November 25th, 2010 Nickelsville moves in to Fire Station 39 for Winter Shelter Weaver Architects submit application to do seismic upgrades. No evidence of work having been done. No final inspection by DPD. March 31st, 2011 Nickelsville moves out of Fire Station 39 April 8th, 2011 Date permit # 6267102 was issued June 1st, 2011 Fire Department cut off date for occupancy until sprinklers and fire alarm system installed. July 21st, 2011 Date permit # 6267102 expired November 18th, 2010 Application by Chris Potter Project # 6267102 Temporary occupancy of former Fire Station #39 for indigent housing for 6 months, per plans November 8th, 2010 Memo from Fire Marshall regarding temporary occupancy. - Conditional use granted for ONLY one 6 month temp use. - No further occupancy allowed after June 1st, 2011 - Installation of automatic sprinklers and fire alarm system throughout building required for any “continuous, extended, or repeated shelter or residential use.” November 25th, 2011 UGM moves in to Fire Station 39 for Winter Shelter March 31st, 2012 UGM Winter Shelter stops operation at FS39. UGM equipment left there in storage. July 23rd, 2012 City Council passes Ordinance # 123939. This changed the Seattle Municipal Code regarding temporary occupancy of non conforming buildings. Previous to this date, the language indicated that a non conforming buildingcould be used only one time for a maxiumum period of 6 months and that this was a Type II Land Use decision that could be appealed. It now says that a temporary occupancy permit can be granted for 18 months with no limit to renewals. It also states that after an initial Type II decision is made and not appealed for a temporary occupancy, all subsequent decisions to issue temporary occupancy permits are Type I. Type I permits do not allow appeals. October 3rd, 2012 Thomas Whittamore from DON announces at the North District Council meeting that there will not be a Winter Shelter this year at the old Fire Station 39. Richard Gholagong from FAS confirms this by phone to a LC Chamber representative on October 4th. November 3rd, 2011 Application by Chris Potter Project # 6299158 Temporary use and occupancyfor 4 weeks for night-time homeless shelter and daytime services for the homeless, per plans January 6th, 2012 Application by Chris Potter Project # 6303315 Temporary use and occupancy for 6 months for night-time homeless shelter and daytime services for the homeless, per plans January 11th, 2012 Date permit # 6303315 was issued. Note that this permit was originally issued as a six month permit, but was retroactively made into an 18 month permit after the July 21st, 2012 council decision. July 11th, 2013 Date permit # 6303315 expires A - The entire first 6 month shelter period occurred with NO approved permit. This permit was under the old rules and was a Type II appealable land use decision. The seismic and life safety upgrades were not required for this period by SPD or DPD. C - The requirements to install an automatic sprinkler system and a fire alarm system had not been completed prior to UGM occupying the building. In the last few weeks of March,2012 - prior to the end of the shelter stay - electricians installed a fire control panel and wired the building for an alarm system. This is contrary to the DPD permit site’s passed final inspection on November 23rd, 2011. B - The second 6 month period started with a four week temp permit, apparently to get around the fact that another 6 month temp permit was not allowed. There is a 25 day period after the 4 week permit in which they were again occupying the building with no occupancy permit. A second 6 month temp permit is issued even though it is not allowed. The required upgrades for conforming occupancy have still not been completed at this time.
