    Be it enacted by the Senate and House of Representatives of thePhilippines in Congress assembled::

    Ch/pter !'ener/l Provisions

    Article #ne0/sic Air 1u/lit Policies

    +ection !. +hort "itle.- This ct shall be !no"n athe Philippine Cle/n Air Act of !999.

    +ection 2. &ecl/r/tion of Principles.- The State shall protect an

    advance the right of the people to a balanced and healthful ecology iaccord "ith the rhythm and harmony of nature#

    The State shall promote and protect the global environment to attaisustainable development "hile recogni$ing the primary responsibilitof local government units to deal "ith environmental problems#

    The State recogni$es that the responsibility of cleaning the habita

    and environment is primarily area-based#The State also recogni$es the principle that %polluters must pay%#

    &inally' the State recogni$es that a clean and healthy environment for the good of all and should' therefore' be the concern of all#

    +ection 3. &ecl/r/tion of Policies.- The State shall pursue policy of balancing development and environmental protection# T

    achieve this end' the frame "or! for sustainable development shall bpursued# (t shall be the policy of the State to:

    )a* &ormulate a holistic national program of air pollutiomanagement that shall be implemented by the governmenthrough proper delegation and effective coordination of function

    and activities+)b* ,ncourage cooperation and self-regulation among citi$ens anindustries through the application of mar!et-based instruments+

    )c* &ocus primarily on pollution prevention rather than on controand provide for a comprehensive management program for apollution+

    )d* Promote public information and education and to encouragthe participation of an informed and active public in air ualitplanning and monitoring+ and

    )e* &ormulate and enforce a system of accountability for shoand long-term adverse environmental impact of a pro.ecprogram or activity# This shall include the setting up of a fundinor guarantee mechanism for clean-up and environmenta

    rehabilitation and compensation for personal damages#+ection 4. Recognition of Rights.- Pursuant to the abovedeclared principles' the follo"ing rights of citi$ens are hereby soughto be recogni$ed and the State shall see! to guarantee theen.oyment:

    )b* The right to utili$e and en.oy all natural resources accordinto the principles of sustainable development+

    )g* The right to bring action in court or uasi-.udicial bodies ten.oin all activities in violation of environmental la"s anregulations' to compel the rehabilitation and cleanup of affectearea' and to see! the imposition of penal sanctions againsviolators of environmental la"s+ and

    )h* The right to bring action in court for compensation opersonal damages resulting from the adverse environmental anpublic health impact of a pro.ect or activity#

    &efinition of "er5s+ection 6. &efinitions. s used in this ct:

    a* %ir pollutant% means any matter found in the atmospherother than o/ygen' nitrogen' "ater vapor' carbon dio/ide' anthe inert gases in their natural or normal concentrations' that detrimental to health or the environment' "hich includes but no

    limited to smo!e' dust' soot' cinders' fly ash' solid particles oany !ind' gases' fumes' chemical mists' steam and radio-activsubstances+

    b* %ir pollution% means any alteration of the physical' chemicaand biological properties of the atmospheric air' or any dischargthereto of any liuid' gaseous or solid substances that "ill or li!ely to create or to render the air resources of the countr

    harmful' detrimental' or in.urious to public health' safety o"elfare or "hich "ill adversely affect their utili$ation fodomestic' commercial' industrial' agricultural' recreational' oother legitimate purposes+

    c* %mbient air uality guideline values% mean the concentratio

    of air over specified periods classified as short-term and longterm "hich are intended to serve as goals or ob.ectives for thprotection of health and0or public "elfare# These values shall bused for air uality management purposes such as determinintime trends' evaluating stages of deterioration or enhancement othe air uality' and in general' used as basis for ta!ing positivaction in preventing' controlling' or abating air pollution+

    d* %mbient air uality% means the general amount of pollutiopresent in a broad area+ and refers to the atmosphere1s averagpurity as distinguished from discharge measurements ta!en athe source of pollution+

    e* %Certificate of Conformity% means a certificate issued by th2epartment of ,nvironment and 3atural Resources to a vehiclmanufacturer0assembler or importer certifying that a particulane" vehicle or vehicle type meets the reuirements provideunder this ct and its rules and regulations+

    f* %2epartment% means the 2epartment of ,nvironment an3atural Resources+

    g* %,co-profile% means the geographic-based instrument foplanners and decision-ma!ers "hich present an evaluation of th

    environmental uality and carrying capacity of an area# (t is thresult of the integration of primary and secondary data aninformation on natural resources and anthropogenic activities othe land "hich are evaluated by various environmental risassessment and forecasting methodologies that enable th2epartment to anticipate the type of development contronecessary in the planning area+

    l* %Medical "aste% means the materials generated as a result opatient diagnosis' treatment' or immuni$ation of human beings oanimals+

    m* %Mobile source% means any vehicle propelled by or througcombustion of carbon-based or other fuel' constructed anoperated principally for the conveyance of persons or thtransportation of property goods+

    n* %Motor vehicle% means any vehicle propelled by a gasoline odiesel engine or by any means other than human or animapo"er' constructed and operated principally for the conveyancof persons or the transportation of property or goods in a publhigh"ay or street open to public use+

    o* %Municipal "aste% means the "aste materials generated from

    communities "ithin a specific locality+

    rating of the anti-!noc! characteristics of a grade or type oautomotive gasoline as determined by dividing by t"o )6* thsum of the Research 7ctane 3umber )R73*' plus the Moto7ctane 3umber )M73*+ the octane reuirement' "ith respect tautomotive gasoline for use in a motor vehicle or a class thereo"hether imported' manufactured' or assembled by manufacturer' shall refer to the minimum octane rating of suc

    automotive gasoline "hich such manufacturer recommends fothe efficient operation of such motor vehicle' or a substantiaportion of such class' "ithout !noc!ing+

    r* %7$one 2epleting Substances)72S*% means those substancethat significantly deplete or other"ise modify the o$one layer in manner that is li!ely to result in adverse effects of human healtand the environment such as' but not limited to

    s* %Persistent 7rganic Pollutants)P7Ps*% means the organcompounds that persist in the environment' bioaccumulatthrough the food "eb' and pose a ris! of causing adverse effectto human health and the environment# These compounds resisphotolytic' chemical and biological degradation' "hich shainclude but not be limited to dio/in' furan' PolychlorinateBiphenyls )PCBs*' organochlorine pesticides' such as aldrindieldrin' 22T' he/achloroben$ene' lindane' to/aphere anchlordane+

    "* %Standard of performance% means a standard for emissions oair pollutant "hich reflects the degree of emission limitatioachievable through the application of the best system of emissioreduction' ta!ing into account the cost of achieving sucreduction and any non-air uality health and environmentaimpact and energy reuirement "hich the 2epartmendetermines' and adeuately demonstrates+ and

    a* ,/tent of pollution in the country' per type of pollutant and petype of source' based on reports of the 2epartment

    e* 7ther pertinent ualitative and uantitative informatioconcerning the e/tent of air pollution and the air ualitperformance rating of industries in the country#

    The 2epartment' in cooperation "ith the 3ational StatisticaCoordination Board )3SCB*' shall design and develop an informatio

    net"or! for data storage' retrieval and e/change#The 2epartment shall serve as the central depository of all data aninformation related to air uality#

    +ection 7. %ntegr/te Air 1u/lit2 %5prove5ent (r/5e4or:.The 2epartment shall "ithin si/ )=* months after the effectivity of thct' establish' "ith the participation of >4?s' 347s' P7s' thacademe and other concerned entities from the private sectoformulate and implement the (ntegrated ir uality (mprovemen&rame"or! for a comprehensive air pollution management ancontrol program# The frame"or! shall' among others' prescribe themission reduction goals using permissible standards' controstrategies and control measures to underta!en "ithin a specified timperiod' including cost-effective use of economic incentivesmanagement strategies' collective actions' and environmenta

    education and information#

    b* Provide for the establishment and operation of appropriatdevices' methods' systems and procedures necessary to monitocompile and analy$e data on ambient air uality+

    c* (nclude a program to provide for the follo"ing: )5enforcement of the measures described in subparagraph @aA+ )6regulation of the modification and construction of any stationarsource "ithin the areas covered by the plan' in accordance "itland use policy to ensure that ambient air uality standards arachieved+

    d* Contain adeuate provisions' consistent "ith the provisions othis ct' prohibiting any source or other types of emission

    activity "ithin the country from emitting any air pollutant iamounts "hich "ill significantly contribute to the non-attainmenor "ill interfere "ith the maintenance by the 2epartment of ansuch ambient air uality standard reuired to be included in thimplementation plan to prevent significant deterioration of auality or to protect visibility+

    e* (nclude control strategies and control measures to b

    underta!en "ithin a specified time period' including cost effectivuse of economic incentives' management strategies' collectioaction and environmental education and information+

    g* ll other measures necessary for the effective control anabatement of air pollution#

    The adoption of the plan shall clarify the legal effects on the financiamanpo"er and budgetary resources of the affected governmenagencies' and on the alignment of their programs "ith the plans#

    (n addition to direct regulations' the plan shall be characteri$ed by participatory approach to the pollution problem# The involvement o

    private entities in the monitoring and testing of emissions from mobiland0or stationary sources shall be considered#

    To effectively carry out the formulated action plans' a 4overninBoard is hereby created' hereinafter referred to as the Board#

    The Board shall be headed by the Secretary of the 2epartment o,nvironment and 3atural Resources as chairman# The members shabe as follo"s:

    a* Provincial 4overnors from areas belonging to the airshed+

    b* City0Municipal Mayors from areas belonging to the airshed+

    c* representative from each concerned government agency+

    d* Representatives from people

    The 2epartment shall base such ambient air uality standards o

    9orld Health 7rgani$ation )9H7* standards' but shall not be limiteto nor be less stringent than such standards#

    +ection !3. E5ission Ch/rge +2ste5.- The 2epartment' in casof industrial dischargers' and the 2epartment of Transportation anCommunication )27TC*' in case of motor vehicle dischargers' shalbased on environmental techniues' design' impose on and collecregular emission fees from said dischargers as part of the emissio

    retrofit their e/isting facilities "ith mechanisms that reduce pollutioshall be entitled to ta/ incentives such as but not limited total creditand0or accelerated depreciation deductions#

    +ection !4.Air 1u/lit2 )/n/ge5ent (un.- n ir ualitManagement &und to be administered by the 2epartment as a speciaaccount in the 3ational Treasury is hereby established to financcontainment' removal' and clean-up operations of the 4overnment i

    air pollution cases' guarantee restoration of ecosystems anrehabilitate areas affected by the acts of violators of this ct' tsupport research' enforcement and monitoring activities ancapabilities of the relevant agencies' as "ell as to provide technicaassistance to the relevant agencies# Such fund may li!e"ise ballocated per airshed for the underta!ings herein stated#

    The &und shall be sourced from the fines imposed and damage

    a"arded to the Republic of the Philippines by the Pollutiod.udication Board )PB*' proceeds of licenses and permits issued bthe 2epartment under this ct' emission fees and from donationsendo"ments and grants in the forms of contributions# Contributionto the &und shall be e/empted from donor ta/es and all other ta/escharges or fees imposed by the 4overnment#

    +ection !6.Air Pollution Rese/rch /n &evelop5enProgr/5.- The 2epartment' in coordination "ith the 2epartment oScience and Technology )27ST*' other agencies' the private sectothe academe' 347

    Such a research and development program shall develop air ualitguideline values and standards in addition to internationally-acceptestandards# (t shall also consider the socio-cultural' political aneconomic implications of air uality management and pollutiocontrol#

    Article "oAir Pollution Cle/r/nces /n Per5its for +t/tion/r +ources

    +ection !. Per5its.- Consistent "ith the provisions of this cthe 2epartment shall have the authority to issue permits as it madetermine necessary for the prevention and abatement of apollution#

    Said permits shall cover emission limitations for the regulated apollutants to help attain and maintain the ambient air ualitstandards# These permits shall serve as management tools for th>4?s in the development of their action plan#

    +ection !7. E5ission 1uot/s.- The 2epartment may allo" eacregional industrial center that is designated as special airshed tallocate emission uotas to pollution sources "ithin its .urisdictio

    that ualify under an environmental impact assessment systemprogrammatic compliance program pursuant to the implementinrules and regulations of Presidential 2ecree 3o# 5=#
