf.

    Council Member Johns

    He raised an issue previously reported regarding dogs onGriffin Street. He has received calls that there are more

    dogs than reported and people are afraid to walk outside.

    Council Member Singleton

    He noted that he has heard no complaints regarding the leafpick-up this year. Mr. Dickerson said there are no complaints

    regarding leaf pick-up in the monthly Solid Waste Report

    Council Member Kennedy

    He has received complaints regarding the odor from the pumpstation at White Deer Park. He asked staff to contact the

    City of Raleigh to see if they can give some serious attention

    and consideration to trying to resolve the problem. He saidthey really need to see if there is something that can be

    done.

    He noted people have commented on the movement of TimberDrive. He asked if Council can get a tour to see how they are

    progressing.

    He said a number of good things have happened in Town thisyear thanks to lots of extra staff effort.

    Closed session pursuant to N.C.G.S. 143-318 (11) (a) (3) to confer withcounsel regarding matters in litigation, specifically USA and OxfordHouse, Inc. v. Town of Garner and Garner Board of Adjustment, pending inthe US District Court, EDNC, case # 5:09-CV-00216.

    Mr. Watkins said he would like to update the Council on the matterof an offer from the Kelly family to the Town to purchases propertyon Garner Road near the Historic Auditorium. He said the paper workwas complete to move forward with the purchase.

    A motion by Council Member Singleton to add this item to the

    Councils agenda was seconded by Council Member Marshburn and votedon unanimously.

    Action: Authorize Manager to Purchase of Two Parcels of LandLocated on Garner Road for the amount of $200,000. Thecurrent tenant will be allowed to stay on the propertyfor 90 days

    SUBJECT: UDO Text Amendment Regarding Hair Salons/BarberShops/Beauty Shops as Permissible Uses in the Office &Institutional Zoning District

    Background

    Staff briefed the Town Council on this matter at the January 25th work session.Over the last several months we have received inquiries regarding the possibilityof allowing hair salons/barber shops/beauty shops as a permissible use in the O&Izoning district. In 2006 the Town Council approved a UDO text amendment toallow these types of uses in the Neighborhood Office District subject to theissuance of a Special Use Permit (public hearing before Council). The 2006amendment did not specifically address whether the use should also be allowed

    in the more intense O&I zoning district. Currently in addition to theNeighborhood Office District the above noted uses are permitted inNeighborhood Commercial (NC), Central Business District (CBD), CommunityRetail (CR), Service Business (SB), and the Industrial Districts (I-1 and I-2), butnot in the O&I District.

    Findings

    The following is an excerpt from the UDO regarding the purpose and intent ofthe Office and Institutional (O&I) District.

    In evaluating any proposed amendment to the UDO the following should beconsidered:

    1. The extent to which the proposed text amendment is consistent withthe remainder of the UDO, including, specifically, any purpose andintent statements.

    2. The extent to which the proposed text amendment represents a newidea not considered in the existing UDO, or represents a revisionnecessitated by changing circumstances over time.

    3. Whether or not the proposed text amendment corrects an error in theUDO.

    4. Whether or not the proposed text amendment revises the UDO tocomply with state or federal statutes or case law.

    5. In deciding whether to adopt a proposed amendment to the UDO, thecentral issue is whether the proposed amendment advances the publichealth, safety or welfare and is consistent with the Towns

    Comprehensive Plan and the specific intent of the UDO.

    Staff recommends Council set a public hearing for March 7, 2011 to formallyconsider a UDO text amendment to allow hair salons/barber shops/beautyshops as permissible uses in the Office & Institutional zoning district

    General Fund investments have increased by $2,162,498 since November 30, 2010.General Fund Investments increased $2,524,574 during the same period last year. Totalinvestments for all funds increased $2,163,395 in December.

    North State Bank requested we close our account. These funds were transferred to TheNorth Carolina Capital Management Trust in December.

    Interest rates at the North Carolina Capital Management Trust were .14% for Decemberwhich represents a .01% increase from November. Interest rates for the past year are indicated inthe following chart:
